  El Presidente. – El punto siguiente en el orden del día es el debate sobre:

- la pregunta con solicitud de respuesta oral a la Comisión sobre el Informe anual 2014 del Comité de Vigilancia de la OLAF, de Petri Sarvamaa, en nombre del Partido Popular Europeo (Demócrata-Cristianos), y de Bart Staes, en nombre del Grupo de los Verdes/Alianza Libre Europea (O-000060/2015 – B8-0553/2015),

  Bart Staes, Auteur. Laat mij eerst wat positief nieuws brengen. Binnen OLAF werken vele honderden mensen keihard en goed en ze maken van hun werk een strijd tegen fraude, tegen corruptie en tegen illegale praktijken die de belastingbetaler veel geld kosten. Maar het activiteitenverslag van het toezichthoudend comité veegt de vloer aan met sommige praktijken binnen OLAF en met de concrete werking van de directeur-generaal van OLAF.

Enkele voorbeelden:

1) er worden onderzoeken geopend zonder dat er een voldoende ernstige verdenking bestaat over fraude en corruptie, terwijl dit wel wettelijk nodig is;

2) de directeur-generaal van OLAF neemt de aanbevelingen van het toezichthoudend comité niet ernstig;

3) het toezichthoudend comité wordt belemmerd in zijn werkzaamheden en krijgt geen of onvoldoende toegang tot documenten en info;

4) er bestaat geen wettelijke basis voor het opnemen van privételefoongesprekken en toch is dit gebeurd in een belangrijk onderzoek;

5) statistieken over de duur van onderzoeken worden gemanipuleerd om de onderzoeken sneller te doen verlopen of althans dat zo te laten lijken;

6) het secretariaat van het toezichthoudend comité staat onder enorme, soms persoonlijke druk want het valt onder het administratief toezicht van de directeur-generaal van OLAF, de gecontroleerde heeft dus macht over de controleur.

Het toezichthoudend comité bestaat uit vijf leden. Die werken collectief en die staan in hun lidstaat bekend als enorm competent, met heel veel expertise inzake fraudebestrijding. In het activiteitenverslag lezen we duidelijk dat er een verschil van mening bestaat tussen het toezichthoudend comité enerzijds en de directeur-generaal van OLAF anderzijds over de rol van de Commissie. Hier komt de Commissie in zicht. Daar moeten jullie jullie verantwoordelijkheid nemen. Commissaris Georgieva, die de anti-fraude-commissaris is, moet een standpunt innemen. De vaststellingen van het toezichthoudend comité zijn ernstig, zijn concreet en slepen al lang aan.

Dus onze vraag is: welke maatregelen gaan jullie nemen om ervoor te zorgen dat de opmerkingen van het toezichthoudend comité opgevolgd worden en de problemen opgelost worden? Niemand vraagt u tussen te komen in operationele activiteiten, ook het toezichthoudend comité niet, maar er moet actie komen, er moet een actieplan komen. Er moet hier iets gebeuren zodat deze problemen kunnen worden opgelost. Ik wacht met spanning op uw antwoord.

  Petri Sarvamaa, author. Mr President, this is something that I am sure we all are aware of, and the Commission certainly has to be aware of what we are dealing with and talking about tonight.

There have been so many questions raised during the past years that I do not think they need to be repeated in detail. But what really needs to be said tonight in this debate – and when we are putting these questions to the Commission – is that for the first time we are witnessing a crucial and damning report from an independent supervisory committee consisting of five independent experts. Their role in supervising the work of OLAF is not just anything; it is absolutely crucial and essential to the credibility of the Union in the eyes of EU citizens.

Therefore, we are asking you tonight not just what the Commission has done, but what is the Commission's doing? What is the Commission doing to deal with the problems that clearly are present? The Supervisory Committee is calling into question its ability to conduct its work. This is not acceptable. We really need to see some action, so our main question tonight is: what is the Commission doing to change this?

  Dennis de Jong, Auteur. Ik ben blij dat we vandaag deze discussie met de Commissie kunnen voeren en wel op een zakelijke manier. Ik heb geen enkele behoefte aan aanvallen, noch op de persoon van de DG OLAF, noch op de Commissie begrotingscontrole. Maar feit is dat de toezichthouder een aantal concrete kritiekpunten heeft opgenomen in zijn jaarverslag en dat de antwoorden van OLAF de ongerustheid van vele collega’s en van mezelf niet wegnemen.

Het openen van zaken bijvoorbeeld moet zorgvuldig gebeuren. Je start een officieel onderzoek pas als er een voldoende ernstige verdenking van fraude bestaat. OLAF wijst erop dat de nieuwe regels destijds nog niet van kracht waren. De toezichthouder beroept zich echter niet op de nieuwe OLAF-verordening maar op de jurisprudentie van het Hof van Justitie. OLAF geeft toe dat deze jurisprudentie niet werd gevolgd en dat is ernstig.

Het is maar een voorbeeld, de echte discussie tussen de toezichthouder en OLAF gaat volgens mij vooral over de vraag hoe je toezicht kunt houden als je geen of in ieder geval te weinig inzicht krijgt in individuele zaken. Natuurlijk heeft DG OLAF gelijk als hij zegt dat de privacy van verdachten gewaarborgd moet zijn, maar dan nog kan OLAF ervoor zorgen dat de informatie over selectiecriteria en over prioriteitstelling voldoende onderbouwd aan de toezichthouder wordt overgelegd. De instellingen bakkeleien hier nu al jaren over en volgens mij ligt hier een hele duidelijke taak voor de Eurocommissaris. Kennelijk moeten er meer specifieke aanwijzingen komen over de informatieverstrekking aan de toezichthouder om de impasse te doorbreken.

