  Judith Sargentini, Plaatsvervangend auteur. – Voorzitter, mensen in nood helpen is de morele plicht van ons allemaal. Als een Deense automobilist een Syrische familie met kleine kinderen langs de snelweg ziet sjokken, dan is het gewoon menselijk om hen een lift te geven. Als Spaanse brandweermannen bij Griekse eilanden mensen redden van de verdrinkingsdood, dan verdienen zij ons applaus. Toch werden de Deense automobilisten en de Spaanse brandweermannen voor de rechter gedaagd, omdat zij mensen zouden hebben gesmokkeld.

In de richtlijn uit 2002 met de heel lange titel “tot omschrijving van hulpverlening bij illegale binnenkomst, illegale doortocht en illegaal verblijf” is bepaald dat elke lidstaat passende sancties moet hebben als een Europees burger iemand helpt om op irreguliere manier het land binnen te komen of zich in die lidstaat te verplaatsen, als dit tegen de nationale wetgeving is. De richtlijn zegt ook dat als een Europees burger hierbij uit is op persoonlijk financieel gewin, die lidstaat die burger moet vervolgen. Want dat is een misdaad. Maar, en ik spreek trouwens liever over irregulier en niet over illegaal, maar als een Europeaan een migrant zonder verblijfsrecht simpelweg hulp verleent, mag dat op grond van het protocol van de Verenigde Naties tegen de smokkel niet strafbaar worden gesteld. De richtlijn (in het kort) “omschrijving hulpverlening“ biedt daarvoor in artikel 1, lid 2 een niet-bindende optie voor een uitzondering voor humanitaire hulp. Maar die uitzondering is blijkbaar niet in alle gevallen goed begrepen, want anders zouden die Deense automobilisten en die Spaanse brandweermannen toch nooit vervolgd zijn geweest.

Derhalve vraagt het Europees Parlement de Europese Commissie heldere richtsnoeren te formuleren voor de lidstaten over de toepassing van deze richtlijn, zodat de uitzondering geregeld wordt en zodat het bieden van humanitaire hulp in het vervolg in iedere lidstaat dan wel in de wet, dan wel in de praktijk wordt ingebed en we voor eens en voor altijd helder stellen welke vormen van hulpverlening niet strafbaar moeten worden gesteld in lidstaten. Ik denk dat het nu juist van het allergrootste belang is dat te onderstrepen.

Op Malta ligt het schip de Seawatch te wachten tot ze toestemming krijgt om uit te varen. Het schip de Aquarius ligt in Marseille in de haven, omdat ze zich niet meer in Italië mocht bevoorraden. Er zijn momenteel nauwelijks nog reddingsschepen van ngo's actief op de Middellandse Zee. En dat terwijl de wet in Italië heel helder is: humanitaire hulp is niet strafbaar. Ook in Oostenrijk, in België, in Duitsland, in het Verenigd Koninkrijk, in Finland, in Zweden, in Nederland, in Luxemburg, in Portugal, in Kroatië, in Ierland en deze lijst is niet compleet, ook in die landen wordt op de een of andere manier onderscheid gemaakt tussen mensen die smokkelen voor financieel gewin, een zaak die strafbaar is, en mensen die helpen uit humanitaire motivatie. Dat onderscheid is heel belangrijk. In Frankrijk is onlangs de wet aangescherpt en wordt het voor hulpverleners moeilijker hulp te bieden. Terwijl het in Hongarije sinds de stemming over de nieuwe ngo-wet eigenlijk vrijwel onmogelijk is geworden om migranten te helpen met simpele dingen als eten en drinken en een slaapplaats. Terwijl heel veel landen in eigen land dus onderscheid maken tussen hulp en uitbuiting, lijken ze dat bij reddingsacties op de Middellandse Zee uit het oog verloren te zijn.

In de conclusies van de Raad van afgelopen week staat te lezen dat alle schepen die op de Middellandse Zee opereren, de geldende wetten moeten respecteren en de werkzaamheden van de Libische kustwacht niet in de weg moeten zitten. Natuurlijk moeten alle schepen op de zee de wet volgen. Waarom moet dat worden benadrukt? Volgen deze ngo's de wet dan niet? Ik denk juist van wel. Ik denk dat zij de wet respecteren en ook de wet van de zee waarin één principe heel erg helder is, namelijk dat een drenkeling gered moet worden. Waarom wordt er zo'n nadruk gelegd op het opereren van de kustwacht van een derde land? Het VN-protocol tegen smokkel waarin helder verwoord is dat het verlenen van humanitaire bijstand niet strafbaar is, geldt toch ook op de Middellandse Zee? En de Europese richtlijn “omschrijving hulpverlening” toch ook?

Dus, Voorzitter, het is zeer gewenst dat de Europese Commissie de lidstaten helderheid verschaft omtrent de interpretatie van de richtlijn. Dank u wel.

