  Knut Fleckenstein, Berichterstatter. Herr Präsident, liebe Kolleginnen und Kollegen! Seit Anfang der Diskussion um das Hafenpaket 1 vor 15 Jahren gab es – meiner Meinung nach immer wieder zu Recht – in diesem Haus keine Mehrheit für das port package.

Ich bin davon überzeugt, dass der heutige Entwurf besser ist und dass ihm zugestimmt werden kann, denn er unterscheidet sich deutlich von den bisherigen Hafenpaketen. Eine Zustimmung und ein Auftrag zur Verhandlung im Rat sind möglich, weil der Entwurf nicht mehr den Wunsch nach Wettbewerbsfähigkeit für marktradikale Ideologien missbraucht.

Im Mittelpunkt steht nicht mehr die Zwangsöffnung der Märkte – koste es, was es wolle –, sondern die bessere Organisation der Häfen, sogar mit einer Begrenzung von Hafendienstanbietern, wo es notwendig und sinnvoll ist.

Es geht bei dem heutigen Entwurf um die Stärkung der Wettbewerbsfähigkeit, um mehr Transparenz, um die Autonomie der Häfen, um bessere Informationen und Einbeziehung der Hafennutzer, um ernst zu nehmende, aber doch unbürokratische Aufsicht im Sinne auch einer Beschwerdestelle.

Zur Stärkung der Wettbewerbsfähigkeit gehört auch, dass es gute Arbeitsplätze in den Häfen gibt. Im 21. Jahrhundert sollte es in unseren Häfen keine Tagelöhnerarbeiten mehr geben.

Ich weiß, dass diese Fragen mit der Verordnung nicht geregelt werden können. Aber ein Hinweis für diejenigen, die es regeln könnten, ist notwendig und sinnvoll. Das bezieht sich auf Ausbildung und Training, auf Arbeitszeitmodelle, die entwickelt werden könnten, um bessere und gute Arbeitsplätze zu ermöglichen.

Die heutige Lösung war möglich, weil Kommissarin Bulc im Gegensatz zu ihren Vorgängern eine ausgesprochen kooperative und pragmatische Herangehensweise gewählt hat. Sie ist auch möglich geworden, weil wir mit vielen Stakeholdern gesprochen haben, zum Teil vor Ort.

Natürlich haben wir nicht alle überzeugen können. Die britischen Häfen meinen, weil sie private Häfen sind, seien sie nicht davon betroffen – im Gegensatz zu den privaten Häfen auf dem Kontinent. Die polnischen Terminalbetreiber sind dagegen, weil zu viel Transparenz auch für sie nicht einfach zu diskutieren ist. Die europäischen Reeder sind zu Recht nicht begeistert, denn ihr Traum davon, dass philippinische Matrosen zukünftig die Schiffe in Häfen selbst be- und entladen können, ist mit der morgigen Abstimmung endgültig ausgeträumt.

Wir werden mit dem Rat, wenn das Plenum es morgen so beschließt, zügig Verhandlungen aufnehmen. Aber einen erfolgreichen Abschluss wird es nur geben, wenn beide Seiten – also auch der Rat – sich inhaltlich bewegen und wenn Kommissarin Vestager mit einem vernünftigen Entwurf zu den block exemptions im Rahmen der Diskussion um staatliche Beihilfen für Häfen mitmacht. Auch die werden wir intensiv prüfen.

Ich möchte mich bei allen Schattenberichterstattern für ihre konstruktive Begleitung herzlich bedanken, bei der Kommissarin für den von ihr gewählten pragmatischen Weg und bei den Stakeholdern von allen Seiten – ein Dankeschön, weil der Wille, zu einem guten Ergebnis zu kommen, erkennbar war.

Ich weiß, es ist nicht gelungen, alle zufriedenzustellen. Aber ich lege diesen Bericht heute in der festen Überzeugung vor, dass es sich um einen guten Kompromiss handelt, um dessen Annahme ich dann morgen bitte.

  Violeta Bulc, Member of the Commission. Mr President, the Commission welcomes the report that we will discuss today. I sincerely thank the rapporteur, Mr Fleckenstein, for the important and future-oriented work he has accomplished. Thank you also to the shadow rapporteurs and the Committee on Transport and Tourism for the good quality of the report.

The port services regulation is an important piece of the European transport policy to foster investment and push further modernisation of ports. You know about the crucial role of ports for the transport system and our economy. They are Europe’s gateways to the world. They provide employment in ports directly and in related sectors. They are hubs for short-sea shipping which we must strengthen as part of our decarbonisation strategy. In short, ports are valuable assets which we must preserve and strengthen.

That is what the regulation aims at and that is why it is one of the Commission’s priority files for 2016. The regulation will ensure transparency in the use of public funds in ports. We need to ensure a level playing field between European ports, many of which receive considerable financial support from both national and EU budgets. Financial transparency is crucial for this. Financial transparency will also allow us to simplify the application of state aid rules. The Commission is working on the general block exemption regulation; it should exempt certain port investments from state aid rules and focus the Commission’s work on critical cases in order to establish a genuine level playing field.

A first draft, proposed, was published today for consultation. And today the public consultation has started.

The port services regulation will provide an important input into this work, provided it gets your support. The port services regulation will also bring more clarity for the organisation and tendering of port services. It will end today’s unclear situation where ports policy is not decided by the legislator but defined on a case-by-case basis by the European Court of Justice, only according to the Treaty principles. The adoption of the regulation will therefore mean more legal clarity and legal stability for both port workers and investors.

The regulation is also important for our decarbonisation strategy, which after COP21 we are even more committed to. Making ports more attractive is essential to developing alternatives to congested motorways and avoiding unnecessary land and sea traffic. We need to diversify maritime routes and promote short-sea shipping.

The report got broad support in the Committee on Transport and Tourism. All major organisations representing the European port sector stand behind it: the trade unions, port authorities, port terminal operators and port service providers. Let me stress that the Commission fully supports the social dialogue as well as better training and safety for workers. Let me also stress that the regulation does not impose a one-size-fits-all approach. We know that every port in Europe is different. The draft regulation respects this. It is compatible with all forms of organisations, including private ports. It does not impose one model.

Your vote tomorrow, to start the trilogues, is essential for advancing with this important piece of legislation. The Council already adopted a general approach in 2014. This was one of the major successes of the Italian Presidency. It is time for Parliament to enter into negotiations with the Council and conclude this file. The Dutch Presidency is very interested in negotiating and concluding the file still before summer. I am inviting you all not to lose this opportunity.

τα λιμάνια αποτελούν αδιαμφισβήτητα έναν από τους σημαντικότερους μοχλούς οικονομικής ανάπτυξης αλλά και πηγή ευημερίας για τα κράτη μέλη και την Ευρώπη. Δεν είναι τυχαίο ότι το 75% του εμπορίου της Ευρωπαϊκής Ένωσης αλλά και το 38% του ενδοκοινοτικού εμπορίου διεξάγεται διά θαλάσσης, γεγονός που υποδηλώνει τη σπουδαιότητα του τομέα.

Για τον λόγο αυτόν, ο κανονισμός που θα ψηφίσουμε στην Ολομέλεια αποσκοπεί στην ενίσχυση της απόδοσης των ευρωπαϊκών λιμένων και τη βελτίωση της συνολικής ποιότητας των λιμενικών υπηρεσιών με στόχο τον εκσυχρονισμό τους. Επίσης δημιουργεί συνθήκες δικαιότερου ανταγωνισμού, μειώνει τις νομικές ασάφειες, ενδυναμώνει τη διαφάνεια και την καλύτερη κατανομή των δημοσίων πόρων. Μόνο η δημιουργία σταθερού νομικού περιβάλλοντος που διέπεται από δίκαιους όρους ανταγωνισμού και συγκεκριμένους κανόνες διαφάνειας μπορεί να προσελκύσει επενδύσεις στα λιμάνια συμβάλλοντας στην ανάπτυξη της οικονομίας της Ευρωπαϊκής Ένωσης, ιδιαίτερα σε περιόδους οικονομικής κρίσης.

