16. OLAF Uzraudzības komitejas sekretariāts (debates)

President. – The next item is the debate on the report by Ingeborg Gräßle, on behalf of the Committee on Budgetary Control, on the proposal for a regulation of the European Parliament and of the Council amending Regulation (EU, Euratom) No 883/2013, as regards the secretariat of the Supervisory Committee of the European Anti-Fraud Office (OLAF) (COM(2016)0113 – C8-0109/2016 – 2016/0064(COD)) (A8-0188/2016).

  Ingeborg Gräßle, Berichterstatterin. – Frau Präsidentin! Diese kleine Revision der OLAF-Verordnung, mit der wir uns heute Abend beschäftigen, zeigt, dass die Institutionen in Brüssel handlungsfähig sind. Nur zwölf Wochen nach der Vorlage des Kommissionsvorschlags liegt die Änderung fertig ausverhandelt auf dem Tisch. Ich bitte Sie dafür um Zustimmung morgen. Ich danke der Kommission, aber vor allem auch dem Rat und der niederländischen Präsidentschaft, die ihre Effizienz eindrucksvoll unter Beweis gestellt hat – eine prima Leistung und im Rat zur Nachahmung empfohlen!

Die Revision nimmt eine punktuelle, aber ausgesprochen wichtige Änderung an der seit Oktober 2013 geltenden OLAF-Verordnung vor. Das aus acht Mitarbeitern bestehende Sekretariat des Überwachungsausschusses, das bisher Teil des OLAF war, wird nun aus dem Amt herausgelöst und ins Organigramm der Kommission überführt.

Wir hatten also bisher die Situation, dass diejenigen EU-Bediensteten, die den fünf hochrangigen Mitgliedern des Überwachungsausschusses zugearbeitet haben, dem OLAF-Generaldirektor unterstellt waren, also ausgerechnet demjenigen, dessen Amtsführung der Überwachungsausschuss ja eigentlich begleiten soll. Dass dies die Gefahr von Loyalitäts- und Interessenkonflikten barg, kann man sich unschwer vorstellen.

Dieser Mangel ist jetzt behoben, und es steht zu hoffen, dass wir dadurch eine Stärkung der Unabhängigkeit des Überwachungsausschusses erreichen. Das sollte letztlich dazu führen, dass der Überwachungsausschuss künftig seine Aufsichtsfunktion wirksamer ausführen kann.

Damit wir am Ende tatsächlich eine Verbesserung erreichen, kommt es jetzt darauf an, dass dem Ausschuss nicht noch weitere und andere Steine in den Weg gelegt werden. Das Sekretariat muss also wie bisher in den Räumlichkeiten des OLAF untergebracht werden, damit es auch weiterhin Zugang zu den speziell gesicherten Dokumenten des OLAF und zum IT-System hat. Die bisherige Personal- und Mittelausstattung muss ebenfalls beibehalten werden, und es müssen Vorkehrungen getroffen werden, um die im Sekretariat arbeitenden Beamten vor Interessenkonflikten und Nachteilen im weiteren Karriereweg zu schützen. Dazu wird die Kommission morgen auch eine Erklärung abgeben, in der sie all diese Punkte zusichert, und wir werden darüber wachen, dass dies auch in der Praxis so passiert.

Ich möchte Ihnen nicht verhehlen, dass diese Revision gleichzeitig auch der Beweis eines riesigen Fehlschlags ist, denn dass diese Revision notwendig war, zeigt, dass die Macht und die Allmacht des Generaldirektors des OLAF begrenzt werden mussten. Es ist traurig, dass diese Revision mit diesem Inhalt nach 17 Jahren des Bestehens des OLAF nötig war. Ich halte diese Revision für einen eindrucksvollen und traurigen Beleg für mangelnde Professionalität, mangelnde Managementqualitäten und fehlende Fairness dieses Generaldirektors gegenüber seinen Mitarbeitern und seinem Überwachungsorgan.

Es gab immer Probleme mit dieser Überwachung im OLAF, aber so drängend und zugespitzt wie in den vergangenen 24 Monaten, das ist neu. Diese Revision reagiert darauf, und ich bin allen sehr verbunden, dass sie an diesem Strang mitgezogen haben. Wir werden also im Auge behalten müssen, ob die OLAF-Verordnung weiter unterlaufen wird und die Rechte des Überwachungsausschusses ausgehebelt werden.

