  Jean-Marie Cavada, rapporteur. – Monsieur le Président, la situation française suppose que l’on soit disponible pour les commentaires, puisque nous sommes en train de constituer un gouvernement à forte densité européenne.

J’en viens au rapport et je voudrais me féliciter de cet accord car il nous fait franchir un pas très important entre les trois institutions et permettra l’application de ce règlement, de façon concrète, début 2018.

Cette proposition était très attendue des citoyens européens, qui pourront maintenant se déplacer en emportant les services auxquels ils sont abonnés dans leur propre pays. Le règlement s’appliquera aux services fournis contre rémunération; par conséquent, le principe du maintien du droit d’auteur est sanctifié et souligné par ce texte mais nous introduisons une liberté nouvelle qui est tout à fait importante, celle de pouvoir se déplacer temporairement et de bénéficier temporairement des services dont on dispose dans notre lieu de résidence, dans notre pays d’origine.

La définition et les moyens de vérification de l’État membre de résidence constituent une disposition tout à fait essentielle pour le fonctionnement de ce dispositif. Le texte est suffisamment clair: les fournisseurs des services devront vérifier le pays de résidence des abonnés et les contrôles seront effectués conformément aux règles de l’Union européenne, à savoir notamment qu’ils ne transgresseront pas les règles relatives à la protection des libertés individuelles et à la discrétion des données. De ce point de vue aussi, ce texte est très équilibré.

De même, un système de dérogation à la vérification est également prévu en cas d’accord entre les fournisseurs de services et les ayants droit, à condition que l’ensemble des ayants droit au contenu utilisé par le fournisseur de services soit concrètement inclus dans l’accord et qu’il n’y ait pas de fraude sur l’État de résidence.

Afin de prévenir les abus, il sera possible au fournisseur de services, s’il en a la volonté, de vérifier dans une liste fermée de possibilités, notamment au moyen de l’adresse IP, s’il n’y a pas de fraude à cet accord, de façon à maintenir l’équilibre entre les deux aspects, droits d’auteur, d’une part, et liberté de circulation pour les déplacements temporaires, d’autre part.

Je sais la nécessité pour notre marché unique numérique de pouvoir concilier l’exercice des droits de propriété intellectuelle et la libre prestation des services commerciaux. Ce règlement a donc réussi, en réalité, un pari qui apparaît à beaucoup, pour des raisons idéologiques, difficile mais qui, avec un peu de bon sens et de volonté de ne pas appauvrir la création européenne, peut s’appliquer sans aucune difficulté.

Aujourd’hui, je souhaite que nous puissions tous compléter ce texte afin de pouvoir entamer des négociations entre les trois institutions qui permettent une application rapide.

À cet égard, je remercie M. le commissaire d’avoir fait un pas vers les différentes demandes que nous avions faites dans ce sens et j’espère que nous aboutirons très vite à l’application de ce règlement, probablement en 2018, comme je l’ai dit.

  Andrus Ansip, Vice-President of the Commission – Mr President, honourable Members of the European Parliament, we all know that those roaming surcharges will be abolished in the European Union very soon. The 15 June will be the end date of those roaming surcharges for European citizens, and if people do not have to pay those high roaming surcharges anymore, they would like to get more and more access to their legally bought digital content even when they travel in other EU Member States.

We know that 20% of European citizens spend at least ten days during the year in some other EU Member State, and many of those people travelling in some other EU Member State would like to get access to their legally bought digital content; to their favourite movies, TV series, music, video games, e—books, audio books, sports events, and football, all of which are really important. But today, they cannot do so. We have to provide legal access to digital content for our citizens. We know that according to public opinion polls, even 20% of internet users in the European Union are using VPN to get access to digital content. Even 68% of film viewers in the European Union say that they are using so-called free downloads. This is a problem. Authors are not fairly remunerated. So, I am happy that we were able to reach consensus in this cross-border portability proposal, and I am absolutely sure that all the European citizens will also be happy. I would like to thank the European Parliament, and especially the rapporteur, Mr Cavada, and all the shadow rapporteurs, and I would like to ask Parliament to vote in favour of this very important proposal.

  Carlos Zorrinho, relator de parecer da Comissão da Indústria, do Comércio Externo, da Investigação e da Energia. – Senhor Comissário, queria também começar por cumprimentar o relator pelo trabalho conjunto que foi possível desenvolver. Todos sabemos que é muito importante definir juridicamente os procedimentos para assegurar uma efetiva portabilidade transfronteiriça de serviços e conteúdos em linha, mas isso não dispensa a harmonização e a modernização das infraestruturas tecnológicas ao nível europeu e um combate muito forte à exclusão digital, provocada quer por problemas de qualificação, quer por problemas de dificuldades económicas, quer por restrições geográficas.

Este parecer, de que fui relator na Comissão ITRE, contém contributos muito relevantes no plano jurídico e processual.

Permite diferenciar entre pagamentos de serviços e pagamentos de taxas de licenciamento.

Garante a vinculação dos credores às condições contratuais, estabelecidas à data da entrada em vigor deste regulamento.

Assegura o dever de informação quanto à qualidade dos serviços.

Estabelece as definições de assinante, consumidor, Estado-Membro de residência, de permanência temporária.

Define mecanismos simplificados de verificação.

Garante a neutralidade tecnológica.

Tudo isto é muito importante mas, como o Sr. Comissário também aqui referiu, para tirar partido desta oportunidade é importante desenvolver uma identidade digital europeia que seja fundada na inclusão digital e na liderança tecnológica e, para isso, é muito importante integrar este regulamento com o Pacote Telecom, com as regras do fim do Roaming ou com a concretização da iniciativa WIFI4U.

Só assim nós conseguiremos fazer da portabilidade uma medida que beneficie todos, que desenvolva o mercado e que beneficie em concreto os cidadãos europeus.

A nossa ambição deve ser, primeiro que tudo, reconectar os cidadãos europeus com o projeto europeu e concretizar medidas que influenciem e melhorem a sua vida no dia a dia.

E este regulamento em debate é um bom exemplo desse tipo de medidas.

  Marco Zullo, relatore per parere della commissione per il mercato interno e la protezione dei consumatori. – Signor Presidente, onorevoli colleghi, prima di tutto faccio i complimenti al relatore per l'ottimo lavoro svolto.

Oggi l'Europa punta sempre più verso la mobilità dei cittadini e quindi l'impossibilità di usufruire liberamente di servizi digitali già acquistati legittimamente è una barriera non più sostenibile, quindi bene questo regolamento che supera tale difficoltà per i cittadini. Però vorrei che in futuro si andasse verso una visione per cui non ci sia nessuna discriminazione nei confronti dei cittadini sulla base dei confini amministrativi di uno Stato membro.

Come relatore della commissione IMCO sono felice che siano stati mantenuti molti dei principi che abbiamo enunciato, quindi nessun limite temporale (alla temporaneità) per permettere a chi viaggia per lavoro e anche per studio di accedere a questo servizio; assoluto divieto di tracciare i dati dell'utente; assoluto divieto di trattare e conservare i dati dell'utente e, quindi, tutela massima della riservatezza degli utenti e soprattutto, nessun costo aggiuntivo per poter usufruire di questo servizio.

  Sabine Verheyen, Verfasserin der Stellungnahme des mitberatenden Ausschusses für Kultur und Bildung. – Herr Präsident, Herr Kommissar, liebe Kolleginnen und Kollegen! Mit der Verordnung zur Portabilität machen wir einen wichtigen Schritt zur Verwirklichung des digitalen Binnenmarktes. Es ist gelungen, einen ausgewogenen Kompromiss zu erarbeiten, der einerseits den Zugang von Bürgerinnen und Bürgern zu ihren legal erworbenen Inhalten ermöglicht – auch grenzüberschreitend –, andererseits die Rechte der Rechteinhaber jedoch ausreichend schützt, wodurch auch in Zukunft kulturelle Vielfalt abgesichert wird.

Das gut funktionierende System europäischer Filmfinanzierung und das Prinzip der Territorialität konnten auch durch ein flexibel gestaltetes Verifikationssystem geschützt werden, und dies war uns ein besonders wichtiges Anliegen im Kulturausschuss, weil wir davon überzeugt sind, dass wir die kulturelle Vielfalt und die Stärkung auch des europäischen Filmsektors zum jetzigen Zeitpunkt nur durch das Beibehalten des Territorialprinzips erreichen können und ein langer Zeitraum gebraucht wird, um hier neue Strukturen dauerhaft aufbauen zu können.

