  President. – The next item is the report by Gabriel Mato, on behalf of the Committee on Fisheries, on the Proposal for a regulation of the European Parliament and of the Council on the conservation of fishery resources and the protection of marine ecosystems through technical measures, amending Council Regulations (EC) No 1967/2006, (EC) No 1098/2007, (EC) No 1224/2009 and Regulations (EU) No 1343/2011 and (EU) No 1380/2013 of the European Parliament and of the Council, and repealing Council Regulations (EC) No 894/97, (EC) No 850/98, (EC) No 2549/2000, (EC) No 254/2002, (EC) No 812/2004 and (EC) No 2187/2005 (COM(2016)0134 – C8—0117/2016 – 2016/0074(COD)) (A8—0381/2017).

  Gabriel Mato, ponente. – Señor presidente, querido comisario, mis primeras palabras tienen que ser necesariamente de agradecimiento a todos los que durante este tiempo han trabajado para que finalmente hoy estemos debatiendo este importante dosier, muchas veces desde puntos de vista totalmente diferentes, pero siempre con un gran espíritu constructivo.

Han sido casi 21 meses de trabajo, 77 reuniones y muchísimas horas de debate con la Comisión, con el Consejo, con los pescadores, con las ONG y con todos cuantos se han querido unir a este reto. Porque es un reto afrontar un dosier como el de las medidas técnicas que regulan cómo, cuándo y dónde pueden operar los pescadores y que ya ha tenido dos intentos fallidos de revisión. Y este reto se complica cuando queremos que un reglamento englobe más de 30 disposiciones, algunas de ellas basadas en una legislación que data de 1998 y que se ha convertido a lo largo del tiempo en un sistema complejo, impracticable y muy rígido de normas. Pero nadie duda de que es necesario revisar las medidas técnicas. Y tampoco duda nadie de que es necesario y urgente intentarlo pronto, ya que se aproxima el brexit, pero también el final de este mandato parlamentario.

Mi objetivo, y creo que el de todos, fue la simplificación, sin reinventar reglas, pero haciéndolas más comprensibles y viables para los operadores y las administraciones, a través de la regionalización y la gestión basada en resultados, que da mayor flexibilidad a los pescadores y acerca la toma de decisiones a las regiones y a las especificidades locales, al tiempo que mantiene las líneas maestras, de modo que ofrecemos al sector igualdad de condiciones y normas que se adaptan a la realidad de cada pesquería y cada cuenca marina, y así, al mismo tiempo, las instituciones de la Unión Europea no pierden el control de las características más importantes de las medidas técnicas.

Creo que todos estos objetivos se reflejan en los compromisos alcanzados, en los que hemos tenido en cuenta el arduo trabajo que ha mantenido la Comisión con el Consejo durante mucho tiempo, y por eso pido que durante la votación mantengamos los compromisos en los términos en que fueron adoptados por la Comisión. Precisamente por ello creo —porque se trabajó mucho y creo que bien— que el paquete de compromisos es muy equilibrado.

En cuanto a los objetivos, algo que preocupa a la Comisión y también a nosotros, el compromiso que propuse y se adoptó en la Comisión de Pesca es ambicioso y equilibrado. Incluye una reducción progresiva de las capturas de peces pequeños como objetivo principal de la futura normativa sobre medidas técnicas, dejando a los Estados miembros o a la Comisión, si los Estados miembros no adoptan las recomendaciones conjuntas dentro de un marco limitado de tiempo, con el mejor asesoramiento posible para establecer pesquerías clave. Y, si la reducción de capturas juveniles no va acompañada, como algunos pretenden, de un porcentaje de cifras concretas, no es por falta de ambición, sino por la necesidad de ser más pragmáticos y tener en cuenta las realidades de cada pesquería en una determinada cuenca. La regionalización desempeñará un papel fundamental en el establecimiento de objetivos cuantificables y la Comisión no será ajena en este proceso. En lugar de una figura arbitraria o simbólica, el compromiso busca objetivos hechos a medida, con base científica y operacionales, adaptados a cada pesquería.

La Comisión afirma que la ausencia de un objetivo cuantificado creará situaciones desiguales en las diversas cuencas de la Unión Europea. Yo creo que lo principal es establecer objetivos realistas porque no hay mayor injusticia que imponer las mismas reglas para diferentes situaciones.

Por último, los últimos días se abrió un nuevo frente que ha polarizado posiciones y ha creado divisiones en los diversos grupos. Se ha intentado paralizar el dosier y se ha monopolizado el debate, dejando aparte temas muy importantes, solo en torno a la pesca eléctrica. Hay quienes tratan de, pensando en hace doce años, cambiar lo que entonces se hizo. Yo creo que es un tema controvertido, que hay defensores y detractores, pero, al margen de posiciones maximalistas, la enmienda o el compromiso que se ofrece es un compromiso que creo sinceramente que cumple con los objetivos.

  Karmenu Vella, Member of the Commission. – Mr President, I would first like to congratulate the rapporteur, my colleague Mr Mato, his team and the Committee on Fisheries (PECH) for the work done to achieve the report on our proposal for a new technical measures framework. Regulating technical measures is about setting out how fishermen can go about their work at sea – what gears to use, what specifications to meet and which standards to strive for. It is therefore a key element of how our common fisheries policy operates on the ground. The current legal framework is quite old and no longer in line with the ambitious objectives of our reform policy in terms of greater sustainability, as Mr Mato said.

I welcome Parliament’s position, which embraces key elements of the Commission’s proposal, including a firm rejection of reinstating the existing complex array of technical rules and support for the Commission’s proposal on measures to protect sensitive species and habitats. We also welcome the PECH Committee’s approach on how regionalisation would work in the context of technical measures.

However, I would like to take this opportunity to discuss several areas of concern. This is the third attempt to reform technical measures legislation, and our proposal was based on the concept of results—based management and accountability by the operators. This was proposed to deliver simplification and flexibility to amend technical regulations at a regional level, while retaining oversight and minimum standards by setting quantitative objectives.

I have to express my disappointment in the fact that the clear and measurable EU targets included in the Commission’s proposals have been deleted in the draft EP’s report. These targets would introduce accountability and be the basic measuring stick for results—based management. It is a fundamental element of the Commission’s proposal, and its deletion risks emptying the proposal of much of its intended purpose.