Ten slotte valt het op dat OLAF erg veel zaken binnenshuis wil houden. Zo is er het voorstel om een controller over procedurele waarborgen binnen OLAF te plaatsen. Maar het geldt zeker ook voor de toezichthouder. Die is voor alles afhankelijk van het budget en de informatie van OLAF. Hier moet de Eurocommissaris uitdrukkelijk naar kijken. Hoe kan de toezichthouder werkelijk onafhankelijk worden van de organisatie waarop hij toeziet? Iedereen heeft er belang bij dat de verhouding tussen de toezichthouder en OLAF snel verbetert. Deze organen komen er duidelijk zelf niet meer uit. Daarom hoop ik dat de Eurocommissaris snel de handschoen oppakt en in de resolutie vragen we dan ook om een concreet actieplan. Ik vertrouw erop dat de Commissie ons toezegt snel met een dergelijk plan te komen. Dat zijn we aan de burgers van Europa verplicht.

  Michael Theurer, Verfasser. Herr Präsident, Herr Kommissar, liebe Kolleginnen und Kollegen! Die Angelegenheit, über die wir heute sprechen, ist eine sehr ernste Angelegenheit, da stimme ich den Kollegen zu. Und sie ist nicht neu. Im vergangenen Mandat habe ich in der Funktion des Vorsitzenden des Haushaltskontrollausschusses erleben müssen, dass bereits im Jahr2011 und im Jahr 2013 im Bericht des Überwachungsausschusses darauf hingewiesen wurde, dass die Mitglieder des Überwachungsausschusses Schwierigkeiten dabei erkennen, ihre Arbeit ausüben zu können, dass sie nicht an die von ihnen für notwendig erachteten Informationen herankommen, dass es offensichtlich immer wieder Kompetenzstreitigkeiten gibt zwischen dem Management, dem Direktor von OLAF und dem Überwachungsausschuss.

Deshalb sehen wir uns heute bemüßigt, hier im Plenum eine Frage an die Kommission zu stellen, denn OLAF ist unabhängig. Wir brauchen eine starke und funktionsfähige Betrugsbekämpfungsbehörde, das ist richtig. Und die Unabhängigkeit verteidigen wir als Europäisches Parlament auch. Aber in einem Rechtsstaat ist es erforderlich, dass es checks and balances gibt. Das heißt, die Frage ist: Wer kontrolliert eigentlich die Kontrolleure?

Hier haben wir in der OLAF-Verordnung ja das supervisory committee, den Überwachungsausschuss eingeführt. Es ist für uns als Haushaltskontrollausschuss höchst bedenklich, wenn sich die Mitglieder dieses Überwachungsausschusses an uns wenden und auf Schwierigkeiten hinweisen. Wir wollen, dass der Überwachungsausschuss seine Aufgaben auch erfüllen kann. Das heißt, wenn OLAF die Polizeibehörde ist, dann fehlt auf EU-Ebene der europäische Staatsanwalt, den wir seit Jahren fordern, der dann die Polizei gegebenenfalls überwachen kann. Vor diesem Hintergrund glauben wir, dass der Überwachungsausschuss jetzt gestärkt werden muss oder dass die Kommission Maßnahmen ergreifen muss, damit der Überwachungsausschuss die in der Verordnung niedergelegten Aufgaben auch tatsächlich erfüllen kann. Wir erwarten von der Kommission, dass sie uns hier Antworten gibt.

  Dimitris Avramopoulos, Member of the Commission. Mr President, Vice- President Georgieva regrets that she is not able to participate in this debate tonight. I therefore represent the Commission on this occasion.

The fight against fraud is of the utmost importance for the Commission, and I know that it is the same for Parliament. In this context, Parliament has repeatedly shown great interest in the work of the European Anti-Fraud Office and its Supervisory Committee. Most recently, when the Supervisory Committee presented its annual activity report covering the year 2014, this gave rise to discussions in the Committee on Budgetary Control. Some honourable Members have stated that the report identified serious deficiencies in the work of OLAF.

The Commission would like to emphasise that the role of the Supervisory Committee is to reinforce OLAF’s independence as an investigative board. The Supervisory Committee can identify issues which, in its view, require further improvements with the aim of making OLAF stronger in its core mission. In this context, the Commission has received three oral questions covering matters referred to in the Supervisory Committee activity report or in other discussions concerning the Supervisory Committee of OLAF. Furthermore, four motions for a resolution touching on the same subjects were tabled by different political groups.

Allow me to elaborate on the matters raised in the oral questions. The first is the opening of 423 cases on 12 February 2012. The second is the Commission’s position with regard to ensuring that OLAF complies with the legal requirements placed on it in the OLAF Regulation.

OLAF has been criticised for the opening of a large number of cases, by a single decision, in February 2012. The Commission has been informed that this decision was taken transparently; that all investigative units and OLAF management were involved; and that the decision and its impact on OLAF’s resources were transparently reported on in OLAF’s annual report for 2012—2013. The decision was due to internal reorganisation and the need to clear a backlog. The Commission also notes that OLAF does not agree with the Supervisory Committee that the opening of the cases failed to meet the legal requirement for the opening of an investigation. OLAF does not share the Supervisory Committee’s legal assessment on this matter.

The Commission emphasises that the opening of investigations is an investigative act, that OLAF is fully independent in those acts, and that the Commission is required to respect the independence of OLAF in its investigative functions. The decisions that the European Union and national authorities may adopt in the follow-up to OLAF investigations are subject to judicial review. It should, furthermore, be noted that it is not the role of the Supervisory Committee to pass judgment on the legality of individual investigative acts, as recognised by the Supervisory Committee itself.

My third point concerns the Commission’s perception of the working arrangements and working relations between OLAF and the Supervisory Committee, and its intention to facilitate those relations and to make OLAF more efficient. The Commission is aware that OLAF and the Supervisory Committee are working very hard to improve their relations. In particular, OLAF and the Supervisory Committee are currently reviewing their working arrangements in order to align them better to the needs of the Supervisory Committee.