Παράλληλα, η νέα νομοθεσία δίνει στα λιμάνια μεγαλύτερη αυτονομία σχετικά με τον καθορισμό των λιμενικών τελών. Το γεγονός αυτό ενισχύει τον ανταγωνισμό τόσο μεταξύ των ευρωπαϊκών λιμένων όσο και μεταξύ των λιμένων της Ευρωπαϊκής Ένωσης με τρίτες χώρες. Επιπλέον, προβλέπει μια σειρά ευνοϊκών διατάξεων για τα μικρά λιμάνια, ώστε να αποφευχθεί η δυσανάλογη διοικητική επιβάρυνση και τα πρόσθετα τέλη και τα κόστη. Η Ευρώπη έχει ανάγκη από τέτοιες νομοθετικές πρωτοβουλίες που αναδεικνύουν τα κοινά συμφέροντα μεταξύ των κρατών μελών και τονώνουν την ενιαία εσωτερική αγορά.

  Maria Grapini (S&D), întrebare adresată în conformitate cu procedura „cartonașului albastru”. Domnule președinte, stimată colegă, și eu apreciez că este un raport extrem de important, așa cum, de altfel, și doamna comisar ne-a spus. Aș adresa concret o întrebare. Nu a rezultat punctul de vedere din intervenția dumneavoastră. Diferența între ce a propus Comisia și ce propun raportorii legată de stabilirea taxelor în porturi. Credeți că este bine cum e prevăzut acum în raport: eliminarea propunerii Comisiei de a înființa un comitet cu reprezentanții operatorilor pentru a stabili nivelul taxelor sau ar fi mai bine să stabilească singure porturile taxele pentru operatori?

  Ελισσάβετ Βόζεμπεργκ-Βρυωνίδη ( PPE), απάντηση σε ερώτηση με γαλάζια κάρτα Ευχαριστώ πολύ για την ερώτηση. Θα σας πω ότι το κείμενό μας είναι απόλυτα ισορροπημένο ακριβώς και στον τομέα τον οποίο θίξατε, διότι προβλέπει και μια δίκαιη κατανομή των τελών και του κόστους και για τα μικρότερα λιμάνια, που μέχρι στιγμής είχαν μία επιβάρυνση.

Στην ερώτησή σας απαντώ ότι το κείμενο διαβλέπει και αυτή την παράμετρο ολοκληρωμένα, και μάλιστα με ισορροπημένες τροπολογίες, που έγιναν κατόπιν πολλών συζητήσεων μεταξύ των πολιτικών ομάδων.

  Lucy Anderson, on behalf of the S&D Group. Mr President, there over 300 ports in our European network, even leaving aside the very small ones, and more than three million jobs depend on the port sector directly or indirectly. Especially given the diversity in size, operations and governance of EU ports, we should only regulate this sector with the utmost care.

Now, I should say that I am not saying this on behalf of the S&D, but I and other Labour MEPs are not opposed to the idea of progressive balanced EU measures on ports. These could help improve standards in the sector, in the UK and across the whole of Europe, on port safety and security, terms and conditions of workers, environmental protection, as well as provide a secure framework for investment.

The problem is that, despite the commendable efforts of our rapporteur, this proposal, even if amended as he suggests, simply does not quite achieve the goals that I have mentioned. There are good provisions on training. There are good provisions encouraging good practice on minimum requirements on tendering, but it is not enough overall.

The draft regulation is in fact an example of the spectacular double standards of the so-called better regulation agenda; for instance, the provisions to regulate port charges will undoubtedly still be an administrative burden for ports and do not give legal clarity if you read them carefully – you are still asking yourself questions about what they mean. They are also unsupported by concrete evidence from the Commission of major problems in charging practices in many ports and the report by PwC – the management consultancy report that looked into this – did not uncover major problems.

There has also been no updated impact assessment since at least 2012 despite the new institutional agreement on better regulation saying that these things should be updated. Equally the right for trade unions to take legitimate industrial action is not sufficiently protected in Article 8 and Article 10 fails to provide for the compulsory transfer of staff. We were looking for something that improved workers’ rights, including in relation to how agency workers are dealt with, but it is just not there.

Ports will not specifically also be required to consult environmental experts and local communities.

So in overall terms, please reject the Commission’s proposal.

  Bogusław Liberadzki (S&D), blue-card question. Ms Anderson, you mentioned something about your doubts concerning social issues. To what extent are you not satisfied with the social package in this Commission bill? Second, what is your opinion of European added value concerning this particular bill?

  Lucy Anderson (S&D), blue-card answer. Well, in terms of the social elements, much more could have been done within the articles to reinforce the importance of that issue – for example to mention the social dialogue. Although the social dialogue stakeholders think that this could have been worse and they say that overall it could be negotiated on, they are still not entirely happy. If you look at their previous positions about what they wanted, this is not what they wanted and they could quite happily live without it. I think there are very real concerns on that.

In terms of the European added value, at least we are talking about the issues and that raises awareness, but I think that is as far as it goes.

  Peter van Dalen, namens de ECR-Fractie. In de eerste plaats mijn welgemeende complimenten aan rapporteur Fleckenstein. Hij heeft zijn nek uitgestoken en is realistisch aan de slag gegaan. Bijgevolg hebben de PPE-, de ALDE- en de ECR-Fractie met de rapporteur nu een uitstekend resultaat neergezet.

Ik denk aan de volgende punten: in de eerste plaats minder bureaucratie en minder sociale lasten voor de havens. Aanvankelijk stond het voorstel vol met bepalingen op sociaal gebied, zoals de verplichting dat havenbedrijven training en opleiding aan havenwerkers zouden moeten geven. Maar veel havenbedrijven gaan daar helemaal niet over. Dat is er nu ook terecht uit.

Ten tweede bepalen havens nu zelf hoe ze georganiseerd willen zijn. Verplichte markttoegang is niet langer aan de orde. Europa sluit nu aan bij de situatie in de regio's in de lidstaten, niet andersom. Havenbedrijven bepalen zelf hoe ze georganiseerd willen zijn, en terecht. De situatie in Rotterdam is heel anders dan bijvoorbeeld in het Spaanse Vigo. De subsidiariteit en soevereiniteit zijn echt tot hun recht gekomen.

Ten derde is er een uitzondering voor de private havens. We hebben extra gelet op de situatie van de Engelse private havens en die kunnen nu zelf diensten regelen zoals het binnenslepen of het afmeren van schepen. Ze hoeven ook geen ingewikkelde aanbestedingsprocedures te doorlopen, dus ook dat is hartstikke mooi.

Sommigen roepen hier op om het voorstel te verwerpen. Dat zou erg dom zijn. Dom, omdat dan het directoraat-generaal Mededinging om de hoek komt kijken en de commissaris Vestager onverkort de bepalingen die gelden voor mededinging ook op de havens van toepassing laat zijn. Nou, dan zijn we pas echt ver van huis als die trukendoos wordt opengetrokken. Het zou dus erg onverstandig zijn om dit te verwerpen en ik roep iedereen op, ook in mijn eigen fractie, om dit voorstel te steunen.

  Gesine Meissner, im Namen der ALDE-Fraktion. Herr Präsident, Frau Kommissarin! Vielen Dank vor allen Dingen an Knut Fleckenstein als Berichterstatter! Die Häfen in Europa sind verschieden. Das haben wir schon gemerkt, und das macht es auch so furchtbar schwierig, ein passendes Hafenpaket hinzubekommen. Das ist jetzt der dritte Anlauf, und ich hoffe, dass es dieses Mal wirklich klappt.

Es ist vielleicht ganz schön, dass ich jetzt gerade nach S&D und ECR sprechen kann, denn da haben wir schon gemerkt, wie unterschiedlich die Positionen, über die wir gestritten haben, auch bei uns natürlich sind. Von der S&D hieß es, es ist zu wenig auf soziale Dinge, zu wenig auf Arbeitnehmerrechte geachtet worden. Bei der ECR hieß es, da ist eigentlich schon zu viel davon drin. Und deswegen muss ich sagen: Das zeigt schon, dass der Berichterstatter einen wirklich sehr guten Kompromiss hinbekommen hat. Es ist natürlich so, dass bei einem Kompromiss nie jemand hundertprozentig zufrieden ist. Auch bei uns, bei den Liberalen, sind einige nicht ganz begeistert, weil es Ausnahmen gibt, die rauskommen aus dieser Verordnung. Dass nicht alle Dienste erfasst werden, dass Umschlagdienste und Lotsen rausgenommen werden, Schlepper und Festmacher besondere Klauseln haben – das sind alles Dinge, die wir nicht so gerne gehabt hätten. Aber es ist jetzt so, dass wir denken, es ist wirklich ein Kompromiss, etwas, was ein gangbarer Weg ist, um weiterzukommen.