For example, the draft report introduces compromise amendments to regionalise the rules governing the use of different mesh sizes. With no EU quantitative objectives and targets, there is no way to ensure that regional rules will deliver greater sustainability and selectivity in line with the CFP goals. The deletion of EU targets therefore represents a major concern about how regionalisation may work in practice. We no longer have common objectives across Union waters. We therefore run an unacceptable risk of having an uneven application of a common policy between different areas, and of having different level playing fields between our fishermen. This is of significant concern, as it undermines the core principle of the CFP.

My second concern relates to the EU landing obligation. The reform of the CFP aims at gradually eliminating the wasteful practice of discards through the introduction of the landing obligation. This radical change in fisheries management aims to improve fishing behaviour through improvements in selectivity. Amendment 136 essentially introduces a derogation from the landing obligation on the condition that all catches are fully documented. Here I would like to point out that the obligation to fully document catches is already a legal requirement. In effect, this amendment would provide an exemption from a key element of the CFP. If this amendment is passed, it will significantly undermine the incentive for fishermen to improve selectivity.

I am also aware of the discussions surrounding the issue of electro-pulse fishing, and I would like to remind you that the current technical regulations permit the use of electro-pulse fishing on a limited basis. In our proposal we have proposed to remove the five-percent limit, but to retain the geographical restrictions to the southern North Sea. This is based on advice from both the Scientific, Technical and Economic Committee for Fisheries (STECF) in 2012 and ICES in 2016. ICES, for instance, considers that the conventional way of fishing by beam trawling has a negative impact on ecosystems, while electric pulse stimulation, if properly controlled and applied, may offer a more ecologically benign alternative way of fishing by reducing unwanted by-catch, reducing seabed damage and lowering CO2 emissions.

There are other elements in the report that are problematic, such as amendments that weaken existing provisions – to protect sensitive habitats in the Mediterranean, for example – or amendments that dilute measures to protect vulnerable deep—water sharks and other vulnerable species of marine mammals and reptiles, but the specific issues I raised earlier – that is the removal of Union—wide quantitative targets and the blanket derogation from the landing obligation – would seriously undermine the Commission’s original proposal and key elements of the CFP. Therefore, I have to be very clear that Amendments 52—60, 68 and 171 are unacceptable for the Commission, as these would remove common targets. Equally unacceptable are Amendments 130, 131 and 136, as these would undermine the landing obligation.

We therefore count on your support to ensure that the CFP delivers on its key objectives through a meaningful revision of the technical measures guiding fishing activities.

  Nicola Caputo, relatore per parere della commissione per l'ambiente, la sanità pubblica e la sicurezza alimentare. – Signor Presidente, onorevoli colleghi, nelle acque europee una quantità allarmante di stock ittici continua a essere oggetto di uno sfruttamento eccessivo e i livelli di catture accessorie di specie non bersaglio rimangono spesso elevati.

È chiaro dunque che l'attuale struttura regolamentare per le misure tecniche non ha ottenuto risultati ottimali. Al fine di valutare l'efficacia delle misure tecniche dovrebbero essere stabiliti specifici target per quanto riguarda i livelli di catture indesiderate, il livello di catture accessorie di specie sensibili e l'estensione dei fondali marini significativamente danneggiati dalle attività di pesca, target che siano conformi agli obiettivi della PCP e soprattutto stabiliti su una solida base scientifica. La regionalizzazione potrà consentire di elaborare nell'ambito dei piani pluriennali regionali misure tecniche più adatte alla specificità dei vari tipi di pesca.

La pesca ad impulsi elettrici, infine, rappresentando una forma di concorrenza sleale nei confronti dei piccoli pescatori ed essendo una tecnica non selettiva, che rischia di provocare enormi danni all'ambiente marino, è a mio avviso una pratica da vietare almeno fino a quando non si determineranno condizioni più sostenibili dal punto di vista economico e sociale.

  Alain Cadec, au nom du groupe PPE. – Monsieur le Président, Monsieur le Commissaire, je veux tout d’abord remercier le rapporteur et les rapporteurs fictifs pour l’énorme travail qu’ils ont mené sur ce dossier très compliqué.

Le règlement sur les mesures techniques doit déterminer où, quand et comment les pêcheurs peuvent pêcher. Il est indispensable de moderniser les règles actuelles pour les adapter aux objectifs de durabilité de la politique commune de la pêche, tout en respectant le principe de régionalisation.

En ce qui concerne la pêche électrique, je rappelle ma position, qui est également celle de la délégation française du groupe PPE: je suis contre la pêche électrique et nous voterons pour l’interdiction de celle-ci. Toutefois, dans le cas où l’interdiction serait rejetée, j’ai déposé un amendement de repli contre l’extension de cette méthode, celui-ci propose le statu quo. Le cadre actuel autorise 5 % de la flotte des États membres, limitée à la partie sud de la mer du Nord, à utiliser cette méthode à titre expérimental. Si ce cadre actuel est maintenu, il faut impérativement que la limite des 5 % soit respectée par les États membres présents dans ce bassin.

  Renata Briano, a nome del gruppo S&D. – Signor Presidente, onorevoli colleghi, signor Commissario, le misure tecniche sono norme che stabiliscono come e dove i pescatori possono pescare e il loro scopo principale è quello di garantire la sostenibilità delle risorse e delle attività economiche legate alla pesca. Attualmente sono contenute in oltre 30 differenti regolamenti e tale complessità e frammentazione gravano sui pescatori, che da anni chiedono una radicale semplificazione.

Ho da sempre sostenuto che le misure tecniche rappresentano l'occasione per tradurre nella pratica il principio della regionalizzazione e su questo abbiamo cercato di lavorare perché, purtroppo, fino a oggi la regionalizzazione è stata più sulla carta che nella vera politica comune della pesca.

Troppo spesso i pescatori hanno percepito le norme europee come lontane e onerose da un punto di vista amministrativo ed è per questo che, Commissario, abbiamo inserito questa soluzione sulla regionalizzazione dei target, che non vuol dire diminuire gli obiettivi ma vuol dire renderli coerenti con le caratteristiche dei vari territori.