The Commission, and in particular Vice-President Georgieva, has regularly raised with both sides issues linked to the relations between OLAF and the Supervisory Committee. The Commission’s aim is, of course, to facilitate and foster good cooperation and constructive dialogue. It should be noted, however, that OLAF and the Supervisory Committee are two independent bodies which are already in dialogue and work together with the same aim. The Commission can offer its advice and support, but it is the responsibility of OLAF and its Supervisory Committee to develop sound and constructive cooperation.

Referring, in its activity report, to the independence of its secretariat, the Supervisory Committee mentions legal requirements. The OLAF Regulation specifies that the Supervisory Committee secretariat shall be provided by the Office in close consultation with the Supervisory Committee. In its most recent opinion, No 1/2015, on OLAF’s budget 2016 – an opinion not yet shared with the institutions – the Supervisory Committee recognises that the current arrangements with OLAF come close to sufficient financial autonomy for the Supervisory Committee and its secretariat.

As stated by my colleague Vice-President Georgieva at Parliament’s March 2015 part-session, the Commission is currently exploring ways in which it can further strengthen the independence of the Supervisory Committee in its human resources and budget management within the existing framework. Fuller formal independence of the Supervisory Committee and secretariat, in terms of both budget and human resources, would, however, require the legislator to amend OLAF Regulation 883/2015. In view of the international role of both OLAF and the Supervisory Committee in the protection of the European Union’s financial interests, the relations between OLAF and the Supervisory Committee are, of course, a matter of interest to Parliament, the Council and the Commission. We would like to propose that the subject be discussed further in the context of the annual interinstitutional exchange of views provided for in the OLAF Regulation. The next exchange of views will take place in September 2015.

Fourthly, on the question of whether the Commission is to propose an action plan to resolve serious deficiencies highlighted in the Supervisory Committee annual report, the Commission is of the opinion that it is excessive to consider that the Supervisory Committee has identified serious deficiencies. It is the very purpose of the Supervisory Committee to identify issues which, in its view, require further improvement in the work of the Office, and to make the corresponding recommendations.

Many of the issues raised by the Supervisory Committee in its activity report refer to OLAF’s investigative activities, such as the opening of the 423 cases in 2012, the investigative policy priorities and the participation of the office in the Commission’s Clearing House meetings.

Last week, on 2 June 2015, OLAF presented its annual report for the year 2014. It reports on the efficacy and results of its investigations, providing a positive picture of its achievements. It is for OLAF, as an independent investigative body, to give proper follow-up and to inform the Supervisory Committee and the institutions thereof.

The Commission has been informed by OLAF that it has responded to, or is in the process of responding to, many of the Supervisory Committee’s recommendations and requests. As mentioned by the Chair of the Supervisory Committee during his speech at the meeting of the Committee on Budgetary Control on 4 May, the important professional work carried out by OLAF deserves all our appreciation, and the statutory role of the Supervisory Committee is to improve this work and to contribute to trust in OLAF’s investigative activities.

  Ingeborg Gräßle, im Namen der PPE-Fraktion. Herr Präsident, Herr Kommissar! Manchmal wäre es besser, wenn man nicht verlesen würde, was andere aufschreiben. Der Vortrag jetzt war so gekennzeichnet von mangelnder Sachkunde und von Einseitigkeit, dass mir eigentlich fast die Stimme wegbleibt. Was würde denn passieren, wenn eine Polizeibehörde in der EU oder in Drittstaaten Statistiken manipuliert, Fälle eröffnet, um besser dazustehen, das Parlament mit geschönten Zahlen konfrontiert und angeblich informiert und im Kernbereich ihrer Aufgabe, nämlich dem Schutz der Gelder, zumindest unklare Ergebnisse erzielt? Da wäre die EU doch dagewesen und hätte schon längst viele gute Ratschläge parat. Im Kernbereich dessen, was die EU betrifft, nämlich in dem Amt für Betrugsbekämpfung, haben Sie uns nun lange dargelegt, dass das alles doch gar nicht so schlimm ist, dass man doch die Sache von zwei Seiten sehen könne und dass man sich doch bitte gar nicht aufregen soll über das, was da passiert, weil zum einen die, die das feststellen – der Überwachungsausschuss – doch ihr Mandat überdehnen würden.

Herr Kommissar, das war alles großer Mist. Entschuldigung, das war alles großer Mist. Es war zumindest sachlich völlig unangemessen. Wir haben ein großes Problem, die Sache stinkt buchstäblich zum Himmel. Und Sie – die Kommission – tun so, als ob Sie das alles gar nichts anginge. Die Kommission versucht, das auszusitzen. Das versuchen Sie jetzt seit zwei Jahren auszusitzen. Wir haben es mit gravierenden Rechtsbrüchen zu tun, und Sie sagen uns: Leute, stellt euch nicht so an, das interessiert uns gar nicht. Überlegen Sie sich zweimal, was Sie hier sagen. Es tut mir leid. Wir werden das alles aufarbeiten. Ich muss Ihnen sagen, ich hätte es nicht für möglich gehalten. Gut, dass ich dabei war.

  Inés Ayala Sender, en nombre del Grupo S&D. Señor Presidente, doy la bienvenida a aquellos compañeros y compañeras que durante años ignoraron y persiguieron al Comité de Vigilancia de la OLAF, cuando yo sola entendía que debía asegurarse su trabajo, que es el de proteger la independencia de la OLAF y, ahora, además, proteger también a los investigados. Pero esos eran otros tiempos.

La precipitación es siempre muy mala consejera, y más en el tratamiento del organismo que se ocupa de luchar contra el fraude dentro y fuera de la Unión Europea, a la espera del próximo Fiscal Europeo.

