  Tatjana Ždanoka, Vice-Chair of the Delegation to the EU-Kazakhstan, EU-Kyrgyzstan, EU-Uzbekistan and EU-Tajikistan Parliamentary Cooperation Committees and for relations with Turkmenistan and Mongolia. Madam President, I will speak now in my capacity as Vice—Chair of the Central Asia Delegation. In this capacity, I prefer mutually respectful, equal dialogue with Kazakhstan.

The EU has a vital interest in stepping up strategic cooperation with such an important international actor as Kazakhstan. Therefore, I would like to pose the following question to my colleagues. Unless it decently calls into question Kazakhstan’s ambition to be a candidate for a non-permanent seat on the UN Security Council in 2017-2018, do we have the moral right, as cavalierly as is made out in the resolution, to teach Kazakhstan on the questions concerning freedom of expression while we ourselves behave badly in the very same area?

Last December our Parliament accepted the resolution saying that measures taken over the past few years in Hungary have led to a serious systematic deterioration in the situation as regards the rule of law and fundamental rights, inter alia freedom of expression. This January we hotly debated the rule of law and media independence in Poland.

In my own country, Latvia, the parliament has just adopted at first reading new provisions in criminal law which are aimed at sentencing to imprisonment for even non—violent actions against the state, that is independence, sovereignty, territorial integrity, and also for cooperation with foreign organisations against the security interests of the state.

I myself sharply condemn attacks on freedom of expression elsewhere in the world. Therefore, I am sure that we have to fight for these freedoms together, but not against each other.

  Ignazio Corrao, Autore. Signora Presidente, onorevoli colleghi, la situazione in Kazakistan continua ad essere grave nonostante le raccomandazioni e i rapporti commerciali. Le minoranze continuano a denunciare vessazioni da parte della polizia e delle autorità locali. Alcuni esponenti politici dell'opposizione continuano ad essere detenuti arbitrariamente; i funzionari dei servizi di sicurezza sono stati accusati di utilizzare sistematicamente tortura e maltrattamenti contro gli attivisti della società civile. Il governo kazako limita pesantemente la libertà di riunione, di parole e di religione.

Nonostante le numerose richieste della comunità internazionale, di fare passi avanti, in tema di libertà di espressione, il governo ha adottato una nuova legislazione che de facto la limita ancora di più. Esprimiamo profonda preoccupazione per lo stato in cui versa la società civile, gli oppositori antigovernativi e i giornalisti del Paese. Chiediamo che l'Unione europea, anche tramite gli accordi bilaterali in essere, pretenda dalle autorità kazake indagini efficaci e sanzioni appropriate per i colpevoli. Non vorremmo pensare che la diversa sensibilità che dimostriamo in analoghi casi di violazione dei diritti umani sia dettata dalla presenza di interessi che sono posti su un piano superiore.

  Ryszard Czarnecki, autor. Pani Przewodnicząca! Panie Komisarzu! Nie będę mówił o sytuacji na Łotwie, jak pani przewodnicząca Ždanoka, chcę mówić o Kazachstanie. W tym kraju byłem siedmiokrotnie, nie byłem tylko w stolicy (najpierw to była Ałma-Ata, obecnie Ałmaty; teraz stolicą jest Astana), ale przejechałem dwa tysiące kilometrów samochodem. Myślę, że znam to państwo i generalnie byłoby dobrze, gdybyśmy zabierali głos wtedy, kiedy znamy specyfikę danego kraju. Mieliśmy niedawno debatę o uchodźcach. Ja byłem w obozach dla uchodźców, więc też wiedziałem, o czym mówię. Sytuacja w regionie jest specyficzna: tam wolność słowa i wolność mediów jest inaczej postrzegana niż wypadałoby to postrzegać według naszych europejskich standardów. W związku z tym tę poprawkę należy przyjąć, ale w tej rezolucji jest też mowa, że Kazachstan jest naszym bardzo ważnym strategicznym partnerem.

  Tunne Kelam, author. Madam President, I would say to Commissioner Hahn that we are deeply worried about freedom of expression in Kazakhstan. The recent signing of the enhanced PCA was actually a welcome and mutually beneficial step, but such a relationship must be based on shared values and democratic reforms. This is not lecturing a partner; this is about shared values.

