Frans Timmermans,First Vice-President of the Commission. – Madam President, I would like to thank the European Parliament for putting the situation in Poland on the agenda of its plenary meeting today. Last time we discussed this issue in plenary was on 13 September. The resolution which the plenary adopted later that day provided a strong support for the Commission, and I would like to thank Parliament for this support.
Today, I would like to explain what has happened since and how we see the situation since the adoption of our recommendation. As you know, the Commission raised three main issues of concern in its rule of law recommendation of 27 July. The composition of the Constitutional Tribunal, the publication of its judgments, and the effectiveness of the functioning of the Tribunal. The Commission asked the Polish authorities to address these concerns within three months. Regrettably, since the adoption of the recommendation, the situation has not improved.
On 14 October, the Venice Commission issued an opinion on the rule of law in Poland which fully supports the concerns expressed by the Commission. Regrettably, the Polish Government has not accepted, but strongly criticised this opinion. Let me remind you, the Polish Government asked for the Venice Commission to give its opinion.
On 27 October, the Commission received a reply from the Polish Government. However, this reply did not announce any new actions on the part of the Polish authorities to address the concerns identified by the Commission. It rather explained why the Polish Government disagreed with the positions of the Commission expressed in the recommendation. In particular, the Polish Government denied that the judgments of the Polish Constitutional Tribunal of the 3 and 9 December 2015 had any legal relevance for the composition of the tribunal.
Furthermore, three new laws regarding the Constitutional Tribunal are at the final stage of the legislative process; they were voted on last night in the Sejm. While these laws would address some of the issues raised in the recommendation of 27 July, they also introduce new provisions, raising concern in particular regarding the President of the Constitutional Tribunal.
The President of the Republic would be given the right to appoint an ‘Acting President’ of the Tribunal, which is in clear disregard of the provisions of the Polish Constitution concerning the election of the President and the Vice-President of the Tribunal. In addition, the functioning of the Tribunal is significantly impeded as three judges of the Constitutional Tribunal, elected by the previous Sejm, have still not been sworn in. Three judges appointed by the new majority are currently not participating in the Tribunal’s work. This leaves the Constitutional Tribunal unable to decide cases in composition of a full bench, which requires the participation of 11 judges.
I am deeply concerned by these new developments, which threaten to deepen the rule of law crisis in Poland. I therefore urgently call on the Polish authorities not to put into force the new laws before the Constitutional Tribunal has had the occasion to examine their constitutionality, which is the role the tribunal has in the Polish Constitution.
I also call on the President of Poland to urgently swear in the three judges elected by the previous Sejm, and I call on the Poland Government to publish, and fully respect, all the previous judgments of the Constitutional Tribunal. You do not get to pick and choose which judgments you like and then only publish the judgments you like; that is in violation of the separation of powers.
The College is following the situation closely and will discuss the situation in Poland soon, in order to consider the situation and determine the best way of addressing this situation. Let me underline, once again, that this is not a political question; it is about our fundamental values. It is crucial that, whatever a government’s programme entails, it is done in full accordance with the constitution and the law itself. That is why the effective functioning of the Constitutional Tribunal is so important. This is also crucial for the implementation of all Union policies, including the Internal Market, and is the basis for the mutual trust between Member States.
The separation of powers is essential for the functioning of our internal market, because the Court of Justice in Luxembourg has to be sure that, in its direct relationship with courts at the national level, there is no interference of the other branches of power. Judicial independence is of the essence for the whole system to be able to function, including the functioning of the internal market.
To conclude, I would like to thank the European Parliament for its continuous efforts to uphold the rule of law in the EU and for supporting the Commission’s actions concerning the situation in Poland. As I said at our last debate, upholding the rule of law is the shared responsibility of all EU institutions, and it has never been as necessary as it is today. That is why, Parliament, your support is crucial; that is why, let me say this again, this is a dispute the Commission has with the Government of Poland, not with the Republic of Poland – certainly not with the people of Poland – but with the Government of Poland.