Eine große Zahl von Europäern, die sich innerhalb der EU aus unterschiedlichen Gründen – sei es aus beruflichen Gründen, zum Studium oder zur Freizeitgestaltung – vorübergehend im Ausland aufhalten, wird von dieser Verordnung profitieren, weil ihnen so ermöglicht wird, ihr Heimatprogramm, das sie legal erworben, auch auf Reisen mitzunehmen. Das entspricht unseren Vorstellungen von Mobilität und der Freiheit auch zum Zugang von Inhalten.

Ich begrüße, dass wir hier einen klaren Rechtsrahmen haben, der auf der einen Seite den Datenschutz berücksichtigt, auf der anderen Seite aber auch einen Handlungsspielraum gibt, der flexibel genug ist, um auch verschiedene Systeme der Verifikation umzusetzen, so dass wir hier in der Anwendung dennoch einfach bleiben können und dabei die notwendige Rechtssicherheit auf allen Seiten gewährleisten. Ich denke, hier ist ein guter Kompromiss gelungen, der uns einen deutlichen Schritt weiterbringt. Ich möchte den Berichterstattern und den Schattenberichterstattern an dieser Stelle recht herzlich für ihre Arbeit danken.

  Angelika Niebler, im Namen der PPE-Fraktion. – Herr Präsident, Herr Vizepräsident der Europäischen Kommission, liebe Kolleginnen, liebe Kollegen! Auch ich möchte zunächst ein herzliches Dankeschön an unseren Berichterstatter adressieren. Monsieur Cavada, Sie haben einen exzellenten Job gemacht! Nicht nur, dass Sie sichergestellt haben, dass wir uns in kurzer Zeit auf diesen Vorschlag geeinigt haben, ich fand auch die Zusammenarbeit mit Ihnen ausgesprochen zielführend. Es gibt wenige Dossiers, bei denen wir in so kurzer Zeit dann auch für unsere Bürgerinnen und Bürger etwas erreichen können.

Und damit bin ich beim Thema. Ich freue mich, dass wir heute wirklich für unsere Bürgerinnen und Bürger etwas real Erfahrbares, Erlebbares gemacht haben – der Kommissionsvizepräsident hat es ja schon angesprochen: Ich freue mich riesig, dass wir zum 15. Juni keine Roamingaufschläge mehr haben, dass wirklich jeder mit seinem Smartphone in der Europäischen Union seine Dienste abrufen kann. Und ein Stück, um eben weiter in diesem Europa für unsere Bürger und Bürgerinnen etwas Positives zu erreichen, ist die Portabilitätsverordnung, über die wir morgen abstimmen. Ich hoffe sehr, dass es eine breite Unterstützung und Zustimmung auch von allen Seiten gibt.

Was ist damit erreicht worden? Wenn Sie heute in Urlaub fahren in ein anderes europäisches Land und Sie nehmen ein Buch mit, und Sie würden dieses Buch aufschlagen und sehen, dass es dort nur weiße Seiten gibt, dann wären Sie enttäuscht und könnten es nicht fassen. Genau das aber passiert heutzutage oft noch mit Online-Diensten mit Abos, die Sie online bestellt haben, die Sie in Ihrer Heimatstadt und in Ihrem Heimatland bezahlt haben – Spiele, Spielfilme, Sportberichterstattung etc. können nicht abgerufen werden. Künftig ist dies Gott sei Dank möglich, eben mit dieser neuen Portabilitätsverordnung.

Ich komme aus München. Ich freue mich riesig, dass ich künftig die Fußballspiele es FC Bayern nicht nur bei mir zu Hause sehen kann. Ich habe ein Abonnement, das mir das online zubilligt, und ich kann künftig auch, wenn ich hier in Brüssel oder Straßburg zu tun habe, die Fußballspiele meines Heimatvereins mitverfolgen. Das ist etwas Großartiges. Ich freue mich, dass das künftig alle Bürgerinnen und Bürger in Europa können.

  Victor Negrescu, on behalf of the S&D Group. – Mr President, this report represents a new and important step towards facilitating the free movement of people and services in the European Union. It enables European consumers who subscribe to online contact services acquired legally in their Member State of residence to continue to access the service when they are temporarily in another Member State. I congratulate all colleagues who worked on this report and salute the important contribution of the Maltese Presidency in making this happen.

To be more exact, the Portability Regulation ensures that consumers can use portable online contact services which offer access to music, games, films, entertainment programmes or sporting events not only in the Member State of residence but also when they are temporarily present in another EU country for purposes such as leisure, travel, business trips or learning mobility. We are speaking about almost 6% of the European population, around 30 million people, and the number could grow by 2020 up to 70 million beneficiaries. This regulation includes not only people who travel but also students studying abroad, people who work for a limited period of time in another Member State or cross-border commuters.

I am glad to say that we, the European Parliament, secured in the trilogue important achievements, defended strongly also by my group, the Socialists and Democrats. I refer here to: the absence of specific time limitations; the deletion of the formulation ‘regularly returns’; the closed links for the means of verifications; the restrictive IP checking in binary format; the safeguards in terms of data protection; the promotion of study mobility as an example for the use of portability; or the provisions that allow the waiver of the mandatory verification of the Member State of residence.

These are great achievements, and it is important to mention that the European Parliament promoted them, but we have also to be clear that this report is implemented without affecting either the copyright protection framework or the principle of territoriality. I really believe this regulation is an important step for building a common market, but also a common society where European citizens feel free to move in any Member State without restrictions or limitations.

  Sajjad Karim, on behalf of the ECR Group. – Mr President, I would like to start first of all by thanking my friend the rapporteur Jean-Marie Cavada on delivering what is for European Union citizens a real breakthrough. For far too long we have tried to work towards deconstructing borders, only today to find ourselves in a situation where our citizens can physically pass through a border, but a big part of their life stops as soon as they do so because they cannot access the digital content that rightfully belongs to them. Therefore, it was essential that this matter was dealt with, and I congratulate you for the approach that you have taken and the well-balanced inclusive solution that you have arrived at.

That balance has been struck between consumer rights and right holders. It was essential that this Parliament delivers a strong message of support to the rapporteur’s work. I will certainly do that, and my Group also, through the trilogue outcome, which we will be voting on tomorrow. I truly believe it is a digital single market success story. It strikes the right balance between providing online content to consumers while they are temporarily outside of their own Member State, whilst ensuring that sufficiently robust residency verification safeguards are in place for rights holders.

I am happy to see that the verification methods strike the right balance between being effective but respecting data protection rules in order to avoid abuse. Service providers will do so by verifying a subscriber’s country of residence through payment details, an internet contract or an IP address check. Slowly but surely, the digital single market is being addressed and consumers and rights holders can both be happy with the outcome of this report.

  Dita Charanzová, on behalf of the ALDE Group. – Mr President, seamless access around the European Union to online content services is important for the smooth functioning of the internal market and for the effective application of the principle of free movement of persons and services. It is also important for many of us to fully enjoy our time with family and away from work. With the adoption of this regulation, we are helping to ensure people moving through Europe for leisure, business or learning are not blocked from their legally purchased content and, in many cases, access to their own language and culture.

The ALDE Group promised all voters two major items during the European elections: an end to roaming and an end to geo—blocking. With this vote – the vote on the end of geo—blocking of legally owned content – we show that we keep our promises. We have allowed our citizens to take their internet everywhere with them in Europe and after today we will allow them to take their digital content too. We pay for this content and no—one should tell us where we can and cannot access it. Never again will you miss your favourite TV or radio shows just because you are travelling in Europe.

  Martina Michels, im Namen der GUE/NGL-Fraktion. – Herr Präsident, liebe Kollegen! Ja, es ist leider wahr: Bisher konnten wir bereits online gekaufte Musik, Filme oder unsere Lieblingsserien in Europa nicht einmal grenzübergreifend nutzen. Ja, die neue Portabilitätsrichtlinie wird da endlich etwas Abhilfe schaffen, deswegen werden wir auch zustimmen. Aber wahr ist auch: Aus kulturpolitischer Perspektive ist das nur ein Minischrittchen. Denn allein die gegenwärtigen öffentlichen Debatten zeigen, dass einige Akteure in der kulturellen Kleinstaaterei weiter schlafen wollen. Längst erobern doch HBO/CBS oder andere Plattformen wie Netflix inzwischen auch mit europäischen Eigenproduktionen die Herzen des Publikums.

Da, wo Geoblocking ins Wanken gerät, sind bisher größere tragfähige politische Lösungen außer Sichtweite. Ja, es geht um das Geschäftsmodell der großen und kleinen europäischen Film- und Musikproduzenten. Das ist keine konfliktfreie Debatte um eine Öffnung des Territorialprinzips. Doch wir müssen sie endlich führen und fragen, wie europäische Film- und Musikproduzenten heute grenzüberschreitend erfolgreich sein können, damit europäischer Kulturaustausch über Festivals hinaus im Alltag ankommt.