  Dimitris Avramopoulos, Member of the Commission. – Mr President, let me first thank Ms Sargentini and say that I have taken note of her advice. There are not many of us here tonight, but what we say and have to discuss tonight is very important and I would like to express my thanks to all colleagues who have brought this issue to the surface.

I would like to tell you that the focus of all our actions at EU level with the Member States is, and has always been, to disrupt the criminal networks that make significant profits out of the smuggling of migrants to and within Europe. Our actions have been successful so far, although we shall not reduce our efforts until we destroy their business model entirely.

Thanks to our coordinated work and also to the EU-Turkey Statement, the business of the smugglers on the Turkish coast has already significantly decreased. With the support of Europol, many migrant smuggling networks have been dismantled.

These are the kinds of results that we aiming for. We do not want in any way to prosecute citizens and organisations that provide genuine assistance to those in it. Criminalisation of genuine humanitarian assistance should be avoided and, let us be clear, EU legislation on the facilitation of unauthorised entry, transit and residence does not require Member States to do so. On the contrary, it provides for the possibility to exempt genuine humanitarian assistance from criminalisation under national law and so far, eight Member States have provided some sort of explicit exemption.

The Commission understands Parliament’s concerns about how the EU legislative framework might impact citizens providing humanitarian assistance. So we take note of your request for guidelines to be issued on this delicate matter.

The Commission has done an evaluation of the Facilitators Package that was published last year. We consider that there is not sufficient evidence about the need to revise the legislation at this point in time. However, we acknowledge the perceived risk of criminalisation of humanitarian assistance as one of the main areas in need of improvement.

That is why we have started to engage with civil society representatives and the Fundamental Rights Agency. A first dedicated meeting took place in May, in Brussels, with the relevant stakeholders and agencies. Discussions on this issue also took place with Eurojust and national prosecutors at the end of May. We are expecting feedback from the participants, and we will continue this process.

Our objective is to create and maintain an ongoing dialogue and exchange with interested stakeholders. We want to gather evidence and foster a dialogue on the implementation of the Facilitators Package precisely to avoid criminalisation of humanitarian assistance. Such an exercise does not preclude other forms of reach—out or initiatives at a later stage should the need arise. I look forward to hearing your views.

  Frank Engel, au nom du groupe PPE. – Monsieur le Président, Monsieur le Commissaire, soyons clairs, il ne s’agit pas uniquement d’éviter que des opérations humanitaires soient pénalisées ou criminalisées. Il s’agit aussi, et à mon humble avis autant, de faire en sorte que l’on ne facilite pas le passage des migrants illégaux sous couvert d’une action humanitaire, non parce qu’il y en aurait trop, mais surtout parce que l’on participe de cette façon au sinistre dessein des trafiquants d’êtres humains.

Il y a des raisons de craindre qu’un certain nombre d’opérateurs qui sont actuellement en Méditerranée, y soient précisément pour cette raison, et cela me pose problème. Que ces gens le fassent même par inadvertance, je veux bien, mais en fin de compte, on facilite de cette façon un commerce que nous avons, je crois, le devoir moral, l’obligation, d’éradiquer au nom de la dignité humaine. Et dès lors, il faut vraiment établir des lignes directrices claires dans tous les sens. Qu’est-ce qui peut être considéré comme une aide inacceptable, illégale, et qu’est-ce qui ressort clairement de l’action humanitaire? Il faut selon moi, pour qu’une action puisse être qualifiée d’humanitaire, qu’elle se fasse sous la supervision, sous le contrôle et, probablement, suivant les instructions des autorités officielles chargées de telles opérations.

Nous avons assisté ces derniers temps en Méditerranée à une action quasiment souverainement conçue par certains capitaines qui se croient non seulement habilités, mais également autorisés à agir là où personne ne les a envoyés, alors que d’autres y seraient aussi. Cela n’aide pas Monsieur le Commissaire, et cela n’aide pas à donner de la crédibilité à ces opérations.

Je suis d’avis qu’il faut faire en sorte que tout le monde soit et reste à sa place.

  Sylvie Guillaume, au nom du groupe S&D. – Monsieur le Président, la criminalisation de l’aide humanitaire est de plus en plus courante dans les États membres. Il est donc urgent de rappeler qu’il existe une directive sur la question, et le rôle de la Commission est d’expliquer comment mieux l’appliquer.

Nous vous appelons donc, au travers de cette résolution, à définir des lignes directrices explicites. Celles-ci doivent permettre aux autorités nationales, notamment, de faire la distinction entre les passeurs et des citoyens qui agissent de manière désintéressée. Sans cette distinction, il sera difficile d’être vraiment efficace dans la lutte contre les vrais criminels que sont les trafiquants.

Il faut éviter de se tromper de cible et d’amalgamer des citoyens de bonne foi aux passeurs, notamment en France, comme le rappelait ma collègue, Judith Sargentini.

Nous appelons donc à une harmonisation en la matière. Elle est essentielle pour que, dans l’ensemble de l’Union, l’action des associations et des acteurs de terrain soit connue et cadrée.

