  Gilles Pargneaux, rapporteur. – Madame la Commissaire, Madame la Présidente, en tant que rapporteur sur la protection des intérêts financiers de l’Union européenne pour l’année 2016, mon objectif premier est de m’assurer que l’argent public venu des contribuables est correctement utilisé au sein de l’Union européenne. La bonne gestion des dépenses publiques et la protection des intérêts financiers de l’Union doivent être notre priorité.

Pour l’année 2016, les résultats obtenus en matière de protection des intérêts financiers, de lutte contre la fraude, sont globalement positifs. L’adoption de la directive sur la protection des intérêts financiers et la création prochaine d’un parquet européen sont deux succès qui méritent d’être mis en avant.

Ces avancées nous permettront de mieux protéger l’argent et les intérêts des contribuables européens et de faciliter le recouvrement des fonds de l’Union frauduleusement utilisés. Je regrette cependant que la totalité des États membres n’ait pas souhaité participer à la mise en place de ce parquet européen (20 sur 28 États membres).

En termes de résultats à proprement parler, je tiens à saluer la réduction de 15 % des irrégularités frauduleuses et non frauduleuses et la diminution de leur valeur de 8 % par rapport à l’année 2015.

Malheureusement, le nombre encore très important d’irrégularités constatées dans les domaines du développement rural, de la politique de cohésion et de la pêche m’inquiète profondément. J’espère sincèrement que la simplification des règles administratives annoncée permettra de réduire le nombre d’irrégularités non frauduleuses, de détecter les cas frauduleux et d’améliorer l’accès des bénéficiaires aux fonds de l’Union.

Ensuite, je souhaite revenir sur certains aspects spécifiques de mon rapport.

Premièrement, je considère que la sous-évaluation des droits de douane sur des produits chinois constitue la question politique majeure de ce rapport. Comme vous le savez, entre 2013 et 2016, des importations chinoises de vêtements et de chaussures destinées au marché noir ont été sous-évaluées à leur entrée au Royaume-Uni. Des pantalons étaient déclarés avec une valeur ridicule de 91 centimes d’euro le kilo, au lieu de 26 euros le kilo habituellement. Le 8 mars 2018, la Commission européenne a ouvert une procédure d’infraction contre le Royaume-Uni afin de récupérer les 2 milliards d’euros qui auraient normalement dû profiter au budget de l’Union européenne. Madame la Commissaire, je tiens à saluer le lancement de cette procédure. Selon moi, le recouvrement de ce manque à gagner, doit absolument être évoqué dans le cadre des négociations budgétaires du Brexit. Le groupe socialiste et démocrate y veillera tout particulièrement.

Deuxièmement, j’appelle la Commission européenne à transmettre dans les plus brefs délais une proposition législative sur la protection des lanceurs d’alerte, comme demandé par le rapport du Parlement européen du 24 octobre 2017 sur cette question cruciale. J’encourage également la Commission européenne et les États membres à adopter des mesures pour protéger la confidentialité des sources d’information afin de prévenir toute action discriminatoire ou menace vis-à-vis des lanceurs d’alerte.

Troisièmement et dernièrement, j’aimerais revenir plus amplement sur notre combat contre le commerce illicite des produits du tabac. En tant que président du groupe de travail contre l’ingérence de l’industrie du tabac au Parlement européen, je tiens à rappeler que 12 % des 6 000 milliards de cigarettes commercialisées chaque année dans le monde font l’objet de commerce illicite. Les conséquences sont bien évidemment sanitaires et en tant que vice-président de la commission de l’environnement, de la santé et de la sécurité alimentaire, je tiens à souligner que les cigarettes contrefaites ou de contrebande sont moins chères, plus facilement accessibles pour les jeunes et plus dangereuses. L’éradication du commerce illicite du tabac entraînerait une baisse de la consommation de 2 %. Face à ce défi concernant la lutte contre ce commerce illicite, nous devons mettre en œuvre une stratégie globale pour lutter efficacement contre ce commerce illicite du tabac.

Voilà, Madame la Commissaire les différentes observations ou constatations que je voulais vous faire dans mon propos liminaire à propos de ce rapport sur la protection des intérêts financiers de l’Union pour l’année 2016.

  Corina Crețu, Member of the Commission. – Madam President, you know very well that the fight against corruption and fraud is higher on the agenda for the Commission than it is for Parliament.

Several hours ago, the Commission President, Jean-Claude Juncker, and the Commissioner for the budget presented the Commission proposal on the post-2020 multi-annual framework. The EU budget is, of course, a means to achieve our joint political goals and to have the resources needed to turn political priorities into tangible results for Europe and for European citizens in order to have a truly positive impact on their lives. To make that happen, however, we must fight fraud and corruption. The financial interests of the Union should be protected through effective measures both on the expenditure and on the revenue side. This includes prevention, detection and investigation of fraud, the recovery of funds and the imposition of penalties.

I therefore thank the rapporteur for the Committee on Budgetary Control, Mr Pargneaux, for the good work done on Parliament’s annual report on the protection of financial interests and in particular for taking a holistic approach to the fight against fraud. The result of your work is a comprehensive report, and there is indeed a continuing need for such a holistic and comprehensive approach to combating fraud affecting the EU’s financial interests in all budget areas.