La complessità del dossier, è vero, ha richiesto lunghe negoziazioni in commissione PECH, e oggi noi abbiamo ottenuto un buon risultato. Abbiamo bisogno di …

  Peter van Dalen, namens de ECR-Fractie. – We kennen in het Parlement een aantal speerpunten. Ik denk aan milieu, innovatie en Europese samenwerking. Maar het is mogelijk dat morgen bij de stemming over het verslag van collega Mato deze drie speerpunten volledig onderuitgaan. Wat bedoel ik? In Europa is in de afgelopen tien jaar een zeer innovatieve en milieuvriendelijke visserijmethode ontwikkeld: de pulskorvisserij.

Bewezen voordelen van deze methode: aanzienlijk minder brandstofverbruik, aanzienlijk minder CO2-uitstoot, aanzienlijk minder bijvangsten die niet gewenst zijn en aanzienlijk minder beroering van de Noordzeebodem. Logisch dus dat de Europese Commissie deze methode nu wil toestaan.

Maar wat zien we? Misleid door de Parijse organisatie Loom willen diverse afgevaardigden dit succesverhaal morgen blokkeren. Bye bye innovatie, milieu en Europese samenwerking.

Ik bedank collega Mato voor de geweldige samenwerking. Collega Mato heeft laten zien een betrouwbare Europeaan te zijn, vóór het milieu en vóór innovatie. Zijn verslag verdient steun!

  Peter van Dalen (ECR), "blauwe kaart"-antwoord. – Welnu, deze methode voldoet volledig aan de Europese spelregels. Dus het is geen spelletje, en zeker geen cricket! En we zien dat de Europese Commissie nu zegt: laten we deze methode toestaan. Ze is voldoende onderzocht, ze heeft bewezen voordelen.

Dus je bent eigenlijk heel raar bezig als je deze mooie innovatieve methode blokkeert. Vandaar de hartelijke steun voor wat de Commissie nu bepleit en voor het vrijgeven van deze methode, uiteraard binnen de bestaande quota die we hebben. Dat blijft het kader waarbinnen we opereren.

  Izaskun Bilbao Barandica, en nombre del Grupo ALDE. – Señor presidente, quiero dar las gracias, al señor Mato, por su trabajo, y a Nils Torvalds, que no puede estar aquí.

Quiero decir, respecto de este informe, que las evidencias científicas inteligentemente combinadas con el pragmatismo que necesita la industria deben conducir esta necesaria revisión de las medidas técnicas para la protección de los ecosistemas pesqueros. Alcanzar el rendimiento máximo sostenible de la actividad requiere tanto alejarse de la utopía como reconocer que la actividad pesquera, incluidos sus profesionales, debe considerarse parte también del sistema que hay que proteger. La complejidad, dispersión y contradicciones de las normas que estamos revisando tienen su origen precisamente en una visión parcial asentada en una u otra sensibilidad.

Los científicos avalan el establecimiento de un porcentaje de capturas de juveniles y un plazo para alcanzarlo matizados con las posibilidades de ajustes regionales si se justifican con datos, tal y como propone la enmienda de mi grupo. Innovando es posible incrementar la selectividad. No hay mejor estímulo para avanzar en la creación de nuevas artes y técnicas pesqueras que estableciendo objetivos prudentes. En esta línea, y por las mismas razones, me inclino por mantener el actual statu quo de la pesca eléctrica, es decir, cuatro años de período de prueba para hasta el 5 % de la flota, pero incluyendo el mar del Norte y garantizando el acceso de científicos a los buques, prohibiendo el uso de accesorios complementarios como las cosquilleras y comprobando que se reducen los descartes, reportando áreas, capturas y voltajes.

Igualmente apoyo que las medidas reflejen la diversidad de las pesquerías, pero siempre bajo un esquema común, el de la objetividad de los estudios técnicos y bajo la supervisión de la Comisión.

  Anja Hazekamp, namens de GUE/NGL-Fractie. – Voorzitter, wederom is er in Europa sprake van een race to the bottom. Een race naar de zeebodem welteverstaan. Wie lukt het om de zeeën zo snel en efficiënt mogelijk leeg te vissen? De boomkorvissers of de pulskorvissers?

Van de boomkor weten we dat ze een verwoestend effect heeft op de zeebodem en voor veel bijvangst zorgt. Van de elektrische pulskor weten we dat ze dodelijk effectief is voor het vangen van tong en bij kabeljauw zorgt voor gebroken wervels en bloedingen. Maar over de gevolgen van de pulskor voor het ecosysteem weten we niets. En over de gevolgen voor haaien en roggen, die erg gevoelig zijn voor elektriciteit, weten we ook niets.

De ene verwoestende visserijmethode vervangen door de andere is niet de oplossing. Laten we de emoties aan de kant schuiven en wachten op de wetenschappelijke resultaten voordat we het verbod op de pulskor opheffen.

Bovendien moeten we af van vistuig dat zorgt voor bijvangst van zeevogels, dolfijnen en zeehonden. Een verbod op staand want en drijfnetten is daarom noodzakelijk.

Voorts ben ik van mening dat de Europese landbouw- en visserijsubsidies moeten worden afgeschaft.

  Marco Affronte, a nome del gruppo Verts/ALE. – Signor Presidente, onorevoli colleghi, le criticità di questo fascicolo si capiscono dal numero di emendamenti (veramente tanti) che sono stati presentati qui in Plenaria. Speriamo che ci aiutino, che ci servano per migliorare questo fascicolo.

L'abbiamo capito anche dall'intervento del Commissario Vella, che ha fatto un elenco specifico, numerico degli emendamenti che indeboliscono questa proposta e che la rendono qualcosa di inefficace, qualcosa che non ci consente di applicare pienamente la politica comune della pesca.

La regionalizzazione era il momento in cui dovevamo applicare la regionalizzazione vera, ma dicendoci cos'è la regionalizzazione. La regionalizzazione è lasciare la possibilità ai singoli Stati e alle singole regioni di scegliere un percorso, un tracciato di applicazione delle misure tecniche ma puntando a obiettivi comuni, precisi, chiari e numerici che vengano stabiliti per tutta l'Unione. Devono essere numerici perché nel tempo abbiamo la necessità di monitorare se ci stiamo avvicinando a quegli obiettivi oppure no. Questa regionalizzazione, così com'è nel fasciscolo adesso, è anarchia e non è regionalizzazione.

