  Glenis Willmott, rapporteur. – Mr President, I would like to start by thanking all my shadow rapporteurs for their excellent support and cooperation including, of course, Mr Liese, the rapporteur on IVD. My thanks to the Commission and the Council, and I would also like to thank the Luxembourg – and, in particular – Dutch Presidencies for their determination to get the Council agreement that we have today.

We have put in place strong, clear rules for the whole life—cycle of devices, from design and manufacture through clinical testing and authorisation to vigilance and market surveillance, giving manufacturers legal certainty about what they have to do.

Protecting patients is at the heart of this legislation. We all remember the scandals of the past. I have heard from women whose lives have been turned upside down after having a pelvic mesh implant, women who are now living in constant pain. I have heard from women who are still not sure which breast implants they have had and whether they need to be worried about their future health.

It just is not right that people have not got sufficient information about devices that have been used in their medical procedures. So in future all devices will be traceable with a unique device identification number and patients will receive an implant card with this number, so we will all know which device has been implanted in which patient. If there is a problem with the device, patients deserve to be compensated, so it is clear that manufacturers must have sufficient financial coverage to deal with their potential liability.

We know that in the case of metal—on—metal hips there was little clarity for patients as to whether the problems were caused by the device or by the medical professionals treating them. When there is reason to believe a device has caused harm to a patient, information on that device must be made available to the patient and their doctor.

To ensure patient safety in the future we must make sure devices are safe before they reach the market. All devices will undergo a thorough clinical evaluation before marketing, and Parliament insisted that there should be additional scrutiny for the highest—risk devices. Things such as implants, insulin pumps and pacemakers will be referred to an expert panel for additional assessment.

Parliament also argued for restrictions on hazardous substances used in medical devices. Wherever possible, manufacturers will have to substitute materials that are carcinogenic, mutagenic or toxic to reproduction, and justify where this is not possible. Notified bodies will still have responsibility for awarding a CE mark, but it is clear that these have to be up to the job. We have introduced strict new requirements for notified bodies, and they will be regularly inspected by Member States. Notified bodies will also have greater powers to carry out unannounced inspections and must inspect samples of all devices regularly. Any problem should be picked up early and action taken straight away.

While it is vital that we ensure devices are safe before they are placed on the market, it is also essential that they are carefully monitored afterwards. The new law will significantly strengthen requirements for post-market surveillance, including introducing periodic safety update reports similar to those that are now produced for medicines.

Finally, on reprocessing of single—use devices, this was one of the most difficult issues to get agreement on. For the Member States it is a very sensitive issue. Some wanted reprocessing to be banned entirely; others wanted no legislation at EU level. Therefore, reprocessing will only be allowed if it is permitted under national law. Those Member States that want to ban it can do so. For those that allow it, there are EU-wide standards that must be complied with, including reprocessors assuming all the obligations of the manufacturers.

Colleagues, it has taken a long time and a lot of work to get to this point, so I hope you will support the final agreement as one which gives patients much more protection, while ensuring continued innovation.

  Peter Liese, Berichterstatter. – Herr Präsident, Herr Kommissar, liebe Kolleginnen und Kollegen! Es wird wirklich allerhöchste Zeit, dass wir ein besseres Medizinprodukterecht bekommen. Zahlreiche Skandale haben das Vertrauen der Patientinnen und Patienten erschüttert, und auch die seriösen Firmen sind in Misskredit geraten, weil einige massiv betrogen haben.

Vor wenigen Wochen hat der Europäische Gerichtshof sich noch einmal mit dem PIP—Skandal beschäftigt, und der EuGH hat leider festgestellt, dass es bisher in unserem Recht keine Verpflichtung gibt, die Produkte vor Ort unangemeldet zu kontrollieren. Deswegen müssen wir dringend etwas ändern.

Wenn wir morgen die beiden Berichte annehmen, dann werden wir unangemeldete Vor—Ort—Kontrollen einführen. Es darf nicht nur das Papier kontrolliert werden, sondern es muss auch kontrolliert werden, was wirklich los ist. Dadurch können wir schwarze Schafe entdecken, und dadurch wird auch in den Firmen sicher ein anderer Geist herrschen, wenn man weiß, dass man jederzeit unangemeldet kontrolliert werden kann.

Skandale gab es nicht nur bei den Brustimplantaten, sondern auch bei Hüftimplantaten, bei Stents, die zum Beispiel in die Gefäße zur Versorgung des Gehirns eingepflanzt werden, und auch bei diagnostischen Tests wie Gentest, DNA—Test oder HIV—Test. Es war jahrelang ein HIV—Test auf dem Markt, der signifikant häufiger als andere falsch negative Ergebnisse angezeigt hat. Das heißt, es war ein HIV—Virus vorhanden, aber der Test hat gesagt, es sei kein HIV—Virus vorhanden. Man kann sich vorstellen, welche Probleme das mit sich bringt, wenn dann jemand aufgrund einer solchen falschen Aussage Blut spendet oder ungeschützten Geschlechtsverkehr hat. Deswegen müssen wir unangemeldet kontrollieren.

Deswegen müssen wir auch andere Dinge einführen mit dieser Gesetzgebung: eine stärkere Überprüfung der benannten Stellen. Für Hochrisikoprodukte gibt es bei den Tests nicht nur das Scrutiny-Verfahren, das es auch bei Medizinprodukten ansonsten gibt, sondern ein Netz von Referenzlaboren, die die Einhaltung der Standards kontrollieren, und außerdem haben wir auch bei den Tests den klinischen Nachweis vorgeschrieben. Der Test muss das, was er auszusagen vorgibt auch wirklich aussagen.

Auf der anderen Seite, meine Damen und Herren – das war für meine Fraktion besonders wichtig: Wir wollen keine Regeln verabschieden, die nur unnötig Bürokratie mit sich bringen. Nur Papierkram nutzt dem Patienten nicht, und deswegen haben wir zum Beispiel abgelehnt, dass der Rat für Medizinprodukte der Klasse A – da handelt es sich zum Beispiel um solche einfachen Dinge wie einen Urinbecher – vorgeschrieben hat, dass man dort regelmäßig neue Papiere ausfüllen muss über den periodic safety update report. Wir brauchen ein Gleichgewicht aus Kontrolle, aber auch der Möglichkeit für Innovation und die Firmen, sich zu entwickeln, und das ist uns ganz gut gelungen.

Für das Parlament und auch für mich persönlich war ein weiterer Aspekt sehr wichtig: Wir wollten bei den sensiblen DNA—Tests nicht nur die Qualität der Tests besser kontrollieren, sondern auch Regeln für die Anwendung festschreiben. DNA—Tests können große Auswirkungen haben, deswegen müssen die Menschen wissen, was auf sie zukommt, und auch die Freiheit haben, einen Test abzulehnen. Leider war der Ministerrat nicht bereit, den Änderungsantrag, den dieses Parlament mit riesiger Mehrheit angenommen hat, wörtlich zu übernehmen, aber wir haben einen Kompromiss erzielt: Es gibt eine Informationspflicht bei genetischen Tests und eine ausführliche Pflicht zur genetischen Beratung bei Erkrankungen, die nach dem Stand der Wissenschaft nicht zu behandeln sind. Und das gilt auch für die meisten Fälle der Pränataldiagnostik, sodass auch hier eine Beratung stattfinden muss. Wir werden sorgfältig auf die Umsetzung dieses Punktes achten.

Insgesamt, glaube ich, haben wir einen guten Kompromiss erreicht, und ich möchte mich auch bei allen bedanken, die dazu beigetragen haben: bei der Kommission, der Ratspräsidentschaft, bei Frau Glenis Willmott, als Ko-Berichterstatterin, bei allen Schattenberichterstattern, vor allen Dingen Mairead McGuinness für die EVP, und – meine Damen und Herren, erlauben Sie mir das noch zum Schluss – bei unseren Mitarbeiterinnen und Mitarbeitern. Sie können sich nicht vorstellen, wie viele Stunden, auch abends und am Wochenende, die investiert haben, damit wir dieses gute Ergebnis erzielen konnten. Deshalb noch mal ganz herzlichen Dank, und ich bitte um Zustimmung morgen im Plenum.

  Vytenis Povilas Andriukaitis, Member of the Commission. – Mr President, I would like to warmly thank your House and you, the Members of the European Parliament, for the determination that you have constantly shown. Over the past five years, you have striven for a successful outcome on such a technical and complex file.