Take the example of regional policy, for which I am responsible. The Union’s main policy to reduce disparities among regions and Member States is a major driver of job creation, sustainable growth and innovation in Europe. According to the Commission’s 2016 report on the protection of the EU’s financial interests, 45% of reported irregularities concerned the area of cohesion policy and fisheries, 2.10% being related to fraud. That is why OLAF has included the protection of cohesion expenditure among its investigation policy priorities and has recommended the recovery of hundreds of millions of euros spent fraudulently in this area.

Only an effective and also a trustworthy and comprehensive system, including, as I have said, prevention, detection, investigations, penalties and recovery, will persuade Member States to support a strong cohesion policy in the future MFF.

Over the last six or seven years, we have progressed significantly in the anti- fraud area at Member State level. The Commission has developed new and innovative concepts. The basis of the Commission anti-fraud strategy and the idea behind the national anti-fraud strategies is that the Commission helps Member States to develop. The Commission fosters the sharing of knowledge and best practice and enables a network to be created among competent authorities of the Member States. We finance dedicated programme projects and put anti-fraud tools guidance at the disposal of Member States. These initiatives have boosted cooperation with and among Member States, but, again, we will do more.

That is why the Commission is currently in the process of reviewing its anti- fraud strategy in the context of the new multi-annual financial framework, taking into account recent changes in the fraud landscape. This new Commission anti-fraud strategy, an update of the strategy dating from 2011, will respond to the major risks affecting new financial interests, for example organised crime. The new strategy might inccorporate oversight of the anti-fraud measures in Commission departments and agencies and strengthen the role of analyses.

Let me now turn to the legislative domain. Over the past few years we have together reinforced the legal framework for protection of the Union’s financial interests, achieving significant results. 2017 was a year of great achievement in that respect, with the adoption of two major legislative acts: the regulation establishing the European Public Prosecutor’s Office and the directive on the fight against fraud to the Union’s financial interests by means of criminal law.

Continuing in the same vein, the Commission will later this month adopt a proposal to amend the OLAF Regulation (Regulation (EU, Euratom No 883/2013) to ensure close cooperation with the EPPO and the effectiveness of OLAF’s investigations. The creation of the EPPO is a fundamental advance in the EU approach to fraud affecting its budget. Once European Prosecutor investigation has been set up, we will have two EU bodies with distinct but complementary mandates to investigate in this area. European Prosecutor investigation will increase the effectiveness of the criminal law response to fraud, and it will be in line with European criminal prosecution policy proper, whereas OLAF will complement the Prosecutor’s activities through its administrative investigations.

The Commission is currently taking the necessary steps to set up the European Prosecutor’s Office. Our aim is to ensure that it will start operations in late 2020, thus contributing to successful implementation of the new multi-annual financial framework. In order to ensure that all available means are used to counter fraud and other illegal activities affecting the EU budget, the European Prosecutor and OLAF will work in close partnership and be mutually reinforcing, each acting within its own mandate. This is one of the main drivers of the proposal to amend Regulation (EU, Euratom) No 883/2013.

The Commission wants OLAF to remain strong and fully functioning so as to complement the European Prosecutor’s criminal law approach with administrative investigation. OLAF’s role will remain essential in several respects. Firstly, OLAF will keep its mandate in all Member States in the area of non-fraudulent irregularities concerning the Union’s financial interests. The EPPO will have no competence for these purely administrative irregularities. Let me give you concrete numbers from the reports that we have been discussing today, which show the impact that non-fraudulent irregularities have on the Union’s financial interests. In 2016, for instance, a total of 19 080 fraudulent and non-fraudulent irregularities were reported to the Commission, involving a total of approximately EUR 2.97  billion. Out of that figure, 17 700 irregularities were reported as non-fraudulent, with

a financial impact of approximately EUR 2.5 billion. This means that 93% of all irregularities reported in 2016 were not of a criminal nature and thus do not fall within the mandate of the European Prosecutor.

Secondly, OLAF will continue its investigations on the same basis as now in Member States not participating in the European Prosecutor’s Office. In those Member States, the national authorities, as well as OLAF, should create the conditions to ensure an effective and equivalent level of protection of the Union’s financial interests throughout the EU.

Thirdly, in the Member States participating in the European Prosecutor’s Office, OLAF’s operations will be adjusted. Today, when OLAF encounters possible criminal offences, it can only address a recommendation to national judicial authorities, but with no guarantees as to whether a criminal investigation will be opened. In the future, OLAF will report such suspected offences to the European Prosecutor’s Office and collaborate with it in its investigations in order to complement EPPO operations to the greatest possible degree. OLAF investigations in participating Member States will lay particular emphasis on facilitating recovery and preventing further harm to the new financial legislative measures, thus supplementing the EPPO’s criminal law approach. In coordination with the EPPO, it may need to carry out action to complement an EPPO investigation, for instance in cases where there is a risk related to time or where the amounts at rsik are very high. OLAF must therefore become a close and a dependable partner for the EPPO in the Member States participating in the enhanced cooperation. carry on its work concerning irregularities of a non-criminal nature in all Member States and continue to fulfil its mandate as it does today in non-participating Member States.

We will need the strong support of the European Parliament and the European Council to ensure that by the time the EPPO becomes operational, the OLAF Regulation is amended in order to allow full cooperation and the smoothest coexistence with the EPPO. As I have said, we must keep on stimulating, encouraging and also – when necessary – criticising the Commission and the Member States in our efforts, when dealing with fraud and irregularities, to protect Europeans’ financial interests effectively.