  Mike Hookem, on behalf of the EFDD Group. – Mr President, if the stated aims of the common fisheries policy are to ensure that fishing and aquaculture activities are environmentally and economically sustainable, then why are we proposing to relax the rules on electro-pulse fishing? Electro-pulse is a technique that is blamed for breaking the backs of cod, eradicating molluscs and gastropods, causing internal bleeding and leaving the marine environment a dessert. Already banned in China and other parts of the world for being too damaging to the ecology, electro-pulse fishing must now also be outlawed, as per the 1990 EU ban on fishing with electricity, explosives and poisons.

In recent weeks we’ve seen a lot of propaganda outlining the supposed environmental credentials of electro-pulse fishing, but the fact is that little independent non-partisan science has been completed. In the 13 studies conducted since electro-pulse was allowed, only three have looked at the effects on the marine environment. These three studies showed that 50% to 70% of the large cod caught with electricity had their spine broken and internal haemorrhages, that the survival rate of undersize discarded fish is very small, and that electrical currents may result in a weakened immune system for invertebrates.

As for the claim that electro-pulse fishing is better for the sea bed, this is also a fallacy. Rather than gliding about the sea bed, pulse trawls are heavy rigs that penetrate the sediment by 6 cm with electrodes blasting 50 volts of electricity of an intensity of 60 amps killing everything in their path. The fact is, other than a small reduction in overall fuel usage there is no environmental benefit. Yet there is growing empirical and anecdotal evidence that electro-pulse fishing is doing catastrophic damage to Europe’s marine environment, fishes and fishing communities.

So I urge you, if you put the marine environment above profit and care about the economic and social benefit of …

  Sylvie Goddyn, au nom du groupe ENF. – Monsieur le Président, le maintien de la dérogation accordée à la pêche électrique dans ce règlement fait l’objet d’une vaste polémique, et à raison. Comment cette pêche peut-elle être considérée comme une pêche viable écologiquement par l’Union européenne, alors qu’elle est interdite dans un grand nombre de pays dont la Chine, les États-Unis ou le Brésil, qui ont souvent des réglementations et des normes moins sévères que les nôtres?

Aujourd’hui, rien ne prouve la durabilité de la pêche électrique. Autorisée par dérogation depuis dix ans, elle n’a jamais fait l’objet d’études d’impact. Rien n’a été fait pour déterminer l’impact des décharges électriques sur les juvéniles, sur la fécondité et sur les espèces invasives. Le résultat de cette négligence est que la sole et la plie disparaissent des zones où l’on pratique cette pêche. L’impact social est important: beaucoup de pêcheurs artisanaux ont mis la clé sous la porte, ou vont le faire si cette pêche n’est pas interdite.

Il y a quelques jours, on a appris que la Commission européenne s’était servie d’un rapport de son comité scientifique, technique et économique, prétendant qu’il était favorable à cette pêche. En réalité, ce rapport affirmait le contraire. C’est la raison pour laquelle le rapport de M. Mato aurait dû être renvoyé en commission de la pêche afin que la Commission européenne s’explique devant les députés.

  Werner Kuhn (PPE). – Herr Präsident, Herr Kommissar! Wir sehen, dass im Parlament die Meinungen gerade bezüglich der neuen fischereilichen Methoden und auch des dazugehörigen Fanggeschirrs sehr stark auseinandergehen. Dazu gehört auch die Pulsfischerei. Der Kollege Mato hat mit seinen Schattenberichterstattern bei den technischen Maßnahmen einen sehr guten Kompromiss gefunden. Wir haben das vorhin von der Kollegin schon erwähnt bekommen. Es ist notwendig, dass neue fischereiliche Methoden und das Fanggeschirr wissenschaftlich getestet werden, und zwar über vier Jahre hinweg und unter entsprechender wissenschaftlicher Begleitung – wir haben genügend Institute in der Europäischen Union, die das tun können –, und dass nicht mehr als 5 % der betreffenden Flotte damit ausgerüstet werden.

Das ist ein wichtiger Punkt, damit wir den Streit auch zwischen den niederländischen Baumkurrenfischern und den französischen und den deutschen und vielleicht auch den britischen – ich weiß zwar nicht, wie lange sie noch dabei sein werden – beilegen können. Deshalb finde ich diesen Kompromiss so wahnsinnig gut und kann nur befürworten, dass wir dem zustimmen und hier sozusagen viele Dinge wieder auf die vernünftige Bahn bringen.

  Ricardo Serrão Santos (S&D). – Senhor Presidente, antes de mais quero felicitar o relator e os relatores-sombra pelo difícil trabalho e reconheço que há aqui, de facto, elementos de muita rotura.

Mas deixe-me ser claro, Senhor Comissário, o meu ponto de fratura com a Comissão Europeia no contexto deste dossiê está baseada no artigo 4.º. Apoio o compromisso atingido. Na minha perspetiva, uma solução única para todas as pescarias europeias não é técnica, nem politicamente, razoável. A possibilidade de uma decisão diferenciada em diálogo com os concelhos regionais é um passo importante e sensato, e pacificamente pacificadora, e não fere a PCP, antes pelo contrário. Pode, aliás, criar credibilidade à PCP em relação ao lado mau do mito urbano e das desconfianças em relação a decisões demasiado centralizadas.

Outro aspeto - a captura acidental de espécies sensíveis - tem de ser reduzida e foi com desagrado que vi as minhas propostas de medidas para a sua redução serem reprovadas em comité. Por isso, regresso para reforçar a proteção de espécies sensíveis como mamíferos marinhos, incluindo pinípedes.

  Ruža Tomašić (ECR). – Gospodine predsjedniče, donošenje Uredbe o tehničkim mjerama predstavlja važan trenutak u razvoju ribarskih politika. Nakon dugog niza godina pogrešnog pristupa, novom Zajedničkom ribarstvenom politikom i usklađivanjem zakonodavstva s njezinim ciljevima stvorena je prilika za održivo ribarenje koje uvažava regionalne specifičnosti.

