  Ignazio Corrao, author. – Mr President, the situation in the Philippines is extremely worrying, especially after the election of President Duterte. He started with all kinds of provocations and insults, and this year became the protagonist of verbal attacks against the UN, China, the President of the United States and the Pope, with hate speeches instigating violence against suspected drug sellers and drug users. As a consequence of these promises and behaviour, according to the official information at our disposal, starting from the day of his election on 30 June 2016 until this month of September, 44 people have been killed every day – 2 927 in total – as a result of extrajudicial execution and lynching, following these hateful speeches.

Duterte is an elected president and in the near future he will play a fundamental role in the complex and delicate geopolitical balance of the South China Sea between China, the United States and Russia. With this resolution we ask the authorities to investigate and condemn the action of vigilance groups, and we urge the Commission to use all available instruments to help the government in respecting its international human rights obligations. We have the duty to use all our means in order to block the rise of a new dictator and the consequences on human rights violations in the Philippines.

  Charles Tannock, author. – Mr President, the illicit drug trade in the Philippines, and its associated criminal activities, is clearly a menace to its domestic – and the wider, global – population. President Duterte’s pledge to crack down on the trade is therefore naturally welcomed. His methods to date, however, are not. A policy that fails to distinguish between users and distributors is but one problem. The indiscriminate killing of thousands of drug users and dealers without any due process is to be absolutely condemned. The arrest of thousands more suspects on the basis of spurious allegations and hearsay is also of concern. Duterte’s comments that we will not stop until the last drug lord and pusher have surrendered or are put either behind bars or below the ground, if they so wish, is far from the tone that I would expect or wish to see from an elected president.

I welcome this House’s resolution and call for an investigation into the extrajudicial killings. But EU Member State governments must also do more to put pressure on the government of the Philippines to re—evaluate its totally unacceptable policies and practices in this area.

  Laima Liucija Andrikienė, author. – Mr President, we are having this urgency debate on the situation in the Philippines since new evidence about extrajudicial executions and killings taking place in that country in the context of an intensified anti-crime and anti-drug campaign is shocking. Actions taken by the government look unacceptable from the perspective of international conventions on human rights the Philippines have ratified, especially as President Duterte has repeatedly urged law enforcement agencies and the public to kill suspected drug traffickers who do not surrender, as well as drug users. President Duterte has even publicly stated that he would not pursue law enforcement officers and citizens who killed drug dealers who resisted arrest. Thousands of people have already been killed by police and vigilante armed groups.

President Duterte should understand that he cannot continue like this in the future. The UN Secretary General and the UN special rapporteur on extrajudicial and arbitrary executions have denounced the series of extrajudicial killings as illegal and a breach of fundamental rights and freedoms. We, the European Parliament, urge the government of the Philippines to put an end to the current wave of extrajudicial executions and killings and bring those responsible to justice. We also urge the European Union to use all available instruments to assist the government of the Philippines in respecting its international obligations.

  Hilde Vautmans, indiener. – Net als voorgaande sprekers wil ook ik erop wijzen dat de Filipijnen worden geteisterd door een bloedige oorlog tegen drugs. Sinds president Duterte aan de macht kwam, werden al meer dan 1 800 drugsdealers omgebracht. In diezelfde periode doodde de politie 712 personen op verdenking van drugshandel en drugsgebruik, vaak zonder aanleiding en zonder proces. En dat in de Filipijnen, een land waar we als Europese Unie altijd goede banden mee hebben onderhouden. Nu zijn de Filipijnen een politiestaat geworden waar willekeur heerst en waar mensenrechten weinig waarde hebben. Toegegeven, president Duterte had in zijn campagne al aangekaart dat hij de bevolking zou oproepen om het heft in eigen handen te nemen. Drugsgebruikers zijn door die oproep en opruiende taal eigenlijk een vogel voor de kat geworden. De Filipijnen worden inderdaad geteisterd door drugs, maar laten we van de president toch eisen om de oorlog tegen drugs binnen een wettelijk kader en op een humane manier te voeren. En laten ook vragen om de doodstraf niet opnieuw toe te passen. Dat is voor ons Europeanen een blijvend strijdpunt. Met de rechtsstaat mag niet worden gesold, ook niet als het gaat om de strijd tegen drugs.