  Julia Reda, on behalf of the Verts/ALE Group. – Mr President, Europe is a union, and yet we still have digital borders between Member States today. On this day we are creating a small exception to those borders. People will no longer be blocked from accessing the videos that they have already paid for just because they are visiting another country.

That is good. It is common sense and it is an important step forward, but this has to be the first step of many in the fight against geo-blocking; it cannot be the last. Geo-blocking will remain a widespread problem when this regulation is enacted. According to the Commission, almost 70% of video sites in the EU geo-block. Our own Parliament Research Service has estimated that people are actually willing to pay almost a billion euros extra per year if geo-blocking is abolished altogether. That is income, and that is an audience that we are currently denying our European creators.

Now the film industry has voiced quite a lot of concerns. Some feel that they have come to rely on geo-blocking as the sole means for their business model. Let us work together to find solutions to that, but the solution cannot be to accept virtual borders. The status quo is simply not working for consumers. It is failing at making Europe’s amazing cultural diversity accessible to all Europeans.

Let us be clear: geo-blocking is a form of discrimination. A common European public sphere cannot develop with geo-blocking in place. It locks European audiences out from European works and it locks artists’ international borders. ‘This video is not available in your country’. Let’s put these words where they belong, not on the screens of European internet users, but in the dustbin of history.

  Stanislav Polčák (PPE), otázka položená zvednutím modré karty. – Já jsem velmi pozorně poslouchal váš projev. Rozumím tomu, že jsme učinili malý krok v oblasti on-line služeb, ale pokud bychom měli jít ještě do dalších oborů autorských práv, tak se to poněkud bije se zásadou teritoriality, která je pro tento právní obor zcela vlastní.

Můžete tedy uvést nějaký konkrétní právní nebo jiný nástroj, jak bychom tuto zásadu nemuseli porušovat a zároveň tedy vyhověli i vámi pochopitelné snaze překračovat hranice?

  Julia Reda (Verts/ALE), blue-card answer. – Mr President, thank you very much for the question. The Portability Regulation will ensure that, when you go on holiday to another country, you can access content that you have already had access to in your home country. But those who find themselves permanently on the wrong side of the border – for example, linguistic minorities or language learners – cannot benefit from that. I think the overall effect of geo-blocking on the film industry is negative. On average, a European film is only legally available in two to three countries outside the EU. This means that there are a lot of paying customers who do not have the possibility to access this content legally. We need to take into account the possible revenues that could be created if there was a legal offer.

  Gilles Lebreton, au nom du groupe ENF. – Monsieur le Président, la portabilité permet à une personne abonnée à un service en ligne de continuer à l’utiliser quand elle est en déplacement temporaire dans un autre État membre de l’Union. En soi, l’idée est donc intéressante. Plusieurs constats doivent toutefois inciter à la prudence.

Tout d’abord, le texte proposé est un règlement et non une directive; il sera donc particulièrement contraignant pour les États.

Ensuite, il risque à terme de remettre en question le droit de géo-blocage qui est une composante de la souveraineté des États.

De plus, il souffre d’une grave contradiction interne en ne précisant pas la durée limite de séjour dans un autre État ouvrant droit à la portabilité. Dès lors, la portabilité risque de devenir un principe et non une exception.

Enfin, le texte risque de favoriser des offres globales qui mettront en péril la territorialité du droit d’auteur et qui provoqueront une réduction de la diversité des offres. Une fois de plus, l’Union favorisera ainsi la concentration des offres au profit des multinationales. Pour toutes ces raisons, je voterai contre ce texte.

  Λάμπρος Φουντούλης (NI). – Κύριε Πρόεδρε, στα μάτια ενός νέου η σημερινή συζήτηση θα φαντάζει κενή και άνευ ουσιαστικού περιεχομένου. Στην εποχή της ψηφιακής επανάστασης είναι εξαιρετικά εύκολη η πρόσβαση σε όλων των ειδών τις υπηρεσίες παροχής διαδικτυακού περιεχομένου, πολύ πριν η Επιτροπή αποφασίσει να ασχοληθεί νομοθετικά με το αντικείμενο. Εν πάση περιπτώσει, η έκθεση που συζητάμε σήμερα δεν διασφαλίζει ούτε τα προσωπικά δεδομένα των χρηστών, παρέχει υπερβολικές δυνατότητες στις εταιρίες ενώ, αντίθετα, σωστά αναφέρει πως μια πλήρης απελευθέρωση θα είχε σοβαρότατο αρνητικό αντίκτυπο, τόσο στους χρήστες αυτών των υπηρεσιών, όσο και στην εθνικές οικονομίες και ειδικά στον τομέα της παραγωγής μουσικής, τηλεοπτικών σειρών, ταινιών και άλλων ειδών σχετικών με καλλιτεχνική δημιουργία και πνευματικά δικαιώματα. Συμφωνώ με τη θέση για δυνατότητα προσωρινής πρόσβασης για όσους μετακινούνται μεταξύ των κρατών μελών της Ένωσης, αλλά πιστεύω πως είναι αναγκαία η θέσπιση συγκεκριμένου ορίου ημερών, καθώς μόνο έτσι δεν θα γίνει κατάχρηση της δυνατότητας αυτής. Τέλος, όλοι πρέπει να παραδεχτείτε πως οι ευρωπαίοι πολίτες αντιμετωπίζουν σήμερα πολύ σοβαρότερα προβλήματα τα οποία απαιτούν λύση και δεν έχουν ανάγκη τη νομοθετική παρέμβαση της Επιτροπής σε ζητήματα άνευ πραγματικής αξίας που τα έχει λύσει από μόνη της η κοινωνία.

To, że ciągle jeszcze nasz wspólny europejski rynek jest podzielony na 28 kawałków, jest tylko ponurym dowodem na to, że ciągle jeszcze mamy tendencje do myślenia ograniczonego do granic kraju, w którym na co dzień żyjemy. Ale to rozporządzenie, które jutro będziemy przyjmować, pokazuje, że jednak powoli idziemy w dobrym kierunku, i korzystam z okazji, żeby pogratulować i Panu, Panie Przewodniczący, i naszemu koledze Jean-Marie Cavadzie i wszystkim koleżankom i kolegom, którzy nad tym rozporządzeniem pracowali.

Świat zmienia się coraz szybciej i jednym z obecnych wyzwań jest zapewnienie konsumentom możliwości swobodnego korzystania z usług online, które sobie wykupili, również poza krajem, w którym zamieszkują na co dzień, i dzisiaj (przyjmujemy jutro to rozporządzenie) konsument nie będzie miał już problemu np. z oglądaniem swojego serialu, meczu czy tego, co najbardziej lubi, w trakcie podróży. A namawiamy naszych obywateli do tzw. mobility w czasie podróży służbowej, wakacji czy inaczej spędzonego czasu poza swoim krajem. Ale to jest dopiero ten jeden krok, przed nami już następne kroki: możliwość przenoszenia treści cyfrowych będzie w pełni wykorzystywana dopiero wtedy, kiedy nie będziemy mieli w Unii Europejskiej dodatkowych opłat za roaming, a to już za miesiąc. To nastąpi 15 czerwca. Następnym krokiem będzie zniesienie nieuzasadnionego geoblokowania itd., i w końcu nasi obywatele będą mogli rzeczywiście czuć się jak w domu na całym rynku europejskim, czego wszystkim nam życzę.

  Nicola Danti (S&D). – Signor Presidente, onorevoli colleghi, signor Vicepresidente Ansip, il regolamento sulla portabilità dei contenuti online rappresenta una delle prime misure concrete della strategia del mercato unico digitale presentata dalla Commissione europea. Esso costituisce la prima tappa di un percorso più ampio, volto a eliminare tutte le forme di geoblocco ingiustificato e che contribuirà a realizzare concretamente l'idea di uno spazio comune di diritti e opportunità per i cittadini europei.

La costituzione di una dimensione digitale europea del mercato unico parte anche dal riconoscimento della possibilità di usufruire dei contenuti online acquisiti nel proprio paese di residenza, film, musica, giochi ed eventi sportivi potranno essere visti in tutto il territorio dell'Unione, anche quando siamo al di fuori del nostro paese di residenza, in occasione di viaggi, di studio oppure di lavoro. Nonostante oggi solo una fascia limitata della popolazione europea sia coinvolta, i numeri sono destinati ad aumentare esponenzialmente, arrivando a coinvolgere 72 milioni di cittadini europei entro il 2020.

