  Der Präsident. – Als nächster Punkt der Tagesordnung folgt die Aussprache über die Anfrage zur mündlichen Beantwortung an die Kommission über die Lage in Ungarn: Folgemaßnahmen zur Entschließung des Europäischen Parlaments vom 10. Juni 2015 von Claude Moraes im Namen des Ausschusses für bürgerliche Freiheiten, Justiz und Inneres (O-000140/2015 - B8-1110/2015) (2015/2935(RSP)).

  Claude Moraes, author. Mr President, on behalf of the LIBE Committee, allow me to present the oral question to the Commission which we have tabled concerning the situation in Hungary. On 10 June Parliament adopted a resolution in plenary on this situation, where it asked the Commission to assess the situation and to establish an EU mechanism to monitor democracy, the rule of law and human rights annually across the EU. The aim of the resolution is not to single out a single Member State or government but to call on EU institutions, particularly the Commission as the guardian of the EU Treaties, to fulfil an obligation to ensure the application of and compliance with the Treaties and the Charter of Fundamental Rights of the EU, across the Union.

The EU, as we all know, was founded on values of respect, freedom, democracy, equality and rule of law as well as human rights. With this in mind it is important that Member States and all EU institutions work together to protect these basic European principles.

In paragraph 11 of the resolution the European Parliament urged the Commission to ‘activate the first stage of the EU framework to strengthen the rule of law, and therefore to initiate immediately an in-depth monitoring process concerning the situation of democracy, the rule of law and fundamental rights in Hungary, assessing a potential systemic serious breach of the values on which the Union is founded as per Article 2 TEU including the combined impact of a number of measures exacerbating the state of democracy, the rule of law and fundamental rights, and evaluating the emergence of a systemic threat to the rule of law in that Member State that could develop into a clear risk of a serious breach within the meaning of Article 7 TEU’, and asked the Commission to ‘report back on this matter to Parliament and the Council before September 2015’.

So I put the following questions to the Commission: Has the Commission carried out this in-depth monitoring process as requested by Parliament? If not, can the Commission explained the reasons for not having initiated such in-depth monitoring? Secondly can the Commission provide the European Parliament with its assessment of the situation of democracy, the rule of law and fundamental rights in Hungary today? Third, has the Commission activated the Rule of Law Framework as called for by the European Parliament, and if not, can the Commission provide a reasoned argument for not having done so?

I am very much looking forward to the responses of the Commission and the debate of Members on these key questions.

  Věra Jourová, Member of the Commission. Mr President, I would like to thank Parliament for the oral question on the situation in Hungary. I know that there is a lot of discussion on whether to trigger Article 7 of the Treaty on European Union or the Rule of Law Framework as regards Hungary. Today I would like to set out for the House what action the Commission is taking to monitor the situation in Hungary, and to ensure that European Union law and fundamental values remain respected there. And it is against that background that I will also explain to you why the Commission does not believe that there are grounds at this stage to trigger Article 7 or the Rule of Law Framework.

During our previous debates I have always made it clear that the Commission will be vigilant when concrete measures and actions are taken by the Hungarian authorities. I have also said that the Commission will use all the means at its disposal to ensure that Hungary – as well as any other Member State – complies with its obligations. And you know that the Commission has already done so in the past when it took Hungary, for instance, successfully to Court for the early retirement of judges or violation of the independence of the Data Protection Supervisor.

This is what we have done. Following Parliament’s resolution of 10 June 2015, the Commission has taken a number of actions with respect to the recent developments in Hungary. Let me give you a brief overview.

As regards migration, the Hungarian Government formally announced on 15 September 2015 a ‘crisis situation caused by mass immigration’ on the basis of legislation that had entered into force that same day. A preliminary assessment of the Hungarian legislation revealed a number of concerns and questions on substance and implementation relating in particular to the compatibility of this legislation with the EU’s asylum and borders acquis, and the EU Charter of Fundamental Rights. These issues were addressed by the Commission’s services in a letter sent on 6 October 2015 to the Hungarian authorities.

A detailed reply from the Hungarian authorities was received on 4 November, which clarified a number of questions but did not remove all outstanding concerns. This response is currently under assessment by the Commission.

As regards the debate on the reintroduction of the death penalty, both Commission President Juncker and First Vice-President Timmermans made clear statements on this: Article 2 of the EU Charter of Fundamental Rights prohibits explicitly and clearly any person from being condemned to death, or executed. In addition, the European Court of Human Rights has ruled that the death penalty is a violation of the European Convention on Human Rights. The abolition of the death penalty is a condition which states are required to meet in order to become members of the Council of Europe or of the European Union. The reintroduction of capital punishment would be contrary to the EU’s fundamental values. A reintroduction of the death penalty by a Member State would therefore lead to the application of Article 7 of the Treaty. The debate launched by Prime Minister Orbán did not materialise and the death penalty has not been introduced.

As regards the situation of civil society in Hungary, the Commission expressed its concerns about the disagreement between Norway and Hungary and about the follow-up to this dispute, which may have a serious impact on a number of NGOs working on the promotion of human rights in Hungary, and negatively affect the functioning of the European Economic Area and Norwegian financial mechanisms.

The Commission’s services sent an administrative letter to the Hungarian authorities underlining this concern. On 7 October this year it was reported that the National Tax Authority had closed its investigation into the NGOs relating to the European Economic Area/Norway grants. The decision to withdraw the tax registration numbers of the NGOs concerned is still pending before a Hungarian court. We have also noticed that a Hungarian court ruled that a police raid on watchdog NGOs in 2014 was illegal.

As regards the situation of Roma, the housing situation remains a concern. The Commission’s services started an EU pilot procedure and are assessing the matter in the light of the Directive on Racial Equality, which prohibits discrimination on grounds of ethnic origin in a number of fields, including housing.

On the education of Roma, concerns remain as well, in particular relating to possible segregation and discrimination of Roma children. Also on this matter the Commission’s services started an EU pilot procedure and are following further developments, again in the light of the Directive on Racial Equality.

As regards the transposition and implementation of the Framework Decision on racism and xenophobia in Hungary, a meeting took place on 15 October 2015 between the Commission’s services and the Hungarian authorities to discuss a number of outstanding issues. The meeting was part of a series of bilateral dialogues held during the past year with Member States on this topic prior to the possible launching of infringement procedures.

I can assure you that the Commission will not hesitate to take action to ensure the proper transposition and implementation of the Framework Decision by Hungary, like any other Member State. We underlined this in the European Agenda on Security as well as during the Commission’s Colloquium on Fundamental Rights in October.

As regards the situation of the media, the Hungarian Parliament amended on 27 May 2015 its advertising tax law, following an EU Pilot procedure and an in-depth state aid investigation launched by the Commission. As a result, the EU Pilot procedure could be closed, while the state aid investigation continues, as certain state-aid related aspects still remain to be clarified.

The Commission has also taken note of the opinion of the Venice Commission of 22 June 2015 on Media legislation in Hungary and is following the response of the Hungarian authorities to the recommendations contained therein.

