  Președintele. – Următorul punct de pe ordinea de zi este dezbaterea privind raportul lui Agustín Díaz de Mera García Consuegra, în numele Comisiei pentru libertăți civile, justiție și afaceri interne, referitor la propunerea de regulament al Parlamentului European și al Consiliului de modificare a Regulamentului (CE) nr. 539/2001 de stabilire a listei țărilor terțe ai căror resortisanți trebuie să dețină viză pentru trecerea frontierelor externe și a listei țărilor terțe ai căror resortisanți sunt exonerați de această obligație (revizuirea mecanismului de suspendare) COM(2016)0290 - C8-0176/2016 - 2016/0142(COD).

  Agustín Díaz de Mera García Consuegra, ponente. – Señor Presidente, señor Comisario, lo primero que quiero hacer es agradecer el buen trabajo de todos los ponentes alternativos que, independientemente de su voto final, han cooperado lealmente y han demostrado su gran espíritu europeísta. Todos los Grupos han estado a la altura de lo que se les pedía y hemos sabido ver las implicaciones que este informe tenía sobre la política exterior de la Unión, la política general de visados y, sobre todo, sobre los futuros procesos de liberalización.

Ucranianos y georgianos seguían nuestros debates y pedían amparo al Parlamento ante la actitud del Consejo, quien ligó sin base jurídica la aprobación de este informe a la negociación de esos otros expedientes. Espero sinceramente que, ahora que vamos a aprobar el mecanismo de suspensión reformado, el Consejo coopere con el Parlamento en la rápida exención de visados para Georgia y Ucrania, países que desde hace tiempo han cumplido con los requisitos exigidos.

Han sido seis meses de intensos y duros debates en el Parlamento. Nos empleamos a fondo para reformar este mecanismo y hacerlo más efectivo, operativo y ágil. En todo este tiempo hemos presentado hasta cuatro propuestas de compromiso diferentes que intentaban acomodar las posiciones de todas las partes. Desgraciadamente, veíamos cómo todas estas propuestas eran rechazadas por el Consejo sin ningún motivo jurídico. Espero que, una vez que finalicen todos los expedientes conexos, podamos conocer la intrahistoria de la posición de algunos Estados miembros, especialmente de aquellos que bloquearon el acuerdo hasta bien avanzada la noche del jueves.

Sé que no es el texto ideal. No es lo que hubiéramos deseado. Todos hemos hecho grandes concesiones, pero sin olvidar nuestras posiciones: defender los derechos fundamentales y preservar el rol del Parlamento. Y si hemos hecho esto, ha sido conscientes de que con nuestro compromiso fortalecíamos el proyecto europeo.

El mecanismo tenía que ser más flexible, ágil y operativo, ya que las circunstancias que dieron lugar a la aprobación del originario en septiembre de 2013 se han visto desbordadas en los últimos años. Hoy podemos garantizar el futuro del espacio Schengen, evitando posibles abusos que pudieran derivarse de los procesos de liberalización de visados. Y, además, podremos activar este mecanismo en caso de que se produzcan algunas de las siguientes situaciones en relación con un tercer país que disfrute de la exención del requisito de visados para acceder a la Unión: incremento del número de nacionales a los que se rechaza el acceso o respecto de los cuales se compruebe que permanecen en el territorio del Estado miembro de manera irregular; incremento súbito de las solicitudes de asilo de una forma injustificada; riesgos o una amenaza inminente para el orden público o la seguridad interior de los Estados, o una disminución de la cooperación en materia de readmisión.

Y al mismo tiempo, en coherencia con nuestra política exterior, garantizamos que los criterios que dieron lugar a la liberalización de visados con terceros Estados se sigan respetando en el futuro. Hablamos de todos los criterios contenidos en el artículo -1 del Reglamento: coherencia regional, beneficios económicos, seguridad, entre otros; pero muy especialmente la protección de los derechos humanos y las libertades fundamentales, tanto en nuestro territorio como en el de origen.

Esto es algo que logramos a través de la introducción de un nuevo mecanismo de monitoreo por parte de la Comisión, por un plazo de siete años después de que se produzca la liberalización del requisito de visado, o posteriormente si existen indicios de violación de alguno de estos criterios. Y todo ello lo hacemos a su vez mejorando y asegurando el rol del Parlamento en la toma de decisiones sobre futuras reintroducciones temporales del requisito de visados.