There are signals of increasing repression of critical voices. It is especially alarming that just around the signing of the PCA last December, criminal cases were launched against independent journalists and editors of the Nakanune.kz website, Guzyal Baidalinova and Yuliya Kozlova, who were merely accused of spreading false information. I also called for the release of the opposition leader Vladimir Kozlov, several journalists, such as Seztkazy Matayev, and bloggers, such as Ermek Narymbayev, Serikzhan Mambetalin and Bolatbek Blylov. Even if their names sound like they come from a faraway country, we feel very close to them in a spirit of solidarity. We demand that they be able to exercise their freedom of expression with the dignity of truly free citizens.

  Urmas Paet, author. Madam President, the situation on the freedom of expression in Kazakhstan has deteriorated in recent years. Independent media outlets, journalists and bloggers frequently suffer arrests and pressure from authorities just for doing their job and exercising their right to voice an opinion. People are even harassed for being active in social media. We call on the Kazakhstan authorities to ensure that human rights are respected and that the media and civil society be able to carry out their activities without fear of harassment.

EU enhanced relations with Kazakhstan are linked to concrete human rights improvements. The Partnership and Cooperation Agreement (PCA) with the EU must be linked to developments in democracy, rule of law, human rights and fundamental freedoms in Kazakhstan.

While I am most delighted that Kazakhstan has joined the World Trade Organization, it is also important that Kazakhstan fulfil its international obligations in other spheres and follow the rule of law and guarantee legal certainty for international companies operating in Kazakhstan and the protection of their investments.

  Lola Sánchez Caldentey, Autora. Señora Presidenta, Kazajistán es el país postsoviético no europeo más rico, sobre todo, debido a sus reservas de petróleo. La Unión Europea lo considera un aliado clave por intereses geopolíticos y económicos. Sin embargo, las desigualdades en Kazajistán se agravan, la corrupción se dispara y los políticos y los hombres de negocios se confunden.

Kazajistán está derivando en un régimen autoritario. Se persigue toda crítica, ya venga de oposición política, periodistas o blogueros. Los derechos laborales están en dramática recesión, los estándares de la OIT se violan sistemáticamente y se criminaliza a los sindicatos. La situación en las cárceles es muy preocupante. El maltrato a prisioneros políticos es constante.

En este contexto, la Unión Europea está revisando su Estrategia para Asia Central y parece que se basará simplemente en objetivos geopolíticos y económicos, sin tener en cuenta los derechos humanos, una vez más.

Es urgente que empecemos a preocuparnos por la situación de los derechos humanos en aquellos Estados que consideramos socios. La Unión Europea no debe asociarse con violadores de derechos humanos.

Signora Presidente, onorevoli colleghi, gli arresti e le detenzioni di giornalisti e blogger avvenuti lo scorso dicembre, in alcuni casi, solo pochi giorni prima della firma dell'accordo rafforzato di partenariato e cooperazione tra l'UE e il Kazakistan, il quale contiene clausole chiare sul rispetto dei diritti umani e delle libertà dei media e di espressione, rappresentano un segnale molto preoccupante per la Comunità europea.

Oltre ai recenti casi che sono tra l'altro menzionati nel testo della risoluzione, pare che le autorità kazake stiano muovendo anche a livello internazionale, cercando di silenziare i media che erano già stati banditi in Kazakistan, ma che continuano a lavorare all'estero, come Res publica, che attualmente sta combattendo cause legali avviate dal Kazakistan presso tribunali americani.

Rimane particolarmente preoccupante l'uso frequente dell'articolo del codice penale sulla ispirazione all'odio sociale, molto vago e spesso utilizzato in caso di mancate prove e argomenti validi, contro individui critici nei confronti delle autorità. Per tutto questo, è indispensabile che questa risoluzione sia approvata.

  Jiří Pospíšil, za skupinu PPE. Paní předsedající, já se chci připojit ke svým předřečníkům a autorům daného textu. Je podle mě správné, že debatujeme o stavu lidských práv a otázkách svobody projevu v Kazachstánu.

