  Isabella Adinolfi (EFDD), per iscritto. ‒ L'UE attribuisce grande valore alla semplificazione e alla chiara formulazione del diritto europeo, affinché lo stesso diventi sempre più comprensibile e accessibile a tutti i cittadini. Ecco perché si prevede che, qualora un atto europeo venga in più occasioni modificato, lo stesso debba essere codificato, al fine di garantirne l'immediata comprensione e chiarezza. La codificazione consiste nella mera riunione delle varie modifiche intervenute in materia, senza perciò apportare modifiche sostanziali di alcun tipo. In tal senso si inserisce la proposta di regolamento che istituisce un codice unionale concernente l'attraversamento delle frontiere da parte delle persone. Ho espresso voto positivo poiché ritengo di fondamentale importanza assicurare chiarezza e coerenza del diritto europeo, garantendo non solo una corretta applicazione dello stesso ma anche maggior chiarezza per i cittadini.

El informe es la codificación de las diferentes versiones y enmiendas introducidas a este Reglamento desde el 15 de marzo de 2006. Puesto que es un informe de codificación que preserva íntegramente el contenido de los actos que están siendo codificados —dada la naturaleza técnica de la codificación—, he votado a favor.

En effet, ce texte a pour objectif de codifier le corpus de règles rassemblées autour du statu quo Schengen. Or, une telle codification a l'ambition d'assurer la postérité des règles de Schengen.

Profondément opposé au maintien de l'espace Schengen qui fait le jeu de l'immigration de masse et du terrorisme, je ne pouvais soutenir un tel texte.

By way of background information, codification is a bringing together of all the legal text when a Regulation or Directive (in this case Regulation (EC) No 562/2006) has been amended by other legal acts for 10 or more times. This is to clarify the text and make it easier to read. A codification exercise can only make formal modifications; no substantive changes or deletions may be made. The EP always has to check whether a codification only makes formal changes to the legal text. Moreover, codification serves to simplify complicated legal texts and, as a result, prevents unnecessary legal challenges in the future.

  Marie-Christine Arnautu (ENF), par écrit. ‒ Le rapport dont il est ici question vise à codifier le corpus de règles rassemblées autour du statu quo Schengen. Alors qu’historiquement, de l'empereur romain Justinien à l'empereur français Napoléon, toute entreprise de codification s’inscrivait dans une volonté d'assurer la postérité de règles et de consacrer de grands principes juridiques, il s’agit plutôt ici d'apporter notre pierre à un édifice que nous souhaitons déconstruire en raison de ses faiblesses patentes. L’espace Schengen a en effet très largement empiré la crise migratoire que nous connaissons actuellement. J’ai donc voté contre ce texte.

  Jonathan Arnott (EFDD), in writing. ‒ This was a legislative proposal to consolidate the rules on Schengen. This provides for the absence of border control of persons crossing the internal borders between Member States of the European Union. It lays down the rules governing border control and establishes the list of persons to which the absence of internal border control applies.

I voted against this proposal because I do not believe in such harmonisation.

  Petras Auštrevičius (ALDE), in writing. ‒ I voted in favour of this report. Europe has been paralysed with regard to the migrant crisis. While we keep discussing possible solutions to the grave problem we face, it hardly ever comes to common action. However, even when we do decide on joint measures, we do not follow through on them. The Dublin Agreement and the relocation system have failed utterly, as the Member States have not committed to apply them.

We must either effectively enforce the current measures, or introduce new ones. Either way, it is not a problem that can be solved by any Member State alone. It is a dilemma that must be dealt with by the European Union as a whole. It cannot be fixed by closing national borders, but only by guarding our common ones; those defined by Schengen. What we need to do is form a common border guard and coast guard and put a collective reception and relocation system in place. Furthermore, we must prompt Turkey to crack down on the criminals smuggling refugees to Europe under harsh circumstances and we must speak with African governments about returning economic migrants. However, what is most important is that Member States keep to it.

  Zoltán Balczó (NI), írásban. ‒ A javaslat célja a személyek határátlépésére irányadó szabályok közösségi kódexének (Schengeni határ-ellenőrzési kódex) létrehozásáról szóló, 2006. március 15-i 562/2006/EK európai parlamenti és tanácsi rendelet kodifikációja. Az új rendelet a benne foglalt jogi aktusok helyébe lép. E javaslat teljes egészében megőrzi a kodifikált jogi aktusok tartalmát, és ennek megfelelően, kizárólag a kodifikáció elvégzéséhez szükséges alaki módosítások elvégzésével, azokat pusztán egybefoglalja. Mivel nem történik érdemi változás az eddigi schengeni szabályokban és magyar szempontból erősen érdekeltek vagyunk a belső határok átjárhatóságában (ingázó munkavállalók, belső magyar határok megszűnése Szlovákia és Szlovénia felé), illetve a belső határellenőrzés ideiglenes visszaállásának elvi lehetőségét a rendelet tartalmazza, ezért az újrakodifikált schengeni rendelet elfogadását támogattam.

  Nicolas Bay (ENF), par écrit. ‒ Cette nouvelle codification vise à sauver l'espace Schengen: j'ai donc logiquement voté contre.

  Hugues Bayet (S&D), par écrit. ‒ Il s'agit ici de codifier – pour plus de clarté – le règlement de 2006 établissant le « Code frontières Schengen » qui a fait l'objet de nombreuses modifications depuis son adoption.

Même s'il s'agit d'un texte d'une importance majeure (régime de franchissement des frontières extérieures) le nouveau règlement proposé se substituerait aux divers actes qui y sont incorporés en en préservant totalement la substance.

J'ai approuvé cette codification.

  Brando Benifei (S&D), per iscritto. ‒ In uno dei momenti di maggior crisi dell'Unione, che vede gli Stati membri divisi sul tema della gestione dei flussi migratori e dei controlli ai loro confini, appare sempre più necessario favorire un accesso diretto dei cittadini alla legislazione europea in materia di attraversamento delle frontiere. La relazione Hautala sulla proposta di regolamento che istituisce un codice unionale relativo al regime di attraversamento delle frontiere rappresenta un passo ulteriore in questa direzione. La risoluzione, dal carattere eminentemente tecnico, conferma la validità del percorso di codificazione dei testi esistenti, promuovendo l'affermazione di un sistema che renderà più semplice e chiaro l'accesso alla normativa prodotta dall'Unione. Vista l'assenza di modifiche alla legislazione vigente e condividendo l'intento della proposta ho quindi deciso di sostenere questa relazione.

  Xabier Benito Ziluaga (GUE/NGL), por escrito. – Hemos votado a favor de este cambio en el Código de fronteras, en tanto en cuanto no supone un cambio en el contenido político del Código existente y es una mera simplificación y reducción de duplicidades en codificaciones superpuestas.

  Izaskun Bilbao Barandica (ALDE), por escrito. ‒ Quiero agradecer a la ponente su trabajo para la aprobación del Reglamento que establece un Código de normas de la Unión para el cruce de personas por las fronteras. El grupo consultivo, tras las reuniones de los días 9 y 26 de febrero y 15 de abril de 2015 constató ciertas modificaciones mencionadas en los puntos 1 a 6. Esto ha permitido determinar de común acuerdo que la propuesta se limita a una codificación pura y simple de los textos existentes, sin modificación sustancial de estos.

  Dominique Bilde (ENF), par écrit. ‒ En lançant la coopération Schengen, les États membres ont accepté d'abolir les contrôles aux frontières intérieures dans l'espace Schengen, ce qui repose sur la confiance dans le fait que les États membres sécurisent leurs frontières extérieures et mettent en œuvre les mesures requises à cet égard.

Ce rapport se propose de codifier les règles de l'espace Schengen. L'Europe nous rend vulnérable et, force est de constater, que l'espace Schengen est une passoire géante aujourd'hui. Or je suis contre l’espace Schengen que cette codification tente de sauver. Il nous faut retrouver la maîtrise de nos frontières nationales pour stopper la vague migratoire et appliquer une politique migratoire stricte à l'image de celle Australienne.

Enfin, nous devons engager une véritable politique de codéveloppement avec les pays d'origine des "migrants" et conditionner les aides accordées à ces pays selon des accords en la matière.

J'ai décidé de voter contre ce rapport.

  Mara Bizzotto (ENF), per iscritto. ‒ Gli accordi di Schengen sono ormai sorpassati e si sono dimostrati del tutto inadatti per fronteggiare l'attuale situazione europea che fa i conti con una crisi migratoria senza precedenti. Questi accordi vanno del tutto rivisti. Per questo motivo ho votato contro questa relazione.