Janusz Lewandowski, w imieniu grupy PPE. – Pani Przewodnicząca! 35 lat temu, 13 grudnia, pod osłoną nocy, komunistyczna władza wypowiedziała wojnę własnemu społeczeństwu. To była ciemna karta polskiej historii. Ja wtedy wraz ze studentami organizowałem opór na Uniwersytecie Gdańskim. Była to naiwna barykada, w pełnym poczuciu bezbronności na widok czołgów, ale też z pełnym poczuciem sensu tego protestu i nadzieją, że przyniesie on owoce. I doczekaliśmy wolnej Polski w zjednoczonej Europie. Jest to dobra okazja, by podziękować wszystkim tym, dla których los Polski nie był obojętny, którzy nam pomagali na drodze do wolności.
Wczoraj, czyli 35 lat po wprowadzeniu stanu wojennego i 27 lat po odzyskaniu niepodległości, dziesiątki tysięcy ludzi wyszły na ulice, by wyrazić swój sprzeciw wobec nadużyć obecnej władzy. Ta władza wzięła się z demokratycznego mandatu, ale mandat mniej niż 20 % uprawnionych do głosowania nie usprawiedliwia postępującego zamachu stanu na instytucje państwa prawa, społeczeństwo obywatelskie, zdrową gospodarkę. Nie usprawiedliwia rujnowania pozycji Polski w świecie. Lista tych nadużyć wydłuża się.
Wczoraj był smutny dzień dla Polski, ponieważ nowa ustawa o zgromadzeniach tłumi wolność zgromadzeń – fundamentalne prawo, o które walczyła Solidarność. Lista się wydłuża, i można wskazać kolejne cele tej rozprawy ze społeczeństwem: samorząd terytorialny, niezawisłe sądownictwo...
To wszystko jest doskonale widoczne dla demokratycznego świata po obu stronach Atlantyku. Nie można już spuścić nowej żelaznej kurtyny. Misja prania mózgów, realizowana przez niektóre media publiczne w Polsce, nie dociera do Strasburga i Brukseli. Każdy, kto tutaj zakłamuje obraz polskiej rzeczywistości, traci wiarygodność, również na tym forum.
Już pięć razy była mowa o Polsce na forum Parlamentu Europejskiego, więc jesteśmy chorym ogniwem tej Wspólnoty. Cenę płaci cała Polska. To wspaniałe dzieło zbiorowe milionów Polaków, jakim jest Polska ćwierćwiecza, nie zasługuje na płacenie tak wielkiej ceny za nadużycia władzy. Dlatego będziemy dawali świadectwo prawdzie. Będziemy głosem milionów ludzi, którzy wiedzą, że zasady wpisane w traktaty i w naszą konstytucję są po to, żeby chronić wolności obywatelskie, zdrową gospodarkę, zdrowy ład publiczny i społeczny. Będziemy głosem milionów ludzi, którzy dobrze czują się w Unii Europejskiej, czują się u siebie, i rozumieją Unię Europejską jako gwarancję naszego bezpieczeństwa i szans na rozwój.
Birgit Sippel im Namen der S&D-Fraktion. – Frau Präsidentin! Der 30. Jahrestag des polnischen Verfassungsgerichts sollte ein Grund zur Freude sein, ein Symbol für das polnische Bekenntnis zu Freiheit und Demokratie. Doch davon ist wenig zu spüren. Die erzkonservative PiS-Regierung amputiert das Oberste Gericht immer weiter, und zusätzlich bereiten Berichte über die Einschränkung des Versammlungsrechts oder die Beschneidung der Rechte von Frauen Sorgen.
Keine demokratische Mehrheit der Welt berechtigt eine Regierung zur Zerstörung der Demokratie. Und deshalb war es richtig, dass die Kommission den Rechtsstaatsmechanismus für Polen eingeleitet hat. Doch die polnische Regierung zeigt keine Einsicht. Ich bin es leid, dass unsere Rufe zur Einhaltung der Grundrechte, zur Sicherung von Freiheit und Demokratie immer wieder an einer Mauer des Widerstands abprallen, die Herr Orbán und Frau Szydło jeden Tag höher aufbauen.
Setzen wir endlich ein klares Zeichen! Polen gehört auf die Tagesordnung des Rates, und für die formale Anerkennung, dass in Polen eine systemische Gefahr für die Rechtsstaatlichkeit vorliegt, braucht es nur eine Vierfünftelmehrheit. Das wäre immerhin ein Signal, auch wenn es wohl nicht zu konkreten Sanktionen kommt.
Das zeigt auch: Die bestehenden Instrumente zur Sicherung von Demokratie und Rechtsstaatlichkeit reichen nicht. Doch die Kommission ist nicht so hilflos, wie es Präsident Juncker in einem Interview darstellt. Herr Timmermans! Wir fordern Sie mit Nachdruck auf, einen Vorschlag für einen unabhängigen Jahresbericht zum Stand der Rechtsstaatlichkeit in allen EU-Staaten vorzulegen. Demokratische Grundrechte sind offensichtlich keine Selbstverständlichkeit. Wie vielerorts in Europa, mussten auch die Menschen in Polen diese hart erkämpfen. Sie nun zu erhalten, liegt aber in der Verantwortung aller Europäer.
Ryszard Antoni Legutko w imieniu grupy ECR. – Pani Przewodnicząca! No, niestety znowu robią Państwo orwellowski spektakl. Mam nadzieję, że ostatni, choć znając tę izbę, nigdy nic nie wiadomo. Jak poprzednio, cała ta decyzja o debacie na temat Polski jest bezsensowna, niesprawiedliwa, skrajnie stronnicza i niczym niepoparta.
Nie wiem, jak w tak krótkim czasie mam rozsupłać te wszystkie nieprawdy, które zostały powiedziane. Nie ma, proszę Państwa, żadnego problemu z ustawą o zgromadzeniach. Nie ma. Czy wyrażam się jasno? Nie, nie ma żadnych ograniczeń czyjegokolwiek prawa do demonstracji w Polsce – ani jednostek, ani grup, ani organizacji. Nie ma! Dlaczego zatem zawracacie ludziom głowę? Jak można tak skrajnie rozmijać się z faktami? Wstydźcie się! Nie wolno takich rzeczy robić!
Jakieś uwagi tutaj były na temat praw kobiet w Polsce i na temat konwencji stambulskiej. Proszę Państwa, jeśli chodzi o przemoc wobec kobiet, Polska jest na ostatnim miejscu w Europie w tym niechlubnym rankingu. Na ostatnim miejscu w Europie! Pana ojczyzna, panie przewodniczący Timmermans, jest natomiast bardzo wysoko w tej hierarchii. Więc może zajmiemy się takimi krajami jak właśnie Holandia, jak Belgia i przestaniemy mówić o Polsce. Przyjedźcie do Polski – może nauczycie się tego, jak należy dbać o prawa kobiet. Podobno na naukę nigdy nie jest za późno. Ta zasada być może nie obowiązuje elit europejskich, ale mam nadzieję, że jednak coś się zmieni w tej sprawie.
Pan, panie przewodniczący Timmermans, ciągnie z niezrozumiałym dla mnie uporem sprawę Trybunału Konstytucyjnego, domagając się – no, bo to tak naprawdę do tego się sprowadza – by ten Trybunał był zdominowany przez nominatów jednej strony politycznej. Ten zabieg został dokonany w sposób – delikatnie mówiąc – nie do końca zgodny z prawem pod koniec poprzedniej kadencji w czasie poprzedniego rządu i pan wtedy nie zareagował. Dlaczego pan nie zareagował? Dlaczego Komisja nie zareagowała? Powiem panu dlaczego. Dlatego, że to była pańska strona.
Ja poniekąd rozumiem, dlaczego pan uważa, że instytucje, również polskie, powinny być zdominowane przez jedną stronę sporu politycznego. W Unii Europejskiej od niepamiętnych czasów rządzi jedna konstelacja polityczna i Państwo już tak przyzwyczaili się do tego, że jeżeli gdzieś następuje jakieś zróżnicowanie, to traktują to jako anomalię.
Panie przewodniczący, proszę mi wierzyć: jeżeli są spory w Trybunale Konstytucyjnym, to może dobrze. Jeżeli prawnicy się różnią, to może dobrze, czyż nie? Czy pan uważa, że w takim razie jeden chór nominatów jednej strony powinien rządzić, sprawować kontrolę nad konstytucją w Polsce?
Zresztą podobna postawa charakteryzuje – mówię to z przykrością – Komisję Wenecką, która w lutym tego roku przyjechała po raz pierwszy do Polski i nawet nie raczyła się spotkać z sędziami Trybunału Konstytucyjnego, którzy mają inne zdanie. Po prostu nie raczyła, a ich przekazaną pisemnie opinię wyrzucili do kosza. To jak ja mam – przepraszam – wierzyć w wiarygodność Komisji Weneckiej? Co to są w ogóle za obyczaje?
I nie mówcie mi tutaj, że chodzi wam o wolność i prawa, bo o nie chodzi wam najmniej. Chodzi wam – jeszcze raz powtarzam – o zachowanie monopolu jednej strony. Choćbyście nie wiem jak długo mówili tutaj o wartościach europejskich, to prawda jest taka, że macie z tymi wartościami coraz mniej wspólnego.
Nie przestrzegacie traktatów. Panie przewodniczący, nie przestrzegacie traktatów! Cała ta procedura, którą pan i pana koledzy wszczęli przeciw Polsce jest pozatraktatowa. Pan to kompletnie ignoruje. Nie szanujecie zasady pomocniczości, nie szanujecie innych poglądów niż wasze, nie uznajecie zasad racjonalnej dyskusji, nie uznajecie rzymskiej zasady, że trzeba słuchać racji drugiej strony. Nie przestrzegacie innej rzymskiej zasady, że nikt nie może być sędzią we własnej sprawie. To wyalienowanie elit europejskich, unijnych z kultury europejskiej, które obserwujemy od dłuższego czasu, jest faktem głęboko zasmucającym i fatalnie rokuje.
Niedawno z moim kolegą – panem Tomaszem Porębą – napisałem do pana obszerny list, wskazując na rażące błędy – powtarzam: rażące błędy – w stanowisku pana i Komisji Europejskiej i nie chodzi o interpretację. Chodzi o rzeczowe błędy dotyczące polskiej konstytucji i polskiego prawa. Pan swoim zwyczajem i zwyczajem pańskich kolegów to kompletnie zignorował. Albo pan ich nie zrozumiał, albo pan udaje, że tego nie rozumie. To jest stara metoda – udawanie, że czegoś nie ma. Unia Europejska, zamiast stabilizować się, jest coraz bardziej rozkołysana, a Państwo ponoszą za to sporą część odpowiedzialności. Antagonizujecie społeczeństwa, pogłębiacie podziały, nie tylko w Polsce zresztą. Spójrzcie, jak gotuje się w większości krajów europejskich. Zamiast zjednywać sobie sojuszników, szukać wsparcia, produkujecie w coraz szybszym tempie nowych wrogów. Wrogów – mówię – nie reformatorów, takich jak ja czy moi koledzy z mojej grupy, którzy chcą Unię zreformować. Ale to nie może trwać wiecznie. No, jak długo ten proces ma trwać, proces generowania pokolenia nowych wrogów, którzy chcą Unię Europejską rozbić od środka?
Jaka jest na to Państwa odpowiedź? Więcej tego samego, tak? Więcej tego samego. To się wszystko może fatalnie skończyć. Wobec tego, na koniec, cóż mogę zrobić? Mogę się odwołać do jakiegoś autorytetu. Dedykuję panu, panie przewodniczący, i Państwu sławne zdanie ze Starego Testamentu, z Księgi Przysłów: „wyniosłość kroczy przed porażką, a duch pyszny przed upadkiem” .