Dass wir diese Revision vornehmen müssen, ist ein schlechtes Zeichen. Die drängenden Probleme im OLAF und um den Generaldirektor erfordern eigentlich sofortiges Handeln der Kommission, ungeachtet der Klagen zum Immunitätsverfahren und ungeachtet der belgischen Ermittlungen.

Nach der Reform ist vor der Reform. Wir werden uns mit weiteren Revisionen der OLAF-Verordnung – nicht nur in diesem Punkt, sondern auch in weiteren Punkten – befassen müssen, nämlich einer unbedingt erforderlichen Stärkung der Rechte der Verfahrensbeteiligten, um mehr Fairness und auch mehr Klarheit über die Natur der OLAF-Untersuchungen und der administrativen Untersuchungen mit ihrem strafrechtlichen Gehalt zu erhalten und auch darauf Rücksicht zu nehmen, dass die bisherige Waffenverteilung sehr ungleich ist.

  Kristalina Georgieva, Vice-President of the Commission. – Madam President, I would like to thank Ms Gräßle, the rapporteur, most sincerely for the effort she has put into bringing this proposal to the debate tonight. We tabled it on 4 March at the Commission and it is indeed an exceptionally fast development for us, the three institutions, to have reached our common objective. I was with the Supervisory Committee yesterday, and I would like to convey the gratitude of the Chair of the Supervisory Committee and all its members for the action that is being taken with regard to the objective of this proposal, and it will strengthen the independence of OLAF’s Supervisory Committee by very clearly separating the secretariat of the Committee and its budget from the service that they have a mandate to supervise.

I want to stress that the Supervisory Committee has been very active, and the Chair and the members of the Supervisory Committee have been exercising their authority. We do not have material evidence that the independence of the Committee has been undermined, but even the perception of interference in their independence is of course a source of concern. We have listened very carefully to the Members of Parliament and to the members of the Supervisory Committee to make sure that we are coming with a clear solution to what has been perceived as a potential restriction of their independence.

We have already placed the budget of the Supervisory Committee with the Commission’s payment office (PMO), and what we are proposing, to put it in very practical terms, is that we are now attaching the secretariat to the PMO as of the date of application of the amended regulation. This attachment will be of a purely administrative nature in order to facilitate the organisational and budgetary aspects. It will not affect the independent functioning of the secretariat, or of the committee, nor their current budget and staffing. To be sure that this is entirely clarified, it has been agreed that the Commission will make a statement to this end tomorrow, ahead of the vote on this proposal. So again, I would like to express the determination of the Commission to do everything we can for an institution as important as OLAF and its Supervisory Committee to be entirely supported in undertaking their work independently.

  Petri Sarvamaa, on behalf of the PPE Group. – Madam President, I would like first of all to welcome the Commission’s common sense and the rapporteurs’ steam and guts to uphold what might at first glance appear only rational, but with a closer look turns out to be a strange fight against something that we simply should not have to fight against in the first place.

The important role of the European Anti-Fraud Office (OLAF) Supervisory Committee is to regularly monitor the implementation of OLAF’s investigative function. In order to fulfil this responsibility, the Supervisory Committee needs a well-functioning Secretariat. And as the Committee, also its Secretariat must be independent from OLAF; therefore, appropriate financing should be guaranteed directly by the Commission, separately from OLAF’s budget. All this is rather clear to me – and it is good that the Commission thinks alike on this matter.

But as regards the issue of whether the Secretariat should be physically in or out of the same building where the Supervisory Committee and OLAF itself are located, let me be as clear as possible: what we are dealing with here is a very serious matter inside the Union. To move the Secretariat out of the building, using artificial argumentation, is another worrying signal of the state of affairs at OLAF. OLAF is supposed to be – and only to be – concentrating on activities investigating fraud inside the European Union or in the use of the Union resources. It should not be concentrating on issues like this.

The effective functioning of the Committee requires constant contacts with the offices of OLAF. Therefore, it is essential that the Secretariat is placed in OLAF premises. Congratulations to the rapporteur for making sure this common sense prevails.

