  Πρόεδρος. – Το επόμενο σημείο στην ημερήσια διάταξη είναι η συζήτηση επί της εκθέσεως του Franck Proust, εξ ονόματος της Επιτροπής Διεθνούς Εμπορίου, σχετικά με τη θέσπιση πλαισίου για τον έλεγχο των άμεσων ξένων επενδύσεων στην Ευρωπαϊκή Ένωση (COM(2017)0487 - C8-0309/2017 - 2017/0224(COD)) (A8-0198/2018).

  Franck Proust, Rapporteur. – Monsieur le Président, Madame la Commissaire, pour savoir où l’on va, il faut savoir d’où l’on vient, et je pense pouvoir dire au nom de tous que l’on revient de loin.

Lorsque trois pays membres ont proposé de créer un mécanisme européen de filtrage des investissements, l’accueil fut glacial. Lorsque le PPE a proposé un document de l’Union au Parlement européen sur ce mécanisme, l’accueil fut réservé. Lorsque le Président Juncker a présenté la proposition de règlement, ici-même, en septembre 2017, le scepticisme était majoritaire.

Je souhaite d’ailleurs féliciter, ici, l’efficacité des services de la Commission européenne, qui ont très rapidement réagi avec un règlement, dès le départ habile, notamment sur la question des compétences.

Je crois qu’on peut tous se féliciter d’avoir pris en compte à la fois le contexte, le besoin et surtout les intérêts de chacun, et ce grâce à un excellent travail commun des trois institutions: une présidence autrichienne du Conseil consciente des enjeux politiques, une Commission à l’écoute des propositions et un Parlement européen pragmatique.

Je souhaite remercier également mes collègues et corapporteurs, avec qui le travail de réflexion a été une force. C’est ce trio qui a réussi. Alors, vous l’avez dit, Madame la Commissaire, ce mécanisme est une première.

Le premier mécanisme européen sera un complément majeur des mécanismes nationaux de filtrage. Et pour reprendre le titre célèbre du roman d’un autre Proust, nous étions «à la recherche du temps perdu».

Nos principaux partenaires disposent déjà tous d’un mécanisme: les États-Unis, avec le CFIUS, ont une expertise depuis 1975. Ce mécanisme est donc le symbole de la prise de conscience des Européens que le monde qui nous entoure n’est pas rempli seulement d’investisseurs aux objectifs bienveillants. Vous conviendrez que cette vision était bien naïve.

Désormais, les États membres ne pourront plus fermer les yeux sur des investissements étrangers et étranges sur le territoire européen et dire: «nous ne savions pas». Nous ne savions pas que toute une chaîne de valeurs européennes a été acquise par une seule entreprise étatique ou étrangère, nous ne savions pas qu’une technologie à double usage, civil et militaire, a été acquise par une armée étrangère, nous ne savions pas que l’investisseur ultime, réfugié derrière un investisseur classique, avait pour objectif de saboter un programme européen. Ne pas savoir est une faute, à l’heure où les preuves de ces craintes sont parfois inscrites dans la planification politique de l’économie de certaines puissances étrangères.

Nous restons bien entendu ouverts aux investissements étrangers, car nous en avons besoin. L’Europe est une terre d’innovations et restera compétitive, aussi grâce à la libre circulation des capitaux.

Mais la liberté ne veut pas dire l’anarchie. La liberté ne veut pas dire l’impunité. Filtrer ne veut d’ailleurs pas dire interdire. Filtrer, c’est retenir le meilleur et les mailles de ce filtre, dans ce règlement, sont à la hauteur des enjeux actuels, et ce grâce, aussi, au Parlement européen, qui a joué son rôle en renforçant la proposition de la Commission, faisant de ce mécanisme autre chose qu’un timide essai.

Nous avons renforcé la collecte et l’échange d’informations, nous avons renforcé l’anti-contournement des mécanismes nationaux, nous avons renforcé la coopération intraeuropéenne et également internationale. Nous avons surtout marqué une étape en remplaçant la loi du silence par la loi du dialogue.

Enfin, vous savez que je ne peux pas ne pas parler du troisième scénario, ce scénario du pire pour lequel je me suis battu, jusqu’au bout, et qui permet d’anticiper, d’ores et déjà, les inquiétudes d’au moins un tiers des États membres sur un investissement étranger. La Commission, au cœur de ce dispositif, devra alors donner un avis. Cet instrument est une chance que les États membres doivent saisir pour l’ordre public et la sécurité des Européens, car nous sommes dans le marché unique, mais pas uniquement dans un marché. L’Europe, avec cet instrument, pourra mieux se prémunir de l’effet papillon d’un investissement, sans parler aussi de la course à l’investissement que se livrent les États-Unis et la Chine, et qui ne doit pas faire de l’Europe un supermarché. Elle doit rester une vitrine.