As regards corruption and misuse of EU funds, the Commission suspended on 14 July 2015 payments for several contracts across eight programmes due to the use of an excessively restrictive selection criterion in public procurement procedures. The Commission had already suspended interim payments to Hungary from the European Regional Development Fund for priorities 1, 2 and 3 of the operational programme ‘Economic Development’. This suspension was lifted by the Commission on 23 September 2015, following corrective action by the Hungarian authorities. OLAF is continuing investigations.

In the context of the European Semester, the Commission noted continued shortcomings as regards corruption and lack of transparency affecting public administration, decision-making and public procurement in Hungary. Following a Commission proposal, country-specific recommendations were adopted by the Council on 14 July 2015, calling for action to address these issues.

The Commission is actively pursuing infringement procedures against Hungary in a range of other areas. Several infringement procedures are rule-of-law related, for instance, concerning the principle of legal certainty, the effectiveness of judicial review, or the powers and independence of administrative authorities. Other infringement procedures are related to economic discrimination, in particular affecting the freedom of establishment, the freedom to provide services or the free movement of capital.

In addition, the Commission is actively conducting state aid investigations, inter alia concerning two recent Hungarian measures with steeply progressive rate structures, notably a food-chain inspection fee and a new tax on sales of tobacco products. In these cases the Commission issued injunctions, prohibiting Hungary from applying the progressive rates until the Commission has concluded its assessment. The Commission also opened, last week, in-depth state aid investigations into Hungary’s plans to provide financing for the construction of two new nuclear reactors in the Paks plant.

The Commission is also following how the judiciary in Hungary is fulfilling its role of guarantor of the rule of law. In recent months a number of noteworthy judgments have been rendered by the Supreme Court, the Constitutional Court and also by ordinary Hungarian courts.

This overview demonstrates that the Commission is actively monitoring the situation in Hungary and is ready to use all the means at its disposal to ensure that Hungary – as well as any other Member State – complies with the obligations under European Union law and respects the values of the European Union enshrined in Article 2 of the Treaty on European Union. This includes using infringement procedures in case of violations of European Union law as well as the EU Rule of Law Framework where this is necessary.

The Commission has at this stage not activated the Rule of Law Framework as regards Hungary. The Rule of Law Framework will be activated where there are clear indications of a systemic threat to the rule of law in a Member State, in particular in situations which cannot be effectively addressed by infringement procedures and if the ‘rule of law safeguards’ which exist at national level no longer seem capable of effectively addressing these threats. These national ‘rule of law safeguards’ refer to all judicial and constitutional mechanisms and safeguards which aim to ensure the protection of democracy and fundamental rights in a Member State.

Considering that concerns about the situation in Hungary are being addressed by a range of infringement procedures and pre-infringement procedures, and that also the Hungarian justice system has a role to play, the Commission takes the view that the conditions to activate the Rule of Law Framework regarding Hungary are at this stage not met.

The Commission will continue to monitor the situation in Hungary closely, including the functioning of the national rule of law safeguards referred to above.

  Monika Hohlmeier, im Namen der PPE-Fraktion. Herr Präsident, Frau Kommissarin, liebe Kolleginnen und Kollegen! Zunächst einmal ein herzliches Dankeschön an die Kommissarin für den doch sehr umfassenden Überblick. Und auch ein Dankeschön für die Antwort, die Sie uns eigentlich schon am 5. November gegeben haben, die allerdings bedauerlicherweise die Parlamentsverwaltung nicht im adäquaten Zeitrahmen an die Abgeordneten weitergegeben hat, sodass wir dementsprechend die Antwort leider so spät erhalten haben, dass wir Ihnen in der Anfrage noch einen unberechtigten Vorwurf entgegengebracht haben, nämlich den, dass Sie uns angeblich nicht geantwortet hätten. Sie haben uns geantwortet, und ich möchte mich dafür ausdrücklich bedanken.

Als Zweites möchte ich mich dafür bedanken, dass Sie sehr sachlich mit dem Thema umgehen. Denn ich halte es angesichts der Probleme, die wir nicht nur in Ungarn, sondern beispielsweise auch in Griechenland und in Polen in großer Mannigfaltigkeit, aber genauso derzeit in der Slowakei und in der Tschechischen Republik im Bereich Umgang mit den Flüchtlingen, im Umgang mit Flüchtlingen und Ähnlichem zu verzeichnen haben, für dringend notwendig, dass Sie versuchen, dies auf sachliche, strukturierte Art und Weise anzugehen und die Arbeit hier mit Sorgfalt fortzusetzen.

Das, was ich von Seiten des Parlaments derzeit als problematisch sehe – und ich habe das den Kolleginnen und Kollegen schon mehrfach gesagt –, ist, dass ausschließlich der Fokus auf Ungarn gelegt wird, wo es doch genügend andere Mitgliedstaaten gibt mit ganz ähnlichen Problemen. Das Justizwesen in Griechenland leidet mindestens genauso wie das in Ungarn. Es ist unter einer linkspopulistischen und rechtspopulistischen Regierung, verzeichnet seit vielen Jahren erhebliche Probleme, ohne dass wir dies hier in diesem Parlament offensiv gegen Griechenland unter Androhung des Artikels 7 durch das Parlament diskutieren. Wir haben auch in Ungarn – nicht nur in Ungarn – Probleme mit Flüchtlingen. Wir haben dieselben Probleme in Griechenland, auch mit Menschenrechtsverletzungen. Wir haben auch Probleme in Polen, teilweise mit Argumentationsweisen, die sehr heftig sind und die sehr intensiv sind und sich gegen Flüchtlinge aussprechen, wobei jeder die Menschenrechtskonvention unterzeichnet hat und wissen muss, dass Flüchtlinge ein Anrecht haben, in einem Mitgliedstaat der Europäischen Union Zuflucht zu finden, wenn sie vor Krieg, vor Tod, vor Not und vor Elend fliehen und in ihrer eigenen Heimat nicht überleben können. Dann sind wir verpflichtet, ihnen eine Heimat zu geben. Darüber sollte es eigentlich keine Diskussion geben, sondern Solidarität unter den Mitgliedstaaten.

Ich möchte hiermit zum Ausdruck bringen, dass ich die strukturierte Art und Weise des Vorgehens sehr positiv finde. Frau Kommissarin, ich hätte die Bitte an Sie: Sie haben in Ihrem Brief geschrieben, dass es eine ganze Menge an – sozusagen – Kontrollmechanismen, Monitoringsystemen gibt. Es wäre für uns sehr interessant zu erfahren, gegenüber welchen Mitgliedstaaten in welcher Art und Weise entsprechende Verfahren durchgeführt werden, denn dann könnte auch zum Beispiel ich als Abgeordnete besser überblicken, ob die Systeme fair – sozusagen gleichmäßig – gegenüber allen Mitgliedstaaten angewandt werden oder ob der Blick doch ein bisschen zu spezifisch geraten ist. Ich glaube eher, dass Sie sehr fair vorgehen, aber ich hätte einfach Interesse daran, mehr darüber zu erfahren.