Para nosotros es una cuestión emblemática la cuestión de los actos delegados. Es cuestión fundamental, como siempre he defendido. La política de visados es una materia compartida. El Reglamento (CE) n.º 539/2001 se modifica, como en este caso, a través del procedimiento legislativo ordinario y, por tanto, toda enmienda sustancial del acto de base debe hacerse a través de un acto delegado, y no de ejecución. Esta ha sido siempre nuestra postura, lo fue en el 2013 y así lo mantuvimos ante el Tribunal de Justicia en el año 2015, quien nos dio la razón en su sentencia de 16 de julio del mismo año.

En fin, para terminar esta parte de mi intervención, quiero señalar que la Comisión también cobra nuevo protagonismo, añadiendo a lo que ya tiene la activación del mecanismo como una facultad que compete a la Comisión, al Estado miembro concernido y a la mayoría simple de los Estados miembros. Y la Comisión también gana en competencias al poder activar el mecanismo de revisión y de evaluación."

  Dimitris Avramopoulos, Member of the Commission. – Mr President, honourable Members of the Parliament, the last-minute addition of this point in the plenary agenda was a very welcome one to me. The agreement on the reinforced suspension mechanism goes beyond the importance of the mechanism itself.

Let me start by expressing my thanks to our rapporteur, Mr Agustín Díaz de Mera, for his excellent work. I know it was not an easy job. You did it. Without his commitment it would not have been possible to reach an agreement before the end of the year. I also want to express my thanks to the Council Presidency, which brokered the deal in the Council.

Both institutions made decisive steps towards each other at the last minute, which made the agreement possible. The Commission also made some concessions for the sake of an overall agreement – for example, by accepting some elements of automaticity introduced by the Council. We also committed to taking into consideration the categories proposed by the Member States and to ensuring that these categories are sufficiently large to address in a proportionate way the circumstances.

The Commission has made declarations in that respect to COREPER. Overall we have jointly succeeded in making the suspension mechanism a more effective instrument for our common visa policy. It will enable the European Union to react quickly in situations of strong migratory pressures or high security risks by suspending the visa exemption for certain third-country nationals.

The final outcome allows for a flexible approach and a proportionate reaction to the circumstances encountered. Very importantly, it also allows for a dialogue with the third country concerned to remedy the situation that led to the suspension. By adopting this strengthened suspension mechanism we will be able to pursue our visa liberalisation strategy based on stronger safeguards.

I am pleased to know that the trilogue on visa liberalisation for Georgia has been successful, and I am looking forward to the same outcome for Ukraine. These two countries have concluded a series of reforms to implement their so-called visa liberalisation road map, and it is now for us to deliver and grant to their citizens visa-free travel to Europe.

Our common priority now is to accelerate the procedures for the entry into force of the suspension mechanism as well as for the adoption of the visa liberalisation proposals for Georgia and Ukraine. We have delivered on the commitments made to our partners. The correct implementation of visa-free travel for Georgia and Ukraine will only be beneficial mutually, enhancing the cultural and economic exchanges and strengthening mobility between these countries and the European Member States.

It is an important and symbolic achievement, bringing people and nations closer. I hope that it will become a reality early in spring thanks to the agreement on the suspension mechanism that we are discussing today.

  Mariya Gabriel, au nom du groupe PPE. – Monsieur le Président, avant toute chose, merci et félicitations au rapporteur pour son travail remarquable.

Le Parlement européen est colégislateur pour cette politique des visas et nous devons continuer à faire respecter nos prérogatives.

J’aimerais formuler trois remarques. Premièrement, la révision du mécanisme de suspension fait partie de l’approche holistique pour une gestion intelligente et contrôlée de la migration et de la mobilité. Plus de sécurité grâce à davantage de flexibilité pour déclencher le mécanisme; c’est un premier succès. Il faut toutefois rappeler les principes fondamentaux qui devront guider nos décisions si le mécanisme devait être déclenché: un examen au cas par cas, sur des critères précis, avec l’intérêt des citoyens comme ligne directrice.

Deuxième remarque, et je dois encore féliciter le rapporteur, car, grâce à l’introduction de la possibilité de suspendre l’exemption pour certaines catégories de personnes, nous conservons le potentiel de la politique des visas comme outil de la politique étrangère et de dialogue politique.