Alors oui, nous revenons de loin. En un temps record pour un nouveau règlement, nous avons trouvé cet accord et, désormais, nous pouvons dire que nous savons où nous allons, vers une Europe qui affirme et défend ses intérêts offensifs et défensifs.

  Reinhard Bütikofer, Verfasser der Stellungnahme des mitberatenden Ausschusses für Industrie, Forschung und Energie. – Herr Präsident, Frau Kommissarin Malmström, werte Kolleginnen und Kollegen! Wenn man vor drei Jahren davon sprach, dass es nötig sei, von den USA beim Investment-Screening etwas zu lernen, dann traf man meistens auf völliges Unverständnis. In den drei Jahren haben wir enorm viel dazugelernt. Ich möchte mich, wie Herr Proust, bei allen Institutionen, die an dieser erfolgreichen Übung beteiligt waren, bedanken – bei der Kommission insbesondere. Das war eine sehr erfreuliche Zusammenarbeit. Auch bei der österreichischen Präsidentschaft und nicht zuletzt bei Ihnen, Herr Proust, als Berichterstatter. Sie haben das wunderbar geleitet.

Das Investment-Screening wurde von zahlreichen Mitgliedstaaten skeptisch beäugt, als es auf den Tisch kam. Wir können heute feststellen, dass es da einen Meinungswandel gegeben hat. Eine ganze Reihe von Mitgliedstaaten, die am Anfang das nicht mit der Pinzette anfassen wollten, sind inzwischen zu der Überzeugung gekommen, dass sie das auch aktiv betreiben müssen.

Wichtig ist festzuhalten: Wir wollen damit keinen Protektionismus betreiben, aber wir sind auch nicht blauäugig. Es ist kein industriepolitisches Instrument, sondern ein Instrument, um Sicherheit und öffentliche Ordnung zu verteidigen.

Wir haben in der Tat schnell gearbeitet, und ich bin dankbar für diese Zusammenarbeit. Wir werden sicherlich in dem Bereich auch noch weitere Schritte machen müssen. Aber es zeigt, dass diese Union unter neuen Herausforderungen handlungsfähig ist und neue Wege einschlagen kann.

  Cecilia Malmström, Member of the Commission. – Mr President, let me start by thanking the rapporteur, Mr Proust for the work you’ve done here –tireless, energetic and also very inclusive. Also Mr Bütikofer for the work you have done and the very constructive approach that you and your colleagues had in the trilogues that we’ve been doing jointly on this.

As you know, the Commission made it a priority to finalise legislation on the Foreign Direct Investments (FDI) screening before the end of this term. President Juncker announced it here, sitting here, in his State of the European Union in September 2017, when he announced that he wanted to move on to propose a proposal on investment screening. And with your support we are about to deliver just that for our citizens, that their security and public order interest will be protected.

By concluding this file we send a very strong message to our partners. We are open in the European Union to foreign investment. That is, and has been and will be fundamental to growth, jobs etc. But a condition for being open is to be able to trust that foreign investors will not threaten our security and our strategic interests. Increasingly, in an interconnected and interdependent world, we share opportunities but also threats, and this becomes even more important in the internal market where a foreign investment in one Member State might have an impact in another, or the whole Union.

In September when we launched the proposal, this was, as was said by the two rapporteurs, a new policy area. Several Member States and some of our international partners, actually, most of them, were already experienced in this type of legislation, screening foreign direct investment. But the majority of our Member States did not have their own legislation or mechanism in place.

This proposal has triggered a constructive debate at European and national level, and what we see is that several Member States are now in the course of reforming or even introducing their own screening mechanisms. This regulation will help set a common framework, increase cooperation and information sharing and building on efficient practices.

Thanks to the new regulation, Member States and the Commission will have a much better overview of foreign investment in the EU. Moreover, for the first time, they would have the possibility to collectively assess potential risks to their security and public order. I welcome Parliament’s and the Member States’ understanding of the need for a key role for the Commission here as well in this mechanism, when security and public order in several Member States could be at risk or with projects of the Union’s interest, like Galileo or Horizon 2020, fundamental for our future.