Ve chvíli, kdy Kazachstán, jak už bylo řečeno, s námi podepsal strategickou dohodu o posíleném partnerství, pak nás musí zajímat to, jak náš partner se staví k základním lidským svobodám, k právu na veřejné projevy, k právu na shromažďování atd. Důležité je to v tuto chvíli, když za několik dní se konají v Kazachstánu předčasné volby. To je třeba také říci, za několik dní probíhají v Kazachstánu předčasné parlamentní volby a my bychom měli sledovat, zda budou splňovat základní principy svobodných a tajných voleb. Bylo už tady zmíněno a v usnesení je to podrobně popsáno potlačování práv novinářů, blogerů, opozičních politiků. Je třeba vyzvat Kazachstán, pokud chce být dále naším strategickým partnerem, a my to chceme, aby propustil tyto vězněné politiky, blogery, novináře. Jinak těžko do budoucna můžeme úzce spolupracovat.

Ma tahaksin sotsiaaldemokraatide poolt kinnitada, et ühelt poolt on kasahhide püüdlus olla Euroopa Liidule partneriks väga oluline ja me toetame seda, kuid teiselt poolt tõstab see veelgi meie nõudlikkust, et Kasahstan jälgiks ja järgiks neid põhimõtteid, mis on meie koostöölepingus. Ja praegune olukord näitab siin väga teravat ja suurenevat vastuolu. Kusjuures Kasahstani võimud tegelevad sellega, et nad jälitavad opositsiooniliidreid isegi siis, kui nood on saanud poliitilise varjupaiga Euroopa Liidu maades, ja kasutavad kõiki võimalusi selleks, et – nagu siin juba oli öeldud – jälitada ka neid meediaväljaandeid, mis tegelikult on läinud Kasahstanist väljapoole.

Nii et me loodame väga, et selles olukorras, kus koostööleping Kasahstaniga peab saama heaks kiidetud kõikide liikmesriikide parlamentides ja ka meie poolt siin, pööraksime me teravat tähelepanu sellele, et Kasahstan tõepoolest neid kohustusi täidaks ja kõiki neid demokraatlikke vabadusi ja põhiõigusi kaitseks, mis on ette nähtud nii selles lepingus kui ka, muide, Kasahstani enda põhiseaduses. Ma seepärast väga toetan seda resolutsiooni ja kutsun ka kõiki meie parlamendiliikmeid üles pöörama oma liikmesriikides tähelepanu praegusele olukorrale Kasahstanis ja võimalusele seda olukorda praegu meie surve abil parandada.

  Илхан Кючюк, от името на групата ALDE. Подобно на всички държави от региона, Казахстан е страна с богата история, която дълги години е била част от Съветския съюз. Взаимоотношенията ни с Казахстан са от особено значение, като се има предвид, че страната бе първата в Централна Азия, която подписа споразумение за сътрудничество с Европейския съюз, в резултат на което имаме значими съвместни проекти. И въпреки че 25 години търси своята демократична идентичност, няма как да пренебрегнем факта, че политическата система проявява признаци на олигархизъм. Нещо повече, през последните години наблюдаваме влошаване на цялостното зачитане на демократичните стандарти, правата на човека и основните свободи в Казахстан. Арестът на журналисти и блогъри за това, че изпълняват своите функции, са актове, на които Европейският съюз трябва категорично да се противопостави.

В тази връзка призовавам казахстанските власти да действат в съответствие с международните задължения и своите ангажименти към ОСС, да се въздържат от използването на политически мотивирани обвинения срещу критични журналисти, независимите медии и гражданите, които са неоснователно задържани, да бъдат незабавно освободени.

Dear colleague, as you know, the Partnership and Cooperation Agreement between the European Union and Kazakhstan still has to be ratified by some of EU Member States’ parliaments. Do you not think that, taking into consideration this situation, we should call on some of the Member States’ parliaments to slow down the ratification so that Kazakhstan implements the EU recommendations on the protection of freedom, freedom of assembly and the respect for human rights?