I know that many of you have worked on this issue. I would like to thank, in particular, the rapporteurs on the two regulations, Ms Willmott and Mr Liese, for their outstanding competence and dedication to this file. Thank you once again. I would also like to thank the shadow rapporteurs, and I have not forgotten the rapporteur on medical devices under the previous legislative term, Ms Dagmar Roth-Behrendt.

As you know, the EU is world leader in the medical device field. In the EU the sector employs over half a million people in about 25 000 companies, of which around 90% are SMEs. Annual sales amount to EUR 100 billion, of which a significant part is invested annually in research. The availability of safe and innovative medical devices is a key factor in guaranteeing effective and affordable treatments for European patients.

Designing a new regulatory framework for this sensitive and crucial sector is the joint responsibility of all the EU institutions. The Commission wholeheartedly welcomes the final compromise, which contains a series of crucial improvements to the current system.

Let me mention some of them: first, strict market control for high—risk devices; second, reinforced criteria for the designation and oversight of notified bodies; third, the inclusion of certain aesthetic devices in the new legislation; fourth, the introduction of a new risk classification system for diagnostic in vitro medical devices; fifth, improved transparency via the establishment of an EU database on medical devices; sixth, a stability system based on unique device identification; seventh, the introduction of an implant card for patients; eighth, stricter and more detailed rules on clinical evidence and clinical investigation; and, ninth, an improved coordination mechanism between Member States for vigilance and market surveillance.

The new European legislation will ensure a higher level of patient safety, provide legal certainty for economic operators and promote innovation and competitiveness in the sector. It consolidates the role of the EU as global leader in the field, while establishing a world-class reference for medical device regulation. Thank you once again.

  Mairead McGuinness, on behalf of the PPE Group. – Mr President, I have to say that I thought this day would never come. I am relieved and happy to be here. Glenis Willmott and Peter Liese, who led us in these two important files, are to be congratulated for the work they did and the work we all did on this. And Commissioner, thanks go to your colleagues as well, and to the Council, because this was not just technical; it was political.

I am also glad that the Chamber is full with visitors, because what we are talking about today will affect each and every one of us, now and in the future. Also, Commissioner, thank you for acknowledging the importance of this industry in terms of both jobs and its output. This industry makes our lives better and extends our lives, and for that we should be grateful. Yes, we are talking about when things go wrong, and that spurs us to do more things, and to do them better. We should acknowledge that the industry is a very good industry that Europe should be proud of. What we are doing today is making it more certain for that industry to continue, so that when we get slightly older and may need things that are improved upon, we may live better and longer lives.

May I, at this point, say that Glenis Willmott has gone through the technical details, so there is no need for me to repeat that. What I think is most important is that we implement, and that the Member States who have signed up to this, and the Commission who are with us on this journey, realise that this Parliament will keep a watching brief and will make sure that resources are put in place so that we do put action on the words.

Lastly, can I say that our staff – as has already been mentioned – are hugely important. I think it is very important that we say this openly, because on the technical side they were incredible – both our Group staff and our individual staff. If I may say so, I very carelessly lost two staff members during the course of this regulation, and both to the medical devices industry, because they are excellent workers on behalf of citizens: Mark Taylor and Sinead Duggan, who I know is watching this debate. I think that is the good thing about what we have done. We will make our industry more certain. We will make safer the lives of citizens, and we can grow jobs and grow our economy.

So today, fingers crossed, is a good day.

  Biljana Borzan, u ime kluba S&D. – Gospodine predsjedniče, medicinski uređaji nas ne zanimaju dok nam ne trebaju, ali onoga trenutka kad nam ustrebaju postanu najvažnija stvar na svijetu. Glavni cilj koji želimo postići ovim propisima je bolja zaštita pacijenata uz poticanje inovacija u industriji. Europa ima najbolje liječnike na svijetu, ali i oni i pacijenti moraju znati da raspolažu opremom koja je kvalitetna i sigurna.

Povjerenje u industriju se kapitalizira kroz bolji plasman i prodaju proizvoda, stoga će od novih pravila ustvari profitirati svi. Komisija je objavila inicijalni prijedlog još 2012. godine, što znači da europski pacijenti već 5 godina čekaju da se zatvore rupe u propisima radi kojih su se dogodili skandali s umjetnim kukovima, implantatima i testovima za virus HIV-a.

Kada se u ovom sektoru dogodi skandal, ljudi nažalost umiru. Upravo zato smo i inzistirali da novi i inovativni in vitro medicinski uređaji najviše klase rizika za koje ne postoje reference i zajedničke specifikacije budu pokriveni dodatnom procedurom nadzora. Nova pravila jačaju kapacitete i strukture imenovanih tijela koja imaju najvažniju ulogu kod stavljanja uređaja na tržište.

Njihova odgovornost i obveze se povećavaju, a jedna od novina su i nenajavljene inspekcije proizvođača. Kada se dogode skandali i pacijenti nastradaju pitanje pravedne i pravovremene odštete postaje imperativ. Nove regulative obvezuju proizvođače medicinskih uređaja da u slučaju incidenta imaju primjeren sustav i resurse za obeštećenje pacijenata. Nadalje, oštećenicima i nadležnim službama proizvođači će morati omogućiti primjeren pristup informacijama i dokumentaciji vezanoj za njihov slučaj.

Što se tiče Odbora za etiku i pitanja, poput kliničkih ispitivanja uređaja na maloljetnicima, od prvog dana smo inzistirali da se regulative usklade s regulativom o ispitivanjima lijekova. Mislim da smo uspjeli postići dobar kompromis koji podiže razinu sigurnosti pacijenata i korisnika. Nove procedure i sigurnosni mehanizmi neće biti prepreka inovativnosti i konkurentnosti europske industrije medicinskih uređaja.

Pozivam vas zato sve da podržite ovaj kompromis, jer je to u interesu i pacijenata i proizvođača medicinskih uređaja. Zaključno, htjela bih se zahvaliti kolegici Glenis Willmott, kolegi Peteru Lieseu i svim ostalim izvjestiteljima u sjeni s kojima sam radila na ovom dokumentu. Bio je to zaista težak i mukotrpan posao, ali rezultati će biti na radost svih nas, a osobito pacijenata.

  Bolesław G. Piecha, w imieniu grupy ECR. – Panie Przewodniczący! Panie Komisarzu! Koleżanki i Koledzy! W pracach nad sprawozdaniami zawsze starałem się kłaść duży nacisk na zapewnienie właściwej równowagi pomiędzy priorytetem, jakim jest bezpieczeństwo pacjentów, a postępem technologicznym, kompetencjami państw członkowskich a kompetencjami instytucji Unii Europejskiej. Sam fakt, że odbyło się dziesięć posiedzeń trójstronnych, podczas których osiągnięto w miarę satysfakcjonujące porozumienie międzyinstytucjonalne, ukazuje, jak trudny to był proces – ale proces możliwy. Z jednej strony priorytet, czyli bezpieczeństwo pacjentów, jest opisany w sprawozdaniu poprzez powołanie specjalnych jednostek notyfikowanych, które mają obecnie obowiązek przeprowadzania niezapowiedzianych kontroli w zakładach produkcyjnych, co oznacza, że w przypadku urządzeń, zwłaszcza wysokiego ryzyka, nie wystarczy jedynie skontrolować odpowiednią dokumentację, ale co więcej – należy również skontrolować i przeprowadzić należytą kontrolę w miejscu wytwarzania danego produktu. Z drugiej strony w sprawozdaniu promuje się nowe technologie medyczne, gdyż otwiera się drogę do zachęcenia producentów, aby poszukiwali – a w sytuacjach koniecznych poszukiwali również zamienników – substancji, które mogą być rakotwórcze, mutagenne lub toksyczne. Oprócz tego poprawa jakości bezpieczeństwa pacjentów została zapewniona przez włączenie specjalnych zespołów eksperckich, które zajmą się niezależną oceną. Uważam, że ten tekst jest dobry. Poprawi on ramy prawne stosowane do urządzeń medycznych i urządzeń medycznych do diagnostyki in vitro tak, że staną się one bezpieczniejsze, a zarazem ramy te nie utrudnią jakościowego postępu w procesie rozwoju technologii medycznych. Tekst respektuje również podział kompetencji pomiędzy instytucje europejskie a państwa członkowskie. I choć nie wszystkie proponowane zagadnienia są dla mnie zadowalające, chociażby poradnictwo genetyczne, to głosowałem za i będę głosował za.

