  El Presidente. – El punto siguiente en el orden del día es el debate sobre el informe de Viviane Reding, en nombre de la Comisión de Comercio Internacional, que contiene las recomendaciones del Parlamento Europeo a la Comisión sobre las negociaciones relativas al Acuerdo sobre el Comercio de Servicios (ACS) (2015/2233(INI)) (A8-0009/2016).

   Viviane Reding,rapporteure. Monsieur le Président, Madame la Commissaire, chers collègues, l'ACS reste inconnu du grand public alors qu'il est négocié depuis 2013 avec 23 pays qui représentent 70 % du commerce des services.

Nous serons bientôt assujettis à ses règles, que ce soit lorsque nous prendrons notre téléphone, notre carte de crédit, les différents moyens de transport à l'étranger, quand nous surferons sur les raisons sociaux, sur les sites de commerce en ligne: aucun secteur, du numérique au transport en passant par les services financiers, n'y échappera. Nous n'avons donc pas le droit à l'erreur.

C'est pourquoi, bien que la Commission mène les négociations au nom de l'Union, le Parlement – qui contrôle la Commission – va tracer des lignes directrices très claires. Comme en témoignent le rapport sur lequel cette Assemblée se prononcera ce mercredi, l'enjeu est tel que les eurodéputés ont serré les rangs, au-delà des clivages politiques, pour changer l'orientation de la politique commerciale de l'Europe, aussi bien sur la forme que sur le fond des négociations.

Sur la forme, tout d'abord, c'est une véritable rupture. Pendant longtemps, les négociations ont été menées en vase clos. Depuis les élections de 2014, les choses ont changé, les principaux groupes politiques assurent un suivi sans relâche de chaque tour de négociations, ainsi qu'un dialogue intense à l'intérieur du Parlement, avec la consultation de pas moins de huit commissions parlementaires, et à l'extérieur des institutions, avec la société civile, notamment.

À notre demande, le mandat du Conseil et les propositions d'engagement de l'Union européenne ont déjà été rendus publics, et je voudrais remercier la Commissaire pour son aide dans ce sens. Avec ce rapport, nous voulons aller encore plus loin dans la transparence.

Sur le fond ensuite, le changement est tout aussi radical. En tant qu'élus, il est de notre responsabilité de délimiter quel ACS nous voulons et lequel nous ne voulons pas. Notre message est clair: nous voulons une meilleure réglementation internationale, une réglementation juste et solide.

Plus précisément, le présent rapport contient des lignes bleues: plus de réciprocité dans l'accès aux marchés étrangers, notamment dans les secteurs des télécoms, du transport, des marchés publics, plus de droits pour les consommateurs contre les abus tels que les frais d'itinérance ou les courriers indésirables, plus d'avantages pour nos PME, et enfin plus de participants à la table des négociations, où nous pouvons nous imaginer d'avoir aussi la Chine.

Nos lignes rouges sont tout aussi nombreuses. Nos services publics et audiovisuels doivent être explicitement exclus, notre droit à réguler pleinement préservé, nos droits fondamentaux et le droit à la protection des données sauvegardés, le mouvement des personnes limité aux déplacements temporaires de personnels qualifiés dans le cadre d'un contrat.

Finalement, on oppose souvent intérêts offensifs et défensifs à tort. Ils sont indissociables. Il ne peut y avoir un accord sans protection ni de protection sans accord. Concentrant 25 % des exportations mondiales et un excédent commercial de 160 milliards, l'Union européenne peut et doit changer la donne en instaurant des règles internationales plus justes et plus solides.

Chers collègues, vous aurez l'occasion, mercredi, d'envoyer un message fort aux négociateurs pour que ces négociations prennent la bonne direction, dans l'intérêt de nos entreprises, dans l'intérêt des citoyens européens.

Voter contre le rapport, c'est voter pour le statu quo, c'est-à-dire pour le manque de réciprocité, pour l'absence de règles. Voter pour le rapport, c'est voter pour le changement, c'est-à-dire pour la transparence, la défense de nos valeurs, de nos intérêts. Voter pour, c'est lier la Commission par un mandat parlementaire clair. Prenons donc nos responsabilités.

  Cecilia Malmström, Member of the Commission. Mr President, the Commission would like to thank Parliament for the broad engagement – so many committees engaged in the TiSA negotiations – and, of course the rapporteur, Mrs Reding, for the work she has done on this, as well as the shadow rapporteurs. It is very important for us to make sure that we negotiate this in close cooperation with the European Parliament.

As you know, services account for about 70% of our GDP, but they represent only 25% of our external trade. So TiSA is a tool to try to redress that imbalance and open up foreign markets to EU suppliers. This week, as we speak, negotiators from 23 WTO members are meeting in Geneva for the 16th negotiation round of TiSA. We welcome the progress achieved to date, especially in the autumn: a lot of progress has been made, and we hope to continue on this positive track.

I had the possibility to meet almost all ministers whose countries are engaged in TiSA in Davos. We took stock of where we are. There was a positive atmosphere, and many countries wanted to bring these negotiations to an end this year. This is an ambitious, realistic tool, but, of course, for us the content is more important than speed.

Having a very ambitious work plan ahead of us, we appreciate the support and recommendations that the European Parliament has included in the draft resolution to be voted on Wednesday. We would certainly take your views into account, as much as possible, as the negotiations progress. As you point out in the resolution, TiSA aims to unleash the untapped potential of more integral global services markets. It could give us a unique possibility to address the existing barriers to the international trade in services that are impeding the expansion of services export.

We aim to develop strong, transparent and effective rules across the different sectors that are crucial in enabling global services trade in TiSA. This is also an important contribution to the multilateral trade agenda, in particular in a situation where plurilateral deals are meant to play an increasing role in the post-Nairobi context. So we fully agree with you – and this is important for me personally – that there should be as broad a participation as possible in TiSA so that we can work towards future multilateralisation.

As you know, today 23 countries participate in the negotiations, and that represents 70% of global services trade. But we should keep the doors open for more applicants, notably towards large, emerging economies such as China. It would bring TiSA towards the critical mass required for the multilateralisation of the deal. With this in mind the EU has been leading the efforts to design the proposal and the architecture of TiSA so it would be fully compatible with the GATS agreement and thus facilitate future multilateralisation.

I am pleased to hear that the European Parliament has appreciated the efforts of transparency. Thank you for pushing on this, and we will continuously try to enhance that. You now receive all negotiation documents, as does the Council. The chief negotiator regularly delivers extensive briefings to the INTA monitoring group led by the rapporteur Mrs Reding, and we are in regular dialogue with civil society. In addition we have ensured that all the reports from the negotiating rounds are available on the internet.

I would like to reassure you on some of the points that you raised in the resolution and some of the concerns. The draft resolution calls for horizontal carve-outs accepted by all TISA participants on public services and an assurance that TiSA parties subscribe to the ILO Conventions. However, if we want to see TiSA multilateralised in the framework in the future, we need to base it on the scope of the GATS, and GATS does not contain such broad carve-outs or requirements to subscribe to other international conventions or law which developing and emerging countries would want to see if they joined TISA, and they will have difficulties to subscribe to this. But that does, of course, not exclude us in other fora working with countries for them subscribing to the ILO Conventions.

Secondly, and this is very important, public services, culture, labour rights – it is my firm intention, and this is for the whole negotiating team, to ensure that we remain able to unilaterally, here in Europe, decide on the level of protection we want to have. In particular, the EU will never compromise on the essential role of the widest discretion of national, local and regional authorities in providing, commissioning and organising public services as guaranteed in the EU Treaty. This is our approach and that will remain.

Third, I note that the draft resolution recommends limited trade liberalisation commitment in cross-border trade: the so-called Mode 1. We will pursue a very cautious approach here, for instance, in some sectors such as financial services. However, in other sectors like digital services, which represent growth potential – especially for us, it is an offensive interest – the cross-border nature is so inherent to the technology that it would not be in the EU’s interest to limit our commitments.

Fourth, data protection is a fundamental right of the EU. TiSA will not jeopardise it.

Finally, let me say that we have come to a compromise on the e-TiSA architecture as a result of very difficult negotiations, and any changes to ratchet and standstill clauses here would bring us back to day one. But be assured that these clauses only apply to a right to discriminate between foreign and domestic companies – what we call national treatment – and not to liberalisation, meaning market access commitment.

In addition, we also deploy broad carve-outs for sectors which we consider genuinely sensitive. So I consider this resolution as a strong signal of support by the European Parliament to continue and to conclude TiSA negotiations. You have clearly marked your red lines and your input here, so allow me to thank you for this and also for all the opinions given by the different committees and to pledge my full cooperation with the European Parliament in the future as we push for a conclusion of this agreement.

  Thomas Händel, Verfasser der Stellungnahme des mitberatenden Ausschusses für Beschäftigung und soziale Angelegenheiten. Herr Präsident! Dass sich das Europäische Parlament zu TiSA äußert, ist gut und wichtig, aber mehr als ein erhobener Zeigefinger ist in wesentlichen Fragen nicht herausgekommen.

Ich will darauf hinweisen: Seit 2007 haben wir in 64 Fällen durch den Globalisierungsfonds mit Milliarden ausgebügelt, was in der Mehrheit die negative Folge von sogenannten Liberalisierungen war. Genau deshalb hat der Beschäftigungsausschuss gefordert, die Ratifizierung, Umsetzung und Anwendung von acht Mindestarbeitsnormen der Internationalen Arbeitsorganisation fest zu verankern und Verstöße einklagbar und sanktionierbar zu machen. Das enthält der Bericht nicht, er enthält die nunmehr harmlose Formulierung „sollen beachtet werden“. Da werden Länder wie USA, Pakistan oder die Türkei schwer beeindruckt sein.

