Die Präsidentin. – Als nächster Punkt der Tagesordnung folgt die Aussprache über den Bericht von Lara Comi im Namen des Ausschusses für Binnenmarkt und Verbraucherschutz über die Umsetzung der Richtlinie 2011/7/EU zur Bekämpfung von Zahlungsverzug im Geschäftsverkehr (2018/2056(INI)) (A8-0456/2018).
Elżbieta Bieńkowska,Member of the Commission. – Madam President, let me start this debate on late payments, which is an extremely important topic. Late payment is really an issue which has a strong impact on our businesses. Let me very briefly recall the history of the file, because it started in 1995 with the Commission’s recommendation on payment periods in commercial transactions. It stated that payment delays were really a danger to the survival of our European businesses.
In 2000, the first Late Payment Directive concluded that the situation had not improved – on the contrary – so in 2011 the revised Directive laid down stronger rules to combat late payments both by public authorities and businesses. In 2016, the Commission’s Report on the implementation of the Directive noted a reduction in average late payment delays. So can we say that late payments are a problem of the past? Of course not. Let me remind you that, today, only one in four businesses in the EU pays within the period agreed in the contract. Putting it another way, 60% of European businesses are regularly paid late, and this is really dangerous. Over half of those businesses suffer payment delays of more than 90 days.
For a small company, the probability of going bankrupt increases after six days of non-payment. And that is why late payments still account for 25% of insolvencies in the EU. And, of course, as everywhere in the economy, late payments are especially harmful to smaller companies – to SMEs – which rely on regular streams of liquidity to run their daily operations.
Is this all or partly the Directive’s fault? I really do not think so. I fully share the rapporteur’s position that the Directive remains the most appropriate instrument to combat late payment. Under this Commission, we have strictly enforced the Directive so, on the one hand, we have opened an active dialogue with the Member States – provided guidance, provided an exchange of best practices – but, on the other hand, we have not hesitated to take more formal and stringent steps. As for today, we have six ongoing infringement cases in the European Union.
I believe that it is still too soon for the revision of the Directive. The point is that late payment is a very complex problem that cannot be solved through legislation alone. I rather think that any change to either hard or soft law should be preceded by a profound change in the business culture and this is what we should focus on.
Evidence shows that late payments are intentional. It is widely known that businesses practice late payments to suppliers. It is the cheapest and the cost-free form of borrowing, but is it really cost-free for all of us, for the economy in its real effects? Of course not. Payment delays cascade down from one supplier to the next. In most cases, late payments are also avoidable as in the case of delays in public contracts. Let me focus a little bit more on this issue.
Lengthy administrative procedures result in extending the payment deadlines artificially and, again, this is especially damaging to smaller companies who are more dependent on contracts with public authorities. In fact I have to tell you that I find late payments by public authorities even more inexcusable than those by private businesses, because we should remember that these are the same public authorities who have very limited tolerance for late payments in the other direction, so from businesses to the tax authorities. Again, this is very dangerous.
The report describes the fear factor affecting smaller businesses – fear that prevents businesses from using the rights the Directive has granted. Fear forces businesses to accept unfair payment conditions from larger counterparts and this is the case for 70% of small and medium enterprises. So, abuse becomes habit, and habit becomes a culture. I firmly believe in the freedom of negotiations, but this freedom should not be abused to the disadvantage of the creditor.
The report lays down a thorough roadmap for building a more responsible payment culture and also strikes the right balance between combating late payments and defending contractual freedoms. It also calls for more transparency of payment practices, stronger enforcement policies and more education on financial matters, again especially for SMEs.
I am also pleased to see that the report takes into account several conclusions of the Commission’s own Implementation Report from 2016. I believe that more can be achieved now by leading by example and it can be done much more effectively.
The Directive calls for a decisive shift towards a culture of prompt payment, and this should be, in my view, our ultimate aim. Prompt payment speeds up the flow of money in the economy. It ultimately benefits everyone in society. So again, I want to applaud the report for the strong message in recognising and rewarding prompt payment practices.
Before concluding, I want to say one word on the very hard work of the rapporteur, Ms Comi, and of course the shadow rapporteurs. It was a huge effort in a short time. The result is a very thorough, very balanced and inspirational report, and I also want to thank President Tajani and my predecessor for adopting and starting to implement the Directive. I am looking forward to the debate and, of course, I want to call on you to accept the report.
