  Presidente. – L'ordine del giorno reca la relazione di Paulo Rangel, a nome della commissione per gli affari costituzionali, su un progetto di regolamento del Parlamento europeo che fissa lo statuto e le condizioni per l'esercizio delle funzioni del mediatore (statuto del mediatore europeo) e che abroga la decisione 94/262/CECA, CE, Euratom (2018/2080(INL) (A8-0050/2019).

Non vedendo ancora il relatore presente in Aula, procedo quindi a dare la parola, a nome della Commissione, al Vicepresidente Frans Timmermans.

  Frans Timmermans, First Vice-President of the Commission. – Mr President, as soon as he is here, I will thank the rapporteur, Mr Rangel, for his work on the report on the Statute of the European Ombudsman. The European Ombudsman is a key part of the institutional system of the European Union and an essential aid at the disposal of European citizens, who are entitled to good administration from the EU institutions and bodies. I would like to commend the Ombudsman’s work in fighting maladministration, which has been highly effective. This is illustrated, for example, by the high compliance rate of EU institutions and bodies with her recommendations, which is around 80%.

In this context, we welcome the Parliament’s report on the Ombudsman’s Statute. It is, of course, essential that the outcome of this review fully respects the respective roles of the EU institutions and bodies as established by the Treaty. I’d like to make a few preliminary remarks without prejudice to the formal opinion that the Commission will issue at a later stage, as foreseen in the Treaty.

We would agree in principle to amendments that consolidate current practice, which in our experience has worked well. This includes the possibility for the Ombudsman to propose solutions and for the deadline for the Commission to reply to recommendations to be able to be extended by two months. Extending the possibilities for the Ombudsman to appear before the European Parliament would also be welcome as, in principle, is the possibility for the Ombudsman to refer issues to OLAF and the European Public Prosecutor’s Office. As regards the proposed extension to three years of the deadline for lodging a complaint, we’d like to better understand the reasons for such an extension. We’re not opposed in principle but, to our knowledge, the current two-year period does not seem to have raised any practical problems. In addition, the more time that has elapsed, the more difficult it is for the administration to effectively address the issue raised by the complainant.

I would also like to recall that the Ombudsman’s role is to deal with cases of maladministration. Cooperation between the Ombudsman and the Fundamental Rights Agency on national fundamental rights, institutions and bodies should remain within that remit. These are preliminary remarks and the Commission will, of course, issue its opinion on the review at a later stage in the procedure, in line with Article 228 of the Treaty.

  Margrete Auken, ordfører for udtalelse fra Udvalget for Andragender. – Hr. formand! Og tak også for hr. Timmermanns’ gennemgang her. Jeg kan fuldstændig dele det. Derfor er jeg også lidt ked af, at de ændringsforslag, vi faktisk fik lavet i Udvalget for Andragender, hvor vi havde et rigtigt godt samarbejde, ikke allesammen overlevede AFCO. Jeg ved ikke, hvad der skete i AFCO. Her jeg gerne for mit vedkommende nævne to sager, som er afgørende – som hr. Timmermanns også kom ind på – nemlig dem, der har med god forvaltningsskik at gøre. Det ene er, at vi skal have slået fuldstændigt fast, at adgang til dokumenter skal være en selvfølge, og at det kun er de yderste sjældne tilfælde, at den ikke kan gives. Det ændringsforslag 9 vil jeg meget gerne bede om, at vi får.

Det andet drejer sig om interessekonflikter. Det er stadigvæk i alle vores lande et stort problem, at der er interessekonflikter i store dele af vores forvaltning, hvor det ikke er nok bare at sige, at man har den. De må slet ikke være der, hvis borgerne skal have tillid til os. Derfor vil jeg bede meget om, at det sker! Og jeg vil lige sige, at disse to punkter, som der jo er lov om i forvejen, drejer sig også om at give os stærke og stolte embedsmænd, for det er godt for forvaltningen og embedsmændene, at der er den sikkerhed omkring dem.