För det första tycker jag att det är väldigt skamligt när du säger att ni är lägst ner på listan, när ni utför ett statligt våld mot kvinnor, mot polska kvinnor. Och där ni förnekar kvinnor rätten till sin egen kropp.

Czy przyzna pan – i to są moje pytania – że ta znienawidzona i brzydka Europa, która tak bardzo chce dokopać naszej ojczyźnie, cieszy się największym poparciem spośród wszystkich krajów europejskich właśnie w Polsce, wśród polskich obywateli? Ponad osiemdziesiąt procent Polaków popiera obecność naszego kraju w Unii Europejskiej. I drugie pytanie – czy nadal będzie pan twierdził, że trzech sędziów wybranych prawidłowo przez Sejm poprzedniej kadencji to sędziowie, którzy mają tworzyć jakąś mityczną większość (nie wiadomo czyją), bo to prawidłowo wybrani sędziowie?
Ryszard Antoni Legutko (ECR), odpowiedź na pytanie zadane przez podniesienie niebieskiej kartki. – To prawda, że w Polsce mamy bardzo duże poparcie dla Unii Europejskiej, ale jeżeli Komisja, w tym pan przewodniczący Timmermans, będzie dalej robiła to, co robi, z czasem to poparcie z pewnością spadnie. I już to widać. Czy można odpowiedzieć? Ja wiem, że trudno w ogóle z Państwem rozmawiać. Pani Przewodnicząca, czy może Pani łaskawie przywołać kolegów do porządku? Tego typu opinie, które zaczynają się pojawiać o Komisji Europejskiej, o niektórych naszych kolegach – nie będę wymieniał nazwisk – jeszcze rok temu by się nie pojawiły, a to wszystko dzieje się z powodu Państwa ciężkiej pracy. Myślę jednak, że Pan ma złe pojęcie na temat tego, co się stało w Trybunale, dlatego że Trybunał...

Tomasz Piotr Poręba (ECR). – Zwracam się do Pani, Pani Przewodnicząca, bo skoro zechciała Pani zwrócić się do pana profesora Legutki o odpowiedź na trzy pytania, a po pierwszym pytaniu Pani mu przerwała, to bardzo Panią proszę, żeby Pani jako przewodnicząca jednak umożliwiała odpowiedzi na pytania, o które Pani również zabiega jako prowadząca te obrady.

Malin Björk (GUE/NGL), blue-card question. – There is structural under-reporting of violence against women in all our Member States, and I think that is definitely the case in Poland also. Would you not agree that under the Istanbul Convention it is a fundamental right of women to live a life free from violence? Why should your government withdraw from that? For me, it is a question of the fundamental rights of women, and they are under attack in Poland. Why is that so?