  Gesine Meissner, im Namen der ALDE-Fraktion. – Herr Präsident, meine Damen und Herren! Ich möchte mich zunächst auch ganz herzlich bei den beiden Berichterstattern Glenis Willmott und Peter Liese bedanken. Bei Glenis noch ein Tickchen mehr, weil ihr Dossier noch ein bisschen größer war. Aber beide haben enorm gekämpft, und es war wirklich ein sehr schwieriger Prozess.

Es geht hier in diesem Fall um Medizinprodukte vom Heftpflaster über die Gehhilfe bis zum Herzschrittmacher. Also es ist wirklich alles drin, was die Menschen wirklich brauchen, wenn sie krank werden. Wir haben in Stunden ausgedrückt zum Beispiel 30 Stunden Trilog gehabt, mehr als 200 Stunden technisches Meeting, 700 Seiten war das Dossier dick, das wir bearbeiten mussten. Ich habe noch nie einen so komplizierten Gesetzesprozess gehabt. Es war lange im Rat blockiert, bis man dort eine Einigung hatte. Und letztlich waren wir im Parlament eigentlich in vielem sehr einig und froh, dass wir es hinbekommen haben.

Es ist tatsächlich so, wie schon gesagt wurde: Wir haben jetzt mehr Patientensicherheit. Das ist gut nach dem Brustimplantateskandal – das war ja der Auslöser –, und wir haben aber trotzdem keine zentrale Zulassung, was auch gut ist, denn das hätte sonst die Innovation und den Zugang der Patienten zu bestimmten Medikamenten erschwert. Darum ist es gut, dass wir das auch hinbekommen haben.

Worum geht es jetzt? Ein paar Sachen möchte ich dazu sagen. Einmal um Risikoklassen. Ich habe dabei auch viel gelernt, muss ich sagen: Risikoklasse 1 ist zum Beispiel ein Pflegebett, 2a sind Hörgeräte, 2b sind Dentalimplantate, und Risikoklasse 3 sind Herzkatheter. Und je nachdem, welche Risikoklasse das ist, braucht es besondere Zulassungsverfahren, und man hat dann eben auch mehr Entschädigungspflicht oder Haftbarkeit bei den Produzenten. Das sind alles Dinge, die wir besprochen haben.

Wiederaufbereitung war ein großes Problem. Ich hatte bis dato auch gedacht, Einmalprodukte dürfen nicht wiederaufbereitet werden. Unter bestimmten Voraussetzungen dürfen Mitgliedstaaten das aber erlauben, und wir haben auch gemerkt, dass das geht. Also wir haben uns wirklich bis ins Kleinste mit solchen Dingen beschäftigt. Auch mit Tests – da bin ich übrigens ein bisschen anderer Meinung als Peter Liese. Ich finde es gut, dass wir den Zugang zu Tests relativ niederschwellig gehalten haben, weil ich denke, dass die Patienten das brauchen.

Als letztes eine dringende Bitte an die Kommission: Es gibt eine ganze Menge Durchführungsrechtsakte und delegierte Rechtsakte, die jetzt kommen müssen, teilweise bevor die benannten Stellen überhaupt ausgewiesen sind. Herzliche Bitte an die Kommission: Sorgen Sie dafür, dass Sie genug Ressourcen haben, um alles so umsetzen zu können, wie die Patienten das in Europa brauchen. Das wäre toll

  Kateřina Konečná, za skupinu GUE/NGL. – Pane předsedající, tyto dvě nařízení zde vyjednáváme více než čtyři a půl roku. Byl odveden obrovský kus práce, přeci jen se jedná o největší legislativní dokumenty, které kdy byly na této půdě projednávány. Obrovský dík patří oběma zpravodajům i všem, kteří se na nich podíleli.

Já tady musím říct, že zcela nesouhlasím s tím, že bychom tyto dva dokumenty tak, jak si myslí kolegové z frakcí odnaproti, měli jakkoli zamítnout či se jimi dál nezabývat. My jsme na nich pracovali, ty dokumenty jsou dobré, i když nemusím souhlasit se vším. Je strašně důležité, abychom je konečně, konečně poslali v platnost a konečně je dali evropským občanům k dispozici, protože jsme je dělali pro ně. Účinnost tohoto nařízení je totiž teoreticky plánována na konec května 2020, popřípadě května 2022. Čili od začátku vyjednávání do doby, než to evropský občan bude moct vůbec na sobě pocítit, je deset let.

Já bych chtěla poprosit pana komisaře, znepokojují mě některé analýzy členských států, které evidentně poukazují na to, že Komise, ani příslušné dozorové orgány nejsou dodnes dostatečně vybaveny k tomu, aby včas tyto dokument provedly. Prosím, když už jsme na nich takto dlouho a tak dobře pracovali, my je musíme začít realizovat. Naší povinností je, aby byly implementovány a byly dány k dispozici členským státům a občanům Evropské unie.

  Michèle Rivasi, au nom du groupe Verts/ALE. – Monsieur le Président, j’adresse un grand merci aux rapporteurs, M. Liese, et notamment Mme Willmott, pour ce rapport. Quatre ans et demi auront été nécessaires pour enfin arriver à ce texte de compromis, sans compter les nombreux trilogues auxquels il a fallu faire face. Ces textes sont toujours dus à un scandale, par exemple le scandale des prothèses mammaires PIP en France, entre autres, mais je crois qu’il y a eu des progrès importants.

Parmi les points forts, je note le système d’assurance de compensation pour des patients qui subissent des dommages, ce qui est très important. Je note les progrès sur la transparence et l’identification, notamment des dispositifs médicaux, la création d’une base de données publique – à ce propos, nous avons écrit à M. Juncker pour que des moyens financiers soient mis à disposition afin que cette base Eudamed puisse être fonctionnelle – tout comme la publication de la déclaration d’intérêt de tous les experts qui y participeront et, enfin, la suppression autant que possible des substances cancérigènes, mutagènes et reprotoxiques.

Je mets un bémol sur quelques points: nous n’avons pas obtenu l’autorisation de mise sur le marché centralisée. Nous allons donc avoir plusieurs organismes notifiés, ce qui entraîne la nécessité d’une évaluation et de contrôles inopinés, comme cela a été dit, afin de s’assurer de leur capacité d’expertise. En effet, le nouveau scandale à propos d’Essure, un implant de stérilisation tubaire, montre que la présence de nickel entraîne énormément d’effets secondaires dont les femmes subissent les conséquences. Il est donc important de garantir que les organismes de certification disposent d’études cliniques très importantes, grâce aussi au comité d’experts qui doit les évaluer.

Je suis donc assez optimiste à propos de ce texte et j’espère qu’il sera voté.

  Piernicola Pedicini, a nome del gruppo EFDD. – Signor Presidente, onorevoli colleghi, la delegazione del Movimento 5 Stelle voterà positivamente queste proposte in materia di dispositivi medici e dispositivi medico-diagnostici perché vanno nella direzione da noi auspicata, e cioè che nessun dispositivo medico di bassa qualità deve essere ancora commercializzato all'interno dell'Unione europea.

In Europa non possiamo più permetterci scandali come quelli delle protesi al silicone o dei test HIV di bassa qualità che hanno prodotto falsi negativi – è stato detto prima dal collega Liese – aumentando quindi il rischio di contagio di una malattia come l'AIDS. Dobbiamo dire basta ai controlli formali e di facciata, mentre dobbiamo privilegiare i controlli diretti e sostanziali che tutelino i pazienti in via preventiva. Noi siamo favorevoli a una rete di laboratori europei di riferimento per il controllo dei dispositivi ad alto rischio, specialmente per quelli innovativi.

Riteniamo infine che sia stato un successo aver previsto l'obbligo di un piano di sorveglianza per monitorare la sicurezza dei dispositivi durante il loro ciclo di vita e per consentire ai pazienti e ai loro medici di avere sempre informazioni tempestive per rilevare eventuali malfunzionamenti.