  György Schöpflin, on behalf of the PPE Group. – Mr President, I think we can all agree that the Ombudsman performs an extremely important function, because one of the factors that makes the European Union viable is its commitment to accountability and to following its own procedures. Sometimes it doesn’t happen, but if this commitment is eroded, then the dangers of arbitrariness, the illicit enlargement of power, the abuse of power even, become real. The function of the Ombudsman, therefore, is to ensure that, in these areas of activity, accountability and procedural consistency are observed fully. In this regard, the institution of the Ombudsman performs a very useful function equilibrating between the different institutions of the European Union. The only problem that arises from this is an ancient one: who guards the guardians? It’s the ‘quis custodiet’ problem.

Once upon a time, the proper operation was democracy, which was predicated on the political actors behaving with due regard for self-limitation. In the ideologically polarised world of today, self-limitation has fallen down the memory hole. So, the more guardians, the better.

  Enrique Guerrero Salom, en nombre del Grupo S&D. – Señor presidente, mi Grupo valora y apoya la función del Defensor del Pueblo. Como ha señalado el vicepresidente de la Comisión, es una institución clave para proteger a los ciudadanos de los casos de mala administración en las instituciones de la Unión.

Por lo tanto, queremos que esta institución siga funcionando en el marco institucional actual, pero adaptada a algunas cuestiones que han surgido en los últimos años y sobre las cuales se ha pronunciado el Parlamento: por ejemplo, mejorar el acceso a los documentos; por ejemplo, proteger o intervenir en la protección a los denunciantes; y, por ejemplo también, tener en cuenta los múltiples casos de acosos de distinto tipo que se producen en las instituciones.

Pero no queremos que el Defensor del Pueblo —el Ombudsman— sea un actor ante el Tribunal de Justicia de la Unión Europea. Queremos que siga la aplicación de las sentencias. Queremos que proteja en ese sentido a los ciudadanos europeos, pero no que sea a la vez un actor judicial. Y queremos que tenga mayores instrumentos financieros y administrativos para cumplir su labor.

  Νότης Μαριάς, εξ ονόματος της ομάδας ECR. – Κύριε Πρόεδρε, νομίζω ότι η λειτουργία του Ευρωπαίου Διαμεσολαβητή έχει αποδείξει ότι ενεργεί με αποτελεσματικότητα και ότι έχει επιτελέσει τον ρόλο του όλα αυτά τα χρόνια. Βεβαίως, μπορούμε —με τροποποιήσεις— να ενισχύσουμε τη δράση του. Εγώ θεωρώ σημαντική την ανεξαρτησία του Διαμεσολαβητή. Ταυτόχρονα, πρέπει να αποκτήσει πλέον τη δυνατότητα ενισχυμένων ερευνών ιδία πρωτοβουλία. Έγινε σαφές, στην πράξη, ότι αυτό είναι εξόχως σημαντικό. Ο Διαμεσολαβητής ήλεγξε κατά πόσον τηρούνται και σε επίπεδο Επιτροπής οι διαδικασίες, ιδίως δε η αποφυγή της σύγκρουσης συμφερόντων, έκανε το ίδιο σε σχέση και με την ΕΚΤ και παρενέβη στα θέματα δημοσιότητας και διαφάνειας, ιδίως για το Εurogroup. Νομίζω ότι πρέπει να ενισχύσουμε περαιτέρω τον ρόλο του Διαμεσολαβητή, ιδίως στο θέμα των μαρτύρων δημοσίου συμφέροντος και, κατά τη γνώμη μου, να του δώσουμε το δικαίωμα να παρίσταται στο Δικαστήριο της Ευρωπαϊκής Ένωσης υπέρ των δικαιωμάτων των πολιτών.

  Maite Pagazaurtundúa Ruiz, en nombre del Grupo ALDE. – Señor presidente, señor comisario, en primer lugar, lo que queremos indicar es que el equipo de Emily O'Reilly y la función que están realizando desde la Defensoría del Pueblo Europea nos parece muy notable, y por eso hemos seguido con tanto interés algunos de los informes que, de forma más intensa, hablaban de la necesidad de que el acceso a la información no sea algo discrecional por parte de los poderes públicos. Y, si bien en un primer momento tuvimos dudas sobre si era prioritario o no reformar el Estatuto, lo que sí pensamos es que el señor Rangel ha sabido manejar el asunto de una manera prudente y muy específica.