  Barbara Kudrycka, autorka projektu opinii Komisji Wolności Obywatelskich, Sprawiedliwości i Spraw Wewnętrznych. – Pani Przewodnicząca! Nie ulega wątpliwości, że obowiązkiem instytucji unijnych, jak i krajowych jest przede wszystkim dbałość o pieniądze podatników. Jak wynika ze sprawozdania Komisji za 2016 rok, wysokość kwot z tytułu nieprawidłowości zgłaszanych jako nadużycia sięga 391 milionów euro rocznie. Należy jednak zauważyć, iż w 2015 roku kwota ta była dużo wyższa i wynosiła 640 milionów euro.

Zaniepokojenie budzi jednak wzrost liczby nadużyć finansowych związanych z podatkiem VAT. Skuteczną ochronę interesów finansowych Unii zapewnią z pewnością dyrektywa w sprawie zwalczania nadużyć finansowych w Unii Europejskiej za pomocą prawa karnego (dyrektywa PIF) i rozporządzenie EPPO, ponieważ przyznają one organom ścigania środki, których dotychczas w walce z korupcją nie miały. Z kolei wprowadzenie instytucji sygnalistów oraz wezwanie Komisji i państw członkowskich do zapewnienia im należytej ochrony również powinno przyczynić się do skuteczniejszej walki z defraudacją środków unijnych. Publikowanie przez Komisję rocznych sprawozdań antykorupcyjnych pozwoli też na lepsze monitorowanie sytuacji we Wspólnocie.

W celu uniknięcia transnarodowych nadużyć finansowych niezbędne jest jednak ustanowienie ściślejszej współpracy państw członkowskich w obszarze Eurofisc, OLAF i Eurojust. Stworzenie skutecznie funkcjonującego systemu wymiany informacji w ramach sieci współpracy państw członkowskich z pewnością przyczyni się do dalszego ograniczenia transnarodowych nadużyć finansowych.

  Marian-Jean Marinescu, în numele grupului PPE. – Doamnă președintă, mulțumesc raportorului pentru raport. Este adevărat că s-au făcut eforturi în protejarea intereselor financiare ale Uniunii. Este foarte bine că se depistează frauda și trebuie recuperate pagubele și, în acest sens, trebuie să existe o cooperare foarte importantă între Curtea de Conturi Europeană, OLAF și, bineînțeles, viitorul Birou al Procurorului European. Sper ca toate statele membre să facă parte din acest birou, pentru că este important pentru protejarea intereselor financiare ale Uniunii. Cred însă că și activitatea de prevenție este importantă, pentru că e mai important să previi și să nu existe fraudă și, în acest sens, aș cere - și există și în raportul Parlamentului European această cerere - să se insiste foarte mult pe proceduri online pentru tot lanțul de licitare, de aplicare, de urmărire a proiectelor cu bani europeni. Cred că acest lucru ar ajuta foarte mult la prevenire și, în același timp, cred că simplificarea procedurilor, a regulamentelor ar fi iarăși un lucru benefic în acest sens.

  Caterina Chinnici, a nome del gruppo S&D. – Signora Presidente, signora Commissaria, dalla relazione sulla protezione degli interessi finanziari dell'Unione, come già sottolineato dal collega Pargneaux, emerge effettivamente una diminuzione del numero totale delle segnalazioni di irregolarità fraudolente. Tuttavia, non si può nascondere che il livello di frode ai fondi dell'Unione rimane ancora elevato e così anche i casi di corruzione.

In questo scenario, la direttiva PIF e l'istituzione della Procura europea rappresentano strumenti fondamentali nella lotta ai reati a danno degli interessi finanziari dell'Unione e conseguentemente anche nel contrasto alla criminalità organizzata e al terrorismo, che spesso si finanziano attraverso tali reati. Nell'attesa della loro definitiva entrata in vigore, però, bisogna intanto continuare a rafforzare le capacità di coordinamento fra le strutture nazionali di controllo e assicurare che il nuovo regolamento OLAF dia risposte chiare e precise sul nuovo sistema di contrasto alla frode a livello amministrativo e sulle future relazioni con la nuova dimensione penale introdotta dalla Procura europea. In proposito, infatti, non si può non sottolineare come la cooperazione rafforzata con cui è stata istituita la Procura europea ponga notevoli sfide sul corretto riparto di competenze fra la dimensione penale e quella amministrativa, in particolare rispetto ai paesi non aderenti.

Il delicato obiettivo che dobbiamo perseguire anche attraverso la Procura europea è il miglioramento del sistema di recupero dei fondi illecitamente frodati per far sì che questo denaro torni nel bilancio dell'Unione e possa essere utilizzato per le necessità dei nostri cittadini e penso soprattutto per la creazione di posti di lavoro e per l'aumento degli investimenti da parte delle aziende.

Anche in questa discussione, infine, va a mio avviso sottolineato come nella lotta alla frode non debba essere sottovalutato il ruolo che possono svolgere gli informatori. Per l'importanza del loro contributo e la delicatezza del loro ruolo, occorre un deciso impegno da parte della Commissione attraverso una proposta legislativa che ne definisca chiaramente diritti e obblighi.

  Ryszard Czarnecki, w imieniu grupy ECR. – Pani Przewodnicząca! Pani komisarz! Tak naprawdę to trzeba lepiej koordynować to, co można zrobić dzisiaj bez wprowadzania dodatkowych instytucji czy organów. Bynajmniej nie prokuratura europejska jest panaceum w walce z korupcją na poziomie unijnym.