Le message de la Commission doit être clair dans un contexte européen de plus en plus suspicieux à l’égard des migrants et de ceux qui les aident.

  Jussi Halla-aho, on behalf of the ECR Group. – Mr President, yes, people should be helped when in distress. But sometimes people get themselves in distress in order to be rescued. Everybody agrees that the migrants should not be drowning in the Mediterranean. At the same time, we must remember that the people who are crossing the sea are mostly economic migrants from sub-Saharan Africa. They are coming because both Libya and the Mediterranean are easier and cheaper to cross than they were 10 years ago.

These people take to the sea on rubber boats and other unseaworthy vessels because they know they have a good chance of being picked up by NGO ships that are waiting close to the Libyan coast, and of being ferried to Europe. Those NGOs thus contribute actively not only to the migration crisis here in Europe, but also to the humanitarian tragedy in the Mediterranean by luring people to the sea. Good intentions cannot be an excuse for anything. Stupidity should not be a European value. This maritime taxi service should not be able to operate with impunity.

  Cecilia Wikström, on behalf of the ALDE Group. – Mr President, usually in the field of migration we are asking the Commission for new or revised legislation, but in this case we have a directive, the Facilitation Directive, which is being applied differently in different Member States and therefore what we need from the Commission is guidelines.

Of course, a regulation instead of a directive could help but, judging from recent experience with the asylum package, adopting a new regulation would take a very long time and we need to act much more rapidly on this.

What is at stake? Well, this concerns the directive that affects citizens who are helping other human beings and providing humanitarian assistance at sea – and who can end up being charged with criminal activities. I chair the Committee on Petitions and we have received a number of petitions on this. I would argue that we need to do more so that we manage migration properly in the Union, but until this becomes the case we should not punish citizens for doing what every human being should do when they meet people in distress, at risk of losing their lives at sea.

So we need the Commission, now, to provide guidelines to Member States to ensure once and for all that real humanitarian assistance is not, and will never be, a criminal act in the European Union.

  Ernest Urtasun, en nombre del Grupo Verts/ALE. – Señor presidente, mientras tenemos este debate, un buque de la ONG Open Arms se dirige a Barcelona con cuatro compañeros eurodiputados de esta casa después de haber rescatado a sesenta personas que, sin la ONG Proactiva Open Arms, seguramente habrían fallecido, igual que han fallecido cuatrocientas personas frente a las costas libias este mismo fin de semana porque, básicamente, hemos expulsado a las ONG del Mediterráneo y hemos hecho una política de capacitación de la marina libia para que pueda tener su propia zona de salvamento y rescate, cosa que ha mostrado que es incapaz de hacer, vulnerando los derechos humanos. Y los resultados están allí.

Y, encima, hemos avanzado hacia la criminalización de las ONG, que tan esenciales han sido. Y no solo en el Mediterráneo. También quiero recordar a los bomberos sevillanos de Proem—Aid, que también fueron acusados de tráfico de personas por estar ayudando precisamente a refugiados. Y esta criminalización de la ayuda humanitaria debe terminar. Y debe terminar, entre otras cosas, porque ―como ya se ha dicho― el Protocolo de las Naciones Unidas contra el tráfico ilícito de migrantes establece de una manera muy clara que, para acusar a alguien de tráfico, tiene que haber un lucro claro y demostrado y, segundo, porque jamás se puede acusar de tráfico a alguien que está prestando ayuda humanitaria.

Y es verdad, en nuestra Directiva, en la Directiva sobre el paquete de medidas relativas a los pasadores de fronteras, tenemos en estos momentos simplemente una indicación de que los Estados miembros pueden introducir excepciones a la ayuda humanitaria en el caso de acusar de tráfico a alguien, y eso no es suficiente.

Por lo tanto, le pedimos a la Comisión que revise esa Directiva para obligar a los Estados miembros a que la ayuda humanitaria esté exenta de penalizaciones y a hacer esas directrices que también le han pedido otros diputados.

  Barbara Spinelli, a nome del gruppo GUE/NGL. – Signor Presidente, onorevoli colleghi, da tempo nei nostri Stati è in atto una criminalizzazione più o meno esplicita di chiunque assista persone provenienti da paesi terzi, via mare o via terra. In pratica l'aiuto umanitario è messo fuori legge, a dispetto di chiare indicazioni che vietano di considerare reato il soccorso a chi è in pericolo. Parlo del Protocollo ONU sul traffico di migranti e della Convenzione sul diritto del mare.

La direttiva sulla facilitazione contiene ambiguità: una dopo l'altra le norme del diritto europeo e internazionale vengono ignorate o smantellate, in Ungheria perfino costituzionalmente. Si impedisce alle navi che fanno ricerca e salvataggio di sbarcare nei nostri porti, si arresta chi alberga migranti in fuga nelle Alpi. Nel Mediterraneo non ci saranno più navi che salvano i naufraghi, in assenza di operazioni in questo senso dell'Unione che non europeizzò per tempo Mare Nostrum.