  Σωτήριος Ζαριανόπουλος ( NI). Κυρία Πρόεδρε, μετά την ανατροπή του σοσιαλισμού και τη διάλυση της Σοβιετικής Ένωσης αποκαλύπτεται ποια είναι η δήθεν δημοκρατία και ελευθερία που επιβλήθηκε στους λαούς της. Καταδικάζουμε κατηγορηματικά την κρατική βία της κυβέρνησης του Καζαχστάν, την καταστολή των δημοκρατικών δικαιωμάτων και λαϊκών ελευθεριών, του ταξικού εργατικού κινήματος και των κομμουνιστών με την απαγόρευση του Κομμουνιστικού Κόμματος Καζαχστάν. Η έκθεση, η κοινή έκθεση όλων των πολιτικών ομάδων, αποσιωπά αυτά τα γεγονότα. Δεν αναφέρει κουβέντα για τη δολοφονική επίθεση της αστυνομίας στους απεργούς διαδηλωτές της πόλης Ζαναοζέν, τον θάνατο και τον τραυματισμό δεκάδων από αυτούς, το πογκρόμ διώξεων κατά δεκάδων άλλων αγωνιστών ούτε αναφέρει τίποτα για τον νόμο για ασφυκτικό έλεγχο των εργατικών σωματείων.

Είναι υποκριτική και επιλεκτική η δήθεν ανησυχία της Ευρωπαϊκής Ένωσης και του Κοινοβουλίου, καθώς ανάλογα μέτρα εφαρμόζονται και σε κράτη μέλη της με την βούλα αυτών των οργανισμών. Εκφράζουμε την αμέριστη αλληλεγγύη μας στους κομμουνιστές και τo ταξικό κίνημα του Καζαχστάν. Κάτω τα χέρια από τους κομμουνιστές του Καζαχστάν!

  Pavel Svoboda (PPE). Paní předsedající, pane komisaři, všichni v tomto sále víme, že svoboda projevu je základním předpokladem demokracie, a to nejenom pro jednotlivé občany, ale zejména pro novináře. Bránit svobodné výměně názorů je nejen nedemokratické, ale také kontraproduktivní, protože šíření nezávislých informací lze sice omezit, ale nikdy se nedá zcela potlačit.

Je dvojnásob odsouzeníhodné, pokud k potlačení svobody slova používá státní moc zástupná obvinění například z držení drog, jak se to děje v Kazachstánu. Sám jsem měl možnost se osobně setkat se zástupci nezávislých médií v Kazachstánu a rád bych proto upozornil na nepřesnost v bodu odůvodnění D preambule našeho usnesení. Novinářka Julia Kozlovová nebyla zbavena všech obvinění. Je stále obviněna z šíření falešných informací, což může vést k odsouzení až na sedm let. Je proto třeba stále její případ sledovat a podpořit ji a všechny další, kteří v Kazachstánu bojují za svobodu projevu.

  Andrejs Mamikins (S&D). Priekšsēdētāj! Godātais komisāra kungs, Hana kungs, godātie kolēģi! Protams, situācija ar vārda brīvību Kazahstānā ir tālu no ideālas. Šeit vēl ir daudz kas jādara gan Kazahstānas valdībai, gan pilsoniskajai sabiedrībai. Vairākus bloga resursus un žurnālistus, tai skaitā arī Vladimira Kozlova sievu, es pazīstu personīgi, jo, pirms šeit kļuvu par Eiropas Parlamenta deputātu, es, būdams žurnālists, devu viņiem iespēju uzstāties un paust savus viedokļus, jo viņiem nebija tādas iespējas Kazahstānā.

Bet īstenībā šis jautājums ir pavisam par ko citu. Kā mēs varam pamācīt Kazahstānu, ņemot vērā to, kas notiek pie mums mūsu pašu mājās? Nesen manā valstī — Latvijā — cilvēks vārdā Maksims Koptelovs tika notiesāts ar reālu pusgadu ilgu cietumsodu tikai par to, ka viņš uzrakstīja internetā par iespējamo Latvijas pievienošanu Krievijai, un tas bija joks, viņš piebilda. Mēs, sociālisti nosodām šo nostāju, bet tas arī ir milzīgs vārda brīvības pārkāpums.

  Eduard Kukan (PPE). Madam President, Kazakhstan has become the first country in Central Asia to have an EPCA with the EU. We expect these enhanced bilateral relations to compliment Kazakhstan’s efforts on political and democratic reforms and to go further within this framework. Despite the strong relationship with Kazakhstan, we have to point out the growing pressure on independent media outlets and the environment in which civil society works.