  Andrea Bocskor (PPE), írásban. ‒ A jelenleg is zajló migráns- és menekültválság tükrében kiemelkedően fontosnak tartom az Európai Unió külső határai megvédésének szükségességét, az arra vonatkozó szabályok végrehajthatóságát. A jelenlegi kodifikált szöveg előremutató ezen a téren, ezért szavazatommal támogattam annak elfogadását.

  Franc Bogovič (PPE), pisno. ‒ Čeprav se sliši kot zelo pomembna tema okoli schengenskega režima, o katerem bi se prav lahko ob trenutni migrantski situaciji lahko veliko pogovarjali, pa gre pri omenjenem predlogu uredbe zgolj za kodifikacijo besedila brez bistvenih vsebinskih sprememb. Zato tudi ni bilo zapletov pri podpori tehničnim popravkom v besedilu, ki so jih pripravile posvetovalne skupine pravnih služb Evropskega parlamenta, Sveta in Komisije. Zaradi navedenih razlogov sem predlagano uredbo podprl.

  Marie-Christine Boutonnet (ENF), par écrit. ‒ Cette proposition de règlement propose d'établir un code de l'Union relatif au franchissement des frontières par les personnes (Code frontière Schengen). Je m'oppose à Schengen depuis des années et, par conséquent, j'ai voté contre le texte.

  Mercedes Bresso (S&D), per iscritto. – Ho votato a favore di questo documento perché ritengo che le modifiche apportate al regime di attraversamento delle frontiere da parte delle persone rispettino lo spirito dell’accordo di Schengen e che pertanto vadano nella direzione di una maggiore integrazione.

  Renata Briano (S&D), per iscritto. ‒ La convenzione di Schengen rappresenta un grande traguardo nel processo d'integrazione europea, permettendo il superamento della gestione frontaliera nazionale e la libertà di circolazione delle persone all'interno dell'Unione europea. Un'Europa senza frontiere interne apporta notevoli benefici anche a livello economico, il che dimostra quanto tangibile, popolare ed efficace sia la creazione dello spazio Schengen, nonché l'importanza che esso riveste nelle nostre società. La codifica del regolamento (CE) no 562/2006 del Parlamento europeo e del Consiglio, del 15 marzo 2006, che istituisce un codice comunitario relativo al regime di attraversamento delle frontiere non ha nulla a che vedere con le proposte attuali di riforma o sospensioni di Schengen. Rappresenta una procedura di natura tecnica (regolata da un accordo interistituzionale che prevede un'approvazione accelerata) su cui il servizio giuridico di Commissione, Parlamento e Consiglio hanno espresso parere favorevole e su cui poi la commissione JURI ha votato a larghissima maggioranza. La commissione LIBE non ha voluto esprimere pareri, proprio a dimostrazione che il nuovo testo non intacca in nulla il contenuto politico dell'accordo Schengen.

  Steeve Briois (ENF), par écrit. ‒ Ce rapport appelle à la codification du corpus de règles relatives au régime de franchissement des frontières par les personnes. Cette entreprise de codification s'inscrit dans une volonté des institutions européennes d'assurer la postérité des règles qui encadrent le fonctionnement de l'espace Schengen.

En tant qu'opposant à l'Union soviétique européenne, il est de notre devoir de voter contre ce texte qui consiste à graver dans le marbre les grands principes de l'espace Schengen, incapable de protéger les États membres de la submersion migratoire actuelle ainsi que de la potentielle arrivée de djihadistes. La multiplication des attentats ainsi que les tentatives d'attentats, notamment en France, démontrent à quel point l'Union européenne n'a pas pris la mesure des risques qu'encourent les peuples européens actuellement.

C'est la raison pour laquelle j'ai voté contre ce rapport.

  Daniel Buda (PPE), în scris. ‒ Obiectivul simplificării și clarității actelor legislative ale Uniunii Europene are ca scop creșterea gradului de coerență și un acces cât mai facil al cetățenilor europeni, în același timp oferind posibilitatea de a face uz de anumite proceduri legislative.

Salut recomandările Grupului de lucru consultativ al serviciilor juridice ale Parlamentului European, Consiliului și Comisiei cu privire la Codul Uniunii privind regimul de trecere a frontierelor de către persoane (Codul Frontierelor Schengen). În contextul crizei imigranților și al trecerii frontierelor de către numeroși refugiați, este nevoie de documente bine structurate, care să ofere cadru legal corespunzător, motiv pentru care m-am exprimat în favoarea acestui raport.

  Gianluca Buonanno (ENF), per iscritto. ‒ Mera procedura di codificazione senza modifiche sostanziali per l'approvazione del codice relativo agli accordi di Schengen. Tuttavia, sono contrario apertamente allo stesso e preferisco dare voto negativo, di natura prettamente "politica", anche al lavoro di codificazione.

  Cristian-Silviu Bușoi (PPE), în scris. ‒ Susțin poziția în primă lectură a propunerii, deoarece, conform concluziilor Grupului de lucru consultativ, prezenta propunere este o simplă codificare a textelor existente și nu aduce modificări importante textului.

Uniunea Europeană este un pionier la nivel mondial prin asigurarea liberei circulații a persoanelor pe piața internă într-un spațiu fără frontiere, conform articolului 26 alineatul (2) din TFUE. În vederea asigurării acestui spațiu fără frontiere interne, UE s-a angajat la adoptarea unor măsuri, precum politica comună în materie de trecere a frontierelor externe. Aceasta trebuie să reflecte și acquis-ul Schengen. Trebuie subliniat că acest control al frontierelor externe nu ține numai de competența statului membru în cauză, ci de întreaga Uniune.

Trebuie menționată singura situație în care un stat membru poate reintroduce controlul la frontierele sale interne pentru o perioadă de maximum zece zile, și anume în cazul unei amenințări grave la adresa ordinii publice sau a securității interne. Subliniez faptul că migrația și trecerea frontierelor externe de către un număr mare de resortisanți ai unor țări terțe nu ar trebui considerate în sine o amenințare și că orice prelungire a perioadei menționate trebuie să fie monitorizată la nivelul Uniunii.

  Fabio Massimo Castaldo (EFDD), per iscritto. ‒ La relazione esprime la posizione del Parlamento europeo sulla proposta di regolamento che istituisce un codice unionale relativo al regime di attraversamento delle frontiere da parte delle persone (cosiddetto codice frontiere Schengen). Tale opera di codificazione si profila necessaria in ragione delle numerose modifiche che sono intervenute sul regolamento CE n. 562/2006. Ho votato a favore della posizione in prima lettura del testo legislativo in quanto il gruppo consultivo dei servizi giuridici di Parlamento europeo, Consiglio e Commissione hanno rilevato come la proposta in questione si limiti ad una mera codificazione dei testi esistenti senza apportare alcuna modifica sostanziale.

  Λευτέρης Χριστοφόρου ( PPE), γραπτώς. ‒ Στηρίζουμε την έκθεση και πιστεύουμε πως η θέσπιση κανόνων για τη διέλευση προσώπων από τα σύνορα, δεν μπορεί να επιτευχθεί επαρκώς από τα κράτη μέλη, αλλά μπορεί να επιτευχθεί καλύτερα σε επίπεδο Ευρωπαϊκής Ένωσης.

  Κώστας Χρυσόγονος (GUE/NGL), γραπτώς. ‒ Η έκθεση σχετικά με την πρόταση κανονισμού του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου για τη θέσπιση του κώδικα της Ένωσης σχετικά με το καθεστώς διέλευσης προσώπων από τα σύνορα (κώδικας συνόρων του Σένγκεν) αποτελεί ένα ζήτημα ιδιαίτερα σημαντικό για την εποχή που διανύουμε, καθώς γινόμαστε μάρτυρες μιας πρωτοφανούς κρίσης που δοκιμάζει τις αντοχές της Ευρώπης. Θεωρώ πως είναι θετική οποιαδήποτε προσπάθεια συμβάλλει στον εκσυγχρονισμό αλλά και τη διόρθωση των κανονισμών προς όφελος των πολιτών. Γι αυτό το λόγο αποφάσισα να υπερψηφίσω.

  Salvatore Cicu (PPE), per iscritto. ‒ Ho votato a favore della proposta di regolamento del Parlamento europeo e del Consiglio che istituisce un codice unionale relativo al regime di attraversamento delle frontiere da parte delle persone poiché sono convinto che il controllo di frontiera sia nell'interesse non solo dello Stato membro alle cui frontiere esterne viene effettuato, ma di tutti gli Stati membri che hanno abolito il controllo di frontiera interno. Il controllo di frontiera contribuirà alla lotta contro l'immigrazione clandestina e la tratta degli esseri umani, nonché alla prevenzione di qualunque minaccia per la sicurezza interna, l'ordine pubblico, la salute pubblica e le relazioni internazionali degli Stati membri, senza i diritti in materia di libera circolazione di cui godono i cittadini dell'Unione.

