  Πρόεδρος. – Το επόμενο σημείο στην ημερήσια διάταξη είναι η συζήτηση επί της έκθεσης της Renate Weber , εξ ονόματος Επιτροπής Απασχόλησης και Κοινωνικών Υποθέσεων, σχετικά με την εφαρμογή της οδηγίας 2000/78/ΕΚ του Συμβουλίου, της 27ης Νοεμβρίου 2000, για τη διαμόρφωση γενικού πλαισίου για την ίση μεταχείριση στην απασχόληση και την εργασία («οδηγία για την ισότητα στην απασχόληση») (2015/2116(INI)) (A8-0225/2016).

  Renate Weber, rapporteur. – Mr President, I would like to start by thanking the shadow rapporteurs not only for their sound and constructive contribution to this report, but mainly for their genuine commitment and work for the protection of human rights and for combating discrimination.

In 2000, I was part of a human rights organisation network that advocated for the adoption of anti-discrimination legislation at the EU level. When the two equality directives were adopted we considered it an historical moment, because discriminating against other human beings is one of the most despicable behaviours one could imagine. Sixteen years later, I have the privilege as a Member of this European Parliament to evaluate how the Employment Equality Directive has been implemented. In 2000, a duty was imposed on our Member States to provide protection against discrimination in the areas of employment and occupational and vocational training.

It comes as no surprise that, while some Member States have gone beyond its requirement by extending protection against discrimination to other areas, including access to goods and services, others are still pretty far from implementing it at the minimum level. The report highlights the necessity of collecting equality data both at the level of Member States and the European Union in order to make it easier to prove the existence of discrimination and, particularly, indirect discrimination. There is quite a discrepancy between the levels of discrimination experienced and discrimination reported.

Awareness-raising, with the help of equality bodies and the social partners, is of utmost importance at all levels of society considering that the victims themselves still have difficulty in recognising discrimination, let alone fighting it. I cannot stress enough the role of equality bodies in awareness-raising and data election in helping the victims but also the employers to understand how to change their policies in line with equality requirements. The impartiality of such bodies must be ensured and their activity supported, including through adequate funding.

I particularly want to emphasise the issue of multiple discrimination, which is often a consequence of the existence of fragmented rules and standards across Member States. If it is difficult for the victims of one type of discrimination to understand the situation and act, we can easily imagine their difficulties when they face multiple discrimination.

It is important to note that access to justice is still limited in many discrimination cases, and the report strongly recommends that the Member States ensure that victims can obtain accessible legal advice and assistance at all stages of the legal process, including confidential counselling in person by equality bodies or appropriate intermediaries. Legal redress is not only important for the victims, but it also has an educational impact on society because pursuing court cases and ensuring adequate representation are still problematic in some cases.

We asked the Member States to find ways to help victims including, for example, by means of court tax exemptions or reductions or legal aid and assistance from specialised NGOs. In fact, it is important to recognise the legal standing of NGOs with a legitimate interest in the relevant judicial or administrative procedures. Sharing good practices among Member States is a must. Acknowledging the importance of fighting all forms of discrimination, I truly hope that this House will adopt this report with a large majority.

  Marianne Thyssen, Member of the Commission. – Mr President, honourable Members, I would like to start by thanking the rapporteur, Ms Weber, who prepared this comprehensive assessment of the application of the Employment Equality Directive. Discrimination on whatever grounds has no place in the Union. Therefore, the Commission is strongly committed to ensuring that non-discrimination directives are effectively implemented, so as to foster a fairer and more inclusive society, including labour markets providing opportunities to all.

The draft outline of the European Pillar of Social Rights specifies that ‘labour market participation of under-represented groups shall be enhanced, ensuring equal treatment in all areas, including by raising awareness and addressing discrimination’. We cannot deny that recent statistics raised certain concerns. According to the 2015 Eurobarometer Survey on discrimination, there is at least a widespread perception of discrimination in the European Union. 64% of the respondents were concerned about discrimination on the grounds of ethnic origin, 58% for sexual orientation, 50% for disability and the same percentage for religious belief. However, we see positive developments. The survey shows, for example, that citizens are increasingly aware of their rights in this area, which is the first critical step in order to improve their enforcement. Our joint implementation report from 2014 on the Race and Employment Equality Directives concluded that they were correctly transposed by Member States. The report also pointed to the necessity of combining existing legislation with appropriate policy action by improving, specifically, awareness of rights, and indeed access to justice. Your report rightly highlights, among others, all these aspects. The Commission is committed to make full use of the Directive on many fronts. Let me mention just a few examples.

Firstly, we promote analysis and research on the situation across Member States through the yearly comparative report on anti-discrimination in Europe referred to in your report; through the report on sexual orientation-based discrimination; through the report on reasonable accommodation for disabled people in the employment context in the European Union; through the report on intersexual discrimination in EU gender-equality and non-discrimination law; and through the ongoing study on equality data collection. We are fully aware that producing these reports is in itself not a solution, but understanding patterns of discrimination is crucial for informed policy-making and enforcement.