Lara Comi, Relatore. – Signora Presidente, onorevoli colleghi, innanzitutto mi scuso perché avevo compreso che il dibattito iniziasse alle 18, quindi mi scuso con Lei, con i colleghi e soprattutto con la Commissaria.
Vorrei ringraziare veramente i colleghi che hanno collaborato insieme a me nella stesura di questa relazione perché, come è stato detto, è un tema importante e molto sensibile e utile, anche per la sopravvivenza delle nostre imprese europee.
La prima domanda che mi sono posta e che ci siamo posti insieme è: come si misura lo stato di salute di un'impresa? Sicuramente quando esiste un buon equilibrio tra un aspetto economico e un aspetto finanziario e patrimoniale e quando un'impresa è in grado di investire e di poter espandersi, creare occupazione e generare anche benefici in quell'economia che è sia nazionale, sia internazionale.
Però oggigiorno molte imprese europee, soprattutto le piccole e medie, che sono il tessuto industriale a livello europeo, sono costrette ad affrontare molti ostacoli per far fronte alla crisi. Ostacoli quali il ritardo dei pagamenti, nelle transazioni commerciali, da parte di un'altra impresa o soprattutto, ed è qui il vero problema, da parte della pubblica amministrazione. In Europa sei imprese su dieci sono pagate in ritardo, rispetto a quanto stabilito nel contratto.
Abbiamo considerato alcuni casi: 62% dei casi a difficoltà finanziaria riguardanti i loro debitori, il 48% dei ritardi intenzionali nei pagamenti, il 45% di inefficienze amministrative e il 19% per controversie.
Ma il problema vero ad aggravare la situazione è spesso quando si accettano in modo passivo termini di pagamento più lunghi, perché c'è una posizione dominante di alcune imprese rispetto ad altre. Pensate che, se tutto fosse applicato in modo corretto nei pagamenti, si potrebbero evitare veramente casi che abbiamo visto anche nelle cronache in Italia ma anche in altre realtà, dove gli imprenditori si tolgono la vita, dove gli imprenditori sono talmente disperati e arrivano a un fallimento ma per crediti non riscossi, non per debiti non pagati, e questo porta anche a perdite di lavoro e delocalizzazioni.
Partendo dalla direttiva che ha ricordato la Commissaria del 2011, che non ha raggiunto in tutti gli Stati membri l'obiettivo che ci siamo posti, abbiamo pensato di introdurre, in questa proposta, un maggiore sforzo per pagare entro i trenta giorni, come era stato anche stabilito e una maggiore trasparenza riguardo al comportamento in materia di ritardo dei pagamenti.
Noi dobbiamo aiutare, valorizzare le imprese e gli imprenditori e anche la pubblica amministrazione che paga in regola, con una cosiddetta white list, promuovere quelli che sono bravi e capaci, fornire agli imprenditori un'adeguata formazione in materia di gestione del credito e di fatture e considerando che migliaia di start-up e PMI falliscono ogni anno per colpa dei ritardi di pagamento della pubblica amministrazione, è doveroso fornire forme obbligatorie e adeguate di compensazione a livello fiscale, tra cui il risarcimento e altre forme e di sostegno, come il factoring che purtroppo nel mio paese non è ancora attivo.
Occorre altresì promuovere le best practice come quella spagnola che abbiamo anche introdotto nel documento e nel progetto, proprio perché quando un ente locale non è in grado di poter pagare, interviene lo Stato.
Tutte queste penso che siano delle ottime soluzioni, anche legate alla questione degli appalti pubblici. Bene escludere i contraenti inadempienti dagli appalti futuri, qualora i subappaltatori non vengano pagati puntualmente dal contraente principale, perché questo fa sì che la best practice alla fine dica chi sbaglia paga, ma a tutti gli effetti e anche alle conseguenze.
Si invitano gli Stati membri a istituire a livello nazionale servizi di mediazione. Ritengo che se tutti pagassero correttamente, risparmieremmo 158 milioni di euro in costi finanziari. Possiamo farlo, dobbiamo farlo e grazie a tutti, perché siamo riusciti a ottenere un ottimo risultato.