  Alberto Cirio (PPE), per iscritto. ‒ Questa proposta di regolamento si limita a codificare norme preesistenti, e ho votato a favore. Tuttavia, ritengo che si debba alzare la voce rispetto a quanto sta avvenendo in merito all'accordo di Schengen: il regolamento di Dublino è palesemente inadeguato ad affrontare la situazione che stiamo vivendo e in Europa in questo momento servono statisti che sappiano guardare al di là della contingenza e disegnare uno schema per il futuro, in maniera da avere nuove norme che siano in grado di resistere a qualunque evenienza. In questo Parlamento lavoriamo per un'entità che gli Stati membri sembrano essere pronti a sacrificare per le proprie necessità elettorali: noi non siamo qui a tappare un buco, ma a scrivere delle regole che i nostri cittadini ci chiedono e che semplifichino la vita nostra e di chi dovrà affrontare problemi simili nei prossimi decenni.

  Carlos Coelho (PPE), por escrito. ‒ Este regulamento, comumente designado por "Código de Fronteiras Schengen", foi aprovado em 2006 e consolida e desenvolve a componente política legislativa de gestão integrada das fronteiras da União Europeia. Ao longo dos anos sofreu seis alterações. Dentre as de maior monta está o estabelecimento de regras comuns sobre a reintrodução temporária do controlo nas fronteiras internas em circunstâncias excecionais, no âmbito do chamado "Pacote de Governação Schengen". As alterações que ora se procedem, que apoio, vêm apenas consolidar o texto que resultou das modificações ao regulamento original, por forma a permitir a sua melhor aplicação e interpretação.

  Lara Comi (PPE), per iscritto. ‒ Ho deciso di votare a favore della proposta di risoluzione in quanto si tratta di una semplice procedura di codificazione del testo già esistente che istituisce un codice unionale relativo al regime di attraversamento delle frontiere da parte delle persone (codice frontiere Schengen), senza apportarvi modifiche sostanziali.

  Edward Czesak (ECR), na piśmie. ‒ Nowe zapisy rozporządzenia wydają się być kolejnym krokiem w realizacji idei powołania wspólnej straży granicznej do ochrony unijnych granic, która ma zastopować m.in. falę nielegalnej imigracji do krajów Wspólnoty. Nowa formacja ma w dalszej perspektywie zastąpić obecną agencję Frontex mającą siedzibę w Warszawie. Z uwagi na dotychczasowe doświadczenia Frontex oraz kolejne nieprzekonujące mnie propozycje działań w obszarze wstrzymałem się od głosu.

  Gérard Deprez (ALDE), par écrit. ‒ J'ai voté en faveur du rapport visant à codifier le règlement établissant un code communautaire relatif au régime de franchissement des frontières par les personnes (code frontières Schengen). Vu les nombreuses modifications subies par ce Code, il me semble justifié, dans un souci de clarté et de transparence du droit, de procéder à cette codification. L'avis rendu par les services juridiques du Parlement européen, du Conseil et de la Commission confirme bien que la proposition se limite effectivement à une codification pure et simple des textes existants, sans modification du fond.

  Mireille D'Ornano (ENF), par écrit. ‒ Ce rapport a pour but de codifier l'ensemble des règles relatives à l'espace Schengen, construction qui est pourtant contestable à de nombreux égards. Or, le principe même de la codification vise à pérenniser un cadre juridique par la compilation de règles de droit positif. Étant cohérente et ne souhaitant pas le renforcement de cet espace, dont on constate chaque jour les conséquences dramatiques, j'ai voté contre ce texte.

Новият регламент ще замести различните актове, които са инкорпорирани в него. Той запазва напълно съдържанието на кодифицираните актове и се ограничава до тяхното обединяване, като внася единствено формални изменения, необходими за самото кодифициране.

Гласувах „въздържал се“, тъй като става дума за кодификация на законодателство, но като цяло смятам, че някои от текстовете нарушават суверенитета на държавите членки и приближават ЕС към централизирана федерална държава.

Las conclusiones por parte de los Servicios Jurídicos de las tres instituciones confirman que las codificaciones son correctas y que, por tanto, la presente propuesta de codificación dotará de mayor claridad y efectividad a las disposiciones recogidas.

"Pretende-se com este relatório introduzir alterações ao Regulamento de 2006, tendo em conta desenvolvimentos legais e a experiência prática, e também devido à entrada em vigor do Tratado de Lisboa.

As alterações encontram-se principalmente na clarificação da definição nas condições de entrada para nacionais de países terceiros e na duração da validade de alguns documentos de viagem. Também introduzem alterações no alargamento de isenção de carimbar os documentos de viagem dos tripulantes de comboios e autocarros de ligações internacionais, tal como já acontece com os tripulantes de avião.

Incluem-se medidas de formação dos guardas de fronteiras de forma a detetarem situações de menores não-acompanhados e vítimas de tráfico.

Não acompanhamos as alterações que visam uma cada vez maior harmonização das políticas de imigração e fronteiras, que obrigam os Estados-Membros a informar sobre os acordos bilaterais que estabeleçam no âmbito do Código das Fronteiras de Schengen. Nem a obrigação de os Estados-Membros serem obrigados a informar quando cidadãos "legais" de países terceiros entram em outro Estado-Membro."

Não obstante tratar-se de uma codificação, procedimento eminentemente técnico, votámos contra, tendo em conta a nossa posição de fundo relativamente à matéria em apreço.

  Marian Harkin (ALDE), in writing. ‒ I voted in favour of the technical codification proposed by the Commission which will not impact on the substance of the Schengen Border Code, only simplify and clarify the text, making it clearer and more accessible to citizens.

On 20 January 2015 the Commission adopted a proposal for the technical codification of the Schengen Border Code (i.e. the rules governing movement of persons across Schengen borders). The Schengen Borders Code regulation is intended to improve the legislative part of the integrated border management European Union policy by setting out the rules on the border control of persons crossing EU external borders and on the temporary reintroduction of border control at internal borders. This regulation applies to any person crossing the external borders of all EU countries, except those of the United Kingdom and Ireland, and the internal borders of the Schengen area (a border-free area comprising 22 EU countries, along with Iceland, Liechtenstein, Norway and Switzerland). Ireland is not a member of Schengen and so we do not fall under the remit of the Schengen Border Code.

Da ich mich für eine Vereinfachung des EU-Rechts und einen Abbau der Bürokratisierung bei den EU-Institutionen einsetze, habe ich dem Vorschlag zugestimmt.

  Филиз Хюсменова (ALDE), в писмена форма. ‒ Уважаеми г-н Председател, Шенгенското пространство е едно от най-осезаемите постижения на европейския проект. Виждаме, че ограниченията във функционирането му водят до забавяния в транспорта, до огромни загуби за европейската икономика. Те повличат отрицателни последици за цялостното състояние на единния европейски пазар, на паричния съюз, стойността на еврото.

Ето защо Европа трябва да положи всички усилия за опазването му, особено чрез укрепване на външните граници на Съюза. При това е крайно несправедливо държави като България и Румъния, натоварени с опазването на 3 349 км от външните граници на Съюза, да бъдат държани извън Шенген, въпреки изпълнените критерии за прием.

  Ivan Jakovčić (ALDE), napisan. ‒ Glasao sam za nacrt zakonodavne rezolucije Europskog parlamenta o prijedlogu uredbe Parlamenta i Vijeća o Zakoniku Unije o pravilima kojima se uređuje kretanje osoba preko granica (Zakonik o schengenskim granicama), jer se dotični prijedlog ograničava na kodifikaciju bez suštinske promjene.

U jednom vrlo važnom području poput kretanja osoba ključno je da pravo Europske unije bude jasnije i pristupačnije te da se osigura izvjesnost istoga. Europska unija mora jamčiti jednostavnije i učinkovitije pronalaženje i razumijevanje njezinih pravnih akata, a kodifikacija ide upravo ka tom smjeru. U tom kontekstu podržavam, također, međuinstitucionalni sporazum kojim se omogućuje ubrzani postupak za brzo donošenje kodificiranih akata.

  Jean-François Jalkh (ENF), par écrit. ‒ Le rapport dont il est ici question vise à codifier le corpus de règles rassemblées autour du statu quo Schengen. Alors qu’historiquement, de l'empereur romain Justinien à l'empereur français Napoléon, toute entreprise de codification s’inscrivait dans une volonté d'assurer la postérité de règles et de consacrer des grands principes juridiques, il s’agit ici d'apporter notre pierre à un édifice que nous souhaitons déconstruire en raison de ses faiblesses patentes. L’espace Schengen a en effet très largement empiré la crise migratoire que nous connaissons actuellement. J’ai donc voté contre ce texte.