Por eso, desde mi Grupo hemos considerado precipitado este debate —que aborda solo una de las partes del problema y se ha organizado incluso antes de conocer el Informe anual de la propia OLAF, que es el organismo central del que deberíamos hablar—, como consideramos en su momento precipitado el debate sobre el Informe anual del Supervisory Committee, casi antes incluso de hacerlo público, sin haberse invitado al director general. Vendría a ser como si, ante la presentación de la aprobación anual de la gestión del Tribunal de Cuentas, no se invitase a la comisaria responsable. Pues eso se hizo. ¿Qué urgencia había? Lo dicho: precipitación.

Por eso nuestra Resolución se concentra en deplorar que el Parlamento, en su Comisión de Control Presupuestario, en vez de ofrecer a ciudadanos y colegas la oportunidad de llevar a cabo un debate completo con todas las opiniones y respuestas necesarias, haya preferido, por parte de algunos Grupos, ofrecer un debate parcial.

La OLAF es el organismo para llevar a cabo el mandato del Tratado de luchar contra el fraude, y el Comité de Vigilancia es el organismo auxiliar para proteger a la OLAF, asegurando su independencia, y proteger los derechos de los investigados. Siempre ha habido una tensión debida entre ambos. Si no existiera, sería que no hacen bien su trabajo. Lo que en el Parlamento no podemos hacer es desequilibrar la balanza maliciosamente, ignorando adrede las respuestas y explicaciones de una de las partes, volviendo a poner encima de la mesa algunos de los puntos que ya este Parlamento votó —y votó en contra—, aunque algún compañero pretende que volvamos a votar una y otra vez hasta conseguir que cambie el voto.

Yo, la verdad, es que entiendo que erigir al Comité de Vigilancia como juez, en vez de como protector de la OLAF, y también parte, puesto que no existiría si no hubiera la OLAF, entiendo que no es el funcionamiento ni nuestro papel. Por eso, solicito a la Comisión que emprenda cuanto antes la labor de asegurar el buen funcionamiento de ambos y clarificar si se ha producido lo que algunos de los compañeros dicen y respecto de lo cual no hemos podido ni siquiera verificar las respuestas.

  Richard Sulík, im Namen der ECR-Fraktion. Herr Präsident, sehr geehrter Herr Kommissar! Ihre Erläuterungen sind fadenscheinig und unglaubwürdig. Alles, wovon Sie sprechen, wäre kein Problem, wenn die EU und OLAF wirklich Interesse hätten, Betrug zu bekämpfen. Haben sie aber nicht – und so gibt es einen Krieg der Bürokratie, endlose Diskussionen, Aktionspläne und Blablabla. Ich selbst habe in den letzten zwölf Monaten 14 Fälle – sie waren meistens sehr eindeutig – bei OLAF eingereicht. Keiner davon ist bis heute wirklich untersucht worden. In sechs Fällen habe ich keine Antwort bekommen und in weiteren sechs Fällen habe ich eine unbefriedigende Antwort bekommen. OLAF arbeitet nicht, wie es arbeiten soll. Wenn die Kommission wirklich Betrug bekämpfen will und jemanden sucht, der die Sache ernst nimmt, stehe ich zur Verfügung.

  Fernando Maura Barandiarán, en nombre del Grupo ALDE. Señor Presidente, el informe sobre la actividad de la OLAF durante el año 2014 deja entrever que la supervisión de este organismo por parte del Parlamento Europeo deja bastante que desear, en particular en la falta de acceso a la información de la OLAF que recibimos por parte de este Parlamento y que suscita numerosas dudas sobre investigaciones ya realizadas o en curso por parte de esa Oficina.

Y pongo un ejemplo: el referente al informe respecto de los campos de refugiados de Tinduf. Habla en él de fraude, pero no hace una estimación del mismo. Dice que se realizó y, sin embargo, no visitó los campos en ningún momento y no consultó datos tan básicos como el censo de refugiados realizado por ACNUR en octubre del año 2000.

Deseo manifestar de forma rotunda que, como consecuencia, se puede producir una mayor tragedia humanitaria de la que ya viven los refugiados saharauis si finalmente ven reducidas sus ayudas.

  Κώστας Χρυσόγονος, εξ ονόματος της ομάδας GUE/NGL. Κύριε Πρόεδρε, ο Οργανισμός OLAF δημιουργήθηκε για να καταπολεμήσει τη διαφθορά και την απάτη σε βάρος της Ευρωπαϊκής Ένωσης. Ωστόσο, από την έκθεση του αρμόδιου εποπτικού οργάνου προκύπτει ότι δρα με τρόπο αδιαφανή και τίποτα δεν εγγυάται την αποτελεσματικότητα και νομιμότητα των ενεργειών του. Είναι φανερό ότι η Ευρωπαϊκή Επιτροπή, που έχει την τελική αρμοδιότητα για τις υπηρεσίες της Ένωσης, αδυνατεί να κατοχυρώσει την πιο στοιχειώδη και απαραίτητη μεταρρύθμιση, δηλαδή την καταπολέμηση της διαφθοράς μέσα στο ίδιο το σπίτι της.

Κατά οξύμωρο τρόπο, η Ευρωπαϊκή Επιτροπή, δρώντας ως μέλος της τρόικα, αξιώνει να επιβάλει δήθεν μεταρρυθμίσεις στα κράτη που υπάγονται σε καθεστώς μνημονίου. Αυτές δεν συνίστανται στην καταπολέμηση της διαφθοράς και γενικότερα της παραβατικότητας, αλλά στην επιβολή νεοφιλελεύθερων ιδεοληψιών και στην απορρύθμιση της αγοράς εργασίας σε όφελος του κεφαλαίου.

Πρέπει να σταματήσουμε αυτή την υποκρισία και να ανασυγκροτήσουμε την Ένωση με βάση τον πραγματικό σεβασμό στη δημοκρατία, το κράτος δικαίου και τα ανθρώπινα δικαιώματα.

  Jonathan Arnott, on behalf of the EFDD Group. Mr President, ‘quis custodiet ipsos custodes’. The ancient Roman poet Juvenal knew the problem all too well: who guards the guards? Who polices the police? And who notices when the EU’s anti-fraud office itself breaks the rules?