La finzione giuridica alla base del regolamento amplia le opportunità per i consumatori senza compromettere la protezione dei diritti d'autore e la qualità delle industrie creative, elemento importante del modello di sviluppo europeo. Il nostro impegno in commissione mercato interno si è focalizzato proprio sulla ricerca di un giusto equilibrio tra l'esigenza di fornire ai consumatori uno strumento agile ed efficace, di tutela rigorosa della privacy, di certezza giuridica e la tutela del diritto d'autore. Credo che l'accordo finale riassuma in modo efficace queste considerazioni.

Spiace soltanto, signor Presidente, Commissario, che ancora una volta il Consiglio non abbia avuto la nostra stessa ambizione nel prevedere un sistema di verifica più agile e un periodo di attuazione più rapido.

  Ангел Джамбазки (ECR). – Уважаеми г-н Председател, представители на Комисията, колеги, най-напред искам да благодаря на колегата Кавада и на докладчиците в сянка за упоритата и последователна работа, за постигнатия резултат. Това споразумение ще бъде важна стъпка към подобряване на качеството на живот на гражданите на държавите – членки на Европейския съюз. Вероятно всеки един от тях е бил в ситуация, в която има абонамент за онлайн услуга, временно се е преместил в чужбина и не е имал достъп до услугата, за която е заплатил и на която е бил абонат.

Това предизвикателство за стратегията за цифров единен пазар не само създава несправедлива тежест за притежателите на права, но и причинява правна несигурност и ограничава донякъде свободното движение на хората и произтичащите от него права, каквито са и Договорите за Европейския съюз.

Надявам се, че в резултат на тристранните срещи, в рамките на девет месеца ще станем свидетели на тази съществена промяна. Чрез трудни преговори беше постигнато балансирано споразумение, с което не само ще бъдат преодолени предизвикателствата на преносимостта, но и ще се гарантира, че притежателите на права разполагат с ефективни предпазни мерки за проверка на своето пребиваване, така че да могат да се възползват от предимствата на своите абонаменти, където и да се намират.

Én is osztozom az Ön örömében, illetve azoknak az eredményeknek rendkívül örülök, amiket Ön is felsorolt, viszont azt kérdezném, hogy Ön osztozik-e velem abban az aggodalmamban, hogy van egy olyan szolgáltatás, ami még mindig be van ragadva és nem az egységes európai piac szerint működik? Nevezetesen, hogy ha én Önt a saját hazámból hívom mobiltelefonon, akkor bizony az külföldi hívásnak minősül. Ha ugyanezt teszem külföldről, akkor már természetesen jóval olcsóbb, pedig ugyanúgy mi beszélgetünk ugyanazokról a telefonokról. Kérdezem: osztja-e Ön ezt az aggodalmamat, hogy ezen változtatni kéne?

А по отношение на Вашия въпрос дали трябва да се преразгледат, според мен, да, трябва, но това е въпрос на преговори между телекомуникационните оператори, с които Вие имате договор. Това са и донякъде и частно-правни отношения.

Но рано или късно този въпрос ще бъде поставен – да бъдат изравнени телекомуникационните оператори, които оперират в сферата на цифровата технология и тези, които предоставят кабелна услуга. Така че, да, това ще се случи рано или късно.

  Yana Toom (ALDE). – Mr President, the report on cross-border portability is a great step forwards for the Digital Single Market. With the increased mobility of Europeans and the abolishment of roaming charges, it was a logical step. The creation of this legal fiction will ensure that all Europeans who travel to another Member State will have access to the content they have paid for in their own country. It abolishes borders for all kinds of online services that many people use, be it for music, e-books or movies.

However, our work is still not finished. Access to content across the entire European Union is still not possible. As a consumer, I cannot gain access to the French version of Netflix unless I am resident in France. Access to European works across the entire EU is still limited.

This is not the only point where the goal of a digital single market has not been reached. At this point we are regulating the internet through different directives and regulations. In practice, this is a real problem. Most of the legislation which is adopted in this House is handled by different committees and there is a lack of cooperation and communication. As a result, the outcome is sometimes completely contradictory. There is a real lack of legal certainty. It is unclear whether the e-Commerce Directive prevails or how the relationship works between the Portability, Copyright, AVMS and InfoSoc [Directives]. There should be clear coherence when we regulate the internet, and not an approach which consists of bits and pieces. The Portability Directive is a success, but the outcome will not be the same in other digital files. We have to stay focused on our Digital Single Market goals.

  Jan Philipp Albrecht (Verts/ALE). – Herr Präsident, sehr geehrter Herr Kommissar Ansip, werte Kolleginnen und Kollegen! Die Portabilitätsverordnung, die wir jetzt zur Abstimmung vorliegen haben, ist ein großer Schritt für die Verbraucherinnen und Verbraucher in der Europäischen Union. Endlich können wir die Inhalte, für die wir auch bezahlt haben, in die anderen Länder der EU mitnehmen, wenn wir zum Beispiel auf Reisen gehen, wenn wir dort studieren oder vorübergehend arbeiten. Das ist ein Riesengewinn, das kann man nicht kleinreden, sondern man muss klarmachen, wozu auch die Europäische Union für uns da ist.

Trotzdem müssen wir natürlich an der Frage des digitalen Binnenmarkts weiter gemeinsam arbeiten. Das heißt also, dass gerade im Bereich von Standards, auch beim Datenschutz, auch in der Frage des Urheberrechts, weitere Fortschritte gemacht werden müssen. Auch in der Frage des grenzübergreifenden Zugangs zu Dienstleistungen, beim Geoblocking, müssen wir weiter arbeiten, um die Grenzen in Europa abzubauen, aber gleichzeitig natürlich auch dafür sorgen, dass die Interessen derer, die zum Beispiel Inhalte produzieren, auch gewahrt werden.

  Isabella Adinolfi (EFDD). – Signor Presidente, onorevoli colleghi, questo regolamento tecnicamente sarà anche un passo in avanti per i consumatori, ma politicamente è un fallimento che giustifica assurde logiche di massimizzazione del profitto anche a scapito della privacy e dei cittadini europei.

Si tratta di un piccolissimo avanzamento che rappresenta il minimo sindacale e tradisce lo sbandierato obiettivo del mercato unico digitale. Io mi rivolgo a Lei, Commissario Ansip, veramente così immaginavate di realizzare il mercato unico digitale che era una delle cinque priorità politiche della Commissione Juncker?

Non riesco a capire, infatti, perché permettiamo alle multinazionali di far circolare liberamente il capitale e di avvantaggiarsi anche in maniera scorretta dei paradisi fiscali europei, sottraendo preziosissime risorse alla collettività e ponendo in essere forme di concorrenza sleale, soprattutto verso le piccole e medie imprese, mentre i cittadini e i consumatori non possono beneficiare del mercato unico. Per me questa situazione è inaccettabile e mi batto per cambiarla.

La sentenza della Corte dice che la clausola che garantisce la territorialità assoluta è contro il trattato, lo abbiamo sentito anche da altri interventi. Io non voglio mantenere questo status quo, che ritengo ridicolo, e che ritengo anche illegittimo e ingiusto per i cittadini europei.

  Georg Mayer (ENF). – Herr Präsident! Gerade wir kennen durch unsere massive Reisetätigkeit die Problematik der Portabilität von Onlinediensten sehr gut. Aber es betrifft eben nicht nur uns, sondern es betrifft Millionen Menschen in Europa, die auf gewisse Dienste nicht zugreifen können. Wenn etwa jemand einen Vertrag mit Amazon Prime in seinem Heimatland geschlossen hat und woanders diesen Dienst abrufen möchte, dann ärgert er sich natürlich darüber, dass dieser Vertrag nicht von einem Vertragspartner in einem anderen Land erfüllt werden kann. Es ist also geradezu unsere Pflicht, in der Gesetzgebung solche Dinge zu erkennen und zu bearbeiten und für die Menschen in Europa praktikabel zu gestalten. Zu beachten ist allerdings – und das ist ja heute schon einige Male angesprochen worden: Damit sind auch Rechte verbunden. Es gibt Inhaber von Rechten, deren Rechte möglicherweise verletzt werden könnten. Darauf ist besondere Rücksicht zu nehmen. Ich sage also: Die Reise beginnt nun erst in der Sache Online-Portabilität.

  Ева Майдел (PPE). – Г-н Председател, европейските граждани искат видими и бързи резултати от нашата работа. Този регламент е конкретен отговор на Европейския парламент към гражданите, но също така е и едно изпълнено обещание, което поех към нашите гласоподаватели.

През 2018 г. всеки европеец ще може да използва своя абонамент за книги, музика, филми, сериали или спортни предавания, където и да пътува в Европейския съюз без да има ограничения на съдържанието, без да има ограничения на броя на устройствата или тяхната функционалност на услугата. И най-важното – без допълнителни разходи.