  Diane James (EFDD), in writing. – My colleagues and I in UKIP voted against this report, because it creates legislation. UKIP is against the EU having any power to legislate so as to make the laws of the United Kingdom.

UKIP opposes the operation of the Schengen Agreement which is causing so much long-term harm to the peoples of the Member States. This is permitting and causing the current crisis in respect of largely economic migrants from Africa and the Middle East and thereby exacerbating the problems of migration from the EU into the United Kingdom.

  Giovanni La Via (PPE), per iscritto. – L'istituzione di un codice comunitario relativo al regime di attraversamento delle frontiere da parte delle persone (codice frontiere Schengen), si limita a una codificazione dei testi esistenti. Ciò non comporta alcuna modifica sostanziale e ho dunque deciso di votare a favore. Come tutti noi sappiamo, l'Unione europea sta attraversando un momento storico senza precedenti e la legislazione comunitaria, in materia d'immigrazione ha bisogno di maggiore chiarezza. Quest'ultima, unita alla certezza giuridica e all'applicazione immediata delle norme comunitarie, è strettamente connessa all'istituzione del codice di cui siamo chiamati a discutere.

  Marine Le Pen (ENF), par écrit. ‒ J’ai voté contre la proposition de règlement du Parlement et du Conseil concernant un code de l'Union européenne relatif au régime de franchissement des frontières par les personnes (code frontières Schengen). La proposition en question se limite à une codification de textes existants, sans modification de leur substance. Or le système Schengen s’est avéré un échec. Il ne s’agit donc pas de le modifier ou de le codifier, il faut le supprimer et donner la possibilité aux États membres de retrouver le contrôle de leurs frontières.

  Gilles Lebreton (ENF), par écrit. ‒ J’ai voté contre ce rapport car il approuve la codification des règles de l’espace Schengen. Or je suis contre l’espace Schengen que cette codification tente de sauver. Il faut retrouver la maîtrise de nos frontières nationales pour stopper la vague migratoire.

La codification a une signification puisqu'historiquement, de l'empereur romain Justinien à l'empereur Napoléon, elle s'inscrivait dans une volonté d'assurer la postérité des règles et de consacrer de grands principes juridiques et sociétaux.

Je refuse donc que soit consacré comme principe l'édification de l'espace Schengen, qui plus est dans son volet de libre circulation des personnes sans aucune frontière ni aucun contrôle. Cette construction artificielle, instable et inepte qu'est l'espace Schengen étant à déconstruire selon moi, j'ai logiquement voté contre ce rapport.

  Ivana Maletić (PPE), napisan. ‒ Kodifikacija Regulacije (EZ) br. 562/2006 o Schengen zoni postavlja uvjete, kriterije i detaljna pravila o promjenama graničnih provjera uzimajući u obzir ljudska prava i dignitet. Granična kontrola će provjeravati pojedinačno osobe kao i do sada, ali će također uvesti dodatne provjere kako bi se osigurale unutarnje granice EU-a. Dodatno će se provjeravati osobe u tzv. SIS sustavu.

Budući da se jedino putem otiska prsta može zaista identificirati osoba, uvest će se konsolidacija sa tzv. VIS sustavom Također, pri prelasku granica svaki put će biti obvezno pečatirati putovnicu. Prema prijedlogu rezolucije, mogućnost ponovnog uvođenja unutarnjih granica EU-a će biti isključivo iznimka i tretirat će se kao zadnja opcija. Također, potrebno je osigurati zajednički odgovor na prijetnje koje mogu prouzročiti zatvaranje granica. Najdulji vremenski period za zatvaranje granica je 10 dana, nakon tog vremenskog perioda, ukoliko je potrebno produljenje, nužno je dobiti odobrenje na razini EU-a.

Podržala sam prijedlog o promjenama pravila budući da je potrebno osigurati unutarnju sigurnost EU-a. Svrha promjene regulacije je bolje upravljanje prelaska granicama kako bi se pojačala sigurnost unutar EU-a gdje ne postoje državne granice. S obzirom na prethodna zbivanja i terorističke napade, javlja se potreba za dodatnom sigurnošću i iz toga razloga podržavam prijedlog.

  Andrejs Mamikins (S&D), rakstiski. ‒ Apmēram 10 gadus atpakaļ – 2006. gada martā – tika pieņemta Eiropas Parlamenta un Padome Regula (EK) Nr. 562/2006, kuras mērķis bija ieviest Kopienas Kodeksu par noteikumiem, kas reglamentētu personu pārvietošanos pār robežām. Savukārt gadu atpakaļ februārī un aprīlī Eiropas Parlamenta, Padomes un Komisijas juridisko darbinieku darba grupa nonāca pie secinājuma, ka Komisijas sākotnējais priekšlikums, ar kuru tiktu uzstādīts Šengenas Robežu kodekss, ir pilnībā pieņemams, jo nekādā ziņā neienes nekādus grozījumus esošajos tekstos, bet tikai juridiski tos apvieno un tādējādi kodificē.

Citiem vārdiem, šodien notika balsojums, kura mērķis bija savā ziņā paaugstināt pastāvošo normatīvo aktu juridiskā spēka līmeni caur tālāko integrējošo kodificēšanu ar jaunās regulas palīdzību. Cerams, ka tas ļaus palielināt Šengenas zonas darbības efektivitāti, kas pēdējā gada laikā esot kļuvusi par daudz principiālāku izaicinājumu, nekā jebkad iepriekš.

  Νότης Μαριάς ( ECR), γραπτώς. ‒ Καταψήφισα την έκθεση σχετικά με την πρόταση κανονισμού του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου για τη θέσπιση του κώδικα της Ένωσης όσον αφορά το καθεστώς διέλευσης προσώπων από τα σύνορα (κώδικας συνόρων Σένγκεν), διότι με έμμεσο τρόπο υφαρπάζει αρμοδιότητα των κρατών-μελών στον τομέα των κανόνων που αφορούν στην διέλευση προσώπων από τα σύνορα. Οι αρμοδιότητες αυτές ανήκουν στα κράτη-μέλη και ο Shengen Borders Code παραβιάζει εν προκειμένω την αρχή της επικουρικότητας και της αναλογικότητας.

È quindi di grande importanza l'esistenza di una normativa europea che sia semplice e chiara così da permettere a tutti i cittadini europei di accedere ad essa e far valere i diritti che detta normativa sancisce.

  Georg Mayer (ENF), schriftlich. ‒ Eine weitere Einzementierung der aktuellen Rechtslage, welche für die derzeitige Krisensituation nicht die richtigen Antworten bietet, ist sicherlich der falsche Weg. Die Nationalstaaten müssen frei darüber entscheiden können, ob und wie sie ihre Grenzen schützen. Daher stimme ich gegen eine Kodifizierung der Schengen-Gesetze und somit gegen diesen Bericht.

Il ouvre la porte cependant à des abus comme la dernière loi danoise de confiscation des biens des migrants. Ainsi ce règlement explique pour beaucoup les désastres de la gestion de la crise migratoire actuelle. Je vote contre sa codification.

  Miroslav Mikolášik (PPE), písomne – Európska únia dnes čelí historickým udalostiam, keď na jej územie prichádza viac utečencov ako kedykoľvek v jej dejinách. Ťažká situácia na Blízkom východe a v Afrike núti mnohých ľudí utekať zo svojich domovov a hľadať bezpečie v iných krajinách. Mnohí z nich hľadajú útočisko práve v štátoch Európskej únie. Schengenský priestor, ktorý je veľkým prínosom pre uľahčenie života bežných ľudí aj podnikateľov v Európe, musí byť dostatočne chránený presnými pravidlami a ich dodržiavaním, a to s ohľadom na bezpečnosť obyvateľov aj utečencov, ktorí prekračujú jeho hranice. Z uvedených dôvodov vítam všetky zmeny, ktoré návrh legislatívneho uznesenia prináša a ktoré pozitívnym spôsobom regulujú právnu úpravu v tejto oblasti.

Voto favoravelmente o presente relatório, que salienta o facto de o estabelecimento de normas aplicáveis à passagem de pessoas nas fronteiras não poder ser suficientemente realizado pelos Estados-Membros, podendo ser mais bem alcançado ao nível da União.

Neste sentido, a União deve tomar as medidas necessárias, em conformidade com o princípio da subsidiariedade consagrado no artigo 5.º do Tratado da União Europeia. Em conformidade com o princípio da proporcionalidade consagrado no mesmo artigo, o referido regulamento e as suas alterações sucessivas não excedem o necessário para alcançar aquele objetivo.

