  President. – The next item is the debate on the oral question to the Commission on use of cannabis for medicinal purposes, tabled by Dubravka Šuica, Guillaume Balas, Urszula Krupa, Catherine Bearder, Estefanía Torres Martínez, Martin Häusling and Piernicola Pedicini, on behalf of the Committee on the Environment, Public Health and Food Safety (O-000122/2018 - B8-0001/2019) (2018/2775(RSP)).

  Dubravka Šuica, izvjestiteljica. – Poštovana predsjedavajuća, u protekloj godini veliki dio moga rada u Parlamentu posebno je bio usmjeren na javno zdravlje, borbu protiv raka, podizanje svijesti javnosti i pristup medicinskim uslugama i lijekovima.

Večeras predstavljamo rezoluciju Europskog parlamenta i usmeno pitanje o upotrebi kanabisa u medicinske svrhe. Puno smo raspravljali o ovoj temi u Odboru ENVI, a prilikom izrade ove rezolucije željeli smo se usredotočiti na podupiranje kvalitetnih istraživanja lijekova koji se temelje na kanabisu, kao i na razlikovanju lijekova na bazi kanabisa koji su prošli klinička ispitivanja i koji su regulatorno odobreni, a i samog medicinskog kanabisa.

Taj izraz je u velikoj mjeri nedefiniran s pravnog stajališta i zato smatram da on ostaje nejasan i otvoren za tumačenje. Osim toga, važan aspekt ove rezolucije bio je napraviti strogu razliku između upotrebe kanabisa u medicinske svrhe i njegove zloupotrebe.

Zemlje Europske unije se u velikoj mjeri razlikuju u pristupu propisima za kanabis, uključujući zakonodavstvo o kanabisu za medicinske svrhe, na primjer, o maksimalnim razinama dopuštenih koncentracija THC-a i CBD-a.

Čak i u onim državama članicama u kojima je medicinski kanabis zakonit, uvjeti za pristup, propisivanje, kupnju, određivanje cijena, povrat novca, kao i razina znanja zdravstvenih radnika o uporabi ovakvih lijekova jako se razlikuju i predstavljaju problem za pacijente. Zato smo u usmenom pitanju Komisiji zatražili obrazloženje: što je Komisija poduzela kako bi podržala kvalitetna istraživanja, što planira poduzeti u pogledu budućih istraživanja, koliko sredstava planira izdvojiti za istraživanja u ovom području u okviru Devetog okvirnog programa Obzor Europa i smatra li Komisija da regulatorno okruženje u Europskoj uniji podržava kvalitetna istraživanja o medicinskom kanabisu. Isto tako, smatra li Komisija da bi trebala poboljšati pristup pacijenata medicinskom kanabisu? Također, namjerava li Komisija uspostaviti norme za nefarmaceutski medicinski kanabis kako bi zajamčila sigurnost korisnika?

U rezoluciju smo pozvali Komisiju i nacionalne vlasti da rade zajedno kako bi osigurali pravnu definiciju medicinskog kanabisa i da napravimo jasnu razliku između lijekova na bazi kanabisa odobrenih od Europske medicinske agencije ili drugih regulatornih agencija, medicinskog kanabisa kojeg ne podržavaju klinička ispitivanja i kanabisa za druge primjene.

Kao što znamo, biljka kanabis sastavljena je od brojnih kanabionida koji mogu imati neuroprotektivno djelovanje, mogu doprinijeti smanjenju nekih simptoma u pacijenata kao što su upale ili bakterijske infekcije, a mogu pospješiti i rast kostiju.

Također, sveobuhvatno reguliranje lijekova na bazi kanabisa koji se temelji na dokazima podrazumijevalo bi dodatne resurse za javna tijela, ograničilo crno tržište, zajamčilo kvalitetu proizvoda i točno označivanje kako bi se pomoglo kontroliranju prodajnih točaka, ograničio pristup toj tvari za maloljetnike, ali i omogućila pravna sigurnost i siguran pristup pacijentima koji bi ga koristili u medicinske svrhe s posebnim mjerama opreza za mlade i trudnice.

Važno je naglasiti da pregled postojeće znanstvene literature o upotrebi kanabisa daje uvjerljive i zadovoljavajuće dokaze da ima terapijske učinke u liječenju kronične boli u odraslih, na primjer u slučaju raka, o kojem smo govorili u prošloj točki, kao i u slučaju epilepsije, Alzheimerove bolesti, artritisa, astme, Chronove bolesti, glaukoma, kao i simptome spastičnosti koje opisuju pacijenti s multiplom sklerozom te su djelotvorni u liječenju pacijenata s poremećajem anksioznosti, PTSP-jem i depresijom.