Los cambios que se pretende introducir en el Estatuto son para reforzar la independencia y la eficacia de la Defensoría del Pueblo. Y están hechos con finura, por eso los aplaudimos. Ahora bien, ha habido enmiendas en el texto que fue aprobado por unanimidad en la Comisión de Asuntos Constitucionales, y nuestro Grupo quiere ser partícipe de aquellas que siguen el camino emprendido por la Comisión de Asuntos Constitucionales en lo que se refiere a la protección de los denunciantes y en algunos procedimientos que se refieren al acoso sexual.

Porque son cuestiones en las que podemos realizar mejoras y en este trámite parlamentario lo vamos a intentar realizar; en todo caso, lo que sí queremos decir es que los ciudadanos europeos esperan mucho de la Defensoría del Pueblo Europea y que nosotros tenemos que estar a la altura de esa expectativa.

  Κωνσταντίνα Κούνεβα, εξ ονόματος της ομάδας GUE/NGL. – Κύριε Πρόεδρε, συνάδελφοι, ο θεσμός του Διαμεσολαβητή είναι ένας θεσμός που συμβάλλει στον εντοπισμό της κακοδιοίκησης. Το καταστατικό του πάλιωσε. Είναι το ίδιο εδώ και τριάντα χρόνια. Η ζωή όμως προχωρά και εμείς πρέπει να κάνουμε αλλαγές. Θα μου πείτε, η παρενόχληση στον εργασιακό χώρο των ευρωπαϊκών θεσμών, ένα θέμα για το οποίο έχουμε καταθέσει τροπολογίες, είναι κάτι καινούριο; Φυσικά και δεν είναι κάτι καινούριο. Είναι μια πολύ παλιά πληγή, αλλά τώρα είμαστε περισσότερο έτοιμοι να καταπολεμήσουμε αυτό το φαινόμενο και εδώ πρέπει να βοηθήσει ο Διαμεσολαβητής. Σας καλώ, λοιπόν, να υπερψηφίσετε τις τροπολογίες που κατέθεσα εκ μέρους της GUE/NGL. Να στείλουμε στους πολίτες ένα καθαρό μήνυμα διαφάνειας και εμπιστοσύνης: ότι ακούμε τα μηνύματά τους και μπορούμε να είμαστε αποτελεσματικοί.

  Josep-Maria Terricabras, on behalf of the Verts/ALE Group. – Mr President, the reform of the Ombudsman’s Statute is a good opportunity to update its capacity. We want to include in the Statute three competencies.

First, on whistle-blowers, we want to make explicit that the Ombudsman should be able to carry out investigations based on information by whistle-blowers, and we want to delete the references to professional secrecy in order to avoid any possible restrictions on future legislation on whistle—blowing polices. Second, on sexual harassment, the Ombudsman should be able to deal with complaints on sexual harassment without exhausting the internal procedures of the institutions. Third, on public access to documents, we want to delete any restrictions on access to documents that narrow the scope of the Regulation on public access to documents. This is how we will continue to defend good administration and transparency.

  Virginie Rozière (S&D). – Monsieur le Président, je voudrais d’abord, en tant que membre de la commission des pétitions, saluer le travail de notre rapporteure, Margrete Auken, qui montre le lien très fort que notre commission des pétitions entretient avec la Médiatrice, puis, évidemment, saluer le travail de la commission des affaires constitutionnelles, représentée par notre collègue Enrique Guerrero.

Notre groupe, mais il n’est pas le seul – vous l’avez entendu – a déposé des amendements importants pour renforcer le rôle de la Médiatrice européenne. La Médiatrice est, au travers du mandat du Parlement, le poste avancé des citoyens pour opérer le contrôle des institutions européennes. Pour cela, nous voulons – cela a été dit – que l’accès aux documents soit renforcé et que tout refus soit motivé, le cas échéant, devant la Cour.