Jeśli chodzi o Trybunał Konstytucyjny, panie przewodniczący Timmermans, również żaden wyrok Trybunału Konstytucyjnego nie mówił nic o trzech sędziach, którzy byli wybrani. Trybunał Konstytucyjny mówi o ustawach, nie o wyborze. Kwestia trzech sędziów pojawiła się w uzasadnieniu wyroku. Uzasadnienie wyroku nie jest częścią prawa. Ja wiem, że może to nowa informacja dla pana, panie przewodniczący, ale zaręczam panu, że tak jest.

Sophia in ‘t Veld, on behalf of the ALDE Group. – Madam President, I always think you are funny, Mr Legutko. For somebody who says that this debate should not take place, you have got a lot of speaking time from your Group. Having this debate, this is a very personal remark. In this debate today, my thoughts go to my former colleague, Bronisław Geremek, who sat next to me for a number of years. He was always a big hero of mine when I was still a student, and I was ever so proud that he was my colleague. Today, I stand, my Group stands, this House stands with the Polish people – just as the European Parliament stood with the Polish people in 2012, when we debated and condemned the website by Geert Wilders’ party from the Netherlands against the Polish people; as the European Parliament also stood by the Polish people this summer, when we mourned a Polish citizen who was the victim of xenophobic hate crime in the UK.
We stood by the Polish people then. We also stand by the Polish people today; we stand by the thousands who took to the streets yesterday at a protest organised by the Committee for the Defence of Democracy, which I commend for their actions. We also stand by our own sister party ‘Nowoczesna’ and other parties like the EPP colleagues who are present. They are protesting against the erosion of their rights, because like all EU citizens, Polish citizens are entitled to an independent judiciary. Polish women, like other women, are entitled to protection against domestic violence. Polish women, like other women, are entitled to free choice into decide over their own bodies. Polish people have a right to freedom of assembly, freedom of speech and freedom of thought, Mr Legutko.
Now the Polish Government is robbing the Polish people of their rights and freedoms. I wonder if this is what the Polish people voted for when they went to the ballot stations a year ago. Did they vote for the restriction of their freedoms? I do not think so, Mr Legutko. They voted for a good life, to get a job, education for their children, housing and infrastructure. That is what they voted for, Mr Legutko. They did not vote for restrictions on the freedom of the press or the independence of the judiciary.
Finally, a question to Mr. Timmermans: you have been criticising the Polish Government, but I would like to know what you are going to do? Because, in your letter of July 27 – I am coming to conclusion, Madam President – you described the situation in Poland as ‘a systemic threat to the rule of law’. Now, if that does not call for action by the European Commission, then what does? Even if you know that the Council will never vote for an Article 7.1 procedure, the Commission should take its responsibility and vote on that. We should put it on the agenda.

Malin Björk för GUE/NGL-gruppen. – Herr talman! Kollegor! För två månader sedan ville den polska regeringen kriminalisera och fängsla kvinnor och de som hjälpte dem att genomföra en abort. Det var ett drakoniskt lagförslag och därför var det kanske inte så oväntat att hundratusentals kvinnor och män i Polen och i solidaritetsdemonstrationer runt om i Europa gick ut på gatorna.
Den polska regeringen fick backa. Det var en seger för alla oss som ser kvinnor som fullvärdiga medborgare.
Nu kommer den polska regeringen tillbaka och fortsätter sitt angrepp på kvinnor. Regeringens ansvariga minister har deklarerat att landet vill dra sig ur Istanbulkonventionen. Jag säger det en gång till: dra sig ur Istanbulkonventionen. Var är vi någonstans? Detta är ett internationellt rättsligt grundläggande instrument för att bekämpa allt könsbaserat våld. Det är en fråga om mänskliga rättigheter, om rättsstaten, om grundläggande principer. Det är lika viktigt som respekten för mänskliga rättigheter.
Uppenbart är man orolig för folkets protester, för dessutom går man vidare med förslag, och det har röstats igenom, att inskränka demonstrationsfriheten.
För oss hänger attacken mot de demokratiska institutionerna och rättigheterna och attacken mot kvinnors rättigheter samman. Det är demokratin och grundläggande rättigheter som attackeras.
Jag vill se att kommissionen tar fighten för de grundläggande instrument som Istanbulkonventionen representerar. Man kan inte släppa den. Det ska inte finnas på kartan att ett medlemsland kan överge Istanbulkonventionen. Tack!

Terry Reintke, on behalf of the Verts/ALE Group. – Mr President, every child in Europe learns in their history classes about the peaceful revolution that took place in Poland and other countries of the European Union some 30 years ago. They learn about the strikes, the protests and the demonstrations that brave Polish citizens organised in order to struggle for democracy and the rule of law. My own image of Poland is strongly shaped by these images. If young people ask me today why they should go out on the streets and get politically engaged, I very often refer to precisely these protests.
In the last month, however, we have again seen mass protests and demonstrations in Polish cities and villages against restricting the right to free media, against limiting the rights of an independent jurisdiction, against depriving women of the right to their own bodies. All of these rights are fundamental rights and thus the European Union has to be concerned about them. We stand in solidarity with these movements and we support their struggles. Mr Legutko, if you are saying that we should not have this debate, I must honestly say that I would like not to have this debate and for these problems not to exist, but should I just shy away and close my ears to the concerns of thousands of Polish people who are asking me to speak up for them? Or should I shut my ears to the Venice Commission, an independent expert commission, that is saying that there are problems with the rule of law in Poland, and trust you? I don’t think so. I think democracy is about listening to different voices. This is why we are having this debate and this is why it is so important to exchange our views.
I think that the European Parliament will continue to stand with these people, whether in fighting against the restriction of freedom of assembly or the withdrawal from the Istanbul Convention, which has actually been announced by some in the Polish Government. But the real question – and I think you will have to give an answer to this today, Mr Timmermans – is, given that you have you have said that you are concerned and the Commission is concerned about the developments, what exactly will you do? Will you stand up? Will you take decisive steps in order to give a strong signal from both Parliament and the Commission that what has been happening in Poland is not only of concern but in fact needs action at European level?