  Norica Nicolai (ALDE), în scris. ‒ Am votat în favoarea acestui raport întrucât problema trecerii frontierelor o cunoaștem cu toții, ea fiind legiferată prin Codul Frontierelor Schengen. Raportul de astăzi nu modifică în fond acest Cod al Frontierelor Schengen, ci se referă doar la o codificare a textelor existente, încredințând Președintelui sarcina de a transmite Consiliului, Comisiei și parlamentelor naționale poziția noastră, a forului european de legiferare. În acest sens, consider că aceste schimbări sunt benefice pentru toate statele membre, în acest moment în care regulile de trecere a frontierelor în spațiul Schengen trebuie să fie extrem de clare.

  Péter Niedermüller (S&D), írásban. ‒ A schengeni rendszer az Európai Unió egyik legfontosabb, nagy gyakorlati hasznot hozó, és egyben jelképes értékű vívmánya. Annak érdekében, hogy a rendszer a nagy számú menedékkérő és a terrorveszély körülményei között is fenntartható legyen szükséges a rendszer szabályainak pontosítása. A Parlament álláspontja azért száll síkra, hogy a rendszer fejlesztése ne érintse Schengen legfontosabb előnyeit, ezért támogatom.

  Franz Obermayr (ENF), schriftlich. ‒ Ich hätte mich gegen diesen Bericht ausgesprochen, da der Schengener Grenzkodex, der die Regeln für das Schengen-Gebiet enthält, die EU-Kommission und die betroffenen Mitgliedsstaaten verpflichtet, das Europäische Parlament sowie den Rat der EU zu informieren, falls Gründe für eine befristete Wiedereinführung von Grenzkontrollen bestehen. Gerade in diesen Zeiten sind Grenzkontrollen besonders wichtig. Kurzfristige Regelungen und Grenzkontrollen sind für mich nicht akzeptabel.

UKIP opposes the operation of the Schengen Agreement which is causing so much long-term harm to the peoples of the Member States. This is permitting and causing the current crisis in respect of largely economic migrants from Africa and the Middle East and thereby exacerbating the problems of migration from the EU into the United Kingdom.

  Aldo Patriciello (PPE), per iscritto. ‒ Il regolamento del codice frontiere Schengen si applica a chiunque attraversi le frontiere esterne di tutti i paesi dell'Unione europea, esclusi Regno Unito e Irlanda, e le frontiere interne dell'area Schengen. Tale regolamento, come è ben noto ha rilevato un ottimo risultato attuando differenti decisioni per le due frontiere. Accolgo quindi con favore una mera codificazione dei testi esistenti, senza modificazioni sostanziali. Voto positivamente.

  Eva Paunova (PPE), in writing. – Free movement within the Schengen area is one of the most important freedoms of the European Union. National borders undermine one of the main achievements of the EU – the internal market. Initial estimates indicate that the economic loss from reinstating some national borders is equivalent to the imposition of a 3% tax in the EU. The only solution is strengthening the security of external borders and the Commission proposal to establish a European Border and Coast Guard. Actions need to be undertaken within the shortest delay possible and I welcome the report on the proposal for a regulation on the rules governing the Schengen Borders Code.

  Alojz Peterle (PPE), in writing. ‒ Different events have proved that the cross-border movement of persons could not be sufficiently achieved by the Member States but could rather be better achieved at Union level. Given the current state of play in which the Schengen area is confronted with extreme realities, a solution from the Union is what is needed.

  Marijana Petir (PPE), napisan. ‒ Podržala sam ovo izvješće kojim se uređuju pravila kretanja osoba preko granica, jer smatram kako će uređenje Zakonika o schengenskim granicama pomoći boljoj kontroli kretanja. Vjerujem kako je važno jasno odrediti parametre u kojima se mogu ponovno uvesti interni granični punktovi te kako svakoj graničnoj kontroli treba pristupati s potpunom profesionalnošću, pritom posebno poštujući ljudsko dostojanstvo.

Važno je imati jasno uređena pravila kako bi se pri svakoj situaciji, bila ona teroristički incident, prijetnja, sumnja u organizirani kriminal ili nešto treće, imao brz i jasan odgovor na terenu. Takva reakcija je moguća jedino uz pristup koji pruža ovaj prijedlog pravila, iz kojeg se bez gubljenja vremena na tumačenje propisa odmah može vidjeti koja je reakcija prikladna u skladu s regulativama Europske unije.

Uzevši u obzir kako ovaj prijedlog pozitivno utječe na vrlo važna pitanja sigurnosti građana Europske unije, a i onih izvan nje, te jasnije određuje neke dijelove s njim povezane Regulative uz pomoć kojih će efikasnost u izvanrednim situacijama biti na višoj razini, u potpunosti ga podržavam.

  Tonino Picula (S&D), napisan. ‒ Podržavam izvješće o kodifikaciji, tj. prijedlog uredbe Europskog parlamenta i Vijeća o Zakoniku Unije o pravilima kojima se uređuje kretanje osoba preko granica (Zakonik o schengenskim granicama), budući da je u prijedlogu u potpunosti očuvan sadržaj akta koji se kodificira, a posebice s obzirom na sporazum o ubrzanoj metodi rada za službeno kodificiranje zakonodavnih tekstova.

U situacijama kada države članice ne mogu dostatno ostvariti i provoditi pravila koja se primjenjuju na kretanje osoba preko granice, pravo je i ovlast Unije da može donositi mjere u skladu s načelom supsidijarnosti utvrđenim u članku 5. Ugovora o Europskoj uniji, a da pritom, u skladu s načelom proporcionalnosti, ne prelazi ono što je potrebno za ostvarenje cilja. Ono što je bitno jest da se ovaj prijedlog ograničava na kodifikaciju postojećih tekstova i ne ulazi u suštinske promjene.

  João Pimenta Lopes (GUE/NGL), por escrito. ‒ O novo regulamento substituirá os diversos atos nela integrados cingindo-se a uma codificação simples dos textos existentes, sem alterações substantivas.

As alterações centram-se essencialmente na clarificação da definição, nas condições de entrada para nacionais de países terceiros e na duração da validade de alguns documentos de viagem. São também introduzidas alterações no alargamento da isenção de carimbar os documentos de viagem dos tripulantes de comboios e autocarros de ligações internacionais, tal como já acontece com os tripulantes de avião. Incluem-se medidas de formação dos guardas de fronteiras de forma a detetarem situações de menores não-acompanhados e vítimas de tráfico.

Independentemente da avaliação feita quanto a estas alterações menores, não alteramos a reflexão anteriormente feita em relação a Schengen. Não acompanhamos a cada vez maior harmonização das políticas de imigração e fronteiras, que obrigam os Estados-Membros a informar sobre os acordos bilaterais que estabeleçam no âmbito do Código das Fronteiras de Schengen. Nem a obrigação dos Estados-Membros serem obrigados a informar quando cidadãos "legais" de países terceiros entram noutro Estado-Membro.

  Andrej Plenković (PPE), napisan. – Podržavam izvješće kolegice Heidi Hautala o prijedlogu uredbe Europskog parlamenta i Vijeća o Zakoniku Unije o pravilima kojima se uređuje kretanje osoba preko granica. Zajedničke mjere o prelasku osoba preko unutarnjih granica i pogranična kontrola na vanjskim granicama trebala bi odražavati pravnu stečevinu Europske unije inkorporiranu u okvir Europske unije, posebice relevantne provizije Konvencije o provedbi Schengenskog sporazuma iz 1985. godine.

Pogranična kontrola je u interesu ne samo država članica na čijim vanjskim granicama se provodi, već svih država članica koje su ukinule unutarnju pograničnu kontrolu. Granice bi trebale pomoći u suzbijanju ilegalne imigracije i krijumčarenja ljudima te u prevenciji bilo kakve prijetnje unutarnjoj sigurnosti, javnoj politici, javnom zdravlju i međunarodnim odnosima država članica. Isto tako, nužno je osigurati pravila o računanju autoriziranog trajanja kratkoročnih boravaka u EU-u.

Jasna, jednostavna i usklađena pravila za sve legalne radnje povezane s tim pitanjem doprinijela bi putnicima, a i pograničnim vlastima i vlastima za vize. Naposljetku, države članice bi trebale osigurati da postupci kontrole na vanjskim granicama ne stvore značajne prepreke za trgovinu i društvenu i kulturološku razmjenu. Stoga bi države članice trebale postaviti odgovarajući broj osoblja i resursa. Iz navedenih razloga, slažem se s izvješćem.