  Inés Ayala Sender, en nombre del Grupo S&D. – Señora Presidenta, deseo también expresar mi satisfacción por la rápida modificación del texto del Reglamento, que intenta subsanar parte de un problema mucho más complejo y amplio y que tiene que ver con las complicadas relaciones entre la OLAF y su Comité de Vigilancia, tensión que, siendo históricamente lógica y que hemos vivido hace ya años también en este Pleno, se ha visto agravada últimamente por implicaciones personales y profesionales y querellas varias, que han llevado a una situación de tal gravedad que se ha llegado incluso a plantear la suspensión de la inmunidad del director de la OLAF, algo que veremos cómo evoluciona.

Yo quería también plantear que espero que, una vez recuperada esta independencia, el Comité de Vigilancia sea capaz de volver a dedicarse a aquello para lo que tiene mandato: defender la independencia de la OLAF con respecto a la Comisión y a cualquiera de las otras instituciones, respetar escrupulosamente las recomendaciones del Supervisor Europeo de Protección de Datos —cosa que últimamente no había sido tan especial— y proteger las garantías procesales de aquellas personas que están bajo investigación de la OLAF.

Deseo expresar también mi reserva sobre cómo, con esta solución rápida —que en eso me parece positiva, la rapidez intentando solucionar un problema enquistado—, vamos a otorgar a la secretaría del Comité de Vigilancia un nuevo estatus en unas dependencias de la Comisión y, al mismo tiempo, una independencia tal que mi pregunta a la señora Vicepresidenta sería de qué manera y ante quiénes van a ser ahora responsables los miembros del Comité de Vigilancia, porque entiendo que, dado su mandato, es muy importante que tengamos claro con qué periodicidad y ante quiénes van a rendir cuentas y cuál va a ser su marco de actuación una vez que tienen una nueva ubicación dentro de la Comisión.

  Jonathan Arnott, on behalf of the EFDD Group. – Madam President, it is of course absolutely right and fundamental that the Anti—Fraud Office should always be impartial. It is of course something which must have the greatest possible credibility. Therefore, it is right that it must be independent and that its secretariat must be independent. For once in this place, I have to say that the committee amendments seem to have the most positive intention: to try to make sure that it is absolutely clear that it must be so, and to say that the Commission shall not interfere with the monitoring functions of the Supervisory Committee. So I think there is a lot that is positive in that. Whether or not that goes far enough, and whether or not we can be absolutely crystal clear about independence and no interference, of that I am not quite so sure.

  Gilles Lebreton, au nom du groupe ENF. – Madame la Présidente, l'Office de lutte antifraude, l'OLAF, a été créé suite au scandale qui a provoqué la chute de la Commission de Bruxelles, il y a 17 ans. Il était censé moraliser l'Union européenne en luttant contre la fraude et la corruption. C'est complètement raté! L'OLAF a porté atteinte, à de multiples reprises, aux droits de la défense et à la présomption d'innocence. Récemment, l'immunité diplomatique de son directeur a d'ailleurs été levée à la demande de la justice belge.

Un comité de surveillance, composé de cinq personnalités indépendantes, est certes chargé de contrôler l'OLAF, mais il n'a pas pu, jusqu'à présent, exercer son rôle pour deux raisons: d'abord parce qu'il est dépendant de l'OLAF, qui gère son budget, ensuite parce que le directeur de l'OLAF refuse de le laisser accéder à ses données, ce qui est scandaleux.

Je me réjouis donc qu'un texte nous propose aujourd'hui d'améliorer l'indépendance du comité de surveillance, mais j'estime qu'il faudrait aller plus loin. L'OLAF a perdu toute crédibilité en multipliant les persécutions et les abus de pouvoir. En conséquence, il faudrait le supprimer, quitte à le remplacer par un nouvel organisme, pour repartir sur des bases saines.

