  La Présidente. – L’ordre du jour appelle le débat sur le rapport de Charles Goerens, au nom de la commission des affaires étrangères, sur une stratégie extérieure de l’Union de lutte contre les mariages précoces et forcés – prochaines étapes (2017/2275(INI)) (A8-0187/2018).

  Charles Goerens, rapporteur. – Madame la Présidente, j’ai l’honneur de présenter à cette assemblée un rapport intitulé «Vers une stratégie extérieure de l’Union de lutte contre les mariages précoces et forcés – prochaines étapes».

La problématique qui fait l’objet de notre débat aujourd’hui concerne un très grand nombre de personnes. Plus de 700 millions de personnes à travers le monde sont concernées par cette problématique. Il s’agit de filles et de garçons mais, avant tout, de jeunes filles qui sont victimes d’une pratique qui est absolument inhumaine et condamnable. Le Parlement européen n’a jusqu’à présent ménagé aucun effort pour condamner ces pratiques.

Au Soudan, par exemple, l’âge nuptial est de 10 ans. À partir de 10 ans, les jeunes filles qui sont forcées de se marier ne peuvent pas s’y opposer et cela donne lieu à des situations intenables. Le quotidien belge Le Soir a encore relaté récemment l’histoire extrêmement triste d’une fille qui a été victime d’un mariage forcé.

Quel est le rôle du Parlement européen dans toute cette problématique? Nous avons itérativement thématisé, disais-je, cette problématique. Ce n’est pas le nombre de constats qui manque. Tout a été dit, mais peut-être pas encore par tout le monde. Ce qu’il faut faire, c’est définir une stratégie, une approche pour faire bouger les lignes en la matière. Or, pour développer une stratégie, il faut fixer un cap. Par conséquent, premièrement, il faut avoir une vision claire sur les objectifs et, deuxièmement, définir le chemin pour y arriver. Il faut donc s’entendre sur des moyens appropriés à mettre en place pour lutter contre ce fléau.

Les objectifs sont les suivants: nous voulons que l’âge nuptial soit porté à 18 ans, et pas seulement dans un pays ou dans deux ou encore dans l’Union européenne, mais partout dans le monde. C’est une norme universelle. Elle a été consacrée par nombre de textes internationaux, elle a été consacrée par nombre de conventions qui sont déjà ratifiées ou en voie de l’être. Il faut faire de l’âge minimum pour accéder au mariage une obligation juridique et cette obligation juridique devient une obligation de résultat. Il faut engager une politique axée sur les résultats. Il ne suffit pas d’avoir inscrit dans la loi une interdiction de se marier en-deçà de l’âge de 18 ans, il faut faire en sorte que cette obligation devienne réalité.

Parlons maintenant des moyens. Dans les pays qui connaissent une pauvreté extrême, l’éducation est souvent le parent pauvre des politiques publiques. C’est dans le cadre d’un dialogue politique que la Commission et le Service européen pour l’action extérieure devraient aborder ces thématiques. La Commission et, bien entendu, les États membres qui véhiculent l’essentiel des moyens mis à la disposition de la politique d’aide au développement. Il faut soutenir les acteurs institutionnels tels que l’Unicef et le Fnuap (fonds des Nations unies pour les populations) qui ont une expérience et une expertise considérables en la matière. Puis, je demanderai aussi à la Commission de faire de la lutte contre les mariages précoces et forcés un élément de conditionnalité.

Parlons aussi de la crédibilité. Nous devons nous assurer que tous les États membres de l’Union européenne fixent aussi cette norme du mariage à 18 ans. Nous demandons à la Commission – c’est aussi une demande de notre commission et du rapport que j’ai l’honneur de vous présenter – de consacrer l’une des prochaines années à cette problématique, en déclarant une année européenne de lutte contre les mariage forcés et précoces. Enfin, il importe de combler les lacunes créées par le Global gag rule. Je sais que la Commission est sur la bonne voie, elle peut compter sur tout notre appui.

Pour conclure, il faut une Union européenne forte et déterminée, des États partenaires forts, ne pas lésiner sur les moyens, fixer un cap et, au plus tard, il faudrait avoir des résultats extrêmement réconfortants et tangibles en 2030, année où les objectifs de développement durable devraient être concrétisés.

  Marianne Thyssen, Member of the Commission. – Madam President, I would first like to thank the rapporteur, Charles Goerens, for his excellent report. Protecting girls is, first and foremost, about upholding European values and respect for human rights. It is also about enforcing European law and respecting the Charter of Fundamental Rights and international human rights law. Combating child marriage requires a comprehensive strategy, and the European Union has already stepped up its external work and the recommendations included in the report are of vital importance to us and will help us in achieving even more.

Ending child marriage has been identified as a priority for the European Union action plan on human rights and democracy. We have translated this priority through the EU Gender Action Plan (GAP II) with a strong emphasis on the empowerment of girls. The revised European Union guidelines for the promotion and protection of the rights of the child highlight the fact that raising awareness and promoting gender equality is a priority for European engagement with partner countries.

The human rights and democracy country strategies for the 2016—2020 period include children’s rights as one of the main priorities, some of them focused on combating child marriage. The report also mentions children on the move as particularly vulnerable. The communication on the protection of children in migration, adopted in April 2017, proposes actions to protect these children, including girls who are at risk of forced marriage.

I want to reassure you that early and forced marriage is being regularly raised in political and human rights dialogues with the EU’s partner countries and we will continue to do so, as requested in the report. The report also calls for the Union to work together with the relevant UN agencies – and the rapporteur also requested this here – on this subject.