Collega's, ik maak me geen illusies. Misschien gaat president Duterte als gevolg van deze resolutie nu ook op ons schelden, zoals gebeurde met de Amerikaanse president Obama, met Ban Ki-moon en met de paus. Maar dat is het meer dan waard. Een oorlog tegen drugs is ook aan regels en respect voor de mensenrechten gebonden. Dat is voor ons liberalen essentieel.

  Barbara Lochbihler, Verfasserin. – Herr Präsident! Präsident Duterte hat als sein politisches Ziel vorgegeben, der Drogenkriminalität auf allen Ebenen zu begegnen und sie mit allen Mitteln zu bekämpfen. Die Folgen dieser Kampagne sehen wir jetzt. In nur wenigen Monaten wurden Tausende verhaftet und außergerichtlich hingerichtet. Nach Angaben der philippinischen nationalen Polizei sind allein im Juli und August dieses Jahres Tausende verdächtige Drogendealer und Drogensüchtige von Unbekannten erschossen worden, über 16 000 Menschen wurden aufgrund von vagen Hinweisen auf Drogenkriminalität inhaftiert. Das führt nicht zum Ende des Drogenhandels, das führt zu einer Brutalisierung und unkontrollierten Gewalt in der Gesellschaft. Die philippinische Regierung muss umgehend dafür sorgen, dass Polizei und Militär internationale Rechtsstandards einhalten, und aufhören, die Bevölkerung quasi de facto zur Lynchjustiz aufzurufen. Nicht nur außergerichtliche Hinrichtungen, sondern auch Folter und Verschwindenlassen von Personen müssen unabhängig untersucht und Verantwortliche vor zivile Gerichte gestellt werden.

Weiter appelliere ich an die philippinische Regierung, von der Wiedereinführung der Todesstrafe abzusehen und ebenso abzusehen von der Herabsetzung des Alters der Schuldfähigkeit auf neun Jahre, wie das derzeit im philippinischen Parlament diskutiert wird.

Ich wende mich an die EU, damit sie prüft, ob es angesichts der verschlechterten Menschenrechtssituation auf den Philippinen nicht auch angebracht ist zu schauen, ob das mit der GSP+, dieser Handelspräferenz, vereinbar ist, denn hier ist ja klar festgelegt, dass eine Gewährung von GSP+ mit dem Einhalten der Menschenrechte verbunden ist.

  Neena Gill (S&D), blue-card question. – Mrs Lochbihler, you made a reference that since December 2014 the Philippines has enjoyed enhanced trade preferences with the EU under the GSP+ Scheme, granted to them in exchange for good performance on human rights and labour rights, the environment and good governance, and this has already provided a major boost to the Philippines. Do you think the Commission should now reconsider, in light of this debate and what we are considering in terms of the back—sliding we have got on human rights and the rule of law and the extrajudicial killings by vigilante groups? Do you think the Commission should take this up now?

  Barbara Lochbihler, blue card answer. – As I said in my statement, I think it is time for the Commission to communicate publicly, including to the President, that this might be the next step if there is no immediate reaction from the Philippines. I am very aware that, including in recent years, the Philippine Ambassador here struggled very hard to get this GSP-plus, and we had also seen good progress on the human rights record in the Philippines. It is timely that the EU should consider this matter now.

I would add that the Philippines takes the leadership in the ASEAN community at the beginning of 2017, so it is all the more important that, in their foreign relations, they have a good human rights record.

  Pier Antonio Panzeri, autore. – Signor Presidente, onorevoli colleghi, questo personaggio, che oggi governa le Filippine, per farsi eleggere ha promesso di fare piazza pulita del commercio illegale di droga e devo dire che attorno ad una battaglia che in sé è giusta, in realtà si sta consumando una odiosa repressione. I colleghi hanno già ricordato i numeri delle uccisioni e delle esecuzioni extragiudiziali; aggiungo a questi il fatto che la massiccia campagna contro gli spacciatori e i consumatori ha portato a più di 15 000 arresti e spinto più di mezzo milione di persone a costituirsi nella speranza di ricevere i trattamenti sanitari adeguati, nonché l'immunità.