Well, in this case, it is supposed to be the scrutiny committee, and their report is pretty scathing. You cannot record phone conversations without legal basis, you cannot open 423 cases on the same day without so much as reasonable suspicion, and you cannot mislead Parliament about fraud figures. But now we need to know the truth.

We need these questions to be put to Mr Kessler in public at the Committee on Budgetary Control. We need to grill him and find out exactly what has been going on. If there is no satisfactory response, then – for once in this place – heads must roll. It is not just about Juvenal, but Caesar’s wife must be above suspicion.

  Louis Aliot (NI). Monsieur le Président, chers collègues, ce rapport est édifiant car il consacre une nouvelle fois une structure européenne qui ne fonctionne pas correctement, sur un sujet pourtant si important: la fraude.

Ce rapport est inquiétant, tant les remarques faites par le comité de surveillance sont pertinentes: nombre élevé d'enquêtes avec des délais trop importants; nombre de dossiers ouverts sans disposer des moyens nécessaires; procédures juridiques élémentaires bafouées, qui mettent à mal les droits de la défense – droits consubstantiels à une démocratie digne de ce nom; enfin, suspicions sur certaines enquêtes, qui sont autant de pressions exercées à l'encontre des parlementaires et de leur mission, internationalement reconnue et consacrée.

Ces éléments nous amènent à constater que les différentes critiques sont justifiées, qu'elles menacent la crédibilité de l'OLAF, et donc de la lutte contre la fraude, et qu'elles nécessiteraient, si l'Union européenne était une véritable démocratie et notre Parlement un véritable parlement, une enquête parlementaire sur l'organisation et le fonctionnement de l'OLAF.

Puisque la Commission ne veut pas la régler, les parlementaires, expression de la volonté générale des peuples, doivent se saisir de cette question et permettre une totale transparence.

  Tomáš Zdechovský (PPE). Důvodem, proč sklízíte tady od nás kritiku, je především fakt, že není poprvé, co projednáváme pochybení. Pochybení úřadu OLAF, který se dostává do hledáčku Evropského parlamentu, ale naše obavy o nezávislost tohoto úřadu se neustále zvyšují.

Poté, co dozorčí výbor úřadu OLAF vydal svou výroční zprávu za rok 2014, pochyby o správném fungování úřadu a jeho vedení se ještě více stupňují. Autoritativní jednání uvnitř instituce, která má být příkladem odpovědnosti a vnitřní integrity, a fakt, že tato instituce sama nedodržuje daná pravidla a postupy, je nejen ostudné pro celou Unii, ale především ohrožuje finanční zájmy evropských občanů.

Pane komisaři, Výbor pro rozpočtovou kontrolu, ale i občanská společnost dlouhodobě upozorňuje na střet mezi dozorčím výborem a vedením úřadu OLAF, který podlamuje efektivní práci celé instituce. Pokud OLAF nemůže fungovat efektivně, je ohrožen evropský rozpočet a dohled nad jeho správným čerpáním, což ovlivňuje celou Evropskou unii.

Nedokáže-li se současné vedení dlouhodobě vypořádat s těmito problémy, které ovlivňují kvalitu práce úřadu OLAF, je zapotřebí, aby se vedení změnilo a aby vnitřní vztah obou orgánů instituce byl přenastaven. Proto se ptám, není skutečně čas na to, aby EU provedla skutečnou změnu v úřadu OLAF?

  Bogusław Liberadzki (S&D). Panie Przewodniczący! Z dość dużym zdziwieniem przyjmuję naszą dzisiejszą debatę. Zgadzam się z tymi wszystkimi przejawami troski, ze stwierdzeniem, że nie działa – tylko my na razie jesteśmy w następującej sytuacji, że jedna strona, czyli Komitet Nadzoru, przedłożyła sprawozdanie. Sprawozdanie OLAF-u, którego nikt nie czyta, jest gotowe raptem od czterech czy sześciu dni. Jeżeli my jako Parlament chcemy – a myślę, że powinniśmy – mieć równy dystans do obu instytucji, nie powinniśmy dzisiaj wypowiadać tego rodzaju opinii, tak jednoznacznie brzmiących, tylko na podstawie tego, co Komitet Doradczy był uprzejmy napisać. Bo jeżeli sprawozdanie OLAF-u będzie inne, a my nie wiemy, jakie jest – o tym nie debatowaliśmy – możemy się znaleźć w dość skomplikowanej sytuacji, czyli przyczynić się do rozchwiania tych instytucji, do pogłębienia różnego rodzaju waśni, zamiast szukać tego, co nas łączy. Dlatego chciałbym, żebyśmy bardzo jasno sobie powiedzieli, że żadnej decyzji dzisiaj nie podejmujemy. Czekamy, na forum Komisji Kontroli Budżetowej, właśnie na sprawozdanie OLAF-u. Oceńmy je rzeczowo i wtedy dopiero próbujmy określić, kto tutaj ma rację. Namawiałbym do daleko posuniętej powściągliwości, wszak to nas obowiązuje.

  Norica Nicolai (ALDE). Domnule președinte, în 2012 OLAF a deschis 423 de investigații, 198 în cooperare cu autoritățile din statele membre, 225 de investigații directe.

Ne poate spune Comisia care este rezultatul acestor investigații la aproape doi ani de la declanșarea lor, pentru că de rezultatul acestor investigații depinde credibilitatea instituției, a bătăliei împotriva corupției și, în final, a Uniunii Europene?

Printre aceste sesizări se numără și 20 de cazuri care privesc finanțarea prin proiecte SAPARD în România. Marea majoritate a acestor proiecte privesc agricultura.

Din raportul autorității relevante române rezultă că într-un singur caz au existat suspiciuni de fraudă, restul au fost clasate. Dar restul au antrenat falimentul companiilor care au fost investigate și care au atras aceste fonduri europene.