This cooperation is already ongoing and will continue. It has to continue. For instance, the European Union has contributed EUR 6 million to the UNFPA—UNICEF Global Programme to Accelerate Action to End Child Marriage. The programme targets communities from a group of 12 countries and focuses on education, access to health care, strengthening enforcement mechanisms, girls’ empowerment and changing social norms. In September 2017, the European Union and the United Nations launched a historic initiative, branded the ‘Spotlight Initiative’, to end violence against women and girls with an investment of EUR 500 million.

Ending early and forced marriage is as much about adopting protective legislation as about enhancing access to education. The report refers many times to the lack of education, not only as a root cause, but also as a consequence of early marriage.

We share this view. The communication on education and emergencies and protracted crises, adopted in May 2018, reiterates the protective role of education, recognising that children who are not in school are exposed to forced marriage and early pregnancy, among many other risks. The Union will markedly focus its education in emergency actions to bring children back into school, those forcibly displaced or those belonging to vulnerable and disadvantaged groups and to quality education.

We are also doing our homework inside the Union. We are combating early and forced marriage through promoting sustainable social change, through our rights, equality and citizenship programme. The Union has co—financed the setting up of a European network on guardianship for unaccompanied children. This network will allow developing guardianship capacity as well as the prevention of, and responses to, early and forced marriage. In October last year, we had a Girls Summit in Brussels, which brought together many young girls from around the world. The aim was to put the spotlight on what needs to be done to ensure their rights are respected, protected and of course enforced.

I would like to conclude by sharing some key messages from this summit that I find very valid in the context of today’s debate. Firstly, child marriage is not only a violation of girls’ rights, but also a form of violence and discrimination against women and girls and, as such, is absolutely unacceptable. Secondly, to end this practice it is of the utmost importance that girls and women have a voice at all levels of society.

We therefore very much share the views expressed in the report that the active participation of girls in society is an active way of preventing child marriage. Thirdly, as the report says, it is urgent to inform and educate men and boys. Men and boys must take full responsibility to challenge discriminatory social norms and gender stereotypes and foster positive norms of gender equality, non—violence and respect. Finally, education is the main channel through which sustainable progress in ending child marriage will be achieved. Congratulations again to the rapporteur.

  Daniela Aiuto, relatrice per parere della commissione per i diritti della donna e l'uguaglianza di genere. – Signora Presidente, onorevoli colleghi, la commissione FEMM, che oggi rappresento in qualità di relatrice per parere, si è già varie volte battuta per fermare lo scempio dei matrimoni forzati, in particolare dei matrimoni infantili che affliggono tutti i paesi del mondo, compresi gli Stati membri dell'Unione.

Quando ho appreso della decisione della commissione AFET di voler proporre una risoluzione alla Commissione per evidenziare il problema sono stata lieta di sapere che le nostre richieste, in quanto commissione FEMM, siano state finalmente ascoltate. Non siamo più soli nel combattere questa violazione dei diritti umani, come si evince anche dalla risoluzione che è stata presentata in quest'Aula.

Da quanto evidenziato in una recente relazione dell'UNICEF, infatti, se le cifre di tale problema continueranno a crescere ai ritmi attuali, potremmo avere in tutto il mondo 1,2 miliardi di matrimoni infantili entro il 2050. Nella stessa relazione si evince come i matrimoni infantili condizionano in maniera negativa e permanente sia la salute fisica che la salute mentale delle vittime che, lo ricordiamo ancora una volta, sono solo delle bambine.

Il matrimonio forzato precoce infantile costituisce una grave violazione dei diritti umani e ciò viene sancito da diverse convenzioni internazionali e dalla stessa Unione europea, come riporta la relazione, in quanto essa stessa è il principale attore in materia di sviluppo globale e diritti umani e deve svolgere un ruolo di primo piano nel fermare concretamente tali reati, soprattutto tramite il quadro della sua politica estera e delle sue politiche di cooperazione allo sviluppo con paesi terzi.

  Bogdan Brunon Wenta, on behalf of the PPE Group. – Madam President, forced marriages leave an impact on girls and boys, and go against the fundamental rights and the dignity of children. We must be clear in our words: early and forced marriages are a form of violence. We must remember that these kinds of marriage lead to serious consequences, including limiting opportunities to study for those concerned, as education is often ceased abruptly, and, in some cases, to high mortality rates among mothers.

We need to ensure that forced marriages are not conducted on European territory among migrants or person of non-European citizenship. If we want to strengthen the fight against these forms of marriage, we need to invest in education and empowerment, especially for women and girls, and provide support to victims. Boys and men in third countries need to be given more information and education in order to develop support for measures that respect human rights, including those of children and women.

We need the EU, as an institution which has a global role on human rights, to also take a central role in the fight against early and forced marriages. The EU and its Member States must cooperate with the competent authorities, including those in third countries, and provide training and technical assistance so as to achieve legislation against this practice and ensure it is enforced.

  Liliana Rodrigues, em nome do Grupo S&D. – Senhora Presidente, Senhora Comissária, todos nós conhecemos a história de Noyud Ali, uma menina do Iémen divorciada aos dez anos de idade. Aproveitou uma saída de casa, meteu-se num táxi e pediu que a levasse a um tribunal. Perante o juiz disse: quero o divórcio.

Noyud casou contra a sua vontade. Foi levada pelo marido e, na mesma noite, violada por esse homem, diz a menina, que cheirava a cebola. Pediu ajuda à sogra. Essa ajuda nunca veio. Tinha início a sua vida de casada a trabalhar na cozinha durante o dia e a ser espancada e violada à noite.