Cristian Dan Preda (PPE), întrebare adresată în conformitate cu procedura „cartonașului albastru”. –De fapt, voiam să intervin pentru a întreba de ce Președinția română a Consiliului nu este aici. Doamna Comi se adresa mai devreme statelor membre. Am observat, de altfel, că și la dezbaterea precedentă, a raportului Terricabras, acolo unde a fost vorba despre stat de drept și drepturi fundamentale, Președinția română nu era prezentă. Am impresia că nu au înțeles că trebuie să participe, în numele Consiliului, la aceste dezbateri și e absolut regretabil. Aș vrea să știu ce se întâmplă.
Lara Comi (PPE), Risposta a una domanda "cartellino blu". – Approfondirò la motivazione per cui non sono presenti, ma non c'è giustificazione che mi è stata indicata per la non presenza, mi sembra una grande mancanza di rispetto nei confronti dei nostri imprenditori e dei cittadini europei la loro non presenza.
Die Präsidentin. – Ich stelle fest, dass es viele Ratspräsidentschaften immer wieder versäumen, da zu sein, und das finde ich nicht allzu gut. Allerdings finde ich es auch nicht allzu gut, wenn man dies nur bei einer Präsidentschaft anmerkt und nicht bei jeder. Deswegen sollten die Kolleginnen und Kollegen doch gleiches Maß anlegen.
Andreas Schwab, im Namen der PPE-Fraktion. – Frau Präsidentin, liebe Kolleginnen und Kollegen! Zunächst möchte ich der Berichterstatterin danken. Frau Präsidentin, Sie kennen mich ja schon länger, Sie wissen, dass wir immer wieder – auch ich ganz persönlich – das Fehlen der Ratspräsidentschaft beklagt haben. Deswegen geht der Punkt, glaube ich, an der Sache vorbei.
Wir haben vor einigen Jahren in Europa in der Tat ein großes Problem gehabt. Der Zahlungsverzug zwischen Nordeuropa und Südeuropa variiert bis zu 180 Tage. Daran zeigt sich, dass wir regional besondere Schwierigkeiten haben, und diesen Schwierigkeiten hat der Bericht von Frau Kollegin Comi in besonderer Weise Rechnung getragen. Denn wir haben gesehen, dass wir mit der Änderung der Zahlungsverzugsrichtlinie, die wir ja in der letzten Wahlperiode beschlossen haben, wirklich etwas erreicht haben: Der Zahlungsverzug ist zurückgegangen. Aber Zahlungsverzug ist natürlich immer ein Stück weit auch ein Problem, das im Zusammenhang mit wirtschaftlicher Entwicklung zu sehen ist. Und deswegen müssen wir nochmal deutlich machen – und der Bericht von Frau Comi macht es sehr deutlich –: Kleine und mittlere Unternehmen leiden unter dem Zahlungsverzug besonders, und deswegen sind die Forderungen des Berichts in dieser Richtung von wirklicher Bedeutung.
Zum Zweiten muss es natürlich auch bei kleinen und mittleren Unternehmen Ausnahmen von strengen Regeln geben, denn wenn die Unternehmen untereinander etwas anderes vereinbaren wollen, dann muss es dafür Platz geben, weil in der Europäischen Union die Vertragsfreiheit gilt.
Drittens müssen wir auch aufpassen, dass wir nicht für jeden Sektor unterschiedliche Zahlungsverzugsregelungen schaffen, sondern dass klar ist – ähnlich wie bei den Fluggastrechten –: Zahlungsverzug ist in der Europäischen Union nicht gestattet. Es gibt ein Mindestzahlungsziel, und das muss von allen eingehalten werden. In diesem Sinne glaube ich, dass der Bericht das richtige Signal aussendet.
Maria Grapini, în numele grupului S&D. – Doamnă președintă, doamnă comisar, dragi colegi, în primul rând, vreau să spun că, în calitate de raportor din partea grupului politic, toată dezbaterea acestui raport a fost într-o atmosferă foarte corectă. Nu s-a ținut cont aici de ambiții și orgolii politice. Mulțumesc doamnei Lara Comi, care a condus foarte bine negocierea.
Doamna comisar, și dumneavoastră ați amintit că, de fapt, directiva, care a fost un prim pas din 2011 și adoptată în 2013, nu și-a atins scopul pe care noi îl speram – și anume să scădem întârzierile de plată.
Pentru că sunt și copreședinte la Intergrupul pentru IMM-uri, unde, de fapt, acest raport a fost dezbătut, vreau să vă spun că, indiferent de statul membru, toată lumea a ridicat aceeași problemă: problema IMM-urilor. Sunt într-un deficit de putere de negociere business-to-business și aici trebuie să intervenim.
