  Przewodniczący. – Kolejnym punktem porządku dnia jest debata nad siedmioma projektami rezolucji w sprawie projektu kambodżańskiej ustawy o NGO i związkach zawodowych (2015/2756(RSP)).

  Ernest Maragall, Autor. Señor Presidente, como es obvio, nosotros defendemos y apoyamos esta Resolución. Lo hacemos, creo, compartiendo también con el resto de autores, y espero que con el conjunto de los Grupos, una cierta inquietud. Porque se trata —estamos ya acostumbrados a ello: a una cierta repetición, a una cierta expresión de preocupación o de denuncia frente a unas realidades— de unos hechos que ya han sido objeto de consideración y de trato en este mismo Parlamento. En este caso, el caso de Camboya, no hace ni un año y medio. Más concretamente, en enero de 2014.

Parece haber una contradicción insalvable —deberíamos planteárnoslo— entre desarrollo económico, producción de prosperidad y respeto de los derechos humanos, dominio del Estado de Derecho, establecimiento de unos estándares básicos de regulación social, laboral, etc.

Ahora asistimos con preocupación, en el caso de Camboya, a una triple iniciativa legislativa del Gobierno de Camboya que no parece respetar en absoluto nuestros criterios mínimos de lo que debería ser un proceso de participación, de debate social, precisamente también porque afecta a colectivos como las organizaciones no gubernamentales o los sindicatos, que son protagonistas, que deberían ser protagonistas de esos derechos básicos.

Y eso sucede al mismo tiempo que en el país se repiten cuestiones ya clásicas, en los últimos años sobre todo, de políticas encaminadas, por ejemplo, al desalojo de los pequeños cultivadores de grandes extensiones de terreno, normalmente propiedad del propio Estado, para convertirlas en concesiones y en explotaciones agrícolas preindustriales, etc. O coincide con la proliferación de pequeños talleres, que también son protagonistas de un más que dudoso respeto de los derechos humanos.

Una parte de esa realidad, digámoslo claro, tiene que ver con nosotros mismos, con nuestros estímulos, con nuestra demanda industrial, con nuestros hábitos de consumo. Hay conexión entre los grandes cultivos de caña de azúcar y nuestra industria de refrescos; la hay entre los trabajadores de los talleres de confección y nuestras grandes cadenas comerciales. Por eso cabría preguntarse si, a esa iniciativa positiva de «everything but arms», todo excepto armamento, no habría que añadirle otra consigna. De acuerdo: todo excepto armamento pero nada sin derechos, «nothing without rights». Creo que sería necesario y oportuno.

Signor Presidente, onorevoli colleghi, credo che il presupposto da cui dobbiamo partire, quando parliamo della situazione della Cambogia, è quello che noi siamo il principale finanziatore di tutti i progetti di sviluppo in corso in Cambogia e spesso e volentieri abbiamo utilizzato le ONG cambogiane per portare avanti questo tipo di iniziative di sviluppo.

Quindi mi sembra chiaro che il problema sussiste ed è un problema grosso, perché se viene approvata questa legge che va a limitare in maniera molto incisiva le libertà sindacali, di organizzazione e di associazione, si viene a minare quello che è il principale mezzo a nostra disposizione per creare sviluppo in Cambogia.

La risoluzione punta chiaramente a far sì che questa legge non venga approvata, perché manderebbe il paese 100 anni indietro, e cerca di continuare, attraverso il dialogo, a mantenere in vita progetti di sviluppo in grado di garantire alla Cambogia un futuro migliore.

  Mark Demesmaeker, Auteur. Voorzitter, in Cambodja wil de regeringspartij door middel van een controversiële wet het verenigingsleven aan banden leggen. De Cambodjaanse Volkspartij, die al sinds 1979 de lakens uitdeelt, wil alle ngo's en vakbonden ertoe verplichten zich te laten registreren en uitgebreid verslag uit te brengen over hun activiteiten en over hun financiën.

Eerste minister Hun Sen vreest dat ngo's en vakbonden als een dekmantel voor buitenlandse mogendheden gebruikt worden om het regime te destabiliseren.