Adesso però attendiamo con ansia l'adozione dei criteri per l'identificazione degli interferenti endocrini, senza i quali non sarà possibile selezionare le sostanze pericolose, che pure potrebbero essere presenti nei presidi medico-chirurgici, e di conseguenza neanche applicare la legislazione che stiamo per votare, con gravissimi danni per la salute dei nostri pazienti.

  Joëlle Mélin, au nom du groupe ENF. – Monsieur le Président, à la suite des scandales des prothèses mammaires PIP fabriquées frauduleusement à partir de silicone non médical et des prothèses de hanche métal-métal qui entraînaient une propagation de cobalt très toxique, il a été décidé de remettre à plat les règles concernant les dispositifs médicaux. Hélas, ces deux cas litigieux seraient en partie la conséquence d’un manque de vigilance d’une agence sanitaire nationale. Mais cela ne justifie en rien la perte totale des prérogatives des États du fait de la mise en place des deux règlements étudiés ce jour.

Ces nouveaux règlements feront peser des contraintes irréalistes sur les organismes notifiés qui sont, de par leur agrément obligatoire, la clé de voûte de la chaîne de valeur étant donné qu’ils transfèrent les compétences des autorités nationales vers ces mêmes organismes notifiés en les transformant en une véritable police sanitaire.

Les conséquences sont alors doubles: la privatisation du système de santé lors de la mise sur le marché des dispositifs médicaux et, par ailleurs, une augmentation considérable des coûts de certification en contrepartie de la responsabilité qui pèsera sur ces organismes et donc sur leur prime d’assurance en prévision des futurs procès.

Si certaines dispositions sont utiles, comme une traçabilité améliorée, le résultat final risque de paralyser assez rapidement le secteur européen du dispositif médical, tout particulièrement le secteur français, incapable à ce jour de s’adosser à un organisme notifié pourtant indispensable.

Ce faisant, ces règlements portent une atteinte sans précédent à notre souveraineté sanitaire. Incapables d’approvisionner leurs clients, faute de marquage CE obligatoire, les PME françaises sont évincées des hôpitaux et des pharmacies sur recommandation de l’Agence nationale de sécurité du médicament française, elle-même, au profit de sociétés étrangères, voire extérieures à l’Union européenne, pourtant pour des produits de moindre qualité. Certes, ces sociétés étrangères doivent aussi obtenir le marquage CE, mais leur rentabilité et leur prévalence sur leur marché national leur permettent de mieux résister, même si, à terme, le manque potentiel d’auditeurs fera dépendre le marché européen d’importations de pays tiers.

Rappelons qu’en France, l’industrie du dispositif médical concerne environ 65 000 emplois sur un millier d’entreprises qui sont à plus de 90 % des très petites entreprises (TPE), pour un chiffre d’affaires de 20 milliards d’euros.

En définitive, si cette discussion était nécessaire et attendue par les acteurs du secteur, cette révision entraîne une très lourde modification des exigences réglementaires allongeant les délais de certification. À l’inverse, les délais d’application de ces règlements sont souhaités à très court terme, quasiment à marche forcée. Pour toutes ces raisons, nous nous opposerons à ces textes.

  Françoise Grossetête (PPE). – Monsieur le Président, Monsieur le Commissaire, il aura fallu pratiquement cinq ans pour que nous arrivions à réviser cette législation vieille de plus de 20 ans et à colmater les brèches qui ont fait que, malheureusement, il y a eu des scandales comme le scandale sanitaire mondial des prothèses mammaires PIP.

Je regrette la lenteur de la procédure, mais je veux féliciter les rapporteurs et, entre autres, Mme Wilmott et M. Liese ainsi que les rapporteurs fictifs parce qu’ils ont vraiment fait un travail énorme pour aboutir à une révision ambitieuse de cette réglementation et répondre à deux objectifs précis, à savoir renforcer et garantir la sécurité des patients et restaurer leur confiance tout en encourageant l’innovation dans le domaine des technologies médicales, et donc la création d’emplois.

Ces textes viennent mettre un point final à une ère où un dispositif médical implantable répondait quasiment aux mêmes obligations réglementaires qu’un simple grille-pain. Aujourd’hui, le renforcement de la surveillance des organismes notifiés, les obligations de contrôle inopiné chez les fabricants, l’attention apportée aux dispositifs de catégorie 3 et 2B, les plus à risque, ou l’amélioration de la traçabilité des produits, tout cela devrait permettre d’éviter les fraudes et de rétablir la crédibilité du marquage CE.

Je regrette simplement que nous n’ayons pas trouvé de solution uniforme pour le retraitement des dispositifs à usage unique, auxquels je suis totalement opposée. Je note toutefois que si les États membres les autorisent, les hôpitaux devront répondre à des obligations extrêmement strictes.

En conclusion, Monsieur le Commissaire, je pense qu’il faut veiller à la mise en œuvre de ces textes. Tout retard dans l’adoption des actes d’exécution pourrait avoir de graves conséquences. Nous ne sommes pas encore au bout de nos peines. L’application, je l’espère, rapide et efficace de ces nombreux progrès appellera des moyens importants et j’espère que la Commission et les États membres sauront mettre ces ressources sur la table.

  Miriam Dalli (S&D). – Mr President, it has been a very long journey but, after four years, here we are and, yes, it is a good day. I would like to congratulate Glenis Willmott – I know you had a big task ahead of you, but you managed to do a great a job – and also our colleague, Peter Liese, and our shadow, Biljana Borzan, because together you managed to build on the spirit of compromise and really put at the heart of the policies you worked on our patients’ safety first and foremost. I am really glad also to see such a large attendance by the public in the galleries today because this field we are speaking about and discussing is diverse, competitive and highly innovative. It is an area of great promise – sometimes spectacular promise – but it can also be an area of a number of pitfalls.

Devices are routinely implanted in our bodies. They replace limbs, bones, tissues and sometimes entire organs, but medical and diagnostic devices, when well designed, well made and properly used, can improve our quality of life and can save lives. If not, they can threaten and impair it. As the directly—elected representatives of our citizens, it is our mission to make sure that patients in the EU can access safe, effective and high—quality medical devices and diagnostics, and that they have timely access to medical technologies that will really help them.

We are living in a digital era where we need to be proactive and anticipate innovation. Our regulatory framework needs to be prepared for the type of technology that will come our way. It needs to help foster innovation and the development of life—saving and life—enhancing equipment. So yes, these pieces of legislation are a good example of how we can improve patient safety, and I look forward to Parliament building further on this spirit so as to ensure the highest level of patient safety throughout the EU, but maybe at a more rapid speed.

  Julie Girling (ECR). – Mr President, can I give my congratulations and thanks to both of the rapporteurs and all of the teams. I have to say I admire your stamina. You are an example to us all. And so here we are at last.

Patient safety is of paramount importance and ensuring that this should always be so is our top priority. I am often one of the first to say that additional regulation can be burdensome, however when it comes to the realm of public health, especially when lives are in jeopardy and the safety of our healthcare system is questioned, tighter oversight and control mechanisms are vital. Indeed, in the wake of the breast implant and metal—on—metal hip scandals of 2012, it is now more important than ever that patient confidence be restored.

I firmly believe that support for these proposals is warranted. With the introduction of more systematic post-market checks, as well as stricter monitoring and traceability measures, these proposals create a framework whereby errors are more easily identifiable, allowing for more targeted and efficient responses and minimising any negative fallout.

While focusing on consumer safety, I would also acknowledge the importance of innovation, and these proposals do exactly that. So I think you have got the balance right, and I will be very happy to vote for this tomorrow.

Efter så mange timer, dage, år er det virkeligt imponerende, at vi nu har nået et resultat, som vi næsten alle sammen er godt tilfredse med. Tak til Glenis Willmott og Peter Liese og også til Dagmar Roth-Behrendt for det arbejde, de har lavet.

Jeg vil ikke gentage alle de fremragende tekniske ting, der her er forelagt, det ville blive for kedeligt! Men jeg vil godt understrege, at det også for industrien er en enorm fordel, at vi nu får ordentlig sporbarhed, ordentlig kontrol, åbenhed og erstatningsansvar. Hvis dette virkelig kommer til at fungere i hele Europa, så vil det betyde, at vi fremover reelt kan sige: "Vi bliver de bedste på verdensmarkedet!", i stedet for de reaktionære kræfter, der indtil nu har sagt "Uh, vi skal endelig ikke have noget som helst, for vi skal have lov til at svindle og bedrage". Jeg er en af dem, der har fået udskiftet både knæ og hofte osv., og jeg er faktisk ret taknemmelig over ikke bare, at det kan lade sig gøre, men også at det kan gøres sikkert, så jeg kan færdes nogenlunde frit.