De asemenea, în relația cu statul – a spus și raportoarea noastră – spun și eu că ar trebui să existe compensări, să nu trebuiască ca IMM-ul să nu primească banii din partea autorităților pentru că, da, sunt de acord cu doamna comisar: trebuie să îmbunătățim cultura antreprenorială.
Problema este ce facem cu cultura administrațiilor publice, centrale sau locale, care nu plătesc și care creează un lanț de neplăți. Cash flow-ul, lichiditățile sunt afectate și mă bucur că am reușit să negociem și să avem în acest raport și acea „listă albă”, despre care s-a mai vorbit, să existe o transparență.
Însă trebuie să avem pârghii sigure, pentru a nu duce la falimentul foarte multor întreprinderi mici și mijlocii. De aceea cred că directiva trebuie modificată.

Paul Rübig (PPE), Frage nach dem Verfahren der „blauen Karte“. – Ich möchte die Kollegin Grapini fragen, ob es nicht möglich wäre, dass auch der Zahlungsverzug vonseiten der Europäischen Union einmal transparent dargelegt wird.
Wir haben sehr viele Programme der Europäischen Union, und ich stelle fest, dass viele kleine und mittlere Unternehmen hier sehr lange warten müssen, bis die Liquidität wiederhergestellt ist. Könnten wir nicht in den europäischen Institutionen ein mapping machen, um sicherzustellen, dass auch wir als Europäische Union diese late payment directive einhalten?
Maria Grapini (S&D), răspuns la o întrebare adresată în conformitate cu procedura „cartonașului albastru”. – În primul rând, vreau să spun că domnul Rübig este foarte activ în Intergrupul pentru IMM-uri și este un susținător al IMM-urilor.
Da, sunt de acord! Așa trebuie să facem și sper, doamnă comisar, să țineți cont de propunerea indirectă făcută de colegul meu, domnul Rübig, pentru că sunt întârzieri din partea instituțiilor europene și evident că statele membre, după aceea, la rândul lor, întârzie plățile către IMM-uri. Sunt de acord și sper să poată fi cuprinsă această propunere în programul Comisiei.
Richard Sulík, za skupinu ECR – Vážená pani predsedajúca, ďakujem pekne. Zmluvná sloboda je jeden mimoriadne dôležitý princíp medzi firmami a vo fungovaní ekonomiky. Práve tieto aktivity narúšajú zmluvnú slobodu. Preto, lebo Komisa alebo aj Parlament vstupujú do vzťahov medzi súkromnými dodávateľmi, súkromnými odberateľmi, preto, lebo politici si myslia, že vedia omnoho lepšie a furt by chceli niečo regulovať. Najlepšie spravíme, ak sa do tohto vôbec nebudeme miešať.
Áno, sú firmy, ktoré platia aj neskoro. No tak tým firmám jednoducho nech nikto nedodáva. Každý dodávateľ si musí svoje pohľadávky chrániť sám. Nesmie mu ich chrániť Komisia, lebo to jednoducho nebude fungovať.
Ak pani komisárka si teda myslí, že naozaj sa treba venovať oneskoreným platbám, nech sa páči, nech začne pri samotnej Európskej komisii, ktorá ešte prednedávnom mala veľké nedostatky v platení načas. Alebo všetky eurofondy, ktoré chodia. To chodí od buka k buku tie peniaze. Takisto v Europarlamente dochádza k oneskoreným platbám. Venujte sa tomu, prosím pekne, ale nemontujte sa do súkromného sektoru. Ten si poradí najlepšie bez vás. Ďakujem pekne.
Jasenko Selimovic, on behalf of the ALDE Group. – Madam President, the entire European economy, especially small and medium-sized companies, is negatively affected by late payments. The EU has taken some action against this – we have this directive and liquidity flow in businesses has increased – but we still have a way to go. According to the figures provided by the Commission, more than half of Member States, and more than half of Member States’ companies, are still not paying and respecting the 30—day limit imposed by the law. Even worse, many of these small companies are not asking for compensation because they are afraid of becoming the enemy of somebody to whom they owe money.