Esta é uma história semelhante às de 15 milhões de meninas que são obrigadas a casar todos os anos. São 28 por minuto. Em 193 países, 144 não proíbem o casamento infantil. É preciso proibir e criminalizar, é preciso educar. É preciso saber se os programas de prevenção são eficazes. Por fim, é preciso refletirmos se o financiamento europeu para a ação externa deve depender ou não de medidas concretas e mensuráveis de combate ao casamento infantil. A nossa mensagem só pode ser uma: o casamento infantil é inaceitável.

  Nosheena Mobarik, on behalf of the ECR Group. – Madam President, despite considerable progress in advancing gender equality around the world, including through landmark agreements such as the Beijing Declaration and Platform for Action, women around the world are still vulnerable to all kinds of abuse, and in too many places their human rights are completely disregarded.

It is cultural norms and practices which allow this. Child early and forced marriage is a cultural, not a religious, practice, and while strict legal enforcement and education may eventually bring about a changed mindset, it will be a slow, gradual progression before we are rid of these practices. And despite there being many international and legal instruments already available to governments to fight these malpractices, we have a long way to go to eliminate child early and forced marriage. Our efforts must continue and be accelerated. I therefore fully support the recommendations made by MEP Goerens in his report.

Much consideration was given to demands for a minimum age of marriage. I accept that in some Member States you can marry at 16 with parental consent. However, I believe it is right we consider a higher age so that vulnerable young people, particularly girls, are sufficiently mature and are able to stand up for their rights and resist social pressure.

The ECR is committed to gender equality and the empowerment of women and girls through different means, focusing on achieving protection for women and girls from physical and sexual violence, as well as giving them opportunities in education, employment and in society in general.

  Ángela Vallina, en nombre del Grupo GUE/NGL. – Señora presidenta, en el espacio de pocos meses volvemos a tratar en este Parlamento el asunto de los matrimonios forzados, práctica que hay que recordar que también se da en la Unión Europea y en los Estados Unidos.

Como ya hemos mencionado más de una vez, la protección de los menores está en nuestros tratados, y nuestra política exterior debe seguir a rajatabla dichas normas.

Una vez más, hacemos un llamamiento a la coherencia, a la aplicación efectiva de las normas y los acuerdos internacionales, como el Convenio de Estambul y la Agenda 2030 de las Naciones Unidas, y a que nuestras políticas de desarrollo en terceros países y las políticas comerciales converjan hacia el respeto de los derechos humanos, en especial de las mujeres, las niñas y los niños.

Por ello, vamos a votar a favor de este informe. Estamos a favor de la erradicación del matrimonio precoz también aquí, en la Unión Europea, y en cualquier parte del mundo, porque son prácticas que suponen formas de esclavitud que aún persisten en este mundo.

De esta manera, estaremos además cumpliendo con el artículo 37 del Convenio de Estambul.

Tolerancia cero, señora comisaria, a cualquier tipo de imposición de una cultura patriarcal.

  Klaus Buchner, im Namen der Verts/ALE-Fraktion. – Frau Präsidentin! Kinder- und Zwangsehen sind mit der massenhaften Migration der letzten Jahre in Europa zu einem Problem geworden. Vor allem die jungen Frauen sind oft erst 12 oder 13 Jahre alt. Von einer freiwilligen, bewussten Entscheidung für eine Ehe kann in diesem Alter überhaupt keine Rede sein. Wie sollen wir damit umgehen? Sollen wir solche Ehen als Recht aus einem anderen Kulturkreis anerkennen? Nein, niemals! Denn von einer freiwillig eingegangenen Ehe kann keine Rede sein. Ich habe das selbst bei einer Afrikanerin erlebt, die mit 14 Jahren an einen etwa 60-jährigen Mann verheiratet wurde und sehr bald eine Tochter bekam. Sie wollte aus dieser Ehe fliehen und wurde sowohl von ihrem Mann als auch von der Familie mit dem Tod bedroht, weil sie Schande über die Familie gebracht hat.

Deshalb bin ich froh, dass wir in der neuen Entschließung, an der ich mitgearbeitet habe, fordern: In Europa sollen Ehen nur anerkannt werden, wenn beide Partner über 18 Jahre alt sind. Leider ist das kein Gesetz. Die EU kann nur eine Empfehlung an die Mitgliedstaaten richten. Trotzdem ist es damit wahrscheinlicher geworden, dass beide Ehepartner freiwillig und bewusst die Beziehung eingehen und dass ihre Kinder eine angemessene Erziehung von erwachsenen Eltern erhalten.

Die Entschließung enthält auch eine Empfehlung an die Mitgliedstaaten, den Frauen eine Aufenthaltsgenehmigung zu geben, die unabhängig von der ihrer Ehemänner ist. Eigentlich eine Selbstverständlichkeit, aber trotzdem oft nicht erfüllt.

  Jörg Meuthen, im Namen der EFDD-Fraktion. – Frau Präsidentin! Mittelalterliche Zwangs- und Kinderehen waren hier längst überwunden. Frau Merkels unkontrollierte Masseneinwanderung hat sie zigtausendfach nach Europa gebracht. Diese Form der Gewalt gegenüber Minderjährigen wollen wir nicht. Sie bringt unermessliches Leid. Doch in Parallelgesellschaften ist das an der Tagesordnung. Ursache dieser Praxis ist – nennen wir das Übel beim Namen – die Scharia. Nicht Armut und Patriarchat sind die Ursachen von Zwangs- und Kinderehen, sondern in erster Linie der Islam. Der Bericht verpasst die Chance, dies klar zu benennen.

Es ist richtig, Zwangs- und Kinderehen außenpolitisch entgegenzuwirken. Aber wir müssen diese Verbrechen auch bei uns sanktionieren. Die Verheiratung einer Neunjährigen ist Kindesmissbrauch, nichts sonst. Wer das tut, muss strafrechtlich verfolgt werden. Anders als im Bericht behauptet, sind dafür nicht nur Männer verantwortlich, auch Frauen, Mütter wirken aktiv an der Zwangsverheiratung ihrer Kinder mit. All das muss aufhören. Wir müssen dem klare rechtliche Grenzen setzen.