Für meine Begriffe ist etwas ganz wichtig: Im Vorfeld sind natürlich Pressemitteilungen herausgegeben worden, und sowohl die Hafenbetreiber als auch die Hafengewerkschafter sind für diesen Kompromiss und bitten uns alle, dem hier im Plenum zuzustimmen, damit wir weiter verhandeln können und damit für die Häfen, die wirklich enorm wichtig sind für Europa und für die zukünftigen Warenverkehrsströme – wir wollen ja am Puls der Zeit bleiben, wirklich halbwegs einheitliche Bestimmungen haben, Transparenz über die Finanzströme haben, in einigen Bereichen ein bisschen mehr Wettbewerb, aber sehr gute Bedingungen auch für die Arbeitnehmer, und dann auch Anreize für Investoren, um wirklich in den Häfen zu investieren. Alles dies ist durchaus gewährleistet.

Ich weiß, dass es schwierig war, weil der Kommissionsvorschlag und das, was der Berichterstatter zunächst hatte, doch überhaupt nicht so richtig zusammenpassten. Jetzt haben wir wirklich eine Mittelposition, und ich kann nur alle, die jetzt im Moment noch überlegen, dagegen zu stimmen, ermutigen: Eine ganze Menge ist drin, alles kann keiner haben. Und ich denke, das, was wir jetzt haben, das sollten wir mit dem Rat verhandeln, im Interesse der Häfen und im Interesse Europas.

  Στέλιος Κούλογλου, εξ ονόματος της ομάδας GUE/NGL. Κύριε Πρόεδρε, είναι καλό ότι κατορθώσαμε να θέσουμε ένα συγκεκριμένο πλαίσιο λειτουργίας. Το πεδίο εφαρμογής του κανονισμού περιορίστηκε στην οργάνωση των λιμένων και τη διαφάνεια των οικονομικών συναλλαγών. Δεν υπάρχουν ρυθμίσεις σχετικές με την απορρύθμιση των εργασιακών σχέσεων και το ανεξέλεγκτο άνοιγμα στις αγορές. Πολλοί εμπλεκόμενοι φορείς και τα περισσότερα συνδικάτα υποστήριξαν τη δουλειά μας. Κατορθώσαμε να απέχει το αποτέλεσμα από τους αρχικούς στόχους της Επιτροπής.

Σε αυτή τη βάση η προς διαπραγμάτευση με το Συμβούλιο πρόταση παρέχει μια καλή προστασία για τους εργαζομένους στα ζητήματα ασφάλειας και υγείας, ενισχύει το δικαίωμα στην εκπαίδευση και κατάρτιση και θα λειτουργήσει σαν ανάχωμα μπροστά σε παραπέρα επιθέσεις ενάντια στις συνθήκες εργασίας. Προβλέπει την περιβαλλοντική βιωσιμότητα των λιμενικών υπηρεσιών, και όλα αυτά σε συνθήκες διαφάνειας. Θέλω να ευχαριστήσω τον εισηγητή για τη δουλειά του.

Σας προτρέπω να ψηφίσετε υπέρ των συμβιβαστικών τροπολογιών, που υιοθετήθηκαν σε μπλοκ, και να δώσουμε στον κ. Fleckenstein την εντολή για την έναρξη των διαπραγματεύσεων με το Συμβούλιο και την Επιτροπή. Τώρα τα κράτη μέλη και οι κυβερνήσεις πρέπει να αποδείξουν την ετοιμότητά τους για ισχυρές δεσμεύσεις ενάντια στο κοινωνικό ντάμπινγκ και υπέρ της προάσπισης των ασφαλών εργασιακών συνθηκών στα λιμάνια.

  Lucy Anderson (S&D), blue-card question. I see what you are saying about how full market liberalisation is no longer in this measure but, nevertheless, it does have detailed and prescriptive rules for ports to follow on contracts with service providers and public service obligations. Your Group in particular is often very keen to protect public services. Do you not think that to present it simply as a harmless transparency measure is maybe slightly misleading?

  Στέλιος Κούλογλου ( GUE/NGL), απάντηση σε ερώτηση με γαλάζια κάρτα Δεν πιστεύω ότι υπάρχει προσπάθεια παραπλάνησης του Κοινοβουλίου. Πιστεύω ότι υπάρχουν καλoί και κακοί συμβιβασμοί, και εδώ έχουμε να κάνουμε με έναν καλό, αξιοπρεπή συμβιβασμό, που προασπίζει τα βασικά δικαιώματα.

  Keith Taylor, on behalf of the Verts/ALE Group. Mr President, following two fairly spectacular failed attempts at liberalising port service provisions, the Commission has greatly scaled down its ambitions on services in an attempt to finally create a sector-specific legislation in this area. However, yet again, the port services regulation has failed to tackle the real issues in Europe’s ports.

It is clear that maritime transport, to which ports are vital, plays a crucial role in achieving greater sustainability in the transport sector. The Greens’ political objective is to embed seaports into the wider framework of a sustainable transport policy that addresses safety, social and environmental standards, incorporates cross-border cooperation and coordination between seaports and aims to account for external costs.

There is also no doubt that public finance needs transparency. We cannot talk about port services without looking at the public money flowing into the ports for their infrastructure and operations. The port services regulation could have facilitated some of those aims. Unfortunately it seems clearly to fail to meet its own objectives of ensuring a more sustainable and interconnected transport network.

On financial transparency, the one valid point it does contain, it still does not do enough to ensure much needed legal certainty for the sector due to the strong link between financial transparency and the Commission’s envisaged state-aid guidelines and/or block exemptions for the ports. Both proposals should have been developed in parallel. Having first announced this initiative some 11 years ago, the Commission’s news that it will not now adopt state-aid guidelines before 2017 is frustrating but somehow unsurprising.

If Parliament accepts this report it needs to be prepared for some serious criticism, having backed a piece of binding legislation that does very little to tackle anything at all. This legislation is undeveloped and ineffective, and I therefore call upon Members to reject this report when they have the opportunity to vote tomorrow.

Do you agree with me that this package, although improved, presents some of the same dangers as the proposals rejected by Parliament by a big majority in 2006? It imposes additional administrative burdens on our ports, whilst not ensuring adequate protection for fundamental rights or safety at work.

  Keith Taylor (Verts/ALE), blue-card answer. I think you are entirely correct in making that assumption, and do not forget that Parliament has rejected these proposals, or something very similar, twice before. There is no recognition of environmental requirements – all the references to environmental assessment, bird life, habitat, Natura 2000, etc., were deleted. This is just a failed attempt to push on to Parliament another unwelcome version of basically the same thing, and we should say the same: ‘No’.

  Jill Seymour, on behalf of the EFDD Group. Mr President, the port services regulation is not required or wanted in the United Kingdom. Unlike most of continental Europe, the UK has very competitive ports, with the lion’s share in the private sector. The EU has tried to regulate ports without success on two previous occasions and this is the third attempt. As the majority of ports in the UK are privately owned, successful and efficient, it is not for the EU to regulate British ports.

With the Brexit referendum on 23 June, the people of the United Kingdom will vote to leave and we will free ourselves from the excessive rules, regulations and red tape imposed by this place. We will then rejoin the rest of the world and take back our freedom to run and operate our own businesses. Britain has a long and proud history trading with the world and our ports are the doors to our prosperity. This port service regulation will do more harm than good, and the UK will be better off out.

  Marie-Christine Arnautu, au nom du groupe ENF. Monsieur le Président, la libéralisation des services portuaires est un vieux serpent de mer européen. Bien que la Commission européenne ait déjà essuyé deux échecs au début des années 2000, elle revient à la charge: jamais deux sans trois.