Our report puts forward measures that will improve this. We are encouraging Member States to introduce even stricter payment terms. We are calling for the introduction of mandatory information – as was talked about just five seconds ago – on payment behaviour, such as databases and registers for both the public and private sectors. We are urging Member States to set the national and regional free and confidential mediation services so that these businesses can go to somebody else and ask them to fight their cause instead of them.
To finish, we are advising Member States to take all necessary steps in order to ensure that the public authorities pay their suppliers in due time, because this is happening sometimes for economic reasons and sometimes for political reasons as well. By doing this, Member States will increase the liquidity flow in businesses and help to fulfil their obligations, and we will manage to make the business climate in Europe better than it is today.
Igor Šoltes, v imenu skupine Verts/ALE. – Gospa predsednica, torej gre za temo, ki je izjemno pomembna za tudi gospodarstvo v Evropski uniji in pa za plačilno disciplino.
Kot smo lahko videli v preteklosti in tudi vsak dan, so zamude pri plačilih v trgovinskih poslih žal realnost, s katero se sooča mnogo evropskih podjetij. In tukaj pravzaprav nobena od evropskih držav ni posebej varna.
Posebej pa so na udaru mala in pa srednja podjetja, ki so največkrat tudi deležna te zamude pri plačilih. To pa seveda povzroča zelo hude posledice. Ničkolikokrat smo slišali za primere, ko so mala srednja podjetja šla v stečaj, ko so zaradi tega trpele cele družine.
In gre za to, da seveda lahko in moramo prepustiti veliko stvari trgu samemu, ampak vsekakor moramo vzpostaviti regulativo, ki bo šibkejše ščitila pred zlorabo močnejših. In te zamude pri plačilih so samo ena od oblik tako imenovane nedovoljene trgovinske prakse, ki se žal prepogosto pojavlja na vsakem koraku. In neplačevanje oziroma plačevanje z zamudo je samo eden od teh elementov poleg seveda vračanja neprodanega blaga, slabega ravnanja z malimi dobavitelji, in mislim, da kot Evropska unija smo dolžni poskrbeti za mehanizme, ki bodo na tem delu šibkejše zaščitili.
Bi pa seveda poleg te mediacije, ki so jo kolegi že omenili, omenil še nekaj: med velikimi neplačniki oziroma plačniki z zamudo pa se uvršča tudi javni sektor. In tu pa seveda ni izgovorov, da na tem delu ne moremo ukrepati. Tu mislim, da imamo ogromne rezerve in največ seveda lahko naredijo države same, samo sramotno je, da tudi javni sektor velikokrat prispeva k tej zamudi s plačili.
Jiří Maštálka, za skupinu GUE/NGL. – Paní předsedající, napříč Evropskou unií každoročně zbankrotují tisíce malých a středních podniků při čekání na proplacení svých faktur. Opožděné platby v Evropě způsobují mnoho případů platební neschopnosti, což vede k sociálním potížím a ztrátám pracovních míst. Směrnice z roku 2011 o postupu proti opožděným platbám v obchodních transakcích měla za cíl situaci pro společnosti zlepšit. Děkuji paní zpravodajce, že zmapovala a detailně ukázala, jaká je situace kolem provádění této směrnice. Ukazuje se, že stále existuje řada problémů a překážek, jako je nedostatečné povědomí o existenci tohoto právního nástroje. Dále chci uvést, že je pouze malé procento malých a středních podniků, které zaznamenaly pozitivní dopady na opožděné platby od dlužníků díky této směrnici.
Dámy a pánové, máme co zlepšovat. Nesouhlasím s kolegou Sulíkem, abychom se neangažovali v této věci, protože není horšího nepřítele pro střední a malé podniky, než je finanční úřad a jeho aparát, který vždycky hraje přesilovku. Podporuji proto plně paní zpravodajku a její návrhy na řadu opatření, která by mohla vést ke zlepšení prosazování směrnice o opožděných platbách. Cílem musí být nastavení rovných podmínek pro všechny společnosti.
Vzhledem k tomu, že jde, paní předsedkyně – prosím –, o moje zřejmě poslední vystoupení v tomto parlamentu, chci poděkovat všem, se kterými jsem za 17 let mohl spolupracovat, počínaje předsednictvem a konče tlumočníky.