U tom smislu moram čestitati izvjestitelju Mati i svim kolegama izvjestiteljima u sjeni na ovom sjajnom Izvješću.

Ovo je prvi korak koji će nas nedvojbeno dovesti do izmjene Mediteranske uredbe, što sam i predložila svojim amandmanom koji je i usvojen. Prema trenutno važećoj regulativi ribolov mrežama plivaricama u Jadranu nije moguć zbog njegovih specifičnosti koje regulativa ne uvažava.

Takvo je stanje diskriminatorno prema hrvatskim ribarima koji se s ovim problemom suočavaju od dana pristupanja Hrvatske Europskoj uniji. Zadovoljna sam jer smo donošenjem ove Uredbe korak bliže rješenju koje znači opstanak hrvatskog ribarstva.

  Younous Omarjee (GUE/NGL). – Monsieur le Président, nous avons la responsabilité de parler pour et à la place des poissons sans voix.

Les poissons, qui nous demandent si nous n’avons pas honte de nos méthodes de pêche barbares. De cette pêche électrique qui brise leur colonne vertébrale et électrifie les fonds marins. En fait, une véritable arme de destruction massive.

Les pêcheurs artisans, eux, nous demandent jusqu’où ira la prédation des flottes industrielles qui, par appât du gain, font des océans de véritables cimetières. Les pêcheurs artisans, qui sont aujourd’hui menacés dans leur existence même, car «plus de poissons, plus de pêcheurs»; c’est aussi simple que cela.

C’est pourquoi nous devons dire non, trois fois non, à la pêche électrique qui est une honte pour l’Europe et pour notre humanité; c’est pourquoi nous devons voter l’amendement que mes collègues et moi avons déposé, pour bannir définitivement cette pratique de l’Europe, pratique qui est d’ailleurs déjà interdite dans le monde entier.

  Yannick Jadot (Verts/ALE). – Monsieur le Président, Monsieur le Commissaire, chers collègues, nous avons un choix majeur à faire sur la pêche électrique. Soit nous poursuivons et nous généralisons l’électrocution des fonds marins qui décime les poissons, sacrifie les pêcheurs, désertifie nos territoires côtiers, soit nous interdisons la pêche électrique, cette arme de prédation massive, nous protégeons les ressources, nous sauvons la pêche artisanale et nous avons de beaux et bons poissons dans nos assiettes. Alors oui, nous devons voter l’interdiction et nous devons le faire malgré la Commission européenne parce que, Monsieur le Commissaire, comme le reste de la Commission, vous continuez à mentir sur la pêche électrique, vous mentez sur le fondement scientifique de vos décisions, vous avez failli sur les dérogations – il n’y a aucun protocole scientifique sur vos dérogations –, vous avez failli sur l’expansion des dérogations qui en font aujourd’hui une pêche massive.

Alors pour la pêche artisanale, pour les océans, pour les chefs cuisiniers qui nous soutiennent, pour les ONG qui nous soutiennent, interdisons cette pêche. Monsieur le Commissaire, vous devrez rendre des comptes devant cette assemblée.

  Annie Schreijer-Pierik (PPE). – Voorzitter, de pulsvisserij is een duurzame, selectieve vistechniek. Een innovatie die de zeebodem, het klimaat en het milieu spaart. Dat blijkt uit alle voorlopige onderzoeksresultaten van de Universiteit Wageningen en Wageningen Marine Research. En daar baseerde de Commissie zich op. De Nederlandse vissersgezinnen hebben de afgelopen jaren met Europese steun en toezeggingen volop geïnvesteerd in dit vistuig om in overeenstemming te komen met de aanlandplicht.

Op basis van nepnieuws heeft zich helaas een monsterverbond en front gevormd van protectionisme, extreemrechts en extreemlinks in dit Parlement om deze innovatie de doodsteek toe te brengen. Als hun amendementen doorgaan, betekent dat de doodsteek voor vele Nederlandse vissersplaatsen zoals Urk, Den Helder, Scheveningen, Stellendam en nog veel meer, en de doodsteek voor de Nederlandse kottervloot.

En bovenal – en vergeet u dat niet – de doodsteek voor het vertrouwen in de wetenschappelijk gefundeerde en degelijke Europese wetgeving in dit Parlement. Ik roep u allen op om Mato te steunen. Want net werd gezegd: sommige landen gaan uit Europa. En Nederland, als we zo doorgaan, ook!

  Isabelle Thomas (S&D). – Monsieur le Président, Monsieur le Commissaire, mes chers collègues, avant tout, je tiens à saluer le rapporteur, M. Mato, et les rapporteurs fictifs pour le travail fourni sur ce dossier complexe et dense et pour avoir réussi, surtout, à trouver pour l’essentiel des compromis utiles pour avancer. Bien sûr, il reste cette question de la pêche électrique.

En 2007, la Commission a autorisé, par dérogation, sur un segment de 5 % de la flotte en mer du Nord, cette pêche électrique. Elle nous demandait, aujourd’hui, de la généraliser.

Alors, oui Monsieur van Dalen, nous sommes tous favorables à l’innovation, mais encore faut-il qu’elle soit vérifiée, qu’il soit vérifié scientifiquement que l’objectif de la gestion durable de la ressource est respecté.

Or cette gestion durable doit être basée sur le meilleur avis scientifique, ce qu’a ignoré la Commission en 2007 – et ce n’était pas M. Vella qui en était commissaire – en ne respectant pas l’avis scientifique de 2006, qui préconisait de n’accorder aucune dérogation.

Il n’y a aucun protocole scientifique sur les juvéniles et les écosystèmes marins et les scientifiques persistent à nous alerter sur les dégâts sur le cabillaud ou le merlan…

  Jarosław Wałęsa (PPE). – Mr President, technical measures are broad sets of rules which govern how, where and when fishermen may fish. They are established for all European sea basins, but obviously they differ considerably from one basin to another, in accordance with their original conditions. It is a highly technical issue, but it is also highly political because, after all, we are trying to combine different interests from different Member States and different stakeholders.