Wir sollten die öffentliche Daseinsvorsorge ausnehmen und keine Verpflichtung zur Liberalisierung, die unumkehrbar ist, in diesen Bericht aufnehmen. So kann Handel mit Dienstleistungen nicht fair und sozial erfolgen.

Gracias a todos los que estáis trabajando para marcar unas líneas de negociación que hagan este acuerdo un poco menos nefasto. Gracias especialmente a los miembros de la sociedad civil, porque habéis sido los lectores más sagaces de los textos filtrados, encontrando y denunciando los capítulos que hacen que el ACS sea, sencillamente, inadmisible.

Parece que quienes apoyan este Acuerdo han aprendido muy bien la lección con el informe de la ATCI de junio. No han querido partir de un texto abiertamente indignante, sino revestir el núcleo dañino de palabras muy bonitas pero, en su mayoría, superfluas.

Está por ver qué votará cada uno en las enmiendas que realmente importan: aquellas que exigen sin ambigüedades el uso de listas positivas, el cortafuegos a la expansión descontrolada de servicios financieros o el rechazo tajante de las infames cláusulas demantenimiento del statu quo y de trinquete.

Confío en que nadie quiera aplazar la votación del informe alegando el número de enmiendas. Ya que no se consulta ni informa a la ciudadanía, qué menos que dejar que se presenten y que se voten las enmiendas que reflejan su voluntad.

  Alessia Maria Mosca, relatrice per parere della commissione per i problemi economici e monetari. Signor Presidente, onorevoli colleghi, l'obiettivo del TiSa, come quello di ogni accordo commerciale, deve essere, a nostro parere, quello di portare vantaggi ai consumatori e ai lavoratori europei attraverso l'inserimento di norme ambiziose che favoriscano la crescita di lungo termine e che siano in grado di disciplinare la prestazione dei vari servizi.

In questo senso, anche per quanto riguarda i servizi finanziari, il Parlamento europeo chiede che vadano promosse l'attuazione e l'applicazione delle norme internazionali, senza però prendere nuovi impegni suscettibili di compromettere le normative dell'Unione europea nel settore finanziario.

Il TiSa deve inoltre essere sfruttato come opportunità per una messa a sistema, a livello globale, della lotta contro la frode fiscale, l'evasione, la pianificazione fiscale aggressiva e il riciclaggio di denaro nel settore dei servizi finanziari.

Da ultimo, ma non in ordine d'importanza, chiediamo alla Commissione di proseguire sulla strada della trasparenza, elemento fondamentale per riavvicinare i cittadini europei alle decisioni che ci troviamo a prendere tutti i giorni.

Ci auguriamo che il voto favorevole della commissione possa essere confermato anche da quest'Aula.

  Virginie Rozière, rapporteure pour avis de la commission du marché intérieur et de la protection des consommateurs. Monsieur le Président, avec l'accord sur le commerce et les services, c'est un nouvel accord de libre-échange qui vient sur la table, une nouvelle discussion au Parlement européen, et cette discussion pose à nouveau les mêmes questions et révèle les mêmes problèmes qu'on a pu rencontrer avec d'autres accords.

D'abord, une question sur l'objectif, parce qu’un accord de libre-échange n'est pas une fin en soi. Il a du sens uniquement s'il est favorable aux entreprises et aux citoyens européens et cela passe par des principes simples: les conditions d'une concurrence équitable, un accès réciproque aux marchés et surtout le maintien de la possibilité de légiférer dans le sens de l'intérêt général. Et puis, nous avons le même problème sur la méthode, avec toujours ce manque de transparence, tant pour les représentants du peuple européen que nous sommes que pour la société civile.

Par conséquent, nous devons adresser un message clair dans ce rapport: nous voulons justement plus de transparence, nous voulons empêcher l'évasion fiscale et le dumping social, nous voulons protéger les données personnelles des citoyens européens et nous voulons exclure de cet accord un certain nombre de services: les services publics, bien sûr, mais aussi les services culturels.

Je remercie l'ensemble des collègues et la rapporteure, qui proposent d'adresser un certain nombre de messages en ce sens. J'imagine que la rapporteure agit contre la volonté d’une partie de son groupe politique et je la remercie de cet effort.

  Terry Reintke, Verfasserin der Stellungnahme des mitberatenden Ausschusses für regionale Entwicklung. Herr Präsident, sehr geehrte Frau Kommissarin, liebe Kolleginnen und Kollegen! TiSA ist ein sehr weitreichendes Abkommen, welches auch und vor allem die lokale und regionale Ebene betreffen wird. Der Regionalausschusses ist deshalb in seiner Stellungnahme sehr klar: TiSA darf sich nicht gegen die Ziele der europäischen Kohäsionspolitik, des wichtigsten Investitionsinstruments der EU, richten. Wir begrüßen, dass die Ausnahme der öffentlichen Dienstleistungen, welche in unserer Stellungnahme erwähnt wurden, nun auch im Bericht von Frau Reding fest verankert ist.

Die Grundsätze der allgemeinen Zugänglichkeit, Qualität, Sicherheit, Bezahlbarkeit und Gleichbehandlung müssen unbedingt gewahrt werden. TiSA darf die Handlungsfähigkeit und die Zuständigkeiten der Kommunen in der Europäischen Union nicht einschränken, damit diese die auf das Gemeinwohl ausgerichteten Ziele erreichen und die Interessen der Bürgerinnen und Bürger uneingeschränkt vertreten können. Es ist Aufgabe dieses Parlaments, die Interessen der europäischen Bürgerinnen und Bürger zu schützen und deshalb auch eine gute Versorgung mit öffentlichen Dienstleistungen zu wahren. Das ist der Punkt der Stellungnahme des Regionalausschusses zu dem TiSA-Abkommen.

  Wim van de Camp, Rapporteur voor advies van de Commissie vervoer en toerisme. Europa staat op dit moment voor grote uitdagingen. We kennen de problematiek van de vluchtelingenstroom en het toenemend nationalisme. Wij van de transportsector zien echter enorme kansen in de Overeenkomst betreffende de handel in diensten, de TiSA-overeenkomst. Als je ziet wat wij doen op het gebied van spoorwegvervoer, maar zeker de zeevaart, dan heeft Europa grote kansen in de TiSA-overeenkomst, ook met zijn andere diensten.

Ik vraag wel aandacht ook voor de sociale aspecten van de werknemers in de transportsector. Die zijn een beetje benauwd voor een té grote invloed van buiten Europa. En ik vraag bijzondere aandacht voor de positie van de postdiensten en het openbaar vervoer. Maar over het algemeen genomen wens ik de commissaris, maar ook mevrouw Reding, veel succes bij het afronden van de TiSA-overeenkomst.

Signor Presidente, onorevoli deputati, come relatore del parere approvato all'unanimità in sede di commissione ITRE, dove abbiamo sostenuto sia l'impianto generale della relazione Reding – trasparenza, rendicontazione e protezione dei servizi pubblici – sia le necessità specifiche delle telecomunicazioni e dell'energia, voglio spiegare il perché di questo intervento del Parlamento.

Il Parlamento si muove, completando il mandato del Consiglio, per stabilire ulteriori vincoli che questo delicato negoziato deve rispettare. Si tratta di vincoli che riguardano la sostanza: rispetto della nostra sovranità, reciprocità, garanzia dell'effettivo vantaggio per i cittadini e delle imprese, perché è particolarmente importante preservare il nostro modello economico e sociale, riconoscendo l'importanza che nell'Unione accordiamo ai nostri servizi pubblici. E si tratta anche di vincoli per la procedura: accesso ai documenti, ampia consultazione con tutte le parti e permanente controllo del Parlamento. Dobbiamo garantire che i negoziati rispetteranno tutte le cautele giustamente richieste dai cittadini europei che rappresentiamo. Sia ben chiaro quindi ai cittadini che mercoledì il Parlamento non voterà il sì a un trattato, ma voterà un mandato più stringente e preciso per i negoziatori.

  Daniel Caspary, im Namen der PPE-Fraktion. Herr Präsident! Frau Reding ist dieses Jahr nominiert für den MEP Award für den Ausschuss für internationalen Handel.

Ich denke, wenn man sich ihren heutigen Bericht anschaut, dann hat sie diesen Preis auf jeden Fall verdient. Sie hat einen Satz gesagt, den ich bemerkenswert fand, und allein dieser Satz verdient schon den Preis! Sie hat nämlich gesagt: keine Vereinbarung ohne Schutz, aber kein Schutz ohne Vereinbarung.

Genau darum geht es unserer Fraktion im Europäischen Parlament. Wir wollen Vereinbarungen treffen. Wir wollen Globalisierung gestalten, wir wollen verbindliche Regeln aufstellen, die einklagbar sind und auf die sich unsere Unternehmen, aber vor allem auch unsere Arbeitnehmer, unsere Verbraucher, unsere Mitbürgerinnen und Mitbürger verlassen können. Und dass wir, als Europäisches Parlament uns heute zum zweiten Mal ausführlich mit TiSA beschäftigen, ist, glaube ich, ein gutes Zeichen.

Wir hatten ja vor Beginn der Verhandlungen im Jahr 2013 schon einen Bericht des Europäischen Parlaments, wo wir sehr deutlich unsere Punkte dargelegt, haben und Viviane Reding und die Kolleginnen und Kollegen haben sich in den letzten Monaten nochmal ausreichend Zeit genommen, ins Detail zu gehen, nochmal besser aufzuarbeiten, was all die Dinge sind, die uns wichtig sind. Ich rufe die Kommission auf: Bitte, Frau Kommissarin, machen Sie sich das zu eigen, was das Europäische Parlament am Mittwoch beschließen wird.