The extensive list of journalists harassed by the authorities is worrying. Even when fighting extremism and terrorism, freedom of expression cannot be compromised. This should particularly apply in a pre-electoral environment so that voters can freely choose their candidates. With respect to the upcoming early parliamentary elections already taking place on 20 March, I would like to underline the importance of full OSCE/ODIHR recommendations.

  Νότης Μαριάς ( ECR). Κυρία Πρόεδρε, η κρατικά ελεγχόμενη οικονομία στο Καζαχστάν έχει πληγεί σοβαρά από την πτώση της τιμής του πετρελαίου. Το εθνικό νόμισμα έχει χάσει τη μισή του αξία από το περασμένο καλοκαίρι και όλα δείχνουν ότι η κρίση θα συνεχιστεί κατά τη διάρκεια του 2016. Σε αυτές τις συνθήκες σκληρής πλέον οικονομικής κρίσης εκφράζεται η δυσαρέσκεια του λαού. Πρέπει λοιπόν να γίνονται σεβαστά τα δικαιώματα των μειονοτήτων, ιδίως του ρωσικού στοιχείου, όπως επίσης και η βούληση του λαού του Καζαχστάν. Όμως το καθεστώς φιμώνει την ελευθερία του Τύπου, τις οργανώσεις της κοινωνίας των πολιτών, παραβιάζει τα δικαιώματα των εργαζομένων και τις συλλογικές ελευθερίες.

Η Ευρωπαϊκή Ένωση πρέπει να στείλει ένα αποφασιστικό μήνυμα στο Καζαχστάν, το οποίο αποτελεί σημαντικό εμπορικό εταίρο της Ένωσης. Στην Κεντρική Ασία θα πρέπει να υπάρξει σταθερότητα και ανάπτυξη, αυτό όμως περνάει από τον σεβασμό των ανθρωπίνων δικαιωμάτων και την ειρηνική συμβίωση χριστιανών και μουσουλμάνων.

  Fabio Massimo Castaldo (EFDD). Signora Presidente, onorevoli colleghi, come sempre ci troviamo a commentare una gravissima situazione di profonde violazioni dei diritti umani. Trattamenti inumani e degradanti, tortura, negazione sempre più pressante della libertà di espressione, media che vengono di fatto controllati con manovre amministrative, col pretesto della sicurezza nazionale. Per non parlare di molestie e intimidazioni costanti subiti dai giornalisti che, in qualche modo, tentano di continuare a fare il proprio dovere, come accaduto ad esempio al giornale Adam-bol nel dicembre del 2014.

Ormai, il Procuratore generale in Kazakistan ha persino la possibilità di bloccare l'accesso a contenuti Internet se giudicati estremisti e lesivi della sicurezza nazionale, addirittura, senza un pronunciamento giudiziale. È del 2015 l'introduzione nel nuovo codice penale del reato di incitamento alla discordia, con il quale vengono puniti anche i rappresentanti delle ONG, ai quali viene di fatto impedita la possibilità di esplicare il proprio ruolo all'interno della società civile. Questo è il quadro del Kazakistan.

Ora io colleghi vi invito, come sempre, a non utilizzare due pesi e due misure. Come sempre, non dobbiamo permettere che i nostri valori e la difesa dei diritti umani si svendano al metro cubo di gas o al barile di petrolio e spero che ve ne ricordiate in questo come in tanti altri casi. Coerenza!

  Stanislav Polčák (PPE). Paní předsedající, já navážu na pana kolegu Castalda. Skutečně ten nový trestný zákoník, který byl přijat v Kazachstánu, budí velké obavy a velké emoce. Pan kolega zde zmínil jeden aspekt trestných činů, který je zavedený, já bych zmínil druhý. To je omezení svobody sdružování. Kazachstán se zjevně bojí, tamější vládnoucí režim, pokud se lidé budou moci shromažďovat, pokud budou moci demonstrovat. Samozřejmě nezávislá média jsou hlavním znakem svobodného demokratického právního státu, ale svoboda sdružování je rovněž jedním z těch podstatných komponentů právního státu.