  Péter Niedermüller, a S&D képviselőcsoport nevében. Köszönöm, Elnök Úr! A Szocialisták és Demokraták Képviselőcsoportja határozottan kiáll az Európai Unió alapértékei mellett. Ezek az alapértékek jelentik ugyanis azt a kötőanyagot, amelyik összetartja az Uniót.

A magyar kormány 2010 óta fittyet hány az európai jogszabályokra, értékekre, nincs tekintettel a többi tagállamra, a Bizottságra, semmire és senkire. Mégis, amiről ma este vitázunk, nem egyszerűen magyar kérdés, hanem európai ügy. Az illiberális, Unió-ellenes, tagállami önzésen alapuló szélső jobboldali politika ma már nem csak Magyarországot fenyegeti, felütötte a fejét más tagállamokban is. A magyar kormány a politikájával tudatosan és szisztematikusan gyengíti az Európai Uniót. És pártcsaládja, az Európai Néppárt szó nélkül tűri ezt. Pedig tudjuk, ez a vita az Európai Unió jövőjéről szól.

A magyar miniszterelnök ma a bevándorlásválságra azt találta mondani, hogy ez az embercsempészek, a fizetett jogvédők csapatának és az Unió vezetőinek a terméke, ők csinálják ezt a menekültválságot. Kérdezem, van-e valaki a Bizottságban, vagy éppen a Néppártban, aki nyugodt szívvel azt meri mondani, hogy ez az otromba és mérgező politizálás nem veszélyezteti az Unió egészét. Aligha hiszem!

Tisztel Biztos Asszony, Ön fölolvasott egy hosszú listát, mégis engedje meg, hogy azt mondjam, az a benyomásom, hiányzik a bátorság, a politikai bátorság a Bizottságból, hogy szembenézzen a tényleges helyzettel. Örülnék, ha kiderülne, hogy tévedek! Köszönöm!

   Zdzisław Krasnodębski, w imieniu grupy ECR. Panie Przewodniczący! Troska o demokrację w Europie, o prawo, podstawowe wartości europejskie jest chwalebna. Obowiązkiem Parlamentu Europejskiego jest reagowanie na ich naruszanie w krajach będących członkami Unii. Jednak oceny i analizy sytuacji w poszczególnych krajach powinny być wyważone i oparte na faktach, nie mogą być ingerencją w demokratycznie podejmowane suwerenne decyzje tych krajów. Dlatego tak bardzo cieszy wyważone stanowisko Komisji Europejskiej.

Węgry były krytykowane w Parlamencie Europejskim za rzekomą próbę przywrócenia kary śmierci, ale nic takiego się nie zdarzyło, a rząd węgierski od samego początku zaprzeczał, że miał takie intencje. Krytykowanie rządu Węgier za to, że widzi powiązanie między zjawiskiem imigracji – masowej imigracji – a zagrożeniem dla bezpieczeństwa, jest absurdem w świetle tego, co stało się w Paryżu. Oskarżenie Węgrów o zamknięcie granicy, gdy zamierza się rozwiązać problem ochrony zewnętrznych granic UE rękami tureckimi, jest hipokryzją. Oskarżenia o populizm, nacjonalizm czy ksenofobię, rzucane bez dania racji, służą tylko jako broń polityczna przeciwko niewygodnym rządom lub partiom politycznym.

Szanując niemiecką Willkommenskultur, nie możemy się zgadzać na narzucanie jej wszystkim krajom Europy. Szanując różnorodność poglądów politycznych jako esencję demokracji, nie możemy zgodzić się na monopol poglądów lewicowo-liberalnych w Europie. Warto przypomnieć artykuł 3a traktatu lizbońskiego: „Unia szanuje równość państw członkowskich wobec Traktatów, jak również ich tożsamość narodową nierozerwalnie związaną z ich podstawowymi strukturami politycznymi i konstytucyjnymi. Szanuje podstawowe funkcje państwa, zwłaszcza funkcje mające na celu zapewnienie jego integralności terytorialnej”.

  Sophia in 't Veld, on behalf of the ALDE Group. Mr President, contrary to the previous speaker, I do not think that this is about national culture or being left-wing or right-wing; that is rubbish. This is about the European Union being a community of values. This should be a space where every single European citizen can live in freedom, make choices for his or her life without having to fear the authorities.

The thing is, listening to the Commission – not just now but during all the years in the past – the Commission is taking a fairly narrow legalistic approach, and I understand that it does not have that many instruments to do anything else, but the Commission is only assessing whether there is a strict violation of European Union laws. But let us be fair – and I think the Commissioner would agree with me – if we look at the state of Hungary today, is it a place where people are free, happy citizens? No, because there is a government there that is fuelling xenophobia and homophobia, that is harassing the media, harassing NGOs, harassing the opposition – just yesterday 17 people from the opposition were arrested on charges of defamation – restricting free research, and I could go on and on.

Maybe we do not really have a legal instrument to tackle this but we need a political instrument because, quite frankly, I too, like most of my Hungarian colleagues probably, are tired of talking about Hungary. Soon we will be having similar debates about Poland. I have serious concerns about Poland as well. The Polish Government is saying: ‘Oh, we think Mr Orbán is a perfect example to follow.’ What has the new parliament done? It has fired five judges and immediately appointed new ones. That makes me really concerned about the independence of the judiciary.

So I do think that we need to move beyond monitoring the situation or silent diplomacy. I mean, Mr Timmermans’ silent diplomacy is so silent that I do not even see him here today. I really hope that with all the Groups in this House we are going to elaborate the Democratic Governance Pact, which will serve to monitor and debate the situation in all Member States to ensure that we will have, or we will be, this community of values.

  Marie-Christine Vergiat, au nom du groupe GUE/NGL. Monsieur le Président, depuis mai 2010, la situation des droits de l'homme en Hongrie ne cesse de se dégrader. Ce Parlement a eu l'occasion d'en débattre et de voter des résolutions pour demander à la Commission d'agir.

Effectivement, la Hongrie n'est pas le seul État concerné, tous les États sont plus ou moins concernés par les violations des droits de l'homme, et il serait bien que les uns et les autres cessent leurs obsessions politiciennes.

Votre réponse, Madame la Commissaire, était longue, mais ne me satisfait pas. La commission est-elle vraiment gardienne de tous les articles du traité? Qu'en est-il du rôle du Parlement européen si notre résolution de juin dernier semble passer en pertes et profits? La charte des droits fondamentaux fait-elle vraiment partie intégrante des traités? Comment peut-elle sans cesse être bafouée sans réaction réelle de votre part?

Alors oui, les droits des migrants sont symboliques. Ils sont violés en Hongrie comme ailleurs, et notamment en France, mon pays. Mais je rappelle qu'en Hongrie, la police a désormais le droit de tirer sur les migrants.

