  Federica Mogherini, Vice-President of the Commission / High Representative of the Union for Foreign Affairs and Security Policy. – Madam President, the fate of Selahattin Demirtaş is an issue which, I believe, lies close to the hearts of many of us. He has been for long years an interlocutor for many and a key figure in Turkey’s democratic debate. So today we are discussing not just the fate of a human being, which is probably the most important thing the Chamber can discuss, but also the state of Turkey’s democracy. We are discussing the individual and collective rights of all Turkish citizens.

In the past two years, we have witnessed the detention of elected politicians, journalists and academics. We are well aware of the incredible challenge that Turkey faced, back in July 2016, with the attempted coup d’état but today the state of emergency is over and this should be the time to strengthen Turkey’s democracy. The independence of Turkey’s judiciary is being undermined. Fundamental rights such as the presumption of innocence are often ignored and violated.

On the one hand, the case of Mr Demirtaş reflects these wider trends and, on the other hand, this case is quite unique. Demirtaş is a Member of Parliament, a former presidential candidate, the Co-Chair of his party and a democratically elected leader. His case is about pluralism in Turkey and the right of every individual freely to take part in their country’s democratic life, and, for this reason too, we have followed his case since his detention more than two years ago. On the day of his detention, Commissioner Hahn and I described him as ‘our trusted and valued interlocutor’, and I believe many in this Chamber will share these views.

As you know, I raised this case again, in public and in private, during my last meeting with Foreign Minister Mevlüt Çavuşoğlu at the High Level Political Dialogue in Ankara last month. That, by the way, was a very fruitful, open and constructive meeting, and I’m very happy about that. This was just two days after the ruling by the European Court of Human Rights which we are discussing today. The Court had ruled that Mr Demirtaş’ extended detention violated the European Convention on Human Rights. As Commissioner Hahn and I said in Ankara, just a couple of weeks ago during this meeting, we expect the Turkish authorities, including the Turkish judiciary, to follow up in an appropriate manner on the recommendations by the Council of Europe and on the rulings by the European Court of Human Rights. We expect to see concrete progress in Turkey on the rule of law and fundamental freedoms, including those of Mr Demirtaş.

The Court in this case has described his detention as an unjustified interference with the free expression of the Turkish people’s opinion and with his right to be elected and to sit in Parliament. The Court found, ‘beyond reasonable doubt’ that his time in prison had the purpose to suffocate pluralism and Turkey’s democratic debate.

Let me remind everyone that the European Convention on Human Rights does not belong to the European Union nor to any of our Member States. It is the result of work done in the 1950s by the Council of Europe, and Turkey is a proud founding member of the Council of Europe. The European Convention on Human Rights is embedded in Turkey’s domestic law so this is a violation not of a recommendation from the European Union but of Turkey’s own laws, principles and values.

Mr Demirtaş’ legal status has changed now, following a recent ruling in another case by a Turkish court of appeal. Nonetheless, I believe that it is not only Turkey’s responsibility but also in Turkey’s interest to follow up immediately on rulings by the European Court of Human Rights.

This is not just about Turkey’s status as a candidate country. I would like to be very clear on this. I believe it is about the kind of country the Turkish people and citizens want and deserve: a country with stronger institutions, a more inclusive country, and a country where all the people of Turkey can find their place and contribute to Turkish society’s collective progress. What we would like to see, as the European Union, is a strong, free, secure, prosperous and democratic Turkey as a key neighbour and partner in our region, not just as a candidate country. It is in our shared interest to contribute to this, and all the Turkish people should know that they can count on the European Union to be at their side for a secure, democratic, free and prosperous Turkey.

  Kati Piri, on behalf of the S&D Group. – Madam President, opposition leader Selahattin Demirtaş is facing a maximum sentence of 183 years. He is jailed, his freedom of expression is curtailed, and so is his right to politics. And for what? For representing millions of people in Turkey who want peace, millions of people who want to continue their struggle for equal rights through democratic means, and for being the voice of Kurdish – and Turkish – youth who are fed up with the decades-long bloodshed.

The European Court of Human Rights last month unanimously ruled for his immediate release. To say it in the words of the Court: ‘It is beyond reasonable doubt that the Demirtaş detention had pursued the predominant ulterior purpose of stifling pluralism and limiting freedom of political debate.’ This is the definition of a political prisoner. This is the reason why President Erdoğan has no plans to release his political opponent. It’s easier to rule without an opposition, without free press, and without civil society.

Dear Başak, when you are in the court tomorrow to testify in the show trial against your husband, know that you have the European Parliament behind you. We will not forget him, and we will continue to demand justice. Selahattin, we are with you.

