  Carlos Coelho, Relator. – Senhor Presidente, Senhora Comissária Bienkowska, passaram 4 anos sobre a reforma sobre a legislação relativa à contratação pública. É altura de fazer um balanço da sua implementação pelos Estados-Membros. Do que está a correr bem e a correr mal na aplicação das regras europeias.

Concordamos que, para o bom funcionamento do mercado interno, é crucial definir um quadro político global e estratégico para a contratação pública que promova o crescimento, o emprego e a inovação.

A contratação pública representa, na nossa economia, uma parte substancial do investimento público. Mais de 2 biliões de euros por ano. Isto significa que 250 mil autoridades públicas usam cerca de 14 % do PIB da União na aquisição de serviços, obras e fornecimentos através de contratos públicos. Sabemos que a prestação de serviços públicos de elevada qualidade depende, em larga medida, de processos de contratação pública modernos, eficientes e transparentes.

O relatório hoje em debate vem responder precisamente a essa necessidade. Concordamos com a estratégia da Comissão Europeia de propor um pacote de medidas não legislativas, duas comunicações e uma recomendação sobre a profissionalização da contratação pública.

Não precisamos de mais leis, mas de uma boa implementação das leis que temos. Por isso, aprovámos um conjunto de recomendações que a Comissão do Mercado Interno pretende ver implementadas.

Caros Colegas, as diretivas aprovadas em 2014 não são apenas um instrumento para regulamentar a aquisição pública de bens, serviços e obras. Elas devem contribuir para os Estados-Membros promoverem políticas de inovação, de economia ecológica e circular, de crescimento sustentável e inclusivo. Lamentamos, porém, o ritmo dececionante, com que muitos Estados-Membros transpuseram as diretivas, levando mesmo a processos de infração, e temos consciência de que muitas das críticas apontam um cariz protecionista, o difícil acesso e compreensão para as pequenas e médias empresas, o compadrio e a pouca transparência e o facto de o único critério de adjudicação parecer ser o preço mais baixo, em vez de, por exemplo, critérios sociais e ambientais estratégicos para as comunidades.

Por isso, o meu relatório propõe, entre outras medidas que, sempre que possível, e se justifique, se adotem critérios de qualidade em substituição do critério do preço mais baixo, parágrafos 12 e 13. Se apoie a participação das pequenas e médias empresas nos concursos públicos através, por exemplo, do estímulo à divisão em lotes, parágrafo 38. Se introduzam instrumentos de transparência, tais como registos de contratos, parágrafos 29, 33 e 41. Se invista e acelere a digitalização em todas as fases do processo de contratação pública, parágrafos 26 a 33, e se promova a inovação, parágrafos 4, 23 e 24. Se desenvolvam estratégias nacionais de contratação pública, a análise sistemática dos dados e planos de profissionalização para os agentes que lidam com contratos públicos, parágrafos 53 a 57. Se combata a concorrência desleal nos procedimentos de contratação pública transfronteiriços e que se melhore o acesso aos mercados de contratos públicos em países terceiros, parágrafos 45 a 49. Se apliquem elevados padrões de ética e deontologia em todas as fases do processo, parágrafos 15 e 20.

Para concluir, Senhor Presidente, agradeço sinceramente aos relatores-sombra que colaboraram tão empenhadamente neste relatório e os pareceres elaborados pelas comissões ENVI e INTRA. Creio que chegámos a um bom relatório, que estabelece a abordagem correta para contratos públicos eficientes, eficazes e competitivos, que responde aos desafios que hoje se colocam ao setor e que dá um contributo estratégico para atingir objetivos como a inovação, a inclusão social e a sustentabilidade económica e ambiental.

Conto com o apoio de todos os colegas para a aprovação final deste relatório que promove o bom funcionamento do mercado único, do crescimento das empresas e do emprego e protege os interesses dos cidadãos.

Garantir que o dinheiro dos contribuintes é gasto de forma eficiente e eficaz é do interesse comum e é uma exigência legítima dos nossos cidadãos.

  Elżbieta Bieńkowska, Member of the Commission. – Mr President, I would like to thank honourable Members very much for the discussion on this subject.

Public procurement is a very important subject. You have heard the data and you have heard the numbers, but at the same time, besides the data and the numbers, this is a powerful tool which can help carry out policy. We are not using the full potential of public procurement at the moment. Taxpayers are often still not getting the best value for money and do not see results that provide them with the best public services.

That’s why we decided last year – almost a year ago, in November last year – to adopt a public procurement package because we feel that we need a major shift in the culture of public procurement (PP). But at the same time it is also important, as you have heard, that this package is not new legislation. It is made up of voluntary measures, recommendations, suggestions, some new ideas and best practices. It calls for a wide partnership, but also for political ownership of this topic. The package is our attempt to jointly steer the political discussion on PP, to identify priorities and to offer tools for implementing them. We also underlined the role that public procurement can play in responding to European competitiveness and to societal environmental innovation challenges because we know that, for example, it can encourage energy and resource efficiency investment. It can foster innovation and facilitate social inclusion.

We specifically addressed the importance of selecting the most economically advantageous tenders based on a cost effectiveness approach to get the best value for public money for all our citizens, but – as was said before – the most economically advantageous is not always the cheapest. It can never be underlined and repeated enough that EU law does not require the lowest price as the only award criteria.

The package shows how the possibilities offered by the Public Procurement Directives can be used to support wider EU policy objectives. It contains practical measures and guidance along with implementation support from the Commission. So we recommend some actions and offer assistance at the same time.

We organised the package around six priorities. Let me briefly list them. The first one is ensuring wider use of innovative, green and social procurement, then professionalising public buyers – there we need the right competencies and skills of the people who are dealing with this topic – increasing access to procurement markets for SMEs and all EU businesses, though of course SMEs are at the centre of our interest, improving transparency and integrity, delivering better data, boosting the digital transformation of procurement, using technologies to simplify and to reorganise procedures, and cooperating more between authorities at different levels, to procure together.

In March the Council endorsed the package and underlined its importance for European competitiveness. In February we also discussed this package in the Ecofin Council to show the importance of good procurement for public budgets. We definitely know that improving the way procurement is carried out and focusing on the professionalisation of public buyers can really generate important savings in Member States’ budgets.

The Economic and Social Committee and the Committee of the Regions have also adopted their opinions so I am very glad that today Parliament will complete this interinstitutional cycle and adopt the own initiative report. I appreciate that this has been done after a thorough debate with contributions from many of you, under the really valuable leadership of Mr Coelho, together with the shadow rapporteurs. You have prepared a good report, which largely supports the Commission’s proposed approach, while at the same time giving us food for thought for the future. I am also happy to see that there is a large degree of consensus within Parliament and substantial agreement with the Commission’s view on some specific issues.

I will mention just three or four of them. First SMEs, as was underlined before. I would caution against too much pessimism. There is not a big share of SMEs participating in the public procurement market, and as the directive has only been recently transposed I think it will take some time before the simplification really takes effect. We have launched a recent study to identify the possible remaining barriers to SME participation in procurement.

The second point is on quality criteria – what else? – and strategic procurement. Here the situation varies enormously between the Member States. In many there is still a lot of scope to increase the use of quality criteria. We believe that spreading the word that clarifying the lowest price is not mandatory at all, and obtaining high—level commitment to that principle is extremely important. I also think that we should make it easier to apply green, innovative and social procurement. That’s why we are updating existing guidance and compiling best practices to assist authorities incurring tenders. I would also like to stress that we fully share the views of the report when pointing at the huge benefits that digitisation of procurement could bring.

The last point is on the professionalisation of public services, first through more cooperation and exchange of good practices. On this point I couldn’t agree more. We have launched an e—competence centre and a web page bringing together all guidance and good practice from different Member States. We are developing a European competence framework for public buyers to make sure that the skills competences they require are clearly identified.

These are the main points. Thank you very much for taking this subject on board.

  Reimer Böge, Verfasser der Stellungnahme des mitberatenden Ausschusses für internationalen Handel. – Herr Präsident, Frau Kommissarin! In der Tat, die öffentliche Dimension der öffentlichen Auftragsvergabe wird oftmals nur eher beiläufig erwähnt oder analysiert. Aber das wäre ein Fehler. Wir sind heute in der Tat noch in der Situation, dass für Wettbewerber aus der Europäischen Union öffentliche Beschaffungsmärkte in Drittstaaten oftmals de jure und de facto geschlossen sind. Hier müssen wir auf einen besseren Zugang dringen. Die Frau Kommissarin hat es angesprochen: Ja, die Herausforderungen und Probleme gerade für KMU, wenn es um die internationale Dimension geht, müssen ernst- und wahrgenommen werden.

Ein zentrales Problem auf dem Weg zu einem besseren Marktzugang sind einerseits multilaterale Abkommen, allen voran das government procurement agreement. Aber unabhängig davon bleibt ein besserer Marktzugang als Kerninteresse der Europäischen Union auch weiterhin ein wichtiges Element unserer bilateralen Handelsgespräche. Und das Abkommen CETA, aber auch das WPA mit Japan sind hierfür eigentlich erfolgreiche Beispiele, die man auch in Zukunft als Pilotprojekte, als wichtiges Element für die weiteren Verhandlungen mit einbringen sollte.

Schlusspunkt: Gerade die internationale Dimension der öffentlichen Auftragsvergabe hat ein Potenzial, als Wachstumstreiber für mehr Wachstum und neue Arbeitsplätze in Europa einen wichtigen Beitrag zu leisten.

  Andreas Schwab, im Namen der PPE-Fraktion. – Herr Präsident! Frau Kommissarin! Liebe Kolleginnen und Kollegen! Ich freue mich zunächst mal, dass der Kollege Böge aus dem Ausschuss für internationalen Handel nochmals die globale Dimension des europäischen Vergaberechts deutlich gemacht hat. Und es ist ein guter Moment für mich, darauf hinzuweisen, dass die Schwellenwerte, die wir in der Europäischen Union haben, die auch in Deutschland festgesetzt werden, nicht von der Europäischen Union festgelegt werden, sondern aus dem Global Procurement Agreement abgeleitet werden, und deshalb bestehen und deutlich machen sollen, dass die europäische Wirtschaft – anders als mancher Präsident der Vereinigten Staaten von Amerika – eben nicht Europe first alleine als Mittelpunkt sieht, sondern eine gewisse Offenheit der Märkte sicherstellen will, damit eben gerade unsere Firmen auch in anderen Märkten auf die gleiche Offenheit hoffen dürfen. Und da sollten sie auf Dauer nicht nur darauf hoffen dürfen, Frau Kommissarin, sondern da müssen wir noch mehr Druck dahinter bringen, dass tatsächlich auch andere Länder ihre Märkte genauso stark öffnen, wie wir unsere Märkte geöffnet haben.

Der Bericht des Kollegen Coelho, den ich außerordentlich begrüße, stellt meiner Ansicht nach deutlich dar, dass es in den Mitgliedstaaten eigentlich keinen Grund gibt, dass nach wie vor immer noch 55 % der Aufträge allein auf der Basis des niedrigsten Preises vergeben werden, weil wir mit der Vergaberechtsrichtlinie und der Reform 2014 eigentlich ganz viele Möglichkeiten für die Vergabebehörden, egal auf welcher staatlichen Ebene, geschaffen haben, das beste Angebot am Ende zuschlagsfähig zu machen. Deswegen mein dringender Appell an alle Vergabebehörden – nicht nur in Deutschland, sondern in ganz Europa –, sich genau zu überlegen, welche Bedingungen in die Ausschreibung aufgenommen werden, um am Ende tatsächlich das beste Angebot zu bekommen und nicht hinterher darüber zu klagen, dass wieder das billigste Angebot genommen wurde, und bestimmte rechtliche Schwierigkeiten im Nachgang bestehen.

Ich glaube, Frau Kommissarin – Sie haben zu Recht darauf hingewiesen –, dass wir mit der Digitalisierung im Bereich des Vergaberechts – und da ist Portugal ein leuchtendes Beispiel – noch viel Flexibilisierung und Transparenz schaffen können. Das sollte allen europäischen Unternehmen, gerade auch den kleinen und mittleren Unternehmen, noch erheblich helfen.

  Nicola Danti, a nome del gruppo S&D. – Signor Presidente, signora Commissario, onorevoli colleghi, con la revisione del quadro normativo relativo agli appalti pubblici del 2014, l'Europa si è dotata di una buona legislazione, le cui potenzialità non sono ancora state sfruttate appieno da gran parte degli Stati membri.

La relazione, per la quale ringrazio il collega Coelho e il nostro relatore Marc Tarabella, offre una panoramica completa sullo stato del recepimento e attuazione di tali norme, ma anche sulle problematiche più urgenti da affrontare a livello europeo e nazionale.

Io vorrei soffermarmi su tre punti, il primo: dobbiamo proseguire con l'applicazione dei criteri di qualità nell'aggiudicazione degli appalti. Troppo spesso dietro a un prezzo basso si celano concorrenza sleale, scarsa attenzione a sostenibilità, inclusione sociale e disabilità.

Secondo punto: dobbiamo prendere atto che le PMI europee e le imprese dell'economia sociale si aggiudicano solamente il 45% del valore degli appalti, in evidente contraddizione con il loro peso reale nell'economia. Su questo tema sarà necessario adottare misure concrete tra cui, ad esempio, la suddivisione obbligatoria in lotti, unita ad una migliore assistenza e formazione per le piccole e medie imprese.

Terzo punto: in parallelo alla costruzione del mercato unico digitale dobbiamo anche cambiare passo sul processo di digitalizzazione degli appalti pubblici. Abbiamo bisogno di procedure semplificate, di meno burocrazia e di maggiore trasparenza. Infine, vorrei citare anche il tema della reciprocità nel campo degli appalti pubblici internazionali. L'apertura dei nostri mercati pubblici non deve farci scordare quanto sia difficile, se non impossibile, per gli offerenti europei accedere ai mercati dei paesi terzi.

Uno squilibrio insopportabile a cui la Commissione e gli Stati membri devono rapidamente porre rimedio, ad esempio attraverso l'approvazione del cosiddetto strumento per gli appalti internazionali, ancora ostaggio di veti interni al Consiglio.

  Jasenko Selimovic, on behalf of the ALDE Group. – Mr President, I would like to thank Mr Coelho and the shadow rapporteurs for their smooth and good work. The potential of public procurement is obviously enormous. 250 000 public authorities in the Union spend around 14% every year of our GDP – nearly EUR 2 000 billion each year on purchasing services, work and supplies – and still, this enormous potential is not fully achieved. There are three reasons for that. Firstly, because Member States have been very late in transposing the 2014 directives on public procurement – so late that the Commission had to initiate infringement procedures against some of them, and, unfortunately, I do suspect they will again be late transposing for the next round of deadlines, notably regarding e—procurement.

Secondly, Member States’ authorities on a national, regional and local level are not using public procurement strategically. That’s why I urge them to not consider public procurement as an administrative burden, but a way to promote a smart, sustainable and inclusive growth, to force innovation to help SMEs to gain new markets, create new jobs.

Thirdly, because the practitioners of public procurement need further education. Those directives are indeed complicated and Member States should therefore organise training in order to get it right in public procurement and open university courses to develop public procurement studies and public procurement law.

That’s why I welcome all the action proposed here, all the strategies taken by the Commission, and I wish to remind everybody that an effective public procurement will lead to taxpayers’ money being better spent in the Union.

  Igor Šoltes, v imenu skupine Verts/ALE. – Gospod predsednik, hvala za besedo. Prvo, seveda, čestitke poročevalcu za odlično poročilo.

Res je, javna naročila so lahko odlično orodje za dosego številnih politik in to je bil tudi namen javnih naročil, ne samo na gospodarskem, pač pa tudi na socialnem, delovno-pravnem, tudi okoljskem, tudi na področju zdravja, na področju gerontologije, na področju demografskih sprememb. In seveda so javna naročila pokazala veliko dobrih stvari, hkrati pa tudi nekaj negativnih. Tisto, kar je slabo, je to, da tudi Evropska komisija ocenjuje kar 2 milijardi evrov korupcije na področju javnih naročil, kar je odločno preveč in tukaj morajo državni organi odločno ukrepati. In tudi na nekaterih področjih so se javna naročila prej pokazala kot breme ali pa ovira kot pa velika prednost in ena takih stvari je hrana, zlasti hrana za naše najranljivejše skupine prebivalstva, kot so otroci, starostniki in pa bolniki. In v tem delu mislim, da bi morali narediti korak naprej, biti bolj drzni, ker če zagotovimo zdravo, lokalno pridelano hrano za te najranljivejše skupine prebivalstva, dosežemo velike učinke. Prvič, izjemno poboljšamo zdravstveno sliko našega prebivalstva, manj zavržene hrane, omejimo nepoštene prakse, skrajšamo pot od vil do vilic, ohranjamo in razvijamo podeželje in ustvarjamo višjo samooskrbo in pa seveda tudi nova delovna mesta. Gre za učinke, ki so lahko merljivi, in ki pravzaprav govorijo o tem, da če pri javnem naročanju upoštevamo samo najnižjo ceno ali pa predvsem po tem postavimo na tehtnico zdravje in ceno, potem je jasno, da moramo dati prvo mesto ali pa prednost seveda zdravju.

Zato mislim, da je treba v tem paketu javnih naročil resno premisliti, ali bi ravno za področje veljalo upoštevati to, da hrano izvzamemo iz sistema javnih naročil, ker mislim, da smo to tudi dolžni našim prebivalcem zagotoviti višjo kakovost in zdravje.

  João Ferreira, em nome do Grupo GUE/NGL. – Senhor Presidente, a contratação pública é - deve ser - um importante instrumento ao dispor dos Estados para defender e promover o respetivo tecido produtivo, o emprego de qualidade e com direitos, a preservação ambiental, entre outros objetivos estratégicos.

Ora, sendo certo que o quadro legislativo vigente na União Europeia teoricamente abre a porta à consideração muito parcelar de algumas destas preocupações, na realidade há uma impossibilidade prática de explorar todo o potencial deste instrumento, uma vez que este quadro legislativo está submetido e constrangido pela sacrossanta lógica da livre concorrência no mercado único. Ou seja, a legislação está toda feita à medida dos interesses das grandes empresas, das grandes corporações transnacionais que, efetivamente, dominam o mercado único e que há muito fazem convergir sobre o mercado da contratação pública o seu apetite voraz ainda não inteiramente satisfeito.

Isto conjuga-se com o avanço do mercado sobre áreas que dele deviam estar resguardadas, nomeadamente no que se refere aos serviços públicos que foram progressivamente desmantelados, e privatizados, graças também à ação, à legislação e à pressão da União Europeia, precisamente para alargar o negócio da contratação pública.

  Andreas Schwab (PPE), Frage nach dem Verfahren der „blauen Karte“. – Herr Präsident! Der Kollege Ferreira hat ja die lustige Geschichte erzählt, dass hier alles irgendwie um multinationale Konzerne geht, das hört man immer wieder. Deswegen habe ich zwei Fragen an ihn.

Erstens: Haben Sie die Vergaberechtsreform von 2014 wirklich gelesen und gesehen, was für kleine und mittlere Unternehmen dort alles gemacht wurde? Zweitens: Was wollen Sie denn als weitere Auswahlkriterien wählen, wenn es nicht der Wettbewerb sein soll? Vielleicht haben Sie da ja gute Ideen, die ich noch nicht kenne.

  João Ferreira (GUE/NGL), Resposta segundo o procedimento "cartão azul". – Muito rapidamente, caro colega, efetivamente tenho presente na apreciação que aqui fiz, o conjunto de legislação que foi aprovado em 2014. Pese embora toda a retórica que a perpassa em defesa das pequenas e médias empresas, como de resto acontece com muitas outras legislações da União Europeia, a verdade é que toda ela, toda ela, precisamente por se submeter a essa lógica da livre concorrência no mercado único, está feita à medida dos interesses das grandes empresas, porque são essas que na livre concorrência no Mercado Único, efetivamente vão dominando esse mercado e não esquecer, não esquecer, porque é muito importante, esta ação conjuga-se com o desmantelamento que foi feito dos serviços públicos nas águas, nos correios, na energia, como agora também se quer fazer na saúde e se vai fazendo na saúde para abrir essas áreas precisamente à contratação pública.

  Tim Aker, on behalf of the EFDD Group. – Mr President, there needs to be a new way to look at procurement to make sure taxpayers’ money stays within the local area, creating jobs and ensuring local investment. Traditional rules meant big business swooped in and took huge local government contracts. The legal complications and expense in placing tender bids has squeezed out local competition. In my own borough of Thurrock in South Essex, residents were surprised to see the new gas maintenance provider had its head office in Liverpool. It’s as if there are no good quality local providers anymore, and big businesses consume all and leave nothing in their wake.

Procurement rules need to change to stop this, and Preston Council is showing just how to do it. It is prioritising contracts based on localism and keeping money in the local economy. Research from the Federation of Small Businesses has shown that, for every pound spent with a small or medium sized firm, 63 pence is respent locally – that drops to 40 pence or less with a large or multinational company.

Before Preston changed the way it looked at procurement, only one pound in twenty stayed in Preston. Surely we would be better off with local solutions to contracts and tendering wherever possible. From my own experience as a councillor, we would be better off with local maintenance contracts: people who live in the same community they look after making repairs.

The government may well say that austerity is over, but there are choppy waters ahead. Councils can prepare for this now by thinking differently about procurement, keeping money local in dividing up contracts to ensure money stays with local firms, and small businesses can help prepare for uncertain times ahead.

  Maria Grapini (S&D), întrebare adresată conform procedurii „cartonașului albastru”. – Domnule președinte, stimate coleg, sunt de acord cu ce ați prezentat dumneavoastră, dar nu credeți că achizițiile publice care sunt alocate unor companii mari - așa cum spuneți dumneavoastră - de fapt, folosesc un truc: pun un preț mic și ulterior adaugă la preț prin acte adiționale? Este o procedură pe care am întâlnit-o. Puteți să confirmați că aveți cunoștință de așa ceva?

  Tim Aker (EFDD), blue-card answer. – Yes, that’s a very good point, and what you see is a race to the bottom in contracts. But the experience in Preston is that if they keep contracts local and give to small and local businesses, the money is respent and reinvested, and local people are employed, which in the medium term will reduce expenditure at local government level. So I quite agree; I think it’s time that the rules were changed to keep money as local as possible to help the local economy.

  Mylène Troszczynski, au nom du groupe ENF. – Monsieur le Président, la transparence et le respect d’une certaine déontologie dans les passations de marchés publics sont des objectifs naturels, du simple bon sens, qui n’a pas attendu ce texte pour s’exprimer, mais qui exige toutefois un soutien logique de notre part.

Toutefois, le texte ne se cantonne pas à ces objectifs. Ces exigences de transparence et d’honnêteté sont associées à d’autres dispositions beaucoup moins évidentes. L’ouverture systématique et non négociable des marchés publics aux pays tiers pose de réels problèmes de souveraineté et d’indépendance. Les pouvoirs publics nationaux doivent pouvoir élaborer de manière indépendante les critères applicables pour le choix des entreprises qui remporteront ces marchés.

