5.3. Talba għat-tneħħija tal-immunità parlamentari ta' Viktor Uspaskich (A8-0149/2015 - Laura Ferrara) (votazzjoni)

– Before the vote:

  Guy Verhofstadt (ALDE). – Madam President, first of all my apologies to all colleagues that I have to intervene in the case of this request for the waiver of parliamentary immunity of Mr Uzpaskich, but Mr Uzpaskich has sent a letter to President Schulz and I want to speak in support of referral back to the Legal Affairs Committee.

The reason, very briefly, is the following: in the Legal Affairs Committee they got two sentences of something that Mr Uzpaskich said about justice in his country; but the recording contains far more than that. Those two sentences have been taken out of context, because in what he said he makes reference to what the President of Lithuania had said about the justice system in the country.

So my only plea to the plenary is to refer the matter back to the Legal Affairs Committee so that the Legal Affairs Committee can listen to the whole recording and not only to the two sentences that were sent by the Lithuanian authorities; that is my request.

  Richard Sulík (ECR). – My budeme v prípade pána Uspaskiča hlasovať o jeho imunite – ide len o výroky. Ja si myslím, že toto je mimoriadne dôležitá vec. Poslanec Európskeho parlamentu nesmie byť trestaný za žiadne výroky. Na to je imunita.

  Laura Ferrara, relatrice. – Signor Presidente, onorevoli colleghi, in qualità di relatrice di questa relazione tengo a sottolineare che abbiamo esaminato in maniera approfondita la questione in sede di commissione giuridica.

Si tratta di una condotta che è dall'attività parlamentare legata al ruolo di deputato al Parlamento europeo dell'onorevole Uspaskich.

Si tratta di vilipendio al potere giudiziario del Parlamento, per cui non è stato ritenuto opportuno mantenere in capo all'onorevole Uspaskich l'immunità parlamentare perché la condotta non era né correlata al suo mandato, né erano ravvisabili degli elementi tali da sostenere il fumus persecutionis.