  Marie-Christine Vergiat, au nom du groupe GUE/NGL. – Madame la Présidente, Madame la Haute représentante, depuis sa prison, Selahattin Demirtas nous a écrit pour nous demander soutien et solidarité. Demain commencera à Ankara un nouveau procès, auquel ma collègue Anne-Marie Mineur assistera. Comme tant de Kurdes et de progressistes en Turquie, M. Demirtas a été arrêté il y a plus de deux ans. Il a fait l’objet de 29 enquêtes et risque jusqu’à 150 ans de prison. L’essentiel de l’accusation repose sur des discours tenus pour soutenir le processus de paix en Turquie, que l’Union européenne a accompagné.

Hier encore, à Diyarbakir et à Batman, une cinquantaine de personnes ont été arrêtées. Leur crime: soutenir la grève de la faim d’une autre députée kurde, Leyla Güven. C’est pourquoi la décision circonstanciée, dont vous venez de nous parler, de la Cour européenne des droits de l’homme, demandant la mise en liberté dans les plus brefs délais de M. Demirtas au motif que sa détention provisoire illimitée portait atteinte au pluralisme et au libre jeu des débats démocratiques, a apporté comme un vent d’espoir. M. Erdoğan a dit que ce n’était pas une décision contraignante, en bafouant le droit du Conseil de l’Europe.

Nous avons demandé ce débat parce que M. Demirtas est effectivement un symbole de ce qui se passe en Turquie, et pour vous demander comment, concrètement, vous pouvez agir pour faire respecter la décision de la Cour européenne des droits de l’homme.

  Jordi Solé, on behalf of the Verts/ALE Group. – Mr President, HDP Co-Chair Demirtaş must be immediately released. According to the European Court of Human Rights ruling, which is binding, the fact that he was in pre-trial detention during two electoral campaigns for the constitutional referendum and for the presidential election did not just undermine his political rights, but also the rights of the citizens to be represented. This, therefore, undermines pluralism and democracy itself.

When state authorities abuse pre-trial imprisonment to silence opponents and limit freedom of political debate, we cannot remain silent. Nor should we remain silent waiting for another ECHR ruling concerning similar situations that exist today in the EU: for example, those of the Catalan political prisoners in pre-trial detention who are also MPs who cannot exercise their duties as elected politicians, and some of them were even prevented from participating in the electoral campaign. We will stand by human rights, or again we will be recklessly using double standards.

  Jiří Pospíšil (PPE). – Pane předsedající, já jsem velmi pozorně poslouchal vystoupení paní vysoké představitelky, velmi se s ním ztotožňuji. Ten problém má dvě roviny, stav lidských práv v Turecku a potlačování opozice a pak je ta druhá rovina, na kterou bychom neměli zapomínat, že Turecko přestává respektovat rozsudky Evropského soudu pro lidská práva. To je velmi smutná zpráva, že byť Turecko, jak bylo řečeno, je zakládající člen Rady Evropy, tak závazky, které na sebe vzalo, v tuto chvíli velmi relativizuje a zpochybňuje. My bychom na to měli reagovat. Zaprvé, měli bychom se jasně postavit za vůdce opozice, jasně bychom měli označit jeho procesy za politické. Měli bychom také řešit otázku nerespektování rozsudku Evropského soudu pro lidská práva. Tady mám dotaz na paní komisařku: Co tedy bude dělat Komise, pokud tento jev bude narůstat a Turecko se bude dále vydělovat z evropských právních tradic a nebude respektovat rozhodnutí této soudní instituce?

  Julie Ward (S&D). – Mr President, the ruling of the European Court of Human Rights was a step in the right direction and certainly confirmed what our political family, the Socialists and Democrats, have been saying since Demirtas was first imprisoned. It is important that the Court called for his release and we will continue to advocate for the rights of HDP, our sister party.

I am, however, very worried about the uncertainty regarding the implementation of this ruling. The Turkish authorities have been very clear about their intention to disregard this ruling and to keep Demirtas in prison on the basis of other charges. I urge Turkey to implement this ruling. The situation of rule of law in the country is extremely worrying as the independence of the judiciary is questionable. As a friend of Turkey and a friend of the Kurdish people, I will continue to stand by Demirtas and all the other politicians, academics and journalists and human rights defenders that are currently attacked and imprisoned by the Turkish State.