W Polsce ludzie, którzy rządzili w komunizmie są chronieni zgodnie z prawem przez ten trybunał, i rzeczywiście obecna władza łamie przepisy, bo chce wprowadzić trochę inny porządek. Trybunał stracił moralne poparcie kraju.
Anna Maria Corazza Bildt (PPE). – Mr President, I also share the concern of the Polish people at the drift away from democracy and the rule of law in their country. The Constitutional Tribunal has disregarded since March – you said it so well, First Vice—President – the proposal to limit the right of assembly, thus undermining civil society. Does that mean that Polish women demonstrating for their rights will not be able to take to the streets anymore and attend the protests that I wholeheartedly supported? Would that be banned? There was another statement from the Minister of Social Affairs that Poland intends to withdraw from the Istanbul Convention on preventing and combating violence against women.
Today, as co-rapporteur for the Convention, I want to reach out to you, colleagues, and to the Polish Government, to engage in an open and constructive dialogue on their reservations. I call on you, First Vice-President, to initiate this dialogue together with the Council of Europe. Let’s do it based on facts, not ideology. And what is the definition of gender-based violence in the Convention? It is clear: it is violence done to women just because they are women. We are talking about domestic violence, sexual abuse, rape, child marriage, honour killings. To consider the Convention to be against our tradition and culture is a false interpretation, even according to the Council of Europe.
How could punishing criminals and protecting girls be considered against Christian values? I therefore ask the Polish Government to reconsider their intention to withdraw from the Convention. I am sure we share these common values on zero tolerance against violence. I want to conclude by saying that we in the PPE continue to stand by the people of Poland demonstrating for their rights.
Tanja Fajon (S&D). – Današnja razprava ni razprava proti Poljski, temveč za Poljsko – zato da bo korigirala svojo smer in spet postala država za vse svoje prebivalce.
Podpiram ukrepanje Evropske komisije. Podpredsednik Timmermans, ali bo zaleglo? Nikoli ne bom tiho, ko bodo vlade, kot je poljska, grobo, a brez posledic kršile številne pravice svojim državljanom.
Poljska se vse bolj odmika od demokratičnih vrednot, vse bolj očitne so kršitve pravic ženskam in krnjenje vloge ženske v družbi. Vse bolj hujša je situacija v medijih, ki postajajo manipulativni, in vse opaznejši je porast skrajnega desničarstva in kriminalnih dejanj iz sovraštva. Vse slabša je vloga pravne države.
Kolegi, današnja razprava ni proti Poljakom, ampak proti trenutni poljski vladi, in je razprava, ki zahteva pozornost tudi jutri na Svetu Evropske unije.

Syed Kamall (ECR). – Mr President, here we are again. Yet another session, and yet another opportunity for this Parliament to lecture Poland, its people and its government on how to run a democracy. But when you try to lecture a government, especially one which won a democratic election with a large majority, you lecture not just the governing party, but also the people who voted for that governing party.
No wonder people feel more detached than ever from Brussels. The Polish Government needs no lecture from you guys on how to run a democracy; but the Left, they like to give lectures on democracy while the hypocrisy blinds them to the authoritarian regimes that they have supported in the past. Many on the left of this House kept silent or even supported Soviet socialism. While members of the Polish Government and governing party fought for years to throw off the shackles of communism and oppression, and on the week of the 35th anniversary of invoking martial law in Poland, this is fresh in our minds.
It is very clear that whatever everyone's role is in this situation, it is outlined in the Treaties. This House has no real role in this; it should be for the Commission. The tone here, where we were supposed to be having a debate, seems to be undermining dialogue – it is just polarising.
So often, Members in this House refer to the Treaties and call upon the Commission to act in a fair and impartial way; yet so many are happy to throw that rule book out the window if it means cheap political points can be scored here in the Parliament. Add to that, the Polish opposition parties that, having lost democratic elections at home, seek to attack their government in Brussels and Strasbourg – forgetting the fact that they packed the Constitutional Court when they were in power and did not follow international standards on media regulation, never missing the opportunity to play judge, jury and executioner.
Some here will argue that they are defending democracy and offering a helping hand, but that helping hand is starting to feel like a controlling fist. The tone of this debate and the ones before it is why some Member States now feel less equal than others. That is why when it comes to this issue, many brave Poles who fought against martial law are beginning to feel that in Brussels it has a master rather than a partner.