Stiamo tornando agli anni Trenta, quando gli organi internazionali cedettero all'arbitrio di stati canaglia. Se l'Unione, custode della legge europea, non offre linee chiare che aboliscano il reato di solidarietà, si ripeterà il colossale fallimento della Lega delle Nazioni.

Concludo ringraziando gli interpreti e appoggiando il loro sciopero.

  David Coburn, on behalf of the EFDD Group. – Mr President, I am missing football for this so I regard it as a very serious issue.

Prime Minister Orbán has quite rightly passed the ‘Stop Soros’ laws. The laws are aimed at stopping the influence of George Soros in Hungary. New laws make it a criminal offence to be associated with an NGO participating in criminal activity, with a 25% tax imposed on foreign money coming into them.

And why not? NGOs should stop virtue-signalling and obey the law, whether on land or at sea. The Hungarians have every right to defend their sovereignty and their elected government’s ability to fulfil its manifesto promise of cutting down on immigration, which, of course, is damaging their economy and their capability in terms of social rights and everything else.

NGOs seem determined to change the nature of Hungary’s culture, regardless of the views of the Hungarian electorate, by breaking Hungary’s laws. All nations have the right to protect their citizens’ jobs, healthcare and quality of life. It is not for NGOs to decide this [...] (The President cut off the speaker)

  Auke Zijlstra, namens de ENF-Fractie. – De afgelopen dagen waren ze volop in het nieuws, de boten Lifeline en Aquarius, varend onder valse vlag met hun verplichte radiobaken uit. Gesponsord door Artsen zonder morele grenzen, zijn zij onderdeel van de illegale migratieketen, een keten die loopt van het rekruteren van migranten in Afrika tot het afleveren van die mensen in het land waar zij willen wonen. Alle schakels in deze keten faciliteren een illegale activiteit. Het Europees Parlement is een grote fan van deze ngo's, die door het ophalen van migranten vlak voor de kust van Libië het dodelijke smokkelen van mensen over de Middellandse Zee uitlokken. Het Europees Parlement vindt nu dat ngo's nooit vervolgd mogen worden voor mensensmokkel.

Voorzitter, het strafrecht behoort niet tot de bevoegdheden van de Europese Unie. De lidstaten gaan over het strafrecht. Uit deze discussie blijkt dat dit een goede zaak is, want dat betekent dat ook het vaststellen van de uitzonderingsregels op het strafrecht een soeverein recht is van elke lidstaat.

Voorzitter, ngo's staan niet boven de wet. Dank u wel.

  Lívia Járóka (PPE). – Elnök úr! Engedje meg, hogy leszögezzem, hogy szociális antropológus vagyok, emberjogi aktivista, rengeteg humanitárius programot vezettem magam is – általában a saját forrásomból – és hogy teljesen megértem a kollégák jó szándékát, azonban meg kell mondanom, hogy egyetértek Tusk elnökkel, aki a múlt heti csúcson azt mondta, hogy minden hajónak, beleértve a civil szervezetek hajóit, amely a Földközi-tengeren cirkál, be kell tartani a hatályos törvényeket, és nem szabad akadályozniuk a líbiai határőrség munkáját.

Örülök, hogy tegnap is ebbe az irányba indultunk el. Ezzel nem a civil szervezetek életmentő segítségnyújtása ellen szeretnék felszólalni. Viszont ahogy a jogellenes be- és átutazáshoz, valamint a jogellenes tartózkodáshoz történő segítségnyújtásról szóló 2002/90-es tanácsi irányelv kimondja: az illegális bevándorláshoz történő segítségnyújtás leküzdéséhez intézkedéseket kell hozni. Nem csak szigorú értelemben vett jogellenes határátlépéssel összefüggésben, hanem akkor is, ha ennek célja az emberek kizsákmányolására szolgáló hálózatok fenntartása.

A hatályos EU-szabályozás nem zárja ki azok büntethetőségét, akik illegális bevándorlónak segítenek, sőt azt mondja, hogy minden tagállamban szankciókat lehet megállapítani azoknak, akiknek illegálisan segítenek az állam területére beutazni embereket. A segítőket, a felbujtókat meg kell büntetni.

Vannak olyan civil szervezetek sajnos, akik nem állnak a jó oldalon. Próbálják rejteni ezt, és a civil szervezeteknek kivétel nélkül tiszteletben kell tartani a hatályos EU-szabályozást, és ahogy hallottuk, már a magyar kormány célja is az volt, hogy az igazságszolgáltatási szervek fel tudjanak lépni azok ellen, akik pénzért szállítják...   Juan Fernando López Aguilar (S&D). – Señor presidente, en un momento en que decrecen los flujos migratorios, sin embargo el Mediterráneo sigue siendo una fosa común expuesta a la inacción de los Estados miembros, que dan la espalda a las buenas prácticas humanitarias como las del nuevo Gobierno de España, que recibió al Aquarius y va a recibir mañana miércoles al barco de Open Arms.