Enfin, j’insiste aussi sur la libéralisation des visas avec la Géorgie et l’Ukraine. Le Conseil avait décidé de lier la révision du mécanisme à ces deux autres dossiers. Un accord a été trouvé sur le mécanisme et je n’accepterai plus aucun retard superflu. Je compte sur la présidence maltaise pour commencer les trilogues sur l’Ukraine dès janvier.

  Tanja Fajon, v imenu skupine S&D. – Hvala predsedujoči, najprej hvala poročevalcu De Meri za izjemna pogajanja, ki so zavarovala interese Evropskega parlamenta in vseh evropskih državljanov. In odprla tudi vrata Gruzijcem in Ukrajincem za skorajšnja potovanja brez vizumov.

Kolegi, vizumska politika Unije je eden izmed najbolj otipljivih in konkretnih instrumentov evropske zunanje politike. Vsaj takšna je bila v preteklosti. Spominjam se izjemnih čustev ljudi z Zahodnega Balkana, ko smo jim uspeli odpraviti vizume.

Danes ta ista vizumska politika izgublja privlačnost zaradi nenehnega zaostrovanja. Na eni strani zaradi dodatnih, tudi političnih, kriterijev za odpravo vizumov in novih ukrepov, kot so uvedba pametnih meja ali ETIAS-a. Na drugi pa zaradi nenehne grožnje po ponovni uvedbi vizumov, kar omogoča na novo sprejeti mehanizem o suspenzu.

Spoštovani komisar!

Evropska vizumska politika ima še drugo ključno plat, to je vzajemnost. Evropska unija mora imeti tudi pogum, da ukrepa, ko gre za vprašanje vzajemnosti. Danes Komisija še vedno dovoljuje drugorazrednost državljanov kar petih članic Unije in zavestno krši svoja lastna pravila. V Parlamentu bomo pozorno spremljali izvajanje novih pravil in bomo v primeru zlorab odločno ukrepali.

  Monica Macovei, în numele grupului ECR. – Domnule președinte, îl felicit și pe colegul nostru Augustin Diaz de Mera, care a modificat regulamentul foarte bine și sub presiune, cu negocieri târziu în noapte - am participat la acestea, fiind raportor al grupului meu.

Mecanismul de suspendare al scutirii de vize, în prezent, nu este adecvat și de aceea am modificat practic regulamentul în ceea ce privește procesul de suspendare și acest lucru îl vom vota mâine.

Este foarte important să înțelegem că în joc este și credibilitatea Uniunii Europene, care acordă scutire de vize unor state și apoi, evident, că așteaptă ca acele state să continue progresele și criteriile pe care le-au îndeplinit în momentul scutirii de vize. Dacă fac pași înapoi, nu e normal să continue să beneficieze de scutirea de vize.

De asemenea, credibilitatea noastră în fața cetățenilor europeni, care văd că am scutit de vize cetățenii unor state, dar apoi văd că aceștia încalcă ordinea publică, văd că aceștia nu vin cu intenții bune și curate pe teritoriul Uniunii și creează probleme. De aceea este foarte bine pentru credibilitate.

Ce modificăm, foarte pe scurt, sunt: termenele pentru cererea de suspendare a scutirii de vize s-au scurtat, de asemenea, motivele pentru a cere suspendarea scutirii de viză s-au mărit și unul dintre ele este nou, anume nerespectarea obligației de readmisie a migranților acolo unde există astfel de acorduri.

De asemenea, s-a introdus un mecanism nou de verificare a criteriilor care au existat atunci când a fost scutit de vize un anumit stat, dacă aceste criterii mai persistă și nu s-a produs un regres. Toată lumea va fi mai responsabilă, și statele membre, și Uniunea.

  Petr Ježek, on behalf of the ALDE Group. – Mr President, visa liberalisation is a valuable political tool for the European Union which also offers significant advantages for the citizens of the third countries concerned. At the same time, for the security of EU citizens, we need an efficient suspension mechanism to avoid any abuse. This upgraded mechanism makes it easier to alert the Commission to irregularities and emergencies that could justify a reintroduction of visa requirements.

It was not easy to reach an agreement. Both institutions had strong views on how this mechanism should be activated. Both Parliament and Council had to make concessions, resulting in a two-step approach which I believe in the end does not affect the main objective of this proposal; but we lost time due to the interinstitutional in-fighting.