Quand je vous entends, Madame la Commissaire, je suis triste. Je constate une fois encore que la Commission est plus efficace en matière d'économie: vous nous avez parlé d'aides d'État, d'augmentation des taxes, mais qu'en est-il des droits des personnes?

Vous attendez les décisions de justice, mais vous nous dites vous-même que la justice pose problème dans ce pays. Alors, il n'est plus temps d'écrire, il n'est plus temps de dire, il n'est plus temps de se préoccuper, il faut agir sans attendre que la peine de mort soit rétablie, comme vous venez de nous le dire.

  Judith Sargentini, namens de Verts/ALE-Fractie.Mevrouw de commissaris, u zegt dat er genoeg verslagen zijn en dat er genoeg onderzoek is. We hebben niet meer mechanismen nodig en ik deel die opinie eigenlijk wel met u. Er is een heleboel bekend, maar er wordt niet naar gehandeld. U zegt ook bij de voorbeelden die u geeft: Viktor Orban heeft inderdaad gesproken over de doodstraf, maar de voorstellen zijn niet gematerialiseerd. Dat zou er nog eens bij moeten komen, zou ik willen zeggen. Maar is dat niet al een enorm probleem an sich, dat hier altijd maar over gepraat mag worden, dat het gesprek in Europa steeds harder wordt, dat iedereen als een soort van disclaimer zegt: ik wil de vluchtelingen niet met de terroristen vergelijken, maar ...?

Ik heb mijn spreektekst weggegooid, want ik las vanavond The Guardian waarin Donald Tusk, de voorzitter van de Europese Raad, zegt dat iedere migrant die in Europa aankomt 18 maanden moet worden opgesloten, opdat wij de veiligheid in acht kunnen nemen, opdat wij kunnen kijken of die migrant niet eigenlijk een terrorist is. Voorzitter, mevrouw de commissaris, ik begrijp in het licht van dit soort debatten in Europa best dat u de ruimte niet heeft om een rechtsstatelijkheidsmechanisme in te zetten. Ik begrijp dat. Maar ik weet echt niet meer wat ik in dit Europees Parlement moet doen op een moment dat de voorzitter van de Europese Raad zegt: iedere migrant die binnenkomt, moet 18 maanden vastgezet worden. Natuurlijk krijgt u nooit de steun in de Raad voor een optreden richting Hongarije of voor een activiteit richting Polen, dat nu zijn rechters aan het ontslaan is, als de voorzitter van de Raad dit kan vinden en het niet weersproken blijft. Mevrouw de commissaris, eigenlijk wil ik maar één ding: ik wil dat wij vanavond hier de opmerking van Tusk dat vluchtelingen, migranten 18 maanden moeten worden opgesloten, dat we die hier met z'n allen terugnemen.

A essere minacciati sono i principi democratici, lo Stato di diritto e i diritti umani. La realtà è che nessuna forte azione è stata intrapresa, soprattutto a livello europeo, per reagire a quella che da più parti viene considerata una minaccia ai valori fondanti dell'Unione europea. Persino due giorni fa, è stata presentata da parte dei cittadini, è stata registrata sul sito della Commissione europea, un'iniziativa che chiede l'applicazione dell'articolo 7 del trattato sull'Unione europea. Occorre dunque dare un'adeguata risposta da parte dell'Unione europea, occorre dotarsi di un meccanismo di tutela dei diritti fondamentali che agisca a livello preventivo e non aspettare che ad esempio la pena di morte venga introdotta, per poi sanzionare uno Stato membro, altrimenti il rispetto dei diritti fondamentali sarà destinato a rimanere soltanto una dichiarazione di intenti.

  Nicolas Bay, au nom du groupe ENF. Monsieur le Président, une fois de plus, cet énième débat sur la Hongrie prend des tournures de lynchage à l'encontre du gouvernement de Viktor Orbán. Drôle de conception de la solidarité européenne dont vous nous rabattez pourtant les oreilles. Car, au fond, que reproche-t-on au chef du gouvernement hongrois? De respecter à la lettre les accords de Schengen? Ces accords prévoyaient la libre circulation à l'intérieur de l'Union européenne et je ne ferai pas grief aux pays de l'ex-Union soviétique d'en avoir été de fervents partisans. Mais en contrepartie, ces mêmes accords étaient censés garantir les frontières extérieures de l'Union européenne. Or, devant l'échec manifeste de Frontex, face à l'absence de volonté politique d'endiguer l'afflux sans précédent d'immigrés clandestins, M. Orbán fait ce que tous les responsables européens auraient dû faire, il protège son peuple de cette immigration massive et incontrôlée dont il a pu voir les conséquences en Europe occidentale: chômage de masse, communautarisme et, aujourd'hui, terrorisme.

Quand on voit ce qu'est devenue Bruxelles, aujourd'hui en état de siège, on comprend que Viktor Orbán veuille préserver Budapest de votre folie.

  Zoltán Balczó (NI). Elnök Úr, köszönöm a szót! Ismét az Európai Parlament napirendjén szerepel a magyarországi helyzet. Ha föltesszük a kérdést, hogy kellene-e javítani Magyarországon a jogállamiság és a demokrácia viszonyain, a válasz az, hogy igen. Két területet említek, az egyik az egyre nyíltabbá váló korrupció, a másik pedig a médiaviszonyok súlyos kiegyenlítetlensége. No de ilyen előfordul más országokban is. Miért pont Magyarország az, akivel szemben el akarják indítani azt az eljárást, ami akár a szavazati jog felfüggesztésével járna.

A válasz egyszerű: mert a magyar kormány a parlament és a lakosság nagy többségű támogatásával egy olyan bevándorlási politikát valósított meg, ami eltér attól, amit a Bizottság itt képvisel, meg a Parlament többsége, de eredményes. Megvédte a saját szuverén határait és ezzel együtt a schengeni határokat. És igen, a kvóta-rendszert helytelennek tartja, mert nem elosztani kell a bevándorlókat, hanem a bevándorlást meg kell akadályozni.

Kellene egységes közös európai migránspolitika? Kellene. De eredményes kellene. Ehhez pedig szembe kéne nézni azzal, hogy ez a szervezett bevándorlókkal való elözönlés ez egy háború része. És egyébként hadd tegyem hozzá: azért, mert egy ország, annak lakossága nem olyan táblákkal várja a bevándorlókat, hogy „Refugee welcome”, attól még nem xenofób. Köszönöm!

  Victor Boştinaru (S&D). Mr President, I listened carefully to the Commissioner’s speech, which lasted more than 15 minutes, on the long list of violations and the saga of the illiberal democracy of Viktor Orbán. My question is, what is enough for the EPP Group and what is enough, and when is it enough, for the European Commission?

Let me be clear from the outset that we have to distinguish between Orbán’s dangerous behaviour and the Hungarian people. The choice of the present instrument, an oral question, is the result of a very mature and responsible debate within my political group which aims exactly at this: protecting Hungarian citizens and not penalising them for the severe infringements carried out by the Hungarian Prime Minister.