Pero lo más indignante es que persista esa interpretación aberrante de la Directiva de ayuda. En el artículo 1, apartado 2, de esa Directiva se dice que los Estados miembros «podrán» eximir de criminalizar a quienes presten ayuda humanitaria en el rescate en la mar. Debe decir «deberán».

Por tanto, es imprescindible que la Comisión actúe para asegurar que, en ningún caso, nunca más – never again, nie wieder – pueda criminalizarse la ayuda humanitaria, lo que permitió que se sentaran en el banquillo de los acusados tres héroes españoles: Manuel, Enrique y Julio, de PROEM-AID.

Que ninguna organización humanitaria tenga que pagar con la pena del banquillo ni con un proceso penal el haber rescatado vidas en la mar con sacrificio de la propia.

  Helga Stevens (ECR). – Beste collega's, jullie vragen dat alle lidstaten in hun wetgeving opnemen dat ngo's die actief zijn in de Middellandse Zee, niet strafrechtelijk mogen worden vervolgd. Kunnen we nu even serieus blijven! We moeten onder ogen zien dat deze ngo's zich laten gebruiken door mensensmokkelaars, waardoor deze laatsten buiten schot kunnen blijven. Zo voer de Aquarius alle veilige havens in Tunesië voorbij om te proberen te ontschepen in Europa. Artsen zonder grenzen deed er dus alles aan om Afrikaanse gelukszoekers naar Europa te brengen. Twee dagen geleden probeerde de Spaanse ngo Open arms een reddingsactie van de Libische kustwacht te saboteren. Twee andere ngo's deden een week eerder hetzelfde onder een valse vlag.

Dan vraag ik u: waar zijn ze in godsnaam mee bezig? Voor ons moet de nadruk liggen op het redden van mensen van de verdrinkingsdood. Dat bereiken we alleen door de lucratieve business van mensensmokkel te stoppen. Daarom mag een illegale binnenkomst in de EU van gelukszoekers ook niet langer automatisch leiden tot een verblijfsrecht. Dank u.

  Eva Joly (Verts/ALE). – Monsieur le Président, en déclarant que les ONG font le jeu des passeurs, Emmanuel Macron marche dans les pas du gouvernement italien. En plus de ne pas assumer ses obligations en matière d’accueil des demandeurs d’asile, de les maltraiter de Calais jusqu’à la frontière italienne, d’enfermer les enfants et de condamner l’humanité des citoyens solidaires, désormais, la France va jusqu’à attaquer frontalement les ONG qui pallient les carences des États membres. Quelle honte!

Prendre ces ONG comme boucs émissaires fait le jeu de l’extrême droite et autres populistes. Entraver le travail des ONG ne fait qu’aggraver le sort de celles et ceux qui franchissent la Méditerranée pour échapper au pire.

La vérité, c’est que la France, comme beaucoup d’autres États, préfère s’attaquer aux citoyens qui font preuve d’humanité plutôt qu’aux criminels qui s’en prennent aux migrants. Cela doit cesser.

Laissez les ONG et les citoyens européens intervenir sans entraves. Mieux, assumez vous-même ce qui est une obligation morale.

  Steeve Briois (ENF). – Monsieur le Président, sans grande surprise, l’Union européenne se désolidarise des États membres qui souhaitent pénaliser ces associations qui, sous couvert d’aide humanitaire, favorisent en réalité le trafic d’êtres humains.

La proposition de résolution de Claude Moraes constitue donc un gigantesque appel d’air dans lequel s’engouffreront demain les mafias de passeurs.

Au contraire, nous demandons à l’Union européenne de durcir les mesures de lutte contre l’immigration clandestine et de refermer maintenant cette boîte de Pandore. Nous invitons également les États membres à alourdir les sanctions financières à l’encontre de ces ONG dont certaines bénéficient de financements opaques, ainsi qu’à confisquer leurs bateaux, comme l’Aquarius.

À l’instar de Matteo Salvini, envoyons un message clair aux filières de passeurs, ainsi qu’à tous ceux qui seraient tentés, demain, par une immigration clandestine en Europe. En résumé, le sauvetage des vies en Méditerranée ne doit pas servir, demain, de cheval de Troie d’une submersion migratoire en Europe.

  Tomáš Zdechovský (PPE). – Pane předsedající, vždycky napomáhání k nepovolenému vstupu nebo páchání jakékoliv trestné činnosti zvětšuje možnost nevyřešení migrační krize a myslím si, že tady zazněla řada argumentů, které ukazují, že je potřeba ocenit ty neziskové organizace, které skutečně pomáhají, ale na druhou stranu je potřeba říct těm, které slouží pouze k převozu ekonomických migrantů, že takto činnost svojí dělat nebudou. Tady nejde přece o to kriminalizovat humanitární pomoc, ba naopak, my jsme rádi za každého dobrovolníka, za každého člověka, který v neziskovém sektoru dělá svoji práci ve prospěch dobré věci.