Lad mig til allersidst understrege det punkt, som Peter Liese havde fat i, nemlig rådgivning. Nogle af disse ting er faktisk lidt mere dramatiske for mennesker, end vi helt har kunnet få et indtryk af her. At få foretaget en gentest er faktisk ikke ingenting. Man kan risikere, at folk begynder at amputere bryster og arme og ben og nærmest ikke tør få børn af bar skræk for, hvad der måske kan ske. Her er det vigtigt at understrege, at der skal være rådgivning, og det allerbedste ville være, hvis medlemsstaterne insisterede på, at en sådan rådgivning var obligatorisk.

  Julia Reid (EFDD). – Mr President, the role of medical devices in the UK, as well as in Europe, is of exceptional importance, and the medical devices sector plays a fundamental role in the diagnosis, prevention, monitoring and treatment of diseases. I share the concern about this issue with the rapporteur and the European Commission, and recognise that disgraceful things have happened in the past, where women having breast augmentation procedures were given Poly Implant Prostheses (PIPs) containing industrial silicone.

Although I agree with the objectives of this report, which aims to influence the manufacturers at the site of production, as well as to increase transparency in instances where patients have had an adverse reaction to a medical device and are searching for information, I believe, however, that Member States are best placed to act in this field. My party and I believe that this is an issue best dealt with by national parliaments, therefore avoiding unnecessary bureaucracy.

  Giovanni La Via (PPE). – Signor Presidente, onorevoli colleghi, commissario Andriukaitis, credo che abbiamo compiuto un lungo percorso e abbiamo fatto insieme un viaggio, dalla proposta di cinque anni addietro all'accordo chiuso sotto la presidenza olandese. Per questo credo che vadano ringraziati i colleghi Willmott e Liese per il ruolo che hanno avuto da relatori, e anche personalmente li vorrei ringraziare per la collaborazione che hanno prestato nell'ultima fase del negoziato durante i triloghi per raggiungere un'intesa, un'intesa proficua con il Consiglio e con l'aiuto della Commissione.

Il negoziato è stato complesso e lungo, non solo per la durata, ma anche per la complessità del dossier, molto tecnico, con una serie di elementi che abbiamo dovuto definire in corso d'opera. Ma il risultato finale è sicuramente un risultato importante: forniamo all'industria del settore un quadro chiaro che consentirà di realizzare investimenti e contribuirà a quell'obiettivo che ci eravamo dati sin dall'inizio, che era quello di avere una maggiore sicurezza del paziente, ma anche di stimolare l'innovazione in medicina.

Abbiamo lavorato per innalzare fortemente gli standard di qualità e sicurezza dei prodotti, a tutela della salute dei cittadini europei, e avviato un percorso che costringerà il settore industriale ad un importante cambio di mentalità. Sono certo che tali nuove norme rappresenteranno un'opportunità per il sistema della salute e industriale europeo. Ci sono molte misure importanti, soprattutto in tema di trasparenza, come l'istituzione del database centrale per creare un sistema di raccolta di tutte le informazioni. O penso ai pazienti con dispositivo impiantato, per i quali è prevista la messa a disposizione di informazioni chiave sul prodotto, comprese le eventuali precauzioni di cui potrebbe aver bisogno.

In definitiva, abbiamo raggiunto un compromesso che ha richiesto tante ore di negoziato, ma del quale come parlamentari europei dobbiamo essere sicuramente fieri. Domani spero che tutti quanti lo sosterremo in quest'Aula.

  Christel Schaldemose (S&D). – Hr. formand! Også fra mig skal der lyde et kæmpestort tillykke til fru Willmott og hr. Liese for et stort, stort stykke arbejde. Men mest af alt skal der lyde et kæmpe tillykke til de europæiske patienter. For med det forslag, vi skal stemme om i morgen, bliver det markant mere sikkert at være patient i Europa, hvis man har brug for at få nye hofter eller ny pacemaker eller underlivsnet, eller hvad man nu kunne have brug for.

Lad mig dog også sige, at det godt nok også var på tide! Vi har kæmpet med dette i mange mange år, lige siden skandalerne for ca. 5-6 år siden væltede ud af skabet. Særligt er jeg glad for, at vi får væsentligt strammere krav til udstyret, inden det må blive markedsført, og markant større kontrol med udstyret, efter at det er markedsført. Det er lige præcis det, vi har brug for! Jeg havde også gerne set et europæisk centralt godkendelsessystem, men det kom vi desværre ikke i mål med. Uanset hvad, skal der lyde et kæmpe tillykke til de europæiske patienter. Det er nu mere sikkert at være patient.

  Mark Demesmaeker (ECR). – Jammer genoeg blijkt dat er vaak eerst een crisis moet uitbreken voordat er in zaken verandering kunnen worden gebracht. We hebben deze ochtend het debat over “dieselgate” gevoerd en nu over medische hulpmiddelen. Ook hier maakten verschillende schandalen pijnlijk duidelijk dat de controlemechanismen op medische hulpmiddelen ontoereikend zijn. Iedereen herinnert zich de problemen met gebrekkige borstimplantaten van de Franse producent PIP.

De bestaande wetgeving dateert van begin jaren negentig en is dus achterhaald, ook door de technologische vooruitgang. De nieuwe regels moeten de veiligheid en kwaliteit van medische hulpmiddelen verhogen, in het belang van de patiënt. Een strikte controle vóór het product op de markt komt, moet hand in hand gaan met een strikt markttoezicht achteraf, wanneer het product beschikbaar is. Een verstrenging van de regels voor medische hulpmiddelen met een hoog risico, zoals bepaalde implantaten, is nodig.

Daarnaast zijn betere transparantie en traceerbaarheid essentieel.

Het akkoord dat voorligt, is niet perfect, maar is zonder meer een stap vooruit en mijn delegatie zal het dan ook steunen.

  Miroslav Mikolášik (PPE) – Vážený pán komisár, na európskom trhu v súčasnosti existuje viac než 500-tisíc zdravotných pomôcok a diagnostických pomôcok in vitro. Vďaka rýchlemu vývoju sú tieto pomôcky čoraz sofistikovanejšie, avšak platná úprava s vedeckým pokrokom nedrží krok. Vzhľadom na viaceré škandály, keď diagnostické pomôcky poskytli pacientom chybné výsledky, som presvedčený o nutnosti prispôsobiť legislatívu reálnemu stavu a sprísniť pravidlá so zámerom eliminovať prípady nesprávnej diagnostiky. Stotožňujem sa s predkladaným znením návrhu nového nariadenia, ktoré je zamerané na posilnenie procesu dohľadu nad diagnostickými pomôckami in vitro pred uvedením na trh a po ňom, ako aj na vysledovateľnosť pomôcok v rámci celého dodávateľského reťazca, a popri tejto podpore výskumu a inovácií musíme mať neustále na pamäti bezpečnosť pacientov, ochranu života a zdravia, čo je naším primárnym a najvyšším cieľom. Implementácia novej legislatívnej úpravy musí byť Európskou komisiou náležite monitorovaná, a to najmä v oblasti odborného genetického poradenstva, tak ako sme to požadovali v našej parlamentnej pozícii. Ani pacient, ani spotrebiteľ nesmú byť vystavení zavádzajúcim informáciám, prípadne dezinterpretáciám výsledkov či interpretáciám v takej citlivej oblasti, ako je zdravie.

  Gilles Pargneaux (S&D). – Monsieur le Président, Monsieur le Commissaire, chers collègues, chers corapporteurs, du simple pansement au cœur artificiel en passant par les prothèses mammaires ou de hanche, ces dispositifs médicaux sont essentiels pour notre santé et notre qualité de vie au quotidien. Ils occupent une place prépondérante dans l’économie européenne de la santé – je pense que c’est important de le dire – et jouent un rôle déterminant pour notre espérance de vie, qui ne cesse d’augmenter. Voilà une réalité qu’il convient toujours de prendre en compte et c’est l’occasion que nous offre ce débat.