Secondly, the High Level Group on Non-discrimination, Equality and Diversity facilitates the exchange of best practices. To improve awareness of rights and access to justice, we support the strengthening of the national equality bodies. We have run training, seminars and conferences such as the 2015 Colloquium on Fundamental Rights, which focused on tolerance and respect, preventing and combating anti-Semitic and anti-Muslim hatred in Europe, and the seminar focusing on multiple discrimination. Moreover, we collaborate and support various organisations active in the field of anti-discrimination – the Academy of European law, the European Union Fundamental Rights Agency and Equinet, the well-known network of national equality bodies for the promotion of equal treatment.

Thirdly, in the legislative field, the 2008 proposal for an equal treatment directive aims at extending the prohibition of discrimination on the grounds of religion or belief, disability, age or sexual orientation into areas not yet covered, among others the areas of social protection, social advantages, education, and access to and supply of goods and services. It would thus align the protection to that provided on the grounds of race. Directives prohibiting discrimination on grounds of sex do not cover social protection, social advantages and education, as you know. I trust the proposal will be adopted soon by the Council.

We have also achieved progress in the discussions on the proposed Directive for a European Accessibility Act, both in Council and in Parliament. Accessibility is a catalyst for the full and equal participation of people with disabilities in society. I would like in this context also to mention the intense work in relation to the United Nations Convention on the Rights of Persons with Disabilities, and the forthcoming review of the European Disability Strategy.

Last but not least, in 2015 we proposed a full list of actions to advance on LGBTI. Let us not forget our European Court of Justice, that also plays an important role in clarifying the scope of European anti-discrimination law. For example, we are currently expecting important rulings on two pending cases relating to dismissals of female workers wearing Islamic headscarves in private firms.

Lastly, I want to stress that inclusive labour markets can only be achieved through a partnership approach involving all stakeholders. Public authorities can help people gain skills to get jobs and contribute to growth. Companies can commit to diversity and, as a result of diversity, benefit from enhanced productivity, innovation and performance. Trade unions, NGOs and academia can contribute valuable insights and help in spreading best practices on diversity and non-discrimination. Thank you for your attention.

  Helga Stevens, rapporteur voor advies van LIBE. – Uit dit verslag blijkt dat er 16 jaar na de goedkeuring van de EU-richtlijn gelijke behandeling in arbeid en beroep nog veel werk aan de winkel is. Er is zeker vooruitgang geboekt, maar personen met een beperking blijven nog zwaar ondervertegenwoordigd op de arbeidsmarkt. Minder dan 50 procent heeft een job, tegenover 70 procent voor personen zonder beperking. Een brede, allesomvattende aanpak blijft dus nodig op alle domeinen, met gebruik van het concept van redelijke aanpassingen. Hierbij dient erover gewaakt te worden dat ook personen met een beperking kunnen genieten van vrij verkeer van personen, wat nu vaak niet het geval is. Werknemers met een beperking worden bijvoorbeeld vaak geconfronteerd met allerlei belemmeringen, ook administratieve, waarmee werknemers zonder handicap niet worden geconfronteerd. Onaanvaardbaar toch! Tot slot ben ik blij dat in het verslag wordt verwezen naar het VN-Verdrag voor de rechten van personen met een handicap, het enige algemene mensenrechtenverdrag dat de Europese Unie tot dusver heeft geratificeerd.

  Michaela Šojdrová, navrhovatelka Výboru pro práva žen a rovnost pohlaví. – Pane předsedající, dovolte mi, abych poděkovala, paní poslankyni Weberové za její práci na zprávě. Společně se shodujeme na tom, že diskriminace v zaměstnání je problém, který musí být dál aktivně řešen, a musíme usilovat o zlepšení v této oblasti.

Byla jsem předkladatelkou stanoviska Výboru pro práva žen a v něm jsme poukázali na problém nepřímé a vícenásobné diskriminace žen. Také jsme konstatovali, že je třeba zabývat se otázkou znevýhodněného postavení žen, které souvisí s jejich mateřstvím. Za práci žen v domácnosti a jejich péči o děti musíme ženy ocenit a umožnit jim návrat do práce, pokud to bude jejich volba.

Zprávu jako celek vítám, mám k ní ale některé výhrady. Spíše je třeba důsledně aplikovat stávající legislativu, než předkládat nové směrnice. Za velmi problematickou snahu považuji také harmonizaci etických otázek, případně kritiku členských států, které přistupují k zákazu nošení náboženských symbolů na pracovišti. V těchto otázkách bychom měli respektovat subsidiaritu a nechat členské státy, aby tyto otázky řešily ve své působnosti. Prosazování rovného zacházení v zaměstnávání je tedy úkol, který trvá a který musíme dále podporovat.

