  Michaela Šojdrová (PPE). – Paní předsedající, ochrana lidských práv je jednou ze základních hodnot, na kterých je Evropská unie založena. Přijetí Listiny základních práv Evropské unie a její závaznost tak představuje zásadní krok, kterým Evropská unie vyslala signál, že ochrana lidských práv je a vždy bude vůdčím principem pro všechny instituce, orgány i členské státy při aplikaci unijního práva. Dodržování listiny musí být bezvýhradné. Byla bych však velmi opatrná v jejím pojímání jako strategického dokumentu, podle kterého by se měla přizpůsobit vnitřní pravidla institucí. Instituce musí být transparentní, ale pokud ve jméně listiny zavedeme průběžná hodnocení dopadu na ochranu lidských práv, četná školení a jiné byrokratické procesy, pak skončíme jako administrativní kolos, ve kterém se skutečný význam listiny jakožto katalogu lidských práv utopí. Proto jsem se také při konečném hlasování zdržela.

  Andrejs Mamikins (S&D). – Madam President, I welcome the report drafted by my colleague Barbara Spinelli. The task of the EU institutions is indeed not only to avoid violation of the Charter but rather to maximize its potential.

Furthermore, it’s evident that some very important steps of decision making are simply falling outside the scope of the Charter. First of all, I’m speaking about the Council meetings, where it is believed that it is better for the public not to see how choices are made. I am glad that the Ombudsman has recently reported this practice. Secondly, I am talking about the so—called trilogues. You cannot find the word ‘trilogue’ in the Treaties and, because of their informal character, they are kept out of the public eye.

Being committed to transparency and respect for fundamental rights, I specifically welcome the call to conduct separate fundamental-rights impact assessments, to be included in all items of legislation as a fundamental-rights review clause.