  Janusz Korwin-Mikke (NI). – Szanowna pani komisarz raczy sobie chyba żartować. Myśmy rok temu podjęli decyzję, przyjęliśmy rezolucję, w której domagaliśmy się między innymi powołania prokuratury europejskiej, co miało być zrobione trzy lata temu. OLAF sam nie może prowadzić śledztw. OLAF-owi nie wolno kontrolować komisarzy, a wróble na dachu ćwierkają o gigantycznych nadużyciach wśród komisarzy. Mamy sytuację, w której praca OLAF-u jest sparaliżowana, w której szef OLAF-u ma oskarżenia i miał zdjęty immunitet – w tej chwili nie wiadomo, czy ma zdjęty, czy nie – w której komisarz OLAF-u oskarża trzech komisarzy, dziwnym trafem akurat niesocjalistów, ale podobno w zanadrzu trzyma oskarżenia również przeciwko innym. I pani mówi, że pani w marcu zabrała się za kontrolę tej sytuacji. Zajmujemy się problemem, czy sekretariat ma być w tym samym budynku, czy nie. W momencie kiedy komitet nadzoru ma być wymieniany etapami, Komisja usiłuje zmienić cały komitet nadzoru, oczywiście wbrew założeniom. Sytuacja wymaga radykalnych działań, a nie dyskusji nad miejscem powołania sekretariatu.

  Tomáš Zdechovský (PPE). – Paní předsedající, asi bych se opakoval, protože přede mnou měli řeč excelentní řečníci, jako jsou paní Grässleová, paní Sanderová a pan Sarvamaa, kteří řekli vlastně všechno, co jsem chtěl říct já. Nicméně, paní komisařko, si dovolím zdůraznit, že transparentnost a integrita jsou naší společnou prioritou. Jak vaší, tak i EP.

A proto je nesmírně důležité, abychom disponovali nezávislými kontrolními orgány, které zajistí objektivní vyšetřování potencionálních podezření z podvodů a korupce. Takovým orgánem je právě OLAF a k zajištění jeho maximální nestrannosti je třeba zaručit, aby i jeho dozorčí orgán byl skutečně nezávislý a dokázal zakročit v momentě, kdy by došlo k jakémukoliv podezření v samotném úřadu OLAF.

A proto je pro nás důležitá funkce dozorčího výboru úřadu OLAF a jeho sekretariátu. Ten musí být absolutně nezávislý na vedení úřadu OLAF, aby zaručil tuto nezávislost a transparentnost.

  Julia Pitera (PPE). – Pani Przewodnicząca! Parlament Europejski wielokrotnie wzywał Komisję do wprowadzenia regulacji zwiększającej niezależność funkcjonowania sekretariatu Komitetu Nadzoru OLAF. Dotychczasowe zasady organizacyjne budziły uzasadnione obawy co do możliwości występowania konfliktu interesów. Jest to oczywiste w sytuacji, gdy organ nadzorujący jest powiązany finansowo i kadrowo z instytucją nadzorowaną. Niejednokrotnie budziło to wątpliwości, czy członkowie Komitetu Nadzoru mogą prawidłowo wykonywać swoje obowiązki. Zmiana rozporządzenia była więc pilnie potrzebna, by uniknąć podejrzeń, że OLAF mógłby negatywnie wpływać na funkcjonowanie Komitetu Nadzoru. Przesunięcie środków sekretariatu Komitetu Nadzoru z linii budżetowej i planu zatrudnienia OLAF-u do linii budżetowej i planu zatrudnienia Komisji Europejskiej pozwolą na osiągnięcie takiej niezależności. Dlatego chciałabym podziękować pani komisarz Georgievej za wysłuchanie głosu Parlamentu.

Catch-the-eye procedure

  Jiří Pospíšil (PPE). – Paní předsedající, já jsem velmi pozorně poslouchal tuto debatu, protože musím říci, že my třeba v České republice velmi vnímáme nezávislost úřadu OLAF. Není to pouze teoretická věc, ale v České republice například nyní je řešena kauza vicepremiéra Babiše, jehož možné střety s právními předpisy právě prošetřuje úřad OLAF.

A pro nás je důležité, aby právě tento orgán byl maximálně nezávislý a měl maximální autoritu tak, aby česká veřejnost následně rozhodnutí úřadu OLAF v kauze vicepremiéra Babiše přijala, protože tato kauza, marná snaha, bude ovlivňovat a ovlivňuje politický vývoj a politickou stabilitu v České republice. Proto chci poděkovat jak paní zpravodajce, tak paní komisařce, že tomuto tématu věnují takovouto pozornost, a za své voliče říkám, není to u nás pouze teoretický problém míry nezávislosti, ale je to velmi důležitá praktická věc, která v České republice bude mít konkrétní politické dopady.