In its initial position and in the course of the negotiations, Parliament has made it clear that it was supporting this proposal and it has sought further improvement, and they have largely passed into the final compromise. The cooperation mechanism has been reinforced in many aspects. For instance, with the possibility for a Member State to proactively seek opinions or comments, the strengthened provisions on anti-circumvention or an increased scrutiny by the Commission when a third of Member States issue concerns on a specific foreign investment. Furthermore, you have proposed reporting with the yearly public report on the implementation of the regulation. International cooperation with like-minded third countries is also encouraged, and I would like to thank you for these improvements.

Tomorrow’s vote will be an important milestone. As we will be shifting towards implementation, we will use the transition phase to ensure that Member States and the Commission can swiftly put in place the necessary arrangements for this new mechanism. I think we can all salute this moment and hope for a very strong vote tomorrow because we know that this is of concern to our Member States, to our companies, to our citizens, and we will have delivered by then.

  Geoffrey Van Orden, rapporteur for the opinion of the Committee on Foreign Affairs. – Mr President, I would like to thank the Commissioner for her remarks. The interest in this foreign direct investment (FDI) screenings framework arose, of course, from concerns about external investors buying technologies in our European countries which could be used for their own strategic objectives, while they themselves maintain barriers for investments from European countries.

We’re pleased that the draft regulation agreed in trilogue recognises that it is the sole responsibility of Member States to safeguard their national security. It’s important, therefore, that individual Member States retain responsibility for setting up screening mechanisms for FDI on grounds of security and to cover critical infrastructure and sensitive technologies. These now specifically include, among other categories, aerospace and defence facilities and nano and bio technologies. There is also a need to consider whether a foreign investor is directly or indirectly controlled by government or its state bodies or armed forces, including through the ownership structure.

So this is a difficult and complex area and I might just – somewhat mischievously and separately – remark that while today we’re considering only FDI into the Union, some of the considerations should also perhaps apply to activities within the Union, particularly investment in assets in one Member State by state-controlled assets in another. But that’s another matter.

  Roberts Zīle, Ekonomikas un monetārās komitejas atzinuma sagatavotājs. – Priekšsēdētāja kungs, cienītā komisāres kundze! Man ir liels gandarījums, ka Eiropas Savienība beidza būt naiva un domāt, ka visas trešo valstu investīcijas rada tikai peļņu viņas īpašniekiem un darba vietas Eiropas Savienībā. Un labi, ka šī skrīninga sistēma tiek veidota.

Man ir arī gandarījums, ka Prosta kungs novadīja šo daudzu komiteju iesaistītos viedokļus un nepazaudēja to, kas komitejās tika radīts. Un arī ECON komitejas vārdā es varu teikt, ka mums bija gandarījums tas, ka mēs iestrādājām dalībvalstu ekskluzīvo ekonomisko zonu, kas ir arī teritoriālie ūdeņi, kā investīciju vietu Eiropas Savienībā.

Un, vēl būtiskāk, kritiskajā infrastruktūrā investīcijās no trešām valstīm mēs ieskaitījām medijus, jo mediji ir demokrātiskas sabiedrības pats viens no būtiskākajiem elementiem, un, ja mediji tiek, vairākkārt tirgojot caur dažām citām Eiropas Savienības dalībvalstīm no trešām valstīm... faktiski ietekmē citās dalībvalstīs sabiedrisko domu un demokrātiskos procesus. Un man ir liels gandarījums, un es ļoti ceru ka dalībvalstis sadarbosies arī par šādām pārrobežu daļām, kas maina trešo valstu investīciju saturu. Tā kā es ļoti ceru, ka šis ir pirmais solis — ļoti veiksmīgs. Nebūsim naivi! Mums ir trešās valstīs ne tikai tehnoloģijas zādzības, bet arī sabiedriskās domas ietekmēšanas vēlmes.

  Christofer Fjellner, för PPE-gruppen. – Herr talman! Jag ska börja med att tacka Franck Proust som har lett arbetet med den äran. Men innan vi diskuterar investeringsgranskning tycker jag att vi måste börja i rätt ända, med att slå fast några viktiga sanningar.

Det första är att investeringar, även utländska sådana, är bra. De skapar jobb och tillväxt, och det behöver vi mer av i Europa – jobb, tillväxt och investeringar. Det märktes tydligt inte minst efter euro- och finanskrisen.