Je me souviens d’avoir été corapporteur d’une résolution en 2012: après les scandales de 2010 et de 2012, il fallait absolument demander à la Commission européenne de nous proposer un dispositif de protection. C’est chose faite après cinq ans d’un combat victorieux. Par conséquent, je remercie Glenis Wilmott et Peter Liese, mais aussi le commissaire européen, M. Andriukaitis, de nous permettre d’offrir un dispositif de protection à l’ensemble des Européennes et des Européens.

  Urszula Krupa (ECR). – Panie Przewodniczący! Wprowadzenie zmian w prawie dotyczącym wyrobów medycznych i wyrobów do diagnostyki in vitro było konieczne nie tylko w celu wyeliminowania skandalicznych nieprawidłowości, ale także umożliwienia łatwiejszego dostępu pacjentów do nowoczesnych technologii w medycynie, czego nie zabezpieczały przestarzałe dwudziestoletnie regulacje. Wprowadzenie reżimu niezapowiedzianych kontroli przez wzmocnione prawnie jednostki notyfikowane, dokonujące oceny zgodności wyrobu z obowiązującymi przepisami, zapewne poprawią bezpieczeństwo – szczególnie produktów najwyższego ryzyka. Szkoda, że nie wprowadzono zasady nakazującej producentom ubezpieczanie się, prawdopodobnie z powodu ewentualnego wzrostu cen wyrobów. Jednak pozytywem jest zobligowanie odpowiednich organów do przekazywania osobom poszkodowanym informacji dotyczących wadliwego działania produktu, co ma ogromne znaczenie w przypadku dochodzenia roszczeń wraz z wykazaniem związku przyczynowo-skutkowego. Mam nadzieję, że dokument zostanie przyjęty.

  Francesc Gambús (PPE). – Señor presidente, señor comisario, en primer lugar quisiera felicitar a la señora Willmott y al señor Liese por el gran trabajo realizado y por el éxito conseguido en la negociación de estos dos informes. No ha sido fácil. Hace casi cinco años de la propuesta original que presentó la Comisión Europea, y ha llovido mucho desde entonces. Cinco años de trabajos y casi dos años de duras negociaciones entre el Consejo, la Comisión y el Parlamento que nos llevan a poder aprobar unas nuevas normas sobre los productos médicos que reflejen los avances tecnológicos y científicos que ha tenido el sector en los últimos veinte años.

Un acuerdo a favor del cual votaremos mañana porque refleja lo que queremos: más seguridad para nuestros ciudadanos; más seguridad tanto en controles posteriores a la aprobación de los productos como en los pasaportes que todos los implantes deberán llevar para ser debidamente monitorizados y trazabilizados; más seguridad, mayor transparencia y más rapidez de respuesta, obligando a los Estados miembros a que tomen las medidas necesarias para empoderar a los profesionales de la salud, los usuarios y los pacientes para que informen de las sospechas sobre incidentes serios a nivel nacional utilizando formularios armonizados.

Queremos unos productos más seguros que nos permitan construir un sistema de control y protección que refuerce los controles previos y posteriores a la comercialización, que sea más transparentes y que evite que se repitan casos tan graves como los de los implantes mamarios PIP que afectaron a miles de mujeres en Europa.

  Daciana Octavia Sârbu (S&D). – Domnule președinte, au existat în ultimii ani mai multe scandaluri notorii care ne-au demonstrat că legislația aplicată defectuos, atunci când e combinată cu neglijența sau chiar cu infracțiunile unor producători, poate pune în pericol sănătatea și viețile pacienților. Defecțiunile unor teste HIV sau ale unor proteze de șold, scandalul PIP cu implanturile care conțineau silicon de tip industrial, toate aceste cazuri dovedesc nevoia urgentă de a schimba sistemul care le-a făcut posibile.

Prin aceste noi reguli, toate dispozitivele medicale, inclusiv cele un rol estetic vor trebui să respecte aceleași standarde pentru a primi autorizarea de punere pe piață. Dispozitivele cu risc ridicat vor face obiectul unor teste clinice suplimentare. Inspecțiile obligatorii neanunțate vor descuraja neregulile, iar măsurile mai stricte, de trasabilitate, vor permite producătorilor să-și îmbunătățească reacția în situații de criză.

Doresc să felicit colegii mei pentru finalizarea acestei legislații și pentru munca depusă. Cred că ea va juca un rol foarte important pentru creșterea siguranței pacienților și va reduce riscul apariției de noi scandaluri de acest tip. Vă mulțumesc.

  Annie Schreijer-Pierik (PPE). – Dank aan de rapporteurs. Medische hulpmiddelen zijn onmisbaar in ons dagelijks leven, vooral als er even iets mis gaat en de patiënt weer patiënt gaat worden. Velen van ons danken hun leven aan medische hulpmiddelen: borst- of gehoorimplantaten, kunstheupen en virale testen maken het leven van mannen en vrouwen in de Unie gezonder en daar mogen we blij mee zijn. En niet te vergeten: zij zorgen voor een aangenamer en menswaardig leven.

Sinds de eeuwwisseling zijn wij geconfronteerd met schandalen, zoals het PIP-schandaal. Borstimplantaten bleken gevaarlijke siliconen te lekken. Ik ben daarom tevreden met de wetgeving die door ons als Parlement in onderhandelingen met de lidstaten en de Europese Commissie en onder het Nederlands voorzitterschap is bereikt. Deze wetgeving zorgt voor betere traceerbaarheid, grotere aansprakelijkheid en verantwoordingsplicht van producenten. Verder omvat zij scherpere regels voor risicovolle medische hulpmiddelen en tot slot een verscherpte beoordeling voorafgaand aan en na het op de markt brengen van deze producten. De gezondheid van de burger en gebruiker staat weer centraal.

Ik ben minder tevreden over de veel te trage wetgevingsprocedure met de lidstaten. De Europese Unie moet echter sneller resultaten gaan leveren wanneer het om volksgezondheid gaat. Deze wetgeving wordt pas over drie, respectievelijk vijf jaar van kracht. Deze wetgeving duurt veel te lang. Pas tien tot vijftien jaar na de grote schandalen. Wij moeten als Europa snelle resultaten gaan leveren.

  Soledad Cabezón Ruiz (S&D). – Señor presidente, yo no puedo más que agradecer y reconocer el gran trabajo de la señora Willmott y del señor Peter Liese en lo que considero que no solamente viene a solventar el tema de los productos sanitarios y cosméticos, sino que marca —o intuyo que marca— el futuro de la seguridad del paciente en general.

Han introducido conceptos tan importantes como la responsabilidad del fabricante, con cobertura financiera suficiente; tienden a eliminar y limitar el uso de tóxicos y cancerígenos en estos tipos de productos, una clara mejora de la trazabilidad, un seguimiento poscomercial y, por supuesto, información del paciente.

En definitiva, un excelente trabajo para estos productos, pero —como digo— estoy muy segura de que será el futuro también de la mejora de la seguridad del paciente en su conjunto.

  Seán Kelly (PPE). – Mr President, medical devices cover a wide array of products, from sticking plasters to heart valves, to analytical laboratory equipment; all in all, about 500 000 devices in the EU market. The proposals here mainly focus on scrutiny of devices before they are placed on the market and their surveillance after becoming available as well as their traceability and the supply chains, and this is highly commendable.

Proposals include stricter criteria for designating and monitoring notified bodies, adaptation of classification rules and streamlining of different assessment procedures. We must ensure a high level of health and safety protection for EU citizens using these products and must adapt the EU legislation to the significant technological and scientific progress in this sector over the last 20 years.

I believe that with this text these goals will be achieved and I commend the rapporteurs Willmott and my colleague, Liese on their significant work in this regard. With this work, we will see stricter requirements for notified bodies who check the conformity of these products. This is important for consumers who rely on them for ensuring the highest standards for these products in the EU.

Strengthened rules for high-risk devices are also welcome, as is the guidance and expertise to be provided by expert panels and laboratories on this issue. This is also important to ensure the utmost safety of products on the market. I am pleased with the inclusion of the enhanced system of traceability of devices along with post-market surveillance. I welcome the setting up of a central database. A good job well done by the rapporteurs.