De civiele maatschappij is uiteraard niet te spreken over dit initiatief. Ze ontkent niet zozeer de behoefte aan een wettelijke regeling voor de circa 5 000 ngo's, maar neemt het niet dat de regering het wetsontwerp in het geheim en zonder een publiek debat opgesteld heeft en op een drafje door het parlement wil jagen.

Ondertussen mobiliseert de civiele maatschappij massaal. Eergisteren woonden nog honderden verontruste burgers een infomoment over de wetteksten bij. Zij zijn natuurlijk bang voor een inperking van de democratische verworvenheden.

Wij roepen de regering op om de twee wetsontwerpen in samenspraak met de civiele maatschappij te herzien. We zijn blij dat we hen een hart onder de riem kunnen steken dankzij deze resolutie.

  Jeroen Lenaers, author. Mr President, I would like to thank Commissioner Malmström for staying with us this afternoon. It is highly appreciated by all of us. I am very happy that we have such a strong and united position from Parliament – a strong position that basically says that where civil society flourishes, democracy flourishes, and where trade unions can work and can function properly, democracy flourishes.

We have two very key messages for the Government of Cambodia. Please withdraw the law on associations and NGOs, as well as the law on trade unions. Also, please make sure that any future draft legislation in this area commits to internationally recognised fundamental freedoms and is only adopted through an inclusive process that includes dialogue with stakeholders, NGOs and civil society.

Señor Presidente, el Parlamento Europeo, el mismo que exige a la Comisión la firma de agresivos tratados comerciales con los países en desarrollo, que facilita la penetración de las grandes multinacionales en sus economías, finge sorprenderse de sus trágicas consecuencias, que no son otras nada más que la expulsión de los campesinos de sus tierras y la explotación de los trabajadores en las fábricas exportadoras.

Queremos hacer un llamamiento al Gobierno de Camboya: que asegure el respeto de los convenios de la Organización Internacional del Trabajo en materia sindical y laboral, permitiendo a los trabajadores organizarse frente a las multinacionales; también que frene y revierta el terrible acaparamiento de tierras por parte de las grandes agroexportadoras.

Pero la responsabilidad de Europa va más allá de recordar estos principios fundamentales: Europa debe actuar para que el reconocimiento pleno de los derechos laborales y del derecho a la tierra esté incluido en sus acuerdos de asociación y cooperación, especialmente con los países menos desarrollados.

Solo así podrá evitar colaborar en la explotación de trabajadores que ahora denuncia.

  Marietje Schaake, author. Mr President, we are all worried that the vital role that Cambodian civil society plays – and there are around 5 000 NGOs registered – will be stifled by the proposed NGO law, which is restrictive and contradicts not only the Cambodian Constitution but also the international law commitments that the government is bound by.

With our strong commitment to human rights, the EU is spending about EUR 410 million between 2014 and 2020. We call on Cambodia’s authorities not only to respect human rights but to appreciate the vital role for liberties that a flourishing civil society has and represents as an integral part of sustainable development and growth, and to appreciate that the two should go hand in hand. We urge the Cambodian Government to act accordingly and respect the freedoms and rights of association of civil society.

  Josef Weidenholzer, Verfasser. Herr Präsident! Kambodscha ist eines der meistgeprüften Länder dieser Welt.

Die Verbrechen des Pol-Pot-Regimes, die bis zu drei Millionen Tote forderten, liegen immer noch wie ein Schatten über diesem Land.

Es war ein langer, schwieriger Weg aus der Düsternis dieser Jahre hin zu mehr Demokratie, zu Wohlstand und zu individueller Freiheit. Das ist erst in den letzten Jahren gelungen. Das zivilgesellschaftliche Engagement gewinnt in diesem Land immer mehr an Bedeutung.

Das Hun-Sen-Regime ist dadurch auch ins Wanken geraten. Daher ist es sehr bedauerlich, dass man gerade jetzt den Raum für NGOs und für Gewerkschaften systematisch einzuschränken beginnt.

Das ist ein Phänomen, das wir auch aus anderen Schwellenländern kennen. Aber gerade vor dem Hintergrund Kambodschas ist es notwendig, alles zu tun, um zu verhindern, dass der Weg der demokratischen Wiederfindung Kambodschas nicht schon an seinem Beginn unterbrochen wird.