Det andra, det stora problemet vi har i Europa i dag, är tyvärr fortfarande investeringsprotektionism, att länder vill skydda sina kronjuveler från internationellt eller utländskt ägande. Ibland franska som vill skydda sig från italienska, ibland italienska från franska, ibland holländare som inte vill sälja Akzo Nobel till amerikaner.

Men det är inte bara investeringsprotektionism som är problemet, och det är inte bara för få investeringar som är problemet. Det är trots allt så att vi har alltför många handelspartner som gör investeringar med annat än kommersiella intressen. Alla våra handelspartner har inte goda avsikter, och då måste vi ha verktyg att möta dem. Ibland handlar det om säkerhetspolitik. Ibland handlar det om att stjäla teknologi eller sabotera teknisk utveckling i Europa. Då måste vi ha en full verktygslåda för att möta det. Det här initiativet borde följas upp av vidare initiativ, till exempel i gränslandet mellan handel och säkerhetspolitik för att skydda vår cybersäkerhet. Det vi ser i dag med Huawei och ZTE oroar mig – att jag inte kan ringa hem från Bryssel till Sverige utan att göra det över kinesiska televäxlar. Det här borde var en läxa även för Sverige, för Sverige tillhör ett av få länder i Europa som inte har någon sådan här investeringsskrivning. Då tycker jag att Sverige i stället för att ställa sig i hörnet och tro att vi vet bäst borde titta på våra grannländer i Europa och lära av deras exempel.

  Agnes Jongerius, namens de S&D-Fractie. – Voorzitter, bij investeringen als de verkoop van de Duitse robotmaker Kuka aan een Chinees concern, of het mogelijk binnenhalen van Huawei in Europa is er terecht angst voor de nationale veiligheid, het weglekken van kennis of kil winstbejag, zoals bij de opsplitsing van het Nederlandse chemieconcern AkzoNobel onder druk van activistische aandeelhouders het geval was.

Europa moet echter geen dam opwerpen tegen buitenlandse investeringen, want veel van die investeringen dragen namelijk ook positief bij aan de werkgelegenheid, aan innovatie en daarmee aan onze economische groei. Maar we moeten wel realistisch zijn.

De eerste stappen die wij hier vandaag zetten, zijn goed, maar uiteindelijk moeten we toe naar een mechanisme waarbij de Europese Unie één vuist maakt tegen ongenode gasten. Alleen zo beschermen we de kennis, de veiligheid en de werknemers.

  Joachim Starbatty, im Namen der ECR-Fraktion. – Herr Präsident! Auch die ECR möchte sich bei Herrn Proust bedanken, nicht nur für die konstruktive, sondern auch für die angenehme Atmosphäre, die Sie geschaffen haben. Der Schutz vor ausländischen Übernahmen und Investitionen aus Gründen von Sicherheit und öffentlicher Ordnung ist legitim. Auch ein Informationsaustausch zwischen EU-Staaten ist sinnvoll. Allerdings muss der Einsatz dieses Instruments eng beschränkt bleiben – Herr Fjellner hat darauf hingewiesen; es darf die große Mehrheit legitimer Interessen nicht abschrecken. Die Investitions- und Rechtssicherheit darf nicht in Frage gestellt werden.

Großen Wert legt die ECR darauf, dass dieses Instrument nicht aus protektionistischen Gründen eingeführt beziehungsweise angewendet wird, denn die EU profitiert wie kaum ein anderer Standort von Investitionen aus dem Nicht-EU-Ausland. Diese Gefahr war im ursprünglichen Bericht gegeben. Die Politisierung des Screenings unter Einfluss von Dritten hätte Aspekte jenseits von Sicherheit und öffentlicher Ordnung in den Vordergrund gerückt. Das hätte dem Protektionismus Vorschub geleistet. Deshalb hat die ECR als einzige Fraktion ursprünglich gegen den Parlamentsbericht gestimmt.

In der Einigung im Rahmen des Trilogs sind entscheidende Aspekte für uns geändert worden – zum Positiven. Der Einfluss des Parlaments auf die Einzelfallentscheidung ist nicht realisiert worden. Die letzte Entscheidung in jedem Investitionsfall liegt bei den Mitgliedstaaten, also das Prinzip der Subsidiarität. Mitgliedstaaten, die keinen Screening-Mechanismus haben, werden nicht zu dessen Einführung gezwungen.

Die Einigung im Trilog schafft Rechtssicherheit und erfüllt aus der Sicht der ECR die notwendigen Anforderungen, und deswegen werden wir zustimmen.