The rapporteur is doing a very good job. Mr Mato, you have my full support because of the tailor-made measures adopted for the specificities of each fishery and each sea basin, the reduction of micromanagement and rigid technical rules – adopting a more flexible and result-based management – and, finally, the greater involvement of sector in decisions of the common fisheries policy. This is the way to go and I congratulate you on the very hard work you have done.

  Francisco José Millán Mon (PPE). – Señor presidente, me gustaría felicitar en primer lugar al ponente por los esfuerzos realizados para buscar compromisos y por su actitud de diálogo permanente con el sector. Como gallego le agradezco mucho esta cercanía y disposición de diálogo.

Tras varios intentos fallidos en los últimos años sobre la simplificación de los más de 30 textos legislativos que existen, ya es necesario que en esta legislatura las instituciones europeas efectuemos la revisión y consolidación de esta reglamentación.

Los pescadores tienen que saber a qué atenerse en este dosier tan importante y creo que la regionalización, por ejemplo, de las decisiones sobre las dimensiones de las redes y sobre el establecimiento de objetivos de reducción de las capturas de especies por debajo de las tallas mínimas es el camino adecuado. De esta forma se pueden ajustar las decisiones a la realidad de las diferentes pesquerías ya que, a mi juicio, las propuestas iniciales de la Comisión en estas dos baterías no tenían en cuenta suficientemente la situación real de estas pesquerías y tampoco tenían el respaldo científico necesario.

La solución de regionalización —repito— me parece la adecuada. Está a medio camino entre las posiciones dispares existentes.

  Jérôme Lavrilleux (PPE). – Monsieur le Président, d’un côté, j’entends qu’il y a une nécessité absolue de préserver la ressource et, notamment, les juvéniles, et, de l’autre côté, on s’apprête à pérenniser ou à étendre la pêche électrique, qui n’est pas discriminante, puisque jusqu’au plus petit poisson dans la zone concernée, tout sera éradiqué. Il y a là une incohérence que je ne m’explique pas. Cela équivaudrait, pour d’autres activités comme la chasse, à autoriser la chasse avec un hélicoptère équipé de plusieurs mitrailleuses au prétexte qu’on blesserait moins le gibier. Ce serait un scandale absolu! Autoriser la pêche électrique, c’est ni plus ni moins que cela.

Il faut avoir une pêche qui soit discriminante, qui préserve la ressource et qui permette à nos pêcheurs – notamment aux artisans pêcheurs de ma circonscription, qui seront les premiers touchés – de continuer à pérenniser leur activité pour le bien du développement du tissu économique local et pour l’avenir des générations qui veulent continuer à manger du poisson un jour.

  Marijana Petir (PPE). – Gospodine predsjedniče, čestitam kolegi Mati na izvješću te izražavam zadovoljstvo jer je Odbor za ribarstvo prihvatio moje amandmane za uvođenje fleksibilnosti zbog specifičnih uvjeta ribolova u Jadranu.

Nakon provedene opsežne međunarodne studije o tehnologiji ribolova mrežama plivaricama, tehničkim odlikama tih mreža i njihovom utjecaju na morsko dno, dokazano je kako prilikom ribolova u Jadranu ne dolazi do spuštanja mreže do dna bez obzira na dubinu.

Naime, trenutnim odredbama europskog zakonodavstva ograničenjem korištenja okružujućih mreža plivarica na dubinama manjim od 70 % visine mreže, te zbog utjecaja morskih struja, ali i promjenjive konfiguracije morskog dna, ribolov tim mrežama bio bi gotovo obustavljen.

To bi bespovratno ugrozilo 2 000 ljudi koji rade na brodovima i 15 000 ljudi koji rade u preradi i svim drugim popratnim djelatnostima, što nije zanemarivo jer su to stalna radna mjesta 12 mjeseci u godini na hrvatskim otocima i priobalju. Stoga je usvajanje izuzeća za Jadran posebno važno i zahvaljujem na podršci.

  Seán Kelly (PPE). – Mr President, is there any area that is more controversial and more difficult to get consensus on than the fishing area? I see that in my own country. I see it here. I see Mr Mato, who is an excellent politician and chairman, coming forward with his speech. Then Commissioner Vella, who is equally sincere, takes issue with some of the points made and I say to myself, when are we going to get all this together? How are we going to convince enough people that we can have a good majority going in the one direction? It seems to me to be very difficult.

One thing that is absolutely necessary is independent, empirical scientific evidence before we do anything, and that doesn’t seem to be available. We get different groups coming forward with different proposals – electro-pulse fishing is an example – to me it seems to go against the grain and against the natural order. Do the fish have any chance if you are going to extend it? Why have it as an experiment if you do not intend to extend it further, and perhaps even eliminate the whole lot of them?

So I think that there is a huge job of work to be done by the Commission in relation to PR in all of this.

  Νότης Μαριάς (ECR). – Κύριε Πρόεδρε, η προστασία των θαλασσίων οικοσυστημάτων είναι απαραίτητη για την εμπέδωση της βιώσιμης αλιείας. Σημαντικό ρόλο διαδραματίζουν οι έλεγχοι διεθνών οργανισμών όπως είναι η ICCAT, δηλαδή, η Διεθνής Επιτροπή για τη Διατήρηση του Τόνου του Ατλαντικού. Στο Αιγαίο, τα τουρκικά αλιευτικά, με τη συνοδεία σκαφών της τουρκικής ακτοφυλακής, αλιεύουν παράνομα εντός των ελληνικών χωρικών υδάτων διαπράττοντας πειρατεία. Επιπλέον, το τουρκικό λιμενικό, ισχυριζόμενο ότι ενεργεί δήθεν για λογαριασμό της ICCAT, επιχείρησε σε διεθνή ύδατα κοντά στο Καστελόριζο να υποβάλει σε νηοψία ελληνικά αλιευτικά, χωρίς, φυσικά, οι Τούρκοι να τηρούν τις προδιαγραφές, να έχουν δηλαδή αναρτήσει σημαία της ICCAT, και χωρίς να υπάρχει παρουσία επιθεωρητή της ICCAT. Ζητώ από εσάς, κύριε Vella, να εξετάσετε αυτή την καταγγελία. Θα σας αποστείλω όλα τα στοιχεία τα οποία έχω στη διάθεσή μου. Επίσης, δεν είναι δυνατόν να επιτρέπουμε παράνομα οι Τούρκοι να κάνουν νηοψίες σε ελληνικά αλιευτικά σε διεθνή ύδατα, ισχυριζόμενοι ότι δήθεν ενεργούν για λογαριασμό της ICCAT.