  Karin Kadenbach (S&D). – Herr Präsident, Herr Kommissar! Ich danke zuerst einmal allen, die dazu beigetragen haben, dass wir wieder einen sehr wesentlichen Schritt in Richtung höchster Patientensicherheit machen konnten. Die Rechtsvorschrift ist komplex, umfangreich und von hochtechnischer Natur. In der dreijährigen Übergangszeit nach der Veröffentlichung der Medizinprodukteverordnung müssen die Regulierungsbehörden an die 80 Durchführungs- und delegierte Rechtsakte, davon 18 obligatorische, liefern. Sie müssen die Eudamed—Onlinedatenbank entwickeln und testen. Sie müssen neue Fachberatungsstrukturen und neue EU—Präferenzlaboratorien einrichten. Sie müssen die benannten Stellen, die für die Bewertung von Medizinprodukte—Dossiers zugelassen sind, neu benennen.

Derzeit stehen für diese und noch für etliche weitere Arbeiten knapp 15 Mitarbeiterinnen und Mitarbeiter in der DG GROW und im Joint Reseach Centre zur Verfügung. Soweit ich verstanden habe, ist gemeinsam vorgesehen, diese Gruppe auf ca. 40; 45 Leute aufzustocken, und es zeigt sich, dass hier die Rekrutierung offenbar recht langsam stattfindet. Wenn wir, was wir uns heute vorgenommen haben, nämlich höchste Patientensicherheit garantieren wollen, dann müssen wir auch garantieren, dass das dazu notwendige Personal vorhanden ist. Ich glaube, dass selbst die angestrebten 45 Personen diese große Aufgabe im Sinne der höchsten Patientensicherheit nicht werden erfüllen können.

  Andreas Schwab (PPE). – Herr Präsident, liebe Kolleginnen und Kollegen! Ich möchte mich zunächst natürlich auch bei allen bedanken, die an diesem wichtigen Dossier mitgewirkt haben: bei Frau Willmott, der Kollegin aus Großbritannien, bei Peter Liese, aber natürlich auch bei Mairead McGuinness bei uns in der Fraktion.

Der PIP-Skandal hat uns vor einigen Jahren alle außergewöhnlich schockiert. Mit dieser Gesetzgebung heute geben wir einen Gutteil der Antworten, die notwendig sind, um auf der einen Seite Patientinnen und Patienten Sicherheit zu gewähren, aber auf der anderen Seite das unglaubliche Innovationspotenzial der Medizintechnik nicht unnötig zu erschweren. Da waren viele schwierige Gespräche notwendig, da gab es viel Veränderungsbedarf, auch am Kommissionsvorschlag. Aber es ist uns gelungen, das jetzige Endergebnis dieser Diskussionen unbürokratisch zu gestalten – so unbürokratisch, wie das eben bei derart komplizierten Fragen geht –, gleichzeitig mehr Sicherheit für die Patienten zu erreichen und bei alledem den Innovationsaspekt der Medizintechnikbranche nicht zu sehr zu erschweren.

Ein wichtiges Element, das auch gelegentlich schon angesprochen wurde, besteht jetzt darin, dass die Umsetzung in Europa überall gleich erfolgen muss. Das wird die Sicherheit aller Europäerinnen und Europäer verbessern. Es wird keine unterschiedlichen Umsetzungsvarianten geben, sondern wir müssen Wert darauf legen, dass es einheitlich umgesetzt wird. Überall in Europa wird die Medizintechnikbranche sich am Ende nach einem Gesetz messen lassen müssen. Wir brauchen da pragmatische Lösungen, und wir brauchen flexible Lösungen, die es ermöglichen, dieses hohe Innovationspotenzial am Ende auch an die Patientinnen und Patienten heranzubringen.

  Nicola Caputo (S&D). – Signor Presidente, onorevoli colleghi, gli scandali degli ultimi anni sui dispositivi medici hanno evidenziato l'urgente necessità di porre rimedio all'evidente carenza normativa.

Complimenti ai relatori: finalmente l'Unione si dota di un quadro normativo solido e trasparente finalizzato a incrementare il livello di protezione della salute dei cittadini europei senza ostacolare l'innovazione. Tra le novità più significative figurano una procedura speciale per taluni dispositivi ad alto rischio con una valutazione indipendente da parte di un gruppo di esperti, un chiarimento dei ruoli e degli obblighi di tutti i soggetti operanti sul mercato, un divieto totale per determinate sostanze cancerogene, mutagene e tossiche presenti in alcuni dispositivi oggetto di una serie di deroghe e un sistema globale di tracciabilità dei dispositivi, di vigilanza e sorveglianza post-commercializzazione per garantire il monitoraggio costante e una rapida reazione in caso di problemi.

Abbiamo raggiunto un buon compromesso. Il nuovo quadro normativo permetterà di superare le differenze di attuazione e garantirà la sicurezza dei dispositivi medici e la loro libera circolazione nel mercato interno.

  Τάκης Χατζηγεωργίου (GUE/NGL). – Κύριε Πρόεδρε, θέλω κατ’ αρχήν και εγώ να συγχαρώ πραγματικά τους εισηγητές, γιατί φέρνουν στην επιφάνεια ένα ζήτημα που αφορά ζωές και την υγεία των ανθρώπων. Υποστηρίζω, επίσης, ότι, πριν οι ιατρικές συσκευές εισαχθούν στο εμπόριο, πρέπει να αποδεικνύεται ότι είναι ασφαλείς. Πρέπει, όμως, και μετά να πραγματοποιούνται ποιοτικοί έλεγχοι στις ιατρικές συσκευές, όπως και στα φάρμακα.

Τα εμφυτεύματα δεν αποτελούν παράμετρο, αλλά ουσιαστικό στοιχείο του ζητήματος, δεδομένης και της πολύ γνωστής υπόθεσης με τα εμφυτεύματα που αποκαλύφθηκε πριν από κάποια χρόνια στη Γαλλία. Τα όργανα μίας χρήσης χρήζουν περαιτέρω ενδελεχούς έρευνας. Η νομοθεσία πρέπει να επιβάλει και αιφνιδιαστικό έλεγχο. Κλείνω επαναλαμβάνοντας αυτό που είπα στην αρχή, ότι εδώ μιλάμε για τη ζωή και την υγεία των ανθρώπων και πρέπει να είμαστε αυστηροί.

  Γεώργιος Επιτήδειος (NI). – Κύριε Πρόεδρε, η ανάγκη που αισθάνεται κάθε άνθρωπος να προστατεύσει ή να αποκαταστήσει την υγεία του έχει δώσει τη δυνατότητα της αισχροκέρδειας στους κύκλους εκείνους που ασχολούνται με την παραγωγή και την εκμετάλλευση ιατρικών μηχανημάτων και άλλων συναφών προϊόντων. Τα κρούσματα αυτής της διαφθοράς είναι πολλά και δυστυχώς αυξάνονται, είτε διότι τα κράτη δεν μπορούν να ελέγξουν την κατάσταση είτε διότι πολλές φορές την ανέχονται. Τελικά θύματα και αποδέκτες αυτής της απαράδεκτης καταστάσεως, όμως, είναι οι ασθενείς και όσοι χρησιμοποιούν τα υλικά αυτά, διότι όχι μόνο δαπανούν μεγάλα ποσά για πολλές φορές ελαττωματικά υλικά, αλλά και διότι τίθεται σε κίνδυνο η υγεία τους.

Για τον λόγο αυτό, θέλω και εγώ να εκφράσω τα συγχαρητήριά μου προς τους εισηγητές του νέου κανονισμού διότι, μεταξύ των άλλων, έχουν προβλέψει πολλούς, ποικίλους και αυστηρούς ελέγχους των βιομηχανιών και των προϊόντων που παράγονται και με αυτό τον τρόπο προστατεύουν τη δημόσια υγεία.

  Maria Grapini (S&D). – Domnule președinte, domnule comisar, când vorbim de dispozitive medicale, trebuie să ne gândim la oameni și la securitatea lor. În foarte multe cazuri, pacienții au avut de suferit de pe urma calității acestor dispozitive medicale și îmi pare bine că raportorii au completat propunerea Comisiei cu responsabilitatea producătorilor, care lipsea din propunere.