  Dita Charanzová, on behalf of the ALDE Group. – Mr President, I agree that this is an important piece of legislation, which addresses some of the concerns currently related to investments coming to sensitive sectors in Europe. These concerns exist, various Member States face them and I am convinced that we can now bring a new instrument to our toolbox in this area. For instance, if we had this regulation in place today, we could have come up with a more coordinated approach to some of the Chinese companies, Huawei for instance.

Personally, I value in this legislation the exchange of information between respective stakeholders in the Member States. Some of the potentially problematic investments could come to several countries, and it would be beneficial to share information on them. It remains on a voluntary basis to set up a screening mechanism at a national level, but there is no doubt that there are good reasons to control investments coming to very sensitive areas such as critical infrastructure, defence and the security industry, but also the media or – very topical now – telecommunications and new digital technologies, such as artificial intelligence.

The EU needs to remain open to foreign investment. It has always been a source of our economic growth. Through the process of negotiating this regulation, I emphasise that this is by no means a protectionist tool, but a guarantee for the EU to face those investments where economic goals are not a primary consideration, a sort of warning in the same way that we need trade, defence or anti-dumping legislation. They are triggered only when a threat is identified. I believe this regulation will prove useful and functional once applied.

  Eleonora Forenza, a nome del gruppo GUE/NGL. – Signor Presidente, onorevoli colleghi, signora Commissario, credo che l'obiettivo del meccanismo che voteremo domani sia in teoria quello di proteggere settori strategici e infrastrutture. E noi crediamo che abbia un senso, che si possa avere un meccanismo di screening.

Qual è il punto, però? Che in presenza di un estremismo neoliberista, che molto spesso obbliga o induce fortemente alla privatizzazione – e sicuramente le politiche di austerità hanno agito in questa direzione – con una politica che privilegia la concorrenza, vietando addirittura la possibilità di aiuti di Stato, quando non di pubblicizzazione e di nazionalizzazione di settori strategici, lo screening di investimenti può ridursi a uno strumento di definizione di gerarchie tra Stati membri dell'Unione europea. Potrebbe quindi diventare, da uno strumento per gli Stati membri per rendere più forte le loro imprese, uno strumento per alimentare una guerra commerciale. Da strumento di difesa commerciale a uno strumento di guerra commerciale che andrebbe a privilegiare gli Stati membri più forti dell'Unione europea.

  Christelle Lechevalier, au nom du groupe ENF. – Monsieur le Président, ce cadre pour le filtrage des investissements étrangers se donne pour objectif de nous protéger d’investisseurs extra-européens, hostiles, souhaitant s’approprier nos entreprises stratégiques et leur technologie.

À l’heure où les Chinois rachètent dans nos pays des infrastructures clés et des entreprises disposant de savoir-faire uniques, afin d’en récupérer bien entendu l’expertise, il est temps de dire stop au laisser-faire. Une prise de conscience est nécessaire et la délégation Rassemblement national approuvera ce texte qui est un premier pas, bien tardif, vers des mesures de protection de notre économie et de nos actifs stratégiques.

Rappelons cependant que depuis des décennies, l’Union européenne a favorisé le libre-échange outrancier et le libéralisme le plus débridé. Si aujourd’hui toute l’Europe est potentiellement menacée par des investissements extra-européens dans des États dépourvus de mécanismes de filtrage, c’est avant tout à cause du marché commun que vous avez mis en place, sans réserve. Ce midi encore, la plupart des députés applaudissaient l’un des nouveaux traités de libre-échange organisant la mise en concurrence déloyale de nos entreprises avec celles des quatre coins du globe.

Depuis 40 ans, la Commission, la majorité des députés et de nos gouvernements ont été complices des politiques qui ont entraîné notre désindustrialisation. Ils ont également laissé de nombreuses entreprises stratégiques être rachetées par des intérêts étrangers.

Les pompiers pyromanes que vous êtes souhaitent maintenant mettre en place des protections pour limiter, tant bien que mal, les dégâts causés par leur propre politique. À trois mois des élections, espérons que ce mécanisme ne soit pas qu’une communication envers nos citoyens et qu’il permettra une réelle évolution. L’Europe de demain devra protéger les intérêts de ses États membres. Ce protectionnisme intelligent a toujours été l’une de nos priorités, espérons que cela devienne la vôtre aussi.