Na druhou stranu musíme říct, že řada neziskových organizací nebo lidí, kteří tvrdí, že dělají neziskovou činnost, ve své činnosti porušují zákony Evropské unie a porušují zákony členských států a tyto organizace musíme začít tvrdě trestat. Já si nedokážu představit to, že by tato činnost nadále pokračovala. To, co vadí dneska Evropské unii a řadě jejich občanů, proč jsou vůči ní skeptičtí, je právě to nedodržování zákonů. A ten dvojí metr uvnitř celé Evropské unie.

Nakonec bych chtěl zdůraznit tady kolegům ze strany Zelených, že nechápu, jak politik může nasednout na nějakou loď a přivést ji do přístavu, i když ví, že porušuje tato loď zákon. Já osobně to dělat nebudu.

  Elly Schlein (S&D). – Signor Presidente, onorevoli colleghi, mentre i governi europei si chiudono nei loro egoismi, c'è un altro volto dell'Europa: quello dei tanti volontari e delle organizzazioni che salvano vite a terra e in mare, cercando di offrire degna accoglienza.

Eppure sono sotto duro attacco, con l'accusa di aver favorito l'immigrazione irregolare e addirittura collaborato con i trafficanti, accuse che in più decisioni giudiziarie si sono rivelate del tutto infondate.

È inaccettabile attaccare chi sta solo sopperendo alla grave mancanza di una risposta umanitaria europea. È inaccettabile che le navi di chi salva vite in mare debbano temere conseguenze legali per avere rispettato il l'obbligo di soccorso, prevista dal diritto internazionale: siamo davanti a una vera e propria criminalizzazione della solidarietà.

Volete davvero contrastare i trafficanti? Aprite vie legali e sicure di accesso in tutti i paesi europei. Per questo noi chiediamo anche di cambiare la direttiva sul favoreggiamento, rendendo obbligatoria la clausola che esclude espressamente la punibilità per chi offre assistenza umanitaria. E a tutti i paesi chiediamo di introdurla.

  Barbara Matera (PPE). – Signor Presidente, onorevoli colleghi, gli sbarchi continuano e con essi sono aumentati i morti in mare: cento morti al largo della Libia solo pochi giorni fa. Ma in questa tragedia dei nostri giorni resta da chiarire il ruolo delle organizzazioni non governative che prestano assistenza ai migranti e che hanno, con le loro azioni di salvataggio, incentivato il traffico.

In altre parole i trafficanti, consapevoli della presenza di imbarcazioni battenti bandiera di paesi di mezza Europa e che prestano soccorso in mare, hanno aumentato l'uso di carrette del mare per i loro sporchi traffici.

Siamo qui oggi a chiedere che la Commissione europea riconsideri le regole in vigore per dare una definizione all'assistenza umanitaria e che superi la direttiva 2002/90. La Guardia Costiera italiana ha più volte lamentato che quella direttiva, che si applica in situazioni di emergenza, sia invece diventata la norma.

Gli Stati membri dell'Unione europea sono tenuti ad attenuare la legislazione che introduce sanzioni penali contro l'agevolazione dell'ingresso irregolare, del transito e della residenza.

  Cécile Kashetu Kyenge (S&D). – Signor Presidente, onorevoli colleghi, reato di solidarietà: ecco l'assurdo concetto di cui discutiamo qui oggi. Con questo concetto l'Europa anti-immigrazione ci fa assumere le sembianze di un'assurdità quasi kafkiana.

In Europa, culla dell'umanesimo, una porzione sempre crescente della popolazione ha aderito all'anti-umanesimo, tanto da indurre i responsabili giudiziari di alcuni Stati membri a ipotizzare sanzioni contro cittadini solidali, dando il via a incredibili processi contro la solidarietà. Il sentimento di antipatia verso i migranti è la bandiera politica di xenofobi e populisti, che confondono il soccorso con il delitto e corrompono le nostre certezze.

Al principio, in alcuni Stati europei, è stato inventato il reato di clandestinità contro i migranti; poi qualcuno l'ha commutato in reato di solidarietà contro i propri cittadini volenterosi. Su questa linea viaggiano i tratti di un processo di imbarbarimento della nostra società a cui occorre porre rimedio. Serve quindi anche chiarezza per la nostra direttiva europea.

Dobbiamo dunque ribadire un fatto: ai cittadini europei che soccorrono persone in difficoltà vanno riconoscimenti e medaglie al merito civile ed è del tutto fuorviante paragonarli ai trafficanti di essere umani oppure accusarli di favoreggiamento all'immigrazione clandestina.

Diciamolo forte, una volta per tutte: l'azione filantropica dei nostri concittadini consolida il primato della persona! È certo importante la legalità: ma laddove la vita delle persone è in pericolo dobbiamo appellarci alla legittimità delle azioni di solidarietà.