Róża Gräfin von Thun und Hohenstein (PPE). – Pani Przewodnicząca! Zawsze podkreślam, że przecież z dnia na dzień widzimy jak pozytywnie zmieniło się nasze życie, dzięki temu, że wszyscy jesteśmy w Unii Europejskiej. Ale codziennie obserwujemy i odkrywamy, że moglibyśmy, że musimy robić coraz więcej. Udało się nam wiele: likwidacja geoblokowania, likwidacja roamingu – to te spektakularne ogromne sukcesy. Udało się nam to załatwić, a korzystamy wszyscy, wszyscy obywatele Unii Europejskiej.
Dziś przyglądamy się sytuacji przedsiębiorców w Unii Europejskiej i mamy sprawozdanie z wykonania dyrektywy w sprawie tzw. opóźnionych płatności. Wiele małych firm ma problem z powodu nieuregulowanych na czas płatności. Widmo bankructwa z powodu opóźnień stoi przed niejednym przedsiębiorcą, który i tak ma wystarczająco zmartwień z zawiłymi regulacjami, np. podatkowymi, albo małą płynnością. Dlatego sprawdzamy, czy prawo przyjęte w tej kadencji Parlamentu, działa jak należy. I co się okazuje? Nie działa.
Sprawozdanie słusznie wskazuje punkty, w których stosowanie przepisów mogłoby być znacznie lepsze. Jednak ta sprawa – pamiętajmy – leży w gestii państw członkowskich i to one odpowiadają za właściwe wdrożenie i egzekwowanie przepisów unijnych. Ważny jest postulat wprowadzenia większej przejrzystości, np. w odniesieniu do zachowań płatniczych. Rozwiązanie to mogłoby zachęcić opieszałych dłużników do szybszego spłacenia długów.
Zarówno wtedy, gdy przyjmowaliśmy tę dyrektywę, i dzisiaj musimy wyważyć wszystkie racje. Cele, które przyświecały regulacji, jak np. zwiększenie zatrudnienia, ochrona wierzyciela czy wzrost gospodarczy, są w tym przypadku bardzo istotne. Przedsiębiorcy – ostatnie zdanie, Pani Przewodnicząca – przedsiębiorcy, szczególnie mali i średni, są dla nas kołem zamachowym, a pacta sunt servanda i tak musimy pracować.
Nicola Danti (S&D). – Signora Presidente, onorevoli colleghi, signora Commissario, bisogna riconoscere che la direttiva del 2011 sul ritardo dei pagamenti ha avuto certamente in questi anni un effetto positivo, almeno quello di ridurre la durata media dei tempi di liquidazione per le aziende.
Tuttavia, sappiamo anche che ancora il 95 % delle piccole e medie imprese europee non riceve i compensi per le prestazioni nei tempi stabiliti e talvolta, anzi, questo ritardo provoca fallimenti per molte aziende. Allora io credo che questa relazione che domani il Parlamento approverà intende proporre miglioramenti per debellare questa piaga.
In particolare, a me preme sottolineare tre punti: il primo, introdurre per le imprese che vantano crediti nei confronti delle pubbliche amministrazioni, procedure di rimborso e recupero più rapido.
Il secondo: promuovere l'istituzione di servizi di mediazione gratuiti ed accessibili, per sostenere le piccole e medie imprese, che spesso non hanno i mezzi finanziari adeguati per affrontare lunghi contenziosi giudiziari.
Il terzo punto: prevedere la pubblicazione obbligatoria delle informazioni relative agli enti pubblici e privati che pagano nei tempi giusti. Credo, signora Presidente, che la certezza dei tempi di pagamento sia una sfida molto importante che noi abbiamo e può apparire anche difficile, visti i risultati non brillantissimi di questi anni. Tuttavia da questa passa la competitività del nostro sistema europeo delle aziende europee e credo che sia giusto garantire un ambiente nel quale i pagamenti sono nei tempi stabiliti e che è un ambiente nel quale esse possono svolgere bene la propria attività.
Anneleen Van Bossuyt (ECR). – Voorzitter, late betalingen zijn vaak een strop rond de nek van kleine ondernemingen. Om te groeien, om te innoveren, om aan te werven hebben zij hun zuurverdiende centen immers hard nodig. Een te laat betaalde factuur ontneemt hen vaak de zuurstof die voor hen nochtans cruciaal is om te overleven.