La proposition de la commission est inacceptable. D'une part, elle tente d'uniformiser les grands ports européens, qui ont des organisations différentes, empêchant, de fait, les États membres et les gestionnaires portuaires d'encadrer ces services en fonction de l'expérience. D'autre part, sous prétexte de compétitivité et dans l'optique d'attirer davantage d'investissements, elle met l'accent sur la nécessité de libéraliser certains services. Cela aurait pour conséquence néfaste d'empêcher les États d'exiger que certains services se fassent sous pavillon national pour des raisons de sécurité. Remplacer des marins, pilotes ou remorqueurs qualifiés par des personnes sous-qualifiées, sous-payées car employées sur un bateau battant pavillon de complaisance, n'est pas envisageable.

Les amendements de la commission des transports sont positifs, mais, au bout du compte, ce règlement sera une coquille vide. Alors pourquoi vouloir continuer à tout prix à harmoniser et à privatiser? Voulons-nous que nos ports, éléments stratégiques de notre économie, soient rachetés petit à petit par des investisseurs étrangers, comme ce fut récemment le cas du Pirée, repris par le groupe chinois Cosco?

Pour ces motifs, nous voterons contre la proposition de la Commission et contre la proposition du Parlement européen.

  Marian-Jean Marinescu (PPE). Domnule președinte, doamnă comisar, subiectul a fost și este încă intens dezbătut. Există opinii diverse și divergente cu privire la unele prevederi. S—a ajuns, totuși, la un compromis încurajator: regulamentul va permite crearea de locuri de muncă, dezvoltarea și creșterea competitivității importantului sector economic format de porturi; permite autonomie pentru stabilirea tarifelor, creând condiții mai bune pentru competiție și pentru servicii de calitate mai bună la prețuri accesibile; introduce transparența financiară, asigurând condiții egale pentru toți actorii și mijloace de combatere a ajutorului de stat ilegal.

Regulamentul se va aplica tuturor porturilor incluse în TNT. Statele membre au, totuși, flexibilitatea de a nu include porturile din rețeaua globală din regiuni periferice. Porturile mici au flexibilitate în a evita birocrația și costurile disproporționate pentru a întări eficiența și calitatea serviciilor.

Situația economică și competiția din sector cer imperios o decizie care este discutată de mai mult de zece ani. Negocierea cu Consiliul este necesară și poate conduce la eliminarea controverselor actuale.

  Ismail Ertug (S&D). Herr Präsident, sehr geehrte Kolleginnen und Kollegen, verehrte Frau Kommissarin! Zunächst einmal geht mein Dank an den Berichterstatter, Herrn Fleckenstein, für die schwierige Arbeit, die er hinter sich gelassen hat.

Man sollte nicht vergessen, dass wir es mit einem Vorschlag der Europäischen Kommission aus der sogenannten Kallas-Ära zu tun hatten, die Turboliberalisierung in allen Bereichen zum Ziel hatte. Insofern war es umso schwieriger, für den Berichterstatter, einen Kompromiss zu finden. Wie der Name eben schon sagt, ist ein Kompromiss nicht zu 100 % das, was jeder sich wünscht. Aber dennoch muss man bereit sein, Kompromisse zu schließen.

Wenn wir uns jetzt dieses Papier anschauen, das auf dem Tisch liegt, dann sehen wir, dass die Zwangsliberalisierung, die in der ursprünglichen Fassung der Europäischen Kommission hätte kommen sollen, verhindert worden ist. Wenn wir in uns gehen, dann sehen wir, dass die Häfen nun selbst entscheiden können, wie sie ihre Hafendienste anbieten wollen.

Was für mich persönlich mit das Hauptargument war, letztendlich auch zuzustimmen, sind die sogenannten Mindestanforderungen, die der Berichterstatter herausverhandelt hat, Mindestanforderungen zum Beispiel bei der Aberkennung der sogenannten good reputes bei Nichteinhaltung von Sozial- und Arbeitsstandards. Dass auch Streikrecht verbindlich hineinverhandelt worden ist, ist ein Gewinn. Denn ich erinnere mich an viele andere Dossiers, wo uns das nicht gelungen ist.

Wenn wir uns die Verdienste oder zumindest das, was im Bereich Transparenz herausgekommen ist, ansehen, dann kann man all diese Punkte zusammenfassen und am Schluss zum Ergebnis kommen, dass, wenn ich das so sagen darf, das Glas halb voll ist und nicht halb leer und insofern eine Zustimmung durchaus in Ordnung ist.

  Jacqueline Foster (ECR). Mr President, first of all I would genuinely like to thank Mr Fleckenstein for his hard work, enduring work, on this dossier, but regrettably I do not believe that the changes have gone far enough.

It was actually a Conservative government in 1981 that began the process of privatising the ports in the United Kingdom, and therefore I will not support anything that would jeopardise the success that this has brought to the UK economy and on growth and jobs. I would also just like to assure an earlier speaker that we are not inundated with thousands of Philippino workers who are loading and unloading our ships.

Both Conservatives and our Polish colleagues and others will support a rejection of this Commission proposal. We believe that competition between ports rather than prescriptive regulation on ports’ internal operations is a greater driver for efficiency. The Commission’s proposal was overly-bureaucratic and does not fit well in our UK system of privatised and market-driven ports. Whilst we welcome some improvements in the Committee position, I am fully aware that both our UK port owners and trade unions remain firmly opposed to the proposal as it stands.

The present text could still interpret the open port duty in the UK as imposing public service obligations on private ports whilst we believe that the proposal on private and trust ports does not go far enough to guarantee their exemption from the regulation. Moreover, it is feared that the social provisions introduced by the rapporteur and others would gold—plate existing EU legislation dealing with the transfer of staff due to a change in the service provider as well as current ILO training and labour protection guidelines.

In addition, we are disappointed that the rapporteur’s compromise package did not include smaller ports from the provisions on market opening. It is for these reasons that I have re—submitted amendments which would exempt small ports from the regulation as well as amendments reflecting competitive market exemption in order to allow a fully competitive industry to be free to procure goods and services commercially, and lastly, an amendment which would exclude all private ports from the regulation. I hope they will have majority support, although my preference will be to reject the report.

  Pavel Telička (ALDE). Mr President, some colleagues have said that they are not entirely happy, and I need to say that nor am I – I think that many of us would not be. But the question is, what are the options? What we clearly know is that we need better access to ports, and we need better management, and for me that means we need better organisation. The question is also whether we, for another period of time, should ask public and private stakeholders to stay in legal uncertainty. So while I am not entirely happy with the proposal, and there are definitely issues that have to be addressed, I believe it is high time to submit the proposal for negotiations and do the fine-tuning during the negotiations. Sometimes, less is more. That is why, with this strong message, I will skip my time and give you five seconds extra.

  Gesine Meissner (ALDE), Frage nach dem Verfahren der „blauen Karte“. Jetzt habe ich den Kollegen in Schwierigkeiten gebracht, weil er schon beinahe weg war. Ja, lieber Kollege Telička, jetzt sind es zwar gerade fünf Sekunden weniger gewesen, aber ich habe trotzdem eine Frage: Es ist ja verschiedentlich gesagt worden, dass zu wenig Transparenz hier dabei ist, dass zu wenig Flexibilität möglich ist für die Mitgliedstaaten, dass auch zu wenig darauf geachtet wurde, dass die Häfen sehr unterschiedlich sind, dass zu wenig getan wurde, um private Häfen eben auch private Entscheidungen treffen zu lassen. Wie stehen Sie denn dazu? Ist es wirklich zu wenig flexibel und zu wenig transparent und all dies?

I think that this is the degree to which I can subscribe to it. The question is what is in it that is not sufficient? I am sure that some of the elements are yet to be addressed, but I am sure that with good, solid effort we can make it happen. I would have a number of other issues, but for me the progress so far in comparison to the previous efforts is definitely sizeable and I am ready to support it and raise a hand in favour of negotiating and fine—tuning the proposal as it stands today.

  Merja Kyllönen (GUE/NGL). Arvoisa puhemies, satamapalveluasetuksen ympärillä on käyty hyvin kansallisesti värittynyttä keskustelua. Niinpä rohkenen kuvata tilannetta kotimaani Suomen näkökulmasta. Meidän satamakenttämme on kokenut viime vuosina laajan muutoksen siirryttyään vuoden 2015 alussa toimimaan osakeyhtiömuodossa markkinaehtoisesti toimivina yksityisoikeudellisina organisaatioina.