Sophia in 't Veld (ALDE), blue-card question. – My initial question was going to be whether after this intervention, you can still look yourself in the mirror in the morning, because I do not think you believe what you just said, Syed. Very disappointed. My more political question is going to be – and I think your allegation, that I, as apparently all of a sudden a part of the left, was a support of communism, is really hysterically funny, you know it is not true – but I wonder: if you say Poland is being singled out, you seem to have forgotten that I have been criticizing Hungary, Lithuania, the Netherlands, many other countries. My question to you is: why then did you do not support the report that was voted in this House on the pact for democracy, the rule of law and fundamental rights that covers all the Member States and treats all the Member States equally? I would have expected your support.
Syed Kamall (ECR), blue-card answer. – Because what I see from you, Sophie, is actually selective in your debate. Many people here have talked about the Istanbul Convention and criticised Poland for thinking of withdrawing from it – and I understand those concerns. But look at the Istanbul Convention. Do you know, when you count the numbers, there are 14 Members of the EU that have not ratified it? And yet you are hypocritical. You yourself, from your own country, are hypocritical, condemning the Poles who have ratified it. You are the biggest hypocrite I have seen.
Barbara Kudrycka (PPE). – Panie Przewodniczący! W tej debacie brakuje słów mistrza, dyrygenta tego, co teraz dzieje się w Polsce. Jarosław Kaczyński powiedział, cytuję, o uchodźcach: „Są już przecież objawy pojawienia się chorób bardzo niebezpiecznych i dawno niewidzianych w Europie: cholera na wyspach greckich, dezynteria w Wiedniu, różnego rodzaju pasożyty i pierwotniaki, które nie są groźne w organizmach tych ludzi, a mogą tutaj być groźne.” O wyrokach Trybunału Konstytucyjnego: „To są akty o charakterze prywatnym, które w żadnym wypadku nie mogą nabrać mocy prawnej przez publikację.” O działaniach opozycji: „No cóż, to są opary absurdu – coś między chorobą, wiadomo jaką, a jakąś burleską. Inaczej tego określić się nie da.” I o recepcie na opozycję: „Z naszej strony będą próby uporządkowania działań opozycji. Przedłożymy propozycje zmierzające do tego, żeby spór polityczny w demokracji przebiegał tak, jak powinien przebiegać.” Znamy to już z historii. Czy to nie jest groźne?
Bogusław Liberadzki (S&D). – Panie Przewodniczący! Panie Wiceprzewodniczący Timmermans! Troska o stan państwa prawa, demokracji i praw człowieka powinna nam zawsze towarzyszyć i dotyczyć każdego państwa, niezależnie od tego, jaki rząd w danej chwili w tym państwie panuje.
Jestem polskim posłem i wiem, że trzy czwarte Polaków popiera Unię – pokojową, otwartą, solidarną wspólnotę. Wiem, że Polacy nie zasługują na to, by wątpiono w ich wiarę i nadzieje pokładane we wspólnocie. I to nieprawda, że Polacy odwracają się od Unii, jak to powiedział pan Kamal; jest w błędzie.
Polacy natomiast mają prawo do życia w państwie demokratycznym, przestrzegającym swobód obywatelskich, zachowującym ciągłość. Mają prawo cieszyć się poczuciem dumy z historii. Mają prawo żyć w państwie, w którym nie stosuje się odpowiedzialności zbiorowej, w którym prawo nie działa wstecz, w którym działają niezależne sądy i organizacje społeczne. Rozwaga, umiar, dialog i odpowiedzialność to nasz obowiązek. I rządzących, i opozycji.
Anders Primdahl Vistisen (ECR). – Hr. Formand! Igen og igen skal vi have debatten her, i dette kammer, omkring Polen, omkring Ungarn og omkring andre lande. Hver gang majoriteten i dette hus bliver underkendt i nationalstaterne, i valg, hvor man vælger en mere EU-kritisk, mere EU-realistisk holdning, så tror I, at I skal gøre jer til overdommere over, hvordan et lands demokratiske regering skal agere og handle i det land, hvor den har vundet et valg. Det er skamfuldt!
Og det er endnu mere skamfuldt, når det er så tydeligt, at det eneste, der driver størstedelen af dette hus i den heksejagt, der finder sted mod Polen, er, at I er politisk uenige med den regering, der blev demokratisk valgt af det polske folk for et lille års tid siden. Og det er så tydeligt, når f.eks. ALDE-Gruppen lige har afholdt kongres i Warszawa, hvor man så på det efterfølgende møde her ved formand Guy Verhofstadt beslutter sig for at forslå igen at tage en sådan omgang Polen-bashing på husets dagsorden, hvilket står fuldstændig tydeligt i sammenhæng med det faktum, at I prøver at tage endnu et polsk oppositionsparti ind i jeres egen gruppe.
Eller når kommissær Timmermans vælger – i stedet for at indgå i en dialog med den polske regering, der igen og igen har svaret, når Kommissionen har henvendt sig – at gå uden om regeringen, at gå uden om de officielle kanaler og henvende sig direkte til det polske folk i en hadsk tone mod deres egen regering i en avis; i stedet for, som enhver ansvarlig Kommission burde gøre, at tage dialogen med den regering, der nu engang er valgt og repræsenterer Polen i Rådet. Og derfor må jeg sige til Kommissionen: Endnu engang har I bevist, at I agerer politisk! I er ikke dygtige embedsmænd! I er ikke forsvarere af Traktaten! I er politiske redskaber for jeres egen politiske agenda mod en demokratisk valgt regering, og det er ikke acceptabelt – hverken mod Polen eller mod noget som helst andet land i EU!
Josef Weidenholzer (S&D). – Herr Präsident! Polen ist ein großartiges Land und ohne Polen wäre Europa ein Torso. Deshalb sind die Entwicklungen in diesem Land von europäischer Bedeutung, besonders was die Rechtsstaatlichkeit betrifft. Unsere Diskussion ist keine Einmischung in die nationale Souveränität. Polen hat schließlich mit seinem Beitritt den Kopenhagen—Kriterien zugestimmt. Wir sind besorgt, dass die Verfassungskrise noch immer nicht gelöst ist, ja, dass die Lage von Woche zu Woche dramatischer wird.
Polen braucht keine juristische Anarchie. Polen braucht einen unabhängigen Verfassungsgerichtshof. Das ist wichtig in diesen turbulenten Zeiten in dem Land. Es ist eine bedenkliche Entwicklung, wie sich das Ganze in eine Spirale hineinzieht. Noch ist Zeit dafür, dass die polnische Regierung auf die Opposition zugeht und einlenkt und die Empfehlungen der Venedig-Kommission ernstnimmt. Ein gespaltenes Polen schadet nicht nur Europa, ein gespaltenes Polen schadet vor allem Polen selbst.

Róża Gräfin von Thun und Hohenstein (PPE), pytanie zadane przez podniesienie niebieskiej kartki. – Panie kolego Weidenholzer, wiem, że pan się bardzo interesuje tym, co się w Polsce dzieje, i śledzi to, i widzi pan zapewne, że rząd poprzez tak zwane media narodowe notorycznie obraża tych, którzy w Polsce walczą o prawo i o wolność. Chciałabym się pana zapytać: gdyby pan mógł się dzisiaj bezpośrednio zwrócić do tych, którzy wczoraj byli na ulicach, żeby bronić praworządności, co by pan im powiedział?
Josef Weidenholzer (S&D), Antwort auf eine Frage nach dem Verfahren der „blauen Karte“. – Ich würde diesen Menschen sagen, dass wir ihnen sehr zu Dank verpflichtet sind, dass sie sich als Europäerinnen und Europäer fühlen, dass wir in einem gemeinsamen Haus Europa leben und dass wir dieses gemeinsame Haus nach demokratischen, rechtsstaatlichen Prinzipien gestalten wollen.
Sylvia-Yvonne Kaufmann (S&D). – Herr Präsident, Herr Vizepräsident Timmermanns! Der deutsch-polnische Nachbarschaftsvertrag ist in diesem Jahr 25 Jahre alt geworden.
Ein Grund zum Feiern, denn nie waren unsere beiden Länder so eng miteinander verbunden. Dass sich so viele Deutsche und Polen engagieren, um diesen Vertrag mit Leben zu erfüllen, freut mich besonders. Gerade deshalb bin ich aber auch zutiefst besorgt über das Agieren der polnischen Regierung mit Blick auf Rechtsstaatlichkeit und Demokratie. Beunruhigend ist zudem, wie der Umbau des Landes durch die Neubesetzung von Ämtern und Positionen in Medien, Kultur oder Verwaltung vorangetrieben wird.
Diese höchst bedenklichen Vorgänge haben jüngst auch meine Heimatstadt Berlin erreicht. Dort ist man fassungslos über die überraschende Abberufung der verdienstvollen Leiterin des polnischen Kulturinstituts, noch dazu mit der unerhörten Begründung, sie habe sich übermäßig mit polnisch-jüdischen Themen beschäftigt. Dagegen gibt es zu Recht viel Protest. Es bleibt zu hoffen, dass sich die polnische Regierung der Kritik an ihrem Regierungshandeln nicht länger verschließt, auch im Interesse der künftigen Rolle Polens in Europa.