Cette différence de fond marque une fracture capitale entre les ultralibéraux qui gèrent l’Union européenne et les nationaux qui entendent protéger leur pays. Pour nous, les objectifs économiques, sociaux et environnementaux sont des objectifs sincères que vous ne cessez d’instrumentaliser au profit de votre projet sans frontières. Le localisme et la préférence nationale pour les marchés publics, dans la mesure des capacités, relèvent pour nous des intérêts stratégiques. Cette préférence nationale, nous l’assumons, c’est pourquoi nous voterons contre ce texte.

  Dobromir Sośnierz (NI). – Panie Przewodniczący! Trudno słuchać tych opowieści o tym, jak to zamówienia publiczne są po prostu jakimś wspaniałym oceanem niesamowitych możliwości, które się przed nami otwierają. Nie, zamówienia publiczne są złem koniecznym. Zamówienia publiczne są sytuacją, w której urzędnicy wydają cudze pieniądze na cudze potrzeby. Jest to najgorszy możliwy sposób wydawania pieniędzy, bo kiedy człowiek wydaje własne pieniądze na własne potrzeby, to wydaje je efektywnie i oszczędnie, a jak wydaje cudze pieniądze na cudze potrzeby, to wydaje je nieefektywnie i nieoszczędnie. W związku z tym to, co należy przede wszystkim robić, to wycofać państwo ze wszystkiego, gdzie nie jest ono absolutnie niezbędne. Jeśli się wycofamy, nie będziemy musieli stosować zamówień publicznych i męczyć się z nieuczciwymi urzędnikami. Nie da się wyplenić korupcji. Nie da się wyplenić wszystkich wad zamówień publicznych. Jeśli stosujemy kryterium najniższej ceny, to ono ma tę zaletę, że jest obiektywne i zawsze da się sprawdzić, która cena była najniższa. Jeśli stosujemy inne kryteria, kryteria społeczne, zaraz może się okazać, że to właśnie kolega urzędnika, nikt tak świetnie nie spełnia tych kryteriów społecznych jak właśnie on. Wikłamy się więc w prawdopodobieństwo korupcji. Ani tak, ani tak nie jest dobrze, więc to, co należy robić, to wycofywać państwo ze wszystkiego, gdzie nie jest ono niezbędne.

  Angelika Niebler (PPE). – Herr Präsident, verehrte Frau Kommissarin, liebe Kolleginnen und Kollegen! Ich würde gerne einen Punkt aus dem exzellenten Bericht des Kollegen Coelho herausgreifen, den ich sehr wichtig finde. Und zwar ist in dem Bericht festgehalten, dass die Zahl der Ausschreibungen mit nur einem Angebot im Zeitraum von 2006 bis 2016 von 14 % auf 29 % gestiegen ist. Also, um es nochmal auf den Punkt zu bringen: Ein Drittel aller Ausschreibungen führen dazu, dass es einen Anbieter gibt. Ich finde das als Zahl, ehrlich gesagt, sehr, sehr alarmierend. Und wenn man sich überlegt, woran das liegt, dann muss man schon auch mal zur Kenntnis nehmen, dass es auch für KMU, für mittelständische Unternehmen vielleicht zu viel Aufwand verursacht, sich an Ausschreibungen zu beteiligen.

Wir haben jetzt in meiner Heimatgemeinde eine neue Schule errichtet. Auch da waren wir über dem Schwellenwert von fünf Millionen. Das heißt, wir haben europaweit ausgeschrieben und wir hatten auch nur einen Anbieter. Und ich kann Ihnen sagen, der Verdruss bei den öffentlichen Stellen ist natürlich immens. Man schreibt europaweit aus, ein Riesenaufwand ohne Ende, und dann bewirbt sich einer oder aus der Region bewerben sich zwei. Da fragt man sich schon: Muss man alles europaweit ausschreiben?

Was will ich damit sagen? Ich möchte zum einen betonen, dass man bei der Vergabe von öffentlichen Aufträgen eben auch die Interessen der öffentlichen Stellen und den Aufwand berücksichtigen muss. Und mich würde es sehr freuen, wenn wir – nicht jetzt, nicht in der nächsten Zeit, aber bei der nächsten Revision der Regeln zur öffentlichen Auftragsvergabe – auch nochmal über die Schwellenwerte diskutieren würden. Ich finde das Instrument sehr gut. Wir brauchen Transparenz. Wir müssen einen fairen Wettbewerb bei den öffentlichen Ausschreibungen zulassen. Aber es kann nicht sein, dass ein Drittel aller Ausschreibungen letztlich komplett ins Leere läuft. Da müssen wir uns überlegen, woran das liegt. Ich glaube, gerade im Baubereich ist da eben noch entsprechend Bedarf, dort zu korrigieren, weil es nicht sinnvoll ist, für den Schulbau in meiner Heimatregion Bayern aus Portugal oder aus Zypern oder von sonstwo anzureisen. Also das bitte ich einfach dann für die nächste Revision mitzunehmen.

  Virginie Rozière (S&D). – Monsieur le Président, je voudrais d’abord remercier le rapporteur ainsi que notre rapporteur fictif, Marc Tarabella, pour leur travail sur ce rapport.

Les chiffres ont été rappelés, on connaît l’importance des marchés publics dans l’économie européenne: 14 % du PIB, 2 000 milliards d’euros. C’est donc un outil puissant pour transformer nos économies et imprimer à l’activité économique des valeurs autres que la simple maximisation du profit financier.

En particulier, le dernier paquet législatif, qui date de 2014, reste malheureusement sous-utilisé par les acheteurs publics européens. Je pense bien sûr à l’utilisation des souplesses qu’il prévoit pour permettre de mettre en avant des critères autres que ceux du moins-disant financier et de prendre en compte des questions comme l’inclusion sociale ou la qualité environnementale dans la sélection des offres.

Ce nouveau paquet est un outil supplémentaire pour, justement, mieux faire connaître ces possibilités, mieux former les acheteurs publics et faire en sorte que les marchés publics jouent pleinement leur rôle en faveur d’une activité économique qui serait plus vertueuse et plus durable.

  Bernd Kölmel (ECR). – Herr Präsident! Die Vergabe öffentlicher Aufträge ist eine wirklich sehr sensible Tätigkeit, wo der Staat zeigen muss, dass er sorgfältig mit dem Geld der Bürger umgeht. Das heißt, wir müssen hier mehrere Punkte beachten. Zum einen muss alles ordnungsgemäß verlaufen, andererseits müssen wir Wirtschaftlichkeit und Sparsamkeit in eine vernünftige Balance bringen. Damit die Bürger das nachvollziehen können, was der Staat mit ihrem Geld macht, muss entsprechende Transparenz herrschen. Das heißt, ganz wichtig ist: Diese Verfahren müssen so aufgestellt sein, dass wirklich jeder Bürger, jede Firma das nachvollziehen kann.

Gleichzeitig können wir hier nur erfolgreich sein, wenn diese Verfahren möglichst unbürokratisch sind. Das heißt – wie auch Frau Niebler gesagt hat: Wir können hier nicht alles über einen Kamm scheren. Wir müssen darauf achten, dass die Verfahren für Bieter möglichst effizient durchgeführt werden können. Ansonsten haben wir zwar theoretisch tolle Regelungen, aber praktisch laufen die ins Leere, weil dann die Firmen nicht in der Lage sind, die ganzen Bedingungen zu erfüllen. Deshalb sollten wir unbedingt überlegen, ob wir nicht in einzelnen Bereichen die Schwellenwerte so verändern, dass wir nicht unnötige Bürokratie erzeugen.

  Bas Eickhout (Verts/ALE). – Voorzitter, allereerst dank aan de rapporteur voor dit rapport. Ik denk inderdaad dat wij erkennen dat in er 2014, in de herziening voor openbare aanbestedingen flinke verbeteringen zijn aangebracht, dat we ook niet meer alleen naar de prijs hoeven te kijken, maar ook naar de kwaliteit. Dat is een belangrijke verbetering. Echter in Nederland heeft dit ook al weer geleid tot wat nieuwe problemen. Met name in zorg en lokale zorg, omdat dat in Nederland naar gemeentelijk niveau is gebracht. Dat heeft er in de praktijk toe geleid dat men in vele gemeentes bij de inkoop van zorg meer bezig is met de aanbestedingsregels en dat er ongelooflijk veel bureaucratie omheen is gekomen om te zorgen dat ze voldoen aan die regels van 2014. Die problemen zouden een zorg moeten zijn voor de Commissie, zeker een Commissie die zegt dat betere regelgeving belangrijk is. Commissaris, twee van mijn nationale collega's hebben al vragen gesteld uit het nationale parlement aan de Europese Commissie en die hebben de problemen ook al bekendgemaakt. Maar ik zou toch graag van u antwoorden willen hebben op twee vragen. Allereerst, bent u bereid om lidstaten meer ruimte te bieden om onbedoelde negatieve effecten van deze wetgeving op de kwaliteit van lokale zorg te voorkomen? En twee, gaat u bij de evaluatie van de richtlijn specifiek kijken welk effect het onderbrengen van de sociale diensten onder deze richtlijn heeft?

  Σωτήριος Ζαριανόπουλος (NI). – Κύριε Πρόεδρε, οι δημόσιες συμβάσεις, δηλαδή η ιδιωτική εκμετάλλευση δημόσιας περιουσίας, αποτελούν τεράστια αγορά, πεδίο κερδοφορίας τρισεκατομμυρίων και ανταγωνισμού των μονοπωλίων σε ευρωενωσιακό και παγκόσμιο επίπεδο και, βέβαια, θερμοκήπιο σκανδάλων. Γι’ αυτό και η ανησυχία και η επιθετική στρατηγική της Ένωσης για διασυνοριακό άνοιγμα συμβάσεων ευρωπαϊκών και τρίτων χωρών, αλλά και προστατευτισμό της απέναντι στις τελευταίες, ακόμα και με προσαρμογή των κριτηρίων ανάθεσης στα μονοπωλιακά συμφέροντα.

Στην Ελλάδα με όλες τις κυβερνήσεις, δημόσιες συμβάσεις με ιδιώτες σημαίνει τσουνάμι fast-track ιδιωτικοποιήσεων των πάντων. Παραδόθηκαν δρόμοι, αεροδρόμια, λιμάνια, ακτοπλοΐα, συγκοινωνίες, ορυκτός πλούτος, ενέργεια, τηλεπικοινωνίες, νερό, βουνά, παραλίες, στρατιωτικές παραγωγικές υποδομές, υδρογονάνθρακες, ανακύκλωση, υγεία, παιδεία – τα πάντα. Αποκορύφωμα η παράδοση όλης της δημόσιας περιουσίας της χώρας για 99 χρόνια από την κυβέρνηση ΣΥΡΙΖΑ-ΑΝΕΛ στους δανειστές.

Φυσικό πλούτο και πλούτο βγαλμένο από τους φόρους και τον ιδρώτα του λαού καλείται ο ίδιος να τον ξαναπληρώσει στα ταμεία των ιδιωτών με διόδια, αύξηση τιμολογίων, δάνεια και ευρωενωσιακές επιδοτήσεις που φορτώνεται. Μόνος δρόμος να βγει από τη μιζέρια και να ικανοποιήσει τις ανάγκες του: όλος αυτός ο πλούτος να γίνει λαϊκή περιουσία με κεντρικό σχεδιασμό, εργατικό έλεγχο και λαϊκή εξουσία.

  Adam Szejnfeld (PPE). – Panie Przewodniczący! Rozmawiamy na temat fundamentalnie ważny i nie tylko ze względu na ogromny rynek pracy, ale także ogromne pieniądze, które wchodzą w grę. Dlatego też musi smucić bardzo słabe tempo wdrażania dyrektywy z 2014 r. Dzisiaj chciałbym wskazać na kilka istotnych spraw związanych z zamówieniami publicznymi.

Po pierwsze, występuje absolutna konieczność wzmocnienia kryteriów jakości w stosunku do kryteriów ceny, była o tym mowa. I to dotyczących całego cyklu życia produktu czy usługi, a nie tylko jakości na starcie, gdy dokonujemy zamówienia. W dzisiejszych czasach koniecznością staje się także uwzględnienie tempa zmian w technice i technologiach. Mało tego – powiedziałbym, że zamówienia publiczne powinny nie tylko odpowiadać na zmiany w technologiach, ale także stymulować nowe zmiany.

I to, co jest chyba najważniejsze – powinniśmy zmniejszyć biurokrację zamówień publicznych, a zwiększyć elastyczność zamówień publicznych. Zamawiający, ale także wykonawcy muszą mieć szansę na zareagowanie na zmianę warunków wykonania zamówienia, a często mamy do czynienia z sytuacją – właśnie teraz, kiedy jest na przykład duży rozwój, a spadek podaży siły pracy – że następuje wzrost kosztów pracy, wzrost cen surowców, półproduktów etc., natomiast elastyczności nie ma i nie można dokonać żadnych zmian. Bardzo wielu wykonawców po prostu schodzi z budów. Te kwestie są, moim zdaniem, fundamentalnie ważne, oprócz takich jak zwiększenie symetrii dostępu do rynku unijnego i unijnych przedsiębiorców do rynków państw trzecich czy wzmocnienie roli i udziału małych i średnich przedsiębiorstw.

B’hekk nemmen li r-rapport, kif inhu mfassal, u li fuqu ħa jittieħed vot, għandu jidħol fis-seħħ. B’dan il-mod inkunu qegħdin niżguraw strateġija ta’ akkwist pubbliku li hija ferm aktar aċċessibbli għaċ-ċittadin, għall-entitajiet ta’ gvernijiet u entitajiet privati, filwaqt li nżidu wkoll it-trasparenza.

Dan ir-rapport huwa importanti għax permezz tiegħu ħa tinħoloq sistema ta’ e—procurement li ħa tiffaċilita l-applikazzjoni tat-trasparenza tagħhom, kif ukoll ħa toħloq pjattaforma li biha kumpaniji pubbliċi ħa jkollhom iżommu ma’ standards tal-Unjoni Ewropea b’mod aktar korrett.

Punt li dan ir-rapport jisħaq fuqu: l-implimentazzjoni unanima bejn l-Istati Membri tal-Unjoni. Nixtieq ngħid li Malta diġà implimentat il-liġijiet Ewropej dwar l-akkwist pubbliku, qabel bosta Stati Membri oħra. B’hekk nappella lill-Istati Membri biex jappoġġjaw sistemi bħal din li qed tiġi proposta fl-interess taċ-ċittadini u fl-interess tat-trasparenza.

  Λάμπρος Φουντούλης (NI). – Κύριε Πρόεδρε, οι δημόσιες συμβάσεις, ειδικά σε ορισμένα κράτη μέλη, αποτελούν χρονίζουσα πληγή και πηγή διαφθοράς. Δυστυχώς όμως έχουν υπάρξει περιπτώσεις στις οποίες και ευρωπαϊκοί θεσμοί δεν είχαν και την καλύτερη διαγωγή. Είναι θεμιτή η εξεύρεση νέων μεθόδων ανάθεσης των δημοσίων συμβάσεων και βελτιστοποίηση των υφισταμένων, με γνώμονα πάντα τη μεγαλύτερη διαφάνεια, τη μεγαλύτερη αποτελεσματικότητα και λιγότερη γραφειοκρατία, για το δημόσιο συμφέρον.

Προσωπικά όμως θεωρώ πως η χαμηλότερη τιμή θα πρέπει να εξακολουθήσει να διαδραματίζει σημαντικό ρόλο στην ανάθεση συμβάσεων, με την παράλληλη εισαγωγή νέων κριτηρίων. Σε κάθε περίπτωση, θα πρέπει να μην παραβιάζεται η κυριαρχία των κρατών μελών, τα οποία και πρέπει να έχουν τον τελικό λόγο σε κάθε δημόσια σύμβαση. Ταυτόχρονα όμως πρέπει να παρακολουθούνται στενά οι διαγωνισμοί, ώστε να μην επαναληφθούν φαινόμενα εκτεταμένης διαφθοράς, όπως έχουν παρατηρηθεί σε πολλές χώρες της Ενώσεως. Βασικός σκοπός πρέπει να είναι πρώτα απ’ όλα η πάταξη τέτοιων φαινομένων. Δεν μπορούμε πλέον να επιτρέψουμε σε ορισμένους να πλουτίζουν εις βάρος των πολιτών.

  Maria Grapini (S&D). – Domnule președinte, doamnă comisar, stimați colegi, este foarte bine că avem un raport din proprie inițiativă a Parlamentului pe acest subiect, este foarte bine că reanalizăm pachetul legislativ privind achizițiile publice. De altfel, în 2014, când a fost modificată directiva, eu am avut nemulțumirile mele și, iată, s-a dovedit că am avut dreptate. În primul rând, directiva din 2014, din punctul meu de vedere, este extrem de generală, evazivă și dă voie ca în statele membre să existe o diferență foarte mare din punct de vedere al legislației naționale la achiziții publice.

Și acum ne confruntăm cu câteva lucruri foarte mari și nu știu, doamnă comisar, cum le putem rezolva cu noul pachet. De exemplu, contestațiile. Contestațiile prelungesc foarte mult cheltuirea banilor pe care se presupune că vrem să-i cheltuim pentru a avea un efect al investiției respective imediat. Nu există o definiție foarte clară - cine poate și când să facă contestație, cum definim persoana interesată, pentru că nu poate un butic să conteste o licitație pentru o infrastructură rutieră.

Apoi, prețul cel mai mic - s-a discutat aici - nu se aplică și Comisia a făcut această analiză: peste șaizeci la sută din achiziții nu sunt la prețul cel mai mic. Și mai este o problemă: cercetarea - mai ales cercetarea medicală. Din punctul meu de vedere, achizițiile pentru cercetarea medicală ar trebui să fie excluse.

  Herbert Dorfmann (PPE). – Herr Präsident! Ich war in der Tat Berichterstatter für die Stellungnahme im ENVI-Ausschuss. Da scheint offiziell die Ausschussvorsitzende auf, aber in Wirklichkeit habe ich den Bericht gemacht. Ich habe mich in meinem Bericht vor allem darauf fokussiert, was die Beschaffung von Lebensmitteln für öffentliche Aufgaben angeht, zum Beispiel für die Mensen, in Kindergärten, in Schulen oder auch in Krankenhäusern. Ich denke, dass gerade dort die Kunden und vor allem auch die Eltern der Schüler zum Beispiel lokale Lebensmittel möchten und dass es manchmal etwas absurd ist, wenn die öffentlichen Verwaltungen dann gezwungen sind, über öffentliche Ausschreibungen Produkte zu kaufen, die von weit her gekarrt werden.

Ich habe jedes Verständnis für den europäischen Binnenmarkt. Ich denke, dass er gut und vernünftig ist. Aber ich denke auch, dass wir gerade in solchen Fällen doch auch Vernunft walten lassen müssen und dem Wunsch der öffentlichen Verwaltungen und dem Wunsch der Kunden, der Nutzer dieser öffentlichen Mensen nach lokalen Lebensmitteln auch eine Antwort geben müssen. Deswegen, denke ich, müssen wir bei den öffentlichen Ausschreibungen eine Lösung finden, so dass gerade in diesem Bereich die Auftraggeber die Chance haben, lokale Lebensmittel zu kaufen.

  Rory Palmer (S&D). – Mr President, I agree with much of what has been said this morning in the debate about the need to make procurement processes more accessible to SMEs, and indeed charities and local voluntary organisations as well, but the issue I want to highlight specifically is the scandal that is modern slavery.

Cases of modern slavery are increasing across the European Union. In my own country, 136 000 people are estimated to have been victims of modern slavery in 2017. It would be a scandal if modern slavery is being propped up and supported by the spending of public money through procurement and the supply chains of organisations winning public contracts.

So I endorse – and I hope this Parliament can endorse this morning – action to tackle modern slavery through procurement. One specific example is the Co—operative Party’s Charter Against Modern Slavery, which local and public authorities are signing in the UK. When it comes to modern slavery in public procurement, there can be nowhere to hide.

  Rupert Matthews (ECR). – Mr President, thank you for calling me to speak on this important issue. When it comes to government procurement, big is convenient. Big companies and big contracts are beloved by far too many who award government contracts. But small is beautiful. Small companies can be more effective, more efficient and very often cheaper than their large rivals.

Unfortunately, however, smaller companies are very often excluded from tendering for contracts, and I’m very pleased to be supporting this report, which seeks to address that.

But we need to go further. In my region, smaller companies suffer very often from late payments, from convoluted bureaucracy, from all sorts of bureaucratic hoops that they have to jump through in order to get the contracts and in order to be paid after they have done the work.

Small is beautiful. Small companies offer a good deal to government, a good deal for local workers. We must do more to encourage them.

  Γεώργιος Επιτήδειος (NI). – Κύριε Πρόεδρε, κάθε κράτος συνάπτει, έναντι αμοιβής, συμβάσεις με διάφορες εταιρείες και εγχώριες και εταιρείες του εξωτερικού. Oι συμβάσεις αυτές διαδραματίζουν σημαντικό ρόλο για την ανάπτυξη της οικονομίας του κράτους, διότι συνήθως γίνονται σε τομείς με μεγάλη στρατηγική σημασία, όπως είναι η βαριά βιομηχανία, τα δημόσια έργα, οι κατασκευές, η ενέργεια, οι τηλεπικοινωνίες και άλλα. Με τις συμβάσεις λοιπόν αυτές το κράτος προσπαθεί να προωθήσει την οικονομική –και όχι μόνο– πολιτική του, αρκεί βεβαίως να μην έχει εκχωρήσει όλες τις παραγωγικές του πηγές στους ξένους, όπως έχουν κάνει οι τελευταίες κυβερνήσεις στην Ελλάδα λόγω της εφαρμογής των μνημονίων.

Εν πάση περιπτώσει, για να έχει επιτυχία αυτή η προσπάθεια, εκείνο που έχει σημασία είναι να υπάρχει δυνατότητα προσβάσεως και σε αγορές τρίτων χωρών. Οι χώρες αυτές έχουν, λόγω προστατευτισμού, δημιουργήσει δυσχέρειες στην πρόσβαση και στις προσφορές από ευρωπαϊκές εταιρείες. Γι’ αυτό λοιπόν το λόγο και για να υπάρχει ισορροπία στα μέτρα του θεμιτού ανταγωνισμού, οι ευρωπαϊκές χώρες θα πρέπει να εκμεταλλευτούν τις οδηγίες που έχουν δοθεί με τη μεταρρύθμιση του νομοθετικού πλαισίου για τις συμβάσεις.