Két dologban mindenféleképpen egyetértünk, de egy kérdésem is lenne: az egyik az az, amit Ön is említett, hogy tényleg egy jó jelentéssel állunk szemben, a másik pedig az, hogy hát a tagországoknak bizony, a tagországi kormányoknak még bőven-bőven van teendőjük, különösen néhánynak, amely úgy lemaradt ebben az egész folyamatban.

Kérdésem viszont, hogy Ön úgy érzi-e, hogy a mostani akár tagállami, akár európai uniós intézményi intézkedések lehetővé teszik-e elégséges módon azt, hogy a gyerekek, a fogyatékos gyerekek már felnövésük időszakában a szüleikkel együtt tudjanak készülni a nehéz jövőre?

  Vilija Blinkevičiūtė, S&D frakcijos vardu. – Ačiū Pirmininke. Pirmiausiai dėkoju pranešėjai Renate Weber už gerą pranešimą ir už mūsų bendradarbiavimą. Iš tikrųjų ši direktyva turi įtakos kiekvieno iš mūsų Europos Sąjungos, kiekvienam iš mūsų Europos Sąjungos piliečių – tiek jaunam, tiek vyresniam, tiek neįgaliam, tiek vyrui ar moteriai. Ypač svarbu suvokti, kad dėl Europoje vykstančių demografinių pokyčių, taip pat dėl pensinio amžiaus ilginimo, vyresnio amžiaus žmonių diskriminacijos dėl amžiaus klausimas užimtumo srityje tampa vis aktualesnis. Todėl, jei jau mes priimame sprendimus valstybėse narėse ilginti pensinį amžių, tai privalome mūsų senjorams užtikrinti visas įmanomas galimybes likti darbo rinkoje kaip pilnaverčiams darbuotojams. Taip pat noriu paraginti valstybes nares užtikrinti vyresnio amžiaus darbuotojų apsaugą nuo nesąžiningo atleidimo pensinio amžiaus atveju, nes vyresnių darbuotojų teisės iš tikrųjų neretai valstybėse yra pažeidinėjamos. Kita, į ką noriu atkreipti dėmesį – tai, kad mes vis dar nesugebame nuo diskriminacijos apsaugoti labiausiai pažeidžiamų visuomenės narių – žmonių su negalia. Kai kurios valstybės narės iš tikrųjų pažeidžia šią direktyvą nes nesugeba pritaikyti neįgaliesiems darbo vietų, nesuteikia tinkamo gyvenimo ir kokybiškų darbo sąlygų, neužtikrina lygių galimybių į švietimą ir į profesinį mokymą. Todėl vėl turime raginti valstybes nares pasinaudoti ir struktūriniais fondais, kad būtų pritaikytos darbo vietos bei suteikiama reikiama pagalba neįgaliesiems darbo vietoje. Taip pat turime spręsti priekabiavimo darbe problemą, kuri gali kilti dėl įvairių priežasčių – ir dėl lyties, ir dėl amžiaus, dėl religinių įsitikinimų, kuris žeidžia žmogaus orumą, kuris žemina, ir galiausiai darbuotojui iš tikrųjų sunku dirbti tokioje darbo aplinkoje. Todėl manau, kad labai svarbu skleisti informaciją ir daryti informacines kampanijas žmonėms dėl jų teisių ir galimybių darbe ir darbo rinkoje, bei dėl darbdavių atsakomybės darbuotojų atžvilgiu. Daugelis mūsų piliečių net nežino, kokios teisės yra numatomos šioje direktyvoje. Ačiū!

  Ulrike Trebesius, im Namen der ECR-Fraktion. – Herr Präsident! Die EKR unterstützt Maßnahmen, die sich gegen Diskriminierung am Arbeitsplatz richten. Es ist uns aber auch ein zentrales Anliegen, dass unsere Wirtschaft nicht mit Verordnungen überzogen wird, die am Ende Arbeitsplätze kosten könnten. Ich bin deshalb besonders froh, dass der Bericht einen Bezug zur Vereinbarung über bessere Rechtsetzung herstellt. Wie bei jedem legislativen Papier müssen wir sicherstellen, dass die Ziele erreicht werden und keine unerwünschten Nebeneffekte entstehen. Diskriminierung sollte nicht nur am Arbeitsplatz bekämpft werden. Da der Ministerrat sich aber nicht auf einen Kompromiss einigen konnte, sollten wir die Antidiskriminierungsrichtlinie überarbeiten und verschlanken.

Zwei Anmerkungen zum Schluss: Die EKR wird die Sozialklauseln im öffentlichen Beschaffungswesen nicht unterstützen, ebenso wenig die dringende Einführung einer Richtlinie zum Mutterschutz auf EU—Ebene. Das gehört nach wie vor in die Hände der Nationalstaaten.