Това е стъпка напред в осигуряването на единен дигитален пазар за всички европейци. И точно за това благодаря на докладчика и на моите колеги, с които работихме по този регламент в комисията по вътрешния пазар и защита на потребителите.

Обаче за да имаме един истински и функционален единен цифров пазар, ние трябва да продължаваме да работим със същата и, дори бих казала, по-бърза решителност и по останалите досиета, измежду които например тези за защитата на личния живот и личните данни в електронните съобщения, Кодекса за електронните съобщения, Директивата за договорите за дигитално съдържание и дигитални услуги, както и очакваните от Комисията действия в посока към киберсигурността и онлайн платформите.

  Γιώργος Γραμματικάκης (S&D). – Κύριε Πρόεδρε, η ρύθμιση για ανάπτυξη μιας ενιαίας ψηφιακής αγοράς υπήρξε, πολύ σωστά κατά τη γνώμη μου, ένα πρώτιστο μέλημα της Ευρωπαϊκής Επιτροπής. Η φορητότητα θα εξασφαλίσει στους ευρωπαίους πολίτες που ταξιδεύουν σε άλλες χώρες την ελεύθερη πρόσβαση σε ψηφιακό περιεχόμενο και υπηρεσίες, που έχουν βέβαια αγοράσει στη χώρα τους. Αποτελεί συνεπώς ένα πρώτο αλλά πολύ σημαντικό βήμα προς ένα καλύτερο μέλλον στον ψηφιακό μας κόσμο. Ως εισηγητής λοιπόν των Σοσιαλιστών στην επιτροπή Πολιτισμού σε αυτό τον τεχνικό, αλλά σημαντικό νομίζω, φάκελο θα ήθελα να τονίσω ότι ο συγκεκριμένος κανονισμός αφορά τη φορητότητα ψηφιακών υπηρεσιών και όχι βέβαια τη διασυνοριακή πρόσβαση σε καλλιτεχνικά περιεχόμενα. Το τελευταίο θα είχε αρνητικές επιπτώσεις στην καλλιτεχνική δημιουργία και, κυρίως, το ξέρουμε όλοι, στον ευρωπαϊκό κινηματογράφο, διότι θα αμφισβητούσε την αρχή της εδαφικότητας που είναι σημαντική πηγή εσόδων για τη χρηματοδότηση, την παραγωγή και τη διανομή των ευρωπαϊκών ταινιών. Αξίζει πάντως να σημειωθεί ότι η διαφύλαξη της αρχής της εδαφικότητας και η προαγωγή των ευρωπαϊκών έργων αποτελεί απόλυτη προτεραιότητά μας και στην αναθεώρηση των κανόνων πνευματικής ιδιοκτησίας που ευτυχώς βρίσκεται σε ευοίωνη εξέλιξη. Το ισορροπημένο λοιπόν και σωστό αποτέλεσμα που έχει επιτευχθεί αποδεικνύει για άλλη μια φορά ότι η ένταση μεταξύ καταναλωτών και καλλιτεχνών είναι παραπλανητική και πολλές φορές εθνική. Ο πολιτισμός είναι πράγματι ένα από τα θεμέλια της ευρωπαϊκής ιδέας, αρκεί να μη μένει σε διακηρύξεις αλλά να επιβεβαιώνεται, όπως με αυτόν τον κανονισμό, καθημερινά.

  Kosma Złotowski (ECR). – Panie Przewodniczący! Panie Komisarzu! Korzystanie z usług audiowizualnych online to coraz bardziej powszechny sposób dostępu do filmów, transmisji programów sportowych czy muzyki. Niestety użytkownik takiej usługi musi wciąż mierzyć się z różnymi barierami, które uniemożliwiają mu korzystanie z wykupionych subskrypcji podczas tymczasowego pobytu za granicą. Cieszę się, że wychodzimy tym sprawozdaniem naprzeciw oczekiwaniom konsumentów i umożliwiamy im zabieranie ze sobą w podróż nie tylko smartfonów czy tabletów, ale także i prawa do korzystania z usług online, które wykupili już wcześniej w kraju swego zamieszkania.

Oczywiście ta regulacja odnosi się tylko do konkretnych przypadków i nie ma na celu zmiany obowiązującego systemu licencji terytorialnych. Wszelkie prawa twórców muszą być w tym zakresie odpowiednio zabezpieczone i chronione. Jestem przekonany, że jest to bardzo ważny i potrzebny etap budowy jednolitego rynku cyfrowego i miejmy nadzieję, pójdziemy tą drogą dalej.

  Kaja Kallas (ALDE). – Mr President, this agreement on the cross-border portability of content is to be welcomed, because it corrects a flaw, a loophole in the European Union, which is an area of free movement of citizens, goods and services. We have the tendency in the digital world to create barriers that should not even be there in the first place. Maybe it is because of fear of losing control. When you buy a film on a DVD, nobody takes it from you when you cross the border. So why would we prevent citizens from watching a film that they are paying for at home with an online subscription when they are crossing the border?

Abuses can always come along, and in this respect I hope that the service providers will use the most user-friendly means of verification, such as e-IDs for example, to check the home country of the citizen. I wanted the use of IP addresses, in that respect, to be stricter than that, and I hope that the enforcement of this law will safeguard the individual’s right to privacy.

Last but not least, I think that taxpayers should also be able to watch the content that they have already paid for in their home country, for instance with a broadcasting fee. Although this is only voluntary, I hope that many public broadcasters will be innovative and proactive and deliver such a possibility for the users.

  Michel Reimon (Verts/ALE). – Herr Präsident! Ich habe hier ein kleines Tablet, mit dem ich gerne spät abends im Hotelzimmer eine Folge einer Serie anschaue. Wenn ich hier in Straßburg das im Hotelzimmer öffne, ist das erste, was ich sehe, ein Knopf, wo ich draufdrücken kann: Auch im Ausland ansehen. Ich bin hier am Sitz des Europäischen Parlaments und soll mir Serien im Ausland ansehen. Ich finde, darum geht es in dieser gesamten Diskussion noch viel zu wenig, es geht nicht um einen Binnenmarkt und um eine Marktregulierung, die wir hier machen. Es geht um die Frage, ob Menschen, die hier sind, die an den Sitz eines Parlaments reisen, das sie vertritt, sich in ihrer Heimat fühlen.

Kann ich in Europa über eine Grenze gehen, kann ich meine Geräte, meine Kultur, meine Technik nutzen, wie ich es zu Hause tue? Und fühle ich mich zu Hause, oder bin ich im Ausland, wenn ich nur wenige Kilometer in Europa reise? Das ist in einer digitalen Welt eine Grundfrage, und wir haben das, so wie beim Roaming, herzustellen, dass sich die europäischen Bürger und Bürgerinnen – nicht nur Konsumenten – in ihrer Heimat fühlen, und das stellt diese Regulierung zumindest zum Teil einmal sicher. Das ist gut.

  Rosa Estaràs Ferragut (PPE). – Señor presidente, el presente Reglamento de portabilidad transfronteriza es un buen trabajo, porque reporta beneficios concretos a los europeos. Mis primeras palabras, de agradecimiento al señor Cavada y a todo el equipo que ha hecho posible que este Reglamento vea la luz.

Quienes hayan abonado sus servicios de música, servicios culturales, de deportes, de series y otros legalmente en su país de residencia, cuando se desplacen temporalmente a otro Estado miembro de la Unión, podrán transportar todos estos contenidos. Eso da cumplimiento a la libre circulación de servicios y también a la libre circulación, que es una de las libertades principales de la Unión Europea, de tal manera que los contenidos en línea viajarán a cualquier lugar de Europa con aquel que los haya contratado legalmente.

Se trataba, sin duda, de una necesidad imperiosa. Uno de cada tres europeos solicitaba que esto se regulara. De hecho, la población quiere aprovechar las ventajas de todas las tecnologías digitales para poder disfrutar de contenidos culturales. Y es una historia de un éxito, porque se ha hecho un equilibrio inteligente entre los intereses de los autores ―que tienen toda una serie de derechos y que exigían el principio de territorialidad, y también exigían la temporalidad― y los intereses de los usuarios, quienes ven hoy culminado el interés que ellos tenían.

Se avanza, por lo tanto, en el mercado único digital y se avanza, como digo, en la libre circulación de bienes y servicios.

  Anneleen Van Bossuyt (ECR). – Voorzitter, collega's, binnenkort zal iedereen die betaald heeft voor een online-dienst, die dienst ook kunnen raadplegen als hij tijdelijk in het buitenland verblijft, van netflix-gebruikers en voetballiefhebbers, van mensen die graag een e—boek lezen tot mensen die graag muziek beluisteren, van studenten tot vakantiegangers en zakenmensen.