  Miroslav Poche (S&D), písemně. ‒ Přijímaný dokument byl pouze technické povahy, nicméně rád bych tento prostor využil k vysvětlení svého postoje a podpory udržení schengenského prostoru tak, jak to známe nebo jsme aspoň donedávna znali. Schengenský prostor představuje jeden z největších úspěchů evropské integrace, symbol spojené Evropy, výsady, kterou vnímáme jako samozřejmost. Ta je ovšem nyní ohrožena, pokud evropské státy nenajdou společné řešení a bude pokračovat uzavírání vnitřních hranic Unie, jak už se v případě několika států stalo. Čelíme naléhavým otázkám, které musíme společně řešit. Jak nastavit systém přijímání uprchlíků z válek zmítaných zemí? Jak pomoci státům, které jsou uprchlickou krizí nejvíce postiženy? Jak efektivněji ochraňovat vnější hranice schengenského prostoru, abychom nemuseli uzavírat hranice vnitřní? Zvládání migrační krize a Schengen jsou spojené nádoby. Mají hluboký společenský, ale i finanční dopad. Chceme-li financovat naši azylovou politiku, která je velmi drahá, nemůžeme si dovolit ztratit miliardy EUR, o které přijdeme omezením provozu na vnitřních hranicích. Očekávám od evropských lídrů, že svá rozhodování budou činit po důkladném zvážení všech aspektů a že komplexnímu fungování Schengenu a jeho dopadu bude věnováno více pozornosti než tomu bylo dosud.

  Salvatore Domenico Pogliese (PPE), per iscritto. ‒ A seguito di diverse riunioni, svoltesi nel 2015, tra i servizi giuridici del Parlamento europeo e quelli del Consiglio e della Commissione europea si è arrivati alla conclusione di una codificazione del regolamento (CE) n. 562/2006 del Parlamento europeo e del Consiglio del 15 marzo 2006. Tale codificazione istituisce un codice comunitario relativo al regime di attraversamento delle frontiere da parte delle persone (codice frontiere Schengen) senza modificazioni sostanziali. Ho votato a favore di questa relazione perché ritengo che la codificazione delle diverse disposizioni sia indispensabile al fine di rendere la normativa vigente in materia di attraversamento delle frontiere più comprensibile e trasparente.

  Stanislav Polčák (PPE), písemně. ‒ Návrh na kodifikované znění kodexu Evropské unie o pravidlech, která upravují přeshraniční pohyb osob, podporuji. Poradní skupina složená z právních služeb Evropského parlamentu, Rady a Komise nenavrhla zásadní přeměnu kodexu a jak bylo zmíněno v příslušném stanovisku, poradní skupina dospěla k jednomyslnému závěru, že tento zmíněný návrh je pouhou kodifikací stávajících znění bez jakékoli změny jejich věcného obsahu.

  Tomasz Piotr Poręba (ECR), na piśmie. ‒ Po analizie wniosku Komisji dotyczącego rozporządzenia nr 562/2006 należy zauważyć, że mamy tu do czynienia z ważną zmianą zmierzającą do oddania UE kolejnego uprawnienia należącego dotąd do poszczególnych krajów wspólnoty, tj. ochrony własnych granic. Można to pośrednio wywnioskować ze zmiany treści motywu 19, który otrzyma następujące brzmienie: „W związku z tym, że cel rozporządzenia (WE) nr 562/2006 oraz kolejnych aktów je zmieniających, a mianowicie ustanowienie zasad stosowanych do przepływu osób przez granice, nie mógł zostać osiągnięty w sposób wystarczający przez państwa członkowskie, natomiast możliwe było jego lepsze osiągnięcie na poziomie Unii, Unia mogła przyjąć środki zgodnie z zasadą pomocniczości określoną w art. 5 Traktatu o Unii Europejskiej. Zgodnie z zasadą proporcjonalności, określoną w tym samym artykule, to rozporządzenie oraz kolejne akty je zmieniające nie wykraczały poza to, co było konieczne do osiągnięcia tego celu”.

Nowy zapis motywu 19 rozporządzenia wydaje się być kolejnym krokiem w realizacji idei powołania wspólnej straży granicznej do ochrony unijnych granic, która ma zastopować m.in. falę nielegalnej imigracji do krajów Wspólnoty. Nowa formacja ma w dalszej perspektywie zastąpić obecną agencję Frontex mającą siedzibę w Warszawie. Za powołaniem wspólnej unijnej straży granicznej od lat opowiada się Francja, a także Niemcy. Nie zgadzam się na wprowadzoną zmianę dającą w dalszej perspektywie podstawy do oddania UE kontroli nad ochroną swoich granic, co w praktyce oznacza oddanie UE znacznego zakresu suwerenności państw członkowskich.

  Jiří Pospíšil (PPE), písemně. ‒ Schengenský prostor stále žije. Dokazuje to i fakt, že dnes zde rozhodujeme právě o této zprávě. Je samozřejmě více méně technická, ale i tak je signálem, že většina z nás si přeje udržení schengenského systému, protože je ekonomicky i politicky výhodný pro naše občany.

Este relatório, que votei favoravelmente, foi efetuado de modo a assegurar o pleno respeito pela dignidade humana e a garantir que o controlo fronteiriço não seja exclusivamente feito no interesse do Estado-Membro em cujas fronteiras externas se exerce, mas no interesse de todos os Estados-Membros que suprimiram o controlo nas suas fronteiras internas. Estas medidas deverão continuar a contribuir para a luta contra a imigração clandestina e o tráfico de seres humanos, bem como para a prevenção de qualquer ameaça para a segurança interna, a ordem e saúde públicas, e as relações internacionais dos Estados-Membros.

Pritariu, kad taisyklės turėtų būti visiems vienodos, tačiau svarbu ir tai, kad šalys narės turėtų pakankamai lankstumo jas įgyvendinti; esant reikalui priimti papildomas taisykles.

  Fernando Ruas (PPE), por escrito. ‒ O presente relatório diz respeito a uma proposta de regulamento do Parlamento e do Conselho relativamente à compilação de um conjunto da legislação dispersa relativa ao regime de passagem das pessoas nas fronteiras, com vista a estabelecer um código comunitário (Código das Fronteiras Schengen).

Tendo em conta o crescente cenário de ameaça terrorista que assola a Europa e as medidas internacionais tomadas contra esta escalada de violência, esta proposta de codificação do regulamento vem consagrar, mediante uma análise prévia dos riscos para a segurança interna e das ameaças que possam afetar a segurança das fronteiras externas, a codificação das normas já existentes relativas à passagem de pessoas nos controlos fronteiriços.

Num espaço sem controlos nas fronteiras internas como é a UE, é necessário ter uma resposta comum às situações que possam afetar gravemente a ordem pública ou a segurança interna, permitindo por isso a introdução temporária do controlo interno das fronteiras em circunstâncias excecionais, sem pôr em causa o princípio da livre circulação de pessoas.

Tendo em conta o carácter excecional inerente a esta medida (de teor marcadamente técnico) votei favoravelmente o presente relatório.

  Tokia Saïfi (PPE), par écrit. ‒ J'ai voté en faveur de ce rapport qui soutient la proposition de la Commission de codifier le règlement établissant un code communautaire relatif au régime de franchissement des frontières par les personnes.

C'est donc dans un souci de transparence et de clarté du droit que ce nouveau règlement se substituerait aux divers actes qui sont incorporés dans le code frontières de Schengen. Le contenu du code est préservé; il s'agit d'une simple opération de codification. Ainsi, les conditions d'application liées à l'absence de contrôle aux frontières intérieures de l'UE, les types de contrôles, les circonstances particulières, les modalités de réintroduction exceptionnelle des contrôles ainsi que les réponses aux menaces graves font l'objet d'une nouvelle codification.

Cette opération de codification permet une clarification juridique nécessaire à la mise en œuvre du code frontières de Schengen.

  Branislav Škripek (ECR), písomne ‒ V súčasnej kríze je nutné uskutočňovať konkrétne kroky. Veľké záchranné plány ani kvóty nefungujú v praxi. Preto podporujem konkrétne definovanie praktického spôsobu kontrol na vonkajších hraniciach. Pravidlá tohto systému by však mali byť definované jasnejšie a zrozumiteľnejšie, akceptujúce suverenitu členských štátov. Z tohto dôvodu som sa pri hlasovaní o návrhu nariadenia Európskeho parlamentu a Rady, ktorým sa ustanovuje kodifikované znenie Kódexu schengenských hraníc, zdržal.