  Marc Tarabella, au nom du groupe S&D. Monsieur le Président, Madame la Commissaire, chers collègues, le 30 juin dernier, des centaines de militants, d'ouvriers et de syndicalistes ont tenté de défiler dans les rues de Phnom Penh afin de montrer leur indignation face à la nouvelle version du projet de loi sur les organisations non gouvernementales et les associations, promulgué par le gouvernement cambodgien.

On ne peut que s'associer à eux, évidemment et, à mon tour, je souhaite exprimer mon courroux face à ce projet de loi qui va totalement à l'encontre de la liberté d'expression. Au-delà, c'est vrai que les droits des travailleurs sont de plus en plus menacés. Or, je me souviens qu'il y a neuf ans, pour le Parlement européen, j'ai conduit une mission au Cambodge pour aller vérifier, déjà à l'époque, que ce pays faisait des progrès et continuait à en faire sur la voie du respect des droits de l'homme. Comme M. Corrao l'a rappelé tout à l'heure, nous sommes le premier donateur du Cambodge, qui est très intéressé par cette relation avec l'Union européenne, parce que nous lui donnons de l'argent pour la politique de développement, notamment.

Ne serait-il pas temps de rediligenter une mission de manière à vérifier si ce pays continue sur la bonne voie ou non? Ne serait-il pas temps de mettre dans la balance le fait que nous leur donnons de l'aide? Ne faudrait-il pas aller là-bas pour rétablir ou en tout cas contribuer à rétablir les choses dans la bonne direction?

  Jiří Pospíšil (PPE). Pane předsedající, já jsem velmi rád za tu debatu, kterou zde poslouchám. Jako bývalý ministr spravedlnosti v České republice jsem byl odpovědný za přípravu nového občanského zákoníku, který upravuje právo sdružovací, a je mi jasné, že toto je jedno z klíčových práv každého demokratického právního státu.

My bychom měli trvat na tom, aby Kambodža přijala takový zákon, který bude splňovat evropské parametry. To znamená, aby každý spolek, občanské sdružení nebo chcete-li nevládní organizace, pokud splní základní zákonné podmínky, mohla vzniknout pouhou registrací a stát nemohl svévolně bránit mimo zákon tomu, aby takováto organizace v Kambodži vznikla a mohla fungovat. Je velmi dobře, že toto zde takto říkáme a že to spojujeme s finační pomocí, kterou Kambodži poskytujeme. Jsem přesvědčen, že pokud Kambodža nezmění svoji legislativu, mělo by to mít dopad na finanční podporu této země.

  Doru-Claudian Frunzulică (S&D). Mr President, I would like to express my worries regarding the draft laws enacted by the Cambodian Government, which will restrict freedom of association, freedom of expression and freedom of assembly and will violate the Constitution, shrinking significantly the space of civil society in Cambodia. The most urgent draft law on associations and non-governmental organisations will severely affect cooperation with grass-roots-level NGOs’ and also the bilateral cooperation of the European Union development cooperation and the European Union Member States’ development cooperation programmes.

I strongly believe that, since NGOs have made an important contribution to rehabilitation, reconstruction and development for the past 30 years in Cambodia, and since the EU is its largest partner in terms of development assistance, based on respect for the democratic principles and fundamental human rights established by the Universal Declaration on Human Rights, we need to support the call for the government to fully withdraw this law.

  Ivan Jakovčić (ALDE). Gospodine predsjedniče, nakon svega što je Kambodža doživjela, nakon ratova i tragedija koje su se događale u Kambodži očekivali smo napredak te zemlje.

Ovim odlukama Kambodža nazaduje, a ne napreduje. Pokušaji otimanja zemlje, smanjivanja ili ukidanja sindikalnih prava, sve ono što se čini nevladinim organizacijama, u smislu poštivanja sloboda, udruživanja i ljudskih prava, nešto je što jasno pokazuje da Kambodža nazaduje.

Zemlja je to prema kojoj smo osjećali simpatiju i zemlja za koju vjerujemo da može dobro surađivati s Europskom unijom. I tu EU treba postaviti jasan princip – mi moramo i imamo pravo tražiti da se poštuju one vrijednosti koje mi dijelimo i da Kambodža, ako želi suradnju s nama, mora također ispoštovati elementarne vrijednosti koje njeguje EU.