The Council made this agreement a prerequisite for approving new liberalisation agreements such as those with Georgia and Ukraine. Even though we reached an agreement on the mechanism, it seems Member States are still delaying those liberalisation agreements. Ukraine and Georgia made enormous efforts to reform and fulfil our criteria. It is up to us now to deliver and be a reliable partner. The European Parliament is more than ready, and I call on the Member States not to delay the visa liberalisation any more.

  Marie-Christine Vergiat, au nom du groupe GUE/NGL. – Monsieur le Président, je voudrais tout d'abord remercier notre rapporteur et sa ténacité pour tenir notre mandat. En vain!

Ce texte est significatif de ce que j'appellerais l'obsession migratoire des États membres. Au début des années 2000, quand le texte sur l'obligation de visa et ses exemptions a été mis en œuvre, nous étions dans un tout autre paysage et la volonté de l'Union était d'ouvrir ses frontières aux ressortissants des pays avec lesquels elle entendait avoir de bonnes relations. Les accords de libéralisation ont été mis en œuvre avant même que le Parlement européen ne les approuve.

Depuis quelques mois, changement total de cap. Les nouveaux accords piétinent dans l'attente de l'adoption de ce mécanisme de suspension. Le Parlement européen a été soumis à un véritable chantage et, au lieu d'améliorer le texte, Conseil et Commission n'ont eu que la volonté de le durcir, les États concernés étant jugés à leur capacité d'être les bons gendarmes de l'Union européenne, notamment au regard des accords de réadmission, et peu importe que les droits fondamentaux soient bafoués.

Quand on sait quels sont les acteurs concernés par le blocage, Géorgie et Ukraine, qui ont rempli leurs obligations, mais aussi Kosovo et Turquie, c'est sans surprise. La GUE/NGL ne vous suivra pas sur ce terrain.

  Heidi Hautala, on behalf of the Verts/ALE Group. – Mr President, once, President Poroshenko of Ukraine said at the Eastern Partnership Summit in Riga: ‘I was born visa free’, referring to some demonstrators outside the house who were calling for visa freedom for Ukrainians. And it has been very disappointing to see how long their justified wishes have had to wait for realisation.

Unfortunately, I must say that the most disappointing of all was that the Council wanted to link the visa waiver of Georgia and Ukraine with this suspension clause. We are not happy about it; it gives too many possibilities for EU Member States to restrict the visa waiver on grounds that may lead to human rights violations, for instance when returning illegally-entered migrants to the EU. I believe that the European Parliament has rightly insisted that we need to have more of a say in how the Commission will actually induce this suspension clause, so that it is not arbitrary.

  Gerard Batten, on behalf of the EFDD Group. – Mr President, this legislation is supposedly intended to ensure that visa liberalisation is not abused. It is supposed to ease the concerns of Member States, those concerns being that visa-free access for Ukraine and Georgia will lead to another influx of migrants. This is quite reasonable, given that Ukraine and Georgia have a combined population of 45 million people, while the average income in Georgia is GBP 320 per month and the average income in Ukraine is GBP 160 per month.

If visa-free access is agreed, many hundreds of thousands, or even perhaps millions of people, will come to Europe and very many – visa or no visa – will not leave. These measures are in fact a pathway for the EU to conclude visa-free agreements with those countries. While the UK is not bound by this legislation, the UKIP MEPs will oppose it.

  Gilles Lebreton, au nom du groupe ENF. – Monsieur le Président, Schengen est un malade en coma dépassé, mais l’Union européenne tente encore de le sauver.

Cette fois, il s’agit de rassurer l’opinion publique en renforçant le mécanisme européen de suspension de visa. L’objectif est de pouvoir rétablir temporairement l’obligation de visa pour entrer dans l’Union en cas de pic soudain d’immigration irrégulière.

Cela ne marchera pas, mais l’Union s’en moque, car son véritable objectif est ailleurs. Elle veut donner des garanties illusoires pour faire passer la suppression de visa pour les 45 millions d’Ukrainiens. Alors qu’il faudrait nous protéger de la vague migratoire en restaurant des contrôles à nos frontières nationales, l’Union fait l’inverse, en ouvrant encore davantage ses frontières. L’Union continue à rêver d’un monde sans frontières, alors que partout dans le monde, les États rétablissent leurs frontières.

Son rêve est un cauchemar que les peuples européens rejettent partout où on ose les interroger par référendum. Aux Pays-Bas, au Royaume-Uni, en Hongrie, en Italie et demain en France.