It is high time to understand how Parliament can be both offensive and effective against Viktor Orbán without falling into the trap of his extremist populist rhetoric. The time has come for the Commission to assume its responsibilities as outlined by the Treaties and to unmistakably identify and present the deficiencies and shortcomings in terms of rule of law and democracy registered by Orbán and his government, and to take action now.

  Ангел Джамбазки (ECR). Г-н Председател, г-жо Комисар, колеги, днес за пореден път обсъждаме положението в Унгария, както правихме преди около половин година.

С оглед на всички останали безспорно тревожни теми според мен този дебат е напълно ненужен, той е едно хабене на време, хабене на усилия, с една-единствена цел - да се отправят поредни безсмислени критики към управлението на Виктор Орбан. Още по-малко подкрепям идеята да се подготвят много резолюции на тази тема. С какво тези резолюции ще са по-различни от тази, която беше предложена на 10 юни?

На 10 юни изискахме от Комисията да проведе наблюдение по отношение на положението с демокрацията, принципите на правовата държава и основните права в Унгария.

Да, всички страни членки трябва да спазват поетите задължения и да защитават основните права, но да, всички ние имаме право на мнение и право да изразим и защитим това мнение, но не бива да се намесваме в процедурата за наблюдение, тъй като тя не попада в компетенциите на този законодателен дом.

Според член 17 от Договора за Европейския съюз само и единствено Европейската комисия има компетенциите да проведе такова проучване и само тя има право да установи дали европейското право и трактати са били нарушени.

Уважаеми колеги, слушам тази дискусия от известно време и си мисля следното нещо: преди малко чух, че поведението на Виктор Орбан било опасно. Не, не мисля. Мисля, че поведението на тези, които не разбират какво се случва в Европа, е опасно.

Поведението на тези наши колеги, които не разбират, че ситуацията е крайно променена, че в момента се намираме във война и че тази война няма да свърши, ако ние не защитаваме своите ценности, своите национални държави. Останалото е губене на време, останалото до голяма степен, уважаеми колеги, са празни приказки и лицемерие.

  Cecilia Wikström (ALDE). Mr President, it is with great distress that we have witnessed the constantly worsening state of democracy and rule of law in Hungary over the past years. The freedom of the media has been curtailed through Fidesz-controlled media supervisors who have brought about fear and self-censorship. The court system has been politicised and the freedom of minorities is being trampled on by the Government.

This week we saw the arrest of a number of opposition politicians in Hungary, purely for having shared political criticism of Fidesz policies on Facebook. It was notable that, although these posts were shared by many individuals, the actions of the now Fidesz-run judiciary of Hungary targeted its attacks at active members of the political opposition.

I am usually a big fan – a supporter even – of the Commission, but I would say to the Commissioner that on Hungary, quite frankly, the Commission is nothing but pathetic in your inaction. You have done absolutely nothing with regard to Parliament’s resolution adopted in June. You only offer words and hot air and not a single concrete political action. You are supposed to be the guardians of the treaties, not the guardians of oppressive governments. What are you waiting for? Does Mr Orbán have to turn into an exact copy of Mr Lukashenko before you wake up and smell the coffee? I find it appalling. Your inaction leaves a lot to be desired by citizens out there. Take action on this and do it now.

   Marina Albiol Guzmán (GUE/NGL). Señor Presidente, el Gobierno del señor Orbán en Hungría está violando de manera sistemática los derechos humanos. Su propuesta de implantar la pena de muerte; el trato inhumano a los refugiados y refugiadas en las fronteras; la constante violencia contra los y las migrantes. Y aún no ha habido ninguna sanción contundente a este Estado miembro de la Unión Europea. ¿Por qué? Pues porque es uno de los suyos. Porque es del Partido Popular Europeo.

Porque estuvo hace unas pocas semanas en el Congreso del Partido Popular Europeo en Madrid junto al señor Mariano Rajoy, a la señora Merkel y hasta a Berlusconi. Y allí aplaudían ustedes su discurso xenófobo. Le amparan, le palmean, porque protegen a sus amigos y porque, en el fondo, en realidad, muchos, en el fondo, comparten su programa.

Számtalanszor elmondtuk már, hogy a magyarországi demokratikus helyzetről szóló vita elsősorban nem Magyarországról szól, hanem Európáról. Arról, hogy ez az alapító atyák által megálmodott integráció egy szimpla gazdasági együttműködés, vagy egy olyan értékközösség, közösen elfogadott erkölcsi normákkal, a jogállamiságra vonatkozó elvárásokkal, amelyek betartását ki is kényszeríti a tagjaitól.

A Bizottság tehetetlensége és késlekedése az ezeket a közös értékeket következetesen és rendszerszinten megsértő magyar kormány kapcsán azokat erősíti, akik szívesen semmibe veszik ezeket az értékeket szerte Európában. Akik, mint Orbán Viktor, az EU-t nem tekintik többnek egy balek fejős tehénnél. Akik számára a közös Európa csupán egy bűnbak, amelynek a hátán politikailag felkapaszkodhatnak. A tehetetlenség látványa azonban ragadóssá teszi ezt a példát. Akik most késlekednek, vihart fognak aratni. Akik most nem cselekszenek, később már gyengék lesznek cselekedni. Később késő lesz, tisztelt Képviselő társaim!

  Bill Etheridge (EFDD). Mr President, here you go again. All for the rule of law, as long as it is your law. All for freedom, as long as it is the freedom to live within EU constraints. I saw disgraceful disrespect to the leader of a sovereign independent government when Mr Orbán came to Strasbourg. He was treated in an appalling manner and why? Because he dared to consult with his people about immigration, about law and order? Now he has upset you again by building a fence to keep out immigrants.

Well, you might not like it, but this is the elected government of a sovereign state. They should have the right to make their own laws. Any attempt to change the situation in Hungary would be a sinister EU regime change. The people of Hungary should follow the example of the people of the UK, regain their independence and freedom, and leave the EU.

  Jean-François Jalkh (ENF). Monsieur le Président, Madame le Commissaire, chers collègues, le 10 juin dernier, notre Parlement a adopté une proposition pseudo-moralisatrice pour dénoncer la volonté de renaissance politique initiée depuis maintenant cinq ans en Hongrie par M. Orbán.

Depuis cette date, le gouvernement hongrois a aggravé son cas aux yeux du politiquement correct bruxellois. Il a érigé avec succès une barrière dissuasive à la frontière de son pays, il a refusé le système des quotas qui dilue et pérennise l'invasion migratoire, il a fait école en animant une véritable résistance politique en Europe centrale, réunie dans le groupe de Visegrád, avec la Pologne, la République tchèque et la Slovaquie.

Contrairement aux vrais candides et aux faux naïfs qui peuplent notre assemblée – et je ne parle pas des hypocrites – M.  Orbán n'a pas attendu les événements tragiques de Paris pour agir. Ses craintes étaient fondées puisque nous avons appris, il y a seulement quelques heures, que le cerveau présumé des attentats de Paris, Salah Abdeslam, de retour de Syrie, avait transité par la Hongrie et l'Autriche avant les attentats parisiens.