Vigilența și supravegherea ulterioară introducerii pe piață sunt extrem de importante și valoarea raportului constă și în faptul că prevede inspecții neanunțate. Noul regulament stabilește dispoziții detaliate pentru întregul proces, cu norme clare. Apreciez că există o prevedere și de consiliere genetică în cazurile în care se recurge la teste genetice. Doresc să subliniez că acest raport introduce un sistem global îmbunătățit pentru trasabilitatea dispozitivelor și supravegherea ulterioară și monitorizare constantă pentru reacții rapide, pentru că aici vorbim de viața oamenilor.

Am auzit o colegă care spunea că certificările dispozitivelor sunt prea numeroase. Eu cred că nimic nu este prea numeros pentru viața și securitatea pacienților și vreau să o felicit pe Glenis și pe toți raportorii care au lucrat pentru munca extraordinară la un raport extrem de tehnic, dar extrem de important din punctul de vedere al calității actului medical și al sănătății pacienților.   Vytenis Povilas Andriukaitis, Member of the Commission. – Mr President, I truly believe that this is an important day for EU patients, medical society and industry – especially its innovative sectors – and for all EU citizens. Thank you all for making this happen.

We have set the conditions for Europeans to receive the safest and most reliable healthcare, and for the EU to remain at the forefront of innovation in the field. However, let me also add that the adoption of these two comprehensive texts represents only the beginning of a long and challenging process. We now need to make sure that the new system is effectively put on the ground and delivers the expected added value to all stakeholders.

The Commission will continue to consider this dossier as an utmost priority. I am confident that with the support of the European Parliament, national authorities, patients and all the relevant operators, the challenge of the implementation of this new legal framework will be met successfully and, very importantly, in good time. I wish you all the best and thank you very much indeed.

  Glenis Willmott, rapporteur. – Mr President, thank you all for your support and comments. The medical devices industry is hugely important in the EU, with over 25 000 companies employing almost 600 000 people. That is a lot of people.

Throughout our work on this legislation, we had in mind that we needed stronger rules to improve device safety and protect patients without stifling the innovation that is a key feature of the industry in Europe. I believe the agreement that we have reached strikes the right balance. This will strengthen requirements for medical devices, and require high-risk devices to undergo additional pre-market assessment. Stricter rules on post-market surveillance will also ensure a faster response if there is a problem with a device and a new ID system will improve traceability.

It is clear that Member States will have to cooperate and share information, and the new EU-wide database EUDAMED will help them do that. And importantly, patients will have more information on the devices they use or are treated with.

Unfortunately, we cannot go back in time and prevent past scandals from happening, but with this legislation, we can make them much less likely in the future. Patients rightly expect that if a device has been placed on the market, then it must be safe. But unfortunately this has not always been the case. We have a responsibility to make sure that patients can have confidence in the medical devices industry and I firmly believe that this is what the agreement we will be voting for this week will do.

Once again, thank you to everyone who has helped us to get to this stage, and again in particular to all of our staff and the Group staff, who have worked their socks off on this. I hope we have strong support in the vote tomorrow, because at the end of the day, this is about the safety of patients across the EU, and nothing can be more important than that.

  Peter Liese, Berichterstatter. – Auch von meiner Seite ganz herzlichen Dank für die Unterstützung, die ja von fast allen Rednern gekommen ist. Ich freue mich sehr darüber. Ich möchte kurz auf die kritische Stimme von der UKIP eingehen. Frau Reid ist leider nicht mehr da, deswegen kann sie das jetzt leider nicht mehr hören; vielleicht kann man es ihr aber zutragen. Sie hat gesagt, es wäre doch gut, wenn die Mitgliedstaaten sich um das Thema kümmern. Ich denke, wir müssen klar sehen, dass, wenn diese Produkte im Binnenmarkt gehandelt werden, wir dann auch gemeinsame Standards zur Kontrolle haben. Es geht nicht, dass wir einen offenen freien Markt haben und dass die Gesundheit der Verbraucherinnen und Verbraucher nicht durch gemeinsame Standards geschützt ist, und ich glaube, die UKIP und ihre Verbündeten werden noch erleben, welche riesigen Probleme auf die Bevölkerung in Großbritannien zukommen, wenn der Binnenmarkt irgendwann nicht mehr da ist. Da werden Produkte teurer, da werden auch Innovationen vielleicht aus dem Rest Europas nicht so schnell auf die Insel kommen, und da werden sie noch sehen, was das für eine verrückte Politik ist, die die UKIP auch heute wieder im Europäischen Parlament vertreten hat. Wir brauchen diese Regeln, und wir brauchen den Binnenmarkt mit hohen Regeln zum Schutz der menschlichen Gesundheit.

Und dann möchte auf eins eingehen, was viele Kolleginnen und Kollegen gesagt haben: Warum hat das so lange gedauert? 2012 war der PIP—Skandal, nein, 2012 hat die Europäische Kommission diesen Vorschlag gemacht, der Skandal war noch etwas früher. Und wir haben viereinhalb Jahre gebraucht. Es ist ein schwieriges technisches Dossier. Deswegen kann man das nicht zwischen Mittagessen und Abendessen mal eben verhandeln. Aber wir als Parlament haben in zwölf Monaten eine umfassende Stellungnahme zu allen Themen verabschiedet, und der Rat hat dann noch mal zweieinhalb Jahre gebraucht – das ist leider bei vielen anderen Themen auch so. Europa muss sich nicht um alles kümmern, aber wenn wir solche Probleme haben, dann muss der Rat in Zukunft ein bisschen schneller werden, und dazu sollten wir gemeinsam an die Mitgliedstaaten appellieren. Gute Gesetzgebung kommt, aber sie kommt zu spät. Und auch in anderen Bereichen muss der Rat sich demnächst ein bisschen schneller anstrengen, damit wir die Probleme lösen.

  Cristian-Silviu Buşoi (PPE), in writing. – The medical devices sector, representing more than 25 000 companies of which 95% are SMEs, has not only become an influencer on expenditure, but also increasingly important for the healthcare of EU citizens, covering a wide range of products, from simple bandages to heart valves, and the most sophisticated X-ray equipment. It helps improving the quality of life of citizens by providing innovative health care solutions regarding diagnosis, prevention, monitoring, treatment and alleviation. Since the existing regulatory framework dated back to the 1990s, only considering the advances of technology in the medical sector there was a stringent need for revision. The new regulations on medical and in-vitro diagnostic medical devices will help to ensure that all medical devices are safe and perform well, and will make sure that all medical and in vitro diagnostic devices are designed to reflect the latest scientific and technological state-of-the art, but also comply with EU patient safety and ethical requirements. The rules will also improve market surveillance and traceability, and provide more transparency and legal certainty for producers, manufacturers and importers and help to strengthen international competitiveness and innovation in this strategic sector. I strongly support the outcome reached.

  Elżbieta Katarzyna Łukacijewska (PPE), na piśmie. – Prace nad modernizacją przepisów dotyczących wyrobów medycznych, w tym również do diagnostyki in vitro, trwały od 2012 r., a obecne rozwiązania w tym zakresie zostały opracowane w latach 90. Zważywszy na szybkość postępu technologicznego oraz innowacje w tej dziedzinie, regulacje wymagały dostosowania do realiów, co potwierdzają wypracowane przepisy. W trakcie prac głównymi celami, którym służyć miały regulacje, było: zapewnienie bezpieczeństwa wyrobów sprzedawanych w UE oraz zwiększenie dostępu do innowacyjnych rozwiązań, by mogły one w sposób skuteczny służyć ochronie pacjentów. Musimy pamiętać, że wyroby te w wielu przypadkach pomagają diagnozować i leczyć choroby, schorzenia oraz, co bardzo ważne, że dzięki ich użyciu możemy im zapobiegać. Katalog wyrobów medycznych oraz wyrobów do diagnostyki in vitro to ponad 500 tys. produktów, które dostępne są na rynku UE. Chcąc uniknąć skandali, z jakimi mieliśmy do czynienia w przeszłości, kiedy to wadliwe silikonowe implanty piersi, niespełniające standardów zostały wszczepione 300 tys. kobiet na całym świecie, należy bezwzględnie zapewnić bezpieczeństwo tego typu wyrobów. Najskuteczniejszym sposobem jest kontrola, identyfikacja i nadzór nad wyrobami medycznymi podczas całego cyklu życia produktów. Pozwoli to na podjęcie zdecydowanych działań i reakcję w przypadku pojawienia się problemów mogących mieć negatywny wpływ na życie i zdrowie ludzkie, które powinno być największą wartością.