Käsittelyssä olevassa asetuksessa asetettavat tavoitteet ovat siten jo arkipäivää meidän suomalaisten satamanpitäjien toiminnassa. Pidän erityisen tärkeänä, että kaikilla Euroopassa olisi yhtäläinen säätelykehys satamapalveluiden järjestämisessä ja julkisten varojen läpinäkyvyydessä satamainvestointeja tehtäessä.

Asetuksen osalta lopputulema ei ole ehkä täydellinen tai aukoton, mutta minulle se on good enough. Kiitän esittelijää sekä eri ryhmien varjoja sinnikkäästä työstä ja toivon, että parlamentti säilyttää kylmähermoisuutensa loppuun saakka ja äänestää asian huomenna eteenpäin.

  Karima Delli (Verts/ALE). Madame la Commissaire, chers collègues, c'est la troisième fois que la Commission européenne tente d'imposer la libéralisation des services portuaires en Europe. On a beau en avoir changé le nom "organisation des services portuaires", ne nous mentons pas, il s'agit, là encore, de mettre en concurrence des services comme le lamanage, le remorquage et le pilotage dans tout un ensemble de ports, alors même que nombre d'entre eux sont très différents les uns des autres. Ce qui marche à Rotterdam, à Hambourg ou à Anvers, qui regroupent à eux seuls 20 % du transport de marchandises en Europe, ne marche pas forcément dans un port comme celui du Havre. Hélas, votre étude d'impact ne tient absolument pas compte des spécificités des ports. Pire, elle impose une vision uniforme au mépris de la réalité, au mépris du vécu des gens, au mépris des exigences environnementales, au mépris des exigences sociales.

Notre objectif devrait être de préserver les littoraux et la sécurité dans les ports, d'une part, mais aussi de protéger les salariés, d'autre part. Tout cela est aujourd'hui mis en danger par votre projet. La principale demande des ports européens n'est pas la libéralisation. Ce qu'ils demandent, c'est une clarification des règles européennes, par exemple en matière d'aides d'État. Or, la Commission refuse depuis des années de publier les lignes directrices spécifiques aux aides d'État pour les ports. Même si certaines dérogations à la libéralisation ont été obtenues dans les négociations, ce texte ne présente pas suffisamment de garde-fous, d'avancées réelles, pour pouvoir être soutenu. Dans ces conditions, nous ne pouvons que voter contre ce projet.

  Rosa D'Amato (EFDD). Signor Presidente, onorevoli colleghi, la relazione sembra aver compreso le differenze fra i vari porti europei. La novità più significativa della relazione è la soppressione delle disposizioni relative all'accesso al mercato dei servizi portuali a favore di modelli organizzativi più flessibili e di una maggiore discrezionalità per gli Stati membri. Non può esserci un'unica soluzione legislativa per tutti i porti europei, data la loro diversità.

Ma importante è assicurare l'autonomia, stabilire regole trasparenti e la possibilità di rendere i porti più competitivi. Anche se la relazione ha subito diverse modifiche, si tratta comunque di un cambiamento importante, che arricchisce la politica portuale dell'Unione europea, di una dimensione sociale significativa.

Sono lieta che la relazione riconosca il ruolo delle parti sociali settoriali nel trattare temi quali l'automazione e l'innovazione tecnologica. Il dialogo sociale deve svolgere un ruolo cruciale nella lotta contro il lavoro precario, il quale, ahimè, è diffuso soprattutto nei paesi del Sud Europa.

Faremo di tutto affinché i principi quali diritti sociali, la trasparenza sui fondi pubblici, gli aiuti di Stato, l'esclusione dei piccoli porti e gli eccessivi oneri amministrativi, siano mantenuti dal testo che sarà sottoposto alla firma.

  Luis de Grandes Pascual (PPE). Señora Presidenta, los puertos son un componente fundamental para la creación de una red transeuropea integrada y eficiente, al servicio de los ciudadanos y de la industria de la Unión Europea.

La Comisión Europea es consciente de ello, y por ello ha realizado dos intentos —este será el tercero— para mejorar su funcionamiento. Pero lo que inicialmente perseguía (más competencia, transparencia, igualdad de trato, libertad de establecimiento, protección social y eficiencia) se ha transformado en un traje a medida, trufado de excepciones, opaco, diseñado para determinados puertos y desconectado de la realidad de la cadena logística. Además, el informe se inmiscuye en competencias de los Estados miembros que forman parte de su esencial constitución económica.

En el caso de España, los puertos forman parte del dominio público. Por ello, las tasas por su uso no pueden ser fijadas mediante una negociación entre operadores privados, negociación a la que el ponente añadido la opacidad. Lo siento. La delegación española del Partido Popular votará mañana en contra de este informe por conducir al aislamiento de los puertos de la red de transporte, no responder al interés general y no respetar las disposiciones constitucionales de los Estados miembros. Lo lamentamos.

Hay quien dice que este tercer intento va a ser el único viable; pero, señora Comisaria, no será por su ambición, sino por todo lo contrario.

La modernización de los puertos en Europa va a seguir siendo una asignatura pendiente y con ello no será posible la comodalidad, es decir, la simbiosis entre los diferentes modos de transporte.

  Christine Revault D'Allonnes Bonnefoy (S&D). Madame la Présidente, Madame la Commissaire, le texte sur les services portuaires a longtemps été une créature mythique dont nous entendions beaucoup parler mais qu'en définitive, nous ne voyions jamais. Pourtant, après des mois de travail, Knut Fleckenstein, notre rapporteur socialiste, est parvenu à élaborer un texte pour lequel nous serons appelés à voter demain.

Ce texte est le fruit de longues et laborieuses négociations pour aboutir à des compromis qui ont radicalement transformé la proposition initiale ultralibérale de la Commission. Avec d'autres collègues, j'ai moi-même fait un important travail d'amendement et je suis heureuse que Knut Fleckenstein en ait repris une grande partie.

Il est ainsi fait mention de l'obligation de pavillon national pour les services les plus sensibles, ce qui stabilisera la situation juridique des ports qui s'y conforment déjà. Les obligations de service public sont également inscrites noir sur blanc dans le rapport, ce qui va dans le sens d'une Europe plus sociale. La transparence financière est un point essentiel du texte, ce qui permettra une concurrence plus juste et plus saine entre les ports européens, mais les ports les plus petits ou les plus vulnérables n'auront pas autant d'obligations administratives que les grands, pour leur éviter d'étouffer sous le poids de la bureaucratie.

Dans sa version adoptée au sein de la commission des transports et du tourisme, le texte offre les garanties sociales nécessaires pour nous, socialistes, tout en garantissant aux États membres la marge de manœuvre nécessaire pour leur permettre de conserver leurs modèles nationaux. En effet, il y a une très grande variété d'organisation des ports en Europe, et il ne faudra pas imposer de force un standard unique qui, de plus, risquerait de moins bien fonctionner que les modèles existants.

Le texte actuel est satisfaisant, et il ne faudrait surtout pas qu'il soit abîmé en trilogue. C'est la position des représentants élus par les citoyens qui devra l'emporter. C'est pourquoi le Parlement doit arriver aux négociations avec la position la plus forte possible, et cela passera par le vote le plus unanime possible.

En effet, demain, il s'agit bien de voter pour le texte qui servira de base au trilogue: il ne s'agit pas d'avoir un texte à tout prix, mais d'avoir un bon texte. La question se reposera lorsqu'un accord aura été trouvé avec le Conseil et la Commission: si le résultat devait être décevant, le Parlement pourra alors exercer son pouvoir de codécision en le rejetant, car il vaut mieux, dans le cas présent, ne pas avoir d'harmonisation plutôt qu'une mauvaise harmonisation.

  Izaskun Bilbao Barandica (ALDE). Señora Presidenta, la eficiencia de los puertos europeos es una de las claves de la competitividad de la Unión. Por eso apoyamos este informe que añade eficiencia, transparencia financiera y autonomía a la gestión de estas infraestructuras, fomenta la eficacia y competitividad en igualdad para todos, quiere aligerar la burocracia aduanera sin perder el control, protege mejor los derechos de los usuarios y trabajadores portuarios y garantiza que algunos servicios esenciales, como el del pilotaje, cumplan sin interferencias privadas sus funciones de interés público.