Ich gehe davon aus, das wird eine sehr breite Mehrheit sein, und wenn Sie dann dieses Abkommen möglichst auch mit diesen Ergebnissen heimbringen, dann freue ich mich schon, dass wir unseren Bürgerinnen und Bürgern wirklich etwas mit auf den Weg geben können, was Dienstleistungen voranbringt. Da geht es nicht um irgendwas. Wer ins Ausland geht zum Skifahren, der nimmt eine Dienstleistung in Kauf. Wer einen Aufzug im Ausland wartet, erbringt eine Dienstleistung. Wer seine Lebensversicherung im Ausland hat, nimmt ausländische Dienstleistungen in Kauf, also es ist an der Zeit, dieses auch international zu regeln.

  Paul Rübig (PPE), Frage nach dem Verfahren der „blauen Karte“. Herr Caspary, meine Frage geht in die Richtung, dass natürlich der Dienstleistungshandel auf der einen Seite höhere Löhne bringt und damit die Kaufkraft stärkt. Wenn man günstig einkauft, werden unsere Betriebe dementsprechend wettbewerbsfähiger. Meine Frage: Ist es eigentlich für die Beschäftigungswirkung in Europa auch wichtig, dass wir derartige Verträge abschließen, und können davon auch kleine und mittlere Betriebe profitieren?

  Daniel Caspary (PPE), Antwort auf eine Frage nach dem Verfahren der „blauen Karte“. Sehr geehrter Herr Kollege Rübig! Genau das, was Sie ansprechen, ist der Punkt. Auf der einen Seite wird der Einkauf einfacher und günstiger. Aber was vor allem gilt, ist: Das Verkaufen wird besser.

Und gerade im Dienstleistungsbereich – das ist einer der Bereiche, wo viele Länder positive Handelsbilanzen haben –: Wenn wir es hier schaffen, verbindliche Regeln aufzustellen, an die sich vor allem auch kleine und mittelständische Unternehmen halten können und danach richten können, dann tun wir genau das, was dringend nötig ist, nämlich die Schaffung von Arbeitsplätzen, die im Schwerpunkt eben genau nicht bei den großen Unternehmen, sondern vor allem bei den kleinen und mittelständischen Unternehmen entstehen.

  Jude Kirton-Darling, on behalf of the S&D Group. Mr President, I would like to thank the rapporteur and the other shadows. These TiSA negotiations are controversial. Services are crucial to our economies and their quality has a direct impact on jobs, fairness at work and social cohesion. In this House we have the power to veto any trade deal, and if we use this power wisely in the negotiations we can deliver a more democratic EU trade policy that works for people and not just for profit.

To do that, we have to set out clear mandates for the negotiators on what we are willing to accept and what we will not. We found such an agreement in the Committee on International Trade in the middle of January. We got support from six of eight political groups, and I am now calling on colleagues from all sides of this Parliament to confirm this strong mandate in plenary and, in so doing, to make it impossible for the Commission and the Member States to disregard our views and the public’s concerns.

This is not a vote on whether we are for or against a TiSA deal; it is about setting out red lines. We should be clear: today’s global rules reflect the analogue era, whilst we are in a digital world, and they need to be updated. We need new safeguards and protections. We want a full, unambiguous exclusion for all public services. We need rules to guarantee public authorities’ right to regulate and, while we are good at exporting services in Europe, which is creating and maintaining millions of jobs in the EU, we should do what we can to create new opportunities for our economy. At the same time, we should ensure service sector workers know that we are on their side and that we will not accept an agreement which intensifies social dumping. We need to re-regulate globalisation, and TiSA could help us achieve that. But the Commission needs to get it right. EU negotiators must change the EU’s priorities in the TiSA negotiations. They need to see that we are serious, and that is why we need strong support for this resolution when it is voted upon in plenary.

Ik ken mevrouw Kirton-Darling als iemand die vakbondsrechten erg belangrijk vindt, maar we hebben ook commissaris Malmström horen zeggen dat ze de ILO-rechten, de ILO-verdragen niet wil opnemen in het TiSA-verdrag. Ik ben benieuwd of zij het TiSA-verdrag accepteert als de ILO, de acht basic conventions niet in het TiSA- verdrag worden opgenomen.

  Jude Kirton-Darling (S&D), blue-card answer. In these negotiations – in the GATS agreement at international level which we are looking to revise – there is no social chapter and there is no inclusion of the ratification of ILO standards. We have tussled with this inside the Committee on International Trade (INTA), as well you know. We have worked out how to tackle ensuring that those basic fundamental labour rights are reflected, and the report and the compromise that we reached in the INTA Committee actually sets out a clear demand for all TiSA parties to ratify and to apply ILO Conventions, not in the TiSA agreement but in practice – and, in reality, practice is the thing that we need, not words on paper, and I think this report is a strong step forward.

  Emma McClarkin, on behalf of the ECR Group. Mr President, I welcome the Commissioner. It is great that she is here in what is going to be a vital debate that is actually one that is going to affect tens of millions of jobs in the European Union. The Trade in Services Agreement (TiSA) has the potential to add GBP 20 billion to the annual GDP of the EU, and with services accounting for 70% of our EU economy. The UK is one of the biggest exporters of services in the world, and so my Member State has a keen interest in the advancement of talks at a plurilateral level. And we have managed to attract very broad support in the committee for this report, which shows that many of my fellow colleagues also understand the significance of this trade agreement.

On the one hand, we must ensure that TiSA is an ambitious agreement that tackles the modern-day issues of the 21st century, such as trade in digital services and recognition of and help for the inclusion of small- and medium-sized enterprises in global supply chains. But, on the other hand, we must take on board public concerns about trade deals and their perceived threat, which is why the committee has included the language on the protection of public services such as the NHS and continuing to allow Member State governments to manage the services as they see fit. I am confident that this language is secure and offers the guarantees that people need.

To conclude, I believe that this report offers a solid grounding of support from the European Parliament to the Commission for the advancement of the Trade in Services Agreement that I hope will open up market opportunities for European businesses within a rules-based system that we can then take on a multilateral level.

  Marietje Schaake, on behalf of the ALDE Group. Mr President, the European Union is the world leader when it comes to the export of services. We expect the sector to become even more important. Our service providers are competitive, as the EU itself is already very open and foreign companies are treated equally on our market. There is therefore a lot to be gained by seeing more countries reciprocally opening up their markets to EU service providers and having a level playing field across a larger group of countries. In fact, we would ultimately like TiSA to become a multilateral agreement. Similarly, services are being developed in new areas, such as the digital economy, which will require the rules to be updated. Everyone with internet access could in principle offer a service in a third country.

The Trade in Services Agreement should contribute to clear rules to ensure that principles such as fair competition, but also fundamental rights, are respected. In today’s report the Parliament calls on the Commission to aim for an ambitious agreement, especially in sectors such as e-commerce, telecommunication, financial services, procurement and transport. I think – and this is important to underline amidst all the concerns that also have to be addressed today – that we have every reason to be self-confident. This Parliament does confirm existing legislation and standards are not lowered and free trade should follow rules. Therefore, public services and audiovisual services are also confirmed to be excluded in our report, and TiSA cannot force national governments to break open monopolies on the provision of, for example, water or electricity. I am happy to see that we have, together with the shadow rapporteurs and all colleagues, worked on an interim report on these very important negotiations, and we hope that you will continue to represent the EU with the ambition and self-confidence that we should have here to make sure that the rules-based system is strengthened and that more countries come on board and that trade-in-services relations become more reciprocal.

My question is this: do you think that labour rights should be installed, ipso facto, into all the EU’s trade agreements, or do you think that labour rights are better determined and decided at the national level?

What we have put in this resolution that deals with the trade-in-services negotiations that are ongoing, is that we would like to see all the other partners to this agreement ultimately respect labour rights as enshrined under the ILO. But I agree with my colleague from the UK, Jude Kirton-Darling, when she says that the practice of respecting standards is more important than seeking to underline demands on paper which may not be realistic. So, indeed, strengthening the rules-based system in trade, including trade in services, is there to raise the bar when it comes to standards, including labour rights.

Κύριε Πρόεδρε, ξεκίνησε προχθές, την Παρασκευή, προσπάθεια από τον Πρόεδρο Schultz να αναβληθεί η ψηφοφορία για την TiSA με διάφορα τεχνικά προσχήματα, όπως έγινε και πριν από λίγο καιρό με τη δίδυμη αδελφή της TiSA, την ΤΤΙΡ. Και γιατί ο Πρόεδρος θέλει να την αναβάλλει; Γιατί δεν ξέρει αν η Ομάδα του θα ψηφίσει υπέρ της συμφωνίας ή κατά. Και γιατί δεν το ξέρει; Γιατί αυτή τη συμφωνία δεν την χρειάζεται η Ευρωπαϊκή Ένωση και δεν τη θέλουν πολλοί βουλευτές. Υπάρχει ήδη η GATS, αν χρειάζεται αλλαγές, ας την εκσυγχρονίσουμε!

Οι μόνοι που προωθούν τέτοιες συμφωνίες είναι οι πολυεθνικές εταιρείες και οι πολιτικοί τους εκπρόσωποι. Ξέρουμε το έργο: απορρύθμιση, απορρύθμιση, απορρύθμιση. Απορρύθμιση των κανόνων και των υπηρεσιών, αποδυνάμωση των κρατών να ρυθμίσουν τις υποθέσεις, περιορισμός των μικρών και μεσαίων επιχειρήσεων, αμφισβήτηση των κανόνων και της ποιότητας εργασίας.

Ακόμα και τώρα, προτείνουμε στο Κοινοβούλιο να ζητήσει από την Επιτροπή να αποσυρθεί από τις διαπραγματεύσεις, όπως έκανε η Ουρουγουάη. Ζητάμε εξουσία στις κυβερνήσεις ώστε να αλλάζουν πολιτική και συμφωνίες, αν αυτό το θέλουν και το ψηφίζουν οι πολίτες. Ξεκάθαρη εξαίρεση των δημόσιων υπηρεσιών από την υπό συζήτηση συμφωνία. Διαφορετικά, υπηρεσίες όπως η υγεία και η εκπαίδευση σε λίγο θα ιδιωτικοποιηθούν. Επικύρωση των συμβάσεων εργασίας της Διεθνούς Οργάνωσης Εργασίας, προστασία του περιβάλλοντος, προστασία των δεδομένων και της ιδιωτικής ζωής. Σταματήστε να ψηφίζετε συμφωνίες που υπονομεύουν τα κοινωνικά θεμέλια της Ευρώπης.