  Franz Obermayr, im Namen der ENF-Fraktion. – Frau Präsidentin! Wenn der Berichterstatter Früh- und Zwangsehen als Menschenrechtsverletzungen und Ausbeutung beschreibt, kann man ihm ja nur zustimmen. Leider ist die Forderung nach Ratifizierung diverser Übereinkommen wie auch des Übereinkommens von Istanbul nicht die Lösung bei dieser Problematik. Das Beispiel Türkei zeigt deutlich: Zwangsehen sind dort offiziell zwar verboten, aber die islamisch-religiöse Ehe ab zwölf nicht. Zwölfjährige Mädchen stehen da oft vor der Wahl, sich für eine Zwangsverheiratung zu entscheiden oder von der Familie verstoßen zu werden. Laut Unicef geht in der Türkei beinahe jede dritte Frau mit weniger als achtzehn Jahren in die Ehe.

Die in Istanbul geborene Soziologin Necla Kelek schätzt, dass es 2017 in Berlin rund 500 Zwangsehen gab, und ist auch der Meinung, dass die Tradition der Zwangsverheiratung auch bei uns Alltag wird. Wir dürfen daher in der Union die Augen nicht verschließen. Denn während wir diese Problematik sehr wohl diskutieren und thematisieren, eskaliert mitten unter uns eine islamische Parallelwelt, in der Scharia-basiertes Unrecht gegen Minderjährige real auch gelebt wird.

  Edouard Martin (S&D). – Madame la Présidente, le mariage des enfants est évidemment une violation des droits de l’homme. La question est de savoir comment l’Europe peut aider à y remédier. Il faudrait peut-être que nous nous interrogions sur nos propres politiques extérieures. Je constate avec beaucoup d’amertume que dans nos différents accords, il n’y a jamais, ou très rarement, de chapitres mettant en avant l’égalité entre les femmes et les hommes, les droits des enfants, etc. Je peux pourtant vous assurer qu’ici même, lors de notre dernière session dans le cadre de l’accord de partenariat avec le Chili, nous avons enfin pour la première fois, inscrit un chapitre sur l’égalité entre les hommes et les femmes.

C’est grâce à la généralisation de ce type de conditionnalité que l’Europe pourra aider à y mettre un terme. Le problème ne sera pas éradiqué du jour au lendemain, mais c’est ainsi qu’il faut agir. C’est la voie à suivre.

  Marek Jurek (ECR). – Pani Przewodnicząca! Panie i Panowie Posłowie! Rozmawiamy o kwestii małżeństw zewnętrznych w ramach zewnętrznej polityki Unii Europejskiej, a tymczasem nawet na tej sali słyszymy, że jest to problem, który istnieje u nas w Europie – ale nie w krajach, które nie przyjmują genderowej konwencji stambulskiej, ale w krajach które ją przyjęły.

Dlatego, proszę Państwa, ważne są nie postulaty, ale zdecydowane działania. Międzynarodowa Konwencja Praw Rodziny, której projekt proponujemy w Polsce, zakłada nieważność jakiegokolwiek przymusowego małżeństwa, gdziekolwiek byłoby zawarte.

Jeszcze jedna uwaga na temat tego szczególnego tekstu – w tym tekście ani razu nie pada słowo Islam, natomiast trzykrotnie atakowane są Stany Zjednoczone. Za co? Za politykę obrony najsłabszych w ramach odmowy finansowania międzynarodowych organizacji aborcyjnych. Przemyślmy fundamenty moralne, na których stoi nasza polityka, bo ich brak jest głównym źródłem problemów z którymi mamy do czynienia.

  Jordi Solé (Verts/ALE). – Madam President, knowing that child early and forced marriages, despite being a clear violation of human rights, are still ingrained in some cultures and traditions, the European Union’s external strategy against them should have as central points education and cooperation with communities. Involving and educating community leaders, especially women, is fundamental in changing attitudes and behaviour concerning child marriages.

Education plays an essential role in order to foster social change and empower women and girls so that they can escape from discrimination and from decisions which they do not take and so they can fulfil their potential. Increasing the number of women in decision-making positions can help promote prevention and eradication policies for combating all kinds of violence against women, including forced and child marriages. However, we should not forget that the role of men is key in addressing gender stereotypes. Therefore, fighting against child and forced marriages involves fighting against patriarchal societies.

  Caterina Chinnici (S&D). – Signora Presidente, onorevoli colleghi, i matrimoni infantili precoci e forzati costituiscono una delle più gravi violazioni dei diritti umani e causano spesso danni di lungo corso sulla salute fisica e mentale delle vittime di tale pratica. Il fenomeno, sanzionato dalla convenzione di Istanbul, non colpisce unicamente i paesi terzi ma risulta in aumento anche in Europa: secondo i dati UNICEF sono oggi infatti 750 milioni le donne, nel mondo, che si sono sposate prima dei diciotto anni.

L'Unione europea non può rimanere indifferente rispetto a tale pratica, che ancora oggi priva troppe bambine dei diritti essenziali dell'infanzia e di una serena crescita psicofisica. Per porre fine al fenomeno, sia dentro che fuori l'Unione, è necessario intanto che negli Stati membri venga uniformemente fissata l'età minima per contrarre matrimonio a diciotto anni e che vengano adottate misure amministrative, legali e finanziarie per garantirne l'effettiva applicazione.

Ma per eradicare le cause più profonde di tale fenomeno nei paesi terzi occorre anche investire in azioni di sensibilizzazione, istruzione e parità di genere.