  Νότης Μαριάς (ECR). – Κύριε Πρόεδρε, η απόφαση του Ευρωπαϊκού Δικαστηρίου Ανθρωπίνων Δικαιωμάτων για την υπόθεση του Ντεμιρτάς, που επί της ουσίας διατάσσει την απελευθέρωσή του, αποτελεί ένα ράπισμα για τον Ερντογάν, ένα ράπισμα για το αυταρχικό καθεστώς στην Τουρκία, στην Τουρκία όπου, όπως γνωρίζουμε, υπάρχει μια απέραντη φυλακή. Όλοι οι αντιφρονούντες έχουν μπει στη φυλακή. Βέβαια, ο Ερντογάν λέει ότι δεν θα εφαρμόσει την απόφαση. Είναι γνωστό ότι η Τουρκία είναι ένα κράτος το οποίο δεν εφαρμόζει το δίκαιο, ένα κράτος το οποίο απειλεί την Ελλάδα συνεχώς, ένα κράτος το οποίο έχει καταλάβει το 37% του κυπριακού εδάφους και ήρθε η ώρα, όχι μόνο για την υπόθεση Ντεμιρτάς αλλά συνολικά για την παράνομη δράση της Τουρκίας, να ληφθούν μέτρα, να επιβληθούν κυρώσεις, να γίνει διακοπή των ενταξιακών διαπραγματεύσεων, να επιβληθεί εμπάργκο στις εξαγωγές αγροτικών τουρκικών προϊόντων στην Ευρωπαϊκή Ένωση.

  Τάκης Χατζηγεωργίου (GUE/NGL). – Κύριε Πρόεδρε, να συγχαρώ καταρχήν το Δικαστήριο Ανθρωπίνων Δικαιωμάτων για την απόφασή του, την κυρία Επίτροπο, την κυρία Piri και όλους τους συναδέλφους για το ψήφισμα που μάλλον θα περάσει αύριο. Την επόμενη εβδομάδα θα συνεδριάσει η μεικτή επιτροπή Ευρωπαϊκής Ένωσης-Τουρκίας στην Άγκυρα. Θα μεταφέρουμε εκεί και την απόφαση του Ευρωπαϊκού Δικαστηρίου και την απόφαση που θα λάβει αύριο το Ευρωπαϊκό Κοινοβούλιο για το ψήφισμα που θα καλεί την Τουρκία να απελευθερώσει αυτό τον άνθρωπο, ο οποίος το μόνο που έκανε είναι να υπερασπιστεί τον λαό του, τα δικαιώματα του λαού του. Όμως τίθεται νομίζω ένα ερώτημα: Τι άλλο πρέπει να κάνει η Επιτροπή για να είμαστε αποτελεσματικοί; Είναι φανερό ότι τα λόγια δεν πιάνουν στα αφτιά του κυρίου Ερντογάν. Από τη μια μπαίνουν από την άλλη βγαίνουν. Πρέπει να δούμε τι μέτρα μπορεί να ληφθούν, αλλιώτικα θα μας μείνουν οι αποφάσεις.

  Γεώργιος Επιτήδειος (NI). – Κύριε Πρόεδρε, με βάση την εμπειρία που έχουμε σχετικά με τον τρόπο με τον οποίο παραβιάζονται όλες οι αρχές του κράτους δικαίου στην Τουρκία, δεν πρέπει να έχουμε την παραμικρή αμφιβολία ότι και η περίπτωση του Ντεμιρτάς θα χρησιμοποιηθεί από τον Ερντογάν με τρόπο ώστε να αποκομίσει όσο περισσότερα οφέλη μπορεί από την Ευρωπαϊκή Ένωση. Εκείνο το οποίο πρέπει να επισημάνουμε είναι ότι, όσο η Ευρωπαϊκή Ένωση ανέχεται την Τουρκία και ανέχεται να υποκύπτει στις απειλές και τις πιέσεις της, δεν πρόκειται να αλλάξει κάτι από τη συμπεριφορά της. Και διερωτώμαι τι έχουν να πουν στον τουρκικό λαό όλοι αυτοί οι οποίοι χύνουν τώρα κροκοδείλια δάκρυα και κόπτονται δήθεν για τις ελευθερίες και για τη δημοκρατία στην Τουρκία. Εάν συνεχίζουμε να αντιμετωπίζουμε την Τουρκία με αυτή την ανοχή, δεν θα επιτευχθεί τίποτε και απλά και μόνο θα κοροϊδεύουμε τον δυστυχή τουρκικό λαό. Εμάς όμως κανείς δεν μας κοροϊδεύει σχετικά με το θέμα αυτό.

  Federica Mogherini, Vice-President of the Commission / High Representative of the Union for Foreign Affairs and Security Policy. – Mr President, I shall contribute to your efforts to manage time by simply thanking those of you that bothered enough to come into this Hemicycle and take the floor to support the work we have done and the positions we have taken during these years in defence of all those in Turkey who have worked and continue to work for human rights and democracy. It is not always an easy task, but we believe it is something we do not do against Turkey, but for Turkey and for all Turkish citizens that aspire to a different kind of life.

Many of us have considered and still consider Demirtaş an interlocutor, and I had the chance to express publicly in Ankara just a couple of weeks ago the expectation we have – Commissioner Hahn and I, in the name of the European Union – to see the decision of the court implemented by the Turkish authorities. No clear position could have been expressed publicly at that moment, and I thank this Hemicycle for supporting that position. The work will continue.