Po pierwsze jest kwestia, i mówię to w oparciu… powiem bardzo wprost: przygotowując się do tej debaty rozmawiałem z szefem służb antykorupcyjnych Polski. Zwrócił mi uwagę na dwie rzeczy: po pierwsze kwestia tajemnicy bankowej rozciągniętej wbrew dyrektywom Unii Europejskiej o walce z praniem brudnych pieniędzy. Tu trzeba dać większą możliwość dostępu do kont różnych podejrzanych osób i struktur, to trzeba zgrać i koordynować. Często tak rozciągnięta tajemnica bankowa jest realizowana wbrew dyrektywom unijnym.

I druga kwestia to skoordynowanie danych dotyczących systemów podatkowych w poszczególnych krajach członkowskich w Unii Europejskiej. To też trzeba bardzo poprawić, bo tu brak tej koordynacji.

  Benedek Jávor, on behalf of the Verts/ALE Group. – Madam President, corruption and fraud are systematically endangering the spending of EU resources in several Member States. In some countries it is affected by organised crime groups, such as in Slovakia. In some others, such as my own country, Hungary, governmental corruption distorts the proper use of EU funds.

With all due respect, the Commission, OLAF and the new EPPO have limited resources and capacity to properly control the use of EU funds. Not only the Hungarian or the Slovakian case, but also LuxLeaks, the Panama Papers, the Paradise Papers, taught us how much investigative journalists can do for the protection of the financial interests of the EU. Therefore, it is of direct interest to the EU to invest in media freedom, both legally and financially.

The press can perfectly complement the work of other investigative bodies of the EU and the Member States. And we already called for these steps in previous PIF reports as well. So we need, as was mentioned, good protection for whistle-blowers, also anti-SLAPP measures from the Commission, and we need a commitment from the Commission for a fixed budget line in the next MFF after 2020.

  Miguel Viegas, em nome do Grupo GUE/NGL. – Senhora Presidente, eu apenas iria levantar dois pontos: o primeiro tem a ver com o IVA, e queria desde já lamentar que a União Europeia, que é implacável perante os países que façam um desvio de algumas décimas em relação ao défice, a mesma União Europeia seja tão permissiva em relação ao IVA e não seja capaz de combater este fenómeno que representa uma perda de 150 mil milhões de euros anuais.

O segundo aspeto que queria levantar são as irregularidades que não são fraudulentas, como diz o relatório, que são detetadas na PAC e que estão naturalmente relacionadas com a última reforma da PAC, que trouxe uma burocracia enorme aos agricultores e que está na origem de uma série de irregularidades. Desse ponto de vista, as conclusões deste relatório devem apontar para a necessidade de simplificar a PAC, porque este será um passo decisivo para resolver parte do problema.

  Olaf Stuger, namens de ENF-Fractie. – Voorzitter, toen ik het onderwerp van dit debat zag was ik een beetje verbaasd, want ik dacht namelijk dat we twee weken geleden in Straatsburg hebben gesproken over het grote gevecht tegen fraude. We hebben het namelijk gehad over de zaak Selmayr. En dat was nu het uitgelezen moment om iets te doen tegen klip en klare fraude. Alleen toen bleef het in dit Parlement in meerderheid stil. En dat, Voorzitter, dat toont de hypocrisie aan. Veel woorden over fraude, veel stoere woorden over fraude. Maar als het er echt op aankomt en als we echt iets kunnen doen, dan blijft het stil.

Maar u hoort mij niet klagen, natuurlijk. Ik zou zeggen: hou dit vol, hou dit vast, blijf doorgaan. U bent de schaamte al voorbij hier, push het nog een klein beetje verder en dan weten volgend jaar bij de verkiezingen de mensen in Nederland en in de andere lidstaten in ieder geval wat ze moeten stemmen, en dat is tégen dit mislukte experiment.

  Λάμπρος Φουντούλης (NI). – Κυρία Πρόεδρε, το πρώτο και κυριότερο που πρέπει να λάβουμε υπόψη μας είναι το γεγονός πως δεν συζητάμε σήμερα εδώ για την προάσπιση των οικονομικών συμφερόντων της Ενώσεως αλλά κυρίως για την προάσπιση των οικονομικών συμφερόντων των Ευρωπαίων πολιτών. Χρήματα που άμεσα ή έμμεσα προέρχονται από αυτούς διαχειρίζεται η Ένωση και αυτό μεγιστοποιεί την ευθύνη που όλοι έχουμε για τη χρήση των χρημάτων αυτών. Θα συμφωνήσω απόλυτα πως πρέπει να επιβληθούν πολύ αυστηρότεροι έλεγχοι στη διάθεση και χρήση των ευρωπαϊκών κονδυλίων, ενώ ταυτόχρονα θα πρέπει να γίνει πολύ πιο απλό και ξεκάθαρο το πλαίσιο χρήσης τους, ώστε να αποφεύγονται περιπτώσεις κακοδιαχείρισης στις οποίες δεν υπάρχει δόλος αλλά απλή άγνοια των κανονισμών.