  Krzysztof Hetman (PPE). – Panie Przewodniczący! Szanowna pani komisarz! Koleżanki i koledzy! Zamówienia publiczne i prawo je regulujące są niezwykle ważnym elementem prawidłowego funkcjonowania nie tylko na poziomie krajowym, ale przede wszystkim wśród władz i jednostek lokalnych i regionalnych. Dlatego cieszę się, że Komisja podjęła inicjatywę opracowania strategii, która koncentruje się na sześciu jasno sformułowanych priorytetach. Procedury związane z zamówieniami publicznymi muszą być przede wszystkim przejrzyste i zrozumiałe, dlatego popieram postulat ich maksymalnego możliwego uproszczenia. Duży potencjał w tym kierunku leży w wykorzystaniu nowych technologii, aby stworzyć tzw. e-zamówienia publiczne, całościowo realizowane online. Chciałbym także podkreślić, jak ważne jest, aby kryteria rozstrzygania przetargów zostały wzbogacone o inne wskaźniki niż tylko najniższa cena. Instytucje kontraktujące muszą zwracać uwagę na jakość i zrównoważony charakter projektów.

  Νότης Μαριάς (ECR). – Κύριε Πρόεδρε, 250.000 δημόσιοι φορείς αναθέτουν δημόσιες συμβάσεις για έργα, για προμήθειες, για υπηρεσίες. Το κόστος είναι 2 τρισεκατομμύρια ευρώ, δηλαδή το 14% του ΑΕΠ. Αντιλαμβάνεται κανείς ότι πρόκειται για τεράστια, για σημαντικά ποσά των φορολογουμένων και έχει αποδειχθεί ότι στον χώρο των δημοσίων συμβάσεων επί της ουσίας έχουν γίνει πάρα πολλά σκάνδαλα.

Ταυτόχρονα, οι δημόσιες συμβάσεις θα μπορούσαν να στηρίξουν την ανάπτυξη, να δημιουργήσουν θέσεις εργασίας, να συμβάλουν στην ενίσχυση της στρατηγικής του ίδιου του κράτους, λαμβάνοντας υπόψη κοινωνικά και περιβαλλοντικά κριτήρια. Βλέπουμε ότι οι μικρομεσαίες επιχειρήσεις έχουν πάρει μόνο το 45% των αναθέσεων, ενώ το 55% των αναθέσεων έχει γίνει με βάση την αρχή της χαμηλής τιμής, δηλαδή του μειοδότη, που δεν σημαίνει ότι πάντοτε υπάρχει μια εγγύηση ότι τα έργα είναι αποδοτικά.

Ταυτόχρονα, η διεθνοποίηση δημιουργεί προβλήματα στην Ευρωπαϊκή Ένωση, καθώς ανοίγει την αγορά, όπως έγινε με τις συμφωνίες CETA και ΤΤΙΡ, ενώ άλλες τρίτες χώρες κρατούν κλειστές τις δικές τους αγορές. Ας εξετάσουμε λοιπόν ορισμένα στοιχεία, είτε την τοπικότητα είτε την εθνική προτίμηση, ως στοιχεία ενίσχυσης της ανταγωνιστικότητας των ευρωπαϊκών επιχειρήσεων.

Przyznam, że jestem zwolennikiem ograniczania ilości środków finansowych wydawanych przez podmioty publiczne w zamówieniach publicznych, ale jeszcze bardziej jestem przeciwnikiem prowadzenia działalności gospodarczej przez podmioty publiczne, zwłaszcza przez samorządy. Mam wrażenie, że w ostatnim czasie właśnie ten drugi element niestety umyka kontroli rozmaitych instytucji i powinien być objęty specjalnym monitoringiem.

Natomiast zwrócę uwagę na dwa elementy, chcąc pochwalić kolegę Carlosa Coelho, dlatego że wykonał, według mnie, dobrą pracę. Mamy dwa elementy, które decydują o jakości przetargu. Z jednej strony – ustawodawstwo, czyli te zewnętrzne ramy finansowe, ale z drugiej strony – także precyzja samego zamówienia. Wydaje mi się, że w ostatnim czasie, na podstawie obserwacji wielu rozmaitych postępowań przetargowych, zwłaszcza ten drugi element pozostawia wiele do życzenia. I na to zwracam uwagę na koniec swojego wystąpienia.

  Elżbieta Bieńkowska, Member of the Commission. – Mr President, even from this discussion it is clear how important this subject is. I want to reiterate that the reason we decided to adopt this packet is not because we have bad legislation. The legislation is new, the legislation is fresh, and we think this is good legislation. What is bad is the implementation. This is in response to those of you who are saying that there is not enough flexibility: the legislation gives a lot of flexibility and room to manoeuver. Of course, laws must be obeyed, but it gives quite a lot of room for manoeuver, for example, for social services, from the possibility of exclusion via a light regime to integration of all of the social criteria in tendering. For this specific topic, we are preparing some guidelines on social public procurement to help Member States.

We also share with you the opinion that the digitisation of public procurement is extremely important. On the one hand, it will substantially improve transparency, for example, regarding late payments. On the other hand, we see in the Member States that have implemented e—procurement, that it has increased the participation of small and medium-sized enterprises in the process. Only a few Member States have introduced such an option, but the Commission advocates for the full cycle of public procurement.

Concerning the local level. Many of you mentioned this, and I fully understand it. I had a lot of personal experience with public procurement. Let me tell you, it is not European legislation that is a huge burden for them. The burden is the gold-plating: these are additional things added to the legislation during the transposition process. This is a problem. This is a serious problem everywhere in Europe, and that’s why we decided that this is not the moment for thinking about any changes in the legislation. But in this partnership that we want to create, this exchange of views and guidance, it’s sometimes fear that really stops people from taking the right decision. They just don’t know, they do not have enough skills and they just don’t know how to do it.

Some of you mentioned the late transposition of the directive: the largest deficit in such statistics that we have is in Germany, because the state of transposition is very late. Therefore, we do not have statistics on how it works on the ground.

Let me just add that since the adoption, we have implemented an ex—ante tool for large investment projects. This has already launched a very concrete service to help public buyers to apply the rules and to avoid problems while tendering for really big sums on infrastructure projects. We have disseminated several hundred examples of good practices on professionalisation. We have published our innovation guidance document, but as I said, the next one will be on the social topic and social public procurement.

I’m strongly committed, both to the subject and to the topic, and I am strongly committed to maintaining this discussion with you, because this topic is really worthwhile.

  Carlos Coelho, Relator. – Senhor Presidente, queria agradecer à Comissária Bienkowska as referências que fez e aquilo que disse. Começar exatamente por sublinhar o que ela referiu agora. Nós estamos perante um caso evidente em que a Europa esteve bem, em que aprovamos o nosso quadro legislativo a tempo e onde os problemas resultam da lenta e às vezes errada transposição de legislação pelos Estados-Membros. Não podemos pedir mais a nós próprios. Temos é que pedir aos Estados-Membros para não prejudicarem aquilo que fomos capazes de fazer a nível europeu.

Queria agradecer a todos os colegas os contributos que deram e sublinhar três pontos: primeiro, acho que há um grande consenso relativamente aos grandes objetivos desta iniciativa, a ideia de que, com este instrumento, vamos promover mais transparência e combater a corrupção, vamos garantir uma competição justa e vamos ter instrumentos para prosseguir objetivos de inovação, de economia ecológica e circular e de crescimento sustentável e inclusivo, a ideia de que aqui também temos de ter critérios sociais.

A segunda ideia, a preocupação com as pequenas e médias empresas. Creio que foi geral à maior parte das intervenções que ouvimos durante esta manhã, e em terceiro e último lugar, a ideia da digitalização, não apenas como uma ferramenta para a simplificação dos processos, mas também para assegurar uma melhor transparência.

Senhor Presidente, creio que esta é uma preocupação de todos, garantir que o dinheiro dos contribuintes é bem gasto, é uma exigência que todos os nossos cidadãos fazem e espero que no voto de hoje haja um sinal claro do Parlamento Europeu à volta das recomendações que propomos.

  Lidia Joanna Geringer de Oedenberg (S&D), na piśmie. – Dyrektywy z 2014 r. były nie tylko przeglądem ram prawnych Unii w zakresie zamówień publicznych, ale również modernizowały prawa za nie odpowiedzialne. Ta szeroka reforma miała bezpośrednio służyć realizacji strategii „Europa 2020” i znacznie przyczynić się do wzrostu i konkurencyjności Unii Europejskiej. Wymogiem dyrektyw była między innymi cyfryzacja zamówień publicznych.

Cztery lata po formalnym przyjęciu dyrektyw nie ma pełnego wglądu w sytuację, jak dyrektywy zostały transponowane i jak są wdrażane w poszczególnych krajach UE. W wielu państwach członkowskich wystąpiły znaczne opóźnienia w transpozycji, zmuszające Komisję do wszczęcia postępowanie w sprawie uchybienia zobowiązaniom państwa członkowskiego.

Ważnym krokiem przyjętym w powyższym sprawozdaniu jest wprowadzenie zestawu miękkich środków mających na celu zwiększenie skuteczności wdrażania zasad dotyczących zamówień publicznych w państwach członkowskich oraz przyśpieszenie reform krajowych. Niemniej jednak Parlament Europejski zastrzega sobie prawo do złożenia w każdej chwili wniosku do Komisji Europejskiej o zaproponowanie środków legislacyjnych w celu udoskonalenia ram dotyczących zamówień publicznych.

  Rolandas Paksas (EFDD), raštu. – Viešųjų pirkimų sistema turi būti skaidri ir sąžininga. Tai yra svarbi priemonė, kuri padeda spręsti viešosios politikos klausimus, tokius kaip socialinės atskirties mažinimas, darbo vietų kūrimas, aplinkos tvarumo didinimas Efektyvus viešųjų pirkimų vykdymas turi būti užtikrinamas visoje ES. Labai svarbu, kad būtų tinkamai panaudojamos viešųjų pirkimų efektyvumą skatinančios priemonės. Turi būti didinamas viešųjų pirkimų administravimo efektyvumas. Pati viešųjų pirkimų procedūra turi būti aiški, nesukurianti nereikalingos administracinės naštos. Ypatingas dėmesį reikia skirti MVĮ. Joms turi būti sudarytos tinkamos sąlygos dalyvauti konkursuose. Taip pat manau, kad reikia skatinti spartesnį skaitmeninimą, kas, savo ruožtu, prisidėtų prie skaidrumo didinimo, padėtų užkirsti kelią sukčiavimui ir korupcijai viešųjų pirkimų procese.

  Pirkko Ruohonen-Lerner (ECR), kirjallinen. – Euroopan unionissa käytetään vuosittain jopa kaksi biljoonaa euroa julkisiin rakennusurakoihin sekä palvelu- ja tavarahankintoihin. Kysymyksessä on valtava määrä veronmaksajien rahaa, minkä johdosta hankinnat olisi toteutettava mahdollisimman tehokkaasti, eettisesti ja avoimesti. Olen tyytyväinen siihen, että hankintamarkkinoille pääsyn helpottaminen on yksi komission painopistealueista julkisissa hankinnoissa. Pidän erittäin tärkeänä sitä, että tarjouskilpailut toteutetaan siten, että myös pienet ja keskisuuret yritykset voivat niihin osallistua. Ei ole oikein, jos tarjouskilpailut räätälöidään sopiviksi vain tietyille yrityksille. Mietinnössä mainitut kehotukset esimerkiksi julkisten hankintasopimusten osiin jakamisesta ja liikevaihtorajasta ovat kannatettavia, jotta voidaan tarjota reilut kilpailuedellytykset myös pienemmille toimijoille. Pienten ja keskisuurten yritysten tukemisen lisäksi julkisten hankintojen avulla voidaan edistää esimerkiksi ympäristöystävällisyyttä ja kiertotaloutta, innovaatioita ja sosiaalisia tavoitteita, kuten ikäihmisten ja vammaisten parempaa hoivaa. Pidän huolestuttavana tietoa siitä, että kilpailu unionin julkisten hankintojen yhteydessä on viime vuosina heikentynyt. Joissain jäsenmaissa tarjouskilpailuista suuri osa on sellaisia, joissa tarjouksia tulee vain yksi. Tällainen tilanne ei voi taata parhaita mahdollisia palveluja ja hankintoja parhaaseen mahdolliseen hintaan.

  Algirdas Saudargas (PPE), raštu. – Ar viešieji pirkimai, kur vienintelis kriterijus yra mažiausioji kaina, tikrai skatina ekonomiką, mažina socialinę atskirtį, yra ekologiškai tvarūs ir padeda atsirasti inovacijoms? Ar pakanka skaidrumo ir paprastumo Europos Sąjungos valstybėse narėse, suprantama, ir Lietuvoje, vykdomiems viešiesiems pirkimams? Ar mažos ir vidutinės įmonės (MVĮ) sulaukia pakankamai valstybės dėmesio, turint omeny jų galimybes dalyvauti viešuosiuose pirkimuose? Viešieji pirkimai yra svarbi rinkos dalis, o norėdami įgyvendinti socialios rinkos principus, turėtume siekti, kad viešieji pirkimai būtų socialiai atsakingi. Pritariu, kad Europos Parlamentas bent rezoliucijos forma paragintų valstybes nares vertinti viešuosius pirkimus kaip galimybę skatinti tvarią, socialiai atsakingą ekonomiką, atverti kelius inovacijoms, įgalinti augti ir stiprėti konkurencinėje aplinkoje MVĮ. Mažiausia kaina ir ekonomiškai naudingiausias pasiūlymas ne visada sutampa. Išties svarbu atsižvelgti į visą produktų gyvavimo ciklą, į aplinkosauginius reikalavimus, socialinius aspektus. Labai aktualus yra ir viešųjų pirkimų skaitmeninimo aspektas, inovatyvių technologijų diegimas padėtų spręsti kalbos barjero klausimus bei skatinti tarpvalstybinius viešuosius pirkimus.

  Charles Tannock, author. – Mr President, I cautiously welcomed the 2016 decision to ease some of the restrictive measures against Belarusian officials as part of an EU broader strategy of engagement with that isolated country. But now, given the annexation of Crimea by Russia and its offensive in the east of Ukraine, there is a belief that Lukashenko, the President of Belarus, may have somehow welcomed warmer relations with the European Union as a counterweight to Russia’s dominance of the country, fearing that he too could go the way of President Yanukovych of Ukraine. Such an approach, it was hoped, might yield results in terms of greater freedom and democratic and human rights within Belarus and opening up the country to the west.

As the case of the website Charter 97 however illustrates, such thinking was far too optimistic. As our resolution today makes clear, journalists are being targeted by police in a systematic and deliberate policy of harassment and intimidation. Death threats to the editor—in—chief, Natalya Radina, being a particularly concerning example. Hopes of President Lukashenko changing his stripes were perhaps premature, but we can remain certain that the continued support for organisations such as Charter 97 will be vital to ensuring, one day, a democratic, free and successful Belarus in the future.

  Petras Auštrevičius, Autorius. – Pone pirmininke, eilinė rezoliucija dėl demokratinių teisių padėties Baltarusijoje. Šiandien kalbame apie spaudos laisvę, tai yra spaudos nelaisvę ir nesiliaujantį laisvų žmonių persekiojimą  Baltarusijoje.  Dabar imamasi interneto – bus suregistruoti visi interneto komentatoriai, o jų duomenys perduoti KGB. Šios kontoros fantazijai ir veiklai ribų nėra. Tą puikiai žinome iš istorijos.

Noriu pasakyti labai aiškiai. Pirma, nepakanka portalui „Chartija 97“ vėl ir vėl išsakyti mūsų žodinę paramą.  Komisija ir Išorės veiksmų tarnyba turi pasiekti, kad portalo blokavimas būtų netrukus nutrauktas. Portalui reikalinga konkreti finansinė parama ir ji turi ateiti iš Europos Sąjungos.

Antra, politinis monstras Lukašenka kuria sau branduolinį monstrą – Astravo atominę elektrinę. Bus paminta esminė Baltarusijos ir visos Europos žmonių teisė – teisė į saugumą. Europos Sąjungos veiksmai turi būti grindžiami griežtomis sąlygomis ir aiškiais reikalavimais, o ne bandymais įsiteikti. Komisija ir Išorės veiksmų tarnyba turi nustoti elgtis naiviai. Gana ignoruoti tai, kad Minskas nesistengia net imituoti pokyčių. Aš kviečiu nutraukti derybas dėl partnerystės prioritetų ir imtis rimtų veiksmų.

  Bronis Ropė, Autorius. – Pone pirmininke, iš tiesų, šių dienų Baltarusija yra iškalbingas pavyzdys, kaip laisvos spaudos suvaržymas ir žmogaus teisių pažeidimai kelia tiesioginę grėsmę šalies, regiono ir viso kontinento saugumui. Išgyvenusi vieną didžiausių žmonijos istorijoje atominių katastrofų Baltarusija neseniai ėmėsi atominės avantiūros, kurios pasekmės gali būti kur kas skaudesnės negu Černobylio avarija. Suvaržiusi pilietinę visuomenę ir nepriklausomą žiniasklaidą, kaip, pavyzdžiui, portalą „Chartija 97“, Baltarusija leido Rusijos Putino režimui statyti Europos Sąjungos pasienyje atominę baidyklę. Net sovietai, įvykus Černobylio avarijai, užšaldė tokio tipo reaktoriaus statybos projektus Baltarusijoje. Astravo atominės elektrinės statybos jau matosi iš Lietuvos teritorijos. Nuolat gaunu klausimus iš piliečių – ką Europos Sąjunga daro, kad būtų užtikrintas atominis saugumas? Noriu paklausti Komisijos – kaipgi bus garantuotas Europos Sąjungos streso testų atominėje Astravo elektrinėje rezultatų visiškas įgyvendinimas? Ar keliaujantys į Baltarusiją Europos Sąjungos mokesčių mokėtojų milijonai nėra tiesiog Astravo atominės statybų, įskaitant su tuo susijusių spaudos režimų, rėmimas?

  Clare Moody, author. – Mr President, a free and independent press is a fundamental European value, and it must be an essential part of the EU’s relationship with Belarus. Charter 97 provides a clear example of where our values are being undermined. Their news website was blocked in Belarus, and more recently in Russia, in an attempt to stamp out informed public debate. Other websites and social media are also being tracked, preventing anonymity in order to prevent free speech.

This highlights a worrying trend of a wider clampdown on civil society in an already oppressive environment. Belarus is acting against free association too, most worryingly with the case against independent trade unionists.

In 2016, the EU lifted most sanctions that were in place against Belarusian officials and companies in a spirit of engagement, hoping that better relations would lead to better fundamental freedoms. It is now clear that this is not working. The case of Charter 97 and that of the trade unionists most recently make this failure clear.

Now is the time for action. The EEAS needs to get funding in place for organisations such as Charter 97 and Belsat-TV, which provide independent broadcasting. This funding needs to be direct and it needs to be swift. The EU’s support for Belarus must have conditions and there must be consequences for not meeting those conditions. Harassment, death threats and the imprisonment of journalists, human rights defenders, trade unionists and others are surely the sort of violations that should cost Belarus its EU financial support.

  Miguel Urbán Crespo, autor. – Señor presidente, ante esta declaración nos enfrentamos otra vez a la doble vara de medir o el doble rasero de esta Cámara. La Resolución subraya adecuadamente la represión que se vive en Bielorrusia y que esta represión obstaculiza cualquier relación más estrecha con la Unión Europea y una participación más amplia en la Asociación Oriental. Sin embargo, entre 2014 y 2017 el paquete de asistencia de la Unión Europea a Bielorrusia en virtud del Instrumento Europeo de Vecindad ascendió a 91,5 millones de euros.

El acuerdo se centra especialmente en movilidad humana —qué casualidad— y busca la externalización del control fronterizo de la Unión Europea para reducir los flujos migratorios apoyando, por ejemplo, el desarrollo de centros de internamiento de migrantes. Es decir, reconocemos que se están violando los derechos humanos en Bielorrusia pero cerramos los ojos y les pagamos, y pagamos mucho dinero para que ese Estado que decimos que viola los derechos humanos nos haga de policía de fronteras. Todo muy coherente, señorías.

Tenemos que recordar que Bielorrusia carece de un sistema de asilo y ha entregado a personas que buscan protección internacional a los países en los que corrían riesgo real de persecución. Bielorrusia es un ejemplo más de cómo todo vale con tal de reducir los flujos migratorios de la Unión. Es verdaderamente alarmante el doble rasero que tienen muchos grupos políticos de esta Cámara que se han negado a incluir esta circunstancia en la Resolución.

  Jaromír Štětina, Autor. – Pane předsedající, svobodná média a nezávislí novináři. To jsou úhlavní Lukašenkovi nepřátelé. Novináři nezávislých médií jsou cílem neutuchajícího procesu zastrašování. Informační webový portál Charta 97 je už skoro rok blokován. V roce 2010 byl její spoluzakladatel zavražděn, Chartu vyhnali z Běloruska a vysílá od roku 2011 z Polska. Blokace jejích stránek ji ekonomicky drtí. V srpnu tohoto roku došlo k vlně zatýkání a zabavování majetku v několika redakcích. Novináři čelí trestněprávním obviněním a hrozí jim tresty odnětí svobody. V loňském roce bylo zatčeno více než sto novinářů.

Téměř před dvěma roky jsme zrušili restriktivní opatření vůči Bělorusku. Běloruská strana profituje z evropských peněz. Apeluji proto na podmíněnost naší spolupráce, na dodržování základních práv a svobod běloruských občanů. Lukašenko nám ukazuje, že místo demokratizace utahuje šrouby a pronásleduje ty, kteří se snaží svobodně spoluobčany informovat o dění v zemi. Nevěřme diktátorům, dámy a pánové.

Webový portál Charta 97 vznikl na základě běloruského hnutí Charta 97, hnutí inspirovaného československou Chartou 77. Další důležitý důvod, dámy a pánové, proč cítím já, proč cítím jako Čech povinnost bojovat proti porušování lidských práv v Bělorusku. Svoboda je nedělitelná. Běloruská svoboda je i naší svobodou.

Jako przewodniczący Delegacji do spraw stosunków z Białorusią powinienem dbać o kompletność tego typu opinii, kompletność dyskusji, dlatego też nie będę wracać do wystąpienia kolegi štětiny czy kolegi Tannocka, czy kolegi Auštrevičiusa.

Dodam do swojej opinii, do swojego wystąpienia jeden bardzo ważny element. Element związany z kulturą. Bez wątpienia Białoruś mogłaby być dumna z artystów, ze swojej twórczości, z kultury ludowej. Mają przecież także laureatkę Nagrody Nobla w dziedzinie literatury. Natomiast szykanowany jest teatr. W tym wypadku chcę dokładnie powiedzieć o białoruskim wolnym teatrze, który szykanowany jest na wiele sposobów. Szykanowani są artyści, szykanowani są profesorowie, którzy pomagają temu teatrowi, ale nawet publiczność. Zwracam na to uwagę, bo zależy mi na tym, aby opinia, która wychodzi z Parlamentu Europejskiego, była rzeczywiście kompletna, była pełna i uwzględniała nie tylko losy, problemy Karty’97 czy też Biełsatu, ale także samych artystów.