Byly zde zmíněny i parlamentní volby. No já mám obavu, jakým způsobem budou parlamentní volby probíhat, když ty prezidentské, které probíhaly, tak kandidáti, kteří byli proti panu Nazarbajovi, sami v kampani říkali, že on je nejlepší kandidát. Je to jenom zdání, které nám bohužel Kazachstán předkládá jako zdání právního státu. Tato idea, tato představa je samozřejmě velmi vzdálená. A je důležité, aby Evropská unie v této věci prostě byla aktivní.

  Johannes Hahn, Member of the Commission. Madam President, the European Union closely follows the human rights situation in Kazakhstan. Freedom of expression should be guaranteed under Kazakhstan’s constitution. It is a matter of international human rights – and we see human dimension commitments – and this is priority for the European Union. The European Union has been at the forefront of calling for an improvement of the situation, and has consistently raised issues related to freedom of expression in its bilateral discussions with Kazakhstan.

The European Union is concerned at the increasing pressure on the independent press. Over the past two years a number of publications have been shut down or have received disproportionate fines. We believe that this not only has an impact on the publications concerned, but also leads others to exercise self-censorship. There are also limitations on freedom of expression online, most recently seen with the arrest and prosecution of a number of bloggers for statements made on social media. We welcome the fact that three of these bloggers were recently released, though we deplore that they were released with restrictions imposed on their movement.

Our concerns focus not only on specific individual cases, but also the legislative framework which provides for criminal sanctions, for defamation, denigration of honour and dignity. In particular, we have urged Kazakhstan to consider revising Article 174 of the Criminal Code, which imposes criminal sanctions for broadly worded offences and has been used to prosecute activists and bloggers. The European Union consistently emphasised the importance of freedom of expression for the development of a democratic society in Kazakhstan throughout the process of negotiating the enhanced partnership and cooperation agreement.

During her visit to Astana on 21 December last year to sign this agreement the Vice-President/High Representative raised with her counterparts the importance of strengthening the resilience of societies through the protection of human rights and fundamental freedoms. The European Union has also been consistent in empowering civil society in Kazakhstan and promoting press freedom and the freedom of expression under the European Instrument for Democracy and Human Rights. The European Union stands ready to work together with all partners concerned in addressing this particular issue.

  Dita Charanzová (ALDE), in writing. The EU-Kazakhstan partnership is gradually growing stronger with the ambition to become a strategic one. In order to achieve this it has to be clear that both sides share the same basic democratic values and principles. Freedom of expression is one of those principles that we have to protect and promote. Cases of imprisonment of opposition politicians such as Vladimir Kozlov, and convictions of journalists and bloggers show that Kazakh authorities must be urged to respect these rights. That is why I support this motion for a resolution.

  Tadeusz Zwiefka (PPE), na piśmie. Kazachstan jest członkiem ONZ, OBWE, Komisji Weneckiej Rady Europy oraz stroną Pogłębionej Umowy o Partnerstwie i Współpracy z UE, która dotyczy nie tylko wymiany handlowej, lecz kładzie też duży nacisk na demokrację, praworządność, ochronę praw podstawowych i niezależność sądownictwa. Bez względu na wszystkie zobowiązania międzynarodowe i standardy, które suwerenne państwo dobrowolnie na siebie przyjęło, poszanowanie demokracji i praw człowieka w Kazachstanie budzi zaniepokojenie społeczności międzynarodowej. Aresztowania dziennikarzy, blogerów i obrońców praw człowieka pozbawionych prawa do rzetelnego procesu naruszają podstawy demokracji. Bez niezależnych mediów nie ma mowy o praworządności. Sytuację polityczną trzeba oceniać na podstawie działań, nie deklaracji rządzących. Już w czerwcu 2008 r. i ponownie w maju 2009 r., w związku z nadchodzącym przewodnictwem Kazachstanu w OBWE, minister spraw zagranicznych tego kraju zobowiązał się do poprawy sytuacji w obszarze ochrony praw człowieka w Kazachstanie. Na przestrzeni 8 lat jedyne, co ulegało zmianie, to nazwiska kolejnych aresztowanych i więźniów politycznych, czego przykładem są rezolucje Parlamentu Europejskiego, raporty organizacji międzynarodowych i relacje prześladowanych obywateli. Czas podjąć realne środki w celu wyegzekwowania deklarowanych reform.