  Σωτήριος Ζαριανόπουλος (NI). – Κύριε Πρόεδρε, ο έλεγχος της Ευρωπαϊκής Ένωσης σε επενδύσεις τρίτων κρατών στο έδαφός της είναι μέρος ενός πραγματικού πολέμου· του οικονομικού. Ο οποίος μετατρέπεται, βέβαια, σε θερμό πόλεμο. Η Ένωση αμύνεται απέναντι στην οικονομική διείσδυση τρίτων: της Ρωσίας, της Κίνας και άλλων. Κατά της Βρετανίας, σαν Δούρειο Ίππο ξένων επενδύσεων μετά το Brexit. Ο έλεγχος δεν προβλέπεται υποχρεωτικός, μόνο και μόνο λόγω των εσωτερικών αντιθέσεων εντός της Ένωσης. Λειτουργεί, όμως, σαν εκβιασμός υπέρ των συμφερόντων των μονοπωλίων της. Το εύρος των ελέγξιμων επενδύσεων και η έννοια της ασφάλειας την οποία προασπίζει ο έλεγχος αλλάζουν ανάλογα με τα εκάστοτε συμφέροντά της σε επενδύσεις υποδομών υψηλής τεχνολογίας, στην άμυνα και στον έλεγχο μέσων ενημέρωσης και προπαγάνδας. Εξαιρούνται, βέβαια, οι επενδύσεις στην άμυνα από χώρες του ΝΑΤΟ. Οι εργαζόμενοι πρέπει να το ξέρουν: η περίφημη ελευθερία του κεφαλαίου και της κίνησής του πάει περίπατο. Γίνεται προστατευτισμός αν πρόκειται να προστατευτούν τα συμφέροντα των μονοπωλίων. Ενεργοποιείται, όμως, μόνιμα και πάντα ενάντια στους εργαζόμενους και τους λαούς, που πρέπει να την ανατρέψουν κόντρα στους πολέμους των καπιταλιστών και να ικανοποιήσουν τις δικές τους ανάγκες.

  Daniel Caspary (PPE). – Herr Präsident! Ich bin sehr dankbar, dass wir morgen aller Voraussicht nach mit breiter Mehrheit diesem Vorschlag zustimmen. Ich bin vor allem deshalb dankbar, weil wir über dieses Thema in vielen Mitgliedstaaten, auch hier im Parlament lange diskutiert haben.

Vielleicht war es ja doch auch eine der Ursachen, dass endlich Bewegung rein kam, dass Frank Proust und einige Kollegen aus unserer Fraktion das indirekte Initiativrecht des Europäischen Parlaments genutzt haben und damit auch signalisiert haben, hier im Parlament gibt es Unterstützung.

Was mir wichtig ist: Wir machen morgen aus meiner Sicht einen guten Schritt, aber bitte auch nur einen ersten Schritt. Ich finde es gut, dass im Moment die Mitgliedstaaten die Entscheidungen zu treffen haben. Aber ich sage es ganz offen: Wenn ich mir anschaue, wie stark dominant schon viele ausländische Regierungen auch bei uns in den Mitgliedstaaten tätig sind, wie klein manche Mitgliedstaaten im globalen Kontext sind und wie klein eigentlich alle unsere Mitgliedstaaten im globalen Kontext sind, dann wünsche ich mir, dass wir in einem nächsten Schritt – vielleicht in der nächsten Wahlperiode – Mehrheiten finden, um den nächsten Schritt zu gehen, der Europäischen Kommission mehr Macht zu geben.

Und ich wünsche mir, dass wir auch über den Anwendungsbereich nochmal nachdenken. Wenn ich gerade sehe, wie viel Geld wir in das nächste europäische Forschungsrahmenprogramm investieren, dann wünsche ich mir, dass wir im Zweifel auch, wie Sie das angedeutet haben, Frau Kommissarin, Möglichkeiten haben, unsere Forschungsergebnisse gegebenenfalls vor ausländischen Akquisitionen zu schützen.

  Pedro Silva Pereira (S&D). – Senhor Presidente, Senhora Comissária, felizmente o bom senso acabou por prevalecer. A versão final do novo regulamento para o controlo do investimento estrangeiro, que resultou do trílogo entre as Instituições Europeias, é uma solução equilibrada, permite responder a preocupações que são legítimas quando estejam em perigo valores especialmente importantes, mas fá-lo sem prejudicar a capacidade para atrair investimento externo. E, convém lembrar, o investimento estrangeiro é importante para a economia europeia e é ainda mais importante para os países europeus que têm falta de capital próprio para investir.