  Ana Gomes (S&D). – Mr President, how can the European Council become embroiled in the lies of the extreme right, considering that disembarkation centres outside Europe are actually torture and detention centres as in Libya, where the coastguard is a fiction, it is in fact a militia trafficking human beings?

How can European leaders embark in the narrative of the extreme right, seeking to criminalise NGOs for saving human beings from drowning in the sea? The Council has failed until today to give a ‘save and rescue’ mandate to EUNAVFOR MED Operation Sophia, which has nevertheless saved over 30 000 lives thanks to maritime law obligations.

If our military, our coastguards and even our NGOs were to let people die in the Mediterranean, could European leaders look themselves in the mirror? Could they face their children and can they face their grandchildren? European Commission, do your job! Be the guardian of the Treaties and pass these guidelines preventing Member States from criminalising the saviours of what is left of our decency and humanity.

  Stanislav Polčák (PPE). – Pane předsedající, jsem trochu ohluchlý z vystoupení předchozí kolegyně. Já stojím za tím, že pomáhat lidem je skutečně výraz lidství. Ostatně celé dějiny jsou výrazem toho pomáhat lidem. Mnozí bezejmenní hrdinové skutečně pomáhali a v dějinách mají své důležité místo.

Na druhou stranu je důležité, aby pravidla byla dodržována, a já si nejsem jist, že umíme rozlišit velmi jednoduše mezi tím, kdo je převaděč a skutečně nezákonně porušuje ta pravidla a kdo skutečně pomáhá tak, že zachraňuje lidi na širém moři. I oni jsou zodpovědní za to, že se vrhnou na širé moře a uvrhnou se do jistého nebezpečí.

Dovolím si vyslovit tezi, že taxikář není zachránce. A tady bychom měli vést asi tu dělící linii. Pokud se někdo rozhodne nalodit lidi dokonce proti pravidlům Libye či případně tedy mezinárodního práva, tak také se vystavuje určitému nebezpečí.

  Julie Ward (S&D). – Mr President, the compassionate response of ordinary people to the humanitarian crisis facing desperate migrants and refugees, who are crossing Europe in search of safety and a sustainable life, is in stark contrast to the bureaucratic and political failure of the authorities. Many people have provided food, shelter and medical assistance to people on migratory routes across Europe, providing lifesaving acts of kindness where none existed.

Shockingly, in France, Germany, Denmark, Sweden, Italy, Greece and the UK, some of these people have now been criminally prosecuted because the recipients of their compassionate acts are not nationals. This is pure unadulterated racism on the part of the authorities. This is saying that European lives are more valuable than others. It is absolutely unacceptable that the EU should remain silent when Member States use a European directive to criminalise assistance.

Having worked in close partnership with several organisations providing humanitarian assistance on the ground, I fully support my colleague Claude Moraes’ call for the Commission to [...] (The President cut off the speaker)

  Xabier Benito Ziluaga (GUE/NGL). – Señor presidente, la criminalización de las ONG de rescate en el Mediterráneo empieza aquí, en las instituciones europeas. Hace unas horas, en esta Cámara, el presidente del Consejo Europeo, Donald Tusk, advertía a las ONG: «Respeten la ley y no entorpezcan la labor de los guardacostas libios».

Me llena de vergüenza. Me llena de vergüenza que se ataque así a las ONG, que son las únicas que cumplen con el deber de socorro. ¿Desde cuándo el señor Tusk representa a los paramilitares de los guardacostas libios?

Proactiva Open Arms ya denunció recientemente en este Parlamento la criminalización que sufren todos los activistas. Primero fueron campañas de descrédito, luego se pasó a la actuación militar, las amenazas, los disparos y los secuestros. Ahora se pasa a la persecución judicial.

Puede usted tomar nota, señor comisario, como decía. Sea—watch y Lifeline siguen retenidos. Esta semana cuatro diputados de esta Cámara presencian cómo el Open Arms rescata a sesenta personas y se les cierran los puertos en Italia y Malta.

Usted, señor comisario, el problema es que no tiene una política de salvamento y acogida. Lo que tiene es una política de seguidismo fiel de las políticas xenófobas y racistas de la extrema derecha.