În aceste condiții, își asumă cineva vreo responsabilitate în legătură cu fraudele, cu corectitudinea acestor investigații sau suntem în prezența deschiderii pur formale a unor investigații?

Avem nevoie de reguli clare pentru că respectul față de cetățeanul european și inclusiv aici este prioritar.

Signor Presidente, signor Commissario, onorevoli colleghi, mi spiace che non ci sia la Commissaria Georgieva per rispondere ad alcune delle domande che avevo da porgere, che avrei voluto porgere all'OLAF e che avrei voluto porgere a lei, in veste di rappresentanza della Commissione. In questo momento particolare, da quando è anche nato il mio movimento in Italia, noi siamo impegnati nella lotta alle frodi, alla corruzione, siamo sempre in prima linea per denunciare qualsiasi abuso di fondi pubblici.

In questo caso, però, c'è una battaglia che secondo me, è più politica che nel merito, perché io voglio avere delle informazioni su questi 423 casi aperti e chiusi in così poco tempo. Voglio capire perché erano in un cassetto fino a quel momento e voglio avere delle risposte su tante domande che ho, per questo nella risoluzione che abbiamo presentato a nome del mio gruppo richiedo che ci sia un incontro in commissione controllo di bilancio per definire questi miei dubbi, prima di prendere qualsiasi decisione.

  Janusz Korwin-Mikke (NI). Mr President, I absolutely reject Commissioner Avramopoulos’s remarks. I am sorry, Mr Avramopoulos, but you said that the European Anti-Fraud Office (OLAF) should engage in dialogue with the Supervisory Committee. The Supervisory Committee does not need a dialogue with anybody: it is here to supervise and not to dialogue.

You say that OLAF did this, and OLAF did that. It was not OLAF, but the Director-General, Mr Kessler, and the problem here is with Mr Kessler, not with OLAF. We should look directly at the activities of Mr Kessler, because he does not investigate officials of the European Union; he investigates external firms. Moreover, Mr Avramopoulos, do you know – or perhaps it is only gossip – that Mr Kessler has promised Ms Catherine Day that he will give her information on the investigations led by OLAF? You should check whether this is true.

  Monica Macovei (PPE). Domnule președinte, sunt de acord cu colegii mei că declarațiile și răspunsurile și comentariile comisarului Avramopoulos au fost pur birocratice, formale și nu ne-au dat nici o informație.

Dimpotrivă, sunt foarte îngrijorătoare pentru că ele arată că nu va face nimic ca să remedieze situația de la OLAF.

Și în acest context doresc să-l întreb dacă crede în lupta împotriva corupției și împotriva fraudei și, de asemenea, îl întreb dacă este adevărat că a alterat, a lipsit de substanță, a periat Eurobarometrul de corupție bianual făcut de Comisia Europeană?

Acum, despre cum se supervizează OLAF de către Comisie cred că am spus destule.

Raportul Comitetului de Supervizare e foarte nemulțumit de activitatea OLAF și într-adevăr vorbim de activitatea de management aici și nu de activitatea investigatorilor. Nu sunt date suficiente transmise așa încât controlul nu poate fi efectuat.

De asemenea, statisticile OLAF nu sunt credibile, ele diferă de la un an la altul sau de la câteva luni la alte luni sau de la câțiva ani la câțiva ani și diferă foarte mult, deci nu putem să ne bazăm pe ele.

Și reamintesc în acest context că frauda cu bani europeni este de cel puțin trei miliarde de euro. Și aceștia sunt banii noștri și vrem ca toți cei care-i fură să scoată mâna din buzunarele noastre.

Și dumneavoastră domnule comisar Avramopoulos aveți un rol foarte important și ar trebui să vă ridicați la înălțimea acestui rol în raport cu ceea ce face OLAF.

De aceea e foarte bine că înființăm instituția procurorului...

  Georgi Pirinski (S&D). Mr President, for all we know, all these allegations might be true. However, the question is: how do we find the truth? It is not possible to arrive at an acceptable solution if we do not observe elementary rules of democracy and the democratic process.

Why was OLAF’s report not presented to the Committee on Budgetary Control? Why was OLAF not invited when the Supervisory Committee report was presented? The explanation that they are too confrontational, so they cannot sit in the same room, is ridiculous.

It is the business of the Committee on Budgetary Control, in collaboration with the Commission, to see that an end is put to this absolutely unacceptable situation as quickly as possible because – as we repeat all the time – we need the confidence of our citizens. We have to show them that we are responsible. What are we doing? We are exchanging, through the media, through all sorts of different channels, allegations which cannot be examined in conjunction, and then we wonder why we look ridiculous in the eyes of our citizens.

Again I say: the procedure followed in the Committee on Budgetary Control is beyond any acceptable standards. It is open to severe criticism.

Gerbiamasis Komisare, iš tikrųjų šiandien galiu Jus tik užjausti, kad turite atstovauti tokiu gana sudėtingu klausimu, dėl kurio prieš tai buvęs Europos Parlamentas ir Biudžeto kontrolės komiteto nariai diskutuoja ir matyt dar diskutuos daug metų. Ir šiandien šioje salėje jaučiamas tam tikras nuomonių išsiskyrimas, ir gana kardinalus nuomonių išsiskyrimas. Ir aš manau, kad mes ateityje turėtumėme to išvengti.

Buvo pasakyta, kad yra tam tikros procedūros, ir mes taip pat, politikai arba Europos Parlamento nariai, turime laikytis jų. Ir pirmiausia, kad tiek Priežiūros komitetas, tiek OLAF tarnyba turėtų būti vertinama pagal konkrečius faktus. Ir tikrai reikia sutikti, kad reikia sulaukti OLAF'o ataskaitos, ją įvertinti, kokie buvo pasiekimai, kad nebūtų įvairių nesusipratimų dėl tam tikrų bylų pradėjimo ir dėl to, kokie tų bylų rezultatai. Ir aš manau, kad šitas klausimas išsispręs.