  Davor Škrlec (Verts/ALE), napisan. ‒ Pozitivno sam glasao za ovo izvješće, no ovo obrazloženje glasovanja nastaje kao kritika postojećem sustavu vrednovanja rada zastupnika u Europskom parlamentu isključivo na osnovu statističkog broja parlamentarnih aktivnosti potenciranog u Hrvatskoj, a koji zapravo ne odražava stvarnu kvalitetu i količinu rada, učinkovitost te ponajviše uspjeh zastupničkog djelovanja.

  Monika Smolková (S&D), písomne ‒ Schengenské hranice sú posledné mesiace pod obrovským tlakom. Na jednej strane sú to vonkajšie hranice, ktoré si vyžadujú silnejšiu ochranu. Ale popritom je treba zabezpečiť, aby v krízových situáciách bolo možné vykonávať efektívnu ochranu vnútorných hraníc členských štátov. Za týmto účelom prišla Komisia s návrhom na kodifikáciu smernice o Schengenskom kódexe. Snahu Komisie vyjasniť a racionalizovať pravidlá upravujúce podmienky zavádzania kontrol na hraniciach vítam a podporujem, aj keď je treba podotknúť, že ide najmä o zosúladenie už existujúcich predpisov.

Som presvedčená, že kontroly na vonkajších hraniciach členských štátov by mali byť zavádzané len v krajných prípadoch, aby sme dlhodobo nebránili voľnému pohybu v schengenskom priestore. Ale orgány jednotlivých krajín musia mať možnosť zabezpečiť svoju vnútornú bezpečnosť. Okrem kontroly na hraničných prechodoch je súčasťou Schengenského kódexu aj analýza rizík, hliadkovanie na hraniciach a využívanie informačného systému Schengenu. Občania tretích krajín sa musia vnútri EÚ pohybovať tak, aby bolo z informačného systému víz a z ich cestovných dokumentov jasné, kedy do EÚ vstúpili a ktoré hranice prekročili. Ak je na niektorých miestach potrebné zaviesť hraničné kontroly aj pre občanov EÚ, mali by byť vykonávané v súlade s ľudskou dôstojnosťou a tak, aby bol čo najviac znížený čas čakania na prekročenie hranice.

  Ivan Štefanec (PPE), písomne ‒ Kódex v plnej miere rešpektuje právo voľne sa pohybovať a zdržiavať sa na území členských štátov EÚ. Otázka problematiky azylu, pohybu cudzincov, kontroly hraníc, ochrany práv štátnych príslušníkov tretích krajín, ako i práv občanov Únie a ich rodinných príslušníkov patrí medzi primárne úlohy demokratickej spoločnosti založenej na princípoch slobody, bezpečnosti a spravodlivosti.

  Tibor Szanyi (S&D), írásban. ‒ Támogattam a határozat elfogadását, figyelemmel arra, hogy a Bizottság javaslata, amely az intézményközi bizottsági egyeztetések során támogatást kapott, a schengeni rendszer működőképességének fenntartását és a gyakorlati követelményekhez való igazítását szolgálja. Bár a javasolt módosítások alapvetően jogi-technikai jellegűek, az a felismerés képezi alapjukat, hogy a személyek országhatárokon keresztüli mozgását szabályozó schengeni előírások végrehajtása során bebizonyosodott, hogy a külön tagállami szintű végrehajtással szemben a közösségi, uniós szabályozás és végrehajtás szerepét kell erősíteni.

A közösségi módszer erősítését célzó hasonló korrekciós törekvéseket az átjárható európai határoknak nagy jelentőséget tulajdonító képviselőként a jövőben is támogatni fogom az EP eljárásai során.

A new recital is inserted, based on already existing provisions, recalling the importance of managing movement of persons at EU level, in accordance with the principles of necessity and proportionality.

  Isabelle Thomas (S&D), par écrit. ‒ J'ai voté en faveur de ce rapport, déterminée à maintenir les accords et les frontières de Schengen. Sans la libre circulation des citoyens, l’union ne serait plus qu’un grand marché. Je ne transigerai pas.

Le nationalisme et la rhétorique identitaire conduisent à l’impasse. Pour résoudre la crise migratoire, comme pour combattre les risques terroristes, les pays européens doivent s’unir et renforcer leur politique frontalière commune, pas la disloquer. Le retour aux frontières nationales ne ferait qu’aggraver l’isolement et condamnerait chacun à l’impuissance.

Ceux qui avaient tenté de sortir la Grèce de la zone euro, proposent aujourd'hui de la sortir de l'espace Schengen. C’est inacceptable. La Grèce n'est pas responsable de sa situation géographique qui en fait un point d'arrivée privilégié pour les réfugiés du Moyen-Orient. Faut-il une politique de gestion des frontières? Oui. Mais celle-ci doit se faire aux frontières extérieures de l'Union et avec des gardes-frontières européens!

L'Union Européenne est aujourd'hui dans une phase cruciale : si Schengen tombe, elle tombera aussi. Ensemble nous serons plus forts, sans coopération, nous resterons impuissants.

  Ruža Tomašić (ECR), napisan. ‒ Iako se prema mišljenju savjetodavne skupine pravnih službi Europskog parlamenta, Vijeća i Komisije prijedlog uredbe Europskog parlamenta i Vijeća o Zakoniku Unije o pravilima kojima se uređuje kretanje osoba preko granica ograničava samo na kodifikaciju postojećih tekstova bez suštinskih promjena, vidljivo je da se izmjenom u uvodnoj izjavi radi o važnoj promjeni usmjerenoj na davanje ovlasti Europskoj uniji glede upravljanja na granicama.

S obzirom da podržavam poštivanje suvereniteta i integriteta svake države članice Europske unije, ne mogu podržati još jedan korak u ostvarenju ideje o osnivanju zajedničke granične policije Europske unije, odnosno korak prema federalnoj Uniji. Stoga sam glasovala suzdržano.

  Romana Tomc (PPE), pisno. ‒ Poročilo o predlogu uredbe Evropskega parlamenta in Sveta o Zakoniku Unije o pravilih, ki urejajo gibanje oseb prek meja (Zakonik o schengenskih mejah) sem podprla, saj sem mnenja, da je potrebno pretehtati nujnost in sorazmernost ponovne uvedbe nadzora na notranjih mejah glede na grožnjo javnemu redu ali notranji varnosti, zaradi katere je nastala potreba za takšno uvedbo nadzora.

Pretehtati pa bi bilo treba tudi alternativne ukrepe, ki bi se lahko sprejeli na nacionalni ravni, na ravni Unije ali na obeh ravneh, ter učinek takšnega nadzora na prosto gibanje oseb na območju brez nadzora na notranjih mejah.

Ponovna uvedba nadzora na notranjih mejah bi se na območju, kjer se osebe lahko prosto gibljejo, še naprej morala uporabljati le izjemoma. V prvi vrsti si moramo prizadevati za varnost vseh državljanov Unije.

  Ulrike Trebesius (ECR), schriftlich. ‒ Die Europäische Kommission hat dem Europäischen Parlament einen Kodifizierungsvorschlag für den Schengener Grenzkodex unterbreitet. In einer Kodifizierung dürfen keine materiell-inhaltlichen Änderungen vorgenommen werden. Der konkrete Vorgang stützt sich unter anderem auf die Interinstitutionelle Vereinbarung vom 20. Dezember 1994 über ein beschleunigtes Arbeitsverfahren für die amtliche Kodifizierung von Rechtstexten. Dabei geht es darum, im Sinne einer Vereinfachung bestehende EU-Rechtsakte zusammenzufassen. Im vorliegenden Fall betrifft dies den Gemeinschaftskodex für das Überschreiten der Grenzen durch Personen, kurz Schengener Grenzkodex genannt. Die neue Verordnung ersetzt die verschiedenen Rechtsakte, die Gegenstand der Kodifizierung sind.

Da ich mich für eine Vereinfachung des EU-Rechts und einen Abbau der Bürokratisierung bei den EU-Institutionen einsetze, habe ich dem Vorschlag zugestimmt.

Il n'est donc pas question d'apporter notre pierre à un édifice que nous souhaitons déconstruire.

  Ivo Vajgl (ALDE), in writing. ‒ I voted in favour of this report, which is mainly a technical codification of existing rules that have been amended several times. Specifically, the purpose of this proposal is to undertake a codification of Regulation (EC) No 562/2006 of the European Parliament and of the Council of 15 March 2006 establishing a Community Code on the rules governing the movement of persons across borders (Schengen Borders Code). The new Regulation will replace the various acts incorporated in it; this proposal fully preserves the content of the acts being codified and does nothing more than bring them together with the only exception of formal amendments that are required by the codification exercise itself. The reason for such codifications is that the Commission attaches great importance to simplifying and clarifying the law of the Union so as to make it clearer and more accessible to citizens. This aim cannot be achieved so long as numerous provisions that have been amended several times, often quite substantially, remain scattered, so that they must be sought partly in the original instrument and partly in later amending ones.