La volonté de M. Orbán de préserver la sécurité et les libertés des Hongrois vaut mieux que votre aveuglement coupable d'hier et votre molle politique sécuritaire brouillonne et inefficace d'aujourd'hui.

Merci à Budapest de donner à l'Europe des peuples comme à celle des oligarchies des leçons de lucidité et de bonne gouvernance.

  Γεώργιος Επιτήδειος ( NI). Κύριε Πρόεδρε, σύντομα θα κληθούμε να πιέσουμε την Ευρωπαϊκή Επιτροπή να επιβάλει μέτρα κατά της Ουγγαρίας επειδή αυτή έχει κατηγορηθεί ότι παραβιάζει θεμελιώδεις αρχές της Ευρωπαϊκής Ενώσεως, του κράτους δικαίου και της δημοκρατίας. Και όλα αυτά, γιατί ως ανεξάρτητο και κυρίαρχο κράτος, έλαβε μία απόφαση η οποία δεν άρεσε σε ορισμένους κύκλους της Ευρωπαϊκής Ένωσης.

Η όλη υπόθεση, μεθόδευση, και διαδικασία, πέραν των σκοπιμοτήτων που εξυπηρετεί, δείχνει και το μέγεθος της υποκρισίας που διακατέχει την Ευρωπαϊκή Ένωση. Το Ευρωπαϊκό Κοινοβούλιο δείχνει ευαισθησία για κάποιες πιθανές παραβιάσεις αρχών δημοκρατίας και κράτους δικαίου από την Ουγγαρία και αδιαφορεί προκλητικά όταν οι παραβιάσεις αυτές συμβαίνουν με τρόπο που δεν επιδέχεται αμφισβήτηση στην Ελλάδα.

Πόσες φορές, τόσο εγώ προσωπικά, όσο και άλλοι συνάδελφοί μου ευρωβουλευτές της 'Χρυσής Αυγής', είχαμε καταγγείλει την τότε ελληνική κυβέρνηση η οποία, χωρίς λόγο και παράνομα, φυλάκισε τον αρχηγό, βουλευτές και μέλη του κόμματός μας, της τρίτης πολιτικής δυνάμεως της χώρας; Πότε έδειξε ευαισθησία το Ευρωπαϊκό Κοινοβούλιο για τις δολοφονίες των δύο νεαρών οπαδών του κόμματός μας, του Γιώργου Φουντούλη και του Μάνου Καπελώνη, και ζήτησε με την ίδια ζέση να συλληφθούν οι δολοφόνοι τους που μέχρι τώρα κυκλοφορούν ελεύθεροι εδώ και δύο χρόνια; Πότε συγκινήθηκε το Ευρωπαϊκό Κοινοβούλιο και ζήτησε να ληφθούν μέτρα όταν τα επαχθή μέτρα του μνημονίου εξαθλίωσαν τον ελληνικό λαό;

Τώρα μας ζητάτε να συναινέσουμε σε μία συμπαιγνία εναντίον ενός κυρίαρχου κράτους...

  Inês Cristina Zuber (GUE/NGL). Senhor Presidente, acompanhamos hoje, seis meses depois de as discutirmos, muitas das considerações avançadas, tal como a preocupação e a condenação às intenções manifestadas de recuperar a pena de morte ou a discriminação e perseguição à imigração, a par dos muros da vergonha na Hungria, mas também os Estados-Membros da União Europeia, que se começam a replicar.

Não aceitamos, contudo, que - a pretexto da crise humanitária, dos abusos autoritários e antidemocráticos - em qualquer país se verifiquem, se cavalgue a democracia e se formalize a ingerência. Mantemo-nos contra o conjunto inaceitável de propostas que então e agora se pretendem implementar, em particular a inadmissível proposta de criar um autêntico ranking da democracia do Estado de direito e dos direitos fundamentais, até porque não reconhecemos à União Europeia, nem à Comissão Europeia, a legitimidade para o fazer, porque sabemos que o seu conceito de democracia difere consoante os seus interesses. Esta seria uma ferramenta da Comissão sobre os Estados-Membros cujas consequências só podem resultar em maior intervenção e ingerência.

  Juan Fernando López Aguilar (S&D). Señor Presidente, ¿qué es esto? ¿Un debate sobre Hungría? No. Es un debate sobre la situación en Hungría de la mano del Gobierno de Viktor Orbán —de la familia del Partido Popular Europeo—, instalado en una retórica nacionalista extrema y, además, agresivamente antieuropeo —rayano en la eurofobia—, que habla de la pena de muerte, levanta muros. Y, por tanto, es un debate que alcanza a toda Europa y afecta a toda Europa en la peor crisis de su historia.

Desafía los criterios de Copenhague, que no solamente se exigen cuando se ingresa en el club, sino cuando se permanece en el club. Y exigen, por tanto, una acción europea de este Parlamento Europeo y de la Comisión Europea. Y la Comisión Europea se muestra incapaz incluso de poner en marcha el mecanismo del Estado de Derecho para evaluar la falta de calidad democrática, de respeto de los derechos de las minorías, de la independencia judicial y del derecho al juez predeterminado por la ley en Hungría, como clamorosamente pone de manifiesto una iniciativa ciudadana registrada el 30 de noviembre que exige la aplicación del artículo 7.

Comisaria, convenza al Colegio de Comisarios, señora Jourová, para que la Comisión haga algo para defender los valores europeos puestos en crisis más gravemente que nunca de la mano del Gobierno de Viktor Orbán en Hungría.

  Marek Jurek (ECR), pytanie zadane przez podniesienie niebieskiej kartki. Panie Pośle! Panie Ministrze! Czy Pan sobie zdaje sprawę z tego, że artykuł 2 ustęp 2 Karty praw podstawowych zakazuje orzekania i wykonywania kary śmierci, a nie zmusza rządy do tego, żeby blokowały dyskusję.

A jeżeli mówimy o Karcie praw podstawowych, to może warto, żeby Pan sobie przypomniał, czy Pana rząd respektował prawa rodziców, które są gwarantowane w Karcie praw podstawowych, do wychowywania dzieci zgodnie z własnymi przekonaniami moralnymi. Ja widziałem w Hiszpanii, jak wtedy społeczeństwo hiszpańskie reagowało, więc naprawdę zachęcam: trochę więcej skromności.

  Juan Fernando López Aguilar (S&D), respuesta de «tarjeta azul». Señor Presidente, claro, no he escuchado ninguna pregunta porque no la ha habido. He escuchado una mención a un artículo del Tratado de la Unión Europea que debe ser leído con todos los demás, particularmente en la Carta de los Derechos Fundamentales de la Unión Europea.