  Julie Ward, on behalf of the S&D Group. – Mr President, the EU must take action on Belarus. The passivity of the Commission and the European External Action Service has now emboldened Lukashenko’s government. The human rights situation, in particular when it comes to press freedom, is deteriorating quickly, and the treatment of political prisoners is horrific in a country where the death penalty remains a shameful option.

The case of human rights defender Mikhail Zhamchuzhny is particularly horrific. He has been kept in solitary confinement for most of the time since the last week of July and this, ladies and gentlemen, is in Europe. Dmitry Bobryk, a journalist arrested in August in a vicious attack on press freedom, has reported that – whilst in detention – he was forced to sign a cooperation agreement with the KGB, and the case of Charter 97, as already described, is very concerning. I have worked with that organisation over the past few months, and they feel totally betrayed by the EU. I therefore urge Commissioner Hahn and the High Representative to take action and demand improvements in Belarus’ human rights record.

  Marek Jurek, w imieniu grupy ECR. – Panie Przewodniczący! Białoruś to ważny, bliski nam naród, państwo graniczące z trzema, a więc z ponad jedną dziesiątą państw Unii Europejskiej. Ten naród dzisiaj pracuje nad swoją pamięcią, walczy o swoją pamięć.

W Kuropatach pod Mińskiem zamordowano według szacunków polsko-brytyjskiego historyka Normana Daviesa ćwierć miliona ludzi. Na szczęście to miejsce zaczęło być otaczane szacunkiem i pamięcią. Dziś grozi mu desakralizacja. Trwają protesty społeczne. Arcybiskup Tadeusz Kondrusiewicz, metropolita mińsko-mohylewski, powiedział, że pamięć ofiar Kuropat, szacunek dla tego cmentarzyska (na którym stoi niewiele krzyży, bo większość ofiar jest nieznana) to jest test człowieczeństwa, test świadomości tego narodu.

Apeluję do władz białoruskich: zapobiegnijcie desakralizacji tego miejsca, włączcie się do kultywowania pamięci o tej wielkiej tragedii ludzkości, która powinna łączyć nas wszystkich. Czas potępić wszystkie zbrodnie komunizmu!

  Jasenko Selimovic, on behalf of the ALDE Group. – Mr President, the situation of the press in Belarus has continued to worsen. Belarus now ranks 155 out of 180 in the World Press Freedom Index. Harassment, intimidation, threats now form part of the daily life of independent journalists in Belarus. In early August 2018, Belarusian authorities carried out raids in the newsroom of the independent Belarusian outlets Tut.by and BelaPAN.

At the same time, the government recently extended its control over media outlets by compelling everybody to register with the authorities before even being able to publish. This is beyond what anybody even in this Chamber could imagine. Therefore, Belarusian authorities have to lift the ban of the Charter 97 and all the other independent media and I ask this Chamber to continue our support to the Belarus NGOs. We owe it to the citizens of Belarus to defend their freedom of expression.

  Marie-Christine Vergiat, au nom du groupe GUE/NGL. – Monsieur le Président, la Biélorussie est souvent considérée comme la dernière dictature d’Europe, le seul pays européen à ne pas être au Conseil de l’Europe. La peine de mort y sévit toujours. Aucune élection n’a été jugée conforme aux normes internationales depuis 2001. M. Loukachenko a été réélu en 2015 avec 83,5 % des voix.

Alors, oui, la liberté d’expression y est un leurre: la fermeture du site Charter 97 n’est qu’un exemple. Or, l’Union européenne est de plus en plus complaisante. On négocie même un accord de libéralisation des visas. Pourquoi? Par naïveté? Non. Dans une tentative de reproduire un scénario à l’ukrainienne? Peut-être, mais aussi parce que la Biélorussie est un gendarme de l’Union européenne. L’essentiel des 91 millions au titre de l’instrument de voisinage est consacré non pas à la mobilité, mais à la fermeture des frontières, pour le plus grand intérêt du gouvernement polonais.

Des centaines de personnes originaires de Tchétchénie, mais aussi du Tadjikistan et même de Syrie, ont été bloquées à Brest, près de la frontière biélorusse. La Pologne a refusé d’examiner leurs demandes d’asile et certaines ont été renvoyées, notamment vers la Russie. C’est un comble! La Pologne est plus complaisante avec les travailleurs ukrainiens et a beau jeu de dénoncer les invasions migratoires venant du Sud, refusant de participer à toute solidarité européenne.

On ferme les yeux sur ce qui se passe à cette frontière et on procède à des refoulements vers des pays où l’on dénonce des violations des droits de l’homme: incohérence totale! Deux poids, deux mesures, comme toujours, en fonction de l’intérêt des États membres.

  Michaela Šojdrová (PPE). – Pane předsedající, společnost je tak svobodná, jak svobodná jsou její média. Já jsem velmi ráda, že Evropský parlament se shoduje na podpoře svobodných médií. Novináři v Bělorusku zažívají novou vlnu represí. Zaměstnanci médií, kteří kritizují režim Alexandra Lukašenka, jsou zatýkáni, biti nebo jsou nuceni platit pokuty. Vláda blokuje přístup k nezávislým médiím na internetu. Zablokovala i stránky zpravodajského portálu Charta 97, který sloužil jako platforma pro ty, kteří se v Bělorusku snaží podporovat demokracii.

V červnu tohoto roku schválil běloruský parlament novelu mediálního zákona. Záminkou byl boj proti dezinformacím, ale znamená to jen další novou cenzuru. Za svobodu slova, nezávislá média a demokracii v Bělorusku se musíme postavit. Zatýkání a fyzické útoky na novináře jsou nepřijatelné, stejně jako je nepřijatelná cenzura. Svoboda shromažďování a další svobody by měly být naší podmínkou pro spolupráci s Běloruskem.

  Mark Demesmaeker (ECR). – Voorzitter, intimidatie, arrestaties en censuur. Het levert Wit-Rusland een schamele 155e plaats op op de World Press Freedom Index. Als laatste dictator van Europa houdt Loekasjenko de media stevig in zijn greep, nog altijd na 24 jaar, en hij duldt geen kritische journalistiek. Zo ook in de nasleep van de vreedzame massaprotesten die in februari 2017 uitbraken. 700 mensen werden opgesloten van wie 100 journalisten en de intimidatie van onafhankelijke media gaat tot op de dag van vandaag voort. Laten we niet naïef zijn. Loekasjenko is niet geïnteresseerd in hervormingen. De toenadering die hij tot het Westen zoekt, houdt verband met zijn hebzucht naar meer geld, meer macht, meer erkenning. Hij kiest gewoon eieren voor zijn geld. Loekasjenko verstaat alleen klare taal. Zolang de persvrijheid niet wordt gerespecteerd, kan er geen sprake zijn van toenadering.

  José Inácio Faria (PPE). – Senhor Presidente, na minha intervenção nesta Casa em abril do ano passado sobre a violenta repressão da marcha opositora de 25 de março referi que a liberdade não era uma palavra cara ao regime do presidente Lukashenko. Infelizmente esta constatação é hoje mais verdadeira do que nunca. As agressões, as apreensões as detenções e os processos judiciais contra jornalistas, editores e bloguers independentes e o bloqueio de sites noticiosos, como o conceituado Charter 97, constituem um verdadeiro atentado à liberdade de imprensa, aos valores democráticos que para nós, europeus, são tão caros e tornaram-se um modus operandi de um regime autoritário que tudo faz para silenciar as vozes críticas.

Mas a verdade é que já nada nos deveria espantar de um regime que governa o único país europeu que ainda se orgulha de ter como cartaz de visita condenados à pena de morte e que, ao contrário do que vai acontecendo pela Europa fora, teimosamente persiste na construção da central nuclear de Ostrovets.

Entendo que, por tudo isto, que a União Europeia deve continuar a condicionar a normalização das suas relações com a Bielorrússia ao respeito pelos direitos humanos, incluindo a liberdade de expressão e esta Casa, que em 2004 entregou o Prémio Sakharov à Associação dos Jornalistas de Bielorrússia, deve condenar de forma categórica a imposição de mordaças às vozes livres da sociedade civil.

  Stanislav Polčák (PPE). – Pane předsedající, já bych chtěl co nejostřeji odsoudit postupy Lukašenkovy vlády, které potlačují svobodu, potlačují pluralitu názorů, samozřejmě svobodu tisku, jak zde probíráme. Chtěl bych zdůraznit, že my se zde občas zabýváme případy, které se dějí velmi daleko od nás, třeba v jiných civilizačních okruzích, a mnohdy právě pomíjíme takto křiklavé případy porušování těch základních hodnot, na kterých stojí Evropská unie a které se dějí přímo v našem sousedství. Myslím si, že bychom měli zejména řešit případy, které se skutečně dějí jak v prostoru Evropské unie, tak samozřejmě i v našem bezprostředním sousedství. Tím nechci podceňovat roli i těch případů vzdálených, které řešíme.

Svoboda médií je skutečně klíčovou hodnotou demokracie a já bych chtěl tímto podpořit dotčené médium a svobodu médií obecně v Bělorusku nejen touto svojí řečí, ale i následně svým hlasováním za chvíli.

  Eduard Kukan (PPE). – Mr President, I quote, ‘If we're supposed to become the nails in the coffin of a tyrant, I'd like to become one of those nails’. These are the words of Oleg Sentsov, the Ukrainian film director jailed in Siberia, but they fully apply in their scope to the work of Charter 97 and other independent journalists in Belarus. They have become uncomfortable nails for the political establishment.

The EU made the first sign of goodwill towards Belarus in 2016. It’s now time to firmly remind the Belarusian authorities to make good on their promise to move forward on human rights issues. One sign of positive development from the Belarusian side would be to unblock Charter 97, end the intimidation of independent media and journalists, drop the fabricated charges and move towards the enabling of an independent media environment. This is all part of the international and regional human rights instruments adopted by Belarus. Failure to respect these commitments should result in the EU’s resolute action in Belarus.

  Carlos Iturgaiz (PPE). – Señor presidente, como todos sabemos, Bielorrusia es una dictadura del siglo XXI, enclavada en Europa, y de la misma manera que hay represión y amenazas a los ciudadanos que defienden las libertades y los derechos humanos en Bielorrusia, también hay represión y amenazas a los medios de comunicación que quieren informar libremente sobre lo que está ocurriendo en aquel país europeo.

Hay un refrán, señor presidente, que dice que Dios los crea y ellos se juntan, y el dictador Lukashenko, curiosamente, es íntimo amigo de otro dictador —Maduro, en Venezuela— y sigue las mismas pautas que Maduro, en Venezuela, con los medios de comunicación: detiene a periodistas, ataca a los medios de comunicación y los persigue, como a Carta 97.

Las instituciones europeas deben actuar y advertir a Bielorrusia que está pasando todas las líneas rojas, y esa gravedad debe llevar a imponer sanciones al Gobierno del dictador Lukashenko en Bielorrusia.

  Elżbieta Bieńkowska, Member of the Commission. – Mr President, honourable Members, EU—Belarus relations continue to be driven by the policy of critical engagement on the EU side. As always, we remain very attentive to the human rights situation in that country. At the same time, we believe that progress in a variety of fields can be better achieved by means of enhanced cooperation.

In this context, EU—Belarus relations have come a long way over the last two or three years. We have witnessed the proactive participation of Belarus in the Eastern Partnership. Here we see, of course, the resumption of the EU—Belarus sectoral dialogues and the signature of the Mobility Partnership in October 2016. People—to—people contacts, including youth exchanges, are also developing through the EU programmes, such as Erasmus+ and Horizon 2020, as well as Belarus’ accession to the Bologna process. We are now close to finalising the joint Partnership Priorities – which will be the first document of this kind between the EU and Belarus – an important building block in our relations, setting the strategic frame for our cooperation in the coming years and in which human rights and freedom of media issues play an important role.

We have recently observed an increased willingness by the Belarusian authorities to engage constructively with the EU on the human rights dialogue, including during our last meeting on 17 July in Minsk. Our support for an involvement of civil society will remain an essential part of our policy. The extensive agenda of this dialogue covered also the concerns on the freelance journalists in Belarus and the lack of legislation in this field.

However, this increased willingness for debate has unfortunately not yet led to measurable legislative improvements in the human rights situation, notably on the freedom of media. In response to the new draft law on the media, the EU used the opportunity of the human rights dialogue to reiterate again the importance of freedom of expression and independence of the media. We called for unrestricted access to the internet. We are very much aware that several independent media organisations are working hard to achieve meaningful results in promoting critical thinking and democratic values, and we value their work very much. The EU at the highest political level has underlined to the Belarusian authorities that repressive actions against independent media, including the Charter 97 website, are contrary to the international commitments made by Belarus. We have equally called for the introduction without delay of a moratorium on the death penalty and the need to strengthen the independence of the judiciary.

As we further pursue our policy of critical engagement, we will continue to follow closely developments in Belarus with regard to fundamental freedoms. The EU stands ready to assist Belarus in meeting its obligation in the area of democratisation and full respect for human rights. In addition, the EU will continue to provide financial support for civil society through the relevant EU programmes and initiatives. Steps taken by Belarus to respect fundamental freedoms, the rule of law and human rights will remain key for the shaping of EU policy towards Belarus.

Let me also add one sentence. We are discussing today the human rights issues, but of course nuclear safety issues are also an overall EU concern. The EU is putting pressure for full transparency on the construction process of the new nuclear power plant in Ostrovets and we are also financing experts who are assisting in the new Belarusian national regulation on this.

  Przewodniczący. – Kolejnym punktem porządku dziennego jest debata nad sześcioma projektami rezolucji w sprawie Zjednoczonych Emiratów Arabskich, w szczególności sytuacji obrońcy praw człowieka Ahmeda Mansoora (2018/2862(RSP)).

  Barbara Lochbihler, Verfasserin. – Herr Präsident! Ich möchte zur urgency reden zu den Vereinigten Arabischen Staaten. Gut, jetzt ist es korrigiert worden, das war vorher falsch angezeigt.

Also nochmal: In den Vereinigten Arabischen Emiraten werden fundamentale Menschenrechte verletzt. Regierungskritiker werden verhaftet und in unfairen Prozessen zu Haftstrafen verurteilt. Amnesty International zufolge werden Gefangene unter Bedingungen festgehalten, die Folter gleichkommen. Foltervorwürfe werden aber von den Behörden ignoriert.

Im Mai wurde der prominente Menschenrechtsverteidiger Ahmad Mansur in Abu Dhabi zu einer zehnjährigen Haftstrafe verurteilt, dabei wurden ihm Straftatbestände vorgeworfen, die nichts anderes sind als legitime Meinungsäußerungen. Aufgrund seiner Menschenrechtsarbeit ist Ahmad Mansur bereits seit Jahren Repressionen ausgesetzt. UN-Menschenrechtsexperten fordern nach seiner Inhaftierung im März 2017 seine unverzügliche Freilassung. Neben ihm verbüßen eine Reihe weiterer gewaltloser politischer Gefangener lange Haftstrafen, darunter auch Dr. Mohammed al-Roken. Wir fordern in unserer Entschließung die sofortige und bedingungslose Freilassung von Ahmad Mansur sowie aller anderen inhaftierten gewaltlosen politischen Gefangenen in den Vereinigten Arabischen Emiraten.

Ich finde es sehr befremdlich, dass die konservativen Fraktionen, die EKR und die EVP, diese fundamentalen menschenrechtlichen Forderungen nicht mittragen wollen, und appelliere daher an alle Kollegen und Kolleginnen, sich für die Freilassung von Ahmad Mansur einzusetzen und klar für diese Entschließung zu stimmen.

  Amjad Bashir, author. – Mr President, the United Arab Emirates is a key ally of the European Union in the Arabian Gulf, but we ought to remind ourselves that, when the UAE cut ties with Qatar last year, the Emirati Attorney General warned that citizens expressing sympathy for Qatar could face heavy fines and prison sentences of up to 15 years. In this respect, this House must be crystal clear that freedom of expression and the respect of freedoms for individuals is not just a mere human rights issue. It is profoundly about lasting peace and prosperity in the region. Rule of law is essentially about protecting the citizen from the unjust acts of the government and the state, not the other way round. I can only, therefore, hope that, if the UAE complies with the United Nations Declaration on human rights defenders, we may then have a chance of seeing brotherly nations united again in promoting peace, security and prosperity in the Middle East.

  Soraya Post, author. – Mr President, at a time when we see an increasing number of human rights defenders harassed for doing their legitimate work, we also see that the situation in the United Arab Emirates is extremely concerning. Human rights defender Ahmed Mansoor is in prison for allegedly publishing false information to damage the UAE’s reputation abroad. What is actually damaging the Emirates’ reputation abroad is the violation of the right to freedom of expression.

We demand the immediate and unconditional release of Ahmed Mansoor and all other human rights defenders and prisoners of conscience. How can EU Member States continue trading arms and security equipment with UAE? How can the EU maintain its visa waiver programme with UAE when they clearly violate the human rights clause it is based on? I call on the EU to condemn the treatment of Mansoor and clearly and loudly call for his release. I say again that the EU must uphold human rights clauses in our international agreements and trade policies.

  Marietje Schaake, author. – Mr President, the ambitions of the United Arab Emirates (UAE) seem endless. They praise themselves as young and high tech, and a country that has realised extraordinary growth. It hosts many international conferences and seeks a more active role on the global stage. Reputation is key for the UAE and I’m convinced that the arrest of Ahmed Mansoor, over tweets he sent, and the way he has been treated since, have not helped at all in this respect.

But of course we’re not here to give the UAE any PR advice. We are here to condemn human rights violations when they occur. Mr Mansoor has been recognised as a courageous human rights defender. He was the winner of the Martin Ennals Award and served as an adviser to Human Rights Watch. He is now in solitary confinement in secret detention. He is not allowed to contact family, has not been able to appoint an independent lawyer and has seen his passport revoked. Around USD 1 million have been invested in an Israeli-made digital surveillance system to track Mr Mansoor and his communications. I believe that it is essential that such systems, that are also made in Europe, are not exported to authorities that violate human rights and that we set a new high standard in updating our own export control rules.

In the case of Mr Mansoor, we see his actions as falling within the rights to freedom of expression and call on the UAE authorities to release him. We also urge a review of the federal law combating cybercrimes to ensure that it is actually in line with international standards. I think it is essential that High Representative Mogherini also speak out, in unequivocal terms, about the case of Ahmed Mansoor, including during the next human rights dialogue with the Gulf States. To anyone in Europe considering a holiday in the UAE, it is important to know what can happen after you send a tweet or when you ask for democratic elections. I find it hardly an invitation.

  Marie-Christine Vergiat, auteure. – Monsieur le Président, il y a longtemps que nous n’avions pas réussi à mettre à l’ordre du jour la question des droits de l’homme dans les Émirats arabes unis. Dans cette maison, les pays du Golfe ont beaucoup d’amis, et c’est particulièrement vrai pour les Émirats, seul pays de la région à bénéficier d’une libéralisation des visas.

Les Émirats sont l’un des pays du monde qui acceptent le plus d’immigrés. Ainsi, Dubaï ne compte que 5 % d’Émiratis. Il y a bien quelques exemples d’«Occidentaux» travaillant dans les multinationales (y compris des jeunes victimes de discriminations ici, malgré leurs diplômes, et accueillis là-bas avec des ponts d’or), mais la majorité sont des ouvriers embauchés pour de grands travaux pharaoniques et des domestiques – surtout des femmes – victimes du système de la Kafala, qui en fait des esclaves des temps modernes.

Mais, on le sait, les Émirats sont de bons clients. La France et l’Allemagne, mais également Israël, leur ont fourni des logiciels d’espionnage pour surveiller leurs citoyens, notamment les défenseurs des droits de l’homme, comme Ahmed Mansour, Ossama Al-Najjar et Nasser Bin Ghaith.

Pire, la France est l’un de leurs principaux fournisseurs d’armes via un système de corruption qui vient récemment d’être révélé par les médias français. Ces armes sont utilisées au Yémen, au mépris du traité sur le commerce des armes et avec la crise humanitaire que l’on sait.

Alors, oui, il faut mettre en place d’urgence un embargo sur les ventes d’armes, exiger des Émiratis qu’ils respectent leurs engagements internationaux et qu’ils libèrent tous les prisonniers d’opinion, et il nous faut exiger de nos États qu’ils respectent aussi leurs engagements.

  Tomáš Zdechovský, Autor. – Pane předsedající, myslím si, že Evropská lidová strana vždycky byla na straně těch, kteří jsou ve světě pronásledováni. Proto nám nebyl ani vzdálen případ Ahmada Mansúra, bojovníka za lidská práva, který byl odsouzen za pomluvu, dezinformace a porušování veřejného pořádku, což jsou věci, které my v Evropské unii rozhodně nestíháme.

Ahmad byl odsouzen na 10 let do vězení a já se ztotožňuji s tím, že je potřeba vést s tamní vládou dialog, zda toto rozhodnutí neporušuje zásady právního státu. Bohužel ale nejsme spokojeni jako Evropská lidová strana s finálním textem této rezoluce. Namísto toho, abychom se drželi faktů, jsme tam uvedli spoustu ideologických a nesmyslných věcí, které můžete vyvrátit za pět minut studia celého případu na Googlu. Myslím si, že bychom měli jako Evropský parlament být více důvěryhodní a snažit se opravdu v našich rezolucích držet se faktů a ne domněnek a ideologických frází.

  Julie Ward, on behalf of the S&D Group. – Mr President, the human rights situation continues to deteriorate in the Gulf. The EU and its Member States must therefore take a serious stand against attacks perpetrated against human rights defenders by all our partners. The arrest and sentencing of Ahmed Mansoor earlier this year was already of great concern. Unfortunately, our fears have been confirmed by reports of ill-treatment that he was subjected to whilst in detention. This is not unusual. Information suggesting he has had no access to his family or to legal counsel has also been reported.

The United Arab Emirates (UAE) government must immediately and unconditionally release Ahmed Mansoor and drop all charges against him. He is a political prisoner who has been detained solely for expressing his views on social media.

Discriminations against women also continue to be part of daily life in UAE. There are severe restrictions in their freedom of movement, as women are still dependent on male guardians. As in many places in the Gulf, women’s rights defenders are unfairly attacked, harassed and prevented from conducting peaceful human rights activities.

The situation of labour rights is also very problematic, with widespread abusive practices by employers.

The EU must continue to demand significant progress on human rights in the Emirates. As European governments and companies continue to conduct billions worth of trade and investment, we have all the more responsibility to demand that the highest human rights standards be upheld.

Las hacían desaparecer durante meses, empleaban violencia sexual y torturas para obtener confesiones, y las condenaban en juicios sin ningún tipo de garantías. Hoy, por sus denuncias y publicaciones en redes sociales, este defensor de los derechos humanos está encarcelado y ha sufrido torturas.