Eíndelijk zou ik zeggen. Ik denk dat het een grote stap vooruit is voor de consumenten die op die manier kunnen genieten van de voordelen die de Europese digitale interne markt te bieden heeft.

Ik ben trouwens ook zeer tevreden dat de bijzondere positie van de audiovisuele sector beschermd zal worden door het inbouwen van degelijke controlemechanismen. Ik denk dat dit erg belangrijk is voor de vorming van de identiteit van taal- en cultuurgemeenschappen, van kleinere taal- en cultuurgemeenschappen zoals bijvoorbeeld de Vlaamse.

  Marietje Schaake (ALDE). – Mr President, Every step towards a true digital single market in Europe is very much welcomed. After abolishing roaming costs, supportability is another concrete step that internet users all over the Union should enjoy. It is essential that in our policies we look at the public interest and at our principles, not at certain business models or niche interests. Watching the content you have paid for when on holiday or studying or working abroad is a no-brainer and this is especially important when it comes to publicly funded content.

Now we need to go on to NGO blocking and ensure modernised and harmonised copyright fit for the 21st century, enabling access to content, not punishing audiences. We have to address this and we will be addressing this through a variety of legislative initiatives: the AVMS directives, platforms, copyright reform and electronic communications code in the SETCOM legislative proposals, just to name a few. And the risk of course, is that the different pieces of this legislative puzzle won’t fit, and that the bigger picture gets lost. I think we should all be responsible to keep the big goals in mind.

At the digital single market mid-term, I therefore urge you to be more ambitious and focus on the coherence between the various initiatives at our tables. Of course, we support you as Members of the European Parliament, members of the Liberal Group, to ensure the public interest is preserved in a hyper-connected world. But I think this message is more directed to the Council that sometimes seeks to enjoy the fragmentation and the positions they have without looking at the common interest of a strong and well-functioning digital single market for Europe.

  Pavel Svoboda (PPE). – Úvodem bych rád poděkoval kolegům z Výboru pro právní záležitosti, kteří se podíleli na tomto návrhu, především panu Cavadovi.

Zavedení portability představuje důležitý pokrok v rámci rozvoje jednotného digitálního trhu. Občané EU oprávněně očekávají, že budou moci využívat služby, za které platí, také ve chvíli, kdy využívají práva volného pohybu v rámci EU. Portabilita tak není jen reakcí na technologický rozvoj, ale také reakcí na potřeby evropských občanů vycházející ze stále větší mobility mezi jednotlivými členskými státy.

Právě dnes, kdy je zapotřebí každý praktický příklad prospěšnosti unijní spolupráce, bychom měli vnímat očekávání občanů i v těchto dalších oblastech velmi vážně a pokusit si je naplnit. Úspěšné zavedení portability tak vnímám jako velmi dobrý, ale přeci jen první krok v širší snaze o reformu autorského práva, která bude reflektovat potřeby 21. století a využije potenciál jednotného digitálního trhu.

  Емил Радев (PPE). – Г-н Председател, поздравления на докладчика г-н Кавада за работата и воденето на преговорите по този доклад. Радвам се, че беше постигнато споразумение, което ще позволи на нашите граждани да могат да имат достъп до онлайн съдържание като музика, игри, филми, развлекателни програми не само на територията на тяхната държава членка на пребиваване, но и когато временно се намират в друга държава членка. Така, когато пътуват за удоволствие, служебно или с учебна цел из Европейския съюз, те ще могат да се забавляват със своята музика и филми, за които са платили в своята държава на пребиваване.

Досега потребителите, които временно се намираха в държава членка, различна от тяхната държава членка на пребиваване, често нямаха достъп до онлайн съдържание, за което по законосъобразен начин са придобили правото на достъп и на използване в своята държава членка на пребиваване.

Фактът, че според новите разпоредби доставчиците на услуги за онлайн съдържание не следва да изискват от своите абонати никакви допълнителни такси за осигуряването на трансгранична преносимост на услугите за онлайн съдържание, ще допринесе за повишаване на ползването на тези услуги в целия Европейски съюз.

С тази инициатива ще се подобри и свободното движение на хора и услуги на вътрешния пазар. Разбира се, това не трябва да става в ущърб на авторите и техните творби, защитени с авторски права.   Virginie Rozière (S&D). – Monsieur le Président, je voudrais avant tout féliciter et remercier le rapporteur ainsi que l’ensemble des rapporteurs fictifs pour le travail effectué. C’est un réel service rendu à nos concitoyens. L’été prochain sera peut-être un peu tôt, mais d’ici peu, lorsque ces citoyens partiront en vacances dans l’Union européenne, ils pourront continuer à profiter de leur musique, de leurs séries et de leurs films préférés, puisque c’est de cela dont il s’agit. On peut comprendre qu’il est tout à fait naturel, lorsque l’on souscrit à un service, lorsqu’on l’achète, de pouvoir continuer à en bénéficier. En outre, ce service de portabilité des services audiovisuels partout en Europe s’inscrit dans la continuité de la suppression des frais d’itinérance: à partir du moment où nous mettons en place une connectivité partout en Europe, il est logique de permettre aussi l’accès à ces services dans toute l’Union.

Je me félicite aussi de ce texte parce qu’il renforce et maintient la nécessité d’une juste rémunération du travail des acteurs, des auteurs, des metteurs en scène, de l’investissement des producteurs et de tous ceux qui concourent à la création audiovisuelle et qui peuvent, de cette manière, conserver leur capacité à vivre de leur travail et à percevoir une rémunération légitime. Je trouve donc ce texte très équilibré et, je le répète, très bénéfique pour l’ensemble des citoyens européens.

  Daniel Buda (PPE). – Domnule președinte, mulțumesc. În primul rând doresc să îl felicit pe domnul Cavada pentru munca depusă. Apreciez că prezentul raport constituie un pas important pentru ceea ce înseamnă definirea oricărui colț al Uniunii Europene ca fiind „acasă” pentru fiecare cetățean european.

În acest context, libera circulație a persoanelor trebuie dublată în mod obligatoriu de accesul la un cost rezonabil, atât la internet, cât și la tehnologiile digitale cu respectarea drepturilor de autor și cu păstrarea unui echilibru privind furnizorii de astfel de servicii.

Adoptarea acestui raport vine în întâmpinarea nevoilor cetățenilor și oferă soluții prin care vor fi eliminate restricțiile care îi împiedicau să beneficieze în călătoriile lor de conținutul digital. Europa trebuie să profite de revoluția digitală care a transformat lumea pe toate planurile și toate domeniile, oferind oportunități cetățenilor dar, în același timp, și întreprinderilor.

Un pas important îl reprezintă portabilitatea transfrontalieră a serviciilor de conținut online. Odată cu intrarea în vigoare a acestei măsuri se preconizează că ponderea utilizatorilor portabili de abonamente la serviciile online va crește până în 2020 la aproximativ 72 de milioane de persoane din Uniunea Europeană.

Eliminarea tarifelor de roaming, deblocarea comerțului electronic, portabilitatea la nivelul statelor membre de servicii de conținut online creează premisele unei piețe unice digitale și a unui spațiu unic. În acest fel, cetățenii și întreprinderile își pot desfășura activitățile, pot inova și interacționa fără bariere și în condiții de siguranță, fiind garantată astfel prosperitatea tuturor.

  Tiemo Wölken (S&D). – Herr Präsident, sehr geehrter Herr Kommissar Ansip! Die unsichtbaren Grenzen des digitalen Binnenmarkts müssen abgeschafft werden. Diese Verordnung ist ein erster richtiger Schritt in die richtige Richtung. Die Verordnung ist gerade für die Bürgerinnen und Bürger ein großer Erfolg. Legal erworbener content wird damit in der ganzen EU im vollen Funktionsumfang in der gleichen Qualität und wie von zu Hause aus gewohnt zugänglich sein. Es gilt der Grundsatz „legal erworben, legal gestreamt“ in der ganzen EU. Ich begrüße es ausdrücklich, dass die Verordnung für jeglichen Inhalt gilt. Ein großer Erfolg ist es, dass die Verordnung ausdrücklich keine zeitliche Oberbegrenzung für den vorübergehenden Aufenthalt enthält, es keine Verpflichtung zur Rückkehr ins Wohnsitzland gibt und Anbieter auch nicht in den Allgemeinen Geschäftsbedingungen die Dauer der Nutzung beschränken dürfen.