  Ruža Tomašić (ECR). – Poštovana predsjedavajuća, rani prisilni brakovi predstavljaju grubo kršenje ljudskih prava djece i maloljetnika. Svaka strategija protiv ovakvih oblika spolnog i obiteljskog nasilja koja teži biti vjerodostojna mora podrazumijevati nultu toleranciju na takve prakse na tlu Europe.

Podržavam izvjestiteljev poziv državama članicama koje toleriraju brakove maloljetnika da utvrde jedinstvenu dob od 18 godina kao minimalnu dob za sklapanje braka. Svaku prisilu treba osuditi i onemogućiti, ali čak i kad se radi o dobrovoljnom stupanju maloljetnika u brak smatram da je riječ o lošoj pojavi.

Za preuzimanje odgovornosti i obveza koje brak sa sobom nosi potrebna je doza fizičke i psihičke zrelosti koju maloljetnici u velikim slučajevima nemaju.

  Cécile Kashetu Kyenge (S&D). – Signora Presidente, onorevoli colleghi, il dramma delle spose bambine è ancora una piaga che trascende i paesi, le culture e le religioni. Un dramma che ha sempre un denominatore comune, che trova radici nella povertà, nella disuguaglianza di genere, nella mancanza di istruzione, di opportunità sociali ed economiche. Il matrimonio infantile forzato e precoce non offre mai protezione ai minori costretti a contrarlo: al contrario, costituisce una grave violazione dei diritti umani, in particolare dei diritti delle donne.

Siamo noi, l'Unione europea, in quanto principale attore in materia di sviluppo globale dei diritti umani, a dover svolgere un ruolo di primo piano per eliminare questa forma inaudita di violenza contro le donne.

Lavoriamo quindi per creare uno spazio per un dialogo rispettoso con i leader delle comunità dei paesi terzi, per promuovere azioni trasversali e governative giuridiche, sociali e diplomatiche finalizzate alla prevenzione dei matrimoni forzati. Diamo prova della nostra leadership in materia di promozione dei diritti delle donne e dei diritti umani.

  Sirpa Pietikäinen (PPE). – Madam President, first of all I would like to thank the rapporteurs and congratulate them on the excellent report. Secondly, I would like to thank Commissioner Thyssen and the Commission for a very clear answer and for their activities in this field.

This problem of forced – and unforced – marriages of underage girls and boys shows clearly that we need full competence of the Commission in the field of constitutional rights, because if we do not have effective tools, both to address violence against women and girls in our own Member States and to act on a strong basis in our third-country cooperation, we cannot be as effective as we should be.

Secondly, I hope that, in our development cooperation and bilateral cooperation, we can increase substantially our aid for education on sexual and reproductive rights for girls, because this is an area in which, globally, aid has been cut the most.

  Maria Gabriela Zoană (S&D). – Madam President, every seven seconds there is a girl under 15 years old getting married in the world, often to a man much older than herself. Early and forced marriages seriously violate human rights and, often, girls’ rights to education, increase the likelihood of domestic violence and have serious consequences on the sexual and reproductive health of women and girls.

Early and forced marriages exist in both third countries and within the EU. Some Member States have laws allowing children younger than 18 to marry under certain circumstances. In the current refugee crisis, it happens along the migration routes and in refugee camps. We should make legislative efforts to end early and forced marriages, at both EU and Member State level. Therefore all Member States should accelerate the ratification of the Istanbul Convention and see that it is fully implemented without delay.

  Νότης Μαριάς (ECR). – Κυρία Πρόεδρε, οι αναγκαστικοί γάμοι πολλαπλασιάζονται στις Ηνωμένες Πολιτείες και κυρίως στην Ευρωπαϊκή Ένωση, κι αυτό συμβαίνει διότι πλέον, με τη μαζική μετανάστευση πληθυσμών εδώ στην Ευρωπαϊκή Ένωση, υπάρχουν πληθυσμοί που με συγκεκριμένες πολιτισμικές καταβολές, αλλά βεβαίως και με θρησκευτικές ρίζες και αναφορές στο ίδιο το Ισλάμ, επιβάλλουν πλέον τους αναγκαστικούς γάμους – μια κατάσταση που παραβιάζει τα ανθρώπινα δικαιώματα, μια κατάσταση που παραβιάζει τα δικαιώματα των παιδιών και πρέπει να απαγορευτεί αυτή η διαδικασία πάραυτα. Φυσικά, παραβιάζεται και η Σύμβαση της Κωνσταντινούπολης, η Σύμβαση του ΟΗΕ για την προστασία των δικαιωμάτων των παιδιών.

Οφείλουμε, λοιπόν, να έχουμε μια νομοθεσία στην Ευρωπαϊκή Ένωση για να απαγορεύονται οι καταναγκαστικοί πλέον γάμοι – αναγκαστικοί λέγονται, αλλά καταναγκαστικοί είναι στην πράξη, διότι επιβάλλονται – και φυσικά να επενδυθούν χρήματα στις χώρες που ακολουθούν αυτό το φαινόμενο, προκειμένου να υπάρξει μία στήριξη σε επίπεδο πολιτισμικό και, κυρίως, να περάσουμε τις απόψεις που πρέπει να ισχύσουν.

  Kateřina Konečná (GUE/NGL). – Paní předsedající, k dnešnímu dni bylo více než 750 milionů žen provdáno před dovršením věku osmnácti let a 250 milionů z nich bylo provdáno před patnáctým rokem svého věku. To jsou opravdu děsivá čísla, která dokládají závažné porušování lidských práv. Problémem však je, že zákonný zákaz dětských sňatků, sňatků v raném věku a nucených sňatků by sám o sobě nezaručil konec těchto sňatků. Je zapotřebí co nejširší mezinárodní spolupráce, abychom byli svědky konce této hanebné praxe.