  Tomáš Zdechovský (PPE). – Pane předsedající, pane komisaři, nejdříve mi dovolte poděkovat a poblahopřát panu Díazi de Merovi za skvělou práci, kterou na tomto materiálu odvedl. Já jsem trochu překvapen reakcí kolegy Battena a dalších, kteří tady reagovali tak, že k nám opravdu budou chodit lidé z Ukrajiny nebo z Gruzie. Vždyť je to normální nesmysl, pane kolego. Vy strašíte několik měsíců po referendu o brexitu znovu veřejnost.

Já si myslím, že hodně mechanismů tady v Evropské unii v souvislosti s migraniční krizí nefungovalo. A tady je právě snaha tento mechanismus znovu nastolit a zavést ho v efektivních způsobech, za předem stanovených podmínek. V současné době je vlastně pozastavení velmi pomalé, neboť nedisponujeme dostatečnou flexibilitou. Tento nástroj, který byl teď vyjednán, nám tuto flexibilitu dává. Proto podporuju tento návrh a podporuju to, co bylo vyjednáno.

  Claude Moraes (S&D). – Mr President, thank you and colleagues have said what I wanted to concentrate on, which is that the rapporteur, Agustín Díaz de Mera García Consuegra, and colleagues worked on this file as best they could. The LIBE Committee was locked into six months of very difficult debate with the other institutions. We maintained a position and we ended with the mechanism which speaks not only to dry procedure in relation to visas, but speaks to the hard work of this Parliament in relating to countries. You can see Georgians and Ukrainians here in this Parliament who are waiting to hear about the suspension mechanism, about the work that has been done in securing for them good news about the European Union.

I agree with what the Commissioner has said and indeed other Members of this House. The conclusions of these negotiations between the Parliament and Council have been one of the key priorities for our committee. I want to thank everyone who has been involved in this bid for visa-free travel and colleagues. Sorry, President, I thought I had two minutes. No? Just one minute.

Let me just thank the rapporteur again. Thank you very much Mr Agustín Díaz de Mera García Consuegra. I conclude.

  Cecilia Wikström (ALDE). – Herr talman! Ja, jag vill så klart också stämma in i kören som sjunger kollegan Díaz de Meras lov för hans outtröttliga och enastående arbete med denna komplicerade fråga.

Trots bitvis hårt motstånd i rådet och ibland till och med ganska kontraproduktiva interventioner har vi nu nått i mål med denna upphävande mekanism. Och det är goda nyheter!

Det är viktigt att vi har nått enighet eftersom viseringsfriheten för Georgien och Ukraina har berott på om EU skulle kunna visa att vi kan leverera. Nu har vi gjort det, och vi kan glädja oss åt framtida kontakter och utbyten mellan EU, Georgien och Ukraina.

I en tid där det tycks som om allt fler vill bygga murar är det viktigt att vi nu klarar av att sänka trösklar och också bygga broar mellan människor. Och att vi kan visa att tillit och förtroende är möjligt.

Så detta är goda nyheter för EU och för alla som kommer att beröras av detta. Tack, herr talman!

  Carlos Coelho (PPE). – Senhor Presidente, felicito também o meu Colega Díaz de Mera pelo excelente trabalho que desenvolveu como, aliás, é costume.

A política europeia de vistos, em particular a isenção de vistos, é um elemento essencial das relações externas da União, permitindo uma melhor cooperação com Estados terceiros. Cooperação que é especialmente importante com os países vizinhos. A liberalização de vistos com a Geórgia e a Ucrânia - que este Parlamento já aprovou - é um exemplo paradigmático.

A aprovação deste mecanismo de suspensão vai contribuir para mais segurança, permitindo suspender a isenção no caso de um aumento substancial de permanências irregulares. Ela também será possível no caso de desrespeito dos direitos humanos no Estado terceiro. Igualmente importante é a maior flexibilidade do mecanismo, conferindo uma maior e mais rápida capacidade de reação.

Finalmente, graças à posição determinada de Dias de Mera, ficou assegurado o envolvimento deste Parlamento em situações mais graves e que envolvam uma suspensão mais prolongada. Aqui chegados, é tempo de o Conselho desbloquear a liberalização de vistos com a Geórgia e com a Ucrânia. Não só os requisitos estão cumpridos, como é evidente a sua importância para a política externa.