Σε κάθε περίπτωση πρέπει να ληφθούν άμεσα και πολύ πιο αποτελεσματικά μέτρα στους τελωνειακούς ελέγχους για την καταπολέμηση του λαθρεμπορίου καπνού και πετρελαιοειδών καθώς και του εμπορίου παράνομων προϊόντων και προϊόντων απομίμησης. Τα συγκεκριμένα είδη λαθρεμπορίου στοιχίζουν κάθε χρόνο πολλά εκατομμύρια ευρώ στους Ευρωπαίους. Πλήττουν το νόμιμο εμπόριο και δυστυχώς μέχρι σήμερα δεν έχουν καταπολεμηθεί ικανοποιητικά. Όμως θα ήθελα να επισημάνω πως δεν μπορεί να ασκούνται πιέσεις για ορθή χρήση των ευρωπαϊκών κονδυλίων, όταν στα ίδια τα όργανα της Ενώσεως παρατηρείται πολύ συχνά κακοδιαχείριση και αλόγιστη σπατάλη κονδυλίων.

  Емил Радев (PPE). – Благодаря, госпожо Председател, уважаема г-жо Комисар, дами и господа, годишната оценка на изразходването на европейските средства под формата на сега обсъждания доклад е изключително важна, защото допринася към анализа на ефективността на европейското финансиране. Затова съм изключително доволен, че като цяло се наблюдава спад на грешките и измамите с европейски средства – това означава, че повече пари достигат до тези, които наистина имат нужда от тях, а именно европейските граждани.

В същото време не трябва да спираме да сме взискателни – всеки евроцент, изразходван не по предназначение, е в ущърб на гражданите. В този контекст приветствам създаването на Европейската прокуратура, приемането на директивата за борба срещу измамите с европейски средства, както и по-общата директива за борба срещу изпирането на пари, защото всички тези мерки ще дадат допълнителни инструменти на държавите членки за борба срещу всякакви финансови измами.

Ефективното прилагане на законодателството на практика е ключово в това отношение и се надявам то да бъде транспонирано колкото се може по-скоро!

  Inés Ayala Sender (S&D). – Señora presidenta, agradezco a mi colega Gilles Pargneaux su excelente documento y también agradezco la participación de la Comisión, la OLAF y las distintas instancias precisamente para luchar contra este fraude que tiene un impacto a veces inmenso, como nos ocurrió con el fraude del IVA aduanero en 2015, que llegó a los 159 500 millones, es decir, casi la mitad más de lo que nos acaba de decir el comisario Oettinger que vamos a tener para el próximo Horizonte 2020. Por no hablar también del fraude fronterizo o de carrusel, o también lo que ha comentado el señor Pargneaux en relación con el fraude aduanero con China que se acaba de descubrir y también el relacionado con las pérdidas que nos genera el contrabando de tabaco, que ascienden a unos 10 000 millones.

Es decir, que realmente estamos hablando de importantísimas cifras que tienen que ver con algo que hay que evitar definitivamente. De ahí que salude, en la estrategia anticorrupción, que sea un sistema fiable no solo a nivel de la Unión Europea sino también de los Estados miembros, y que el seguimiento y la trazabilidad de los productos del tabaco sean realmente efectivos. Y, desde luego, apostamos por la eficiencia y la capacidad de la Fiscalía Europea, que cuanto antes se ponga en marcha mejor.

Y, desde luego, agradezco al señor Pargneaux su planteamiento en relación con la protección de los informantes y también de los periodistas de investigación, que son absolutamente esenciales para que muchos de estos fraudes y muchas de estas noticias puedan llegar al público y, de esta manera, sea más fácil luchar contra ellos.

Y, finalmente, deseo solo expresar una cierta preocupación. En la nueva apuesta por el cambio en cuanto a los ingresos de la Unión, veo que hay interés en ir desmantelando en parte el IVA y otros ingresos. Yo preferiría que eso no lo desmantelásemos de ninguna manera hasta que no tengamos claros los nuevos ingresos.

  Zoltán Balczó (NI). – Elnök Asszony, Jean-Claude Juncker néhány órával ezelőtt ismertette itt a Bizottságnak a tervezetét az Unió következő hétéves költségvetéséről. Most pedig az Unió pénzügyi védelméről szóló, a csalás ellen szóló jelentést tárgyaljuk. A kettő összefügg. Sajnálatos módon a kohéziós alapok 7%-kal csökkeni fognak. Ez azt jelenti, hogy még inkább hatékonyan, célszerűen kell ezeket a forrásokat elkölteni. A jelentés megdöbbentő adatot közöl: 2015-ről 2016-ra a kohéziós alapokkal kapcsolatos szabálytalanságok 73%-kal növekedtek. Tehát elemi érdek a korrupcióval való szembenállás. Én azt javaslom azoknak az országoknak, amelyek érintettnek érzik magukat ezekben a kérdésekben, hogy csatlakozzanak az Európai Ügyészséghez, ahhoz a húsz országhoz, amely önként vállalta az ellenőrzésnek ezt a világos, tiszta formáját.

  Bogdan Andrzej Zdrojewski (PPE). – Mamy właściwie trzy obszary takiej ważnej potencjalnej aktywności. Pierwsze to są oszustwa. I w tej dziedzinie odnotowaliśmy pewien sukces, spadła ta kwota z 600 mln do 400 mln rozmaitych zobowiązań, które powinny de facto trafić do budżetu Unii Europejskiej.

Drugi problem to są rozmaite luki. Luki w prawie, luki właśnie w obszarze celnym, i tam trafiają te wszystkie rzeczy, które są związane przede wszystkim z handlem tytoniem, handlem towarami chińskimi, etc.