  Γεώργιος Επιτήδειος (NI). – Κύριε Πρόεδρε, η επιθυμία αλλά και η προσπάθεια των παρανόμων μεταναστών να εισέλθουν οπωσδήποτε και λαθραία κυρίως στις χώρες εισόδου έχει κάνει τους δυστυχείς αυτούς ανθρώπους αντικείμενο εκμετάλλευσης από πολλούς και διαφόρους φορείς, πρώτα από όλα από τους παράνομους διακινητές, και κατά δεύτερο λόγο από τις ΜΚΟ. Γνωρίζετε ότι σε όλες τις χώρες και κυρίως στην Ελλάδα, υπάλληλοι των ΜΚΟ κερδοσκοπούσαν και εξακολουθούν να κερδοσκοπούν εις βάρος των παρανόμων μεταναστών, παραβιάζοντας ανθρώπινα δικαιώματά τους για τα οποία υποτίθεται ότι μάχονται. Σας αναφέρω ένα παράδειγμα στην Ελλάδα όπου η αστυνομία εξάρθρωσε ένα πορνείο το οποίο είχαν δημιουργήσει μέλη ΜΚΟ και εκμεταλλεύονταν εκεί νεαρές μετανάστριες αλλά, δυστυχώς, και παιδιά. Τέλος, έχουμε και τους αποκαλούμενους αλληλέγγυους, οι οποίοι, στο όνομα ενός κακώς νοουμένου ανθρωπισμού, εν γνώσει τους, βοηθούν παράνομους μετανάστες είτε να εισέλθουν παράνομα στη χώρα, είτε να παραμείνουν παράνομα σε αυτήν. Δεν πρέπει να συγχέουμε τις καταστάσεις – είναι εντελώς διαφορετικό πράγμα το να προσφέρει κάποιος φαγητό σε έναν λαθρομετανάστη που πεινάει και άλλο να τον εκμεταλλεύεται και να παρανομεί. Το κράτος πρέπει να διώξει αυτές ακριβώς τις παράνομες... (Ο Πρόεδρος διακόπτει τον ομιλητή)

Nous sommes d’accord pour dire qu’il s’agit d’un sujet délicat, mais important. Tout d’abord, il est clair que la non-assistance à des gens en danger de mort est non seulement inimaginable, mais aussi illégale en vertu du droit international.

Nous sommes prêts à travailler avec vous pour empêcher la criminalisation et la mise en cause de citoyens et d’organisations qui aident ceux qui se trouvent en danger et dans le besoin. Cependant, nous poursuivrons notre lutte contre les passeurs et les trafiquants d’êtres humains, qui exploitent le désespoir des migrants.

Je voudrais d’ailleurs souligner que les législations pénales nationales excluent déjà dans la plupart des cas la criminalisation de l’assistance humanitaire. Refuser l’aide à des personnes en situation d’urgence est même un crime.

I would like to be very clear on that. The duty of assistance at sea to anybody in distress is already an obligation under international law.

Now, as regards the situation in the Mediterranean Sea, it is essential that all those involved comply with international rules. This is our guiding principle. We should never forget that we are all working towards the same goal: saving lives at sea and putting an end to the business model used by smugglers to exploit human misery. Our objective is to replace this model by legal and secured pathways for those in need of protection. We have made good progress over the past few years in this direction, and we have to step up our efforts.

As regards the situation in Hungary, the recently adopted legislative package raises concern as regards its compatibility with several aspects of the aquis. As we always do, we are examining it and, on the basis of the outcome of our assessment, we will take the necessary steps. It is very clear to us that we should not turn our backs on the values and the principles on which Europe is built.

On a more general note, the Commission is aware of the challenges experienced by many civil society organisations in Europe, and is committed to supporting strong, independent and pluralistic civil society in the Member States. The Commission will continue to promote, within its competences, full respect for human rights and fundamental freedoms. We will also continue actively to foster, support and preserve the role of civil society organisations in promoting and safeguarding the European Union’s fundamental rights and values.

  Kinga Gál (PPE), írásban. – Az ENSZ bécsi székhelyű Kábítószer- és Szervezett Bűnözés Elleni Hivatalának (UNODC) június 13-án nyilvánosságra hozott migránscsempészetről szóló első globális tanulmányából kiderült, hogy 2016-ban legkevesebb 2,5 millió migránst szállítottak át illegálisan a határokon embercsempészek, amivel több mint 7 milliárd dolláros (1904 milliárd forint) bevételre tettek szert. A migránscsempészet globális szintű bűnözéssé alakult, amely komoly válaszlépéseket igényel. Nekik semmilyen emberélet nem számít, és sajnos ehhez asszisztálnak az európai NGO-k, amikor még líbiai vizekből mentik ki a migránsokat.

A migránsok legnagyobb része gazdasági bevándorló. Víz, élelem és mentőmellény nélkül szállítják tengerre őket zsúfolt gumicsónakokban, arra számítva, hogy az NGO-mentőhajók úgyis gyorsan megtalálják és „kimentik őket” Líbia parti vizeiből, majd pedig átszállítják őket Európába. Ki kell mondani végre: véget kell vetni annak a gyakorlatnak, hogy NGO-hajók migránsokat „mentenek ki” Líbia parti vizeiből, majd nem visszaszállítják őket a pár kilométerre fekvő Líbiába, hanem átszállítják őket a több száz kilométerre fekvő Európába, hiszen ez egy nagyon erős húzótényezővé („pull faktorrá”) vált.

Egyetértek ezért a pénteki uniós csúcs következtetéseinek azon pontjaival, amelyek szerint az embercsempészek üzletszerű tevékenységének végleges ellehetetlenítése – és így számos tragikus haláleset megelőzése – érdekében meg kell szüntetni azokat a tényezőket, amelyek arra késztetik az embereket, hogy nekivágjanak a veszélyes útnak.