OLAF'o direktorius yra paskirtas pagal procedūras, dėl kurių praeitą kadenciją buvo diskutuojama beveik metus. Taip pat ir Priežiūros komitetas. Ir pats pagrindinis vaidmuo – aš tikrai suprantu – turi tekti Europos Komisijai ir ypatingai tam Komisarui, kuris atsakingas už šiuos reikalus. Jeigu jūs keisitės nuomonėmis tik rugsėjo mėnesį, dėl problemų, kurios egzistuoja keletą metų ir kurių niekaip negalima išspręsti, tai jokių rezultatų mes nepasieksime dar keletą metų. Todėl siūlau Komisijai imtis iniciatyvos.

  Caterina Chinnici (S&D). Signor presidente, onorevoli colleghi, effettivamente dal rapporto annuale del comitato di vigilanza di OLAF sono state evidenziate numerose criticità sull'operato di tale organismo, mentre OLAF nel rapporto annuale per l'anno 2014 presentato la settimana scorsa ha evidenziato i buoni risultati dell'attività svolta sulle indagini sui casi di frode agli interessi finanziari dell'Unione europea.

Fermo restando l'apprezzamento per il lavoro svolto dal comitato di sorveglianza ed il rispetto per il ruolo istituzionale di OLAF, che sappiamo essere di fondamentale importanza nella lotta contro le frodi in danno dell'Unione europea, non può sottacersi che si è ormai determinata una situazione di forte tensione fra i due organismi. Credo quindi occorra molta prudenza e credo quindi necessario fare maggiore chiarezza sulla situazione, ascoltando entrambi gli organismi prima di prendere ogni e qualunque decisione.

  Андрей Новаков (PPE). Благодаря, г-н Председател, аз подкрепям диалога между институциите, който имаме тази вечер, но очаквам конкретни отговори. Хората и бизнесът отвън също ги очакват. И уверявам Ви, че подкрепата на хората отвън свършва там, където започва тяхната толерантност, а толерантността на народа към безобразията е нулева.

В случая с OLAF може да се окаже, че имаме нарушени правила. Но може да се окаже, че имаме нарушени права на бенефициентите – и на хората и на бизнеса. Ето защо ни трябват резултати, и то бързо. В противен случай рискуваме доверието и на хората, и на бизнеса, а те са в основата на кохезионната политика. А и хората, и бизнесът се питат как се отварят 423 дела за 24 часа и защо само 8% от тях са завършени. Надявам се искрено OLAF да има отговори на тези въпроси и да има желязна логика, за да ги обясни, защото в противен случай губим доверието – и в нас, и в институциите, и в Европейския съюз, а нямаме нужда от това.

To say that OLAF did not have a chance to be heard by the Committee on Budgetary Control is an outright lie.

  Tibor Szanyi (S&D). Én úgy gondolom, hogy ennek a vitának a végén érdemes megjegyezni néhány dolgot. Az első megfigyelésem az az, hogy bizony itt három szereplő van: az egyik az OLAF maga, a másik az OLAF felügyelőbizottsága, és hát a főszereplő azért mégiscsak a Bizottság. Én nagyon szeretném a Ház méltósága, illetve az európai adófizető polgárok lelkének megnyugtatása végett azt a helyzetet, amikor ezek a szervezetek nem a problémáikat hozzák ide a Parlament elé, hanem a Bizottság vezérletével, együttműködésével a megoldásokat. Erre vágyunk, és nem pedig arra, hogy itt egy nyilvános vitával kiszolgáltassuk az Európai Unió egyik legdiszkrétebb szervezetét.

Pa kakvu mi poruku večeras šaljemo našim sugrađanima, kakvu mi poruku večeras šaljemo poreznim obveznicima, kakvu poruku šaljemo gospodarstvu i svim drugim institucijama koje znaju za postojanje OLAF-a i koje vjeruju u vjerodostojnost i OLAF-a i Europske unije?

Kakvu mi poruku šaljemo danas kada razgovaramo o nečemu što je potpuno jasno i što je doživjelo, nažalost, ozbiljan debakl zadnjih godina. Zato sam vrlo jasan isto tako u zahtjevima da se napokon uvede ured europskoga tužitelja, jer vjerujem da je, ako ništa drugo, to jedan kraći put da se pravda i zakoni poštuju u Europskoj uniji.

Signor Presidente, onorevoli colleghi, devo esprimere la mia perplessità riguardo le modalità di interazione fra la Commissione di vigilanza e l'OLAF, per quel che concerne il deficit di metodo, trasparenza e procedura. Credo sia fondamentale chiarire il ruolo della Commissione di vigilanza e finire il suo raggio di azione. Una cosa è certa, non possiamo aspettare, le frodi sono un problema gigantesco.

Avrei voluto stasera parlare dei risultati dell'ultimo rapporto. Avrei voluto parlare di quanto i numeri e l'entità, la qualità di queste frodi sono aumentate. Avrei voluto parlare del fatto che non possiamo scaricare le colpe sull'efficienza delle amministrazioni locali, ma i controlli devono partire da Bruxelles. Avrei voluto parlare di quanto sia importante un'azione transnazionale, un'azione europea, e quanto sia importante, quindi, la procura europea perché si armonizzino le singole normative nazionali e consentano maggiore coordinamento giudiziario; invece, qui cosa facciamo? Facciamo da pacieri fra 2 enti, importanti entrambi nella lotta alle frodi.

In quanto coordinatrice del mio gruppo in commissione REGI, pretenderemo di ascoltare sia l'OLAF che il comitato di vigilanza. Questo nella commissione CONT è stato fatto?