Io credo che sia giusto che con questa risoluzione si chieda, unendoci alla voce e agli appelli degli attivisti, di segnalare la preoccupazione che questa politica di tolleranza zero sia stata accompagnata da aspre violazioni dei diritti umani. Sono convinto, come altri, che l'Unione europea debba rivedere le proprie posizioni verso le Filippine.

  Miguel Urbán Crespo, autor. – Señor Presidente, Señorías, el Presidente de Filipinas, Rodrigo Duterte, proclamó el pasado 5 de septiembre un estado nacional de emergencia indefinido. Desde el inicio de su presidencia, ha puesto en marcha la llamada guerra contra las drogas, durante la cual la policía ha matado a más de 929 sospechosos de narcotráfico y 1 507 personas han sido asesinadas por fuerzas de seguridad privadas y paramilitares. Nos preocupa enormemente la apuesta militarista y de populismo punitivo del Gobierno filipino, que da poderes especiales a las fuerzas de seguridad públicas y privadas, lo que genera un contexto de impunidad y de violación sistemática de los derechos humanos.

Pedimos a esta Cámara que tome todas las medidas que estén en su mano para poner fin al estado de violencia e impunidad en Filipinas y que reclame a la Comisión Europea que interrumpa el Sistema de Preferencias Generalizadas Plus con el que Filipinas se beneficia de preferencias comerciales en el mercado de la Unión Europea, así como la cancelación inmediata de las negociaciones de un tratado comercial con Filipinas.

Esta debe ser nuestra respuesta ante la impunidad y la violación sistemática de los derechos humanos.

  Csaba Sógor, a PPE képviselőcsoport nevében. – Elnök Úr! Ha a fennálló jogrend semmibevételével próbálja helyreállítani a törvényességet egy állam, az könnyen káoszhoz és anarchiához vezet. Nagyon fontos, hogy azok, akik felemelik szavukat a rengeteg tisztázatlan gyilkosság miatt a Fülöp-szigeteken, nem a kábítószer-fogyasztást vagy terjesztést helyeslik. Nagyon veszélyes kór ez, amely felemésztheti a társadalmat. A kemény fellépés tehát mindenképpen indokolt és szükséges.

De különbség van az állami szervek kemény fellépése és a közönséges bűnözők leszámoló hadjárata között. Sajnos a Fülöp-szigeteken ez a különbség egyre kevésbé érzékelhető. A politikai vezetés felelőssége, hogy a jogszabályoknak megfelelően, azokkal összhangban lépjen fel a drogok ellen, és ne bátorítsa önbíráskodásra a polgárokat. Ellenkező esetben borítékolható lesz a káosz, az állandó félelem és bizonytalanság, ami sem a fülöp-szigetieknek, sem az ország nemzetközi partnereinek nem érdeke.

  Josef Weidenholzer, im Namen der S&D-Fraktion. – Herr Präsident! Die Ereignisse auf den Philippinen sind äußerst besorgniserregend. Wir erleben, wie ein bisher in der internationalen Gemeinschaft geachteter Staat sich selbst zerstört. Das hängt unmittelbar mit dem neu gewählten Präsidenten zusammen. Es besteht die Gefahr, dass die erfolgreichen Demokratisierungsbemühungen, die nach dem Sturz des Diktators Marcos einsetzten, zunichte gemacht werden. Presse und Meinungsfreiheit werden eingeschränkt, die Einführung der Todesstrafe vorbereitet, und im Kampf gegen die Drogenkriminalität wird der Rechtsstaat komplett aus den Angeln gehoben.

Drogenhändler und Drogensüchtige werden von Todesschwadronen getötet. Das geschieht unter den Augen und mit Ermunterung der Behörden. Oft genügt der bloße Verdacht um getötet zu werden. Das ist besorgniserregend, äußerst besorgniserregend, und es ist zu befürchten, dass sich diese systematische Aushöhlung der Menschenrechte und des Rechtsstaates in die philippinische Gesellschaft hineinfrisst und den Staat zerstört.