Jest jeszcze trzeci obszar – obszar legislacyjny – i tu na szczęście odnotowujemy sukces, choć chcielibyśmy wszyscy, aby ten sukces był szybszy, sprawniejszy. Jeżeli mówimy o różnych bonusach, o różnego rodzaju rabatach, to dobrze byłoby, aby je redukować tak szybko, jak szybko pojawiają się sygnały o możliwych nadużyciach. I na to chcę szczególnie zwrócić uwagę.

  Maria Grapini (S&D). – Doamnă președintă, doamnă comisar, stimați colegi, cred că ce ne-a prezentat Comisia mai devreme, CFM-ul, are mare legătură cu raportul pe care îl analizăm acum. De fapt, minusul pe care l-am regăsit la Fondul de coeziune, la politica agricolă comună, la susținerea IMM-urilor și celelalte elemente din cadrul financiar prezentat le putem rezolva, iată, prin combaterea fraudei. Și raportorul a prezentat bine și toți colegii care au vorbit: care sunt scurgerile de bani și pe unde? La achiziții publice, la utilizarea fondurilor europene, la subevaluarea produselor, nu numai din China, a produselor non-europene care intră pe piața internă a Uniunii Europene, pe lângă faptul că fac o concurență neloială.

Eu aș dori să subliniez din raport două lucruri. În primul rând, cred că ar trebui să ne axăm foarte mult pe prevenție, să asigurăm acea transparență dar și asistență pentru personalul care lucrează în instituțiile ce gestionează aceste fonduri. Apoi cred că ar trebui să - și susțin propunerea raportorului de a avea un raport anual din partea Comisiei privind utilizarea fondurilor europene și transferurile bancare de la BEI și BERD. Și, de asemenea, regret că nu mai avem acel raport public privind combaterea corupției. Aceasta este propunerea raportorului și o susțin.

  Νότης Μαριάς (ECR). – Κυρία Πρόεδρε, η αντιμετώπιση της απάτης σε επίπεδο Ευρωπαϊκής Ένωσης και κρατών μελών πρέπει να είναι προτεραιότητά μας. Κυρία Crețu, έχω επανειλημμένα αναφερθεί, σε αυτήν εδώ την αίθουσα, στον τρόπο διαχείρισης, εκ μέρους των ΜΚΟ, των κονδυλίων της Ευρωπαϊκής Ένωσης τα οποία πηγαίνουν για τη στήριξη των προσφύγων στην Ελλάδα. Διατίθενται πάνω από 500 εκατομμύρια ευρώ. Κι όμως η διαχείριση των κονδυλίων από τις ΜΚΟ γίνεται με πλήρη αδιαφάνεια. Οι ΜΚΟ κάνουν κυριολεκτικά πάρτι, δεν δίνουν λογαριασμό σε κανέναν και ήρθε η ώρα να ελεγχθούν. Πού πηγαίνουν αυτά τα χρήματα; Πώς αξιοποιούνται;

Να σας φέρω επίσης ένα παράδειγμα: Σήμερα στη Σάμο, ένα νησί 180 μίλια μακριά από τον Πειραιά, δέκα ώρες μακριά από τον Πειραιά, μοιράστηκαν 3.133 μερίδες φαγητό. Αυτές οι μερίδες ήρθαν από τον Πειραιά. Έχουν αποψυχθεί και θερμανθεί στη Σάμο, για να διανεμηθούν στους πρόσφυγες. Αυτό γίνεται κάθε μέρα. Εσείς το θεωρείτε σωστό; Είναι δυνατόν να αποστέλλονται έτοιμα φαγητά με κέτερινγκ από την Αθήνα στο νησί της Σάμου, τα οποία φαγητά οι πρόσφυγες δεν τα τρώνε καν· τα πετάνε! Αυτή είναι η πραγματικότητα! Πρέπει να γίνει έλεγχος. Πρέπει να μπει η OLAF.

  Ελευθέριος Συναδινός (NI). – Κυρία Πρόεδρε, η ρητή ονομαστική αναφορά στο λαθρεμπόριο προϊόντων καπνού και η διαφοροποίηση μεταξύ των δόλιων και μη παρατυπιών σε τυχόν διαπραττόμενα σφάλματα είναι ορθή. Όμως, ανεξαρτήτως στόχευσης, κάθε υπόδειξη σε δικονομικές διαδικασίες της διερεύνησης υποθέσεων υπό εθνική δικαιοδοσία είναι αβάσιμη. Οι συστάσεις των οργάνων της Ένωσης ως άσκηση δίωξης ή άλλη δικαστική δράση επαφίενται στις αρμόδιες εθνικές αρχές και δεν συνιστούν υποχρέωση σύμφωνα με το ισχύον καθεστώς και την υφιστάμενη νομική τάξη.

Τέλος, η σχεδιαζόμενη σύνδεση της κατάστασης του κράτους δικαίου με τη διαχείριση των δικαίως καταβληθέντων κονδυλίων είναι καταχρηστική και η επιδιωκόμενη παύση τους αποτελεί μεροληπτική στάση απέναντι στα συγκεκριμένα κράτη. Εν ολίγοις, παρά τις ορισμένες θετικές αναφορές, η έκθεση υπό την παρούσα μορφή αποτελεί σταχυολόγηση δεδομένων και όχημα άσκησης πίεσης για σκοπούς άσχετους με το θέμα της έκθεσης, παρά το γεγονός ότι αποτελεί απαίτηση και ανάγκη η καταπολέμηση κάθε απάτης, παρανομίας και εστίας διαφοράς για την ορθή λειτουργία ενός κράτους.