Ne bih željela ići predaleko s ovom temom pa ću ovdje zaključiti da je rad europskih institucija i agencija na podizanju svijesti o značaju istraživanja i pravnoj definiciji ovog medicinskog kanabisa od najveće važnosti i može pomoći samo pacijentima kojima su zbilja potrebni ti lijekovi, naravno, uz stroge propise i temeljitu analizu.

Na nama političarima, javnim osobama, profesorima, aktivistima je da se ujedinimo u borbi za poboljšanje zdravlja u svakom pogledu. U svakom slučaju želim još samo naglasiti da želimo striktno odijeliti upotrebu kanabisa u medicinske svrhe od onoga koji se koristi za rekreacijske svrhe i to je vrlo važno naglasiti tako da se svaka zlouporaba ovom našom željom otklanja.

  Věra Jourová, Member of the Commission. – Madam President, honourable Members, over the past decade, we have seen growing public interest in the development of therapies derived from cannabis and its components and in the use of cannabis for medical purposes. The therapeutic use of cannabis has been discussed in relation to a wide range of medical conditions, from multiple sclerosis to post—traumatic stress disorder and anxiety.

I would first like to highlight the distinction between non—pharmaceutical medical cannabis and medicinal products derived from cannabis. When it comes to the regulatory point of view, the EU angle is limited. This is a Member State competence, which means that each national authority will decide whether it is legal in its territory. On the other hand, the EU pharmaceutical legislative framework is clear and robust and includes cannabis—derived medicinal products.

A marketing authorisation is granted for a medicinal product only after its quality, safety and efficacy have been evaluated, and a positive benefit/risk balance related to its use has been concluded. Once placed on the market, medicinal products continue to be monitored through pharmacovigilance activities, which also apply to cannabis—derived medicinal products.

So, how exactly can the EU contribute to this discussion? Well, early dialogue and scientific advice for medicinal-product development are examples of EU added value. Furthermore, coordination between the various EU agencies is crucial.

Let me now address each of the questions you raised. As a starting point, let me stress that more research is needed on the safety and efficacy of cannabinoid—based therapies. Opportunities to support this type of research will be available through the upcoming Horizon 2020 calls for research proposals in 2019 and 2020. As for previous framework programmes for research and innovation, the EU has funded a number of relevant projects and fellowships. More than EUR 40 million has been dedicated to research on cannabis and cannabinoid—based compounds. Our mission is to encourage research and innovation in Europe and we will continue with that approach.

In the new framework programme, Horizon Europe, the Commission will continue to support research, including in innovative areas including novel therapeutic approaches.

Turning now to your second series of questions, let me say that the healthcare—related issues are complex, and decisions are taken by the Member States. The EU regulatory framework for pharmaceuticals provides for the authorisation of medicinal products derived from cannabis when their quality, safety and efficacy have been proven. Any other use of cannabis for a medical purpose falls within the competence of the Member States. However, that is not to say that the EU is not contributing to this discussion. In October 2016, the European Monitoring Centre for Drugs and Drug Addiction launched a new service on cannabis, providing updates on cannabis policy models. In December 2018, the agency published a report on medical use of cannabis and cannabinoids, as well as questions and answers for policy making. This was in response to the growing interest in the topic.

On your third set of questions, I want to take this opportunity to stress that non—pharmaceutical medical cannabis lies outside EU competence. At the same time, the Commission is aware of the discussion in the World Health Organisation Expert Committee on Drug Dependence about the pharmaceutical preparation of psychoactive substances. If applicable, the relevant conclusions will be considered in the framework of the pharmaceutical legislation on a product basis.

  Peter Liese, im Namen der PPE-Fraktion. – Frau Präsidentin, liebe Kolleginnen und Kollegen! Der medizinische Einsatz von Cannabis ist sinnvoll. Cannabisprodukte können Patienten helfen, denen andere Medikamente nicht oder nicht gut genug helfen.

Wir müssen uns in der Debatte vor zwei Extremen hüten. Das eine Extrem ist, so wie beim Pawlowschen Hund, man hört das Wort Cannabis und reagiert: Oh, das ist was Gefährliches, Schreckliches, illegale Drogen, da müssen wir dagegen sein. Wenn es medizinisch kontrolliert eingesetzt wird, ist dieser Pawlowsche Reflex nicht angemessen.

Aber auf der anderen Seite müssen wir eben auch aufpassen, dass Patienten nicht eine Einstellung entwickeln, wie es mir mal als Arzt von einem Patienten vorgetragen wurde, der sagte: Ja, gegen meine Rückenschmerzen hilft eigentlich nur, wenn ich in einen Joint rauche. Ohne, dass das wirklich vorher gut von einem Facharzt untersucht worden war, der ihm vielleicht ganz andere Tipps noch hätte geben können, was man gegen die Rückenschmerzen alles machen kann.