Unsere Entschließung ruft die philippinische Regierung auf, eindringlich auf diese gefährlichen Entwicklungen hinzusehen, von der Einführung der Todesstrafe abzugehen, die Verbrechen aufzuklären und zu einer vernünftigen und adäquaten Bekämpfung der Drogenkriminalität überzugehen, weil die Drogenkriminalität tatsächlich ein Problem ist, das man aber nicht mit solchen Methoden bekämpften kann.

  Edouard Ferrand, au nom du groupe ENF. – Monsieur le Président, Mesdames et Messieurs, chers collègues, une fois de plus, les européistes montrent que leur véritable volonté, c'est de s'attaquer aux peuples et aux souverainetés nationales.

Le président Rodrigo Duterte a été élu président de la République des Philippines. Il est le président le mieux élu de l'histoire des Philippines avec plus de six millions d'avance sur son concurrent. Il mène une politique d'éradication de la criminalité, phénomène très important aux Philippines, et il faut croire qu'aujourd'hui, c'est un véritable problème, une menace même pour les Philippins. Aussi féroce soit cette véritable politique de lutte contre la criminalité, elle doit demeurer dans les règles du droit, et si peine de mort il doit y avoir, elle doit figurer dans l'échelle des peines et nulle part ailleurs.

Mais une fois de plus, que les eurocrates ne s'immiscent pas dans les affaires intérieures des États, qu'ils laissent les peuples s'exprimer, quelles que soient les conséquences, que l'Union européenne s'occupe de ses propres turpitudes, notamment en Ukraine, et qu'elle laisse la paix aux Philippines et ailleurs, et qu'elle laisse surtout la paix aux nations pour leur souveraineté nationale.

  Marc Tarabella (S&D). – Monsieur le Président, depuis son arrivée au pouvoir en juin 2016, le président Duterte met tout en œuvre pour débarrasser son pays du fléau de la drogue.

Ce sont déjà plus de 3 000 personnes qui sont mortes sans avoir eu une chance d'avoir un procès équitable. Qu'ils soient vendeurs ou consommateurs, il n'y a pas de distinction. Le président ne leur laisse aucune chance. En effet, la plupart d'entre eux ont été exécutés sommairement, sans discernement, sans jugement. Cette lutte contre la drogue est le véritable cheval de bataille du président et il met tout en œuvre pour parvenir à ses fins.

Le respect des droits humains et par conséquent du droit à la vie ne fait donc pas obstacle à son ambition de voir 100 000 criminels éliminés durant les six premiers mois de son mandat. Il a également laissé la porte ouverte aux justiciers civils, qui peuvent dès lors tuer impunément, si c'est dans le cadre de ce grand projet d'éradication de la drogue aux Philippines.

La victoire écrasante du président Duterte aux élections et son énorme popularité au sein de la population philippine ne doit pas le dispenser de respecter les droits humains élémentaires et l'urgence est telle aux Philippines que l'Union européenne ne peut laisser inchangées ses relations avec cet État.

  Neena Gill (S&D). – Mr President, I had the opportunity to visit the Philippines a couple of years ago and I saw many developments that were cause for optimism. Corruption was still a problem but being addressed, and judicial reforms, human rights and criminal law were all on President Aquino’s reform agenda. Upon return, I advocated granting the Philippines GSP+ status.

Unfortunately, today there is less cause for optimism. The extrajudicial killings taking place in President Duterte’s war on drugs are setting the country back years in terms of human rights and rule of law. We have heard today that more than a thousand people have been killed in police operations or by vigilante groups. His tendency towards international isolation is a further cause for concern.

At a time when South—East Asia’s strategic importance is rapidly increasing, I would urge President Duterte to step up positive engagement with international actors, including the EU and UN, rather than threaten a retreat. I call upon the High Representative, Mrs Mogherini, and the Commission to extend a hand of friendship but, at the same time, to make it clear to the Duterte regime that the consequences will be dire.