  Marian Harkin, on behalf of the ALDE Group. – Mr President, this report by my colleague Renate Weber is a comprehensive and well-balanced assessment on the challenges we face in ensuring equal treatment in employment. Some of these challenges were already articulated by Commissioner Thyssen earlier. This report deals with core issues such as disability, age, religion and belief and sexual orientation, but it also looks at the horizontal aspects which underpin them.

Some of the issues are more straightforward and can be measured more easily. These include, for example, the provision of reasonable accommodation for people with disabilities, the use of universal design in public places, the inclusion of social clauses in public procurement procedures, the need to conduct a review of upper age limits for certain jobs and act on them, and also the need for Member States to work towards ensuring mutual recognition of partnership status, matrimonial regimes and parenting rights. But, equally, some issues are very difficult and very sensitive. Some have a significant impact at national level sometimes because of culture, history or more recent events. All I would say on that aspect is that, when you justify discrimination in the area of employment on those issues, you open a Pandora’s box.

  Rina Ronja Kari, for GUE/NGL-Gruppen. – Hr. formand! Først og fremmest vil jeg gerne sige tak til ordføreren for en rigtig god betænkning. Betænkningen tager jo fat i et vigtigt emne, som berører os alle sammen. Nemlig spørgsmålet om at skabe et mangfoldigt arbejdsmarked, der henvender sig til alle uanset køn, seksuel orientering, alder, etnicitet, social oprindelse, religion eller handicap. For mig at se skal handling på ligestillings- og ligebehandlingsområdet ses som et opgør med den forskelsbehandling, som alt for mange mennesker oplever. Hvis vi bare ser på kvindernes situation på arbejdsmarkedet, så ser vi alt for store forskelle i lønninger og ansættelsesvilkår på trods af, at de har samme uddannelse og arbejdsopgaver som deres mandlige kollegaer. På samme måde kæmper vores minoritetsgrupper i samfundet mod fordomme, ja også ofte mod uvidenhed, blandt mulige chefer og fremtidige kollegaer. Det gør deres vej ind på arbejdsmarkedet alt for besværlig og nogle gange næsten umulig. Vores samfund har brug for at tilpasse sig nutidens kulturelle miljøer for at kunne gøre op med forskelsbehandling, som der stadig er alt for mange, der oplever. Vi skal sætte medlemsstaterne fri af de økonomiske nedskæringspolitikker, vi skal give dem mulighed for at investere i flere arbejdspladser og i bedre arbejdspladser. Vi skal betragte indsatsen imod forskelsbehandling som en investering i fremtiden for hele samfundet. Det er ikke et individuelt problem, men en kollektiv opgave.

  Tatjana Ždanoka, on behalf of the Verts/ALE Group. – Mr President, I would like to congratulate Renate Weber on this report. The Green/EFA Group fully supports the call addressed to the Council to break the deadlock and speed up the adoption of the EU horizontal anti-discrimination directive. At the present time the extension of the existing anti—discrimination legislation, and the enforcement of its consistent application, should be viewed as an important element in the prevention of radicalisation.

Council Directive 2000/78/EC makes it possible to introduce positive action in respect of groups suffering from severe and structural discrimination, a possibility not fully used by Member States.

I also want to underline and support the recommendation on the adoption of a European framework for national strategies to combat anti-Semitism and Islamophobia. I would like to add here that Russophobia is a further phenomenon that has appeared recently.

  Laura Agea, a nome del gruppo EFDD. – Signor Presidente, onorevoli colleghi, ringrazio la collega Weber per questo lavoro. La direttiva nasce 16 anni fa e, a prescindere da qual è lo stato di implementazione fatto in questi anni, ritengo che il lavoro che è stato fatto sia fondamentale, perché nell'arco di questo periodo i problemi strutturali degli Stati membri hanno creato nuove disuguaglianze.

Abbiamo nuove fasce di popolazione, soprattutto all'interno del mercato del lavoro, che subiscono disuguaglianze. Sono, per esempio, le persone a cui è stato imposto un innalzamento dell'età pensionabile e che in qualche maniera subiscono una discriminazione perché non hanno le competenze adeguate per adattarsi al cambio del mercato del lavoro, così come quelle persone che, vittime della crisi economica, hanno perso il posto di lavoro in un'età in cui è complicatissimo ricollocarsi all'interno del mercato del lavoro, quindi è importante.

Ritengo che sia importante la tutela delle persone che denunciano la discriminazione che subiscono sul luogo di lavoro, così come la necessità di un'assistenza garantita quando lo fanno, come intento educativo. E soprattutto rivolgo un invito: le nostre Costituzioni – credo tutte, la mia in particolare lo fa all'articolo 3 – ricordano che è compito dello Stato rimuovere tutti gli ostacoli di qualunque natura che generano disuguaglianza e impediscono la libertà. Quindi a volte occorre fare un passo indietro, verso quello che era, per fare passi avanti oggi.