  Julia Reda, on behalf of the Verts/ALE Group. Mr President, the signal coming from this report to the EU negotiators is quite clear: the EU negotiators need to go back to the drawing board. The negotiating mandate does not reflect the views of the public and indeed not the views of this Parliament. The public interest has not been sufficiently taken into account. Europeans are opposed to the liberalisation of public services through TiSA. They are opposed to ratchet and standstill clauses and other measures that may limit our democratic rights to regulate in the public interest. Challenging the Commission’s negotiating strategy on TiSA is therefore an important achievement of this report.

But for this Parliament to really be taken seriously as a voice of the people in this negotiation, we have to become bolder. We have to clearly reject any agreement that is not firmly based on a positive list approach. We have to be consistent in the criticism formulated in this report and demand the EU negotiating mandate be changed to adopt Parliament’s position. If that does not happen, then the Commission has to be sure that we will be prepared to reject TiSA.

There are still no convincing reasons for abandoning the multilateral approach in favour of closed-door negotiations between individual countries. These agreements put developing countries at a disadvantage because they do not have a seat at the negotiating table. Civil society has even less access to the TiSA negotiations than on TTIP, and in their analysis they have had to rely quite heavily on leaks. Leaks of the e-commerce chapter in particular have raised many red flags. We must not let TiSA undermine the fundamental rights to privacy and data protection. We must not let TiSA undermine our ability to ensure fair competition and consumer protection, for example through rigorous net neutrality provisions and the right of users to use any technical equipment they choose to access the internet. These are laws that are still being developed to some extent and where it is important that we do not let ourselves be locked into a trade agreement that will limit our ability to safeguard our digital rights.

  Tiziana Beghin, a nome del gruppo EFDD. Signor Presidente, onorevoli colleghi, signora Commissario, il trattato sul commercio di servizi, il TiSA, sembra avere una doppia personalità. Da un lato c'è il TiSA buono, che la Commissione ci presenta ogni giorno, quello che creerà lavoro, quello che aumenterà la crescita, quello in cui i lavoratori saranno sicuri e protetti. Dall'altra parte, però, i testi trafugati ci mostrano un TiSA oscuro e pericoloso, quello delle liberalizzazioni selvagge, quello che abolirà per sempre il confine tra statale e privato, quello che metterà fine ai servizi pubblici come li abbiamo conosciuti fino ad oggi: sanità, acqua, scuola, Internet libero.

Ma allora mi chiedo: qual è il TiSA? Che cos'è il TiSA? Siamo ancora lontani dalla sua approvazione. I negoziati sono segretissimi e non c'è ancora modo di sapere quale delle due personalità prevarrà sull'altra. Ma in ogni caso noi saremo qui a vigilare, perché prima o poi, signora Commissario, questo trattato arriverà in questo Parlamento.

Mercoledì prossimo voteremo un testo che metterà nero su bianco le nostre preoccupazioni e le nostre richieste. Non si tratta del testo del TiSA, ma di linee guida per i negoziatori, che dovranno attenervisi strettamente, perché noi, signora Commissario, vi aspetteremo al varco.

  Franz Obermayr, im Namen der ENF-Fraktion. Herr Präsident! Dieser Bericht enthält tatsächlich viele Versprechungen: besserer Schutz der öffentlichen Daseinsvorsorge, Verbraucherschutzstandards und Arbeitnehmerrechte. Doch angesichts von TTIP glauben das eben viele Bürger nicht mehr. Und ich bedenke, dass sich die Kommission durch diesen Bericht in ihrem Kurs bestätigt fühlt. Immerhin verspricht die Kommission ja seit Jahren, dass unsere europäischen Standards angeblich geschützt werden. Ich denke nur an unseren Datenschutz – wie der aussieht.

Der Bericht fordert weiter eine Öffnung von TiSA für noch mehr Vertragsparteien, explizit für China und für die Freizügigkeit der dortigen Fachkräfte. Wenn wir überlegen, dass China im Jahre 2013 ca. 6,4 Millionen Universitätsabgänger hat, da frage ich mich, ob die Organe der Union sich auch das ein bisschen überlegt haben. Letztlich habe ich kein Vertrauen in diese sogenannte Handelsliberalisierung, insbesondere, wenn ich daran denke, dass die Frau Berichterstatterin ein Näherverhältnis zu einschlägigen Unternehmen, wie Aqua oder Bertelsmann, unterhält. Und für diese Unternehmen wird das TiSA-Abkommen sicherlich kein Nachteil sein.

Κύριε Πρόεδρε, η συμφωνία για τις συναλλαγές στον τομέα των υπηρεσιών ενώ θεωρητικά αποσκοπεί στο να βοηθήσει τις ευρωπαϊκές εταιρείες που παρέχουν αυτές τις υπηρεσίας παγκοσμίως, αποτελεί στην πραγματικότητα, ένα ακόμη χτύπημα στην ιδέα του εθνικού κράτους. Περιορίζεται ο δημόσιος έλεγχος σε θέματα χρηματοπιστωτικών υπηρεσιών και στην ουσία καταργείται το κρατικό μονοπώλιο σε αυτούς τους τομείς. Το κράτος δεν έχει τη δυνατότητα να παρεμβαίνει για να προστατεύει τα συμφέροντα των πολιτών του και όταν συμμετέχει, συμμετέχει σε πολύ μικρό ποσοστό και δεν μπορεί να ορίσει τους κανόνες με τους οποίους ρυθμίζεται η παροχή αυτών των υπηρεσιών. Συνεπώς, έχουμε μείωση της κρατικής παρεμβάσεως και ταυτόχρονα θίγονται τα συμφέροντα τόσο των πολιτών όσο και των μικρών εταιρειών εις βάρος των μεγάλων πολυεθνικών.

Επιπλέον, το κράτος είναι υποχρεωμένο να τηρεί αρχεία αυτών των εταιρειών και να επιβαρύνεται με τα έξοδά τους. Εξ άλλου, εάν υιοθετηθούν κάποια στοιχεία τα οποία έχουν προτείνει οι ΗΠΑ, τότε το κράτος δεν θα μπορεί να δίνει συντάξεις στους πολίτες του. Κάτι τέτοιο συμβαίνει αυτή τη στιγμή στην πατρίδα μου την Ελλάδα, όπου γίνεται προσπάθεια να επιβληθεί αυτή η πρακτική. Τέλος, υπάρχει το ενδεχόμενο να έχουμε διαρροή προσωπικών δεδομένων προς χώρες οι οποίες χαρακτηρίζονται από τη μεγάλη διαφθορά τους. Άρα ...

  Jarosław Wałęsa (PPE). Mr President, this agreement will break new ground in terms of market access, but it will also enhance international rules in the fields of transport, digital and financial services. It will also cover a large proportion of the world’s trade in services. With this in mind, it is obvious that this is a great opportunity to open up new markets for companies and to consolidate the EU’s position as a world leader in services. Throughout our work, we have supported a comprehensive and balanced negotiation process, and we have called for even more ambitious commitments across parties, sectors and levels of government – in particular in public procurement, telecoms, transport and financial services.

However, let us not forget about consumer rights in terms of roaming fees, transport carriers or credit card fees when used abroad. With that in mind, I fully support the exclusion of public and audio-visual services from this agreement. It is also great to see that, in the digital sector, we are pushing for comprehensive prohibition of forced data localisation and for wide-reaching data protection. With all that in mind, I can fully support this report. I would like to congratulate and thank Madam Reding for her great work and success on this balanced report.

  David Martin (S&D). Mr President, given that, as others have said, 70% of our workforce is employed in the services sector, TiSA is a major opportunity for Europe. TiSA can level the global playing field by giving EU companies the same level of market access that third countries currently enjoy in our market.

TiSA can be good for small and medium-sized enterprises, in particular, those which find non-tariff barriers more difficult to overcome than bigger enterprises do. TiSA – as we have just heard – can be good for consumers if it tackles the problems they often face with service providers based in third countries. TiSA can be good for workers if domestic labour rights are protected and Mode Four is outlawed from undermining their conditions.

I have used a conditional ‘can be’ intentionally. Whether TiSA turns out to be positive depends on protecting our public services, on protecting governments’ right to regulate and on ensuring a high quality of level for data protection. TiSA will only command the support of my Group if it represents, at the end of the day, our values and aspirations.

I know that Part B, subsection 4, of the recommendations to the Commission specifically opposes such clauses. They would be very damaging if they were included in the agreement. Can you confirm whether you would vote against any such agreement if it still contained a ratchet clause by the time TiSA came to a full vote?

We support the right of governments to determine domestic policy. If it decides that a public service should be a public service, no matter what has happened before, it should have the right to return a public service to the public.

  Joachim Starbatty (ECR). Herr Präsident! Dienstleistungen sind ein bedeutender Sektor in der EU und auch in Deutschland. Der Anteil an der Wertschöpfung nimmt ständig zu. Entsprechend groß ist auch die Bedeutung von Dienstleistungen für den internationalen Handel; das haben wir gehört. Es ist bekannt, dass internationaler Handel die Möglichkeit schafft, absolute und komparative Kostenvorteile zu heben, die den Konsumenten zugutekommen und die internationale Wettbewerbsfähigkeit steigern. Auch das ist ja hier betont worden. TiSA fügt sich nahtlos als ein Baustein in die Handelsordnung der WTO ein. Diesen Prozess begleite ich positiv und fordere ein möglichst umfassendes Freihandelsabkommen.