EU by nyní měla tlačit na to, aby jak v členských státech Evropské unie, tak i ve třetích zemích se jasně uzákonilo osmnáct let jako jednotná minimální věková hranice pro vstup do manželství. Jsem přesvědčena, že je povinností Evropské unie jasně odsoudit tyto sňatky a postupovat v tomto ohledu nekompromisně jak v EU, tak i na mezinárodním poli. I my v Evropské unii máme dostatek nástrojů, abychom třetí země ovlivňovali, pojďme tak konat i v této věci.

  Ignazio Corrao (EFDD). – Signora Presidente, onorevoli colleghi, quando sentiamo parlare di matrimoni forzati, siamo portati a credere che si tratti di qualcosa di remoto nel tempo e nello spazio. Tristemente, si tratta invece di un problema più che mai attuale. Ciò che è più triste è che si tratta di una gravissima violazione dei diritti umani che a volte si compie proprio sotto i nostri occhi, qui in Europa.

Alcuni giornali, ad esempio, ne hanno denunciato la presenza anche in una delle città in cui sono cresciuto, a Palermo, dove adolescenti comprese tra i 13 e i 17 anni, originarie principalmente di Bangladesh, Pakistan, India e Sri Lanka, sono letteralmente scomparse da scuola, da un giorno all'altro, per essere rispedite dalle loro famiglie nei loro paesi d'origine, e là sposare l'uomo che era stato salto per loro e che loro non avevano mai visto.

Ciò dimostra che la lotta ai matrimoni forzati deve essere combattuta su tutti i fronti, all'interno e all'esterno al territorio europeo, e dalle istituzioni a tutti i livelli, a partire da chi negozia i trattati commerciali con questi paesi e ha il dovere di condizionare qualsiasi beneficio al raggiungimento di standard minimi in questo importantissimo settore.

  Γεώργιος Επιτήδειος (NI). – Κυρία Πρόεδρε, η υποχρέωση που επιβάλλουν ορισμένα κράτη της Αφρικής και της Ασίας, κυρίως ισλαμικά, στα κορίτσια, να παντρεύονται σε νεαρή ηλικία, παιδική θα έλεγα ηλικία, αποτελεί πραγματικό στίγμα για τη σύγχρονη πολιτισμένη κοινωνία και την ανθρωπότητα. Δεν είναι μόνο παραβίαση ανθρωπίνων δικαιωμάτων, δεν είναι μόνο άσκηση βίας, είναι κάτι ακόμη χειρότερο, είναι ωμή και βάρβαρη παραβίαση της ανθρώπινης φύσεως. Κορίτσια των οποίων ο οργανισμός και το σώμα δεν έχουν ακόμη διαμορφωθεί, υποχρεώνονται να συμπεριφέρονται ως ενήλικες.

Όσα νομικά μέτρα και να λάβουμε, όσες συστάσεις και αν κάνουμε, ουδέποτε θα μπορέσουμε να επουλώσουμε τις σωματικές και κυρίως τις ψυχολογικές προκλήσεις και πλήγματα τα οποία έχουν δημιουργηθεί στην καρδιά αυτών των παιδιών. Η Ευρωπαϊκή Ένωση οφείλει να ενεργήσει αποτελεσματικά, οφείλει να αναθεωρήσει τις σχέσεις με κράτη τα οποία εφαρμόζουν αυτή την αναχρονιστική μέθοδο και κυρίως να μην επιτρέψει να δημιουργηθεί αυτή η κατάσταση στην ίδια της την περιοχή.

  Michaela Šojdrová (PPE). – Paní předsedající, já myslím, že všichni považujeme nucené sňatky za pošlapávání lidských práv a lidské důstojnosti. Dovídáme se o nárůstu nucených sňatků zejména v zemích, kde je nyní válka a humanitární krize. Například víme, že v Sýrii před válkou existovalo zhruba 13 % těchto sňatků a v poslední době stouplo toto procento až na 40 %.

Co je důvodem? Nucené sňatky jsou způsobeny jednak dlouhou tradicí, částečně náboženskou, ale i životními podmínkami. Sňatek svých dětí, zejména dcer, rodiče považují za řešení těžkých sociálních podmínek nebo způsob ochrany před ještě horšími formami násilí. Pro mnohé dívky to znamená ukončení vzdělání, domácí násilí, psychické problémy a také ještě další komplikace, třeba při porodu.

Zvyky i okolnosti mohou být však silnější než zákon a tak i tam, kde byly zákonem zakázány tyto sňatky, se jejich počet snížil jen minimálně. To znamená větší výchova a lepší životní podmínky jsou řešením.

  Julie Ward (S&D). – Madam President, child, early and forced marriages are a form of gender-based violence and a violation of the rights of the child. Apart from direct psychological and physical consequences, early and forced marriages have a dramatic negative effect on a child’s right to education.

As a feminist and a children’s rights campaigner, I fully support the report’s call for all Member States to ratify the Istanbul Convention, which is the most comprehensive legal instrument that we have to combat all forms of gender-based violence. Eleven Member States, including the UK, still have not ratified this Convention. Shame on them!

Regarding neighbouring countries, let’s recall that, in autumn 2016, President Erdogan’s ruling AKP party in Turkey tried to introduce a law that would have allowed convicted rapists to marry their child victims, thereby legalising paedophilia. And shame on Theresa May for entertaining such an appalling regime during a recent state visit to the UK!

Thank goodness for the values and decency of the EU, which stands against all forms of violence against women and girls.