Dígale al Gobierno de Viktor Orbán −por si no se ha enterado− que formar parte de la Unión Europea significa formar parte de un espacio sin pena de muerte y, por tanto, cualquiera que introduzca ese asunto en el debate tendrá que responder ante toda Europa. Una conquista de la civilización del Derecho y de las libertades que debe ser preservada activamente por la guardiana de los Tratados, que es la Comisión. Por eso debatimos. Cuando un gobernante de la Unión Europea se atreve a hablar de la reinstauración de la pena de muerte como un objeto de debate está faltándole al respeto al contrato que adquirió cuando pasó a formar parte de la Unión Europea.

Signor Presidente, onorevoli colleghi, io ringrazio anche la Commissaria Jourová per la sua relazione, ma tuttora ci preoccupa la situazione in Ungheria così come la situazione di quei paesi nei quali le misure adottate dai governi possono comportare una palese violazione dei diritti fondamentali e di quei valori, come il rispetto della dignità umana, della democrazia, dell'eguaglianza, sui quali si fonda l'Unione europea. E questo anche nei confronti dei cittadini di quegli stessi paesi, che peraltro al momento dell'adesione all'Europa hanno creduto nel modello di democrazia e di difesa dei diritti che l'Unione rappresenta. Ci aspettiamo tutti, quindi, che la Commissione europea, in quanto custode dei Trattati, svolga un monitoraggio accurato e costante per il mantenimento dello Stato di diritto in tutti gli Stati membri e ci aspettiamo che la Commissione affronti la questione dei diritti nella sua totalità e non in maniera parcellizzata, esercitando così il proprio ruolo in ambito europeo in modo incisivo ed efficace.

  Kati Piri (S&D). Kedves Magyar Polgárok! Ne higgyenek el mindent, amit Önöknek mondanak. Igaz, hogy Hollandiát képviselem ebben a Parlamentben, nyíltan mondom, hogy nagyon is büszke vagyok rá, hogy magyar származású vagyok. Minden fideszes képviselőnek üzenem: én nem bosszúból beszélek ma este a magyar helyzetről.

Viszont európaiként ki kell állni az európai elvek mellett. Ha az EU adófizetőinek pénzét teszik zsebre Orbán és haverjai, akkor igenis jogos, hogy számon kérjük a Fidesz-kormánytól. Ha Schengent valóban fent akarják tartani, tudniuk kell, hogy ez egy értékközösség is, nem csak érdekekről szól. A magyar kormány ezeket az értékeket régóta semmibe veszi, és ezzel a magyar emberek érdeke ellen is dolgozik. Köszönöm szépen!

  Sylvia-Yvonne Kaufmann (S&D). Herr Präsident! Angesichts der langen Liste gravierender Probleme, Frau Jourová, ist für mich die Entscheidung der Kommission, im Falle Ungarns nicht einmal die erste Stufe des Rechtsstaatlichkeitsmechanismus zu aktivieren, nicht nachvollziehbar. Wann will man denn endlich ein schärferes Auge auf die Aktivitäten der Regierung Orbán richten? Will man allen Ernstes weiter so lasch agieren, wenn diese Regierung die gemeinsamen europäischen Werte in Frage stellt und ihnen hohnspricht?

Diese Frage ist mir immer wieder – auch in meinem Wahlkreis in Berlin – gestellt worden. Die Bürgerinnen und Bürger fragen zutiefst besorgt, und sie fragen dies gerade, weil sie wissen, wie viel wir Deutsche, wie viel wir Berlinerinnen und Berliner Ungarn zu verdanken haben. Und dass diese Besorgnis offensichtlich auch in der Zivilgesellschaft in vielen unserer Mitgliedstaaten großen Widerhall findet, zeigt die gerade gestartete europäische Bürgerinitiative Wake Up Europe. Sie fordert von der Kommission, Artikel 7 gegen Ungarn einzuleiten, und ich denke, das ist ein klares Zeichen, dass von uns ein deutliches Handeln verlangt wird und dass wir nicht weiter wegsehen sollten.

  Sylvia-Yvonne Kaufmann (S&D), Antwort auf eine Frage nach dem Verfahren der „blauen Karte“. Das ist ja wirklich eine ganz unsinnige Frage. Sie erwarten doch von mir nicht, dass ich mit Ja antworte. Es ist völlig klar, dass wir im Vertrag verankerte gemeinsame europäische Werte haben. Die Liste der Probleme, die Frau Jourová vorgetragen hat, ist sehr lang, und sie betrifft zahlreiche Politikbereiche. Wir haben alle allen Grund, uns Sorgen über die Entwicklung in Ungarn zu machen. Die Verantwortung dafür trägt die Regierung. Und die Regierung muss sich bitte auch der Kritik aus diesem Haus und anderen europäischen Institutionen und auch der Zivilgesellschaft stellen. Das sind wir der gemeinsamen Entwicklung dieses europäischen Hauses schuldig!

  Stanislav Polčák (PPE). Pane předsedající, já se vyjádřím k části, která se týká samozřejmě Maďarska, i když do jisté míry souhlasím s tím, že i některé další členské státy by zasloužily pozornost. V tom má myslím nepochybně kolegyně Hohlmeierová pravdu. Ale pokud zkoumáme ústavní reformy, které byly provedeny v Maďarsku, tak byť jsem člen PPE zde v Parlamentu, tak nemohu zastírat to, že budí rozpaky. Budí rozpaky už proto, že Maďarsko byla první země, která byla podřízena monitoringu ze strany Rady Evropy. Byla to první členská země EU. Já jsem byl v té době členem Rady Evropy, takže vím, o čem mluvím. A je třeba nezastírat, že ty ústavní reformy, které byly provedeny v minulých dvou nebo třech letech, tak skutečně jsou podle mého názoru za hranou přijatelnosti z pohledu evropských pravidel, evropských hodnot.

  Tibor Szanyi (S&D). Köszönöm a lehetőséget, Elnök Úr! Végighallgatva ezt a vitát, egy picit megdöbbentem, mert végül is a tárgy maga az az volt, hogy a Bizottság miként értékeli a kialakult magyar helyzetet, és a legtöbb felszólaló mégiscsak a menekültek ügyét vette elő.

Valóban rengeteg, több százezer menekült szenvedett az elmúlt hónapokban a magyar kormány különböző intézkedései miatt, de én magyar képviselőként leginkább azért aggódom, hogy magyar emberek milliói szenvednek immár évek óta.

És csak nagyon gyorsan három dolgot szeretnék mondani. El tudják Önök képzelni, hogy egy nemzetközi sajtócsoportot, forgatócsoportot kidobnak a Magyar Országgyűlésből, a miniszterelnök és a NATO főtitkár sajtótájékoztatóján, mert nem voltak kifejezetten oda hívva? Vagy az, hogy Magyarországon európai forrásokból származó szerződésekhez csak akkor lehet jutni, hogyha valaki a miniszterelnöknek valamilyen rokona, vagy legalábbis egy olyan konzorciumot alakít, amiben miniszterelnöki rokonnak lennie kell?