Wir dürfen uns auf dem Erreichten aber nicht ausruhen. Bis zur vollständigen Verwirklichung des digitalen Binnenmarkts ist es noch ein weiter Weg. Insbesondere auch mit der CabSat-Verordnung, für die ich Berichterstatter bin, dürfen wir nicht hinter das Erreichte zurückfallen, um auch einen grenzüberschreitenden Zugang zu Mediatheken der Rundfunkveranstalter zu gewährleisten.

  Alojz Peterle (PPE). – Meje na področju gostovanja mobilnih storitev so padale deset let, čez mesec dni pa bodo dokončno padle. V začetku so verjeli le redki, čeprav je zgledalo na začetku nemogoče, se kljub močnemu odporu mobilnih operaterjev nismo ustrašili poti, ki je bila pred nami. Stara ureditev je nepravično kaznovala vse, ki smo telefonirali ali pošiljali sporočila v tujino, zato smo jo bili dolžni končati.

Ne le telekomi, ki so vendarle stopili na stran uporabnikov mobilnih storitev, od katerih končno tudi živijo, tudi vlade držav članic so morale v teh dolgih letih stopiti na stran svojih državljanov. S tem smo dosegli še eno pomebno zmago v uresničevanju ideje notranjega trga. Vendar ne smemo izgubiti sape. Ko gre za koristi naših državljanov tečemo na dolge proge. Potrošnike namreč še vedno bremenijo visoki stroški čezmejnih klicev in SMS-ov znotraj evropske zveze, ki jih opravimo od doma. Situacija, ko so klici, opravljeni v tujini, cenejši od klicev, opravljenih od doma, je nedopustna.

Telekomi ustvarjajo dobičke na račun nepravičnih provizij. Zavezani resnično enotnemu trgu evropskih telekomunikacij si tega ne smemo privoščiti. Če je bilo vprašanje gostovanja dokaz delovanja evropske zveze v korist evropskih državljank in državljanov, moramo enako storiti tudi za tako imenovane klice in pošiljanje SMS-ov znotraj zveze. Sedaj je priložnost, da preprečimo nadaljnje zlorabe notranjega trga in našim državljanom ponudimo nov dokaz delovanja evropske zveze, dokaz, ki ga bodo čutili v žepih.

  Bogdan Brunon Wenta (PPE). – Panie Przewodniczący! Panie Komisarzu! Ja także przyłączę się do gratulacji dla pana posła Cavady i zespołu, który wynegocjował to świetne porozumienie podczas rozmów trójstronnych w czasie prezydencji maltańskiej w lutym tego roku. Te nowe przepisy dotyczące przenoszenia treści dla użytkowników Unii Europejskiej pozwalają obywatelom podróżującym za granicę skorzystać tam z wykupionych w swoim kraju usług dostępu do treści internetowych. Rozumiem to podejście, które ma ułatwić konsumentom dostęp do treści legalnie nabytych lub zaabonowanych w swoim kraju zamieszkania.

Jednak nie wolno nam zapominać o twórcach, bo w europejskiej różnorodności kulturowej to oni tworzą i dostarczają wysokiej jakości produkty i treści kulturowe na rynek europejski. Dlatego to porozumienie daje nam, jako konsumentom, nowe możliwości, ale jednocześnie ma chronić twórców i podmioty inwestujące w produkcję treści kulturowych lub sportowych. Uważam, że jest to wyważone rozwiązanie i pozytywny sygnał dla twórców oraz konsumentów.

  Jiří Pospíšil (PPE). – Já s velkou radostí vítám, že dnes dokončujeme proces projednávání tohoto nařízení. Toto je, vážení přátelé, přesně příklad konkrétního ustanovení evropského práva, které můžeme našim občanům s radostí sdělit a ukazovat, v čem EU pomáhá v životě normálním obyčejným Evropanům.

V pátek budu ve své zemi přednášet pro studenty středních škol, co EU dělá pro občany, a určitě tam příběh tohoto nařízení zmíním a ukážu, co konkrétního pro ně děláme. Takže já gratuluji zpravodaji i panu komisaři a doufám, že se do konce tohoto volebního období podaří prosadit i další části digitálního trhu.

Bouráme tímto nařízením konkrétní část digitálních hranic a spotřebitelům dáváme možnost, aby svoje služby, on-line obsah využívali i v jiné zemi EU. Je to jasná výhoda, já k tomu gratuluji a na tomto můžeme budovat nový image EU pro naše občany.

  Nicola Caputo (S&D). – Signor Presidente, onorevoli colleghi, con la diffusione dei servizi di contenuti online e l'uso crescente dei dispositivi portatili è aumentata l'aspettativa dei cittadini europei di poter fruire dei servizi di contenuti online ovunque si trovino all'interno dell'Unione europea.

Attualmente quando viaggiano nell'Unione europea gli utenti non possono fruire di tale portabilità transfrontaliera o possono farlo solo in misura limitata. L'eliminazione delle barriere esistenti all'utilizzo di contenuti e servizi online consentirà un'efficace soddisfazione delle esigenze degli utenti, ma anche un ulteriore progresso dell'innovazione, a chiaro vantaggio dei consumatori, dei fornitori dei servizi e dei titolari dei diritti.

L'accordo raggiunto è particolarmente opportuno in questo momento storico, anche in considerazione dell'abolizione delle tariffe di roaming all'interno dell'Unione europea. La domanda di portabilità transfrontaliera da parte dei consumatori è destinata a crescere e ritengo che la rimozione degli ostacoli all'utilizzo di contenuti e servizi online possa costituire un passo significativo per la realizzazione di un vero mercato unico digitale, i cui benefici non potranno che ricadere su tutti i cittadini dell'Unione europea.

  Ruža Tomašić (ECR). – Gospodine predsjedniče, pitanja jedinstvenog tržišta često su u drugom planu u odnosu na političku integraciju. Naglasak se nažalost stavlja na nešto što ne može funkcionirati, daljnju političku integraciju, a zanemaruje ono što može još bolje funkcionirati, a to je jedinstveno tržište.

Ovo je izvješće svakako korak u pravom smjeru jer moramo osigurati da se ista pravila primjenjuju na cijelom jedinstvenom tržištu i da su usluge i proizvodi dostupni svim građanima neovisno o njihovom prebivalištu.

Telekomunikacije su dugo bile pod apsolutnom protekcijom država članica, a telekom kompanije sa svojim su velikim lobističkim kapacitetima predstavljale veliku branu unaprjeđenju jedinstvenog europskog tržišta. Nakon ukidanja naknade za roaming, sad idemo i korak dalje s prenošenjem usluga internetskog sadržaja. To je veliki i dobrodošao korak koji će građanima olakšati živote, pa ga mogu samo pozdraviti.

  Davor Škrlec (Verts/ALE). – Gospodine predsjedniče, pozdravljam izvješće kolege Cavade zbog toga što ono predstavlja važan korak prema jednakopravnom pristupu internetu i sadržajima svih građana Europske unije. Svakako se slažem kako potrošači s pretplatama na usluge internetskog sadržaja koje su zakonito kupili u svojoj državi uobičajenog boravišta moraju također imati pristup istima kada se privremeno nalaze u nekoj drugoj državi članici.

Pristup potrošača prekograničnoj prenosivosti usluga internetskog sadržaja svakako će doprinijeti boljem funkcioniranju unutarnjeg tržišta, koje se ponajprije temelji na slobodnom protoku usluga i dobara.

Smatram kako je potrebno utvrditi jasnu razliku između prenosivosti i prekograničnog pristupa kako se ne bi ugrozila održivost financiranja europskog audiovizualnog i filmskog sektora koji počiva na teritorijalnosti prava.

  Νότης Μαριάς (ECR). – Κύριε Πρόεδρε, η ψηφιακή επανάσταση πραγματικά έχει φέρει τα πάνω κάτω. Έχουμε μια ενιαία ψηφιακή αγορά στην Ευρωπαϊκή Ένωση που πραγματικά σε πρώτη φάση έχει προχωρήσει και στην κατάργηση των υψηλών τελών για την περιαγωγή. Τώρα συζητούμε ένα σημαντικό θέμα, όπως είναι η διασυνοριακή φορητότητα επιγραμμικού περιεχομένου, δηλαδή μια δυνατότητα των πολιτών να έχουν και σε άλλη χώρα τη δυνατότητα χρήσης του ψηφιακού περιεχομένου το οποίο αγόρασαν ή έχουν δώσει συνδρομή γι’ αυτό, να μπορούν δηλαδή να χρησιμοποιήσουν παιχνίδια, μουσική, ψυχαγωγικά προγράμματα, ηλεκτρονικά βιβλία κ.λπ. Από αυτό μπορούμε να θεωρήσουμε ότι η φορητότητα είναι παρακολούθημα ουσιαστικά της αρχής της ελεύθερης κυκλοφορίας και των υπηρεσιών αλλά και των ατόμων. Να μπορούν δηλαδή οι πολίτες της Ευρωπαϊκής Ένωσης να έχουν, χωρίς επιπλέον χρέωση, τη δυνατότητα να αξιοποιήσουν αυτό το επιγραμμικό περιεχόμενο, το οποίο έχουν πληρώσει στην ίδια τους τη χώρα. Φυσικά, πρέπει να μεριμνήσουμε και για την προστασία των δικαιωμάτων των δημιουργών και για την προστασία όλων όσοι έχουν δικαιώματα πνευματικής ιδιοκτησίας, διότι αυτό είναι καθοριστικής σημασίας αν θέλουμε να έχουμε στο μέλλον και επιπλέον περιεχόμενο πνευματικής ιδιοκτησίας και δημιουργία.