  Νότης Μαριάς ( ECR). – Κυρία Πρόεδρε, η OLAF είναι κρίσιμη υπηρεσία για την Ευρωπαϊκή Ένωση και γι’ αυτό θα πρέπει να λειτουργεί με πλήρη διαφάνεια. Έτσι, η Επιτροπή Εποπτείας της OLAF, καθώς και η Γραμματεία της πρέπει επιτέλους να αποκτήσουν αυξημένη ανεξαρτησία, προκειμένου να αποφεύγεται κάθε σύγκρουση συμφερόντων. Ταυτόχρονα, η OLAF ως ειδική Ευρωπαϊκή Υπηρεσία Καταπολέμησης της Απάτης θα πρέπει να συνδυάσει τη διαφάνεια με την αποτελεσματικότητα, στην καταπολέμηση της φοροδιαφυγής.

Άλλωστε, το σύνολο των παρατυπιών που αναφέρθηκαν για το 2014 ανέρχεται περίπου σε 3,24 δισεκατομμύρια ευρώ, ενώ ο δημοσιονομικός αντίκτυπος των παρατυπιών που δηλώθηκαν είναι κατά 36% μεγαλύτερος σε σχέση με το 2013, γεγονός που δείχνει ότι η OLAF δεν έχει κάνει τίποτε για να συμβάλλει στην πάταξη της φοροδιαφυγής των πολυεθνικών εταιρειών. Επομένως, εκτός από την ανεξαρτησία της Επιτροπής Εποπτείας και της Γραμματείας της, αυτό που προέχει είναι η OLAF να αποκτήσει έναν πιο ενεργό ρόλο για την καταπολέμηση της φοροδιαφυγής των πολυεθνικών, καθώς και κάθε παράνομης δραστηριότητας που λαμβάνει χώρα στην Ευρωπαϊκή Ένωση.

  Kristalina Georgieva, Vice-President of the Commission. – Madam President, thank you very much for the comments and views expressed. There have been questions directed to the Commission.

First on the Secretariat, whether it will continue to be located in the OLAF building: I want to confirm that, yes, the Secretariat will be located within the buildings that are hosting OLAF and there would be full access to information provided.

Secondly, there was a question, or rather a concern expressed, that maybe the Secretariat will be absorbed in the Commission, and I just want to be very clear that we have taken seriously the question of proper allocation. We have looked at a number of possibilities from our human resources services to the Secretariat General to the PMO, and we have chosen the Paymaster’s Office because it is an office with no policy obligations whatsoever. It is a very good home for the administrative purpose of providing an assignment for the Secretariat where the budget line can be apostate and where people can be accommodated without any interference in the work of the Secretariat. The head of the Secretariat is in charge, and when we looked across the services we thought that this is the most neutral, non-interfering place we can possibly find, and this is why we have decided on it.

There was a comment made that the location of the Secretariat is important, but much more important is the composition of the Supervisory Committee, and there was a call that there has to be renewal or replacement in the Supervisory Committee. Just to share, as Mrs Grässle knows very well, that we have taken this task of identifying the future members of the Supervisory Committee very seriously from the three institutions. We have recently assembled to agree on five new members that would step into their functions as the mandate of the current members expires, plus a reserve list of seven – all very qualified individuals. So we feel that now we are in a very good place institutionally to have a supervisory committee that is fully competent to carry out the job that is trusted to them.

We have not been much concerned on this question of how this transition is going to take place because we have the confidence that the people that are being put immediately on the list of five and on the reserve list can, each and every one of them, dutifully serve, and in the next days this process of selection should be finalised with the good contribution of all three institutions.

COMMISSION'S STATEMENT

"The Commission is fully committed to the independent functioning of the Secretariat of the OLAF Supervisory Committee. The main purpose of the proposed amendment to the OLAF Regulation (EU, Euratom) No 883/2013 is to add further guarantees to the independence of the Secretariat. The implementation of the amended Regulation will be guided by this aim.