Habida cuenta de la naturaleza de dicha norma, creo conveniente votar a su favor.

  Hilde Vautmans (ALDE), schriftelijk. ‒ Ik stemde voor dit verslag. In Europa zijn we er niet in geslaagd een collectief antwoord te bieden op de vluchtelingencrisis. Keer op keer voeren we discussie over mogelijke oplossingen, maar bijna nooit komt het tot een gemeenschappelijk optreden van de Europese Unie. Zelfs in de gevallen waarin we wel tot een gemeenschappelijk optreden komen, slagen we er niet in om dit tot een succesvol einde te brengen.

Nochtans spreekt het voor zich dat het probleem van de vluchtelingencrisis niet door één lidstaat alleen kan worden opgelost. Dit is een Europese crisis en dus moet er een Europees antwoord komen. Het sluiten van de binnengrenzen van de Schengenzone kan geen oplossing zijn, het bewaken van onze gemeenschappelijke buitengrenzen daarentegen wel. Ik pleit daarom enerzijds voor een gemeenschappelijke Europese grens- en kustwacht die onze buitengrenzen bewaakt en anderzijds voor een Europese reeks migratieregels die voor de gehele Unie gelden.

  Miguel Viegas (GUE/NGL), por escrito. ‒ O Regulamento (CE) n.º 562/2006 do Parlamento Europeu e do Conselho, de 15 de março de 2006, estabelece o código comunitário relativo ao regime de passagem de pessoas nas fronteiras (Código das Fronteiras Schengen), que já foi alterado várias vezes. O novo regulamento hoje votado substituirá os diversos atos nela integrados, cingindo-se a uma codificação pura e simples dos textos existentes, sem alterações substantivas.

  Harald Vilimsky (ENF), schriftlich. ‒ Eine weitere Einzementierung der aktuellen Rechtslage, welche für die derzeitige Krisensituation nicht die richtigen Antworten bietet, ist sicherlich der falsche Weg. Die Nationalstaaten müssen frei darüber entscheiden können, ob und wie sie ihre Grenzen schützen. Daher stimme ich gegen eine Kodifizierung der Schengen-Gesetze und somit gegen diesen Bericht.

  Beatrix von Storch (ECR), schriftlich. – Die Entschließung des EU-Parlamentes zu dem Vorschlag für eine Verordnung des Europäischen Parlaments und des Rates über einen Gemeinschaftskodex für das Überschreiten der Grenzen durch Personen (Schengener Grenzkodex) habe ich abgelehnt.

Es wird behauptet, dass sich der genannte Vorschlag auf eine reine Kodifizierung der bestehenden Rechtstexte ohne inhaltliche Änderungen beschränkt, so dass es zum vereinfachten Gesetzgebungsverfahren kommen kann.

Tatsächlich wird jedoch in Erwägungsgrund 19 nun geregelt, dass die „operative Zusammenarbeit und die gegenseitige Unterstützung der Mitgliedstaaten bei den Grenzkontrollen ... durch die mit der Verordnung (EG) Nr. 2007/2004 des Rates errichtete Europäische Agentur für die operative Zusammenarbeit an den Außengrenzen der Mitgliedstaaten (nachstehend „Frontex”) verwaltet und koordiniert werden“ soll. Das geht über die bestehenden Befugnisse von Frontex hinaus, das den Mitgliedstaaten Hilfe geleistet hat. Es handelt sich bei dem neuen Text um eine Souveränitätsabgabe, wenn auch eine kleine. Es handelt sich also nicht um eine bloße Kodifikation bestehender Regelungen.

Ich bin der Meinung, dass das Parlament keinesfalls auf seine ohnehin geringen Kompetenzen zugunsten der Kommission verzichten sollte. Daher habe ich bereits aus formellen Gründen abgelehnt.

  Θεόδωρος Ζαγοράκης (PPE), γραπτώς. ‒ Υπερψήφισα το ψήφισμα για τη θέσπιση του κώδικα της Ένωσης σχετικά με το καθεστώς διέλευσης προσώπων από τα σύνορα (κώδικας συνόρων του Σένγκεν), καθώς η αρμόδια συμβουλευτική ομάδα των νομικών υπηρεσιών του Ευρωπαϊκού Κοινοβουλίου, του Συμβουλίου και της Επιτροπής απεφάνθη, ότι εν λόγω πρόταση περιορίζεται απλώς και μόνο σε κωδικοποίηση των υπαρχόντων κειμένων.

Cada vez son más los refugiados que cruzan nuestras fronteras, tratando de escapar de la guerra y de encontrar un futuro mejor. Sin duda, apoyo firmemente que hay que ayudar a quien viene en busca de refugio; no hacerlo iría en contra de nuestros valores.

Lo que sí creo es que habría que llevar a cabo un control de dichas fronteras, para asegurarnos de que entre quien tenga visado y evitar a aquellas personas que no tienen razones para entrar en la UE.

Sin lugar a dudas, creo que hay que ser conscientes de que aquellos refugiados que se instalen en la UE tienen que gozar de nuestros derechos, pero también han de respetar nuestros deberes y valores; de lo contrario habría que tomar medidas.

A pesar de todo, considero que la solución al problema de los refugiados no reside tanto en la mejora de la gestión de las fronteras de la UE como en poner fin a la guerra de Siria.

  Tomáš Zdechovský (PPE), písemně. ‒ Podporuji tuto zprávu, protože považuji za důležité, aby právo Evropské unie bylo přehledné a srozumitelné. Jednotlivá ustanovení týkající se schengenského prostoru se v průběhu času značně měnila a byly vytvářeny nové dokumenty. Proto velmi vítám kodifikaci, kterou vznikne ucelený dokument celistvé povahy. V právě probíhající uprchlické krizi je nanejvýš důležité, aby členské státy jasně věděly, jaké pravomoci a nástroje jim dokumenty týkající se schengenského prostoru nabízí a které mohou využít.

  Janusz Zemke (S&D), na piśmie. ‒ Popieram projekt rozporządzenia w sprawie przepływu osób przez granice w Unii Europejskiej. Trzeba jednak podkreślić, że dokument ten nie wnosi żadnych nowych rozwiązań merytorycznych, a jedynie ujednolica – zmieniane często w ostatnich latach – przepisy dotyczące tzw. strefy Schengen.

Funkcjonowanie strefy Schengen jest jednym z filarów Unii Europejskiej. Zasady te umożliwiają swobodne przemieszczanie się w Europie obywateli UE. Kontrola graniczna dokonywana przez jedno państwo unijne jest przeprowadzana w interesie wszystkich państw członkowskich. Wynika z tego szczególny obowiązek dla państwa UE, które wydaje dokumenty podróży. Kontrola graniczna powinna być zatem zawsze przeprowadzana profesjonalnie i z zachowaniem szacunku dla kontrolowanych osób. Bez wątpienia ujednolicenie tekstu ułatwi pracę służbom granicznym państw Unii Europejskiej.

  Jana Žitňanská (ECR), písomne ‒ V hlasovaní o tejto správe som sa zdržala. Správa o návrhu nariadenia, ktorým sa ustanovuje Kódex schengenských hraníc mala byť len kodifikáciou existujúcich textov bez zmeny ich podstaty. Napriek tomuto ubezpečeniu však podľa môjho názoru správa v jednom bode smeruje k väčšiemu prenosu právomocí z členských štátov na Európsku úniu, čo vymedzenie kodifikácie bez zmeny podstaty prekračuje. Správa totiž hovorí, že keďže cieľ nariadenia nie je možné uspokojivo dosiahnuť na úrovni členských štátov a bolo by ho lepšie možné dosiahnuť na úrovni Únie, má mať Európska únia možnosť prijímať opatrenia, ktorých prijímanie pred touto kodifikáciou patrilo do právomoci členských štátov. A hoci tento konkrétny článok nemusí z dlhodobého hľadiska znamenať žiadnu podstatnú zmenu, myslím si, že by nemal byť vsúvaný do nariadenia bez náležitej pozornosti.

  Milan Zver (PPE), pisno. ‒ Schengen je eden največjih dosežkov Evropske unije. Danes je na preizkušnji in z njim je na preizkušnji tudi EU. Migrantski val moramo nujno zaustaviti ali zajeziti, za kar pa je potrebno usklajeno delovanje vseh držav članic pri nadzoru zunanjih meja. Zato sem podprl predlog Uredbe, ki prinaša sklop skupnih ukrepov in pravil glede gibanja oseb prek meja.