  Andrus Ansip, Vice-President of the Commission. – Mr President, honourable Members of the European Parliament, when talking about a cross-border portability regulation, we are talking also about people visiting today the European Parliament. When talking about the low portability of digital content, we are talking approximately about 100 million European citizens a year. Our people will get access to their legally-bought digital content, but when talking about low portability of digital content, we are talking also about our authors. Authors have to be fairly remunerated.

We respect the principle of territoriality, but just one and a half years ago there were quite different understandings of what this principle of territoriality really means and what this absolute exclusivity means. For some people it was about absolute exclusivity when they even knew that 68% of those film viewers are using free downloads. According to my understanding, it was very relative understanding about absolute exclusivity. For me, absolute exclusivity means 0% or 100%.

I am happy that we were able to find this common language with creators, and I am sure creators also believe – and they are right to believe – that they will be much better remunerated just because of this cross-border portability regulation. I agree with those people who said that we are just in the beginning of the process. We have to create a digital single market in the European Union, and I hope our cooperation will be also fruitful when we deal in a detailed manner with abolishing of unjustified geo-blocking in the European Union.

  Jean-Marie Cavada, rapporteur. – Monsieur le Président, je remercie tout d’abord nos collègues pour toutes leurs appréciations plus ou moins satisfaites. Le mérite en revient à tous ceux qui ont travaillé sur cette affaire et, en premier lieu, à la Commission européenne.

Dès le début, la Commission actuelle avait affiché d’une façon extrêmement impérieuse la nécessité de créer un marché numérique. C’était une bonne chose, mais beaucoup d’arrière-pensées persistaient, tant dans cette assemblée que, probablement, dans d’autres institutions européennes.

Ce que j’aime bien dans ce texte ainsi que dans les positions que vous avez progressivement prises, Monsieur le Commissaire, c’est l’idée qu’il faille mettre à jour un préjugé dangereux. Oui ou non, le marché numérique doit-il écraser ceux qui créent les contenus de ce marché? Autrement dit: le grand marché unique numérique européen est-il dirigé contre les créateurs, qui devraient se coucher et abandonner toute forme de droit ou de contrôle de droit?

Monsieur le Commissaire Ansip, cher Président, vous avez engagé votre parole et montré par ce texte que vous aviez pris l’option contraire. Non, le marché numérique n’a pas pour adversaire la territorialité ni le géoblocage, contrairement à ce qui se dit de temps en temps, y compris ici, ni – naturellement – la juste rémunération du droit d’auteur. En effet, cette rémunération du droit d’auteur est la colonne vertébrale absolue de l’une des valeurs européennes, et non des moindres. Concrètement, environ 530 milliards d’euros annuels proviennent de l’activité créatrice. Si cette colonne vertébrale venait à être abandonnée, par le géoblocage ou par la suppression de la territorialité, cela voudrait dire que nous ouvririons toutes grandes nos portes aux principaux groupes anglo-saxons et américains qui, dans certains cas, utilisent déjà dans leur activité commerciale des contenus qu’ils n’ont pas achetés, ce qui est en principe interdit dans toute forme de commerce – et je me réjouis que votre collègue, Mme Vestager, soit vigilante pour sanctionner ces faits. D’autre part, ces mêmes groupes – et j’attire votre attention pour les textes à venir – se permettent, grâce à notre faiblesse, de payer leurs impôts là où ils disposent de facilités fiscales et non pas là où sont leurs consommateurs.

Monsieur le Commissaire, de ce point de vue, je voudrais que nous ayons des discussions extrêmement exigeantes sur les textes à venir. Il ne manque pas de gens pour dire que le saucissonnage par sujet de la question du marché unique numérique est une stratégie. Je crois pouvoir compter sur votre bonne foi – vous venez de le démontrer –, mais nous serons naturellement très vigilants sur la suite car c’est défendre une des très grandes valeurs européennes que de défendre le marché unique des auteurs à travers leur territorialité et leur juste rémunération.

Pour ce qui est de ce texte, je veux à nouveau me féliciter et vous remercier, chers collègues, cher Président, Monsieur le Vice-président de la Commission, de l’excellente coopération intelligente que nous avons pu avoir.

  Lidia Joanna Geringer de Oedenberg (S&D), na piśmie. – Pomimo popularności urządzeń przenośnych i łatwości podróżowania po UE wiele usług internetowych wciąż jest blokowanych geograficznie. Według Europejskiej Unii Nadawców 11 % europejskich gospodarstw domowych wykupiło w 2016 r. usługę typu wideo na życzenie. Szacuje się, że do 2020 r. ten odsetek podwoi się. Ponad połowa tego rynku należy do amerykańskiego dystrybutora Netflix.

Przyjęte podczas obecnej sesji plenarnej rozporządzenie pozwoli na korzystanie na terenie całej Wspólnoty z wykupionego w jednym państwie członkowskim dostępu online do ulubionego serialu, programu czy muzyki. Taki nieograniczony dostęp do usług multimedialnych będzie przysługiwał osobom, które przebywają za granicą w celach wypoczynkowych, zawodowych czy naukowych.

Powyższe sprawozdanie stanowi rozwinięcie debaty dotyczącej dzieł osieroconych oraz zbiorowego zarządzania prawami autorskimi i jest kolejnym krokiem na drodze do modernizacji praw autorskich w Europie, nad którą obecnie pracuję. Rozporządzenie powinno pozostać proste w zastosowaniu, tak aby skorzystało z niego jak najwięcej europejskich obywateli, którzy przemieszczają się na krótszy lub dłuższy okres do innych krajów Unii.

  Marc Tarabella (S&D), par écrit. – Nous voterons demain une législation qui permettra aux citoyens européens abonnés à des films, des musiques et des séries télévisées en ligne d’accéder à ce contenu même quand ils se trouvent à l'étranger.

Près d’un européen sur deux est concerné. Concrètement aujourd'hui, 49% des utilisateurs Internet en Europe écoutent de la musique, regardent des vidéos et jouent en ligne. Mais quand vous sortez de vos frontières nationales, vous ne pouvez pas, ou peu, accéder aux services de contenu en ligne auquel vous êtes abonnés et ne pouvez donc pas obtenir les films, les séries tv, la musique, les jeux, ou encore les événements sportifs.

Nous avons obtenu que ces restrictions disparaissent et que le citoyen puisse accéder à tout ce contenu en ligne où qu'il soit en Europe, lors de ses voyages ou ses déplacements professionnels internationaux. Une bonne nouvelle pour le consommateur.

  Romana Tomc (PPE), pisno. – Spoštovani predsedujoči, najlepša hvala za besedo. Enotni trg Evropske unije se mora prilagoditi digitalni dobi in z njo tehnologiji, ki se izredno hitro razvija in nadgrajuje. Ljudem morajo biti storitve na voljo po celotni uniji, ne glede na to, v kateri državi članici so jih zakupili.

To je tudi ena od štirih svoboščin. Zato pozdravljam odpravo čezmejnih blokad dostopa do spletnih vsebin. Verjamem, da bo enostavnejši dostop do storitev s seboj prinesel številne pozitivne učinke, kot so bolj raznolika in kvalitetnejša ponudba.

Večja ponudba pomeni več potrošnikov, več potrošnikov pomeni širjenje industrije in s tem ustvarjanje novih delovnih mest. Izkoristiti moramo vse te možnosti, ki nam jih ponuja digitalizacija. Z novimi tehnologijam pa seveda pridejo tudi novi izzivi, ne smemo pozabiti niti na nevarnosti, ki jih te prinašajo.

Zaščita uporabnika mora ostati primarna skrb, ne glede na industrijo. Zato pozivam k jasni in pregledni regulaciji, ki bo varovala osebne podatke uporabnikov in hkrati nudila vse, kar lahko nudi.