Nous voulons aussi lutter contre les conflits d’intérêts: la Médiatrice est là pour garantir la bonne administration et nous voulons renforcer ses pouvoirs en ces matières ainsi que la protection des lanceurs d’alerte, pour faire en sorte que la Médiatrice puisse informer les citoyens, mais aussi coordonner les différentes entités nationales chargées de la protection des lanceurs d’alerte. Nous avons pris comme boussole, quelque part, le cas du «Selmayrgate». Dans ce cas-là, la Médiatrice a joué son rôle et pour l’instant, aucune conséquence n’en a été tirée. Nous voulons éviter que cela se reproduise et le renforcement des droits de la Médiatrice est un gage de bon fonctionnement de notre démocratie européenne.

  Caterina Chinnici (S&D). – Signor Presidente, onorevoli colleghi, signor Commissario, il regolamento che aggiorna lo statuto del Mediatore europeo rappresenta un esempio dell'impegno di questo Parlamento per garantire ai cittadini europei maggiore trasparenza e buona amministrazione, due fondamentali diritti previsti dalla Carta.

Fra gli aspetti più significativi del nuovo statuto rientrano le previsioni volte a garantire il raccordo con la futura Procura europea, laddove le inchieste del Mediatore dovessero rilevare reati contro gli interessi finanziari dell'Unione. La tutela degli interessi finanziari, che include la lotta alla frode e alla corruzione, deve infatti costituire parte integrante del diritto alla buona amministrazione.

È importante in tal senso anche la previsione, nel nuovo statuto del Mediatore, di uno specifico richiamo alla protezione dei wistleblower, così da permettere ai funzionari che vengano a conoscenza di casi di corruzione e frode all'interno delle Istituzioni e delle agenzie, di far emergere tali fatti senza temere ritorsioni. Questo potrà, a mio parere, potenziare la lotta a tali fenomeni, a beneficio delle Istituzioni e dei cittadini europei.

  Frans Timmermans, First Vice-President of the Commission. – Mr President, just to say that, in our view, the Ombudsman remains an extremely important instrument for addressing maladministration, so that we correct mistakes and avoid maladministration in the future. Improving the way the Ombudsman works is in all the institutions’ interests. So, in that sense, the Commission welcomes the report and, as you know, we will give a full reaction to it later, in conformity with Treaty rules.

I want to add one remark about whistle—blowers because this subject was mentioned by several Members. We are making good progress on really increasing the possibility of protection for whistle—blowers in the future and I want to thank Parliament for working closely with the Commission. Let’s hope we can convince the Council to come to a conclusion soon.

I have to say this is beyond what I had initially expected, so I do want to express my gratitude to Parliament for working closely with the Commission on this.

  Paulo Rangel, Rapporteur. – Mr President, I will speak in Portuguese, but first I would like to apologise to the Chamber, to the President and to the Vice-President of the Commission, for being late. Our way of life involves a lot of flying and when you are flying you cannot control the flight time. I am happy to have been able to attend a significant part of the debate and to speak at the end of it.

Senhor Presidente, queria dizer que é com imenso orgulho que apresento este relatório, desde logo porque ele teve o apoio unânime da Comissão de Assuntos Constitucionais e, portanto, significa que se conseguiu aqui uma base que é uma base, eu diria, muito consensual dentro dos membros da Comissão de Assuntos Constitucionais, e que, portanto, foi de um lado da bancada até ao outro percorrendo todos os grupos políticos que ali estão representados, portanto isto é o primeiro ponto.

O segundo é que era extremamente necessário fazer a reforma do Estatuto do Provedor de Justiça Europeu porque, talvez nem todos tenham consciência, mas o estatuto que nós tínhamos era anterior ao Tratado de Lisboa e, portanto, trata-se aqui, efetivamente, de fazer chegar, pelo menos ao eleitorado, nas eleições de 2019, um texto que esteja já em conformidade com o direito da União que já está em vigor há praticamente dez anos.

Devo, aliás, dizer que também é motivo de grande orgulho que este é um dos casos em que o Parlamento tem iniciativa legislativa e, portanto, é um caso singular do ponto de vista constitucional e por isso é um relatório também importante nessa medida.

Dito isto, eu queria dizer quais foram os dois princípios que conduziram a feitura deste relatório.