As you understand, I cannot elaborate further on your questions: I am not the expert or the competent Commissioner. Let me remind you, as I said at the beginning, that I represent here the Commission. Of course I will inform Vice-President Georgieva of the issues of our debate accordingly.

Let me tell you that the Commission is now looking forward to the annual Interinstitutional Exchange of Views that will take place, as you know, in September and which will provide a forum for discussion of the progression of relations between OLAF and its supervisory committee.

As for the motion for a resolution following its adoption, the Commission will, of course, give you a detailed reply in due time.

  Tamás Deutsch (PPE), írásban. A közös állásfoglalási indítvány vitáját az OLAF Felügyelő Bizottságának 2014. évi éves jelentésében foglalt tények miatt kell megtartanunk. Az OLAF FB abban komoly kritikákat fogalmazott meg az Európai Csalás Elleni Hivatal vezetésével, irányításával és ügykezelésével kapcsolatban, ezeket nem hagyhatjuk figyelmen kívül, és mint a Költségvetési Ellenőrző Bizottság tagjai kötelesek vagyunk az üggyel kapcsolatban a véleményünket kifejezni. A jelentés erősen kifogásolja azt az eljárást, melynek során 2012. február 1-jén a főigazgató határozata alapján egy időpontban 423 ügyet nyitottak meg, anélkül hogy érdemben megvizsgálták volna azt, hogy az Unió pénzügyi érdekeit érintő csalás, korrupció vagy más jogellenes tevékenység alapján megalapozott az OLAF illetékessége az adott ügyekben.

Problémát jelent továbbá az is, hogy az OLAF főigazgatója figyelmen kívül hagyja a felügyeleti testület ajánlásait, az 50 FB ajánlásból mindössze 8-at hajtott végre. A Felügyelő Bizottság hozzáférése a feladatainak ellátásához szükséges információkhoz szintén nem garantált, az FB titkárságának stabil működése szintén nem biztosított. Az állásfoglalási indítvány ezen problémák megoldására szólítja fel az Európai Csalás Elleni Hivatalt, s annak főigazgatóját. A Felügyelő Bizottság hatékony működéséhez és ahhoz, hogy ellássa feladatait, minden szükséges feltételt biztosítani kell, az Európai Parlament Költségvetési Ellenőrző Bizottságának pedig kötelessége ennek érdekében felemelni a szavát. A közös állásfoglalási indítványt a legmesszemenőbbekig támogatom.

  Csaba Molnár (S&D), írásban. Az OLAF 2014-es jelentése szerint a jelenlegi magyar kormány ötösre vizsgázott korrupcióból. A magyar kormány 2010 óta a második legkorruptabb tagállam címét szerezte meg az EU-ban. A magyar hatóságok tavaly egyetlen esetben sem gyanakodtak visszaélésekre, míg a magánszektorból 28 bejelentés érkezett. Annak ellenére nem gyanít semmit a kormány és Polt Péter, hogy az intézményesített korrupció miatt uniós milliárdoktól esünk el, az Egyesült Államokból pedig kormányzati tisztviselőket tiltanak ki. Az OLAF gyászjelentése egyet jelent: ma a magyar kormány az európai adófizetők pénzén harcol az EU ellen, európai pénzen próbál meg illiberális államot építeni Magyarországon. Lázár János múlt héten Brüsszelben nyíltan beismerte ezt, amikor elfogadta az Orbán-kormány korrupciógyanús közbeszerzései miatt kiszabott milliárdos uniós büntetést. Nem lepődünk meg azon sem, hogy a magyar kormány az Európai Ügyészség elgáncsolásán, jogköreinek gyengítésén fáradozik.

A DK ezzel szemben mindent megtesz annak érdekében, hogy egy független, erős, kizárólagos joghatósággal rendelkező Európai Ügyészség jöjjön létre, amely felszámolja a fideszes korrupciót Magyarországon. A DK kiáll amellett, hogy a jövőben csak azok a tagállamok kaphassanak uniós forrásokat, akik elfogadják a 2016-tól felálló európai ügyészség kizárólagos joghatóságát. Az Orbán-kormány bukása után felderítjük a korrupciógyanús eseteket, nem hagyjuk, hogy a magyar emberek, vállalkozások uniós forrásoktól essenek el korrupt kormányuk miatt.

  Igor Šoltes (Verts/ALE), pisno. U vezi odnosa Europske unije i Rusije, smatram da Rusija ilegalnom aneksijom Krima, izravnim i neizravnim sudjelovanjem u oružanom sukobu u Ukrajini te povredom teritorijalnog integriteta Gruzije narušava demokratska i međunarodna načela. Štoviše, ekonomska prisila i politička destabilizacija koju Rusija provodi prema svojim europskim susjedima predstavlja svjesno kršenje međunarodnog prava. S obzirom na navedeno, Europska unija mora temeljito procijeniti odnos s Rusijom i pripremiti sveobuhvatan plan o budućnosti odnosa s Rusijom i istočnim susjedima. Europska unija godinama teži izgradnji uzajamno korisnog strateškog partnerstva s Rusijom te je i dalje otvorena za takav odnos i dijalog u budućnosti kada za to budu ispunjeni preduvjeti. Rusija je važan partner Europske unije i trebali bismo, na obostranu korist, definirati i na konstruktivan način uspostaviti dugoročno održiv odnos temeljen na poštivanju međunarodnog prava.

Die Entschließungsanträge der Fraktionen stellen die unzureichende Position des Überwachungsausschusses fest und nennen unter anderem hierfür eine unbefriedigende Zusammenarbeit, unzureichende Empfehlungsumsetzung bzw. die fehlenden und ungeklärten rechtlichen Handhabemöglichkeiten des SC gegenüber der DG OLAF als Begründung. Meines Erachtens muss die DG OLAF die Position des SC anerkennen und ihre Mittelverteilung überdenken, da rund 86 % der Untersuchungen im Bereich der Referate Landwirtschaft und Strukturfonds getätigt werden mussten.