  Jan Huitema (ALDE). – Ik ben blij met het voorstel van de Europese Commissie, dat het mogelijk maakt om nieuwe vistechnieken uit te proberen in de praktijk. Na een proefperiode en voldoende wetenschappelijk onderzoek wordt bepaald of de nieuwe vistechniek gebruikt mag worden door onze Europese vissers: een toelatingsprocedure die logisch is en waar iedereen zich in kan vinden.

Ik ben dan ook met stomheid geslagen dat sommigen van mijn collega's bij voorbaat in de wet willen vastleggen dat de pulskortechniek niet door vissers gebruikt mag worden. De toelating van de pulskor wordt daarmee politiek gemaakt, in plaats van dat onafhankelijke experts hierover beslissen. Wat bezielt hen? Is het een associatie die zij maken met elektrisch vissen? Spelen onderbuikgevoelens een rol of heeft het puur te maken met politiek-economische redenen en worden de voorlopers bewust tegengehouden?

In elk geval vind ik het een schande dat de pulskor niet dezelfde kansen krijgt als alle andere nieuwe vistechnieken.

  João Ferreira (GUE/NGL). – Senhor Presidente, não obstante as promessas feitas aquando da última reforma da política comum das pescas, esta continua a ser uma política fortemente centralizada, que ignora a diversidade que caracteriza o sector ao nível das frotas dos recursos e das pescarias.

A mirífica regionalização vem redundando numa mão cheia de nada. Continuamos a ter uma política desfasada da realidade que vem criando dificuldades sobretudo ao segmento da pesca de pequena escala, costeira e artesanal.

Esta proposta de regulamentação vem confirmá-lo uma vez mais. É sintomático que a maior permissividade que vemos surgir nesta proposta de regulamentação, beneficie fundamentalmente certos segmentos da pesca industrial de países do norte da Europa. Já para a pesca de pequena escala, com fortíssima prevalência em países como Portugal, sobram medidas que mais não fazem do que agravar um muito sério problema de rendimentos cujas causas, consequências e a necessária superação a União Europeia parece desprezar.

  Karmenu Vella, Member of the Commission. – Mr President, I would like to thank all of you for your interventions and your valuable views. I have taken due note of this very interesting debate.

On a positive note, we all agree on the need to have this review of the technical measures, which is a very good start. Let me now turn to some of the specific points raised by Member States. The first point that I would like to make is that Parliament has focused on electro-pulse fishing, and this is also a good discussion. However, we should not lose sight of the other important elements contained in the proposal, as well as other problematic amendments. Whilst the Commission is aware of the concerns being expressed regarding pulse fishing, it is important that we all recall and keep an eye on the broader perspective as well.

Mr Affronte and Ms Briano spoke on the issue of regionalisation, and obviously we are all in favour of regionalisation, but in this specific case an amendment introduces the possibility of regionalising the specific rules governing the use of different mesh sizes, for example. In practice, there would no longer be a common objective across Union waters. One comment with regards to Croatia, which wants to have a special derogation for purse seine nets. This goes against a well-established rule from the 2006 Mediterranean Regulation, and allowing for a derogation would undermine conservation standards in the Adriatic. With regards to the Turkish coastguard issue that to Mr Marias mentioned, I will look into this and come back to him as well.

A number of you, and Mr Ricardo in particular, have mentioned the issue of targets and quantitative targets. What I have to say is that the concept of quantitative targets introduced in the Commission proposal is a new approach and is intended to allow for the concept of results-based management and accountability by the operators. This was proposed to deliver simplification and flexibility to amend technical regulations at a regional level while retaining oversight through the setting of quantitative of objectives. This would avoid the need to prescribe and micro-manage the specific details of how, where and when a fisherman operates by focusing on the outcome. The alternative proposed by the Committee on Fisheries (PECH) would mean that quantitative reductions are set by different regional groups, and this could lead to a differentiated approach and divergent standards across sea basins.

As I said, most of the speakers spoke about pulse fishing, and we note the concerns raised by a number of MEPs, as well as NGOs outside this House, regarding the use of pulse fishing. Our proposal lifts the current capacity limits on the number of vessels that can use the technique, but we have proposed to limit its use to the southern North Sea, in line with existing provisions.

Contrary to what MEP Hookem said, we do have independent scientific assessments, and according to our independent scientific assessments, the conventional way of fishing by beam trawling has proven to have a negative impact on the ecosystem. Thus, it is important to remember what pulse fishing would be replacing, and that is traditional beam trawling. If properly controlled and applied, I underline these words, electric pulse simulation may offer a more ecologically benign alternative way of fishing by reducing unwanted by-catch, reducing seabed damage and lowering CO2 emissions. Following independent scientific advice, the Commission has retained the geographical limitations...

So that this fishing technique can only be used in the southern North Sea. I could not accept the comment by Mr Jadot, where he said that I was lying. I can assure you that lying is not in my nature and that I have no interest whatsoever in doing so. If I am lying, that means that our scientific advice is lying as well. In its advice of 2012, the Scientific, Technical and Economic Committee for Fisheries (STECF) concluded that most ecological concerns raised by the International Council for the Exploration of the Sea (ICES) have been adequately addressed. Subsequently, advice from ICES in 2016 concluded that – and I will quote – conventional beam trawling has significant and well demonstrated negative economic ecosystem impacts. If properly understood and adequately controlled, electric power stimulation may offer a more ecologically benign alternative and could reduce fishing mortality on more targets species. This is not what I am saying, that is what our independent scientific advice is saying.

Let me reiterate, it is of the utmost importance that in order to move away from the current complexities of technical rules in return for a less prescriptive and results-oriented approach, it is important and it is essential that we retain common measures and objectives. Secondly, it is essential that we do not go back on our commitments under the Common Fisheries Policy to reduce unwanted catches and prohibit discards, as this was a central element of the Common Fisheries Policy that we all signed up for. In the spirit that Mr Kelly mentioned, I look forward to further working with the Parliament in a good spirit of cooperation, and hopefully we can take this file forward.