Hölgyeim és Uraim! Itt most már nem Orbán Viktor világáról van szó, itt Orwell világáról van szó.

  Νότης Μαριάς ( ECR). Κύριε πρόεδρε, το τεράστιο προσφυγικό κύμα που πλήττει την Ευρωπαϊκή Ένωση ανέδειξε τις ενδογενείς αντιφάσεις της. Οι ηγέτες της άρχισαν έναν "σκυλοκαβγά" μια και κανένας δεν ήθελε να αναλάβει τις ευθύνες του. Όμως, το κλείσιμο των συνόρων δεν πρόκειται να μειώσει τις προσφυγικές ροές που η ίδια η πολιτική της Δύσης έχει προκαλέσει. Γιατί είναι η Δύση που με τις επεμβάσεις της δημιούργησε την εκρηκτική αυτή κατάσταση στη Συρία, το Ιράκ, τη Λιβύη και το Αφγανιστάν.

Το κλείσιμο των συνόρων διοχετεύει τις ροές αλλού. Μετά λοιπόν την Ουγγαρία, έκλεισαν τα σύνορά τους η Σλοβενία, η Αυστρία αλλά και η Γερμανία. Έτσι εγκλώβισαν χιλιάδες πρόσφυγες στον ευρωπαϊκό Νότο και ειδικότερα στην Ελλάδα. Σύμφωνα με την απόφαση της 23ης Σεπτεμβρίου, οι ηγέτες αποφάσισαν ρήτρα κατανομής προσφύγων με βάση την έκταση, τον πληθυσμό και το ΑΕΠ της χώρας. Έτσι, στην Ελλάδα αντιστοιχεί φιλοξενία 11.000 προσφύγων και όχι 50.000, που εντελώς εσφαλμένα δέχθηκε ο κύριος Τσίπρας. Κι όμως, παρ' όλα αυτά, "τα ακούσαμε και από πάνω" με την έντονη κριτική των 'δήθεν' ευρωπαϊστών που το μόνο που τους ενδιαφέρει είναι μην τυχόν και οι δυστυχείς πρόσφυγες της Συρίας τους χαλάσουν την ησυχία.

  Ivan Jakovčić (ALDE). Gospodine predsjedniče, gdje su sada naši prijatelji iz Europske pučke stranke? Nema nikoga ovdje. Ne zanima ih Mađarska? Stanje u Mađarskoj? Ili možda ti naši prijatelji nemaju nikakvog argumenta pa ih onda zato nema ovdje i ne žele sudjelovati u ovoj raspravi?

Gospođo povjerenice, nabrojali ste toliko toga da se pitam je li ta zemlja uopće članica Europske unije. Bi li netko tko ima sve te probleme koje ste nabrojali: pitanje pravosuđa, slobode medija, odnosa prema Romima, slobode kretanja kapitala, državnih potpora – bi li takva zemlja mogla postati članica Europske unije? Mi zaista imamo ozbiljan problem unutar nas samih. Možda čak Mađarska nije više izolirani slučaj. I vjerujem da će ova Komisija zaista poduzeti sve da se sve ono što se dešava u Mađarskoj napokon pokuša srediti. Inače će trebati zaista članak 7. aktivirati do kraja.

Mr President, due to the fact that my speech at the beginning was really quite long and I enumerated all the problems which we are addressing using the instruments we have in hand, I only want now to repeat that we are monitoring closely not only Hungary, but also other Member States.

When we see, based on an objective, thorough assessment, that there is a systematic breach of the Treaty, we will act using Article 7. Up till now we have been using the instruments which we have for the problems which I enumerated in my speech.

This does not mean that I did not follow very closely what you have said and all your arguments, and I can only, on behalf of the Commission, confirm here that Hungary will be at the centre of our attention, as well as other Member States where we see similar problems, because one of the principles which we have to keep to is equal treatment towards Member States.   Mario Borghezio (ENF), per iscritto. Trovo questo dibattito alquanto superfluo, almeno adesso. Si chiede un aggiornamento del monitoraggio dello Stato di diritto, di democrazia, dei diritti umani o la violazione degli stessi in Ungheria a seguito delle dichiarazioni rilasciate mesi orsono dal Presidente Orban, discutibili certo, ma in questo momento storico non necessario. Si parla di esasperazione dello stato di democrazia e di minaccia sistematica allo Stato di diritto. Bene, io sposto l'argomento su quanto invece ha fatto Orban per tutelare il suo paese: una vera difesa dei confini e, di conseguenza, del suo popolo. Bene ha fatto Orban a lanciare una consultazione pubblica, democratica, sull'immigrazione mettendo anche in relazione il fenomeno migratorio e il terrorismo: alla luce di quanto accaduto solo qualche settimana fa, ci aveva visto giusto. Consultazioni che accusano le politiche europee: non si dice che l'Europa deve fare di più e che alcune politiche sono sbagliate? Valuto le 12 domande poste nel questionario assolutamente legittime, pertinenti e lungimiranti. Ci si lava la bocca parlando di democrazia e di coinvolgere il popolo attraverso i referendum consultivi, ma è lecito domandarsi cosa abbia mai fatto il Presidente ungherese. Un Presidente così sarebbe necessario anche in Italia! Bravo Presidente Orban!

  István Ujhelyi (S&D), írásban. Büszke magyarként és európai demokrataként soha nem fogom támogatni, hogy Magyarországgal szemben bármilyen olyan szankciót vezessenek be az aktuális kormány működése miatt, amely sérti a magyar nemzet érdekeit. Orbán Viktor ugyanis nem egyenlő a magyar nemzettel. Van azonban, ami nem maradhat retorzió nélkül. Magyarországon a közösből felhasznált uniós források szinte egésze a kormányközeli klientúra felhizlalását szolgálja. Méghozzá következmények nélkül.

Engedjék meg, hogy röviden idézzek a néppárti Fidesz korábbi európai parlamenti választási programjából. Ebben így fogalmaznak: „Az Európai Uniónak jelenleg a gyengeségei közé tartozik, hogy nehezen tud a saját maga által vallott értékeknek és elveknek érvényt szerezni (...) Ennek oka leginkább abban keresendő, hogy az unió intézményei félnek beavatkozni egy-egy kormány belügyeibe. A Fidesznek ugyanakkor meggyőződése, hogy közös értékeink és elveink érvényre juttatását nem lehet mérlegelés tárgyává tenni. Fel kell tehát ruházni az Európai Uniót olyan eszközökkel, hogy tagjait folyamatosan az értékek képviseletére és az alapelvek betartására késztesse; enélkül nincs erős Európa (...) Ellentmondás, ha elvárjuk az uniótól, hogy vegye rá a normakövetésre a tagállamok kormányait, de vonakodunk attól, hogy ehhez a szuverenitásunkat esetleg csorbító felhatalmazást adjunk.” A Fidesznek igaza volt, még ha ma már ennek ellenkezőjét is mondja. Ideje lenni tenni is valamit, amíg nem lesz késő.