  Νότης Μαριάς ( ECR). – Κύριε Πρόεδρε, οι Φιλιππίνες έχουν γίνει, κατά το τελευταίο διάστημα, το επίκεντρο του ενδιαφέροντος για πολλαπλούς λόγους. Γεγονός είναι ότι, και με τη νέα κυβέρνηση του Προέδρου Duterte, ο σεβασμός κάποιων αυτονόητων ανθρωπίνων και κοινωνικών δικαιωμάτων δεν αποτελεί προτεραιότητα. Η διαφθορά, η παραβίαση των ανθρωπίνων δικαιωμάτων, οι ποινικές διώξεις πολιτικών αντιπάλων είναι στην ημερήσια διάταξη, σε μια χώρα όπου το φαινόμενο της παιδικής εργασίας αφορά δύο εκατομμύρια ανηλίκους. Είναι όμως οξύμωρο και δείγμα υποκρισίας η Ευρωπαϊκή Ένωση να εκφράζει, από τη μια πλευρά, την ανησυχία της για τις εξελίξεις στις Φιλιππίνες και να συνάπτει, από την άλλη, μια νέα εταιρική σχέση με τη χώρα αυτή, όπως έγινε τον περασμένο Ιούνιο. Μια εταιρική σχέση που έχει μοναδικό γνώμονα τα συμφέροντα των ευρωπαϊκών πολυεθνικών εταιρειών, οι οποίες επιχειρούν να επενδύσουν εκεί, σε μια αναδυόμενη οικονομία, όπου ισχύουν μισθοί πείνας. Αλλά τότε, τον Ιούνιο, ακόμη οι Φιλιππίνες δεν είχαν κάνει στροφή υπέρ της Κίνας. Αυτό είναι λοιπόν που ενοχλεί το ευρωπαϊκό κατεστημένο και όχι τα πραγματικά προβλήματα που αντιμετωπίζει ο λαός της χώρας αυτής.

  Elmar Brok (PPE). – Herr Präsident, Herr Kommissar, meine Damen und Herren! Auch ich finde es wichtig, dass die Verfolgung von Straftätern egal welcher Art nach den Grundsätzen des Rechts und der Rechtsstaatlichkeit geht und dass dies nicht mit Ermordungen geschehen kann, um ein Problem zu lösen. Auf der anderen Seite sollten wir aber nicht vergessen, auch zu erwähnen, dass drug traffickers Verbrecher sind, Mörder sind, die sie unsere Kinder umbringen. Auch das muss zum Ausdruck gebracht werden. Es darf nicht zur Belobigungsaktion werden, dass wir drug trafficking als eine gesellschaftlich hinnehmbare Situation sehen. Drogenbekämpfung muss strikt durchgeführt werden, es muss gegen Drogenhandel vorgegangen werden; das sollten wir alles unterstützen – aber es muss eben im Rahmen der Rechtsstaatlichkeit erfolgen. Beides zusammen muss man sehen.

Deswegen hoffe ich, dass die Philippinen eine erfolgreiche Politik betreiben werden. Wir haben mit ihnen Abkommen abgeschlossen, auch in dem Sinne, dass die internationalen Gerichtsregelungen bezüglich der Philippinen und der South China Sea entsprechende Beachtung durch die Völkergemeinschaft finden, dass das internationale Recht auch in diesen Fragen durchgesetzt wird.

  Илхан Кючюк (ALDE). – Г-н Председател, уважаеми г-н Комисар, уважаеми колеги, през изминалите години Република Филипини постигна значителен прогрес. Неслучайно в края на 2014 г. Европейският съюз предостави на страната статут по общата схема за преференции GSP+. На ниво законодателство за правата на човека доскоро страната беше образец за другите държави в региона, като ратифицира осем от деветте главни конвенции, но също така и като една от първите държави в Азия, която се обяви срещу смъртното наказание.

За съжаление след президентските избори ситуацията във Филипините драстично се промени. Държавната политика придоби авторитарни измерения. Безпрецедентните убийства на 1 800 заподозрени наркодилъри без съдебен процес или доказателства за предполагаеми престъпления са недемократичен акт, на който трябва да се противопоставим. Призовавам правителството на Филипините да сложи край на извънсъдебните екзекуции и да спазва международните актове, които страната е ратифицирала.