Der vorliegende Bericht wird dieser Forderung gerecht, ohne die öffentliche Daseinsvorsorge zu gefährden. Deshalb habe ich dem Bericht zugestimmt und hoffe auf ein zügiges Voranschreiten der Verhandlungen.

  Helmut Scholz (GUE/NGL). Herr Präsident, Frau Kommissarin, Frau Berichterstatterin Reding! Ihr Bericht schließt eine Reihe unserer Forderungen als Folge der breiten gesellschaftlichen Meinungsäußerung und Mobilisierung gegen TiSA mit ein. Das erkenne ich ausdrücklich an.

Viele wichtige Forderungen der Kommunen, der Gewerkschaften und der Verbraucherschutzverbände, die wir mit unseren Anträgen transportieren, haben in Ihren Kompromissen jedoch keinen Platz gefunden. Wir fordern hier zum Beispiel, ausschließlich mit Positivlisten zu arbeiten. Denn was nicht genannt wird, wird auch nicht dem Markt unterworfen.

Warum konnten Sie nicht die Forderungen der Fachausschüsse einfach mal so stehen lassen, anstatt sie in qualitativ schlechteren Paragrafen nur zu „berücksichtigen“, sprich zu verwässern? In der Abstimmungsliste haben Sie sich gegen fast jede Einzelempfehlung der Fachausschüsse ausgesprochen, die versuchten, die Globalisierung im Interesse von Konsumenten und Produzenten zu gestalten. Wo bleiben dann die roten Linien, zum Beispiel des EMPL-Ausschusses: rechtlich, verbindlich, einklagbar?

Frau Kommissarin! Ich glaube nicht, dass diese Entschließung eine Veränderung der Verhandlungsführung in den TiSA-Verhandlungen bewirken wird, weil das Mandat des Rates anders lautet. Deshalb werden wir auch nicht zustimmen können.

  Max Andersson (Verts/ALE). Herr talman! Ikväll debatterar vi resolutionen om TiSA-avtalet. Det är ett av flera avtal i görningen just nu och det måste ses tillsammans med TTIP-avtalet med USA och Ceta-avtalet med Kanada. Det finns en stor och huvudsakligen välgrundad oro för vad dessa avtal kan innebära för miljö, konsumenter och upphandling, och för vår möjlighet att återta misslyckade privatiseringar i offentlig regi.

Handel är bra, men det är inget självändamål och det är inte överordnat miljö och demokrati. Därför behöver vi nu sända ett tydligt budskap till kommissionen. Den text som ligger på bordet har flera bra skrivningar när det gäller att värna rätten att reglera skydd utav personuppgifter och skydd för offentlig sektor, men det kan bli bättre.

Därför hoppas jag att ni stöder de Grönas ändringsförslag som vill göra förslaget ännu skarpare och ännu bättre med förslag om en positiv lista, med mera. Det handlar om att värna möjligheten att kunna ta bra beslut även i framtiden.

Aber wenn es ein globaler Notstand ist, dann halte ich es schon für sinnvoll, dass unsere Tagesordnung darauf angepasst wird, wenn wir ein Global Player sein wollen.

  Udo Voigt (NI). Herr Präsident! Werte Kolleginnen und Kollegen! Wir konnten heute Nachmittag Zeuge werden, wie in der Geschäftsordnungsdebatte der Vorsitzende der EVP-Fraktion, Herr Weber, klarmachte, das TiSA-Abkommen in dieser Woche durchpeitschen zu wollen. Änderungsanträge besorgter Fraktionen bezeichnete er als Verzögerungstaktik. Wir sollten in diesem Haus einem Freihandel mit öffentlichen Dienstleistungen nicht zustimmen, schon gar nicht unter solchen Vorzeichen!

Öffentliche Dienste müssen eine grundlegende soziale Daseinsvorsorge leisten, die bezahlbar, für alle Bürger verfügbar und nicht gewinnorientiert ist. Ein privates Gesundheitswesen wird nie ein Interesse an gesunden Bürgern haben. Soll künftig der Müll liegen bleiben und der Strom abgeschaltet werden, weil Arbeitslose die gewinnorientierten Preise nicht mehr zahlen können? Öffentliche Dienste sind dann notwendig, wenn die Regeln des Marktes die Anforderungen nicht mehr erfüllen. Mehr noch: Öffentliche Infrastruktureinrichtungen, Einrichtungen der Daseinsvorsorge gehören grundsätzlich nicht in private Hand.

Die Versuchung, den eigenen Unternehmensprofit über das Gemeinwohl zu stellen, ist einfach zu groß. Ich lehne dieses Abkommen mit der gleichen tiefen Überzeugung ab, mit der ich auch dieses Europa der Banken und Spekulanten ablehne.

Señor Presidente, Señora Comisaria, el informe que debatimos hoy tiene por objetivo hacer una valoración de los dos primeros años y medio de negociación del Acuerdo sobre el Comercio de Servicios, pero para establecer unas recomendaciones claras a la Comisión. Debemos otorgar a la Comisión el margen de maniobra necesario para seguir con las negociaciones, sin que suponga renunciar a la mejora de la normativa de la Unión Europea. Apoyamos mantener el derecho a regular de las partes y la transparencia en las negociaciones.

Este Acuerdo es de vital importancia para la Unión Europea. Somos el mayor exportador de servicios con un 25 % de las exportaciones mundiales ―en 2013 obtuvimos un excedente comercial de 170 000 millones de euros en este sector―. Además, las exportaciones de servicios a la Unión Europea se han duplicado en los últimos diez años.

Para nosotros es importante que el Acuerdo sea lo más multilateral posible y que tenga la capacidad de regular y gestionar los servicios públicos de interés general, la capacidad de regular en favor del consumidor y la garantía de que no se rebajarán los estándares sociales y de protección del consumidor.

Y enhorabuena a la señora Reding por el magnífico trabajo que ha realizado.

  Bernd Lange (S&D). Herr Präsident, Frau Kommissarin, liebe Kolleginnen und Kollegen! Wenn man den vorliegenden Text auf eine prägnante Formel bringen will, dann muss man sagen: Ja zu qualitativ hochwertigen Dienstleistungen, Nein zum Ausverkauf von öffentlichen Dienstleistungen, Ja zu fairen Marktzugangsbedingungen und starken Arbeitnehmerrechten und Nein zu Sozialdumping. Diese knappe Formel ist genau richtig, um mit einem Handelsabkommen über Dienstleistungen umzugehen. Gerade was die Arbeitnehmerrechte betrifft, müssen wir eine faire Grundlage schaffen, sodass es eben kein Dumping durch Entsendung von Arbeitnehmern geben kann.

Ich finde es auch gut, dass in dem Bericht darauf hingewiesen wird, dass bestimmte Richtlinien in der Europäischen Union auch zu ändern sind, damit das Prinzip „gleiche Arbeit, gleiche Bezahlung, gleiche Rechte für Männer und Frauen“ sichergestellt wird. Insofern begrüße ich diesen Ansatz.

Ich hoffe auch, Frau Kommissarin, dass Zusammenarbeit nicht nur heißt, dass wir zusammenarbeiten, sondern dass das auch ein klares Ja zum Text ist und ein klares Nein zu faulen Kompromissen.

  Jana Žitňanská (ECR) V týchto dňoch Európsky parlament využíva naplno svoju úlohu pri spoluvytváraní obchodnej politiky Európskej únie. Schvaľujeme odporúčania pre rokovania pre dohodu o obchode so službami, tzv. TiSA.

Budem rada, ak sa my ako zástupcovia občanov budeme podieľať na tom, aby okolo rokovaní nevznikali zbytočné, nepravdivé mýty, ale aby sme konštruktívne rokovali o dohode, ktorá má možnosť priniesť zlepšenie služieb pre viac ako dve desiatky zúčastnených krajín. TiSA je šanca pre našich spotrebiteľov, aby sa v zahraničí dostali k lacnejším službám, a poskytne im viac možností pri cestovaní alebo nákupe na internete.

TiSA je šanca pre našich podnikateľov a podnikateľky, aby vytvárali pracovné miesta a aby sa im ľahšie prenikalo na trhy v tretích krajinách.

Služby, ktoré občania Európskej únie dnes ponúkajú, sú kvalitné. Našou úlohou je pomôcť ich dostávať do tretích krajín a modernizovať medzinárodné obchodné pravidlá tak, aby zodpovedali modernému svetu a využili sme potenciál, ktorý dnes ponúka napríklad digitálny sektor a finančné či odborné služby.

  Anne-Marie Mineur (GUE/NGL). TiSA, het Trade and Services Agreement, is het lelijke broertje van TTIP en CETA. En die verdragen kregen ook al geen schoonheidsprijs. TiSA is weer een voorbeeld van hoe de Europese Unie aan de leiband loopt van multinationals. Dit keer zijn dat de really good friends of services.

Er is niets op tegen om de economie aan te jagen, maar wel als dat gaat ten koste van arbeidsrechten, democratische zeggenschap en de economie van andere landen. Dat is wat TiSA gaat doen. TiSA dwingt landen om hun markt te openen, het zet publieke diensten op de helling en het maakt het onmogelijk om je terug te trekken bij voortschrijdend inzicht.

Ik wil er graag bij de leden op aandringen om te stemmen voor amendement 20, zodat we de Commissie oproepen om ons terug te trekken uit de onderhandelingen. Als je publieke diensten echt wilt beschermen dan is TiSA de verkeerde weg.

Ik wil ook pleiten voor het afschaffen van de zogeheten ratchetclausule, amendement 29, en voor bescherming van het midden- en kleinbedrijf, amendement 49. En ik wil u vragen de overeenkomst ook voor te leggen aan de nationale parlementen, zoals beschreven staat in amendement 53. En speciaal voor mevrouw Kirton-Darling: amendement 36 voor de basisverdragen van de IAO als bindende voorwaarde.