  Seán Kelly (PPE). – Madam President, I was delighted with this debate this evening because all sides of the House emphasised the absolute horror of forced marriages. Only yesterday I was reading about an 11-year-old girl who was forced to marry a 51-year-old man. And when you think of the fact that, even for ourselves, if we have to spend half an hour or an hour with people we do not get on well with, it can be trying, can you imagine what it is like for a young girl forced, as MEPs mentioned, to become an adult almost overnight and, at the same time, only a child?

It’s horrible and it’s a cultural, religious – call it what you like – phenomenon that has been going on for too long. We really have to ensure, first of all, that we end any such practices that may be happening in Europe, and do everything we can to end them internationally, because this is an absolute scandal in the modern era. Every child is entitled to a life and every girl should be able to grow up and marry in her own time.

  Marianne Thyssen, Member of the Commission. – Madam President, from this debate I conclude that we all share a common interest in using European diplomatic power, and all European instruments to their full potential, to protect girls from early and forced marriage.

We now have a unique opportunity with Agenda 2030 for Sustainable Development and its specific target 5.3 on child marriage. To succeed and meet the 2030 Agenda target, we need a stronger partnership, we need more and better laws, more action plans, budget and accountability mechanisms and more data collection. We also need to see more comprehensive approaches, addressing all the various patterns behind child marriage. We need, too, more communication of positive stories on what works and also on what does not work. We see great potential in a European year dedicated to the fight against child, early and forced marriages, and we will ask our services to evaluate this idea. What is absolutely necessary and clear is that we need more funding. An urgent scaling-up is required as current investments are not enough.

Lastly, we need more long-term commitment. We are talking here about the devastating consequences of child marriage on the lifetime of girls and on society.

Let me thank the honourable Members for this useful exchange and specifically the rapporteur for his good report.

  Charles Goerens, rapporteur. – Madame la Présidente, tout d’abord, je suis extrêmement satisfait de la qualité de cette discussion, comme vient de le souligner d’ailleurs à juste titre Madame la commissaire, que je remercie pour ses propos et commentaires absolument pertinents et très appropriés. Elle témoigne ainsi de la volonté de la Commission de prendre à bras le corps ce problème et nous avons pris soin de donner une impulsion politique à ce problème.

Ensuite, les États membres de l’Union européenne doivent être exemplaires. Ils doivent inscrire l’autorisation de se marier à 18 ans dans leur législation. Il s’agit d’une obligation de résultat, aucune circonstance atténuante ne permet de faire l’impasse sur cette obligation.

De plus, l’ancrage d’une pratique criminelle qui se reproduit d’année en année, de génération en génération, ne justifie en rien son maintien. Là aussi, il n’y a aucune circonstance atténuante pour excuser ou justifier un tant soit peu la pérennisation d’une pratique qui est absolument crapuleuse et criminelle. Ce n’est pas l’ancrage d’une telle pratique dans la religion ni dans la tradition culturelle qui le justifierait, parce qu’à la rigueur on devrait finir par accepter le cannibalisme au motif que cette pratique aussi a été ancrée dans certaines traditions.

Donc, soyons absolument clairs afin qu’il n’y ait pas le moindre malentendu à ce propos, nous en tant qu’Union européenne, en tant qu’États membres de l’Union européenne, nous devons être absolument déterminés pour montrer le bon exemple et en faire un élément de conditionnalité dans nos relations extérieures. Que l’on ne vienne pas nous dire que cette interdiction relèverait d’une juridiction ou d’un ensemble de comportements des pays occidentaux. La convention universelle des droits de l’homme est universelle. Toute la législation sur la protection des droits de l’enfant est universelle. Donc, je crois que nous devons agir à l’échelle globale. Étant donné que la Commission fait sienne la volonté d’influer sur le reste du monde, je crois que nous ne pouvons pas faire l’impasse sur ce point.

Enfin, j’aurais souhaité voir la Commission se prononcer sur notre requête de consacrer l’une des prochaines années à cette problématique. Je sais que nous sommes en concurrence avec d’autres, néanmoins, étant donné l’envergure qu’a pris ce problème et l’envergure supplémentaire qu’il risque d’avoir à l’avenir, étant donné la forte croissance démographique dans certains pays, je crois que déclarer une année européenne de lutte contre les mariages forcés et les mariages des mineurs serait tout à fait à la hauteur de nos ambitions.

  María Teresa Giménez Barbat (ALDE), por escrito. – Europa no se construirá sobre la base de valores débiles que, bajo una apariencia de respeto por la diversidad cultural y religiosa, acomodan tradiciones nocivas que dañan la dignidad humana y son un serio obstáculo al desarrollo. A través de su estrategia exterior contra los matrimonios precoces y forzados, la Unión reafirma su compromiso con valores universales, pese a reconocer que la mera prohibición legal de los matrimonios forzados no garantiza por sí sola el fin de estas prácticas, debido a la complejidad de factores sociales, políticos, ecológicos y económicos implicados. Quiero subrayar que, aunque estas prácticas afectan desproporcionadamente a las niñas en todo el mundo, los niños también son víctimas, como reconoce el informe: hasta la fecha, 750 millones de niñas y 156 millones de niños se han casado antes de cumplir 18 años, mientras que 250 millones de niñas y 25 millones de niños lo hicieron antes de los 15. La celebración de matrimonios infantiles contraviene las declaraciones sobre los derechos del niño, el Convenio de Estambul para combatir la violencia contra las mujeres, y tradiciones europeas que salvaguardan el libre consentimiento de los cónyuges. La Unión debe afirmar el respeto por este valor dentro y fuera de sus fronteras.