Ik vraag de Commissie en de lidstaten dan ook met aandrang om op te komen voor onze kleine en middelgrote ondernemingen, die uiteindelijk de ruggengraat vormen van onze economie. De achterpoortjes in de wetgeving die wanbetalers vrij spel geven, moeten gesloten worden. Twee op de drie Belgische bedrijven accepteert een langere betalingstermijn dan die welke ze eigenlijk comfortabel achten. Daarom diende mijn partij op nationaal niveau in 2017 een wetsvoorstel in om de maximale betalingstermijn vast te pinnen. Ook vanuit Europa moet er nu een krachtig signaal komen om late betalingen niet toe te staan.

Bogdan Andrzej Zdrojewski (PPE). – Pani Przewodnicząca! Debatujemy nad niezwykle ważną sprawą. Ważną, bo dotyczącą katastrofy – katastrofy w płatnościach. Tak jak pani komisarz słusznie zauważyła, to są z jednej strony pożyczki najtańsze – najtańsze oczywiście dla tych, którzy je biorą, ale niezwykle kosztowne dla tych, którzy je dają albo którym te środki są odbierane.
Ale chciałem przy tej okazji poruszyć inny temat, dlatego się zgłosiłem. Sami możemy mieć bowiem pewną satysfakcję. Zaczynaliśmy kadencję w Parlamencie Europejskim od zwrócenia uwagi na własne opóźnienia w płatnościach, na przykład w ramach takich programów jak Erasmus+, „Kreatywna Europa”, „Europa dla obywateli”. Po czterech latach możemy powiedzieć, że przynajmniej Komisja w zobowiązaniach i płatnościach poprawiła efektywność. Dzięki temu możemy mocniej, z mocniejszym mandatem, mówić o tych zaległościach, o tych zobowiązaniach, które są po stronie podmiotów gospodarczych.
John Howarth (S&D). – Madam President, I would like to express my thanks to the rapporteur and the Commissioner. Those of us who have run small businesses understand that it isn’t a lack of profitability that sends a business under, it’s a lack of cash, and thousands suffer from this in the EU every year. Last year I hosted an event with the Federation of Small Businesses from the UK on the need to improve the enforcement of the Late Payment Directive, and I’m pleased to see that this report proposes exactly that. Linking procurement rules with the terms of the directive – a particularly important measure after the collapse of Carillion last year – is exactly the kind of initiative we need. Automatic accrual of interest for the public sector: the public sector should lead by example and should pay on time. Mandatory reporting requirements for larger firms has been a positive step in the UK, and other Member States should replicate this. These are all important steps. The Commission should now launch a new public consultation as the next step to strengthening the Late Payment Directive.
Caterina Chinnici (S&D). – Signora Presidente, onorevoli colleghi, malgrado la direttiva del 2011 contro i ritardi di pagamento nelle transazioni commerciali, le imprese europee e specialmente quelle di piccola e media dimensione, continuano a scontare eccessivi ritardi nella riscossione dei crediti e non soltanto nei confronti della pubblica amministrazione.
In Italia, ma non soltanto nel mio paese, il tessuto economico è composto prevalentemente da piccole e medie imprese che tendono ad accettare termini di pagamento più lunghi da parte delle imprese di maggiori dimensioni, per timore di danneggiare le relazioni commerciali.
Occorre quindi sviluppare misure più incisive per scoraggiare quelle che di fatto diventano pratiche sleali, tenendo conto della specificità di ciascun settore produttivo, sul modello della direttiva sulle pratiche sleali nella filiera agroalimentare, volta a tutelare i piccoli produttori in un settore caratterizzato da forti squilibri nel potere contrattuale.
Ed è indispensabile che Commissione e Stati membri sviluppino campagne di sensibilizzazione sul rispetto dei tempi di pagamento e sui rimedi legali contro i ritardi, e questo anche per i crediti vantati nei confronti della pubblica amministrazione.