Esperamos que la autonomía portuaria, expresada en diferentes modelos de gestión, la profesionalidad y la libre competencia favorezcan la innovación y la creación de nuevos y mejores servicios. Por ello, nos oponemos a admitir excepciones que permitan a algunos Estados centralizar la política de precios mediante tasas, una práctica que impide que los puertos, sin perder su condición de públicos, fijen con plena autonomía sus tarifas. Las asociaciones profesionales europeas lo consideran, además, evidentemente lesivo para la competitividad de quienes padecen esa restricción y una amenaza para la autonomía y transparencia de todos los puertos de la Unión.

  Tania González Peñas (GUE/NGL). Señora Presidenta, me gustaría señalar un elemento que para nuestro Grupo es fundamental y es que se ha conseguido desplazar el centro de gravedad de este informe desde la obsesión por la liberalización hacia los aspectos laborales y sociales.

La liberalización —mejor llamada privatización— de los puertos, trenes y servicios públicos en general no libera, al contrario, condena al modelo social, porque los beneficios solo se obtienen deteriorando las condiciones laborales y la calidad del servicio. Cuando se anteponen los intereses de las grandes empresas a los de las personas, el resultado es que se acaba combatiendo el dumping social de los competidores con más dumping social dentro de Europa. Ese no es nuestro modelo, esa no es nuestra solución.

El camino en el que tenemos que trabajar es conseguir puertos más eficientes, transparentes y sostenibles medioambientalmente sin degradar las condiciones laborales ni la calidad del servicio.

  Dieter-Lebrecht Koch (PPE). Frau Präsidentin, Frau Kommissarin, verehrte Kolleginnen und Kollegen! An Liberalisierungsbestrebungen für Hafendienstleistungen kann ich mich gut erinnern. Nach 2001 und 2004 liegt uns nun ein erneutes, ein drittes Hafenpaket vor, und das auch schon seit 2013.

Obwohl sich die Parlamentszusammensetzung seither wesentlich verändert hat, ist das Haus seinen hohen Ansprüchen treu geblieben. Auch mit dem heute zur Debatte stehenden Bericht wird es zu keinem bedingungslosen Zwang zur Liberalisierung für konkurrierende Anbieter kommen. Deshalb danke ich dem Berichterstatter, der unser Ziel nicht aus den Augen verloren hat und sich stets für die Freiheit der Organisation von Hafendiensten eingesetzt hat. Aufgrund der sehr unterschiedlich ausgeprägten Häfen in Europa war es wohl auch so schwierig, einen kohärenten Text zu erstellen. Ich meine aber, dem Berichterstatter ist ein guter Mittelweg gelungen. Vor allem begrüße ich die deutliche Forderung nach Transparenz, sowohl bei der Wahl der Anbieter – hier darf es zu keinen Diskriminierungen kommen – als auch bei den finanziellen Beziehungen und bei den Entgelten für die Nutzung von Hafendiensten oder der Hafeninfrastruktur.

Ich begrüße vor allem, dass zur Aufrechterhaltung der Sicherheit und der Wettbewerbsfähigkeit unserer Häfen Arbeitnehmer auch in diesem Sektor gut ausgebildet und kontinuierlich weitergeschult werden müssen. Ich werbe um die Zustimmung.

Señora Presidenta, la Comisión debe escuchar la posición firme de esta Cámara y de los trabajadores portuarios contra la liberalización del sector y debe actuar de una vez contra aquellos Estados que ignoran la norma europea cuando se definen nuevos estándares sociales.

Consideramos que esta propuesta mejora las condiciones de trabajo en los puertos, algo que pedíamos ya en la opinión de la Comisión de Empleo. Se obliga a formar laboralmente en condiciones seguras y saludables a los trabajadores portuarios y se apoya la negociación colectiva, a la vez que se obliga a respetar mínimos sociales y laborales a las empresas portuarias.

Pero avisamos: estos derechos deben aplicarse por igual a los trabajadores de puertos públicos o privados. Nos oponemos firmemente a las exclusiones que nos pide ahora la derecha.

Y quedan todavía flecos por solucionar: por ejemplo, la insuficiente protección de los trabajadores en caso de transferencia del servicio y los obstáculos a la financiación pública de los puertos. En este sentido, nos parece especialmente grave que pueda ponerse en duda la necesidad de garantizar el control público de infraestructuras clave como son los puertos.

  Massimiliano Salini (PPE). Signor Presidente, onorevoli colleghi, grazie Commissario, mi complimento per il lavoro svolto dal relatore e dai relatori ombra. Un ringraziamento in particolare alla collega Vozemberg, relatrice ombra per il mio gruppo. L'impegno che è stato profuso nel tentativo di far convergere le tante e differenti esigenze dei numerosi porti europei va apprezzato, anche se la risposta non è – come tanti colleghi hanno detto – sempre soddisfacente.

E quali sono i punti su cui, durante la fase di negoziato dei triloghi, noi saremo attenti e controlleremo affinché vengano garantiti i punti forti della presenza dei porti nel sistema di sviluppo europeo? Il primo punto è che si sia chiaro che non tutti i porti, come dicevamo, sono uguali. E vi è una differenziazione evidente tra quanto accade nei porti del Nord Europa e quanto accade nei porti del Sud Europa. Nel mio paese, in Italia, abbiamo un enorme numero di passeggeri, anche nell'ambito turistico, che cubano circa sette-otto milioni di presenze all'anno, quasi il 23%, dei movimenti a livello continentale.

Siamo consapevoli degli enormi numeri che passano attraverso i porti europei nell'ambito delle merci – più del 75% tra import e export, oltre il 37% del mercato interno – e quindi sappiamo quanto sia necessario e complicato far convergere tutte le esigenze. Da questo punto di vista, quindi, anche nell'ambito sociale, chiediamo attenzione perché i porti continuino ad essere il punto dove convergono grandi investimenti per il futuro dell'Europa.

  João Ferreira (GUE/NGL). Senhora Presidente, há muito que os portos e o trabalho portuário estão sob o ataque do grande capital e dos seus representantes políticos. Forçar a desvalorização da força de trabalho é vital para reduzir custos e aumentar lucros, num quadro de cada vez mais acirrada concorrência à escala mundial, de crescente liberalização e desregulação dos mercados e da progressiva privatização do setor portuário, impulsionada pela União Europeia.

A situação em Portugal é paradigmática. Protegido pela ingerência da troica e pelo seu governo de mão, o patronato anteviu uma oportunidade para regressar ao tempo das casas de conto, da exploração desenfreada. Não satisfeitos com a precariedade já existente nunca estão, querem ir mais longe, querem sempre ir mais longe na exploração. Valeu e vale tudo, até criar um sindicato fantoche, mas valeu também a unidade e a combatividade dos trabalhadores portuários. Não tenhamos ilusões, é isto que pode travar o passo à Comissão Europeia, aos interesses que esta defende e aos seus gravosos intentos, defendendo os direitos dos trabalhadores e o interesse nacional.

  Elżbieta Katarzyna Łukacijewska (PPE). Pani Przewodnicząca! Pan sprawozdawca powiedział, że dzisiejszy projekt jest lepszy niż dwa poprzednio odrzucone. Myślę, że po piętnastu latach Europa w tym zakresie zasługuje na bardzo dobre przepisy, które nie pozostawiają wątpliwości interpretacyjnych. Panie Sprawozdawco! Polska nie ma problemów z przejrzystością. Polska, my mamy obawy, które wzbudzają zapisy tego rozporządzenia nieuwzględniające specyfiki portów w krajach Unii Europejskiej, kierując się zasadą, że jedno wspólne europejskie podejście jest lepsze niż działania podejmowane na poziomie państw członkowskich. Z takim podejściem nie możemy się zgodzić. Nie możemy też popierać przepisów, które zwiększają biurokrację i spowodują konieczność zmian w zakresie kompetencji wielu polskich instytucji.

W Polsce posiadamy bardzo dobre przepisy, które gwarantują przejrzystość finansową, swobodę działalności gospodarczej, konkurencję, odpowiedni nadzór. Polskie porty rozwijają się bardzo dobrze i obawiamy się, że te zapisy zaburzą ten rozwój. Dlatego też polska delegacja będzie głosowała przeciwko temu rozwiązaniu, doceniając zarówno wysiłek sprawozdawcy, jak i wszystkich zastępców.