  José Bové (Verts/ALE). Monsieur le Président, Madame la Commissaire, cela fait 30 ans maintenant qu'on essaie de nous imposer l'accord général sur le commerce des services.

En 2013, le précédent rapport disait effectivement que c'était un échec. À l'OMC, on ne sait pas le faire, parce que ça va contre l'intérêt des populations. Aujourd'hui, on essaie une fois de plus, avec un tout petit club privé de 23 pays sur 190, d'imposer un accord général sur le commerce des services. Personne dans le monde n'en veut! Quand on veut ouvrir des négociations, eh bien, par exemple, les États-Unis disent à la Chine: "On ne veut pas que la Chine fasse partie des négociations". Et maintenant l'Uruguay vient de sortir. Mais pourquoi? Peut-être simplement parce que c'est quelque chose qui va à l'encontre de l'intérêt général: c'est ce que les gens disent depuis 30 ans. Quand ils ont manifesté contre l'accord général sur le commerce des services, c'était cela qu'ils disaient. Mais l'accord qu'on est en train de vouloir imposer dans les pays est encore pire que l'accord général sur le commerce des services. C'est ce qui s'appelle, dans le jargon de l'OMC, "un accord ++". Ce qui veut dire qu'une fois de plus on va ouvrir l'ensemble des services. Car c'est faux de dire qu'on protégera les services publics, parce qu'à l'intérieur de ces services, il y a déjà des systèmes qui permettent de les ouvrir à des acteurs étrangers.

Aujourd'hui donc très clairement...

  Romana Tomc (PPE). Najprej bi se seveda rada zahvalila poročevalki, kolegici Viviane Reding za ta priporočila.

Sama sem v tej zgodbi zastopala stališče politične skupine Evropske ljudske stranke za področje odbora ECON in tako zelo dobro vem, da za tem poročilom stoji ogromno dela in usklajevanj. Zato mi je zelo žal, da želijo nekateri zaustaviti sprejetje sporazuma, ki bi lahko državam članicam Evropske unije prinesel lažjo izmenjavo storitev in več delovnih mest.

Pogosto se izkaže, da nasprotovanje izhaja iz strahu ali pa iz nevednosti, zato je zelo pomembno, da smo čimbolj transparentni in da imajo ljudje čim več informacij. Včasih pa to nasprotovanje enostavno izhaja iz želje po ohranitvi monopolov. Konkurenca seveda ni vedno zaželena, toda če je ni, največjo škodo utrpimo prav mi, potrošniki.

Želim seveda uspešno delo, predvsem pa si želim, da bi bila ta pogajanja v naprej čimbolj transparentna.

  Marita Ulvskog (S&D). Herr talman! Dagens tjänstehandel innebär allt längre värdekedjor, ökad digitalisering, otydliga skiljelinjer mellan vad som är varor och vad som är tjänster, och det kräver nya tydliga regler. Tisa får dock inte under några omständigheter leda till social dumpning, till ojust konkurrens, till dåliga arbetsvillkor och exploatering av människor och miljö.

Jag välkomnar därför att parlamentet i det här betänkandet så tydligt kräver respekt för ILO:s kärnkonventioner, och uppmanar samtliga parter att ratificera ILO:s grundläggande normer. Detta ser jag som helt avgörande, tillsammans med ökad transparens, stärkt skydd av offentliga tjänster och att staters rätt att reglera allmänhetens intresse garanteras alltså avgörande för om det ska finnas ett tillräckligt brett stöd i detta parlament för Tisa-avtalet. Allt detta måste klaras annars kommer det inte att vara genomförbart.

  Maria Arena (S&D). Monsieur le Président, Madame la Commissaire, je m'étonne de votre discours. Vous dites: cette résolution confirme mon mandat de pouvoir continuer à négocier de la manière dont je négocie aujourd'hui. À écouter l'ensemble de mes collègues, en tout cas une grande majorité, mais surtout à écouter la rapporteure, Mme Reding, nous entendons que la résolution demande à la Commission, clairement, de changer d'orientation et surtout de respecter un certain nombre de lignes bleues et de lignes rouges.

Faut-il rappeler ces lignes rouges? L'exclusion explicite des services publics, pas de libéralisation par défaut et sans retour, la protection des travailleurs, pas de dumping social, la protection des données comme droit fondamental. Tout cela est inclus dans la résolution et n'est donc pas prévu dans vos négociations actuellement.

Par conséquent, continuer vos négociations dans le sens où vous les menez aujourd'hui, c'est prendre le risque d'avoir dans ce Parlement une majorité cohérente qui dira non à l'accord sur le commerce des services. Je demande à l'ensemble des parlementaires qui voteront pour cette résolution d'être cohérents, c'est-à-dire que si vous ne la respectez pas, ils devront s'engager à voter contre cet accord.

  Inmaculada Rodríguez-Piñero Fernández (S&D). Señor Presidente. Bienvenida, Comisaria. Nosotros creemos que es fundamental actualizar las reglas globales del comercio. No podemos estar regulando la parte más importante del comercio internacional con unas reglas de antes de la era de internet. Es fundamental actualizarlas y frenar el dumping social, garantizar la privacidad de los datos, regular el comercio en línea, el roaming y, desde luego, obtener reciprocidad. Porque el comercio ha de ser un instrumento al servicio de los consumidores y, por supuesto, también de nuestras empresas.

Yo apoyo esta Resolución porque creo que deja claro cuáles son las exigencias del Parlamento Europeo a la Comisión para que las negociaciones vayan por el camino que creemos que tienen que seguir. Es fundamental decir alto y claro que exigimos la exclusión total de todos los servicios públicos, el respeto de los derechos sociales y laborales de los trabajadores, la protección de los datos, la regulación de los servicios financieros y bancarios y, desde luego, también el derecho a la diversidad cultural.

Yo creo que la Comisión —y usted, como Comisaria que está aquí en este Parlamento— tiene que tener muy en cuenta la opinión recogida en esta Resolución. Porque la Comisión tiene la competencia para la negociación, pero, al final, la competencia para aprobar o rechazar un acuerdo la tiene el Parlamento, y queremos un buen Acuerdo, porque hace falta una buena negociación del ACS, progresista y respetuosa con las personas y las pequeñas empresas.

  Emmanuel Maurel (S&D). Monsieur le Président, Mme la rapporteure Reding a dit tout à l'heure que la question qui nous était posée était: "Quel ACS voulons-nous?" J'émettrai une petite nuance. Je pense que la vraie question est aussi: "Voulons-nous de l'ACS?"

Nous sommes un certain nombre de parlementaires, mais aussi de citoyens, évidemment, à douter du bien-fondé d'une telle négociation. Pourquoi? Parce que nous sommes instruits par l'expérience et que nous avons vu le bilan calamiteux des libéralisations passées, alors même que l'Europe, plus que jamais, a besoin de règles et de protection.

Les questions qui sont posées dans cette résolution et que nous sommes un certain nombre à poser, c'est de savoir si l'ACS sera un PTCI déguisé ou une directive Bolkestein au niveau mondial. L'ACS impliquera-t-il encore plus de dérégulation et encore plus de déréglementation financière?

Si la Commission répond oui à ces questions, nous serons évidemment contre l'ACS. De ce point de vue-là, Mme Arena a raison. Notre résolution ne doit pas être un soutien à la Commission, mais plutôt une invitation, un encouragement très vigoureux à procéder autrement et à être toujours soucieuse de la protection des salariés et des consommateurs de l'Union européenne.

  Franc Bogovič (PPE). Svet se na hitro spreminja. Različne storitve s področja telekomunikacij, prometa in ostale storitve predstavljajo zelo velik delež današnje ekonomije.

Svet se digitalizira. Vedno večji je delež digitalnih storitev, zato je nujno, da Evropski parlament da Evropski komisiji zelo jasna izhodišča, ki se v imenu Evropejcev pogaja okoli sporazuma TiSA. Poročilo gospe Redingove je zelo uravnoteženo, zato ga podpiram.

Poročilo daje priložnost tako evropski ekonomiji, tako velikim kot malim podjetjem, prav tako je zelo pozorno do pravic delavcev, da ne pride do socialnega dampinga. Sporazum mora zagotoviti tudi večje pravice potrošnikov storitev, kajti vedno bolj postajamo uporabniki storitev na globalni ravni.

Varovanje osebnih podatkov je tudi eno izmed področij, ki je obdelano in je nujno pomembno, da je dobro obravnavano. Prav tako pa moramo biti pozorni na javne storitve, ki morajo ostati v javnem interesu. Podpiram, da je Evropski parlament samozavesten in da jasna izhodišča Evropski komisiji.

  Tonino Picula (S&D). Gospodine predsjedniče, gospođo povjerenice, Sporazum o trgovini i uslugama o kojem pregovaraju 23 partnera, dakle 50 zemalja, danas predstavlja najosjetljiviji financijski i najsveobuhvatniji trgovinski sporazum za Uniju. Uslužne djelatnosti zapošljavaju 68 % radne snage, a samo 2013. trgovinom usluga ostvarena je dobit od 173 milijarde eura.

Tržište uslugama značajno se izmijenilo razvojem interneta. Premda su europski pružatelji usluga znanjem i kvalitetom koju pružaju konkurentni na globalnom tržištu, pristup mnogim tržištima im je onemogućen zbog pravnih barijera. U isto vrijeme, pristup europskom tržištu je liberalniji. Mala i srednja poduzeća posebno su zapostavljena ovim nerazmjerom. No, reciprocitet ne smije biti naš jedini cilj.

Trebamo snažno braniti standarde zaštite radnika, podataka i prava potrošača. Ovo je prilika da reguliramo globalizaciju. Odredbe Sporazuma trebaju biti dostupne javnosti. Drago mi je što izvješće traži isključenje svih javnih usluga iz Sporazuma, poput zdravstva i školstva, te što lokalnoj samoupravi ostavlja dovoljno prostora da regulira usluge i prema potrebi uvede zaštitne mjere.