Juan Fernando López Aguilar (S&D). – Señor Presidente, este es un debate absolutamente necesario y por eso resulta triste y revelador que haya tenido a ratos momentos grotescos: cuando se invocan argumentos que van desde la defensa de la libertad o la soberanía para encubrir la incapacidad de entender que ser Estado miembro de la Unión Europea comporta obligaciones y que, por tanto, concierne a este Parlamento Europeo preocuparse por los 40 millones de polacos, incluso por ese 34 % que haya votado al Gobierno actualmente en el poder cuando este restringe unilateralmente el pluralismo; cuando achica el espacio de la democracia; cuando reforma unilateralmente el Tribunal Constitucional; cuando cambia las reglas de juego sin someterlas a consenso; cuando se deteriora el entendimiento básico de que este es un club de reglas, de obligaciones, que conciernen también a Polonia como Estado miembro.
Por eso, esto no es un ataque a Polonia, es una reivindicación de que esta es la casa de la libertad, de los derechos fundamentales, de la defensa del Estado de Derecho, y eso va también para con ustedes, señores de la derecha polaca.
Marek Jurek (ECR). – Panie Przewodniczący! Mam zaszczyt reprezentować partię, która nie miała nic wspólnego ani z rozpoczęciem – wtedy, kiedy Państwo rządzili, w czerwcu ubiegłego roku – sporu o Trybunał Konstytucyjny od Państwa nielegalnych działań, ani potem z eskalacją tego sporu, ale wiem jedno: w tym wszystkim nie chodzi ani o Trybunał, ani o traktaty, ani najmniej o prawa człowieka. Bo gdyby chodziło o prawa człowieka, to pan przewodniczący Timmermans już od wielu dni reagowałby na to, co słyszymy z Francji o ustawie, która ma zamknąć usta portalom występującym w obronie życia nienarodzonych. Gdyby chodziło o Trybunał Konstytucyjny i demokrację konstytucyjną w Polsce, to pan przewodniczący Timmermans przypomniałby tym wszystkim entuzjastom aborcji, że w Polsce ochrona życia od poczęcia jest częścią porządku konstytucyjnego ustanowionego przez Trybunał Konstytucyjny orzeczeniem z 1997 roku, potwierdzonym orzeczeniem z 2003 roku, potwierdzonym ubiegłorocznym orzeczeniem Trybunału, którego składu nikt nie kwestionował. Gdyby chodziło o Trybunał Konstytucyjny. Ale tu chodzi tylko o atak na mój kraj.
Tibor Szanyi (S&D). – Elnök Úr! Tisztelt Képviselők! Én magyar képviselő vagyok, és a történelmünkben ez úgy volt, hogy Lengyelország és Magyarország kéz a kézben járt, egymást követték. Hol előbb történt valami Lengyelországban, aztán később Magyarországon, hol előbb Magyarországon és később Lengyelországban. Jó barátságban van a magyar és a lengyel nép. Mindazonáltal azt kell tapasztaljam, hogy mindaz, amit most Lengyelországban láttunk, vagy látunk, ez Magyarországon sajnos sokkal korábban bekövetkezett.
Az, hogy a kormány, a magyar kormány egy éve óriásplakátokon uszít, szó szerint uszít a menekültekkel szemben, és egyáltalán, hogyha csak az isztambuli egyezmény témájára szorítkozom, azt kell mondjam, hogy ugyanúgy Magyarország is kifarolni látszik az isztambuli egyezményből.
Tisztelt Képviselőtársaim! Én szeretném fölvetni azért azoknak a felelősségét is, elsősorban a Néppártra gondolok, akik pont azért, mert a soraikban ül a FIDESZ – a magyar kormánypárt – hosszú-hosszú hónapokon át eltűrték azt, ami most már sajnos úgy látszik, az egész kontinensen végigsöpör.
Ivan Jakovčić (ALDE). – Gospodine predsjedniče, neću govoriti o ustavnom sudu, neću govoriti o Istambulskoj konvenciji, niti ću govoriti o pravu na okupljanje. Reći ću vam samo, dragi prijatelji, da sam kao mladić '81. godine vlakom iz Hrvatske otišao u Varšavu, otišao sam u Gdanjsk potražiti vas, potražiti vaše prijatelje iz Solidarnośći. Pjevao sam u katedrali u Gdanjsku vaše pjesme jer sam vam vjerovao, jer sam vjerovao jer je Poljska bila u mom srcu i u Hrvatskoj smo pjevali Poljska u mom srcu i srce nam je bilo puno. Ali moje je srce danas, dragi prijatelji, prazno i tužno. Kad vas gledam kako nam se smijete ovdje podsjećate me na one najgore komuniste koji su se smijali i vjerovali da će biti vječni. Njih nema, a vjerujem da će i vaša politika isto tako nestati.
Elżbieta Katarzyna Łukacijewska (PPE). – Panie Przewodniczący! Ja zacytuję wypowiedzi pana Legutki, gdyż idealnie zobrazował zachowanie obecnego rządu Prawa i Sprawiedliwości.
Nie słuchacie innych racji, nie słuchacie innej strony, nie dopuszczacie do głosu innych, antagonizujecie społeczeństwo, w szybkim tempie produkujecie wrogów, dodam od siebie – i w Polsce, i za granicą. Macie dwóch wrogów: niewiedzę i uprzedzenie – pycha zawsze kroczy przed upadkiem. To prawda i mam nadzieję, że nastąpi upadek rządu PiS. Wasza demokracja polega na obronie prokuratora stanu wojennego, a nie na obronie tych, którzy o tę wolność walczyli i siedzieli w więzieniach.
Do pana Kamalla: faktycznie PiS wygrał w demokratyczny sposób, ale Polacy nie udzielili demokratycznego mandatu do łamania konstytucji i ograniczania wolności.
I do Polaków: kochani, ja nie słyszałam, aby w tej Izbie ktokolwiek krytykował Polskę i Polaków. Zawsze z dumą mówi się o naszych osiągnięciach – krytykuje się rząd Prawa i Sprawiedliwości!
Maria Arena (S&D). – Monsieur le Président, le 1er octobre, des milliers de femmes polonaises étaient dans les rues, non pas pour soutenir le gouvernement Kaczyński, mais pour dire qu’elles avaient des doutes sur la protection de leur intégrité physique, parce que ce gouvernement voulait prendre des mesures afin de retirer la protection à leur intégrité physique dans le cadre des nouvelles lois sur l’avortement.
Il est de notre devoir, élus européens, de défendre ces femmes, ces femmes polonaises qui demandent qu’elles soient défendues dans leur intégrité physique. C’est cela que nous faisons aujourd’hui, vous n’êtes pas ceux qui défendez les femmes polonaises, nous sommes ceux qui défendons les femmes polonaises.
Je demande aussi à la Commission qu’elle puisse intégrer cette question du genre quand on parle de la question des droits fondamentaux, parce que même si on est femme, nous avons aussi droit aux droits fondamentaux européens.