Необходимо е президентът Родриго Дутерте да гарантира справедлива и независима съдебна система и да започне диалог с международните лидери и организации, за да върне страната по пътя на демокрацията.

  Luke Ming Flanagan (GUE/NGL). – Mr President, what this country is doing is appalling. The war on drugs is not actually a war on drugs, it is a war on people.

They say people take drugs to try and experience another reality. Listening to many people in the debate here, I wonder what drugs you are on, because you talk about a war on drugs and you talk about how cartels should not be promoted in selling these drugs, and that we have got to do something about it. Yet, at the same time, I can walk out of here and I can buy as dangerous a drug as exists called alcohol around here, and you do not seem to have a problem with it.

When you are having a debate and a discussion on something and young people tune into it and they see that it does not add up, because 2 + 2 is not 5, they tune out. They will tune out of this debate as well, because I hear people here say they are against drugs and I have seen them drink alcohol. Make up your minds.

  Christos Stylianides, Member of the Commission. – Mr President, let me start by reiterating the solidarity of the European Union with the people and the government of the Philippines following the Abu Sayyaf attack in the City of Davao on 2 September. Since the beginning of the term of President Duterte there has been progress – or at lease continuity – in some important areas. An indefinite ceasefire with the National Democratic Front was concluded, the peace process in Mindanao has been reinvigorated and the ratification of the partnership cooperation agreement (PCA) is ongoing.

These positive steps are overshadowed by the war on drugs declared by the President. The fight against drugs was the number one promise in President Duterte’s election campaign and remains highly popular. He also promised the reinstatement of the death penalty. According to the latest official figures, there have been more than 2 400 people killed either during or outside police operations between 1 July and 4 September.

Against the background of these figures, in various statements we have expressed our significant consensus in several meetings with high-ranking officials. However, necessary responses to the drug problem must be carried out in full compliance with human rights, the rule of law and the right to due process. We have also reiterated our principal position on the death penalty. President Duterte has repeatedly expressed his administration’s commitment to human rights and he has warned the police against any abuse of authority. In the coming weeks and months there will be several high-level meetings with the Philippines to discuss this further and to share our concerns. We will be alert to see how President Duterte’s commitments on human rights are applied. The High Representative, Federika Mogherini, is expected to meet with her counterpart twice over the coming weeks. The GSP+ monitoring mission is scheduled for before the end of the year. We will hear – and this is more or less in answer to a question – and we will underline that during the next monitoring period, 2016 to 2017, we have strong expectations that the Philippines will strengthen its human rights legal framework.

Following the entry into force of the PCA, we will engage in a formal human rights dialogue. We are also looking at ways to provide further support to the Philippines in a comprehensive approach to combat drug trafficking in line with our shared values. And, of course, we will continue to work closely with the Filipinos on this and other issues. Of course, I would like to congratulate the authors for their work and for this very productive discussion in this political body.

  Isabella Adinolfi (EFDD), per iscritto. – È doveroso condannare fermamente il traffico e l'abuso di stupefacenti nelle Filippine, sottolineando che le droghe illecite costituiscono una minaccia per i giovani filippini, nonché uno dei più gravi problemi sociali.

Pur accogliendo favorevolmente l'intenzione del governo di ridurre gli elevati livelli di criminalità e corruzione nel paese, è necessario che si adottino politiche e programmi specifici, che comprendano anche misure di prevenzione e di recupero, senza concentrarsi esclusivamente sulla repressione violenta, garantendo altresì il rispetto dei diritti umani e delle libertà fondamentali. Inoltre le autorità dovrebbero avviare un'indagine immediata, approfondita, efficace e imparziale sul numero straordinariamente elevato di persone uccise durante le operazioni di polizia, al fine di identificare tutti i responsabili, consegnarli a un tribunale civile competente e imparziale e applicare le sanzioni penali previste dalla legge, assicurando al tempo stesso una protezione adeguata ai difensori dei diritti umani, ai sindacalisti e ai giornalisti.

L'UE deve avvalersi di tutti gli strumenti disponibili per aiutare il governo delle Filippine a rispettare i suoi obblighi internazionali in materia di diritti umani.