  Stanislav Polčák (PPE). Paní předsedající, já bych rovněž vyjádřil naději, že tento třetí pokus o schválení této zprávy, respektive této legislativy, bude úspěšný.

Vítám a oceňuji na tomto návrhu, že do jisté míry ustupuje od některých ustanovení v rámci sociální části. To lze bezesporu ocenit. Nicméně považuji za důležité, aby Komise nadále prosazovala, tak jak plyne z toho návrhu, jednotná pravidla pro fungování přístavu.

Aby tato pravidla vytvářela dostatečnou konkurenceschopnost a konkurenční napětí, protože dnes jsme rovněž svědky situace, kdy se zneužívá trhu. Kdy se zneužívá situace právě v přepravních a zbožových výkonech v rámci tranzitu.

Takže pro nás je podstatné, byť jsme vnitrozemský stát, Česká republika, aby tato pravidla byla skutečně konkurenceschopná i do budoucna, aby nastavovala transparentní, jednoduchou síť pro přepravu zboží.

  Richard Howitt (S&D). Madam President, these coast ports which I represent are a major engine for jobs and growth: one million square feet of new distribution space last year at Felixstowe, Britain’s biggest container port; a new port at London Gateway; GBP 100 million investment in the port of Tilbury, adding to modern crane facilities provided with the help of the EU motorways of the sea; the port of Ipswich playing a major economic role for the Haven gateway, and Great Yarmouth for the economy in Norfolk. That is why I reiterate to my friend Knut Fleckenstein a call to use the negotiation to promote competition between European ports. To ensure a genuine level playing field for state aids, I am worried about the proposed exemptions. I think we have to heed the warnings of the European Towage Association, which predicts environmental catastrophe. I do not ask him for different arrangements for the UK; instead, while the British Government opposes the social and employment aspects in Articles 10(2) and 10(a), I ask him to defend them and to support Amendments 146 and 147, which I co—signed, on enhanced safety and collective bargaining rights. The Port Service Regulation has been refused twice, and if jobs, employment rights, investment and safety are not guaranteed, it should be rejected again.

  Ruža Tomašić (ECR). Gospodine predsjedniče, u izvješću su predstavljene kvalitetne izmjene u odnosu na prijedlog Europske komisije. Posebno pozdravljam odbijanje jedinstvenog sustava upravljanja jer smatram da moramo poštovati svu raznovrsnost lučkog sustava Unije te ojačati modele organizacije lučkih usluga koji se trenutno primjenjuju diljem kontinenta.

Drago mi je da je nadležni odbor uvažio potencijal koji proizlazi iz ovakve raznolikosti i stavio naglasak na zajedničke minimalne zahtjeve i njihovu učinkovitu provedbu. Nažalost, u ovom se domu prečesto inzistira na lošim univerzalnim rješenjima pa je ovo izvješće dobrodošla iznimka koju valja podržati.

Smatram da je u izvješću dovoljno naglašena i važnost financijske transparentnosti pri korištenju javnih sredstava, a inzistiranje na načelu proporcionalnosti pri naplati pristojbe čiji iznos više neće moći biti nesrazmjeran ekonomskoj vrijednosti pružene usluge također predstavlja važan korak u pravom smjeru.

  Ramon Tremosa i Balcells (ALDE). Madam President, this port regulation is a very good attempt to set a level playing field for all European ports and also to enhance their competitiveness. Business as usual in some Member States has until now protected the interests of the centralised port bureaucracy of some Member States instead of the interest of consumers, enterprises and economic growth. Europe needs to be successful in sharing best practices, like the ports’ fiscal autonomy, among the more reluctant reformers of the European Union.

As a Catalan MEP I welcome this report and I hope that this legislation makes it through with minimum changes in the negotiation with the Council.

  Igor Šoltes (Verts/ALE). Ta uredba, ta dokument naj bi torej po mnenju predlagatelja izboljšal konkurenčnost, trasparentnost, manj birokracije za uporabnike. Po mnenju komisarke ponuja pogled v prihodnost, modernizacija pristanišč.

Seveda pristanišča pomenijo vrata v svet. Večkrat je bil danes omenjen tudi problem delovnih mest. Seveda tukaj ne govorimo kar tako o delovnih mestih. Želimo si seveda dostojnih delovnih mest za dostojno plačilo in torej tudi ustrezno nadaljevanje pogajanj o kolektivnih pogodbah, ker seveda na prvem mestu je tudi varnost in pa seveda socialne pravice.

Glede na to, da se poskuša doseči čim bolj enakopraven položaj tudi glede na evropski proračun, pričakujem, da bo tudi s strani Komisije poskrbljeno, kolikor se to da, za uravnotežen razvoj pristanišč glede tudi na njihove različnosti in prednosti.

  Tim Aker (EFDD). Madam President, Tilbury Docks, in my constituency, is linked to one in ten jobs within Thurrock. The success of those jobs relies on the success of the port. At DP World within Thurrock Borough, trade is growing, and this would be the worst possible time to put more regulations on them, especially as trade is growing with the rest of the world outside the EU.

This is a case in point with our referendum coming up: why should EU rules affect non—EU trade that has absolutely nothing to do with the European Union? We will be opposing it for those reasons. The best people to govern our ports are the people that should govern our laws – the British people themselves.

  Diane Dodds (NI). Madam President, I want to speak tonight on behalf of Northern Ireland’s ports, which would be devastated by these proposals. This is yet another example of the EU trying to impose a one-size-fits-all solution.

Ports in Northern Ireland are already part of a thriving, competitive independent UK sector. Belfast Harbour handles goods valued at GBP 30 billion annually, 700 companies are based in the harbour estate, over 22 000 people are employed there. Foyle Port supports an estimated 1 000 jobs, representing wages of GBP 26 million annually into the local economy.

No political union should seek to jeopardise these benefits for local people. What we have in this proposal are bureaucratic obstacles to growth and job creation, the imposition of excessive regulation and oversight. It penalises the ports as being service providers. Of course we all know that if this gets through, it is simply the beginning. Tomorrow I will be voting to reject this approach and to protect Northern Ireland’s economy.

Was gefährdet diese Wirtschaft besonders? Ich glaube nämlich, dass die nordirische Hafenwirtschaft sehr wohl davon profitieren könnte, weil sie nämlich gar nicht gezwungen wird, irgendetwas groß zu ändern.

I want to absolutely confirm with the rapporteur that I have consulted at great length with the Northern Ireland ports, and the Northern Ireland ports are absolutely opposed to these changes. They see them as being anti-competitive, they see them as blocking growth and job creation and, in a place like Belfast which is relatively small, support for 22 000 jobs is absolutely vital.

  Seán Kelly (PPE). Madam President, coming from the island of Ireland, ports are obviously very important to us, and thankfully we have some fine ports both in Northern Ireland and in the Republic of Ireland. Post COP21, the role of the maritime sector, shipping and ports are going to be very important in helping us to meet our targets regarding emissions, and particularly the development of the motorways of the seas. For that reason, it is important that ports are functioning properly and that there be transparency, intra-port competition, and that the rights of workers, etc., be protected. But we also need to develop the core network corridor, especially for ports like Shannon Foynes in my own constituency, which is one of the deepest ports in Europe – and with the Panama Canal now doubling its capacity, deep ports are going to be required. By the extension of the network corridor, this would be a huge asset both to Shannon Foynes and, indeed, to Europe generally, and I think that is something we should consider.

  Inés Ayala Sender (S&D). Señora Presidenta, es el tercer intento de europeizar los puertos y querría plantear qué significado le damos esta vez. Para el Comisario Kallas, que fue quien puso el texto inicial encima de la mesa, consistía en aplicar reglas de competencia dentro de los puertos, imponiendo dinámicas de competencia a los distintos servicios del puerto, incluso a los vitales, como es el caso del practicaje, que debe responder a exigencias de seguridad, medio ambiente e incluso lucha contra la explotación laboral de las tripulaciones. De ahí que en esto sí que coincida con el ponente y el Parlamento. Me congratulo de que los hayamos excluido de una regla que lo ponía todo en peligro.