  Juan Fernando López Aguilar (S&D). – Señora presidenta, esta mañana hemos comenzado el debate con la Comisión sobre el marco financiero plurianual, en un contexto en el que decrecen las partidas de cohesión y de solidaridad que tanto importan a su cartera de política regional.

Sin que esté clara la incorporación de recursos propios, sin embargo se discute la desaparición del recurso del IVA, que tan relevante ha resultado en la lucha contra el fraude, que importa millones de euros en un momento de recursos escasos para atender las necesidades esenciales y las políticas cohesivas de la Unión. La OLAF, Eurojust y Europol deben coordinar sus esfuerzos en la lucha contra el fraude, pero, sobre todo, deben apuntalar con su experiencia la puesta en marcha, cuanto antes y con la incorporación del mayor número de Estados, de la Fiscalía Europea. Y, por supuesto, que veamos, también cuanto antes, el cumplimiento del compromiso de la Comisión, largamente reclamado en cada una de las comisiones de investigación que hemos sostenido en este Parlamento Europeo, del establecimiento de una protección procesal, procesal penal, integral del denunciante, del delator, del informante, del wistleblower, que pone de manifiesto la importancia del fraude y de combatirlo a escala europea.

  Corina Crețu, Membră a Comisiei. – Doamnă președintă, cred că în cadrul dezbaterii noastre de astăzi a devenit evident că protecția intereselor financiare ale Uniunii Europene reprezintă o importanță primordială, atât pentru Comisie, cât și pentru dumneavoastră ca și colegislatori și sper că vom continua să lucrăm împreună pentru a îmbunătăți acest mecanism care funcționează deja.

S-au vehiculat foarte multe cifre. Aici, eu pot să vă spun că în cadrul politicii de coeziune, de trei ani de când sunt comisar, am înregistrat scăderi, dar, într-adevăr, am ridicat cu foarte mult numărul proiectelor pe care încercăm să le verificăm. Dar, pentru prima oară, rata de eroare s-a înregistrat sub 5 %, dintre care numai 0,5 % înseamnă fraudă. Deci, în rest sunt iregularități, care reprezintă achiziții publice și cred că acest nou cadru financiar multianual prezentat de președintele Juncker și de comisarul pentru buget astăzi va aduce, de asemenea, o îmbunătățire, o consolidare a protejării intereselor financiare, care este deja foarte sus pe agenda Comisiei Europene. Pentru că pentru noi ceea ce contează este rezultatul final al cheltuielilor banilor contribuabililor europeni.

Sunt convinsă și știu că Comisia nu este singură în această bătălie și contăm pe sprijinul Parlamentului European pentru a continua această luptă. Sunt convinsă că pe 29 mai, atunci când Comisia va prezenta noile reguli sectoriale, vom veni cu mai multă transparență, care s-a cerut aici, o simplificare a regulilor și, deja în procedura Omnibus, am introdus câteva chestiuni legate de transparență și de lupta anticorupție, necesitatea de a avea aparate pe care ne putem baza în cadrul statelor, pentru că s-a dovedit, din păcate, că 70 % din iregularități ar fi putut fi detectate la nivel național și nu au fost raportate. Deci, din acest punct de vedere, aș vrea să îi răspund doamnei Grappini și celor care au mai ridicat acest subiect legat de raport: știți foarte bine că integritatea și lupta anticorupție sunt relevate în cadrul semestrului european pentru fiecare țară; iar domnului Marias: vă invit să vă adresați Comisiei Europene, să va adresați comisarului pentru buget, domnul Günther Oettinger, de asemenea, vă invit să vă adresați cu date exacte OLAF-ului pentru că, așa cum spunea și doamna președintă de ședință, cred că ceea ce ați semnalat dumneavoastră, ar fi foarte grav, dacă ar fi adevărat.

Deci, vă mulțumesc foarte mult și, așa cum am spus, puteți conta pe Comisia Europeană pentru a ne încuraja, a ne stimula, a ne da idei despre cum am putea să protejăm mai bine interesul și banul european al cetățenilor și impactul acestora pe teren. Mulțumesc foarte mult, deoarece cred că în asta constă încrederea și legătura între europeni și ceea ce facem noi. Poate nu spunem îndeajuns și cred că e o greșeală să ne concentrăm, într-adevăr sunt multe nereguli, dar, pe de altă parte, per ansamblu, dacă vedem ceea ce a făcut politica de coeziune, politica de agricultură și cât au contribuit la creșterea produsului intern brut, sunt convinsă că trebuie să vedem imaginea de ansamblu și nu totul în negru. În ceea ce privește lupta anticorupție, facem tot ce putem și lucrăm cu statele membre, cu OLAF, acum, mai nou, cu Parchetul European, deci, avem toată încrederea că putem detecta la timp orice nereguli pentru a proteja banul european.

  Gilles Pargneaux, rapporteur. – Madame la Présidente, Madame la Commissaire, un grand merci à tous les collègues pour les remarques et observations positives concernant mon rapport.

Madame la Commissaire, dans la minute qui reste, je voulais vous dire que bon nombre de nos collègues ont abordé cette nécessaire lutte contre le commerce illicite du tabac et ainsi, comme je l’ai dit dans mon rapport, attirer simplement votre attention sur quelques points.