  Ruža Tomašić (ECR). Gospodine predsjedniče, pozdravljam poziv na jačanje uloge Europskog parlamenta u postupcima pregovaranja i sklapanja međunarodnih sporazuma, jer je dosadašnja praksa pregovaranja daleko od očiju javnosti potpuno neprihvatljiva. Čak i dobri sporazumi na taj način nailaze na otpor u javnosti, jer građani stječu dojam da se od njih nešto skriva.

Ako su nam oni i njihova dobrobit na prvome mjestu, a morali bi biti, transparentnost nam mora biti visoko na listi prioriteta. Veća mogućnost demokratske kontrole, uvjetno rečeno, komplicira pregovore, ali je apsolutno vrijedna toga. S druge strane, neke ideološke teme, poput borbe za rodnu ravnopravnost, ne bi trebale opterećivati ovakve sporazume.

Moramo zadržati fokus, dakle usmjeriti se na otvaranje stranih tržišta europskim tvrtkama. Taj cilj nećemo ostvariti moraliziranjem i dijeljenjem lekcija ostatku svijeta, nego stvaranjem pravno-političkog okvira koji će našim poduzetnicima omogućiti lakši pristup do jučer zatvorenim tržištima.

Gospodine predsjedniče, podržavam pregovore koje Komisija vrši u ime Europske unije, ali želim istaknuti činjenicu da ovaj vrijedan i značajan instrument kojega možemo usvojiti ovdje u Parlamentu teško da će dobiti podršku ako javnost do kraja ne bude upoznata, u svim detaljima, s onim što se pregovara i da čitav proces postane daleko javniji nego što jest.

Jer iznimno je bitno da i građani daju podršku onome što ćemo mi ovdje prihvaćati. Želim naglasiti problem roaminga, problem e-trgovine, želim naglasiti i potrebu zaštite radnika, i posebno želim naglasiti pravo lokalne i regionalne samouprave na tradicijske usluge i sve one specifičnosti koje nosi supsidijarnost.

Posebno je bilo bitno da javne usluge, zdravstvo i obrazovanje ne budu uključeni u ovom procesu, jer mislim da bi onda definitivno izgubili podršku javnosti. Ovako i onako je teško, ali vjerujem da će nam biti lakše ako uključimo javnost.

  Marina Albiol Guzmán (GUE/NGL). Señor Presidente, el ACS, junto a la ATCI y el CETA forman una tríada de tratados. Tratados de libre comercio, los llaman. De libertad para que las multinacionales impongan sus normas; para que estén por encima de parlamentos y tribunales. Libertad para privatizar nuestros servicios públicos y esclavitud para los trabajadores y trabajadoras. El ACS va a permitir que sean las grandes corporaciones las que elijan los derechos laborales de sus trabajadores y trabajadoras y les permitirá desplazarlos libremente. El ACS traerá niveles de precariedad extremos.

Desde la izquierda europea vamos a votar «no». No a la privatización de servicios públicos. No a la precariedad. No a la dictadura de las multinacionales. Señores diputados y señoras diputadas del Partido Popular y del Partido Socialista, ¿qué van a votar?

Porque votar a favor del informe es votar «sí» a que continúen negociando, en nuestro nombre, qué servicios privatizan y qué derechos nos roban. Es votar «sí» a que la democracia esté en manos de las multinacionales.

Señor Presidente, Comisaria, yo creo —lo ha dicho antes mi compañero Bové— que sabemos lo que son este tipo de tratados: meter por detrás lo que no logramos en el marco de la OMC. Y, encima, reforzado. Cuando sabemos que el AGCS está bloqueado porque hay una gran oposición a este tipo de tratados porque no queremos que se comercie con los servicios públicos. Y a nosotros nos da mucho miedo y no nos creemos las reservas que nos explican desde la Comisión Europea.

Sabemos que va a afectar a los servicios públicos. Nos preocupa mucho la contratación pública. ¿Qué pasa con los procesos de remunicipalización que se están produciendo en el conjunto de la Unión Europea? ¿Cómo se verán afectados por este Tratado? Se verán afectados y lo sabemos. Nos preocupan los derechos laborales del 70 % de nuestra fuerza de trabajo que trabaja en el sector servicios y que puede verse afectada.

Por lo tanto, yo creo, señores diputados, que debemos lanzar un mensaje muy claro esta semana, y debemos ser capaces de hacerlo. Y, si no, no vamos a votar a favor de esta Resolución porque no queremos que se negocie con los servicios públicos. No vamos a aceptar que no se introduzcan listas positivas en este tipo de negociaciones y, finalmente, no estamos de acuerdo con el mandato negociador que tiene la Comisión.

No aceptamos, Comisaria Malmström, que venga aquí a decir que el Parlamento le da el visto bueno a la manera en que está negociando. Si es así, nosotros no estaremos en esta Resolución.

  Jonathan Arnott (EFDD). Mr President, in my constituency, trade and services is incredibly important to business. The UK is the largest exporter of services to the world, even bigger than the USA. That is not just a fact, that is a government statistic – for those who appreciate the irony of that. So I want to make sure that British interests and North-East interests are protected. Why? Because that sector employs over 45 000 people in my constituency and over 12 000 in Newcastle alone.

But, as ever, this report has its wrinkles. It is advisory only. If we adopt it in full it will not remove a single stroke of the pen from TiSA itself. It also recognises that TiSA will involve movement of natural persons between countries that are parties to the agreement. Does that mean even more massive migration to the UK, and if so, how much?

It correctly identifies the threat of a ratchet clause which would put the rights of investors over a democratically-elected government. Long story short: we need to protect the UK’s status as a world leader and I am growing increasingly concerned that TiSA will not do that.

  Jean-Luc Schaffhauser (ENF). Monsieur le Président, tout commerce, tout échange est fondé sur la régulation, sinon c'est la loi de la jungle.

Ici, on souligne l'importance des services publics, on souligne l'importance des données, de la protection et de la réciprocité.

Néanmoins, le problème fondamental est la manière dont ces négociations sont organisées, dans le secret, avec un mandat qui n'est pas clair, qui devrait être impératif, et surtout avec cette base qui avait été celle de l'Organisation internationale du commerce après-guerre, car elle avait utilisé son expérience pour repenser le commerce, la base qui devrait être les Nations unies.

Aujourd'hui, c'est en catimini, en cachette, en dehors des peuples, avec un Parlement qui donne quelques conseils qu'on n'écoute pas, que se règle l'avenir des peuples.

Ce n'est pas comme cela que nous parviendrons à rétablir la démocratie et la confiance des peuples.

  Cecilia Malmström, Member of the Commission. Mr President, thank you for this possibility to discuss this very important agreement that we are negotiating. TiSA is an opportunity to create a global playing field for trade in services. That has great potential for the economy globally but especially for Europe, because the European Union is quite open to other investment – but we need as well to ensure that our companies can also invest abroad. The GATS Agreement really needs to be updated in order to take into account the new global realities and create, as some of you said, the legal certainty that is so important to get this right. Because I absolutely agree, free trade is not something good per se; free trade is a means to create jobs, goods and investment. But of course it needs to be surrounded by certain regulations and certain rules.

The aim is to make this a multilateral agreement. I fully share your concerns on this, and that is why the EU has been so eager to try to make the architecture as open and as inclusive as possible, so that gradually more countries will join, so that we can bring it under the premises of the WTO. It is a fact that the GATS Agreement does not contain obligations to sign up to the ILO, but that does not mean that we are not pushing for this. The European Union is always pushing for countries, in all kind of relations – including trade, of course – to sign up to the key WTO conventions, and we are continuing to do this as well.

Public services – audio-visual services – are always excluded in our agreements. That is very clear in the mandate we have from the Member States. It is very clear from what you have said today, but also earlier on this. Public services such as education, health, water supplies and audio-visual services are excluded. They do not need to be privatised, and if they are privatised there is nothing in this agreement, nor in TTIP or in any other agreement, that will prevent the local, regional or national level if there is a political decision to bring it back to the public sector if that is the political decision.

Also the right to regulate in a non-discriminatory way is not affected. Authorities on all levels can legislate on, for instance, environmental and health standards as they wish, and this will not change.

On transparency, as you have seen, we have really tried to make the EU contribution to this as transparent as possible. Most of the EU proposals, and a summary after each negotiation round, are on line. You as MEPs have access to all documents. But this is a negotiation that we lead together with 22 other countries, and there is no way we can legally publish the proposals of Peru, Australia, New Zealand, Turkey, Pakistan, etc. That has to be their decision. I deplore the fact that they have not chosen to be as transparent as we have, but we cannot publish this, and that is why sometimes proposals, even draft proposals from a given country, appear on the internet, leaked. That does not mean that they are actually part of the negotiation; it is a proposal or a draft for one country. Many of these – you referred to some of them – have been immediately rejected by us and others as well. But we will continue to try to see if we can make this even more transparent and to make sure you are as included and as engaged as possible.

In the end you will, of course, like the Member States, have your say on this. We are negotiating TiSA based on the mandate given to us by 28 countries, and you also had your say on this when it started. I am very mindful of the concerns that you have expressed here – we are taking them on board and we will continue to do so – and of the concerns that that many people have outside this whole House. But I am also very mindful that we still have huge unemployment in this European Union, that millions of people are still without jobs, and TiSA and other trade agreements are a way to create jobs and investment and growth in Europe, which desperately needs it. So we need to find a balance there.

I think that with your input in the resolution, the debate we will have and the continued negotiations – as I said, there is a round as we talk this week, and we will debrief you from that immediately when it is over – jointly we can make this agreement that finds the right balance that so many of you are asking for, and I will be happy to continue to engage with you. Thank you Ms Reding for the fantastic work you have done to get such a broad majority, also all the other committees for your involvement in this, and the shadow rapporteurs.