  Fabio Massimo Castaldo (EFDD). Signor Presidente, onorevoli colleghi, ci troviamo di fronte a un triplice attentato, colleghi, un attentato alla libertà e ai diritti di base dell'uomo, a quello delle organizzazioni internazionali e a quelli dei diritti sindacali.

Hun Sen, il Primo ministro cambogiano, sta puntando sempre di più verso una svolta autoritaria. Questa legge, purtroppo, ne è la dimostrazione più lampante, insieme al famoso progetto di legge sul cybercrime, di cui ancora non si conosce il testo ma che, sulla stessa falsa riga, colpirà anche la libertà di espressione online.

Noi, come principale donatore, possiamo pretendere molto dalla Cambogia, ma dobbiamo pretendere molto anche da noi stessi affinché si possa garantire una politica nostra commerciale coerente e un comportamento delle nostre multinazionali che non vada ad accaparrarsi le terre dei cambogiani, sostenendo appunto svolte autoritarie di questo tipo.

Il Patto dei diritti civili e politici ci ricorda che le libertà di espressione, di associazione e di assemblea non sono negoziabili. Pertanto chiediamo un'azione forte e concreta della Commissione, che chieda al governo cambogiano di retrocedere immediatamente da questa iniziativa.

Elnök Úr, szeretettel és tényleg nem provokációképpen kérdezem képviselőtársaimtól, és nagyon konkrétan remélem, hogy ott van a fülén – nem látok el odáig – a tolmácskészülék a biztos asszonynak. Ugye, Biztos Asszony, hall engem, mert Öntől szeretnék majd konkrét választ. Hall engem, ugye? Tehát kérdezem, hogy az Európai Bizottság tud-e Szima Juditnak az ügyéről. Szima Judit a legjelentősebb szakszervezeti vezető volt Magyarországon. Most ítélték őt három év szabadságvesztésre rendkívül gyanús körülmények között szakszervezeti tevékenységével összefüggésben. Ő a rendőrség szakszervezetének volt a vezetője. Akkor ismerte meg őt az ország, amikor 2006-ban tömeges rendőri brutalitásra került sor Magyarország utcáin, és ő volt az, aki felhívta a bajtársait arra – nyilvánosság előtt –, hogy a jogellenes parancsot tagadják meg. Vajon Kambodzsa szakszervezeti ügyeivel kell-e foglalkoznunk, amikor ma Magyarországon, egy EU tagállamban ilyesmi előfordulhat? Várom konkrét válaszát.

  Cecilia Malmström, Member of the Commission. Mr President, I think we are discussing Cambodia, so we can come back to the Hungarian situation some other time.

As many of you have pointed out, Cambodia does indeed have a very vibrant civil society, and many NGOs and associations are active in various areas. The Cambodian Government has for many years argued that an overarching law on associations and NGOs was necessary to provide simple and transparent regulation to the sector.

We in the European Union have been following this very closely since the idea of the legislation first surfaced many years ago. The draft laws have been a recurring topic in informal and formal meetings between the EU and the Cambodian Government. Our delegation and our ambassador there are very active and have frequent contact at different levels to make sure that our views on this are crystal clear and passed on to the government. We have made clear to them that the legislation that they are planning should enable, and not limit, freedom of association and expression in Cambodia. We have pointed out that a democratic process needs to be transparent and include meaningful consultation with all relevant stakeholders.

A culture of dialogue is the basis of any democracy – dialogue with the opposition, civil society and the private sector. It is only through this dialogue that the government can take into account the needs and concerns of those who are subject to the legislation, and an inclusive process enables government to enact laws that are truly in the interest of the people.

The National Assembly of Cambodia has a very important role to play here, so we welcome the decision by the National Assembly to organise consultations on the draft NGO law, and some of these have actually started to take place already. We hope that the results of this will be reflected in the text of the law. It is also important to have, as some of you do, peer-to-peer contacts between European Parliament Members and Members of the Cambodian National Assembly, in order to help them strengthen the capacity to scrutinise and to improve legislation in close contact with civil society and in a spirit of dialogue.

We will continue to monitor the situation and developments, because in times when civil society and trade unions often face increasing obstacles and restrictions in many countries, Cambodia has an opportunity to prove that it is truly committed to strengthening its democratic credentials.