  Dominique Bilde, au nom du groupe ENF. – Monsieur le Président, je tiens tout d'abord à remercier Mme le rapporteur, qui insiste, dans son exposé des motifs, sur le fait que, dans l'Union, doivent régner le pluralisme et la non-discrimination, notamment fondée sur les convictions. J'espère que ce rappel sera entendu par certains de mes collègues qui, parfois, pratiquent ce genre d'exclusion ici, au sein du Parlement européen.

Comment? Des exemples? Récemment, j'ai été prise à partie dans ma commission de la culture et de l'éducation, où on a interdit à tous les groupes de soutenir mes amendements parce que je faisais partie de ce groupe justement, et j'estime que ça, c'est quand même très grave dans notre institution, surtout dans la mesure où ces amendements étaient tout à fait dans la ligne de ce que tout le monde demande actuellement.

Écoutez, ça dépend comment on fait son travail. Moi je le fais avec mon cœur et je trouve ça particulièrement discriminatoire.

Il y a des éléments très positifs dans ce rapport. Je salue tout d'abord la partie consacrée au handicap et le rappel de la nécessité de tout mettre en œuvre en faveur...

  Λάμπρος Φουντούλης ( NI). – Κύριε Πρόεδρε, νομίζω πως όλοι είμαστε πεπεισμένοι πως για την ίδια ποιότητα και ποσότητα εργασίας οποιοσδήποτε πρέπει να λαμβάνει την ίδια αμοιβή. Να έχει τα ίδια γενικά δικαιώματα, ανεξάρτητα με το αν είναι άντρας ή γυναίκα, ασχέτως εάν έχει ή όχι κάποιας μορφής αναπηρία. Το σημαντικό, όμως, είναι να καταφέρουμε να δημιουργήσουμε και τις προϋποθέσεις που απαιτούνται ώστε ακόμα και αυτοί οι οποίοι, εξαιτίας είτε κάποιου ατυχήματος, είτε κάποιας συγγενούς πάθησης, δεν έχουν τη δυνατότητα να ανταγωνιστούν με τους υπόλοιπους στην αγορά εργασίας, πρέπει να έχουν εξασφαλισμένη πρόσβαση σε θέσεις εργασίας που θα τους επιτρέπει να ζουν με αξιοπρέπεια και να μην είναι οικονομικά εξαρτώμενοι από τρίτους, όπου φυσικά αυτό είναι εφικτό. Σε κάθε περίπτωση, όμως, δεν μπορεί να εξασφαλιστεί η ισότητα στην εργασία αν πρώτα δεν έχει εξασφαλιστεί η ίδια η εργασία. Γνωρίζετε πολύ καλά το τεράστιο πρόβλημα ανεργίας που υπάρχει σε πολλές χώρες της Ευρώπης, με πρώτη από όλες την Ελλάδα. Όταν λοιπόν είναι τόσο περιορισμένες οι θέσεις εργασίας, το κεφάλαιο πάντα θα εκμεταλλεύεται τους εργαζόμενους. Πρέπει να δημιουργήσουμε τις συνθήκες εκείνες που θα επιτρέψουν σε όλους να έχουν εργασία, παράγοντας που από μόνος του θα βοηθήσει και στην ισότητα μεταξύ των εργαζομένων.

  Brando Benifei (S&D). – Signor Presidente, onorevoli colleghi, ieri mattina il presidente Juncker ha affermato che, a dispetto dei miglioramenti, pur incoraggianti, la questione dell'occupazione rimane prioritaria in tutta Europa. Ma non può esistere una solida crescita occupazionale se non si lotta anche contro le discriminazioni nell'accesso al lavoro e sul posto di lavoro.

A 15 anni dall'entrata in vigore della direttiva per la parità di trattamento in materia di occupazione e condizioni di lavoro, il tasso di disoccupazione delle persone con disabilità è ancora quasi doppio rispetto a quello relativo alla popolazione generale. Dopo la sua adozione da parte dell'Unione, la Convenzione ONU sui diritti delle persone con disabilità fornisce buone basi per la definizione del concetto stesso della disabilità nonché per i concetti di progettazione universale degli spazi fisici e di soluzioni ragionevoli adeguate. Inoltre, un ritorno economico importante è possibile con gli investimenti in accessibilità oltre che un guadagno in termini di inclusione sociale.

Dunque è necessario che gli Stati membri facciano molto di più per rendere appetibili queste soluzioni ragionevoli che già esistono.