Νότης Μαριάς (ECR). – Κυρία Πρόεδρε, οι καθυστερήσεις στις εμπορικές συναλλαγές, η μη πληρωμή δηλαδή έγκαιρα από πλευράς ιδιωτικών επιχειρήσεων, δημιουργεί τεράστιο πρόβλημα στον ίδιο τον ιδιωτικό τομέα και, φυσικά, είναι μια διαδικασία που μπορεί να οδηγήσει σε πτωχεύσεις. Το μεγαλύτερο πρόβλημα όμως είναι να χρωστάει το Δημόσιο, διότι το Δημόσιο είναι αυτό το οποίο απαιτεί από τους φορολογούμενους να πληρώσουν και, όταν δεν πληρώνουν ή έχουν δυσκολία να πληρώσουν φόρους – όπως είναι οι φτωχοποιημένοι από τα μνημόνια Έλληνες – τότε το κράτος κάνει κατασχέσεις. Κάνει κατασχέσεις στους λογαριασμούς, κάνει κατασχέσεις στην περιουσία τους. Όμως σε αυτό το κράτος, το ελληνικό Δημόσιο οφείλει αυτή τη στιγμή, με στοιχεία του Δεκεμβρίου του 2018, ένα δισεκατομμύριο ευρώ στον ιδιωτικό τομέα. Ξέρετε γιατί τα οφείλει; Διότι κρατάει τα χρήματα προκειμένου να πληρώσει τους δανειστές, για να δημιουργήσει το περίφημο πρωτογενές πλεόνασμα. Αυτό το γνωρίζει η Επιτροπή, αλλά προτιμάει να πληρώνονται οι δανειστές από το ελληνικό Δημόσιο παρά να πληρώνει το ελληνικό Δημόσιο τις ιδιωτικές επιχειρήσεις.

Elżbieta Bieńkowska,Member of the Commission. – Madam President, I would like to thank all of the Members for this debate, but I especially want to thank you for again putting the late payment issue into the spotlight. It was a good debate and I believe that voting tomorrow will also be positive for this very good report. I want to remind you that we have been dealing with this issue in the EU since 1995 and there is still a lot of work to be done, especially in the area of changing the culture, as I said. Every business and every public institution must understand that this is in their own interest, that prompt payments really are in their own benefit. Since some of you have asked, I also want to underline that of course EU institutions – just like each and every European institution and business and public institution in Europe – have the same obligation under this directive. So let me tell you that the European Commission has introduced a zero tolerance rule for any late payments in the EU institutions. So this is something new and I hope it will give good results in the future. Thank you very much for this and let me say that, of course, the work on late payments is not yet finished.

Lara Comi, Relatore. – Signora Presidente, onorevoli colleghi, signora Commissaria, ringrazio tutti i colleghi che sono intervenuti perché è stato un dialogo molto costruttivo, ma un lavoro costruttivo per le imprese e per i cittadini.
Le pongo solo due rapidissime riflessioni: la prima, nel momento in cui uno Stato non dovesse attenersi a quella che è la direttiva sul ritardo dei pagamenti, entra in infrazione. Attenzione che questo metodo di infrazione porta a delle sanzioni e quindi ad un pagamento aggiuntivo, che va poi a ripercuotersi sui cittadini, e questo è un problema, perché paghi il doppio, cioè lo Stato non ti paga e in più devi pagare anche l'infrazione. Quindi bisogna trovare un altro metodo.
L'altro aspetto che, prima di Lei, ha ricordato il Presidente Tajani, si è ottenuto, per esempio per l'Italia, il fatto di poter sforare il 3 % per pagare i debiti della pubblica amministrazione. Naturalmente questo non deve essere la regola, ma sull'austerity, come giustamente ha ricordato anche ieri il Presidente Juncker, non si ottengono risultati e quindi non c'è scusa, in questo caso per l'Italia, per non pagare i debiti della pubblica amministrazione alle imprese. Penso che questo possa essere un metodo utilizzato anche per altri Stati. La ringrazio e confidiamo nel voto di domani.

Lidia Joanna Geringer de Oedenberg (S&D), in writing. – Late payments remain one of the problems of the European Single Market. In Europe, six out of ten businesses receive payments after the deadline set in a contract. While larger companies have the capabilities and financial means to cope with these difficulties, for SMEs and start—ups it might represent an existential constraint. Delays in transaction have a negative influence on enterprises’ ability to invest, grow, plan production and pay their employees’ salaries, and it hinders their general financial health. In the worse cases, delays might lead to bankruptcy or debts. Therefore, I am closely observing the implementation of the Late Payment Directive, under which businesses must pay invoices within 60 calendar days and public authorities within 30 days. Furthermore, the Directive introduces automatic payment of interest for exceeding the relevant payment date. I believe that authorities and business organisations should promote a culture of prompt payments within their guidelines, sharing the best practices processes and, if necessary, legislate. Settlement of missing payments cross-board should be simplified thanks to a European small claims procedure. A healthy business environment is a pre-condition for securing the competitiveness and solvency of the European economy.