Para los puertos del sur era también la ocasión de establecer un sistema de transparencia para evitar la competencia injusta entre los del norte, que históricamente son ricos porque están financiados con fuertes ayudas de Estado, frente a los del sur, que no tienen estas ayudas. Cuál no ha sido mi sorpresa cuando he visto esta mañana que la Comisaria Vestager ha planteado la exención de las ayudas para infraestructuras de los puertos, evidentemente para aquellos que tienen posibilidades. De ahí que mi voto, también en vista de los problemas de las tasas portuarias del sistema español, no pueda ser positivo.

EU:n satamat tarvitsevat yhtenäiset, ketään syrjimättömät pelisäännöt. Läpinäkyvyys ja avoimet menettelyt ovat kaikkien etu. Nyt äänestettävä ehdotus omalta osaltaan vahvistaa näitä sääntöjä. Siksi kannatan sitä.

  Violeta Bulc, Member of the Commission. Madam President, I would like to thank everyone for this most interesting debate. I have listened carefully to all of the comments, but some of the information in the debate is a bit outdated. State aid exemptions have been published today. The focus is now on the modernisation of ports to make them greener, more socially responsible and more innovative. The benefits are for all ports, not only a few in the north. The text is based on clear complementarity between EU and national levels, leaving ample room to adapt to local environments. The vote will decide if it is a stable legislative framework for ports. The momentum is there to improve the functioning of the trans-European transport network to create growth in ports and through ports, which also leads to new employment opportunities.

Regarding some of the comments by the honourable Members Anderson, de Grandes Pascual and Ayala Sender as regards the autonomy of ports in setting infrastructure charges, I am open to working with you constructively to find a solution during the trilogues. Like the Council, some of you think that the regulation should not prevent Member States from having their say on charges and port management. I hear you; be assured the Commission is willing to look at this question during the trilogues.

To honourable Members Seymour and Foster I would say that as regards private ports, we are open to solutions, but they must not allow private undertakings to abuse their dominant position or distort competition with other ports.

In response to honourable Members Taylor, Delli and Šoltes, allow me to highlight again the benefits the regulation brings for the environment. The internalised external cause the regulation will serve to develop a method for varying port charges according to the environmental performance of the ships. More generally, financial transparency and clearer rules on access to the market will encourage the investments which are dearly needed to make ports greener. I therefore see no disagreement with the objectives of the Green groups.

As regards Article 10 on the transfer of rights, let me be very clear: the transfer of staff should not be regulated at European level, but left to the Member States. We must respect national labour laws and the arrangements which have been developed by social partners. I am confident we will be able to clarify these during the trilogue. I hope this answers the call of honourable Member Anderson.

With that, I want to thank again the rapporteur and his shadows for their perseverance. The support from all major organisations show that the report on the table strikes the right balance, and that is what we have a chance to achieve tomorrow with positive support: a chance for a balanced agreement on ports, an agreement that can further strengthen the single transport area and the single market which has been a great achievement of the EU. I therefore encourage Members to support it; I believe we are ready for trilogues that can bring the final solution.

  Knut Fleckenstein, Berichterstatter. Frau Präsidentin, liebe Kolleginnen und Kollegen! Es gab eine lange und intensive Diskussion – vor allem mit den Hafenbehörden, den Terminalbetreibern, den Gewerkschaften, zum Teil vor Ort in Piräus und Koper, in Triest und Rijeka, in Barcelona und Antwerpen, in Porto, auch in Hamburg. Denn wir haben gewusst, dass nach der katastrophalen Historie des Hafenpakets ein tragfähiger Kompromiss nur zustande kommen kann, wenn möglichst viele Stakeholder beteiligt sind. Nach 15 Jahren Diskussion, nach politischen Streiks selbst in Deutschland, einer beschädigten Außenfassade des Straßburger Parlaments – wenn sich die Älteren erinnern – ist es jetzt aufgrund von viel gutem Willen und harter Arbeit gelungen, weitgehend Einvernehmen zu erzielen.

Ich möchte Ihnen zum Abschluss aus einer E-Mail vorlesen, die uns in den vergangenen Tagen zugegangen ist:

‘On 8 March the European Parliament will be voting on the Fleckenstein report on the proposal for a port regulation. The European organisations representing the ports appreciate the efforts that have been made by the rapporteur and the shadow rapporteurs to reach a balanced compromise text thanks to an inclusive dialogue involving different stakeholders. We strongly believe that the work achieved so far by the rapporteur and the shadows should be supported in the plenary and is a solid base for opening the negotiation with the Council.’

  Jonathan Arnott (EFDD), in writing. Jobs could be lost at the Port of Tyne and Teesport if PSR is passed in this Parliament today. The proposed PSR will have a substantial impact on privately-owned ports. Most continental ports are in public ownership but 75% of British ports are in private ownership, so the United Kingdom will be the most affected. Ports will be forced to contract out services and appoint at least two service providers, even if only one is required. This will undermine the competitiveness of local ports in a tough market. The proposed PSR would also undermine commercial confidentiality. I am very concerned at the impact the regulations would have on Teesport: it is another kick in the teeth for hard-working people. Our local economy is under severe strain, and our transport links are a huge part of the fact that the North East is a net exporting region. We simply cannot afford to risk further loss of jobs at a time when our region already has the highest unemployment in the country. This proposal is a timely reminder that staying in the EU actually carries a substantial risk to local people’s jobs. The UK has Europe’s second-largest port sector, with 344 000 jobs across the country.

Chers collègues, je vous invite à voter en faveur du rapport sur la proposition de règlement établissant un cadre pour l'accès au marché des services portuaires et la transparence financière des ports. Je suis en effet d'avis que le futur règlement devrait permettre d'accroitre l'efficacité et de réduire le coût des services fournis dans les ports maritimes de l'Union européenne.

Dans ce rapport, je retiens plusieurs éléments. Tout d'abord, la nécessaire transparence au niveau des comptes des ports quant aux fonds publics. Il est normal, voire indispensable, que le citoyen puisse facilement identifier les fonds publics dans les comptes des ports. Un autre point sur lequel je souhaite insister est le droit pour le personnel de bénéficier de conditions de travail se fondant sur des normes sociales nationales, régionales ou locales contraignantes ainsi que d'une formation pertinente.

Maintenant, j'attends également des négociateurs du Parlement européen qu'ils insistent sur ces points dans les négociations avec le Conseil en vue d'obtenir un règlement final ambitieux dans l'intérêt de tous, et notamment des travailleurs et des citoyens.

  Indrek Tarand (Verts/ALE), in writing. I would have liked for the report to be more ambitious on the financial transparency aspect. Due to the complex nature of port organisation, especially of the larger ports, the transparency rules need to be strict on paper in order to achieve the desired effect in practice. Even in relatively small ports, such as the port of Tallinn, there are cases of corruption in which the political parties in power benefit from the corruption, and yet remain relatively insulated since their tool of choice is exercising control over the state-owned company. If, due to lack of transparency, these kinds of activities take a while to be discovered in small ports such as Tallinn, we can only imagine what the situation in larger ports could be. Ceterum censeo, parteipoliitikute juhtiv osalus riigiettevõtete nõukogudes on tarvis kogu Euroopas lõpetada ning nad tuleks asendada ekspertide seast leitavate juhtidega.

  Janusz Zemke (S&D), na piśmie. Jestem krytyczny wobec propozycji dotyczącej usług portowych. Chcę zapowiedzieć również, że konsekwentnie będę głosował przeciwko obecnej wersji sprawozdania. W moim przekonaniu państwa członkowskie UE mają już obecnie wystarczające kompetencje, by polepszać jakość usług portowych, modernizować urządzenia portowe i zwiększać przejrzystość finansową portów. Wbrew intencjom, projekt rozporządzenia może skutkować pogorszeniem warunków funkcjonowania portów. Niepokój budzą także przewidywane nowe kompetencje zarządów portów, polegające na możliwości ograniczenia liczby dostępnych usług portowych. Przecież uderza to wprost w zasadę swobody przedsiębiorczości i konkurencyjności. Swoje stanowisko opieram na licznych rozmowach ze specjalistami, w tym z zarządem portów w Gdańsku, Gdyni, Szczecinie i Świnoujściu.