  Czesław Hoc (ECR). – Panie Przewodniczący! Unia Europejska czasami nazywana jest towarzystwem im. Karola Darwina, czyli elita władz unijnych popiera interesy silnych partnerów. Zatem jeśli tak jest, to czy Unia może zagwarantować równość w zatrudnianiu i pracy, skoro w tej pseudorówności na końcu wygrywa silniejszy? Czy zatem dyrektywa transportowa, która ma zniszczyć polską, największą w Europie flotę transportową tirów, ciężarówek, wprowadzając zasadę tak zwanej płacy minimalnej czy też zasady dotyczące pracowników delegowanych, to przejaw walki Unii o równe traktowanie w obszarze zatrudnienia i pracy, czy też po prostu ukryty bądź jawny protekcjonizm tych najsilniejszych? Czy wskaźnik zatrudnienia osób niepełnosprawnych wynoszący poniżej 50 % w porównaniu z 70-procentowym wskaźnikiem zatrudnienia populacji ogólnej jest wizytówką Unii i powodem do dumy, czy też dowodem na dominację silniejszego? Zatem problem równego traktowania w zakresie zatrudnienia i pracy Unia Europejska powinna i musi potraktować poważnie i uczciwie.

  Yana Toom (ALDE). – Mr President, I would like to thank Renate Weber for the excellent job she has done.

The Employment Equality Directive bans discrimination on the grounds of religion or belief. Can we use this act to justify a ban on wearing headscarves in the workplace or other religious symbols? Many MEPs believe that we can – for security reasons, for instance, or because this is a symbol of oppression.

The European Court of Justice found such bans permissible if all religious symbols are prohibited in a particular workplace. In spite of that, I would remind you that even a neutrally expressed requirement might lead to unlawful discrimination, for instance if employers deliberately introduce obstacles to the employment of members of particular religious groups. In this context, Muslim woman are particularly vulnerable.

Democratic states should not dictate to us what to wear. European values have nothing to do with fashion. Security considerations are hardly relevant in the context of headscarves. The free will of women, whether it is determined by personal, cultural or religious reasons, should be respected. I will finish my speech by reminding you that tolerance is one of the main European values.

  Jana Žitňanská (ECR) – Cieľom smernice o rovnakom zaobchádzaní v zamestnaní a povolaní, ktorá je súčasťou aj slovenského právneho poriadku, je zabezpečiť, aby ľudia neboli diskriminovaní v prístupe na trh práce ani pri výkone svojho povolania.

Realita pre ľudí so zdravotným postihnutím je však častokrát iná. Zamestnávať ich nechcú nielen súkromné firmy, ale ani orgány štátnej správy a naša spoločnosť je stotožnená s názorom, že títo ľudia patria do chránených dielní, a nie na otvorený trh práce. Existujú však aj jednotlivci a organizácie, ktorí prichádzajú s inovatívnymi myšlienkami a dokazujú nám, že aj ľudia so zdravotným postihnutím majú obrovský potenciál a pri dobre nastavených podporných opatreniach dokážu byť plnohodnotnými zamestnancami. Medzi takéto projekty patrí napríklad iniciatíva „Každá firma potrebuje svojho autistu“, v rámci ktorej odborníci školia a pripravujú na zamestnanie nielen samotných ľudí s autizmom, ale aj ich budúcich zamestnávateľov; alebo rehabilitačno-vzdelávacie centrum Bivio, ktoré chce pomáhať s uplatnením sa na trhu práce ľuďom s mentálnym postihnutím. Týmto organizáciám nechýba odvaha, odhodlanie, ani know-how. Jediné, čo postrádajú, je podpora zo strany štátu a to sa musí zmeniť.

  Jérôme Lavrilleux (PPE). – Monsieur le Président, je voudrais simplement revenir sur le sujet du port de symboles religieux en entreprise soulevé notamment dans le paragraphe 21 du rapport.

Au nom des membres de la délégation française du Parti populaire européen (PPE), je souhaiterais rappeler le principe de subsidiarité concernant les règles qui encadrent le port de symboles dits à caractère religieux, que ce soit dans les entreprises ou dans l'espace public.

Si les États membres, laïcs ou non, doivent garantir la liberté religieuse, il leur appartient cependant de fixer sur tout ou partie de leur territoire, en fonction de leur histoire et de leur culture, ou encore au nom de l'égalité des sexes ou de la sécurité, des règles encadrant la pratique religieuse, en conformité avec les textes européens. Nous tenons absolument au respect de ce principe et je voulais le rappeler.

  Maria Grapini (S&D). – Domnule președinte, doamnă comisar, vreau să mulțumesc și eu raportoarei, Renate Weber, și celorlalți care au lucrat la raport. Egalitatea de tratament la încadrarea și ocuparea forței de muncă nu cred că trebuie să mai fie pusă la îndoială de cineva din toate punctele de vedere: sex, naționalitate, religie. De altfel, constituțiile statelor membre prevăd clar egalitatea de tratament. Problemele apar atunci când trebuie să le aplicăm în practică. Am ținut să iau cuvântul pentru a sublinia importanța raportului și să trag un semnal de alarmă față de nerespectarea egalității de tratament la locul de muncă sau la solicitarea unui loc de muncă, în mod deosebit când este vorba de persoane cu dizabilități sau în cazul femeilor în procesul de salarizare. Există, încă, cazuri de hărțuire la locul de muncă sau presiuni pentru a părăsi locul de muncă. Eu cred în nevoia de tratament egal prin respectarea valorilor și competențelor fiecărei persoane, de aceea susțin acest raport.