  Caterina Chinnici (S&D). – Signor Presidente, onorevoli colleghi, Commissario, ringrazio il collega Díaz de Mera per il suo lavoro, certamente non facile.

Sono fermamente convinta che la liberalizzazione dei visti rappresenti un'opportunità in termini di sviluppo del turismo, del commercio e del dialogo internazionale. Comprendo, tuttavia, che le politiche in seno all'area Schengen debbano essere rese oggi più flessibili per essere adattate alle sfide della nostra epoca. Rientra in quest'ottica l'introduzione della possibilità di sospendere l'esenzione dall'obbligo del visto, qualora esistano elementi che provino una possibile minaccia alla sicurezza interna degli Stati membri.

Ma naturalmente è importante mantenere il sistema Schengen, pertanto ritengo necessario che, prima di attivare il meccanismo di sospensione, la Commissione valuti la situazione dei diritti umani del paese terzo oggetto della procedura sospensiva, al fine di verificare che la reintroduzione dell'obbligo del visto, ove necessario, non abbia impatti negativi sui cittadini in fuga da drammatici conflitti e da persecuzioni e non ci siano eventuali forme di abusi. Ed è importante, anche a tale proposito, che il Parlamento vigili attivamente sul processo di sospensione dei visti.

  Michaela Šojdrová (PPE). – Pane komisaři, Evropský parlament bude zítra rozhodovat o mechanismu pozastavení udělování krátkodobých víz. Je to nutná podmínka pro vízovou liberalizaci pro Ukrajinu a Gruzii. Věřím, že Evropský parlament tento mechanismus schválí, a občané těchto zemí budou moci od příštího roku cestovat na krátkodobé pobyty bez víz.

Ukrajina i Gruzie splnily všechny smluvní závazky stanovené v akčních plánech, včetně investic do pohraniční stráže či biometrických pasů. Jsem velkou zastánkyní co nejužších vazeb mezi Evropskou unií a zeměmi Východního partnerství, zejména Ukrajinou. Právě vízová liberalizace je hmatatelným benefitem pro občany a podnikatele a zlepší vnímání Evropské unie v dotyčných oblastech.

Naše občany můžeme uklidnit, že projednávaný mechanismus je tu právě pro ochranu před zvýšenými migračními toky a zneužíváním systému pro dlouhodobější nelegální pobyty.

  Ana Gomes (S&D). – Senhor Presidente, felicito o relator do Parlamento, Agustín Díaz de Mera, pela capacidade de fazer consenso num tema importante para a construção de uma verdadeira política de vistos da União Europeia. As novas regras permitem flexibilidade e uma rápida ativação do mecanismo de suspensão em caso de aumento substancial do número de nacionais do país em causa, ou das entradas irregulares no território da União Europeia, de aumento substancial de pedidos de asilo infundados, de falta de cooperação na readmissão e em caso de ameaças à ordem pública, ou de segurança interna, relacionadas com os nacionais do país terceiro.

Este acordo com o Conselho permitirá, esperamos, acalmar alguns dos Estados-Membros e, consequentemente, finalizar rapidamente a aprovação das propostas de acordo de liberalização de vistos com a Geórgia e com a Ucrânia. Resta esperar que estas regras não sejam usadas para perversos jogos políticos.

  Jiří Pospíšil (PPE). – Pane předsedající, já také pogratuluji panu zpravodaji k jeho výkonu. Je třeba přijmout jasná pravidla pro bezvízový styk a jeho případnou suspenzi, respektive pozastavení, protože bezvízový styk pro Ukrajinu a Gruzii je, podle mého názoru, mimořádně významný i z geopolitického hlediska. My musíme těmto zemím jasně otevřít náruč a nabídnout jim spolupráci tak, aby tyto země měly jasnou vizi do budoucna, protože situace v těchto zemích, jak víme, je velmi obtížná a jsou pod obrovským tlakem Ruska.

Já považuji za mimořádně důležité z geopolitického hlediska – jako poslanec za Českou republiku, která byla bohužel v druhé polovině dvacátého století, v rámci Československa, pod vlivem Sovětského svazu – spolupracovat se zeměmi bývalého Sovětského svazu, nabídnout jim otevřenou náruč a k tomu potřebujeme tato pravidla, která pan zpravodaj vyjednal. Velmi to vítám a pravidla kvituji.