Monsieur le Président, comme l'ont démontré la plupart des prises de position, le Parlement forme un front commun pour exiger une transparence pleine et entière, des règles commerciales plus justes, des ouvertures de marché plus réciproques, le droit à réguler et à sauvegarder et davantage de droits pour les consommateurs plus nombreux. Les principaux groupes politiques prennent les choses en main dans ce sens.

La mondialisation et la numérisation de nos économies sont des faits. La question est donc la suivante: "Voulons-nous que l'Europe soit un continent hors taxes et le reste du monde un terrain de jeu sans foi ni loi?" La réponse du Parlement doit être très claire: "Non, nous voulons écrire les règles du jeu aujourd'hui pour ne pas avoir à les subir demain. Nous voulons un accord qui protège nos entreprises et nos citoyens, et oui, nous voulons un changement de politique."

Depuis les élections européennes de 2014, un vent nouveau souffle sur la politique commerciale de l'Union européenne et, avec ce rapport, le Parlement s'apprête à hisser la grande voile. Si nos recommandations sont suivies, elles seront une source de croissance pour l'Europe, des gains de compétitivité pour nos entreprises, un filet de sécurité pour nos citoyens. J'appelle donc les politiques et les groupes à maintenir le fort soutien qu'ils ont démontré lors des travaux parlementaires. Seule une large majorité en plénière mènera à une prise en considération des demandes du Parlement européen.

  Monika Flašíková Beňová (S&D), písomne Odporúčania k dohode o obchode so službami by mali pokrývať dôležitý segment, v ktorom je v súčasnosti v Európe zamestnaných niekoľko desiatok miliónov ľudí. Ďalší rozmach tohto odvetvia súvisí aj s opakovane zdôrazňovanou nevyhnutnosťou podpory digitálneho hospodárstva. Veľmi často počúvame o význame technologických a trhových inovácií pre udržateľný ekonomický rast. Európa si v tejto oblasti udržuje pozíciu lídra. Toto jej postavenie nemôže byť za žiadnych okolností ohrozované. Prípadné uzavretie novej obchodnej dohody by tak malo byť podmienené jednoznačným upevnením pozície Európskej únie ako najvýznamnejšieho globálneho exportéra služieb. Do rokovaní o TiSA je okrem Európskej únie zapojená ďalšia viac ako dvadsiatka krajín. Ich trhy znamenajú viac ako 2/3 súčasného globálneho obchodu so službami. Európska únia už pritom s viacerými z nich má vytvorené vzájomné väzby v tejto oblasti. Dohoda tak musí v sebe obsahovať konkrétny potenciál na ďalší posun vpred. V opačnom prípade pre nás nemá žiaden význam. Musí priniesť väčšiu zamestnanosť, viac práv a nižšie ceny pre európskych spotrebiteľov. Zároveň je nevyhnutné definovať jasné hranice, do ktorých už nemôže za žiadnych okolností zasahovať. Týka sa to najmä verejných služieb, služieb v oblasti kultúry, práva na ochranu údajov či spravodlivé pracovné podmienky.

  Ildikó Gáll-Pelcz (PPE), in writing. TiSA must be transparent. That is the starting point. I am seriously concerned that the negotiations have been conducted so far without the required level of transparency while it appears that all negotiation documents will be officially published only five years after negotiations have been concluded.

Overall, transparency cannot consist of the mere provision of information. We need to call on the Commission to involve Parliament in real consultation and at all stages of the negotiations. Secondly, public services must not be put under pressure for further privatisation or deregulation and thus should not be part of TiSA.

In any event TiSA must not result in an opening of service sectors to foreign suppliers at the cost of high European labour, environmental and consumer standards. Wages and conditions for any posted workers must at least comply with those applying to nationals at the same workplace. They must not be treated differently under the guise of being described as ‘service providers’.

Finally, there must be no further deregulation of the financial markets through TiSA. Reforms of financial markets whose necessity became apparent in the aftermath of the international financial crisis must not be treated as trade barriers.

La posición de nuestro Grupo es clara: un servicio regulado según principios nacionales, sobre la base de los derechos laborales y sociales conquistados, no es un obstáculo al «libre comercio», sino un elemento fundamental de democratización de la economía. Partiendo de la negación de esta premisa, la Comisión insiste en liberalizar la provisión global de servicios a través del ACS con efectos parecidos a los que trajo el mercado único: inestabilidad macroeconómica, explosión del dumping social y sometimiento del Estado al modelo de negocio privado. Es lamentable que el Parlamento presente una Resolución cuyas líneas rojas ni siquiera contengan la ratificación de los mínimos de la OIT o criterios claros sobre la noción misma de «servicio público» que dotaran de contenido a su petición de exclusión —tanto más cuando se aceptan cláusulas de liberalización generalizada, también en ámbitos tan sensibles como las finanzas o el mercado digital—. Por todo ello, una vez más, la posición de nuestro Grupo será de radical oposición.

Δεν είναι τυχαίο ότι οι μεγαλύτεροι ανερχόμενοι εταίροι της ΕΕ, δηλαδή οι BRICS, αρνούνται κατηγορηματικά να συμμετάσχουν σε οποιαδήποτε διεθνή συμφωνία για το εμπόριο στον τομέα των υπηρεσιών. Μία συμφωνία που μόνο στόχο έχει τη διατήρηση με κάθε τρόπο της ηγεμονικής θέσης που κατέχουν οι μεγάλες ευρωπαϊκές εταιρίες παροχής υπηρεσιών στον διεθνή καταμερισμό εργασίας.

Η άρση των δασμολογικών και μη δασμολογικών δασμών εξυπηρετεί πρωτίστως τα συμφέροντα των πολυεθνικών, ενώ αντίθετα πλήττει αυτά των μικρών και μεσαίων επιχειρήσεων καθώς και τις δημόσιες επιχειρήσεις, ιδιαίτερα των μικρότερων κρατών. Οι πολίτες της ΕΕ έχουν εκφράσει την κάθετη αντίθεσή τους στις διεθνείς συμφωνίες TiSA και TTIP και απαιτούν την προάσπιση των δημοσίων και μικρών επιχειρήσεων των κρατών μελών προκειμένου να μην καταστούν έρμαια του διεθνούς ανταγωνισμού.

Je tiens à saluer le compromis obtenu par la rapporteure, Mme Viviane Reding, notamment le refus de clauses de "statu quo" et "à effet de cliquet" voire encore les garde-fous proposés en matière de protection des données par les entreprises étrangères. Néanmoins, lors du vote, je m'abstiendrai. Certaines "lignes rouges" font en effet défaut. Les services publics et services au public d’intérêt général sont exclus du champ des négociations, mais il subsiste un flou quant à leur définition au niveau européen, mettant à mal la restriction. Soyons prudents face à ce type de négociations et à leur impact.

À ce jour, il n’y aucune garantie que le TISA impose le respect des conventions collectives de l’Organisation internationale du Travail (OIT). Par ailleurs, je suis défavorable au principe de "liste négative" induit par TISA: seuls les secteurs cités explicitement dans les accords ne seront pas libéralisables. Le Parlement a donné son "feu vert"; j’y voyais un "feu orange". Je resterai vigilant à ce que les balises essentielles qui conditionnent l’accord soient respectées.

  Jutta Steinruck (S&D), schriftlich. Die Kommission muss in ihren Verhandlungen die Position des Parlaments berücksichtigen. Ich werde TiSA am Ende nur zustimmen, wenn das Abkommen keine Möglichkeit bietet, nationale Standards abzusenken. Nationale Regeln zu Arbeitnehmer- und Sozialrechten sowie Tarifverträgen dürfen unter keinen Umständen umgangen werden. Das Abkommen darf auch nicht verhindern, dass Mitgliedstaaten strengere Regeln in Bezug auf Sozial- und Umweltfragen festlegen dürfen. Und ganz wichtig: Öffentliche Dienstleistungen von allgemeinem öffentlichem Interesse müssen ausgeschlossen werden. Dazu gehören: Bildung, Gesundheit, Wasserversorgung und Abfallwirtschaft. Ich werde einem Abkommen nur zustimmen, wenn diese Bedingungen erfüllt sind.

  Adam Szejnfeld (PPE), na piśmie. Usługi odgrywają coraz istotniejszą rolę w gospodarce światowej. Unia jest dzisiaj największym na świecie eksporterem usług, dzięki czemu miliony Europejczyków znajdują zatrudnienie w tym sektorze. Przewiduje się, że dzięki TiSA unijnym firmom łatwiej będzie eksportować usługi, co z kolei przełoży się na wzrost gospodarczy i większe zatrudnienie. Natomiast umożliwienie firmom spoza Unii świadczenia usług w Europie przyczyni się do zwiększenia wyboru dla konsumentów oraz do obniżenia cen.

Przyjęcie przez Parlament sprawozdania w sprawie TiSA ma charakter przełomowy. Zalecenia poparły bowiem niemal wszystkie grupy polityczne. To dowód na to, że w Parlamencie panuje konsensus co do korzyści, jakie to porozumienie może przynieść przedsiębiorcom i konsumentom. To również jasny sygnał dla Komisji, co może, a co nie powinno znaleźć się w końcowym tekście. Cieszę się, że w rekomendacjach Parlamentu znalazły się zalecenia dotyczące zasady wzajemności w zakresie dostępu do rynków, ochrony europejskich sektorów wrażliwych, zapewnienia ochrony przepływu danych, jak również wytyczne dotyczące ułatwień dla MŚP. Ważne bowiem, żeby TiSA była korzystna dla wszystkich negocjujących ją stron, ale jednocześnie nie stanowiła zagrożenia dla europejskich wartości i sektorów wrażliwych. W pracach jednak nad tą umową podkreślałem swoje odrębne stanowisko wobec postulatów pełnego wyłączenia z TiSA usług publicznych, bowiem nie widzę ku temu wystarczających powodów.