  Gabriel Mato, ponente. – Señor presidente; muchas gracias a todos, a los que han apoyado y a los que no tanto. En todo caso, es muy difícil en dos minutos contestar a todos, pero sí quisiera decir que hay algo que comparto con el comisario.

Querido comisario, desafortunadamente la pesca eléctrica ha desvirtuado por completo este debate. Hay cosas muy importantes en este dosier, incluso más importantes o digamos que igual. Pero, desde luego, creo sinceramente que se ha desvirtuado, y lo lamento profundamente.

Simplemente, decir sin pasión que la propuesta que hemos hecho creo que es equilibrada, que no es una decisión arbitraria, sino que se va a basar en estudios científicos en todo caso.

Y, querido comisario, por muchas veces que diga que vamos a eliminar los objetivos, no es cierto. Los objetivos no se van a eliminar. Eliminamos los objetivos cuantificados de antemano, de forma subjetiva y sin un criterio. Y esos sí los eliminamos, porque, a pesar de que usted dice que la buena gestión quedará en entredicho, yo creo en la buena gestión proveniente de la regionalización.

Usted presume que los Estados y las regiones no van a adoptar bien la propia reglamentación. Yo creo que lo van a hacer bien. Y, desde luego, regionalización no es anarquía, como aquí se ha dicho.

Va a haber metas cuantificables, señor comisario. Usted lo sabe. Y las va a haber en un año, si se ponen de acuerdo, o en un año más seis meses si no lo hacen y lo hará la propia Comisión. Pero serán metas que tengan en cuenta las especificidades de cada pesquería y de cada cuenca. ¿Eso es malo? Yo creo que ustedes apostaron por la regionalización, pero menos, ahora menos.

Y en cuanto al tamaño de la malla, lo que pretendían era acabar con el statu quo, que de un día para otro cambiara radicalmente lo que había. Y nosotros seguimos apostando en eso por la regionalización: distintas cuencas, distintas pesquerías. Y ustedes también lo hacían y han estado muchos meses trabajando con el Consejo en esa línea. Y de repente, todo ha cambiado. Lo que ha servido, ahora ya deja de servir. Yo, sinceramente, no lo entiendo. Comisario, vamos a trabajar en el futuro, y vamos a hacerlo bien. Y seguro que llegaremos a acuerdos.

Y simplemente, termino. Hay que adoptar los compromisos. Todos cedimos. Votemos. Apoyémoslo. Los pescadores quieren unas medidas técnicas nuevas que se puedan utilizar, que sean regionalizadas. Y nuestra obligación es no defraudarlos.

  Michela Giuffrida (S&D), per iscritto. – La riforma della Politica comune della pesca, avvenuta nel 2013, ha introdotto le misure tecniche come oggi le conosciamo. È opportuno e coerente, con il percorso avviato, che vengano ridiscusse, sulla base dei risultati raggiunti e rivolgendo un'attenzione particolare al settore, nel suo insieme. La Commissione avrebbe forse dovuto tenere in considerazione le complessità riscontrate dagli operatori, che dell'indotto della pesca, vivono quotidianamente, agendo di conseguenza sulla normativa vigente, che è stata invece mantenuta pressoché immutata e portando così a confusioni normative, durante il processo di adeguamento. D'altro canto, eliminare la rigidità della normativa attuale e favorire una legislazione più evolutiva e adattata al territorio, è certamente un obiettivo auspicato da tempo. Questo progresso dovrà però essere accompagnato da un parallelo rispetto dell'equilibrio, tra le istituzioni dell'Unione, cosicché gli atti delegati non diventino uno strumento per aggirare norme generali, o il ruolo del Parlamento. Per questo i piani pluriennali, restano lo strumento più adatto a promuovere uno sviluppo efficiente del processo di regionalizzazione che stiamo discutendo. In sintesi, aumentarne la flessibilità mediante un approccio adattato alle specificità di ciascun bacino marittimo dell'UE, si rivelerà tanto più essenziale, quanto saremo in grado di adattare il ruolo dell'Unione alle necessità del settore.

  Claude Rolin (PPE), par écrit. – Le vote du règlement sur les mesures techniques de la politique commune de la pêche est une occasion pour interdire la pêche électrique au sein de l'Union européenne. Cette technique bénéficie actuellement d’une dérogation qui, depuis 2007, permet la pêche au moyen du chalut électrique à titre expérimental dans la limite maximale de 5 % de la flotte de chalutiers à perche de chaque pays de l’Union européenne opérant en mer du Nord. Le motif initial d’expérimentation, aujourd'hui largement dépassé, est fallacieux car la quasi-intégralité de la flotte de chalutiers à perche a depuis lors été convertie à l’électricité. Cette technique, interdite dans la plupart du monde (de nombreux pays dont les États-Unis, le Brésil, l’Uruguay et la Chine l'ont bannie après que de graves conséquences sur l’environnement aient été observées), est dangereuse pour l’écosystème, fait honte à l’Europe et nous décrédibilise sur la scène internationale. Il faut davantage permettre de développer, soutenir et encourager des activités durables plutôt que d'alimenter une pratique controversée. Je vous remercie.

  Daciana Octavia Sârbu (S&D), în scris. – Salut propunerea Comisiei privind conservarea resurselor piscicole și protecția ecosistemelor marine prin măsuri tehnice de revizuire a regulamentelor existente. Principalul obiectiv al măsurilor tehnice este să reducă acele capturi nedorite fie de puieți, fie de specii nevizate, precum și impactul activităților de pescuit asupra speciilor și ecosistemelor vulnerabile.

Propunerea aduce și elemente noi precum simplificarea si regionalizarea, însă cred că simplificarea nu trebuie să se facă cu orice cost. De asemenea, m-am exprimat și mă exprim împotriva pescuitului electric, deoarece nu cunoaștem impactul pe care acesta îl poate avea asupra ecosistemelor, și sper ca votul colegilor sa fie în favoarea amendamentelor noastre care cer interzicerea acestei practici.