Bien, ponente Díaz de Mera, por este trabajo sobre un código de visados que exige una regulación de las condiciones de exención de visado para terceros países y que llega en un momento que se ha calificado de no fácil y que es ciertamente difícil y negativo para el cumplimiento de los objetivos del espacio de libertad, justicia y seguridad, tal y como dispuso el Tratado de Lisboa. Porque el Tratado de Lisboa quiere una política común europea de visados, y lo cierto es que los Estados miembros vienen incrementando las condiciones impuestas unilateralmente, o evaluadas unilateralmente —que pueden dificultar la obtención de esos visados— y quieren potenciar las situaciones en las cuales ellos pueden evaluar y decidir la exención de visado y la eliminación de los visados.

Por tanto, nos encontramos en una situación realmente difícil que se conecta con otros expedientes que vienen siendo bloqueados por el Consejo, como es, lamentablemente, el Código de visados. Pero me importa subrayar la importancia que tiene que tanto la Comisión como el Parlamento ejerzan su poder de evaluación del seguimiento de estos expedientes y de examen de las condiciones de suspensión de los visados.

  Stanislav Polčák (PPE). – Pane předsedající, já se rovněž připojuji ke gratulaci panu zpravodajovi, protože to dílo je opravdu úctyhodné. Chtěl bych pouze podotknout úvodem, že pro mne je podstatné, že tento návrh skutečně přináší flexibilitu, akceschopnost, že je to návrh, který umožňuje předpoklady pro odstranění vízové povinnosti.

Já bych chtěl říci pouze na okraj toho, co se říká právě ve vztahu k Ukrajině a Gruzii, že již budou osvobozeny od té vízové povinnosti – tato předloha pouze nastavuje určitý mechanismus, jak mohou být od této vízové povinnosti osvobozeny, ale neznamená to, že dochází k tomu osvobození už nyní. O takovémto návrhu budeme hlasovat až v únoru, pokud se nemýlím. Chtěl bych zároveň zdůraznit, že tato forma pomoci těmto dvěma zemím je naprosto nezbytná a neměla by být z naší strany dále odkládána. Myslím si, že to těmto zemím dlužíme.

  Andrejs Mamikins (S&D). – Mr President, the Council’s idea to link the free visa regime between the EU and Georgia and Ukraine with a suspension mechanism was a bad idea, as a result of which there has been an unpredictable delay of the visa-free regime with these countries. Georgia and Ukraine fulfilled all the conditions and are waiting for you to fulfil your commitments.

However, while some EU countries have publicly declared that they are glad to see these Eastern European countries on the way to EU integration, at the same time they have put their feet on the brakes and started to blackmail the European Parliament. In this way they are trying to solve their internal political problems. In politics, as in business, a society’s reputation as a reliable partner is a very valuable thing. So the EU’s reputation was seriously damaged in this case. We will not see the negative result immediately, but in connection with other cases of arrogance and neglect, our attitude towards our partners will return to us like a boomerang in the future.

  Νότης Μαριάς ( ECR). – Κυρία Πρόεδρε, κύριε Αβραμόπουλε, σε αυτό εδώ το Ευρωκοινοβούλιο δεν υπάρχει δυνατότητα δευτερολογίας. Εγώ θα αξιοποιήσω το ότι είστε εδώ και θα συνεχίσω αυτά που είπα προηγουμένως, διότι πράγματι η ανακοίνωση της Επιτροπής είναι έτσι όπως την είπατε, ότι μετά τις 15 Μαρτίου θα γίνουν, αν θα γίνουν, επαναπροωθήσεις. Αλλά για να μη γίνουν επαναπροωθήσεις, πρέπει να συμβούν δύο τινά: είτε να αλλάξει η νομοθεσία σε σχέση με το Δουβλίνο ΙΙΙ και να απαγορεύει στη Γερμανία να το κάνει είτε να δεσμευτούν η Γερμανία και άλλες χώρες ότι δεν θα το κάνουν. Άρα λοιπόν δέχομαι τις δεσμεύσεις της Επιτροπής ως προς τις προθέσεις της, αλλά αυτό δεν εμποδίζει τη Γερμανία να προχωρήσει σε αυτές τις διαδικασίες, και αυτό πρέπει να είναι ξεκάθαρο. Και δεύτερον, τελικά απαγορεύει η Επιτροπή στην ελληνική κυβέρνηση να πάρει απόφαση και να μεταφέρει κάποιους από τους 16.000 εγκλωβισμένους, που είναι πρόσφυγες στα νησιά του Αιγαίου; Σε αυτό θέλουμε μια ξεκάθαρη απάντηση.