Por isso, saúdo as duas regras fundamentais que foram consagradas: o facto de o novo procedimento de troca de informações e análise dos investimentos ter carácter excecional e ser reservado para quando esteja em causa a segurança e a ordem pública, e o facto de a decisão final sobre os investimentos pertencer aos Estados soberanamente. São eles que decidem os investimentos no seu próprio território.

Podemos assim avançar na proteção dos nossos interesses comuns sem prejudicar a nossa capacidade para atrair o investimento estrangeiro.

  Ralph Packet (ECR). – Voorzitter, een van de grote troeven van onze Europese economieën is de openheid waarmee we investeringen uit alle windstreken verwelkomen. Maar wie denkt dat buitenlandse investeringen enkel en alleen met goede bedoelingen komen aanwaaien, die dwaalt. We zien meer en meer agressieve overnames of investeringen door bedrijven die bijvoorbeeld onder Chinese staatscontrole lijken te vallen.

De Europese Unie mag voor deze investeringen geen naïef opengrenzenbeleid voeren. We moeten een evenwicht bewaren tussen openheid en bescherming van onze strategische belangen. En dat moet gebeuren zonder de goede economische banden tussen landen onder druk te zetten. We blijven beschikbaar voor vrijhandel, zonder de deur open te zetten voor protectionisme.

Daarom steun ik een Europees kader waarin de Europese Unie vooral een coördinerende rol opneemt. De lidstaten behouden zo hun zelfstandigheid om zelf mechanismen uit te werken. Dit is een domein waarop de Europese Unie door haar schaalgrootte meerwaarde kan creëren zonder in de plaats te treden van de individuele lidstaten.

  Paloma López Bermejo (GUE/NGL). – Señor presidente, el análisis y control de las inversiones extranjeras directas puede resultar necesario en determinadas ocasiones y en sectores específicos y de especial importancia. Pero las razones establecidas en este informe no nos parece que sean ni las correctas ni las que vayan en la dirección adecuada.

Una inversión extranjera peligrosa es aquella que puede cerrar fábricas o afectar de tal manera a un sector que los empleos se vean perjudicados. Una inversión extranjera peligrosa es aquella que fomenta las prácticas contaminantes y dañinas contra el medio ambiente y que, por supuesto, no respeta la responsabilidad social. Cuando la Unión Europea protege, lamentablemente no lo hace pensando en los trabajadores.

Sin embargo, este instrumento se centra en la seguridad y la defensa como único argumento para declarar cuán pertinente es una compra de acciones o una adquisición. El proteccionismo selectivo para evitar las inversiones de países no amigos de la Unión Europea no es el camino para proteger a quien verdaderamente lo necesita, que no son otros que los trabajadores.

  Marcus Pretzell (ENF). – Herr Präsident, sehr geehrte Frau Kommissarin, meine sehr geehrten Damen und Herren Kollegen! Es steht völlig außer Frage, dass wir uns innerhalb der Europäischen Union gegen Investitionen, die eben nicht rein wirtschaftlichen Interessen, sondern anderen Interessen dienen, wie wir das insbesondere in der jüngeren Vergangenheit von China, aber auch aus anderen Ländern erlebt haben, schützen müssen. Insofern ist der Vorschlag, der aus der Kommission kommt, sehr zu begrüßen.

Ich muss allerdings sagen, dass das Parlament bei dem Versuch, diesen Vorschlag zu verbessern, keine besonders glückliche Hand hatte. Ich hätte es sehr begrüßt, wenn wir das, was aus der Kommission gekommen ist, übernommen hätten, ohne es hier im Parlament zu verbessern bzw. zu verschlimmbessern. Denn bei dem Versuch, dort einzugreifen, haben wir einige protektionistische Elemente mit übernommen. Ich glaube, dass wir an einigen Stellen über das Ziel hinausschießen.

Wenn ich heute höre, was auch von Seiten der CDU dazu gesagt wird, dass man nämlich schon darüber nachdenkt, das auch noch zu erweitern, möglicherweise Kompetenzen von den Nationalstaaten auf die Unionsebene zu verlagern, dann macht mich das schon etwas nachdenklich, was uns da in den kommenden Jahren noch erwartet. Denn es ist doch völlig klar, dass, wenn wir das von der nationalen Ebene und damit von der Ebene, wo tatsächlich strategische Interessen auch betroffen sind, auf die europäische Ebene holen, wir bloß die Problemlage verlagern. Denn selbstverständlich gibt es auch unterschiedliche Interessen zwischen den europäischen Staaten.