Also, man muss das in einem regulierten Rahmen machen. Man muss das vorsichtig machen. Ich stimme auch ausdrücklich dem Punkt 14 in der Entschließung zu, dass man das eben – wie bei anderen Medikamenten – unter den Regeln der Zulassung machen muss. Es kann doch nicht sein, dass wir der Industrie bei anderen Sachen hohe Auflagen machen und sagen, wenn sie Cannabis einsetzen, darf man es einfach so irgendwo machen.

Da findet die Entschließung den richtigen Rahmen, und deswegen werden wir sie morgen hoffentlich mit großer Mehrheit unterstützen.

  Guillaume Balas, au nom du groupe S&D. – Madame la Présidente, Madame la Commissaire, j’ai eu des douleurs musculaires un jour et dans mon pays, la France, je suis allé voir un neurologue et la seule chose qu’il m’a dite c’est «fumez du haschich».

D’abord, le problème c’est que fumer c’est mauvais pour la santé et qu’ensuite le haschich est prohibé dans mon pays. Ne croyez pas que dans toute l’Europe aujourd’hui, on puisse utiliser du cannabis médicinal, c’est-à-dire la molécule CBD, ce n’est pas vrai. Donc, nous avons besoin d’un encadrement européen et de ce point de vue-là il est très important que la Commission puisse donner des indications claires aux États membres.

Je voudrais également dire que la résolution présentée ici est claire sur le fait notamment que c’est bien les médecins qui contrôleront les prescriptions et c’est très important. Il ne s’agit pas de dire aujourd’hui que n’importe qui peut utiliser du cannabis, mais que c’est bien le médecin, seul juge, qui peut dire que le cannabis CBD peut être utilisé dans le cadre de la résolution d’un certain nombre de douleurs pour les patients. Mais à cet égard, un certain nombre d’amendements ont été déposés, notamment par les députés conservateurs, qui consistent à dire que seule la forme médicamenteuse pourrait être utile. Or, ce n’est pas tout à fait vrai car, on le sait, des modes de prescription doux, par exemple, tisanes, pommades ou autres peuvent être parfois beaucoup plus efficaces et beaucoup plus ciblés chez certains patients qui supportent mal les médicaments. Donc, attention. Certes il faut des médicaments et il faut qu’ils soient contrôlés, mais il faut aussi faire confiance aux médecins pour qu’ils puissent prescrire d’autres modes d’administration, et c’est notamment le sens des amendements que mon groupe déposera, qui soient des modes plus appropriés pour certaines pathologies et certains profils.

N’enfermons pas le débat, il n’y a pas de dérive possible, nous ne parlons ici que de cannabis médicinal, de la molécule CBD, et non pas de cannabis récréatif, je le précise une nouvelle fois, et il nous faut être ouverts car il ne faudrait pas que les lobbies pharmaceutiques soient les gagnants dans cette affaire.

  Urszula Krupa, w imieniu grupy ECR. – Pani Przewodnicząca! Popieram nie tylko poszukiwanie nowych leków pochodzenia naturalnego kojarzonych ze zmniejszoną ilością objawów ubocznych, ale przede wszystkim profilaktykę, która powinna być fundamentalna w opiece zdrowotnej, obejmując znacznie szerszy zakre, niż tylko eliminowanie czynników ryzyka. Do tej pory zwrócono na to uwagę w rezolucji. Oficjalne dane na temat badań i finansowania marihuany medycznej są nikłe. Udokumentowane skutki lecznicze preparatów farmakologicznych na bazie marihuany dotyczą jedynie zmniejszenia spastyczności w SM, działania przeciwbólowego i przeciwwymiotnego po chemioterapii w chorobie nowotworowej. Przed rozpowszechnianiem marihuany medycznej należałoby najpierw przeprowadzić badania kliniczne nad wpływem szczególnie zawartych tam THC i CBD, a wprowadzanie do powszechnego używania marihuany określanej jako lecznicza z bardzo wysokimi procentami THC i nikłymi CBD wydaje się mało odpowiedzialne. Tego typu odmiany przed wprowadzeniem do lecznictwa otwartego powinny być przebadane w warunkach klinicznych i dopiero ewentualnie używane do leczenia w poszczególnych jednostkach chorobowych, jednak tylko wtedy, kiedy zyski z podania narkotyku będą większe niż skutki uboczne. Eksperymentowanie z narkotykami, z ich zaleceniem w tak wielu jednostkach chorobowych i dolegliwościach bez uprzednich wiarygodnych badań zaprzecza profilaktyce, tym bardziej że leczenie narkotykami charakteryzuje się adaptacją do nich, koniecznością używania coraz większych dawek, silniejszych narkotyków i powikłań.