Rara vez se abordan las violaciones de derechos humanos que se cometen en este supuesto país aliado de la Unión Europea. Un país donde bajo el paraguas de la lucha contra el terrorismo se violan los derechos más básicos; donde las autoridades restringen arbitrariamente la libertad de expresión y penalizan las críticas pacíficas a políticos o a funcionarios del Estado; un lugar donde se están utilizando armas y tecnologías de vigilancia cibernéticas proporcionadas por empresas europeas para llevar a cabo esta represión. Sin nuestras armas no sería posible gran parte de la represión que se da allí.

El propio Mansur fue espiado con estos programas. De hecho, sostiene que la causa de gran parte de la violencia en la región es la desesperación. Y el extremismo crece cuando la esperanza de un cambio pacífico se desvanece. No podemos seguir impulsando esta desesperanza. Tenemos que exigir la libertad de los presos políticos, el cese inmediato de las torturas, así como un verdadero embargo de armas y de equipos de vigilancia, porque no podemos ser cómplices de los actos de represión y tortura que se cometen en los Emiratos Árabes Unidos.

Más allá de declaraciones, hay que tomar partido. Hay que hacer un embargo de armas.

  Ignazio Corrao, a nome del gruppo EFDD. – Signor Presidente, onorevoli colleghi, anche l'ultima voce libera degli Emirati Arabi è stata messa a tacere. Ahmed Mansoor era l'ultimo attivista rimasto negli Emirati che ha osato criticare pubblicamente le autorità, pagando questo grave affronto con una condanna a dieci anni di prigione.

Possiamo ancora tollerare questo atteggiamento degli Emirati Arabi verso i diritti umani e verso coloro i quali osano anche nominarli? D'altronde, mi chiedo cosa possiamo aspettarci da un paese che si posiziona al 116° posto nell'indice di libertà umana e dove chi esprime simpatia per il Qatar rischia fino a quindici anni di carcere.

In un paese campione per la limitazione dei diritti fondamentali, merita una menzione particolare la legge antiterrorismo, che contiene un'ampia e volutamente vaga definizione del reato e fornisce alle autorità ampi poteri per perseguire dissidenti e attivisti. Ritengo pertanto doveroso, da parte nostra, esortare gli Stati membri a vigilare affinché dal Vecchio continente non arrivino negli Emirati strumenti di sorveglianza, che poi vengono sistematicamente usati per controllare gli oppositori politici.

Vorrei esortare infine l'Alto rappresentante a prendere una posizione chiara e decisa sul caso Mansoor richiedendone il rilascio immediato e incondizionato.

  Jean-Luc Schaffhauser, au nom du groupe ENF. – Monsieur le Président, chers collègues, certains États musulmans ont, contrairement à nos pays, compris le danger mortel des Frères musulmans pour les libertés. Les Émirats, avec d’autres pays, ont classé cette organisation comme terroriste. Ils font preuve de lucidité et protègent leur population, alors que l’Occident est souvent aveuglé par le double langage et la séduction des Frères.

Les Émirats sont victimes, depuis 2011, de manipulation et de l’ingérence du Qatar qui se sert des Frères musulmans à cette fin. M. Mansour est, consciemment ou non, un agent de ce complot. Il est affilié aux Frères musulmans, il participe au Gulf Center for Human Rights, organisation financée en grande partie par M. Soros, maître de l’alliance de la finance, du crime et du terrorisme pour déstabiliser nos États et les États.

Chers collègues, nous devons absolument soutenir les Émirats dans leur lutte contre le terrorisme, il y va de notre intérêt. J’ajoute que le roi avait accordé sa grâce à ce délinquant et que nous sommes en face d’un récidiviste.

  Wajid Khan (S&D). – Mr President, Ahmed Mansoor has become a symbol of the ongoing crackdown on freedom of expression and association in the UAE. He has been harassed and persecuted by the Emirati authorities for many years since his first arrest in 2011, when he openly called for political reforms in the country. Last May, Ahmed was sentenced to 10 years in prison for expressing his views on Twitter.

The UAE is trying to project an image of openness and modernism as part of its Vision 2021 Agenda. Dissenting voices are silenced through repressive laws, and human rights defenders have no space to carry out their legitimate activities without fear of retaliation. The Emirates’ poor record on fundamental freedoms was remarked on by the UN Commissioner on Human Rights in his periodical review only a few months ago.

We urge the UAE Government to free Ahmed Mansoor immediately and bring its legislation in line with international human rights standards. We would expect nothing less from a country that is part of the UN Human Rights Council.

  Neena Gill (S&D). – Mr President, we’ve already heard about the human rights defender, Ahmed Mansoor, who has been incarcerated for ten years because he exercised his right to express his views online. Mansoor’s only crime was peacefully promoting freedom of expression and strengthening the role of the MPs in his country. Not only did he face repeated death threats, physical assaults and detention, but he has been denied access to a lawyer, his visitation rights have been suspended and he has allegedly been subjected to torture. The ruling highlights an unabashed and blatant use of over—the—top state security to target human rights defenders in the UAE.

Many Emirati and other activists face repression, arbitrary arrests and abductions by security authorities, who are unaccountable for their actions. So my question to the Commission is: what has the EU done to address forced disappearances while negotiating the recent Cooperation Agreement with the UAE? Secondly, Ahmed Mansoor has filed a Supreme Court appeal against his sentence. How can the EU ensure a timely and fair appeal trial? Thirdly, the UAE’s repressive cybercrime law was amended this week, introducing harsher penalties and sanctions. Will the Commission raise this issue and that of the electronic surveillance of human rights activists in its annual counterterrorism dialogue?

  José Inácio Faria (PPE). – Ahmed Mansoor era, até ao passado mês de maio, uma das últimas vozes abertamente críticas das violações dos direitos humanos nos Emirados Árabes Unidos que ainda permanecia em liberdade. Depois de anos de agressões e de ameaças de morte foi, em março de 2017, detido arbitrariamente e, agora, condenado a dez anos de prisão e a uma pesada pena pecuniária. O crime deste eminente ativista que, de forma pacífica, reivindicava nas redes sociais o respeito pelos direitos humanos e pelos princípios do Estado de Direito, incluindo a possibilidade de realização de eleições por sufrágio universal direto, chama-se, na verdade, exercício de liberdade de expressão e não uma tentativa de perturbação da harmonia social e da unidade do país, como pretende acusar o regime.

A União Europeia não pode, pois, deixar de condenar veementemente a prisão de Ahmed Mansoor, de exigir a libertação imediata e incondicional deste e de todos os outros presos políticos de consciência e de instar a Federação dos Sete Emirados a cumprir as suas obrigações internacionais em matéria de direitos humanos, incluindo a abolição da tortura e da pena de morte e a implementar as reformas constitucionais que garantam o respeito pelas liberdades individuais e uma efetiva separação de poderes.

  Νότης Μαριάς (ECR). – Κύριε Πρόεδρε, στα Ηνωμένα Αραβικά Εμιράτα, όπως και στις υπόλοιπες χώρες της Αραβικής Χερσονήσου, δεν υπάρχει καν η έννοια της δημοκρατίας, διότι εκεί υπάρχει πλήρης καταπίεση των ανθρωπίνων δικαιωμάτων. Οι ακτιβιστές βασανίζονται, οι bloggers διώκονται, υπάρχουν ταξιδιωτικοί περιορισμοί για τους αντιφρονούντες. Στα Ηνωμένα Αραβικά Εμιράτα συνεχίζονται οι διακρίσεις κατά των γυναικών και δεν τηρούνται οποιαδήποτε εργασιακά δικαιώματα, συνεχίζει δε να υπάρχει η θανατική ποινή.

Νομίζω λοιπόν ότι η Ευρωπαϊκή Ένωση πρέπει να στείλει ένα αποφασιστικό μήνυμα προς τα Ηνωμένα Αραβικά Εμιράτα, τα οποία συμμετέχουν στη σφαγή που γίνεται στην Υεμένη και στα οποία πωλούν όπλα οι ευρωπαϊκές εταιρείες παραγωγής και πώλησης όπλων. Θεωρώ ότι πρέπει να ληφθούν συγκεκριμένα μέτρα προς τα Ηνωμένα Αραβικά Εμιράτα, όχι χαϊδέματα πλέον προς αυτούς από την Ευρωπαϊκή Ένωση.

  Fabio Massimo Castaldo (EFDD). – Signor Presidente, onorevoli colleghi, finalmente riusciamo a parlare di Ahmed Mansoor, noto blogger emiratino, fino a più di un anno fa l'unica voce indipendente, non ancora in prigione, a denunciare le numerose violazioni dei diritti umani negli Emirati.

Mansoor è stato condannato a dieci anni di carcere per aver pubblicato sui social media informazioni false e promosso settarismo e odio. In realtà, a noi sembra che abbia solo esercitato pacificamente i suoi diritti in un paese che, lo ricordo, siede eletto nel Consiglio dei diritti umani delle Nazioni Unite, per quanto assurdo possa sembrare, ma quel che più sorprende in questa situazione è come sempre il nostro atteggiamento come Unione, abbastanza ambiguo e ipocrita.

Da una parte, ci definiamo campioni per eccellenza della protezione dei diritti umani, dall'altra, continuiamo imperterriti a fornire software spia a regimi con dubbia democraticità che li useranno per perseguitare e ridurre al silenzio tutte le voci critiche. A gran voce, chiediamo la liberazione immediata e incondizionata di Mansoor e di tutti gli altri prigionieri di coscienza. L'UE deve prendere una posizione forte e chiara quando si tratta di diritti umani, dobbiamo sospendere le licenze di export di tecnologie e sorveglianza e di armi verso questi paesi, non possiamo più renderci complici silenziosi, privilegiando i profitti a scapito delle persone.

  Stanislav Polčák (PPE). – Pane předsedající, já se chci zastat pana Ahmada Mansúra a volat po jeho propuštění, ale nemohu nechat bez reakce jedno vyjádření našeho kolegy, pana Schaffhausera, ten jako jediný v tomto plénu řekl, že pan Mansúr má zůstat ve vězení. Já toto vyjádření pokládám za maximálně pobuřující. Pan Schaffhauser už zde tedy nesedí, nicméně si myslím, že je skutečně pobuřující, aby se člen Parlamentu vyjadřoval tímto způsobem.

Pro mě je důležité zde sdělit, že v Perském zálivu se situace obecně zhoršuje, pokud jde o porušování lidských práv, a nemůžeme mlčet ani v případě Spojených arabských emirátů. Pokud pan Mansúr je vězněn v podmínkách, které se podobají mučení, nemá kontakt s advokátem, myslím si, že v takovou chvíli my musíme zvednout náš hlas. Samozřejmě je otázkou volba konkrétního znění toho návrhu usnesení. I já zde nejsem spokojen s určitými větami, nicméně chci požádat o to, aby pan Mansúr byl propuštěn.

  Paul Rübig (PPE). – Herr Präsident! Für mich steht fest, dass die Meinungsfreiheit eine der Errungenschaften insbesondere in der Europäischen Union ist. Trotzdem haben wir eine Debatte über den Brexit, über Personenfreizügigkeit. Ich glaube, dass wir auch in den Vereinigten Arabischen Emiraten sehr kompetente Politiker haben. In vielen Gesprächen, die wir dort geführt haben, haben wir gesehen, dass es auch in der Politik dort viele gibt, die mit unseren europäischen Werten leben wollen und die sehr wohl zu schätzen wissen, was Europa seinen Bürgern dementsprechend bietet. Deshalb glaube ich, dass wir die Zusammenarbeit vor allem auch mit dem Schura-Rat verstärken sollten, und damit wir bei Reisen in die Vereinigten Arabischen Emirate und natürlich auch hier an den Sitz des Europäischen Parlaments diese prinzipiellen Themen der Meinungsfreiheit, auch die journalistische Freiheit, als eine Bereicherung für die gesamte Kultur dementsprechend anbieten können. Aus unseren praktischen Erfahrungen haben wir gelernt, dass es die beste Methode ist, miteinander zu reden.

  Elżbieta Bieńkowska, Member of the Commission. – Mr President, the United Arab Emirates (UAE) was the first Gulf country with which the EU started a comprehensive dialogue on human rights, with the most recent eighth meeting taking place at beginning of July in Abu Dhabi. Since the first meeting in 2013, we have addressed several areas of concern and have seen improvements, for example, with regard to gender issues and religious tolerance.

Nevertheless, of course, concerns remain in a number of areas: freedom of expression and association, the right to a fair trial, and the situation of human rights defenders, including individual cases, are among the points we have raised consistently during our dialogue. We continue to advocate a cooperative and transparent engagement in which the EU can support the UAE in its endeavours to fulfil its international human rights commitments.

As a first concrete step, we have been insisting on the need for enhanced information exchange. Despite challenges, there is no alternative to continued engagement in this domain.

In the EU, through our delegation in Abu Dhabi, we actively follow the overall human rights situation in the country, including individual cases. The case of Ahmed Mansoor is one case we have been actively following. Mr Mansoor, who was awarded the Martin Ennals Award for Human Rights Defenders in 2015, was sentenced in May this year to ten years’ imprisonment on charges related to the publication of false information and the spreading of hatred and sectarianism.

We are regularly seeking clarification from the Emirati authorities on his situation, his whereabouts and his health, as well as details on the judicial process and the appeal procedure. In doing so, we have constantly reiterated the EU’s principled position on human rights defenders and on freedom of expressions, in line with existing EU guidelines.

Let me also assure you that we will remain actively engaged in this individual case. We will also continue to raise the general human rights situation with the Emirati institutions. We are of course aware of countries’ concerns over their stability and security, but we are quite convinced that one cannot have long-term stability without respect for human rights and fundamental freedoms.

  Monica Macovei (ECR), in writing. – The Belarusian media is faced with numerous challenges brought about by repressive and restrictive laws. In recent years, the nation has seen a deterioration of media freedom, notably targeting independent journalists and news outlets.

In 2017, 100 journalists were arrested or detained, many of whom were covering opposition protests or reporting on issues considered unfavourable to the presidential administration. In recent months, new restrictions have led to increasing arrests, surveillance, libels, and fines against journalists. These National Media Laws create a system of extreme government censorship that directly contradicts the fundamental freedoms protected by the Belarusian constitution. Access to Charter97.org, a news site calling for democracy and pro-human rights, was arbitrarily blocked by the Ministry of Information, displaying an excessive restriction on the right to freedom of expression.

Furthermore, in August, two independent news outlets were raided by Belarusian authorities, leading to the arrests of nine journalists. It is actions like this that have resulted in Belarus being placed at 155 out of 180 countries in the Reporters Without Borders World Press Freedom Index. Belarusian authorities need to strengthen respect for democratic principles and the right for truthful and unbiased journalism to prevent the climate for independent media from worsening.

  Reinhard Bütikofer, Verfasser. – Herr Präsident! Frau Kommissarin! Meine sehr geehrten Kolleginnen und Kollegen! Chinas kommunistische Führung errichtet in Xinjiang einen extremen Polizeistaat, in dem Hunderttausende, wenn nicht mehr als eine Million chinesische Bürger uigurischer und kasachischer Nationalität inhaftiert werden. Als Begründung wird angeführt, man müsse Terror bekämpfen. Ich sage, wer meint, er könne durch allgemeine Unterdrückung Terror bekämpfen, sorgt in Wirklichkeit nur dafür, dass genug Wasser da ist, in dem die Terroristen als Fische schwimmen können. Wer Terrorismus bekämpfen will, muss sich die Erfahrung Südtirols ansehen oder die Erfahrung Nordirlands.

Ich finde es bemerkenswert, dass sich die KP Chinas, während China als Land an Stärke gewinnt, so schwach fühlt, dass sie noch nicht einmal gegenüber ihren eigenen Bürgern die eigenen Gesetze einhält und Religionsfreiheit respektiert. Ich finde es bemerkenswert, dass Chinas Führung, während sie den chinesischen Traum propagiert, die aktuellen Träume ihrer Bürger unterdrückt, jedenfalls dann, wenn sie nicht nach dem Taktstock der KP Chinas im Gleichschritt träumen wollen.

Ich finde es schlimm, dass China diese Unterdrückung auch noch exportiert. Deswegen stellen wir uns dagegen. Und ich möchte zuletzt an den Namen von Ilham Tohti erinnern, einem Wissenschaftler uigurischer Nationalität, der seit langem in einem chinesischen Gefängnis sitzt, weil er seine Meinungsfreiheit wahrgenommen hat. Auch an ihn werden wir immer wieder erinnern.

  Bas Belder, Auteur. – Voorzitter, ik kan me volledig voorstellen dat buitenlandse journalisten deze dagen zeer ongewenst zijn in Xinjiang. Want de Chinese partijstaat test in deze westelijke regio de surveillancesamenleving uit met de inheemse bevolking van Oeigoeren als menselijke pionnen-figuranten. Toch slagen westerse correspondenten er van tijd tot tijd in een indringend sfeerbeeld te schetsen van Xinjiang. Zo antwoordt een Oeigoer op de vraag of "veiligheid" soms ook onveiligheid kan betekenen voor de mensen daar: "Ja, ik heb angst", is zijn antwoord. Want ruim 100 familieleden, buren en kennissen "studeren", dat wil zeggen verblijven al meer dan een jaar in heropvoedingskampen. En passant brengen Chinese functionarissen momenteel verplichte "vriendschappelijke bezoeken" aan Oeigoerse gezinnen die intussen al op gedwongen overnachtingen uitdraaien. Met deze wrede antireligieuze assimilatiepolitiek vestigt Peking de wereldaandacht nota bene op een bepaalde draaischijf in haar ambitieuze “belt and road”-initiatief. Over pure anti-propaganda, zelfbeschadiging gesproken.

  Ignazio Corrao, author. – Mr President, concentration camps are back. There are no other words to describe what is happening in Xinjiang. On paper, the ongoing Chinese ‘strike hard’ campaign in Xinjiang aims to eradicate terrorist threats. In reality, it is used to justify massive abuses, including the establishment of re-education camps or ‘education through labour’ camps. We are talking about up to a million people arbitrarily detained in camps and exposed to torture, forced indoctrination and collective punishment without, of course, the right to due process. Therefore, the answer is simple: these people are guilty of not being Han Chinese.

Colleagues, what else do we have to witness before taking concrete actions – gas chambers? Mass executions? China has no boundaries on its gross human rights violations, simply because nobody dares to enforce such boundaries. Therefore, in light of the overwhelming evidence of grave abuses in Xinjiang, I call on the European Union to take appropriate measure that match the gravity of the situation. In this respect, targeted sanctions against Party Secretary Chen Quanguo can no longer be delayed.

  Jo Leinen, Verfasser. – Herr Präsident, liebe Kolleginnen und Kollegen! China hat in den letzten Jahren und Jahrzehnten eine erstaunliche wirtschaftliche Entwicklung durchgemacht. Aber dieser Fortschritt auf ökonomischem Gebiet ist leider nicht begleitet worden von einem Fortschritt bei den Menschenrechten und der persönlichen Freiheit. Im Gegenteil: Wir notieren hier erhebliche Rückschritte.

Dieses Parlament hat sich schon oft mit Menschenrechtsverletzungen in China auseinandergesetzt und dazu auch Entschließungen gemacht. Heute legen sieben Fraktionen eine Entschließung zu den Menschenrechtsverletzungen in der Provinz Xinjiang vor. Was wir von dort hören, mag man kaum glauben: Eine Million Menschen in sogenannten Umerziehungslagern, die totale Kontrolle der Menschen über moderne technologische Systeme und die Drangsalierung von Uiguren, die im Ausland leben.

Wir fordern die chinesische Seite auf, diese Praktiken abzustellen. Es wird uns gesagt: Das hat Gründe der Sicherheit, es gibt Terrorismus und Separatismus. Jeder Staat kann natürlich die öffentliche Ordnung garantieren, aber exzessive und kollektive Maßnahmen gegen Minderheiten und Religionsgemeinschaften sind nicht zu akzeptieren. China verliert damit auch viel Glaubwürdigkeit in der Welt.

Wir sehen, dass Deutschland und Schweden begonnen haben, Uiguren und Kasachen nicht mehr abzuschieben, weil sie Gefahr laufen, dass sie dort schwere Nachteile haben. Wir fordern andere Staaten auf, das ähnlich zu tun. Auch wir sagen: Die EU muss auf höchster Ebene – es fahren ja alle Staatenlenker unserer Mitgliedstaaten nach China – diese Menschenrechtsverletzungen ansprechen. Das darf nicht sozusagen scheu und konservativ behandelt werden. Also, diese Entschließung stößt hier im Parlament auf große Zustimmung, und ich hoffe, die chinesische Seite reagiert darauf.

  Ilhan Kyuchyuk, author. – Mr President, Madam Commissioner, colleagues, sadly Muslim ethnic minorities of Uyghurs and Kazakhs in Xinjiang, China, are subject to arbitrary detention, torture, restrictions on religious practice and culture. Nothing can justify the arbitrary detention and forced disappearance of one million human beings. Innocent people, mothers, fathers, brothers, sisters and friends have all disappeared. Where are all those people? What is happening inside the so—called re—education camps? Children are reportedly being separated from their families. We cannot be silent as human rights violations are committed on such a massive scale. I call for the immediate release of all those who are held in arbitrary detention in the internment camps and of arbitrarily detained political prisoners, such as Ilham Tohti. Starting from this resolution, there is a need for more concrete action. We need answers. We need an independent investigation in the region.

  João Pimenta Lopes, Autor. – Senhor Presidente, a resolução, baseada em alegações, dados por confirmar ou informações de entidades tão parciais como a Comissão Executiva do Congresso norte-americano, alinha-se com a estratégia dos Estados Unidos e da União Europeia e das suas principais potências de afronta aos países que defendem e afirmam a sua soberania, direito ao desenvolvimento e independência.

Uma resolução que assume a forma sobranceira de quem inaceitavelmente se arroga a intervir, de se ingerir em países terceiros, uma resolução hipócrita dos que se arvoram arautos defensores dos direitos humanos, os manipulam e espezinham nas agressões e guerras que promovem, nomeadamente no Médio Oriente e no Norte de África, branqueando, alimentando e instrumentalizando as hordas terroristas que cinicamente dizem combater.

A União Europeia e este Parlamento não têm legitimidade para dar lições sobre direitos humanos. O desenvolvimento económico e social da China e a sua projeção e papel nas relações económicas e políticas internacionais tornam-na no principal alvo estratégico do imperialismo. É essa a real razão desta resolução e debate.

Elnök Úr! Szeptember tizenkettedikén, az EU és Kína közötti kapcsolatok helyzetéről szóló EP jelentést az Európai Parlament nagy többséggel fogadta el. A dokumentum azt hangsúlyozza, hogy a két fél közötti átfogó stratégiai partnerség olyan elveken alapszik, mint a jogállamiság, az emberi jogok és a demokrácia, célja pedig az, hogy a kölcsönös bizalmat és a megértést erősítse a két fél között. Ennek értelmében emelem fel a szavam a több mint egymillió ujgur és kazah, tömeges és önkényes fogva tartása ellen a Hszincsiang Ujgur Autonóm Területen létesített átnevelő táborokban. A kínai kommunista állam cinikus módon továbbra is tagadja ezeknek a modern koncentrációs táboroknak a létezését.