As confirmed by Vice-President Georgieva to the Chairman of the Supervisory Committee by letter of 20 May 2016, the Commission intends to attach the Secretariat of that Committee, as of the date of application of the amended Regulation, to PMO. This attachment will be of a purely administrative nature, with a view to facilitating certain organisational and budgetary aspects. It will not affect the independent functioning of the Secretariat.

As also mentioned in that letter, the administrative attachment of the Secretariat to PMO will have no impact on its current staffing and budgetary means. The Head of the Secretariat will be in charge of the management and appraisal of his staff. The appraisal of the Head of the Secretariat will be based on a report of the Supervisory Committee.

The Commission will consider, after consulting the Supervisory Committee, putting in place appropriate internal rules on mobility limiting the duration of the postings of the Secretariat, while ensuring continuity in order to render their independence effective, and avoid risks of conflicts of interests or of revolving doors issues with OLAF.

The modification of the Regulation does not affect the access of the Supervisory Committee to information such as that contained in OLAF's IT systems, databases and documents.

The offices of the staff of the secretariat of the Supervisory Committee will be maintained within the building currently housing OLAF, protecting the independence of the Supervisory Committee and of OLAF while ensuring ease of contact."

  Ingeborg Gräßle, Berichterstatterin. – Frau Präsidentin! Vielen Dank auch allen Kolleginnen und Kollegen, die Anmerkungen gemacht haben. Sie haben ja alle so ein bisschen Recht. In der Tat handelt es sich um ein komplexes Problem, und Frau Vizepräsidentin, Sie sind die erste Kommissarin, die wirklich ein Problem jetzt gelöst hat, zumindest versucht, es zu lösen.

Wir haben versucht, es zu lösen, und man darf nicht vergessen: Heute ist ein wichtiger Neustart in den Beziehungen, in den Möglichkeiten des Überwachungsausschusses, und dieser Neustart wird mit allem, was wir dann auch noch zusätzlich unternommen haben, doch hoffentlich auch den richtigen Weg gehen und die richtigen Lösungen bringen. Ich möchte hier aufgreifen, was die Kollegin Ayala gesagt hat: Wem ist der Überwachungsausschuss verantwortlich? Ja, uns! Wir sind seine Interessenträger, wir sind diejenigen, die natürlich auch schauen müssen, dass er arbeiten kann und dass er auch das Richtige tut. Deswegen wird, eine gute und eine vertrauensvolle Beziehung zum Parlament, zum Rat und zur Kommission immer auch notwendig sein.

Man könnte ja, wenn man die Schwierigkeiten sieht, durchaus in philosophisches Nachdenken verfallen. Ich glaube, dass wir jetzt weitermachen müssen bei der Frage, wie wir das Amt gut aufstellen und wie wir vorhandene Rechtslücken füllen. Zu dieser Rechtslücke gehört sicherlich auch der Zugang des Überwachungsausschusses zu den Dokumenten und ganz sicher auch die Aushändigung des Abschlussberichtes an Personen unter OLAF-Untersuchungen. Sie müssen den Abschlussbericht bekommen, weil es rechtsstaatlich ein Unding ist, dass Anschuldigungen erhoben wurden, gegen die sich Menschen nicht wehren können. Da habe ich in den letzten Jahren auch wirklich etwas dazugelernt. Ich glaube, dass wir einige Erfahrungen, die wir jetzt gemacht haben, für die kommende Reform der OLAF-Verordnung wirklich auch aufgreifen müssen, die große Chance jetzt auch mit dem Europäischen Staatsanwalt und einer Neuaufstellung, und hoffentlich auch einer institutionellen Neuaufstellung auch des OLAF im Zusammenhang mit dem Europäischen Staatsanwalt.

Ich habe nicht die Hoffnung, dass sich einige Mängel von selbst erledigen. Aber wir wissen genau, in welche Richtung wir gehen müssen, um eine wirkliche Lösung zu erreichen.

  Birgit Collin-Langen (PPE), schriftlich. – Ich unterstütze den Bericht und die Änderung in der OLAF-Verordnung. Um Interessenkonflikten vorzubeugen und die Unabhängigkeit zu gewährleisten, ist es angezeigt, das Sekretariat des Überwachungsausschusses in die Zuständigkeit der Kommission zu überführen. Es handelt sich hier nur um eine kleine Änderung an der OLAF-Verordnung, die aber von großer Bedeutung ist.