  Νότης Μαριάς ( ECR). – Κύριε Πρόεδρε, έχουν περάσει 15 χρόνια από την έγκριση της οδηγίας για την ισότητα στην απασχόληση, στόχος της οποίας είναι η καταπολέμηση των διακρίσεων στον τομέα της εργασίας εντός των κρατών μελών της Ένωσης. Και όμως, οι ανισότητες στον χώρο εργασίας εξακολουθούν να υπάρχουν. Ειδικότερα, το ποσοστό απασχόλησης των ατόμων με αναπηρία εντός της Ένωσης είναι πολύ κάτω του 50%, ενώ τα ποσοστά ανεργίας των ατόμων με αναπηρία αγγίζουν το 18,3%. Είναι δηλαδή σχεδόν διπλάσια από εκείνα του γενικού πληθυσμού στην Ευρωπαϊκή Ένωση. Παράλληλα, στον εργασιακό χώρο διαπιστώνεται ένα έντονο μισθολογικό και συνταξιοδοτικό χάσμα ανάμεσα στα δύο φύλα. Επιπλέον, στους χώρους εργασίας παρατηρούνται διακρίσεις όσον αφορά τη διαδικασία πρόσληψης ανάμεσα στα δύο φύλα, ενώ οι γυναίκες είναι αυτές που πλήττονται περισσότερο από την οικονομική κρίση με κίνδυνο να βρεθούν σε επισφαλείς θέσεις εργασίας ή να καταστούν άνεργες. Λαμβάνοντας υπόψη ότι έχει ήδη εγκριθεί από το Ευρωπαϊκό Κοινοβούλιο η οδηγία για την ισότητα, κάθε είδους διάκριση στην απασχόληση θα πρέπει να εξαλειφθεί άμεσα.

  Romana Tomc (PPE). – Nediskriminacija, strpnost, pravičnost in enakost med spoloma so besede, za katere si želimo, da bi opisovale našo družbo.

V Evropi je kljub znatnemu napredku v zadnjih letih diskriminacija na žalost še vedno prisotna, predvsem pri zaposlovanju, kar seveda ima negativne učinke na vse vidike življenja, posebej pa ima negativne učinke ne samo za družbo kot tako, ampak na posameznika.

Mislim, da je v boju s tem problemom potrebno okrepiti predvsem dialog med vladami, dialog s civilno družbo in seveda predvsem tudi s socialnimi partnerji. Hkrati pa je treba narediti vse, da bo javnost bolj ozaveščena o tem problemu.

Države članice morajo vsaka pri sebi poskrbeti za sistematično uskladitev zakonodaje in za dosledno uveljavljanje načela enakega obravnavanja.

  Csaba Sógor (PPE). – Elnök Úr! Az egyenlő bánásmódról szóló vonatkozó irányelv alkalmazásának értékelése mellett nem hagyhatjuk figyelmen kívül a jogszabály hatályának indokolatlan korlátozását sem. A nemzeti kisebbségekhez tartozás alapján történő hátrányos megkülönböztetés nem része az irányelv szövegének. Éppen ezért üdvözlöm a jelentésben foglalt, a Bizottságnak szóló felhívást, amely a hátrányos megkülönböztetés valamennyi típusának figyelemmel követésére szólítja fel a testületet.

Itt az ideje, hogy a Tanács végre dűlőre jusson a megkülönböztetés elleni horizontális uniós irányelv elfogadásának ügyében is, amely a munkahelyen kívüli megkülönböztetéssel szemben védené az európai polgárokat. A LIBE-véleményemben is javasoltam: nemzeti kisebbséghez tartozás alapján történő diszkrimináció tilalmának érvényesülése is kerüljön a jogalkotás és az ellenőrzés irányának homlokterébe. Hiszen több millió uniós polgár mindennapi tapasztalata a hátrányos megkülönböztetés.

  Rosa Estaràs Ferragut (PPE). – Señor Presidente, los fundamentos de la Unión Europea son, sin duda, el respeto, la dignidad humana, la igualdad, la democracia, el Estado de Derecho y el respeto de los derechos humanos. A raíz de esto, hace quince años se aprobó la Directiva para la igualdad en el empleo. Es una Directiva que tiene como objetivo la lucha contra la discriminación y, si bien ha habido mejoras en los últimos años, qué duda cabe de que todavía hay retos con determinados colectivos vulnerables, como el de la discapacidad, un colectivo en el que centro una gran parte de mi trabajo. Ahí se puede hacer mucho para poder hacer los ajustes razonables en empleo, políticas fiscales, políticas activas y diseños universales. Pero también hay otros colectivos vulnerables. Lo dice muy bien el informe: colectivos discriminados por razones de religión, por razones de edad y, también, por razones de orientación sexual.