Frans Timmermans,First Vice-President of the Commission. – Mr President, I have listened very carefully to this debate. Please let me make a few points.
First of all, after the painful experiences of the first half of the last century, the free part of Europe – those of us who were lucky enough to end up on the right side of the Iron Curtain – immediately understood, inspired by Winston Churchill – and I am saddened by the fact that Mr Kamall, who made such horrible allegations, has left so I can’t answer him personally – what Churchill brought to the table, which was this: we have seen that it is possible to use democracy against the rule of law simply by saying, ‘I have a majority, therefore I dictate what the rule of law is’.
That is why the Council of Europe, which was created before this institution, always said that, in a democracy, you accept the limits on democratic action which are set by the rule of law, which is controlled by a completely independent judiciary. That is the very foundation of democracy in Europe after very, very painful experiences in our common history. As soon as the Iron Curtain fell and the Polish people had fought for their liberty and obtained their liberty, they immediately subscribed to that principle and wanted to join the Council of Europe as soon as possible and, as a follow-up to that, also the European Union.
The fundamental principle is that you respect the rule of law, you respect human rights and you respect democracy, but you don’t use one against the other. There is a balance between the three that is essential for the European Union – for Europe – to remain free. I cannot understand that some people would use the word ‘freedom’ to fight the very concept of the rule of law on the basis of a democratic majority. The strength of democracy is based on the fact that those who have the majority respect the limits that the rule of law places upon them. This is the context within which we work and I am saddened by the fact that, with all the propositions we have made from our side for a dialogue with the Polish Government, we see exactly the same thing again here today in this Chamber. Mr Legutko took eight minutes not to go into the three points that we have put on the table with the Polish Government. What did he say about not publishing the rulings of the Constitutional Tribunal? Nothing.
If you respect the division of powers and if you respect the independence of the judiciary, you cannot as a government pick and choose which rulings of a Constitutional Tribunal you like and only publish those you like. You cannot do that. That is in violation of the Polish Constitution. You cannot ignore the vote in a parliament to elect judges to the Constitutional Tribunal simply because you do not like the composition of that previous parliament. When judges are lawfully elected, they should be sworn in by the President of the Republic. That is in line with the Constitution. You cannot introduce ways of operating the Tribunal that are clearly in violation of the Constitution. The arbitrator there is the Constitutional Tribunal, so the least you should do is submit these draft laws or laws to the Constitutional Tribunal and then accept the judgment of that Constitutional Tribunal. That’s the whole point of respecting the rule of law.
Also in political terms, I have already said something about some people here using freedom against this very principle. This is not the Commission of others looking at Poland. I am also a Polish Commissioner. I feel a responsibility for the Polish people. I feel a responsibility for the rule of law, all across the European Union. I can tell you, on a personal note, that I might not even been alive had my family, my father not been liberated in 1944 by Polish soldiers who offered their lives for our collective freedom. So I feel a huge debt of gratitude towards the Polish people, a personal debt of gratitude which compels me to insist on these points and to continue on these points. These men who freed us never saw freedom themselves, but their children and grandchildren are living in a free, strong and independent Poland. Poland has never been as independent as it is today as a full-fledged member of NATO and the European Union. This is something I cherish. This is one of the greatest achievements of European history.
So please be aware. It is not only in Poland. I see it in many countries: nationalists and ultranationalists attacking judges everywhere in a personal way, attacking the judiciary, and ignoring the rulings of judges. This should be a warning to all of us, not just in Poland. We see it all across the European Union in some states: personal attacks discrediting the so—called elites. Who are these elites attacking the freedom of the press? I am not saying it is happening in Poland, but I am saying that it is a European phenomenon we should be aware of.
Freedom is what so many people fought for. The European Union, based on the rule of law, democracy and respect for human rights is the concrete expression of the will of freedom, of 500 million Europeans. That is why I believe that these institutions – the European Parliament and the Commission – have a responsibility, where we can, to help 500 million Europeans in the expression of their freedom. For that, we need an independent judiciary in every single Member State, we need full respect of the separation of powers, which is an essential element of our freedom, and we need the possibility to debate and discuss.
Because another element I warn about is portraying your adversaries as enemies. We are political opponents sometimes and we have a political debate. With your adversary you have a debate; your enemy you want to destroy or ignore. In a democracy there are no enemies, there are adversaries. That is how this Parliament operates, that is how the Commission wants to operate, and that is what we need to defend for our children and grandchildren and for our collective future: a Europe whole and free, based on democracy, the rule of law and human rights.