Az önálló népnek is beillő, 10 milliósra tehető ujgur közösség minden egyes tagját szigorú megfigyelés alatt tartják, lábbal tiporva a kínai alkotmányban is rögzített alapvető emberi és közösségi, etnikai és vallási jogaikat. Felszólítom a kínai hatóságokat, hogy haladéktalanul és feltétel nélkül vessenek véget az ujgurok identitásának megsemmisítésére irányuló politikának. Valódi stratégiai partnerségről és kölcsönös bizalomról csupán akkor beszélhetünk, hogyha Kína valamennyi állampolgárának, köztük kisebbségeinek is, az alapvető jogait biztosítja, és emberi méltóságát tiszteletben tartja. Lépjünk fel egységesen Kínával szemben! A stratégiai partnerséghez fűződő gazdasági érdekeink nem képezhetik akadályát az őszinte párbeszédnek, legitim emberi jogi követelményeink kimondásának.

  Tunne Kelam, on behalf of the PPE Group. – Mr President, China has nothing to fear from its minorities, because the Han nation is the biggest in the world. Therefore, it’s most illogical and outrageous to see the Uyghur minority – only 11 million – subjected to systematic oppression, which, in practice, deprives them of their national culture, identity and religion. Up to one million Uyghurs are supposedly being treated in the centres of indoctrination.

Therefore, we call on the Beijing government to immediately end the practice of mass arbitrary detentions for members of the Uyghur and Kazakh minorities. We call specifically on the Commission and EU Member States’ governments to raise systematically the issue of human rights violations in the Xinjiang Province at the highest level, and we ask EU Member States’ governments to prevent harassment of the Uyghur and Kazakh diaspora in EU countries, especially as regards preventing them from being returned to China against their will.

  Michela Giuffrida, a nome del gruppo S&D. – Signor Presidente, onorevoli colleghi, parliamo purtroppo di circostanze ripetute e conclamate, denunciate non solo dal migliore giornalismo internazionale, ma anche da autorevoli esponenti della Commissione europea, e sempre più spesso noi denunciamo in quest'Aula delle pesantissime violazioni di quelli che sono poi diritti umani.

Gli abitanti dello Xi'an sono sottoposti a controlli di polizia quotidiani, a procedure di riconoscimento facciale, a intercettazioni telefoniche di massa, è ormai accertata l'esistenza di campi di detenzione di massa, e l'obiettivo è evidente, la cancellazione dell'identità della minoranza degli uiguri. E sappiamo, perché da tempo, i rischi che corrono sono noti, la Cina applica ancora la pena di morte, la sua legge antiterrorismo definisce questo in modo vago, consentendo spesso un'applicazione appunto arbitraria della legge.

L'Unione europea deve porsi come baluardo in difesa dei diritti delle minoranze, e dunque anche di questi diritti, dei diritti degli Uiguri, esortare i paesi terzi a considerare attentamente le richieste di protezione internazionale, anche quelle di altre minoranze come quelle nella regione dei Cazari.

  Mark Demesmaeker, namens de ECR-Fractie. – Voorzitter, de gedachten zijn vrij. Wie kan ze beletten? Het beginvers van één van de oudste Duitse protestliederen tegen onderdrukking van de vrijheid. De Chinese leiders zouden moeten weten dat gedachten niet opgedrongen kunnen worden en toch is het net dat wat ze proberen in de regio Xinjiang met hun heksenjacht op al wat niet Chinees is. Oeigoeren en Kazakken worden er massaal en willekeurig opgesloten in politieke heropvoedingskampen. Ze worden gehersenspoeld tot ze genezen zijn van hun ideologische ziekte en hun gedachten gezuiverd zijn. Ook buiten de muren van de kampen worden de mensen geïntimideerd, geïsoleerd, bespioneerd. Achter het China dat zich openstelt voor de wereld gaat een meedogenloos staatsapparaat schuil. Ondanks de vele akkoorden en dialogen en bijeenkomsten bungelt het land nog altijd onderaan de Human Freedom Index. De EU heeft de plicht om de Chinese autoriteiten in duidelijke taal te vragen de vervolging te stoppen, de gevangenen vrij te laten, de kampen te sluiten. Want, Voorzitter, de gedachten zijn vrij en geen overheid die dat kan beletten.

  Urmas Paet, on behalf of the ALDE Group. – Mr President, lately the focus of the international community has tended to fade away from the human rights violations in China for certain pragmatic reasons, but a country wishing to be an economic superpower should not be allowed to violate the rights of its people. According to the UN, up to one million Uyghurs are being held in detention camps without any access to legal process. Their family members don’t know where they are, or whether they are alive at all. Collection of DNA samples, GPS tracking systems being installed in vehicles and cell phones, cameras installed in their homes – these are just some of the examples of how they are being harassed.

The Chinese Government must release all those held arbitrarily in those detention camps and release the names, whereabouts and status of those that have disappeared. China must stop the systematic repression and uphold the commitments it has made by adhering to international human rights treaties, and the EU must address this issue in its meetings with the Chinese Government at all levels.

  Fabio Massimo Castaldo, a nome del gruppo EFDD. – Signor Presidente, onorevoli colleghi, “nessuno usava proferire una sola parola, restavano in silenzio come muti, avevano paura di dire accidentalmente qualcosa di sbagliato”, sono le parole di terrore di Sayragul Sauytbay, ex insegnante della propaganda cinese in uno di quei centri di rieducazione, alias campi di concentramento nascosti nelle montagne della Cina occidentale, lo Xi'an, dove circa un milione di uiguri, kazaki e altre minoranze sono oggi arbitrariamente detenuti.

Una cifra della quale non siamo nemmeno certi perché non esistono nemmeno registri pubblici dei prigionieri. Purtroppo, però, queste strutture esistono fin troppo bene, così come le numerose violazioni di diritti umani delle minoranze, comprese le sparizioni forzate di dissidenti politici, proprio come Ilam Tohti, e le intimidazioni contro la diaspora presenti anche nei nostri Stati membri, addirittura parenti dei rifugiati all'estero vengono molestati dalle autorità cinesi per farli ritornare e punire così la loro ribellione.

Abbiamo l'obbligo giuridico e morale di pretendere il rilascio immediato di tutti i prigionieri di questi centri illegali che devono essere smantellati. L'Europa non può e non deve piegarsi alla vergognosa logica del business as usual con la Cina.

  Jean-Luc Schaffhauser, au nom du groupe ENF. – Monsieur le Président, la province du Xinjiang, dans laquelle je m’étais rendu il y a une vingtaine d’années, est depuis très longtemps le théâtre d’un mouvement séparatiste armé, qui a perpétré de nombreux attentats et qui est alimenté par un islamisme militant. Dans ces conditions, quel État ne surveillerait pas les mosquées extrémistes ou les extrémistes? C’est ce que fait la Chine.

Mais ceux qui parlent de camps de concentration avec deux millions de détenus, comme l’a fait, sans aucune preuve de cette information, un membre du Comité pour l’élimination de la discrimination raciale de l’ONU, à Genève, le 13 août 2018, se ridiculisent. Deux millions, ou un million, comme je l’ai entendu ici, c’est la population ou la moitié de la population de Paris. Pourtant, c’est de là que provient le mythe des détentions arbitraires massives. C’est une fausse nouvelle que vous devriez combattre au lieu de la valider par votre résolution.

  Seán Kelly (PPE). – Mr President, we are here today concerning the deterioration in the protection of human rights by the Chinese authorities, in particular with regard to the rights of ethnic minorities. I strongly condemn the arbitrary detention of Uyghurs and other minorities, as well as the mass surveillance of their daily lives through the collection and use of data which they cannot object to. Such issues must be raised by the EU with the Chinese authorities at every political level, in order to reflect a strong, unified voice in its approach to China and to prevent a further deterioration of the situation.

I call for the immediate release of those detained arbitrarily. The fundamental rights to freedom of expression and religion, in addition to the right to peaceful assembly and association, must be reinstated and firmly protected. The promotion of, and respect for, universal human rights, democracy and the rule of law is at the core of the longstanding relationship between the EU and China. The EU’s commitment to upholding these values and China’s expressed interest in adhering to them require a strong condemnation of the situation in Xinjiang province.

  Ramon Tremosa i Balcells (ALDE). – Mr President, I welcome this resolution on the mass arbitrary detention of Uyghurs and Kazakhs in the Xinjiang Uyghur Autonomous Region. I also want to salute Mr Dolkun Isa, President of the World Uyghur Congress. Respect for universal human rights, democracy and the rule of law should remain at the centre of relations between the EU and China.

This resolution condemns the increasingly suppressive regime that minorities, in particular Uyghurs and Kazakhs, face in China today. We call on the Chinese Government immediately to end the practice of mass arbitrary detentions, and to close all the camps in which one million people are arbitrarily imprisoned. An independent investigation mission should be allowed to visit Xinjiang and Tibet. Our resolution also calls on the Chinese Government immediately to release Uyghur scholar Ilham Tohti, and all other detainees.

Dear colleagues, China is a big country. It is also rich in ethnic and cultural minorities, from Tibetans to Uyghurs. It should not be scared of them. It should recognise and respect them. This would make China an even greater country. Free Uyghurs, free Tibet, free China.

  Margot Parker (EFDD). – Mr President, China is a critically important international player, and its significance will only increase in the coming decades. Being such an important actor and a member of the Security Council brings with it certain responsibilities. Whilst flawed, the current international system has brought with it increasing security and prosperity for citizens around the globe. But far too many countries do not respect human rights. For such an important player to show such blatant disregard only erodes the efforts that have been made globally.

Whilst we can all understand and sympathise with the fight against radical Islamic terrorism, Chinese actions in Xinjiang appear to have crossed the line. Dealing with terrorist groups must not slip into the general persecution of the people of Xinjiang. China must decide what kind of future we are all going to share. The application of basic human rights must be amongst them.

  Csaba Sógor (PPE). – Mr President, grave human rights concerns have long been common in China. Recent developments, however, show a turn towards the worst. Emboldened by the silence of Western democracies, China has been stepping up its efforts against religious minorities and ethnic groups it deems unreliable, such as Uyghurs, Tibetans, and Kazakhs.

Some of the most significant and disturbing developments currently happen in the Uyghur Autonomous Region, with the massive—scale development of re—education camps. Human Rights Watch has rightly compared these re—education camps to black holes to which people are added and from which they do not get out. This is why it is so difficult to estimate how many thousands of people have already been sucked into them now. What we know is that today nearly every family in the Uyghur diaspora has a missing relative or loved one.

If it is to prove effective, the EU—China Human Rights Dialogue cannot avoid thoroughly investigating such issues.

  Krzysztof Hetman (PPE). – Panie Przewodniczący! Sytuacja mniejszości Ujgurów i Kazachów w północno-zachodniej chińskiej prowincji Sinciang słusznie określana jest przez badaczy mianem ludobójstwa kulturowego. W ramach tych działań dorośli Ujgurzy umieszczani są w obozach reedukacji, zaś ich dzieci są oddzielane od rodzin i umieszczane w sierocińcach. Cel jest jeden – zniszczenie ich tożsamości narodowej.

Skalę zjawiska doskonale obrazuje poziom inwestycji: w samym tylko 2017 roku na budowę 45 nowych sierocińców dla 5 tysięcy dzieci rząd Chin przeznaczył 30 milionów dolarów. Przerażająca jest też skala stosowania technologii do szczegółowego kontrolowania życia mniejszości etnicznych, na którą wskazuje ostatni raport Human Rights Watch. Uważam zatem, iż należy w sposób zdecydowany domagać się od rządu chińskiego natychmiastowego zamknięcia obozów, uwolnienia niesłusznie zatrzymanych osób oraz zaprzestania łamania praw mniejszości etnicznych. Ważne jest również zapewnienie swobodnego dostępu dziennikarzy oraz obserwatorów międzynarodowych do monitorowania sytuacji w tej prowincji.

  Stanislav Polčák (PPE). – Pane předsedo, já jsem chtěl opět reagovat na vyjádření pana Schaffhausera, který se opět vyjádřil velmi pobuřujícím způsobem, protože vlastně popřel jakýkoliv nátlak čínské vlády na ujgurskou menšinu. Musím říci, že se zachoval vlastně úplně stejně jako pan Lopes ze Spojené levice, který vůbec popřel legitimitu Parlamentu se k těmto otázkám vyjadřovat. Ono to ukazuje, že vlastně východiska některých radikálních členů krajní levice a pravice jsou bohužel stejná a možná by měli sedět vedle sebe, a nikoliv takhle přes sál.

Já bych se chtěl zastat skutečně práv této menšiny, protože jejich útlak má nepochybně etnický původ a je zřejmé, že Čína pouze tímto maskuje svůj údajný boj s terorismem. Měli bychom se zastat této menšiny i při našich návštěvách v Číně, jak řekl pan kolega Paet, protože my můžeme mluvit a neměli bychom při našich delegacích jen mlčet.

  Wajid Khan (S&D). – Mr President, if any other country detained one million people in camps and forced 11 million people to live in a repressive police state, we would be calling for a referral to the ICC on the grounds of ethnic cleansing. At the very least, sanctions would be imposed. Yet, most governments have declined to criticise Beijing or even ask for more transparency about the situation in Xinjiang out of fear of economic retaliation from China.

This Parliament has always been at the forefront in defending human rights worldwide. Sadly, this time our resolution does not represent a breakthrough, but merely an expression of concern. Therefore, I urge you and the Parliament to take all measures necessary to persuade the Chinese government to close the camps and end all human rights violations in Xinjiang against the Uyghur people.

The EU must stand ready to adopt targeted sanctions against all responsible for the persecution of Uyghur, victims of 21st century concentration camps. It is our obligation to acknowledge the Uyghur’s existence as a global community and act now in order to prevent the world’s next disaster.

  Petras Auštrevičius (ALDE). – Mr President, the inhuman treatment of Uyghur and Kazakh minorities in China has been taking place without adequate attention from the international community for too long. Hundreds of thousands of people from these Muslim minorities have been detained in camps under horrible conditions, including torture and restriction of their religious practice and culture, with a view to re—educating them out of their religious beliefs. It is still hard to believe that such camps can exist in the 21st century.

Uyghurs and Kazakhs must have the right to freely choose their way of life and propagate their traditions, culture and beliefs while staying in China. Therefore, I call on the European Union to bring up this issue and demand the closure of those camps in all future political dialogues and negotiations with China as a matter of primary importance.

  José Inácio Faria (PPE). – Senhor Presidente, Senhora Comissária, já começa a ser norma que cada vez que nesta Casa se aborda o tema China raramente o seja por bons motivos. Se fizermos as contas ao número de declarações, resoluções e moções que este Parlamento tem feito sobre a violação dos direitos humanos, da liberdade de culto, da liberdade de expressão e de processos judiciais arbitrários e contra as regras democráticas praticadas pela República chinesa durante o reinado do Presidente chinês, facilmente chegaríamos à conclusão de que a China é um dos campeões mundiais da opressão e do autoritarismo, lado a lado com a Rússia de Putin e a Venezuela de Nicolas Maduro.

A verdade é que, desde que Xi Jinping chegou ao poder em 2003, a situação dos direitos humanos na China tem-se deteriorado ainda mais à medida que o Governo chinês intensifica a sua hostilidade à oposição pacífica, às liberdades de expressão e religião e ao Estado de Direito.

Caros Colegas, face a tantas evidências e aos recentes relatos que referem que uigures, cazaques e outras minorias étnicas, maioritariamente muçulmanas, na região autónoma Uigur do Xinjiang, têm sido sujeitas a detenções arbitrárias e a torturas e a graves restrições em matéria de práticas religiosas e culturais, a União tem que exigir energeticamente e condenar estas práticas e pressionar o Governo chinês a pôr um fim às suas atividades e ações punitivas.

  Michaela Šojdrová (PPE). – Paní předsedající, jak už zde bylo řečeno, tak situace v ujgurské autonomní oblasti je více než alarmující. V převýchovných zařízeních je držen až jeden milion obyvatel. Dovolím si říct, že takto vyjádřeno je Sin-ťiang největším vězením na světě. Hlavní obvinění vůči nim je často velmi vágní jako podpora terorismu. Na případu Sin-ťiang je exemplárně vidět, jak se boj proti terorismu může zneužít vůči obyvatelstvu, a měli bychom vědět, že je aktuální informace o tom, že 1. října byly zaznamenány masové přesuny Ujgurů v uzavřených vagonech se zaslepenými okny z jihu na sever. Tento způsob masového přesunu vězňů připomíná dobu stalinismu v Sovětském svazu a jeho represe.

Plně podporuji proto výzvu Evropského parlamentu vůči Číně, aby ukončila tento represivní postup vůči Ujgurům, a souhlasím s tím, aby také EU zvážila cílené sankce vůči osobám odpovědným za tyto represe.

  Dubravka Šuica (PPE). – Gospodine predsjedavajući, pozdravljam ovu Rezoluciju koja je izraz naše zabrinutosti oko stanja ljudskih prava u Kini.

Ljudska prava trebaju biti u fokusu odnosa Europske unije i Kine. U svakom slučaju, Ujgure i Kazahe treba osloboditi i ja osuđujem i situaciju koja se događa sa stranim novinarima. Njima nije dopušteno izvješćivati iz tih koncentracijskih kampova. Mislim, kad bi se radilo o nekoj drugoj zemlji, o milijun ljudi koji su zatočeni, itekako bi se svi zabrinuli, ali kad se radi o Kini, onda to nije baš u fokusu i stoga je dobro da Europski parlament razmatra ovu Rezoluciju i da na ovaj način izražavamo svoje nezadovoljstvo oko stanja ljudskih prava u Kini.

U svakom slučaju, pozdravljam Rezoluciju i nadam se da će ona bar malo doprinijeti da se ti jadni ljudi oslobode.

  Elżbieta Bieńkowska, Member of the Commission. – Mr President, the EU is closely following the situation in Xinjiang. We are deeply concerned about credible reports pointing to a serious deterioration of the human rights situation there. In addition, the recent concluding observation of the EU Committee on the Elimination of Racial Discrimination merits close attention. This expresses alarm about reports of mass detention, political re—education camps affecting Uyghurs and other minorities, mass surveillance, travel restrictions, and Uyghurs abroad being returned to China involuntarily.

These findings present serious grounds for concern. The EU calls on China to engage constructively with the Committee recommendations. We have received accounts from EU citizens of Uyghur origin in the EU, who report being pressurised to return to China or to provide information about their relatives there. Travel documents of family members in China have reportedly been confiscated or not issued to prevent people from leaving. There are legitimate concerns about the security of Uyghurs and other people belonging to minorities if returned to China.

The EU urges all countries to consider carefully requests for international protection from such people and, where applicable, to ensure respect of the non—refoulement principle. The EU repeatedly raised this concern with the authorities during the last EU—China Human Rights Dialogue in July 2018. The situation in Xinjiang, freedom of religion and belief, and the rights of persons belonging to minorities, especially Tibetans and Uyghurs, were addressed. The EU reiterated its request for a fact—finding visit to Xinjiang, including access to the camps and the need to implement recommendations from international human rights bodies. The EU supports the request made by the UN High Commissioner for Human Rights for her office to have access to all regions of the country.

Respect for fundamental human rights requires that all human rights, including freedom of expression, freedom of religion or belief, freedom of movement, assembly and association, the right to due process and the right to non—discrimination, are respected in Xinjiang, as they should be anywhere in the country, in line with China’s international obligations and national legislation. The upcoming Universal Periodic Review provides an opportunity for open dialogue between China and its international partners on the full range of human rights issues.

Allora questa è una notizia totalmente falsa e il titolo è un titolo disgustoso. Noi stiamo combattendo giustamente contro le fake news sui social, ma questo Parlamento deve combattere anche contro quei giornali che fomentano l'odio e fomentano il razzismo nel nostro continente. W czasie debaty na temat przemocy neofaszystowskiej przewodniczący Paşcu odebrał mi głos po pół minuty, w połowie mojego czasu wystąpienia, i mi go nie zwrócił, dlatego że krytykowałem jego koleżankę partyjną. Jeśli przewodniczący Paşcu nie potrafi zachować neutralności, nie powinien prowadzić obrad.

  Monica Macovei (ECR). – Doamnă președintă, licitațiile trucate, conflictele de interese generează pierderi de peste două miliarde de euro pe an. Toți acești bani sunt din buzunarele cetățenilor europeni. De asemenea, există achiziții publice trucate, pentru că despre asta vorbim în acest raport.

Digitalizarea sistemului de achiziții publice a întârziat. Abia din iulie toate statele membre trebuie să folosească platforme digitale pentru achiziții publice. Platformele trebuie să detecteze practicile frauduloase și corupția, iar statele membre trebuie să pună în aplicare cât mai repede și formularele electronice.

Comisia trebuie să asigure conectarea registrelor naționale de contracte cu registrul european. Achizițiile publice electronice sunt mai transparente, reduc birocrația, simplifică și scurtează procesele, asigură cheltuirea corectă a banilor.

  Ангел Джамбазки (ECR). – Уважаема г-жо Председател, уважаеми колеги, гласувах в подкрепа на доклада на колегата Куелю относно пакета от мерки във връзка със стратегията за обществените поръчки.

Комисията прие последния си пакет подобни мерки през 2014 г., като за редица държави членки беше трудно да приложат мерките в националните си законодателства в заложения срок, а срещу цели четири от тях Комисията започна наказателна процедура поради неприлагане на правилата. Това показва, че е време за нови мерки, които да са съобразени с административните особености на всяка държава – членка на Европейския съюз, но и също така да имат ясни и гъвкави системи за прилагане.

Настоящият пакет от мерки предоставя на държавите членки възможност за модернизация на обществените поръчки. Подкрепих доклада, тъй като основните препоръки, които той прави, са подобряване на прозрачността на договорите и наддаванията чрез увеличаване на онлайн публикуването, подобряването на достъпа на малките и средните предприятия до договорите за обществени поръчки.

Смятам, че всички те са в основата на добро функциониране на системата за обществените поръчки и изразходването на средства по целесъобразен начин с видими и полезни резултати за гражданите на държавите.

  José Inácio Faria (PPE). – Senhora Presidente, gostaria de saudar o meu colega Carlos Coelho pelo brilhante trabalho sobre a estratégia de contratação pública e realce que o gasto de uma quantia considerável de dinheiro dos contribuintes tem de cumprir com valores éticos, de transparência e integridade para, de forma eficiente, fornecer bens e serviços de qualidade aos cidadãos.

Segundo a Comissão, 55 % dos procedimentos de contratação pública ainda utilizam o preço mais baixo como único critério de adjudicação, sem pesarem nestas decisões quaisquer critérios sociais, de sustentabilidade económica ou de proteção ambiental. A seriedade dos processos de contratação exige que se acabe com o amadorismo e com a gestão empírica de aquisições por entidades públicas.