  Luke Ming Flanagan, on behalf of the GUE/NGL Group. – Madam President, I support most of this resolution. We must create the legislative architecture to support the legalisation of medical cannabis across the European Union. We need to see an end to the situation whereby people such as Vera Twomey and her husband Paul must, in spite of getting a licence to treat their daughter’s debilitating illness, travel six times a year to the Netherlands to get this medicine. They should be able to source this medicine locally, either that or the importation of this proven medicine be delivered to their house.

Freedom of movement of goods is meant to be one of the cornerstones of this Union. Let’s make the freedom of the movement of this medicine a reality. Vera Twomey and her husband Paul have woken hundreds of thousands of people up to the fact that medicinal cannabis can help. Their nine-year-old daughter is now seizure-free and the constant trips to the hospital have become a thing of the past. Ava now has a future. We need this future to be made available to all who need it. This resolution will go some way to achieving that.

  Pilar Ayuso (PPE), por escrito. – Es importante diferenciar entre uso recreativo y utilidad terapéutica del cannabis. Es obvio que el cannabis no es una panacea, pero sí posee propiedades terapéuticas para el tratamiento sintomático de algunas enfermedades. Por ejemplo, el dolor crónico, que en mi opinión está muchas veces desatendido desde el punto de vista médico. El cannabis su utiliza como complemento de calmantes y otros fármacos que no consiguen por sí solos paliar el dolor.

No debemos, por otro lado, banalizar los riesgos del consumo de cannabis. Según el Comité de Expertos en Farmacodependencia de la OMS, su consumo puede producir efectos adversos como mareos y alteraciones motoras y de la función cognitiva. Resulta necesario llevar a cabo un mayor número de investigaciones farmacológicas, preclínicas, toxicológicas y de ensayos, que garanticen el control de la calidad, seguridad y eficacia del uso médico del cannabis y sus cannabinoides, así como de estudios que permitan conocer los posibles riesgos asociados a su consumo. Habría así mismo que estudiar su legalización para usos terapéuticos en medicina.

  Miriam Dalli (S&D), in writing. – As a Maltese representative I am proud to say that by passing progressive and necessary legislation, Malta is at the forefront of European progress in the field of medical cannabis. A common European approach will impact and shape national health policies, research and education and bring this beneficial treatment to those in need. This resolution is timely as it calls on the Commission to develop a comprehensive strategy for the sector, emphasising the all-important need for the standardisation and unification of products containing cannabis-based medicines. This should also cover CBD where a lack of regulation has allowed low—standard products to enter the market across Europe. We need to ensure EU—wide standards and requirements that will ensure patients’ safe and reliable access to high quality products. However, it is worth noting that without a structured doctors education programme, it doesn’t matter what the law says if doctors do not have the necessary expertise to prescribe the medicine. Education must go hand in hand with the legislation and proper balanced guidelines are essential for the way ahead.

  Czesław Hoc (ECR), na piśmie. – Paracelsus, zwany ojcem medycyny nowożytnej, jest autorem słynnej tezy „tylko dawka decyduje od tym, czy dana substancja jest trucizną, czy też lekiem”. Moim zdaniem, podobnie możemy powiedzieć o marihuanie – tylko odpowiednia proporcja dawki THC do CBD oraz droga podania decyduje o tym, czy marihuana będzie lecznicza czy rekreacyjna („narkotykowa”). Bowiem dwie główne substancje zawarte w suszonych lub sfermentowanych kwiatostanach żeńskich konopi indyjskich (Cannabis sativa) to THC (delta-9-tetrahydrokanabinoid), który ma działanie „narkotyzujące”: wprawia w stan euforii, daje uczucie „pełnego luzu”, zmienia doznania, natomiast CBD (kanabidiol) posiada działanie przeciwdrgawkowe, przeciwpsychotyczne, przeciwzapalne, przeciwnowotworowe, prawdopodobnie zapobiega też zmianom neurodegeneracyjnym. Zatem dla celów leczniczych chcemy CBD z niewielką domieszką THC. Ot i cała mądrość i... sztuka. A ponieważ medycyna jest pospołu wiedzą i sztuką, zatem należy jej zaufać. Przyjęte dossier przez PE daje zielone światło dla kontrolowanego i w sposób naukowy nadzorowanego stosowania marihuany w celach leczniczych. Jeśli bowiem są lub będą dowody naukowe, że marihuana zmniejsza ból, wymioty, poprawia apetyt i samopoczucie spowodowane chemioterapią czy też redukuje liczbę napadów u pacjentów cierpiących na padaczkę lekooporną oraz rzadkie zespoły padaczkowe, zmniejsza spastyczność mięśni i ból u pacjentów cierpiących na stwardnienie rozsiane, a co więcej wpływa korzystnie na układ odpornościowy – to dlaczego urzędowo mamy tego zabraniać!?