  Ivan Jakovčić (ALDE), napisan. – Dječji su brakovi globalni problem koji nadilazi zemlje, kulture i religije. Brojke su činjenice: danas je na svijetu više od 750 milijuna žena koje su udane prije navršene 18. godine. Rani i prisilni brakovi imaju krajnje negativne posljedice na fizičko i mentalno zdravlje te osobni razvoj dotičnih osoba kao i na djecu rođenu u takvim brakovima te društvo u cjelini.

U potpunosti podržavam ovo Izvješće ususret vanjskoj strategiji EU-a protiv ranih i prisilnih brakova – sljedeći koraci, s obzirom da je iskorjenjivanje tih praksi, koje predstavljaju ozbiljno kršenje ljudskih prava, prava na ravnopravnost, neovisnost i tjelesni integritet, zacrtano kao jedan od prioriteta vanjskog djelovanja EU-a u području promicanja prava žena i ljudskih prava.

Ovo Izvješće, koje podržavam, napominje da neke države članice EU-a dopuštaju sklapanje braka sa 16 godina uz suglasnost roditelja, stoga se poziva zakonodavce, kako u državama EU-a tako i u trećim zemljama, da utvrde jedinstvenu dob od 18 godina kao minimalnu dob za sklapanje braka i da uvedu potrebne administrativne, pravosudne i financijske mjere kako bi izvršili taj zahtjev, na primjer promicanjem registracije brakova i rođenja te jamčeći da djevojčice imaju pristup institucionalnim mehanizmima potpore, među ostalim psihosocijalnom savjetovanju, zaštitnim mehanizmima te prilikama za ekonomsko osnaživanje.

  Lívia Járóka (PPE), írásban. – A gyermek- és kényszerházasságok sajnálatos módon máig jelen vannak a világ különböző tájain. Kijelenthető, hogy a gyermekházasság globális, országokon, kultúrákon és vallásokon átívelő probléma. Eddig több mint 750 millió lányt adtak férjhez 18 éves kora előtt, ezen belül 250 millió lányt 15 éves kora előtt, ami jelentősen növekszik instabilitás, migrációs válság, fegyveres konfliktusok, valamint természeti és humanitárius katasztrófák idején. Bár a legtöbb országban meghatározzák a házasságkötés alsó korhatárát, amely általában 18 év, azonban számos ország továbbra is kivételeket biztosít a házasságkötés alsó korhatárára.

A gyermekmenyasszonyok gyakran erőszak áldozatai, számos egészségügyi problémától szenvednek, megfosztják őket az oktatástól és a jövőbeli fizetett munkaviszonytól, függő viszonyba helyezik őket, ezért nagyobb valószínűséggel lesznek szegények és maradnak azok, így a szegénység tovább öröklődik. A kutatások szerint a gyermekházasság a fejlődő országoknak 2030-ra több billió dollár veszteséget fog okozni. A probléma felszámolásához holisztikus és átfogó megközelítést kell alkalmazni, orvosolni kell a kiváltó okokat, és ki kell terjeszteni a nemek közötti esélyegyenlőséget a hagyományos ágazatoknak számító oktatáson és egészségügyön túl valamennyi más szakpolitikai területre. A gyermek-, a korai és a kényszerházasság a gyermekek jogainak egyértelmű megsértése, és a lányok és fiúk elleni erőszak egyik formája, amely ellen globálisan kell fellépni.

  Pirkko Ruohonen-Lerner (ECR), kirjallinen. – Muutama vuosikymmen sitten pakkoavioliitoiksi kutsuttiin avioliittoja, jotka pariskunnat katsoivat parhaaksi solmia siksi, että nainen oli tullut raskaaksi. Nykyisin pakkoavioliitoilla tarkoitetaan avioliittoja, joihin pakotetaan tai painostetaan hyvin nuoria tyttöjä, joskus jopa pikkulapsia. Lapsi- ja pakkoavioliitot rikkovat vakavalla tavalla perimmäisiä ihmisoikeuksia. Lasten terveys vaarantuu lisäksi järkyttävällä tavalla raskauden ja synnytyksen vuoksi. Lapsiavioliitot kielletään useissa kansainvälisissä sopimuksissa, kuten Istanbulin yleissopimuksessa, mutta konkreettisia toimia tarvitaan yhä kipeästi.

Suomessa lapsiavioliitoista nousi kohu, kun katukuvaan ilmestyi vuosi sitten PLAN Internationalin varainkeruukampanja, jonka julisteessa esiintyi 12-vuotias viimeisillään raskaana oleva tyttö. Kuva puhui enemmän kuin tuhat sanaa ja aiheutti kiivaita keskusteluja, mitä pidän pelkästään hyvänä asiana. Ongelmat eivät poistu sillä, että vaikenemme niistä. Erityisesti maahanmuuton seurauksena lapsiraskaudet ovat lisääntyneet myös EU-maiden sisällä. Lapsiavioliittojen määrät ovat kauhistuttavia. Arviolta neljä miljoonaa tyttöä avioituu vuosittain ennen 15 vuoden ikää. Jos tilanne jatkuu samanlaisena, on arvioitu, että vuoteen 2050 mennessä maailmassa tulee olemaan 1,2 miljardia lapsiavioliiton uhria.

Tälle kehitykselle on tehtävä loppu. Lapsi- ja pakkoavioliittojen perimmäisiin syihin, kuten haitallisiin käytäntöihin ja tapoihin, sukupuolten äärimmäiseen epätasa-arvoon, köyhyyteen ja koulutuksen puutteeseen, on puututtava. Mitkään uskontoon tai tapakulttuuriin perustuvat syyt eivät saa mennä lasten oikeuksien edelle. Lasten on saatava elää lasten elämää ilman ulkoista pakkoa tai painostusta avioliiton solmimiseen.