Finalmente, ao fim de quatro anos, após a revisão do quatro legislativo, a Comissão exorta à modernização e simplificação dos sistemas de contratação pública com recurso às tecnologias de governação eletrónica e uso de economias de escala, com uma contratação conjunta transfronteiriça, fazendo pleno uso do mercado único europeu.

Não posso, no entanto, deixar de referir as consequências que advêm de uma gestão pública irresponsável, como foi o caso das parcerias público-privadas rodoviárias, em Portugal, que lesaram e lesam o Estado em milhões de euros.

Saúdo as organizações da sociedade civil que têm sabido, no meu país, denunciar estas situações e tentar obter a devida justiça. A bem dos contribuintes espero que os Estados—Membros saibam acolher este relatório e usá-lo para operar a mudança necessária na gestão pública.

  Момчил Неков (S&D). – Уважаеми колеги, обществените поръчки играят много важна роля в изграждането на социалната и физическата инфраструктура във всяка държава. Споделям критиката, че при близо 55% от обществените поръчки в Европейския съюз най-важният критерий за избор е факторът „най-ниска цена“. Това създава предпоставки за нелоялна или несправедлива конкуренция от по-големи и платежоспособни участници. От това пък най-често страдат местните представители.

Липсата на качество също съпътства феномена „най-ниска цена“, както за съжаление стана видно от инцидента в Своге в България, при който загинаха 18 души. Злоупотреби и завишени цени има при изпълнението на редица обществени поръчки в моята страна, като например „Училищен плод“ и „Училищно мляко“. Време е това да спре.

Подкрепям доклада относно мерките във връзка със стратегията за обществени поръчки, защото смятам, че процедурите трябва да станат по-прозрачни, по-лесно проследяеми чрез въвеждането на електронни услуги най-късно до края на 2018 г. и нарушителите и техните попечители да бъдат бързо и пропорционално наказвани.

  Monica Macovei (ECR). – Doamna președintă, traficul de droguri, traficul de ființe umane, terorismul, criminalitatea informatică sunt comise la nivel transfrontalier de grupuri care își desfășoară activitatea în mai multe state. De aceea, Eurojust are un rol esențial pentru o reală cooperare și coordonare dintre autoritățile judiciare din statele membre și, de asemenea, în sprijinirea anchetelor în care sunt implicate state terțe.

Noul regulament trebuie să sporească eficiența Europol și să clarifice limitele dintre Europol și Parchetul European, creat așa încât să asigure o bună cooperare între cele două.

  Seán Kelly (PPE). – Madam President, I welcome the support and the steps being taken to secure criminal justice cooperation across the EU and I thank my colleague, Axel Voss, for his good work, as always.

As criminals continue to use more and more sophisticated methods, so too must our criminal justice actors, and to this end, I’m encouraged by the reinforcement of Eurojust’s role in fighting transnational crime. Should crimes such as terrorism, cybercrime, human trafficking and money laundering, continue to rise across our borders, it will be essential that Eurojust can exchange more information with Member States and provide sufficient data protection.

I support the introduction of a new executive board, which will enable increased efficiency for Eurojust, and plans for regular reporting to European and national parliaments. These efforts will be increasingly important to my constituents in Ireland and constituents right across the European Union, so I am very glad to see this progress in the EU’s criminal justice cooperation.

  Monica Macovei (ECR). – Doamnă președintă, am votat pentru acest regulament pentru că păstrează echilibrul între accesul la datele fără caracter personal din sectorul public sau privat și aspecte ce țin de securitatea națională în anumite zone ale sectorului public.

Regulamentul înlătură barierele privind accesul la informații, de exemplu: restricțiile nejustificate impuse de autoritățile publice din statele membre cu privire la localizarea datelor - acestea sunt semne de protecționism care nu își au locul pe piața unică; de asemenea, neclaritățile cu privire la legislația aplicabilă în cazul procesării datelor în regim transfrontalier sau al schimbării furnizorilor de servicii, cum ar fi cloud, în cazul unor practici abuzive ale acestora.

De aceea, facem un pas important pentru deschiderea pieței către noi modele de afaceri și oportunități de inovare.

Dzisiaj głosowaliśmy nad dokumentem w sprawie wniosku dotyczącego rozporządzenia Parlamentu Europejskiego i Rady w sprawie ram swobodnego przepływu danych nieosobowych w Unii Europejskiej. To niewątpliwie istotna kwestia, zważywszy na postępującą coraz szybciej cyfryzację gospodarki. W uzgodnionym tekście wprowadzono zasadę umożliwiającą umieszczanie i przetwarzanie danych nieosobowych w dowolnym miejscu w Unii Europejskiej bez nieuzasadnionych ograniczeń.

Wyjątek od tej reguły, co moim zdaniem jest kwestią kluczową, stanowią względy bezpieczeństwa publicznego, co zostało uwzględnione w dokumencie, dlatego podobnie jak inni posłowie z mojej grupy poparłem ostateczny tekst.

  Момчил Неков (S&D). – Г-жо Председател, в съвременния свят на нови технологии и предвид скоростта, с която те навлизат в ежедневието ни, трябва да предприемем необходимото информацията да бъде използвана разумно и по начин, който не застрашава процесите, в които тя бива използвана. Подкрепям предложенията за забрана на изискванията за локализиране на данни с изключение на случаите, когато има императивни съображения, свързани с обществената сигурност.

Свободното движение на данни в рамките на Европейския съюз ще има важна роля в развойната дейност и въвеждането на иновации и ще играе значителна роля за постигането на основан на данните растеж и иновации. Публичните органи и структури на държавите членки ще извличат полза от по-голямата свобода на избор по отношение на доставчиците на свързани с данни услуги, от по-конкурентните цени и от по-ефикасното предоставяне на услуги на гражданите.

Поради тази причина аз подкрепих доклада.

  Seán Kelly (PPE). – Madam President, I had the pleasure of attending and taking part in the debate on this topic last night. I commend Anna Maria Corazza Bildt on her good work and agree with her that this is a game changer. I very much welcome the significant step to protect the free flow of data, removing any unjustified national laws that limit data storage to that Member State. I welcome the exemption for restrictions for reasons of public security and the harmonisation of this regulation with the GDPR, of which I was a rapporteur.

The removal of technical, legislative and economic barriers to data flow between cloud services will be a great advantage for SMEs across the European Union. This will encourage competition in the data storage market and will prove particularly helpful for organisations looking to store and process data in different Member States considering the challenges posed when trying to change service provider.

The Irish economy will benefit significantly from the removal of unjustified data localisation restrictions so I am happy to be voting in favour of this report. It’s a good job and will help especially when you go to the internet of things and connected cars in due course.

  Miapetra Kumpula-Natri (S&D). – Arvoisa puhemies, globaalin ihmisoikeuden perimmäinen ongelma on ehkä tänään se, että kansallinen lainsäädäntöjärjestelmä ei ole pysynyt mukana globaalitalouden haasteissa. Monet yritykset harjoittavat yritysvastuutoimintaa vapaaehtoisesti, ja se on vaikkapa osa maineen hallintaa, mutta niin kauan kuin yritysvastuu perustuu vain vapaaehtoisuuteen, löytyy yrityksiä, jotka menevät sieltä, missä aita on matalin ja kustannukset pienimmät mahdolliset, ja hyödyntävät näin väärää kilpailuetua, joka saattaa riskeerata ihmisten hengen, terveyden tai ympäristön.

On hyvä, että yritysvastuu elää monella tasolla. Päätavoitteena oli tämän päivän tiukassa äänestyksessä kansainvälisiä yrityksiä ja ihmisoikeuksia koskeva YK-sopimus. Euroopan pitää tietenkin näyttää esimerkkiä ja johtaa prosessia, jotta tällainen kansainvälinen sopimus saadaan aikaiseksi. Kiitos tämän puolesta äänestäneille meppien enemmistölle!

Kansainvälistä sopimusta tai eurooppalaista puitekehystä odotellessa kotimaassani Suomessa on käynnistynyt #ykkösketjuun-kampanja, joka tavoittelee kansallista lainsäädäntöä, yritysvastuulakia, joka velvoittaisi yritykset selvittämään, millaiset vaikutukset sen toiminnalla on ihmisoikeuksien toteutumiseen.

  Lola Sánchez Caldentey, en nombre del Grupo GUE/NGL. – Señora presidenta, hoy hemos aprobado en este Parlamento una Resolución que supone un paso histórico, una Resolución en la que pedimos algo urgente, y lo hacemos de forma más explícita que nunca: que la Unión Europea lidere en las Naciones Unidas la creación de un tratado que obligue a respetar los derechos humanos a las empresas, concretamente a las trasnacionales.

Desde ahora, cada vez que en las Naciones Unidas la delegación de la Unión Europea o alguno de sus Estados miembros obstaculicen el avance hacia el tratado, cada vez que pongan peros a los derechos humanos, les recordaremos que hoy, 4 de octubre, el Parlamento Europeo lo ha dicho claramente: las iniciativas voluntarias de responsabilidad corporativa no funcionan, hay que ir más allá y crear una legislación y debe haber sanciones para quienes no cumplan. Ya no hay peros que valgan.

Me dirijo también a los Estados miembros. El Parlamento Europeo, es decir, los representantes que han elegido vuestra ciudadanía, os están pidiendo que apoyéis el tratado. Si no lo hacéis, estaréis fallando a esta misma ciudadanía porque no la estáis representando.

España, como miembro del Consejo de Derechos Humanos, tiene una oportunidad para marcar la diferencia. Por eso, confío en que el Gobierno de Pedro Sánchez participe activamente en Ginebra, que tenga voz propia para defender el tratado y que no se esconda tras la delegación de la Unión Europea, como hizo el Gobierno del PP.

Y quiero agradecer al Grupo socialdemócrata su apoyo sin fisuras.

Me dirijo, por último, a quienes han votado en contra, a los que hoy se han quedado solos por no querer dar su apoyo a los derechos humanos. ¿Han preguntado a sus votantes qué piensan de un tratado como este? Por favor, ¡si hasta la Santa Sede lo apoya!

A pesar de llevar ya cuatro años en este Parlamento viendo lo que ustedes votan, todavía creo en el sentido común, todavía creo en la gente, en toda —también en la que vota por ustedes— y sé que hoy estarían del lado de los derechos humanos.

Hoy es un triunfo de los vulnerables del mundo.

  Younous Omarjee (GUE/NGL). – Madame la Présidente, sous des yeux qui ne veulent plus voir se déroule au Yémen, selon l’ONU, la plus grave crise humanitaire au monde. Un peuple se meurt dans l’indifférence et avec la complicité – il faut bien le dire – des capitales occidentales, plus occupées à leurs petites affaires et aux grandes compromissions avec l’infâme régime saoudien.

Honte aux gouvernements des États-Unis, de la France, de l’Espagne, du Royaume-Uni, qui vendent des armes qui tuent des enfants au Yémen! Honte à l’Europe, confortablement installée dans son impuissance! Honte à tous ceux qui continuent de donner des leçons au monde entier et font commerce sur le sang des innocents!

J’espère que l’appel lancé par le Parlement européen contre la vente d’armes sera entendu par les États et en particulier par la France.

  Miguel Urbán Crespo (GUE/NGL). – Señora presidenta, la situación de emergencia humanitaria en Yemen es insostenible. Tres cuartas partes de la población yemení —veinte millones de personas— están en riesgo de muerte por desnutrición.

Y esta no es la primera Resolución que hemos aprobado en el Parlamento Europeo sobre Yemen, pero la situación sigue igual. Porque al final el papel es solo papel. Porque la realidad es que algunos Estados miembros siguen vendiendo armas a Arabia Saudí, violando la Posición Común sobre el control de exportaciones de armas que hemos votado en este Parlamento.

Entre los Gobiernos que tienen las manos manchadas de sangre está el Gobierno español. El Gobierno de Rajoy, pero también el de Sánchez. España es uno de los principales exportadores de armas a Arabia Saudí. No se puede prometer una cosa en la oposición y hacer lo contrario en el gobierno. Los derechos humanos no son negociables.

Es fundamental impulsar un cambio de modelo productivo para que el trabajo de muchas familias no dependa de la economía de la guerra. Que no sea más papel mojado lo que votamos en este Parlamento.

  Michaela Šojdrová (PPE). – Paní předsedající, já bych chtěla vysvětlit, proč jsem podpořila usnesení o situaci v Jemenu, a to i přesto, že levice zablokovala ústní pozměňovací návrh kolegy Tannocka, který chtěl zmínit íránské ostřelování cílů v Saúdské Arábii.

Toto naše usnesení vypočítává fakta o tragickém konfliktu, o jeho příšerných humanitárních důsledcích a utrpení civilního obyvatelstva. Evropský parlament vyzývá k humanitární pomoci. Ta musí být ještě intenzivnější. Navzdory válečnému konfliktu, který nedokážeme nyní v tuto chvíli efektivně řešit, je potřeba pomoci lidem. Zpráva také vnímá širší geopolitický kontext i to, že Jemen je velmi nestabilní částí Blízkého východu, kde se střetávají dlouhodobé zájmy různých teroristických skupin.

  Mirosław Piotrowski (ECR). – Pani Przewodnicząca! W tym dotkniętym wojną kraju zamieszkuje bardzo wielu chrześcijan. W światowym indeksie prześladowań 2018 opublikowanym przez organizację Open Doors Jemen uplasował się na dziewiątym miejscu. We wspólnym projekcie rezolucji już w ustępie 1 czytamy, że Parlament Europejski „potępia z całą surowością utrzymującą się w Jemenie przemoc i wszelkie ataki na cywilną ludność i infrastrukturę”.

W przedłożonym dokumencie brak niestety zapisów mówiących wprost o prześladowaniach chrześcijan. Podzielam opinię, że Parlament Europejski powinien – jak zapisano w naszej rezolucji – domagać się od wszystkich stron konfliktu w Jemenie wywiązywania się ze zobowiązań wynikających z prawa międzynarodowego oraz dotyczących dostępu do pomocy humanitarnej i ochrony ludności cywilnej.

  Pavel Poc, Autor. – Paní předsedající, vážená paní komisařko, současný průmyslový chov brojlerů představuje převažující model zásobování evropského trhu množstvím relativně levného masa. Tzv. profesionální farmy s více než 5 000 brojlery dnes pokrývají 90 % celkové populace brojlerů v Evropě. Celosvětové rozšiřování intenzivního chovu drůbeže není ale jenom otázkou dobrých životních podmínek zvířat, je to otázka lidského zdraví.

Brojleři se typicky chovají po desítkách tisících kusů v jednom prostoru bez přístupu denního světla, bez jakéhokoliv obohacení prostředí, bez jakékoli možnosti uspokojení normálních potřeb těch zvířat. Problémy pohybového aparátu, dermatitidy, deformace, bolest, stres, neschopnost, nemožnost projevit přirozené chování, to jsou jenom příklady problémů, se kterými se ta zvířata během života od transportu až po porážku potýkají. Je skutečně doslova otřesné, co jako obyvatelé vyspělých zemí 21. století tolerujeme jako běžnou hospodářskou praxi. Kdyby veřejnost věděla, jak na tom ta zvířata jsou, tak věřím tomu, že by to maso většina lidí vůbec nebyla ochotna jíst.

Za posledních 80 let se snížila doba života brojlerů na průměrných 49 dní a současně s tím jsme zvýšili jejich jateční hmotnost o 100 %. Dovedete si to vůbec představit? Od vylíhnutí na 2,7 kila za necelé dva měsíce? Jenže tyhle experimenty s přírodou se už výrobcům vymykají z rukou, a to by mělo zajímat i ty, které nezajímají dobré životní podmínky zvířat.

Špatný zdravotní stav brojlerů v průmyslových chovech si totiž vynucuje preventivní používání antibiotik, aby se zabránilo vzniku epidemií a šíření nákaz. Podle statistik se v EU zhruba 70 % všech antibiotik používá právě v zemědělské živočišné výrobě, zejména ve velkochovech, a většina z toho je použita na hromadnou medikaci krmiv nebo napájecí vody. Tento způsob používání antibiotik pak vede ke vzniku rezistentních a multirezistentních patogenních kmenů. Tu rezistenci nyní vykazují některé kmeny bakterií Campylobacter, Salmonella i Escherichia a přibývají další. Pokud tenhle globální problém nezačneme včas řešit, riskujeme potíže s naším vlastním zdravotnictvím. Za běžná antibiotika totiž nemáme žádnou dostatečně efektivní náhradu a ztráta tohoto nástroje by posunula naše zdravotnictví doslova o sto let zpátky. To, že drůbeží velkochovy jsou mimo jiné velkým zdrojem znečištění amoniakem, vypadá vedle problému s antibiotickou rezistencí jako pouhá lapálie.

Jsem přesvědčen, že bychom měli pečlivě vyhodnotit dopady velkovýroby a prosadit udržitelnější způsoby chovu, a v této souvislosti bychom byli rádi, kdyby Komise odpověděla na následující otázky:

Přijme Komise opatření ke zlepšení prosazování směrnice o brojlerech, zejména pokud jde o systematické a důsledné používání ukazatelů orientovaných na zvířata?

Jaká opatření hodlá Komise přijmout, aby podpořila alternativní systémy produkce kuřat – například takové, které volí vhodnější plemena, nižší intenzitu chovu, obohacené životní prostředí, přístup k dennímu světlu atd. – vzhledem k tomu, že takové systémy mohou pomoci snížení emise amoniaku a omezit potřebu nekritického používání antimikrobiálních látek a zlepšit životní podmínky zvířat?

Kdy zveřejní Komise zprávu o socioekonomických dopadech povinných metod označování?

  Elżbieta Bieńkowska, Member of the Commission. – Madam President, I took this point on behalf of Commissioner Andriukaitis, but I have to tell you that I am personally very interested in the subject too. I am very concerned about animal welfare and so I am happy to be here with you.

The EU is a major global producer, as was said, of broilers. The poultry sector employees over a quarter of a million people in Europe, with 23 000 large broiler farms in Europe. But of course for us the most important thing for now is discussing animal welfare, and bird welfare.

Over the years, there has been good work in this House on that issue, and I thank you very much for this. The European Union has developed a range of legislation, which is leading the world on animal welfare. Our farmers, in each of the 28 Member States, put this legislation into force almost every day. We take animal welfare very seriously and remain fully committed to constant improvement through the life of the directive and other legislation.

We work closely with the Member States to ensure that the legislation is fully enforced. This includes the directive on the protection of broilers, the Broiler Directive. Since coming into force in 2010, the Broiler Directive has provided a legal framework to the Member States, which has considerably improved the management and housing of broilers. This in turn has improved the welfare of the birds.

The Broiler Directive was the first piece of EU legislation to introduce animal—based indicators as a way to monitor the welfare of animals. Current information and research shows that the use of these indicators, such as footpad dermatitis in poultry, has brought about the majority of improvements in farm welfare for chickens. Encouraged by this, we will continue to develop animal—based indicators as a way of continually improving conditions for animals.

We believe that there is still a lot of room for improvement in animal welfare, but the work already carried out by the European Union gives us hope that a lot has also been achieved so far. In 2019, the Commission, together with the Member States and stakeholders, will work to identify further animal—based indicators for broilers. We hope that these new indicators can be used by national authorities and also by the Commission to better target their action and thus improve the implementation of the directive.

Investment in the health and welfare of animals on farms, of course, brings additional benefits. As has just been mentioned, improvements in animal husbandry have reduced the need to use medication on farms, including antibiotics. This is very significant and provides a strong boost to our fight against antimicrobial resistance. Through the marketing standards for poultry meat regulation, we provide incentives and support for animal—welfare—friendly chicken production. We list certain specific terms, which can only be used for poultry meat produced in alternative production systems. These include terms such as ‘extensive indoor’, ‘traditional free range’ and ‘total freedom free range’, which are defined and limited to farms meeting specific criteria. Member States may additionally co—finance investment in animal—welfare—friendly production systems through the Rural Development Programmes. This funding can be used, for example, to upgrade, fit and improve housing where it goes beyond the minimum required standards.

As regards the question of mandatory labelling of poultry meat, the Commission carried out a feasibility study on animal welfare labelling, following extensive stakeholder consultation, and the outcome of this study was included in a report from the Commission to the European Parliament and the Council, adopted at the end of 2009. This study concluded that mandatory animal welfare labelling in respect of minimum EU standards would offer no added value.

Our work to improve animal welfare standards and implementation in the EU continues. In 2019, work will commence on the designation of the EU Reference Centre for Animal Welfare for poultry, rabbits and fur animals. This centre is expected to provide scientific and technical information, through which we will be able to support Member States in the implementation of animal welfare rules.

  José Inácio Faria, em nome do Grupo PPE. – Senhora Presidente, Senhora Comissária, a 13 de setembro aprovamos o relatório também da colega Karin Kadenbach sobre a proposta da Comissão Europeia para o Plano de Ação europeu “Uma só saúde” contra a resistência aos agentes microbianos. Já na altura tive a oportunidade de aqui dizer o que agora repito: tornou-se inadiável travar a utilização desregrada de antibióticos introduzidos pela intensificação das práticas de criação animal.

Senhora Comissária, ainda que possamos aceitar que os antibióticos têm importância na garantia da segurança alimentar não podemos, no entanto, deixar que a evolução das tecnologias de criação que têm em vista a diminuição dos custos e a obtenção do máximo rendimento na produção animal se faça à custa do futuro da nossa saúde.

A verdade é que a criação de elevada densidade utiliza antibióticos de forma indevida e sistemática na exploração das aves de capoeira, muitas vezes em ambientes insalubres, para evitar a propagação de doenças decorrentes das condições de exiguidade, confinamento e stress em que os animais são mantidos. Estas condições têm ainda a agravante de inibirem o sistema imunitário natural dos animais, mas a utilização de antibióticos como a profilaxia e a metafilaxia em animais produtores de alimentos verá o seu ambicioso fim este ano ainda com a aprovação final do relatório sobre o regulamento relativo à utilização de medicamentos veterinários.

Neste regulamento ficará também bem claro que a doença deve ser evitada não pelo recurso rotineiro a antimicrobianos, mas por boas práticas ou técnicas de higiene de compartimentação e de boa gestão animal.

Entendo que proteger os consumidores e a saúde pública passa por utilizar animais reprodutores saudáveis, de boa qualidade, com diversidade genética adequada e que cresçam naturalmente, passa por assegurar condições de criação que respeitem as necessidades de comportamento das espécies como as interações sociais e as hierarquias e ainda por manter uma densidade animal que não aumente o risco transmissões de doenças.

Senhora Comissária, faço agora a pergunta que está implícita na pergunta oral dos meus colegas: podem os Estados-Membros contar com a aplicação das medidas necessárias para termos no mercado produtos alimentares de qualidade, sem antibióticos desnecessários que evitem o surgimento de resistência antimicrobiana e, termino Sra. Presidente, com a última pergunta: podem os cidadãos europeus consumir carne de aves de capoeira sem preocupações?