  Charles Tannock (ECR). – Mr President, as someone rather unusually decorated by both Ukraine and Georgia for my services to those countries and their Euro-Atlantic aspirations, I of course warmly welcome the agreement for visa liberalisation to allow their citizens, for tourism and business purposes, to visit the European Union Schengen zone. Both countries have waited for years and have made sacrifices by unilaterally lifting visa restrictions and fees on EU visitors with no reciprocity until now. Of course there must be safeguards, including suspension mechanisms if the numbers are excessive or overstay abuses are evident. Both European neighbouring countries deserve our warmest welcome, and in Ukraine we must remember that many of their citizens have died for the freedoms that we take for granted here in the European Union.

  Dimitris Avramopoulos, Member of the Commission. – Mr President, dear colleagues, thanks again for this fruitful exchange. The new suspension mechanism will protect the European Union by making it easier for Member States to flag irregularities that justify a reintroduction of the visa requirement.

The Commission will also have the right of initiative to launch the process leading to the reintroduction of the visa requirement, and it will monitor the continuous fulfilment of the benchmarks required for achieving visa liberalisation. The agreement has also made it possible to proceed with the discussions on the visa liberalisation proposals for Georgia and Ukraine.

Having seen the wide support of the relevant parliamentary committee, I am confident that the plenary will approve this important agreement tomorrow. Thank you again for this fruitful discussion.

Solo quiero subrayar la vitalidad de la Cámara cuando se enfrenta a proyectos legislativos de verdadera envergadura. Ha habido veintiuna intervenciones. Y yo aprecio y agradezco todas aquellas que tuvieron un componente de reconocimiento a la tarea del ponente y de los ponentes en la sombra, pero también quiero decir que aprecio aquellas otras que no estuvieron de acuerdo con nosotros. La vitalidad de la Cámara, la vitalidad del Parlamento, queda inequívocamente demostrada con la solidaridad que se manifiesta ante un proyecto de esta envergadura.

  Urmas Paet (ALDE), kirjalikult. – Viisavabaduse peatamise kord tuleb üle vaadata, et muuta see kiiremaks ja paindlikumaks. See võimaldab ELil reageerida operatiivselt, kui peaks tekkima olukord, mis ähvardab nt ELi julgeolekut, või toimub äkiline kasv ebaseaduslikult ELi territooriumil elavate kolmandate riikide kodanike seas. Selle korra ülevaatamisega eemaldatakse ka takistused Ukraina ja Gruusia viisavabaduse kehtestamisega edasiminekult. See on oluline, sest mõlemad riigid on täitnud vajalikud kriteeriumid juba mõnda aega tagasi ning neile viisavabaduse andmine tuleb otsustada kiiresti.

  Claudia Țapardel (S&D), în scris. – Am sprijinit astăzi în Parlamentul European revizuirea mecanismului de suspendare a vizelor pentru cetățenii din state non-membre ale Uniunii Europene, pentru ca acesta să fie mai eficient și mai flexibil, mai ales în contextul situației politice și a fenomenului migrației cu care se confruntă Uniunea Europeană.

Politica vizelor reprezintă o temă importantă pentru Uniunea Europeană, având repercusiuni atât în plan intern, cât și extern. Procedurile succesive de liberalizare a vizelor au făcut necesară o revizuire a mecanismului de suspendare pentru țările cu un regim de călătorie fără vize, noutatea fiind că Parlamentul European va avea dreptul să participe la luarea acestor tipuri de decizii.

Această revizuire pornește de la necesitatea de a avea instrumente care să îi permită Uniunii Europene să răspundă unor circumstanțe neprevăzute, precum creșterea numărului de cetățeni din țări non-UE în situație de ședere ilegală sau amenințări la adresa securității pe teritoriul european.

Totodată, am reiterat faptul că această flexibilizare trebuie să fie însoțită de un set de măsuri care să garanteze protejarea drepturilor fundamentale ale omului, pornind de la statisticile primite de la agențiile europene sau organismele de securitate competente. Numai așa vor putea găsi un echilibru între siguranța cetățenilor UE și respectarea drepturilor celor care vin din afara UE.