O primeiro foi: é preciso um novo estatuto adequado, mas não queremos, em caso nenhum, em caso nenhum romper com a ideia de soft law e de soft power que anda associada ao Provedor de Justiça. O poder do Provedor de Justiça, o poder do ombudsman é um poder suave, é um poder soft, é um poder informal. No dia em que ele passe a ser parte num processo, no dia em que ele passe a ter intervenções vinculantes, seja ainda que em domínios muito acabados, ele perde o seu poder.

Uma das razões pelas quais as instituições europeias, os vários corpos da União Europeia, confiam no Provedor é porque sabem que o seu poder não é vinculante. A sua autoridade e a sua força vêm da sua fraqueza, vêm da sua fragilidade. Ora havia algumas propostas e algumas tentativas de tornar numa espécie de procurador o provedor. Ora o provedor não é um procurador, o provedor não é um prossecutor, não é um ministério fiscal e, portanto, neste sentido, não é um pubblico ministero, como dizem os italianos e, portanto, é fundamental manter este soft power e creio que esse equilíbrio nós mantivemos.

Depois a segunda preocupação foi reforçar a independência, a imparcialidade, a isenção do Provedor, dando-lhe todos os meios para que ele possa atuar, garantindo que ele pode ter acesso a todos os órgãos e a todas as entidades e pode ter acesso a informação confidencial embora, evidentemente, fique vinculado por essa confidencialidade. Mas isso pode ser muito importante porque muitas vezes para chegar a algumas das suas conclusões, nos vários inquéritos que abre, nas várias diligências que faz, a capacidade de, por um lado, aceder a documentos confidenciais ou a informação confidencial, mas manter a confidencialidade dá-lhe, efetivamente, este estatuto.

Por isso o que nós fizemos foi também reforçar algumas das suas garantias de independência até no seu estatuto financeiro, etc., foi dar aqui alguma, diria eu, tradução prática à garantia de independência, de imparcialidade e de isenção do Provedor e, portanto, manter o seu estatuto de soft power.

Eu dizia que são estas as duas grandes armas de intervenção, depois há pequenos ajustamentos, pequenos acertos, nos direitos de queixa, num conjunto de pequenas matérias, que eu julgo que aperfeiçoam, mas não rompem com aquela que é a tradição de uma instituição, que até agora funcionou bem, e, enfim, costuma-se dizer, até no futebol, que, em equipa que ganha não se mexe. E, portanto, numa equipa como esta, que é uma equipa ganhadora, que é a da Provedoria de Justiça Europeia, evidentemente que nós mexemos o menos possível, mexemos o essencial para reforçar o seu estatuto e estamos muito satisfeitos que se tenha conseguido um grande consenso na Comissão de Assuntos Constitucionais.

Oxalá amanhã no plenário esse consenso se traduza também numa votação que reforce o Provedor de Justiça Europeu como um órgão no qual, não apenas as entidades europeias, mas especialmente os cidadãos da União Europeia, podem confiar e confiar plenamente. É ele o seu defensor, é ele o seu provedor.

  Jarosław Wałęsa (PPE), na piśmie. – Rozwój roli Rzecznika Praw Obywatelskich w strukturze konstytucyjnej Unii wymaga utrzymania jego niezależności. Bezwzględnie konieczne jest zatem dostosowanie przepisów Statutu Europejskiego Rzecznika Praw Obywatelskich do obowiązujących Traktatów. Konieczna jest również gwarancja, że organ ten nadal będzie odgrywał szczególną i decydującą rolę w ramach konstytucyjnych Unii Europejskiej.

Warto nadmienić, że wykonywanie obowiązków rzecznika nie powinno zależeć od innych instytucji, organów czy jednostek organizacyjnych Unii, ani z perspektywy politycznej, ani budżetowej. Co więcej, należy zobowiązać instytucje, organy i jednostki organizacyjne Unii do udzielania Rzecznikowi Praw Obywatelskich wszelkich wymaganych przez niego informacji, z zastrzeżeniem obowiązku nieujawniania takich informacji przez Rzecznika. Liczę, że nowy statut umocni niezależność i bezstronność tego organu.