  Maria Noichl, im Namen der S&D-Fraktion. – Frau Präsidentin! Liebe Kommissarin! Sehr geehrte Kolleginnen und Kollegen! Wir sprechen heute über intensive Masthähnchenhaltung. Wenn man die Werbung über Hähnchenfleisch sieht, dann ist es die Werbung, die für eine neue Lebensart steht. Da geht es um leichte Küche, da geht es um moderne Küche, kalorienarme Küche. Da geht es auch darum, dass man das Gefühl hat, hier ein ehrliches Produkt zu erwerben. Aber nirgends klaffen die Realität und die Werbung so stark auseinander wie im Hähnchenbereich. Wenn Menschen wüssten, wie dieses angeblich leichte Produkte erzeugt wird, würden sie Abstand davon nehmen. Das heißt, die Werbung, die uns Hähnchenfleisch als leicht und modern in Europa verkauft, hat nichts mit der Realität zu tun.

Ich stelle Ihnen die Frage, Frau Kommissarin: Werden Sie alles in Ihrer Kraft stehende tun, diese beiden Dinge zusammenzuführen? Denn Gedanken, den Menschen im Kopf haben, wenn Sie an Hähnchenfleisch denken, und die Realität? Denn gesund ist Hähnchenfleisch, so wie es erzeugt wird, nicht – weder für die Hähnchen noch für die Menschen.

Das Thema Antibiotika wurde schon mehrfach angesprochen. Gesund, obwohl man es oft in den Zeitschriften liest, kann Hähnchenfleisch so in dieser Produktionsweise nicht sein. Kann es denn leicht sein? Vielleicht ist es leicht, Hähnchenfleisch einzukaufen, aber das Leben der Tiere ist nicht leicht. Das Leben der Tiere ist oft ohne ausreichend Platz, ohne Wasser, ohne Belüftung in einem Ammoniakgestank, in einer Ammoniakwolke, für die Menschen normalerweise eine Gasmaske aufsetzen müssen, weil sie diese Ammoniakwolke nicht wirklich ertragen. Also leicht ist es nicht!

Und das nächste: Ist es ehrlich? Wir stehen in Europa für ehrliche Transparenz, was die Kunden unbedingt im Kaufverhalten unterstützen sollten. Und es ist nicht ehrlich! Wir brauchen dringend eine bessere Kennzeichnung, die deutlich macht, welches Produkt der Einkäufer kauft, wenn er in ein Geschäft geht. Dafür brauchen wir die Kennzeichnung, dafür brauchen wir mehr Ehrlichkeit beim Transport, mehr Ehrlichkeit bei der Schlachtung, mehr Ehrlichkeit bei der Auswahl der Rassen – Zweiwegerassen würde es schon lange geben oder langsamer wachsende Rassen, die ehrlich was mit dem Produkt zu tun hätten.

Sehr geehrte Frau Kommissarin, Sie tragen viel Verantwortung. Und in dem Wort Verantwortung steckt das Wort Antwort. Geben Sie mit Ihrer Kommission Antwort auf diese Fragen! Werden Sie endlich tätig, wenn es um die Hähnchenmast in Europa geht, denn die Hähnchenmast in Europa ist immer noch eine Schmuddelecke. Da müssen wir dringend aufklären.

  Urszula Krupa, w imieniu grupy ECR. – Pani Przewodnicząca! Pani Komisarz! Pisanie dyrektywy jest chyba łatwiejsze niż egzekwowanie przepisów, chociaż największym problemem wydają się zautomatyzowane, podobne do fabryk, ogromne, kilkunastotysięczne fermy drobiarskie, gdzie trudno nie tylko zachować warunki dobrostanu ptaków, ale przede wszystkim zapewnić zdrowe mięso hodowanych kurczaków.

Najpierw ograniczono chów drobiu w małych stadach podobnych do naturalnego, następnie wyeliminowano chów na ściółce, zastępując go chowem w klatkach jednopoziomowych aż po ośmiopiętrowe w celu uzyskania wysokiej produkcji bez uwzględnienia naturalnych potrzeb ptaków. W tej chwili prawo europejskie dopuszcza limit zagęszczenia 33 kg/m2, niekiedy nawet więcej, co oznacza, że na jednego kurczaka przypada powierzchnia mniejsza niż kartka A4. Dlatego nie tylko trzeba zapewnić mniejszą gęstość obsady, dostęp do światła naturalnego, lepszą jakość powietrza czy zmniejszenie emisji amoniaku. To wszystko powinno zmniejszyć potrzebę zastosowania środków przeciwdrobnoustrojowych.

Najważniejsze jednak byłyby działania zmniejszające negatywny wpływ konsumpcji mięsa drobiowego na zdrowie publiczne z ograniczeniem bioakumulacji substancji takich jak herbicydy, pestycydy i oczywiście antybiotyki. Także chodzi o minimalizację fetoru i hałasu z farm. Brakuje danych o pochodzeniu i standardzie paszy. Czy jest ona genetycznie modyfikowana, czy zawiera pestycydy? Ogromnym zagrożeniem – już tutaj było mówione – jest oczywiście biokumulacja antybiotyków w organizmach kurcząt i ewentualne dostawanie się do wody i ścieków. Brakuje także przepisów dotyczących hałasu i fetoru, co powoduje narażenie okolicznych mieszkańców na wdychanie odorów z narażeniem na choroby układu oddechowego. Nie ma także regulacji odprowadzania fekaliów do wód podziemnych, co skutkuje podwyższoną zawartością azotanów, azotynów, które mają kancerogenny wpływ na przewód pokarmowy.

  Tilly Metz, au nom du groupe Verts/ALE. – Voici trois arguments destinés à montrer pourquoi il faut agir de façon urgente. Premièrement, c'est un élevage tout à fait contraire au bien-être des poulets. En effet, les espaces sont surpeuplés et les poulets ne peuvent ni bouger suffisamment, ni picoter, ni sautiller sur des branches et même pas déployer de façon convenable leurs ailes. Ce traitement entraîne des souffrances énormes. Leurs os deviennent fragiles et leur comportement anormal.

Deuxièmement, il a des conséquences sur la santé des animaux et des êtres humains. La plupart des poulets dans l'Union européenne sont maintenus dans des systèmes d'élevage intensif qui contribuent à de mauvaises conditions de santé et nécessitent un traitement de masse aux antibiotiques pour prévenir ou contenir les épidémies. Cela développe l'émergence de la résistance aux antimicrobiens, qui est une menace pour la santé publique.

Troisièmement, il a des conséquences graves pour l'environnement. Les élevages intensifs sont aussi une source de pollution. Pour n'en nommer qu'une: l'ammoniac. L'ammoniac pollue l'air, l'eau et le sol et, au lieu de subventionner les pratiques plus respectueuses de l'environnement, des animaux et des êtres humains, nous finançons ces pratiques d'exploitation à grande échelle en les subventionnant avec la PAC.

Notre façon de traiter les animaux est un miroir de notre société européenne et je suis sûre que nous ne voulons pas une société où l'élevage industriel et la maltraitance animale continuent à être subventionnés. Nous pouvons changer cela et j'appelle la Commission à agir en ce sens, merci.

  Anja Hazekamp, namens de GUE/NGL-Fractie. – Voorzitter, het is vandaag Werelddierendag en het is de eerste keer dat het Europees Parlement debatteert over het welzijn van kuikens in de vleesindustrie. Zo'n kip groeit in minder dan 6 weken van een klein kuikentje tot een kiloknaller van ruim 2 kilo. Ze zakken door hun poten en ze groeien letterlijk dood. In Nederland noemen we deze kip een plofkip. Kuikens deden er 50 jaar geleden nog bijna een half jaar over om tot het gewicht van een volwassen dier te komen en nu slechts 42 dagen. Hun korte leven is een lange lijdensweg. Ze zijn kreupel, ze hebben last van voetzweren, ze hebben enorme gewrichtspijn en hartfalen. Om zoveel mogelijk kuikens te laten overleven wordt enorm veel antibiotica gebruikt en dat alleen maar omdat in de Europese Unie de productie en consumptie dwangmatig moeten groeien, ten koste van de volksgezondheid, ten koste van het milieu en zeker ten koste van de dieren. We moeten hier een einde aan maken door snelgroeiende kippenrassen zo snel mogelijk te verbieden. Daarnaast hebben kippen ruimte, frisse lucht, daglicht en een vrije uitloop nodig zodat ze dagelijks maar zeker ook bij een stalbrand naar buiten kunnen. In de afgelopen 11 jaar heeft de Europese Commissie stilgezeten. Haar rapport waaruit blijkt dat er grote welzijnsproblemen zijn bij de kippen kwam 6 jaar te laat en gaf ook nog eens geen enkele oplossing. Ik reken daarom op de steun van mijn collega's, maar vooral ook op de steun van de Europese Commissie om dit eindelijk aan te pakken en dieren de bescherming te geven die ze verdienen. En voorts ben ik van mening dat de Europese landbouwsubsidies moeten worden afgeschaft.

  Eleonora Evi, a nome del gruppo EFDD. – Signora Presidente, onorevoli colleghi, Commissario, oggi nella Giornata mondiale degli animali, io sono contenta che in plenaria si possa discutere questa interrogazione orale, soprattutto perché puntiamo il faro su quegli animali che troppo spesso vengono dimenticati e che invece meritano tutta la nostra attenzione.

Il problema oggi è grave ed è giusto parlarne perché sono sempre più numerose, infatti, le indagini e le testimonianze che ci danno la misura di quanto gli allevamenti intensivi dei polli da carne siano un business del tutto insostenibile. Gli animali sono alimentati forzosamente e crescono strutturalmente deboli, al solo scopo di produrre carne di bassa qualità venduta a basso prezzo.

Animali tenuti in gran numero in spazi estremamente ridotti in condizioni terrificanti, dove malattie animali e zoonosi si diffondono con facilità estrema. Purtroppo le ricette che l'allevamento industriale utilizza in queste situazioni sono del tutto sbagliate. Agire sui polli per scongiurare l'insorgere di focolai di malattie tramite l'uso preventivo e sistematico di antibiotici non può essere una risposta adeguata, non lo può essere perché non fa altro che aggravare il fenomeno dell'antibiotico resistenza, tanto negli animali, quanto negli esseri umani. Un fenomeno che oggi costituisce l'emergenza più pressante per la salute pubblica in Europa.

Io vorrei sottolineare a questo proposito, come è stato ricordato, che il Parlamento si è espresso con una relazione, a settembre, della collega Kadenbach. Per questo ritengo che il settore debba essere richiamato alle proprie responsabilità e che la trasformazione dell'allevamento sia più che mai necessaria in Unione europea ed in Italia, in particolare. Il mio paese è il secondo per l'uso di antibiotici negli allevamenti, con oltre 1 300 tonnellate all'anno, una cifra impressionante, che tuttavia potrebbe essere drasticamente ridotta se decidessimo finalmente di far prevalere un altro modello di produzione e di consumo di carne, un modello basato sulle buone pratiche di allevamento e sull'applicazione di misure di biosicurezza rigorose.

Ma non solo, per ridurre l'uso dei medicinali e il notevole impatto ambientale dell'allevamento industriale di polli da carne – e l'abbiamo ricordato le emissioni di ammoniaca sono un problema enorme – può giocare un ruolo importante la scelta di abbandonare l'uso delle gabbie. Ed è per questo che io chiedo ai colleghi qui presenti di sottoscrivere l'ICE, l'iniziativa "End the Cage Age", e alla Commissione chiedo di prestare ascolto, di iniziare a mettersi in ascolto di quei tanti cittadini che si stanno già mobilitando a favore di questa grande battaglia di civiltà.

  Dominique Bilde, au nom du groupe ENF. – Madame la Présidente, entassés, blessés à répétition, incapables de se mouvoir ou d’entrapercevoir ne serait-ce qu’un seul instant la lumière du jour, combien sont-ils à travers l’Europe à subir ces conditions d’existence indignes pour remplir nos assiettes des quelque 13 millions de tonnes de viande de volaille produite annuellement en Europe?

Ce quotidien macabre n’est pas l’exception puisque le pourcentage d’élevages de plus de 5 000 têtes détient 93,5 % des poulets dans l’Union européenne. Ces animaux, d’ailleurs eux-mêmes sélectionnés pour leur croissance hors norme, quatre fois plus rapide que celle connue dans les années 50, attestent l’industrialisation extrême de notre production agricole.

Loin d’être l’apanage d’une horde de bobos vegans confite dans son confort matériel, comme il se dit dans les médias, la question du bien-être animal recèle en elle le devenir d’une population mondiale en explosion. En effet, à l’heure où la résistance aux antibiotiques menace de nous précipiter dans une crise sanitaire inédite, qui provoquerait jusqu’à 10 millions de morts par an vers 2050, l’impact sur l’homme de leur utilisation intensive pour pallier les infections qui pullulent dans ces élevages surpeuplés est désormais avéré.

Reste enfin la question éthique, puisque si le traitement réservé aux plus vulnérables témoigne du degré de civilisation d’une société humaine, on ne peut plus ignorer les souffrances abjectes infligées à tant d’êtres sensibles au nom d’un productivisme débridé. On n’a pas deux cœurs: un pour les animaux et un pour les humains, écrivait Alphonse de Lamartine. On a un cœur ou on n’en a pas.

  Seán Kelly (PPE). – Madam President, there may not be many MEPs here with our good Commissioner Bieńkowska, but we’re pretty unanimous in our approach to this topic – not surprisingly so, because the welfare of Europe’s animals is an extremely important issue and one that is often overlooked. The 2007 Directive lays down minimum standards for the protection of chickens kept for meat production. As always, it is key that enforcement of these directives is consistent across Member States and, up until this point, we have not seen that happen.

Some of the problems we were speaking about today allegedly include the fact that chickens which are bred purely for the purpose of meat are often reared in groups of tens of thousands in terrible conditions, without any possibility of expressing natural behaviours, such as perching, pecking or even experiencing natural sunlight. There are also several knock—on effects to humans from rearing chickens in this way, such as a threat to our health from antibiotics used on chickens. This is simply an issue we can no longer ignore.

Furthermore, it seems the pollution caused by industrial poultry production is ever—increasing and is now seen as a major contributor to ammonia pollution of air, soil and water. I believe the industry is currently taking steps to address some of these issues, but again it is imperative that a comprehensive approach is taken to ensure we tackle these problems in the most efficient way and spread awareness across all Member States of the extent and variety of the problem.

I support Karin Kadenbach and others’ questions to the Commission and wonder what is going to be done to improve the welfare of broiler chickens. Are any steps being taken to address some of the issues? Are broiler chickens going to be afforded a better existence? Are there alternative methods of rearing chickens being looked into that can attempt to improve their quality of life, while also minimising the negative impact it has on humans and on the environment?

Finally, I would say that if we reared cattle and sheep in this way, I think the farms would be closed down overnight. Why do we treat poultry in such a terrible way? It’s not acceptable any longer.

Frau Kommissarin, ich weiß nicht, wer Ihre Rede geschrieben hat, aber Sie haben eingangs gesagt, Europa wäre ein globaler Player, ein globaler Exporteur von Hühnerfleisch. Glauben Sie wirklich, dass es sinnvoll ist, mit Gentechnik-Soja aus Brasilien, das auf Flächen angebaut wurde, wo Urwald abgeholzt wird, eine europäische Produktion aufrechtzuerhalten, damit wir den Weltmarkt mit Hühnerfleisch beliefern? Das Ammoniak bleibt hier, die Grundwasserverseuchung bleibt hier und die Massentierhaltung bleibt hier. Glauben Sie wirklich, dass das ein Zukunftsmodell für die europäische Landwirtschaft ist?

Sie haben mit Jobs argumentiert. Wissen Sie, tausende Betriebe sperren in Europa jedes Jahr zu, weil sie mit der Preisgestaltung der industriellen Landwirtschaft nicht mehr mithalten können. Meinen Sie nicht, dass es eine Menge mehr Jobs ergeben würde, diese Art von Agrarsystem zu beenden und in Zukunft europäische Bäuerinnen und Bauern darin zu unterstützen, eine artgerechte und umweltfreundliche Haltung von Hühnern hier in Europa zu betreiben?

Und wenn Sie denn dieses nicht wollen aufgrund des Tierschutzes, wenn Ihnen das egal ist, wie die Hühner leiden, dann tun Sie es bitte zumindest, um die Gesundheit der Europäerinnen und Europäer zu schützen. 25 000 Tote jedes Jahr aufgrund von multiresistenten Keimen – ich weiß nicht, welches Argument man noch braucht, um diese Art von Landwirtschaftspolitik zu überdenken! Ich bitte Sie, wirken Sie auch auf Ihren Kollegen Hogan ein, hier ein Fördermodell vorzuschlagen, das europäische Bäuerinnen und Bauern bevorzugt und die Förderung der Agrarindustrie beendet.

  Stefan Eck (GUE/NGL). – Frau Präsidentin, Frau Kommissarin! In der Hühnermast werden immer noch riesige Mengen Antibiotika eingesetzt, und man wird auch in Zukunft viel Antibiotika einsetzen müssen, und zwar deshalb, weil die malträtierten Tiere in diesen nur auf den Profit ausgerichteten Fleischfabriken so krankheitsanfällig sind, weil die Haltungsbedingungen erbärmlich sind, sodass sie nur mit Antibiotika ihr Mastende erreichen. Neben Breitbandantibiotika werden verantwortungslos sogar Reserveantibiotika eingesetzt, die in der Humanmedizin als das allerletzte Mittel bei verschiedenen Erkrankungen Verwendung finden, weil es immer mehr Bakterienstämme gibt, die aufgrund der landwirtschaftlichen Praxis gegen Antibiotika resistent geworden sind. Die verwendeten Antibiotika kontaminieren nicht nur das Geflügelfleisch, sondern auch die Exkremente und die Schlachtabfälle, sie kontaminieren unser Trinkwasser und unsere Böden.

Ist Ihnen eigentlich klar, was gerade geschieht, was für ein Unheil angerichtet wird, dass die Kommission mit ihrer Politik die Hühnerbarone hofiert? Sie schaufelt doch damit quasi das Grab für zukünftige Generationen, die an diesen Krankheiten, an multiresistenten Krankheiten sterben werden. Vor zehn Jahren reichte noch die Gabe von drei Antibiotika-Einheiten aus, um eine Lungenentzündung innerhalb von ein paar Tagen zu kurieren, und heute sterben alte Menschen massenhaft in unseren Krankenhäusern an Pneumonia-Bakterien, weil nichts mehr hilft. Das haben Sie, meine Damen und Herren in der Kommission, zu verantworten. Dass die Kommission so zögerlich gehandelt hat und handelt, ist eine Schande, es ist ein abgrundtiefer Skandal. Deshalb sage ich Ihnen: Ich erwarte von der Kommission, dass sie jetzt handelt, sonst handeln die Tierrechtler!

  France Jamet (ENF). – Madame la Présidente, mes chers collègues, s’agissant des poulets de chair et de l’utilisation d’antibiotiques pour favoriser la croissance des animaux, je tiens à rappeler ici, comme je l’ai maintes fois répété en commission INTA, que si leur usage est interdit dans 51 % de nos États membres, il demeure totalement et à 100 % légal et très largement répandu aux États-Unis, au Canada, dans tous les pays du Mercosur, en Australie et en Nouvelle-Zélande – autant de pays concernés par les accords de libre-échange négociés par M. Juncker et sa Commission.

Rendez-vous compte qu’en l’état actuel des choses, on estime que ces pratiques médicamenteuses ne sont pas loin de concurrencer, voire dépasser en volume, les prescriptions médicales destinées aux êtres humains. Il faut d’ores et déjà revenir sur les conditions de ces traités commerciaux, et il est impératif et vital de mettre en place un véritable système de traçabilité et d’étiquetage des produits importés pour le bien-être des animaux, bien sûr, et pour l’information et le choix du consommateur parce qu’il en va aussi de la santé de nos concitoyens.

  Herbert Dorfmann (PPE). – Frau Präsidentin, Frau Kommissarin, geschätzte Kolleginnen und Kollegen! Wir greifen hier ein wichtiges Thema auf. Hühnerfleisch erfreut sich ja zunehmender Beliebtheit. Wenn man sich die Daten anschaut: Allein in den letzten zehn Jahren ist die Produktion in Europa von acht Millionen Tonnen auf dreizehn Millionen Tonnen gestiegen. Man könnte ja auch mal darüber diskutieren, ob es wirklich für unsere Ernährung sinnvoll ist, dass wir in Europa zum Beispiel im Jahr mehr Hühnerfleisch essen als wir Äpfel essen. Auch das sollte man vielleicht ein bisschen hinterfragen.

Aber man darf auch nicht alles über einen Kamm scheren. Es gibt in Europa durchaus auch Situationen, wo Hühnerfleisch ordentlich hergestellt wird. Es gibt zum Beispiel in Deutschland die Initiative Tierwohl. Ich war selbst mit dem Landwirtschaftsausschuss vor zwei Jahren in den Niederlanden. Dort hat man Ställe entwickelt gemeinsam mit der Universität von Wageningen, wo sehr wohl auf das Tierwohl geschaut wird.

Aber die Kommission ist nicht imstande – da gebe ich meinen Vorrednern durchaus Recht – die Richtlinie 43/2007 umzusetzen, das heißt, endlich dafür zu sorgen, dass die Regeln, die eigentlich da sind, auch umgesetzt werden. Dann sind halt jene, die es richtig machen, letztendlich die Gelackmeierten, denn wenn sie in Tierwohl investieren, sind sie letztendlich nicht mehr konkurrenzfähig, weil andere halt billiger produzieren. Wir haben das ja auch in der Eierproduktion erlebt. Dort war und ist es genau das Gleiche. Jene, die in bessere Stallungen investiert haben, waren letztendlich am Markt nicht mehr konkurrenzfähig, weil andere in Europa mit alten Ställen weitergearbeitet haben. Es passiert das Gleiche wie bei den Eiern auch. Die Ställe in Europa sind abgebaut worden und hinübergestellt worden in die Ukraine, und die Eier wurden dann importiert, und zwar zollfrei. Auch hier haben wir aufzupassen. Entweder jene, die importieren, haben die gleichen Regeln, oder sonst müssen Schutzzölle auf diese Produkte drauf. Alles andere ist für unsere Bauern nicht akzeptabel.

  Elżbieta Bieńkowska, Member of the Commission. – Madam President, I would like to thank the honourable Members who took the floor. This is an important topic. Thank you very much for this short discussion on the issue. I will of course pass all of your remarks, concerns and the whole message to Commissioner Andriukaitis, but let me just point to two things.

First, the Commission wants to move things forward and to really work on this subject. We will continue to work on the enforcement of the directive, but at the same time – and that is why your remarks were so valuable – we need to work closer together to reduce the impact of industrial farming as far as possible, both for the welfare of the chickens and for the environment and human health. We will take all of your concerns into consideration.

Let me also tell you, a little bit more personally, that I will do my best in my capacity to get a lot of interest in the Commission on this. This is what I can commit to you.