Premièrement, de ne pas renouveler les accords de coopération de l’Union européenne avec la British American Tobacco, la Japan Tobacco International et l’Imperial Tobacco Limited, comme nous l’avions fait par rapport à Philip Morris, le 9 juillet 2016. Deuxièmement, d’encourager neuf États membres restants – la Belgique, le Danemark, la Finlande, la Grèce, l’Irlande, les Pays-Bas, le Royaume-Uni, la Slovénie et la Suède – à ratifier très rapidement le protocole de l’Organisation mondiale de la santé pour éliminer le commerce illicite des produits du tabac, et, enfin, de rapprocher les niveaux de taxation des produits du tabac en Europe.

Voilà les observations que je voulais formuler pour conclure notre débat.

  Dominique Bilde (ENF), par écrit. – On peut douter du sérieux de la Commission s’agissant de la corruption financière, au regard de son peu de zèle en matière de lutte contre les paradis fiscaux. De même, les drames survenus avec l’assassinat de deux journalistes d’investigation n’ont pas fait l’objet de sa part de l’attention que la gravité des faits exigeait. Certaines fraudes, comme le système du «carrousel» en matière de TVA, ne sont rendues possibles que par la suppression des contrôles aux frontières internes de l’Union européenne. Pour autant, au regard de l’importance des montants en jeu, la fraude à la TVA ayant occasionné un manque à gagner de 50 milliards d’euros environ (2015), il est urgent de muscler la riposte policière et judiciaire. Je ne saurais néanmoins m’associer avec la proposition d’un parquet européen, qui contreviendrait à la souveraineté nationale des États membres en matière judiciaire. De même, je conteste la légitimité de l’OLAF pour mener toute investigation, a fortiori pour condamner certains États membres à des sanctions pécuniaires. Cet organisme ne respecte en effet pas les règles du procès contradictoires, et des clarifications doivent également être apportées sur ses méthodes d’enquête.

  Lidia Joanna Geringer de Oedenberg (S&D), na piśmie. – Cieszy mnie fakt, że po czterech latach negocjacji, w listopadzie 2016 r. osiągnęliśmy porozumienie w sprawie wniosku dotyczącego dyrektywy o zwalczaniu za pośrednictwem prawa karnego nadużyć interesów finansowych Unii. Ponadto z ostatnich analiz wynika, że łączna liczba zgłoszonych w 2016 r. nieprawidłowości związanych i niezwiązanych z nadużyciami finansowymi spadła o 15 % w stosunku do 2015 r., a wartość tych nieprawidłowości spadła o 8 % (z 3,21 mld EUR w 2015 r. do 2,97 mld EUR w 2016 r.).

Warto pamiętać, że nie wszystkie nieprawidłowości stanowią nadużycia finansowe i że należy wyraźnie odróżniać je od popełnionych błędów. W tym kontekście niezbędne będzie wzmocnienie współpracy Komisji Europejskiej z państwami członkowskimi w wykrywaniu nadużyć finansowych. Dodatkowym problemem jest fakt, iż do tej pory nie wszystkie państwa członkowskie przyjęły krajowe strategie zwalczania takich nadużyć, dla tego konieczne będzie wsparcie KE również w tej dziedzinie.

Podsumowując, niezbędne są działania zapobiegawcze prowadzone przez Komisję Europejską i OLAF mające znaczący wpływ na zmniejszanie poziomu nadużyć w wydatkowaniu środków UE. Takie działania obejmują lepsze wdrażanie systemów EDES i systemu informacji w celu zwalczania nadużyć finansowych (AFIS), a także realizację krajowych strategii zwalczania nadużyć finansowych.

  Tibor Szanyi (S&D), írásban. – Ez a jelentés is rendkívül fontos figyelmeztetéseket tartalmaz az Unió pénzügyi érdekeit és ezáltal a tagállamok demokratikus működését, az állampolgárok bizalmát veszélyeztető korrupció és csalások okozta károkról. Napjainkra az európai szintű csalásveszély minőséget lépett. A közösségi forrásainkat megcélzó korrupció kilépett a kriminalitás szférájából és legalább egy tagállamban – kormányzati szintről szervezett, a helyi igazságszolgáltatás kulcsszereplőinek segítségével folyó, rendszerszerű csalásként jelenik meg. Ez ma az egyik legsürgetőbb jogi és immár súlyos politikai kihívás az EU intézményei és tagállamai számára. Ez a kihívás jelenleg a legnyilvánvalóbb formában a magyar Orbán-kormány által kiépített, a rezsim fenntartását az uniós források, a közbeszerzések szinte teljes kisajátításával biztosító korrupciós hálózatban mutatkozik meg.

A probléma – habár megkésett – felismeréséről OLAF-jelentések, kötelezettségszegési eljárások sora, újabban pedig a 7. cikkely szerinti eljárás javaslata tanúskodik, ám az uniós jog jelenlegi eszközeivel nem sikerült gátat vetni az egyszerre politikai és személyes célú kormányzati korrupciónak. Az európai adófizető és a magyar lakosság érdeke egyaránt az EU legmagasabb szintű, határozott politikai fellépését sürgeti Orbán – és esetleges követői – ellen. Ezen a téren is fontos reménysugár az Európai Ügyészség hivatalának felállítása és – a jelentésben is szorgalmazott – összehangolt működése az OLAF-al és más uniós intézményekkel, valamint a még kimaradó tagállamok ösztönzése a mielőbbi csatlakozásra.