Se necesita algo más que legislación. Se necesita un compromiso político firme. Pero se necesita, también, crear una cultura de solidaridad y que se respire dignidad, que se respire igualdad. En definitiva, se necesita la adopción de medidas efectivas que puedan convertir esta sociedad en una sociedad que luche como prioridad por la igualdad.

  Marianne Thyssen, Member of the Commission. – Mr President, this debate demonstrates how important it is to remain vigilant and continue fighting against all forms of discrimination, notably on the labour market. As I said, I hope, and the Commission trusts, that the proposal for a horizontal directive will soon be adopted by the European Council. The European directives have set up a comprehensive Europe-wide legal framework against discrimination that has been transposed in all Member States. In 2014, the Commission reviewed their application and found that often there is a lack of awareness, sometimes a weak implementation and enforcement at national level. The Commission has, therefore, further developed support to Member States in order to facilitate the full implementation of those directives, in particular by ensuring that the investment priorities of the European structural funds such as the European Social Fund properly include the fight against discrimination in employment. As you know, with Věra Jourová we last year launched a new initiative to promote work-life balance, with the main objective to ensure that women are not obliged to choose between a family and a professional career. Ms Weber’s report and its recommendations will help the Commission to further monitor and, where needed, improve the policy framework on equality on the labour market. I thank you for the report and this debate and I thank you for your attention.

  Renate Weber, rapporteur. – Mr President, I would like to thank the Commissioner and all the colleagues for their comments. The report highlights the need for adequate training for all relevant stakeholders: from employees of authorities of all kinds to law—enforcement bodies, judges, prosecutors and lawyers. However, I am now thinking that we, as public representatives, could also benefit from such training because I have a hard time understanding how the implementation of a fundamental right, which is provided for by Article 10 of the Charter of Fundamental Rights of the European Union, could be a matter of subsidiarity.

We have well-established European Court of Human Rights jurisprudence on the restriction of the fundamental right to a certain extent, but more than that should not be accepted. Moreover, I am wondering how we could accept the non-observance of court decisions: that contradicts everything I had learned and thought over the past 30 years about the meaning of the rule of law. I want to stress that, for me, adequate training not only refers to knowledge of legislation in court decisions but also includes training on understanding cultural differences and on acknowledging unconscious bias.

Since 2007, when I became a Member of this Parliament, together with many colleagues I have been advocating the adoption of a horizontal anti-discrimination directive outlawing discrimination in access to goods and services across the EU. Nine years later, yes, I find it is a disgrace that this directive is still blocked in the Council by a coalition of some Member States. I cannot but welcome the optimism of Commissioner Thyssen that the directive will become a reality soon, so let us stay optimistic and let us hope.

  Ádám Kósa (PPE), írásban. – A foglalkoztatás és a munkavégzés során alkalmazott egyenlő bánásmód általános kereteiről szóló 2000/78/EK irányelv alkalmazásáról szóló jelentés számos előremutató rendelkezést tartalmaz. Az elmúlt 15 év tapasztalatai alapján készült ez a jelentés. Fontos előrelépés, hogy a vallás is prioritássá lépett elő ezen a téren, ugyanakkor megítélésem szerint a vallási jelképek viselésére előírt korlátozásoknak továbbra is nemzeti hatáskörben kell maradniuk. A fogyatékosság területén is előrelépések láthatóak, így pl. az adókedvezmények biztosítása vagy a közbeszerzések, illetve a fogyatékossággal élő személyek jogaival foglalkozó ENSZ-egyezmény monitoringjáért felelős bizottság tevékenysége figyelembevétele fontosságának hangsúlyozásával. Ezzel kapcsolatosan fontos, hogy a fogyatékkal élő személyek jogi védelme is erősödjön és erre konkrét lépések legyenek.

Összhangban a robotika és a mesterséges intelligencia fejlődésével, az életkor alapján történő hátrányos megkülönböztetés terén is remélhetőek további előrelépések, elsősorban a munkavállalók digitális készségeinek javításával, illetve az intelligens szolgáltatások fejlesztésével. Ugyanakkor a jelentés szexuális irányultságra vonatkozó rendelkezései közt találhatóak olyan elemek, amelyek a nemzeti hatáskört és hagyományokat kérdőjelezik meg, amelyek nem támogathatóak. Ezen túlmenően az adatfelvétel tekintetében aggályosnak tartom a faji és etnikai származás alapján történő statisztikák készítését is, mint ahogy a szülői szabadsággal kapcsolatos harmonizációs törekvéseket is, különös tekintettel arra, hogy a családdal kapcsolatos ellátásokra, támogatásokra Magyarország jelentősen az EU-átlag feletti arányban költ.