Und wenn Sie sagen, kleine Länder seien möglicherweise nicht in der Lage, sich alleine dagegen zu schützen, dann ist das zwar richtig. Aber klar ist auch, dass kleine Länder sich unter Umständen gegen die Interessen großer Länder innerhalb der Europäischen Union nicht werden schützen können.

  Dobromir Sośnierz (NI). – Panie Przewodniczący! No widzę, że wielki brat nie mógł spać którejś nocy, że jeszcze coś mu umyka i teraz wielki brat będzie obserwował inwestycje zagraniczne. Będzie monitorował inwestycje zagraniczne w różnych krajach. Wtrącał się w sprawy, które jakoś do tej pory układały się bez niego. No ktoś złośliwy mógłby pomyśleć, że może Komisja Europejska pozazdrościła możliwości brania łapówek krajom członkowskim, rządom krajów członkowskich. Oczywiście ja takim złośliwym człowiekiem podejrzliwym nie jestem, ale po cóż to dawać. Nawet w gorączce bym nie pomyślał takich złych rzeczy o Komisji, ale po cóż dawać pretekst złym ludziom, żeby takie rzeczy myśleli jeszcze przed wyborami. Więc myślę, że komisarzem – no bo ktoś również podejrzliwy mógłby pomyśleć, że komisarze mogą w ten sposób wpływać właśnie na mniejsze kraje członkowskie, zniechęcać do inwestowania, wypłaszać inwestycje z jednych krajów, żeby udzielać takich propozycji nie do odrzucenia inwestorom, żeby zainwestowali zamiast w tym kraju, jednak w innym kraju. Więc myślę, że jest to narzędzie jak najbardziej protekcjonistyczne i niedawno ubolewaliście nad polityką Trumpa, a teraz chcecie robić tutaj takie historie u siebie. Kryteria tego uzasadnienia są mętne, tego wtrącania się, są niejasne i uzasadnienie jest zupełnie nieoczywiste.

  Tokia Saïfi (PPE). – Monsieur le Président, Madame la Commissaire, je souhaite tout d’abord remercier mon collègue, Franck Proust, pour son travail sur ce dossier très important.

Ce premier mécanisme européen de filtrage des IDE marque une nouvelle étape et s’inscrit dans la continuité de la modernisation des instruments de défense commerciale et du refus du statut d’économie de marché de la Chine.

Le monde évolue et il est temps que l’Union européenne s’adapte aux réalités des défis économiques actuels. Nous ne pouvons plus rester immobiles face aux géants chinois, américains, et face aux GAFAM qui imposent leur loi, sans état d’âme. À ce titre, nos règles de concurrence sont dépassées et la décision d’interdire la fusion Alstom-Siemens est une grave erreur.

Nous devons absolument permettre la création de champions européens, il est urgent que l’Europe vive maintenant avec son temps.

  Maria Grapini (S&D). – Domnule președinte, doamnă comisar, stimați colegi, mecanismul de filtrare și examinare a investițiilor străine în Uniunea Europeană este o necesitate. Cine vrea să creadă altceva... Aici nu este vorba de protecționism, este vorba, până la urmă, de siguranță și nu cred că este, așa cum spunea colegul mai înainte, un mod de a lua bani Comisia. Eu sunt, de regulă, critică la adresa Comisiei, dar acum trebuie să ne gândim toți că, dacă nu avem un sistem armonizat, în toate statele membre, de filtrare, de verificare a investițiilor străine, nu numai că se creează o concurență neloială, că sunt distruse IMM-urile din Uniunea Europeană, ci ajungem să nu mai avem securitatea asigurată și, până la urmă, astăzi am mai dezbătut un raport, despre durabilitatea Uniunii Europene.

Cred că toți vrem să avem o Uniune Europeană. Trebuie să avem o piață unică sigură, dar să avem și siguranță. De aceea, eu apreciez foarte mult acest regulament și cred că ține de noi să se aplice corect și este foarte bine că este prevăzută în regulament posibilitatea de verificare de către Comisie și de a raporta Parlamentului cum se aplică acest regulament. Eu cred că aici trebuie să vedem, mai degrabă, problema, modul de aplicare armonizată și modul de filtrare. Este o precizare care îmi place foarte mult: trebuie să ținem cont și de specificitatea țării respective.

  Innocenzo Leontini (ECR). – Signor Presidente, onorevoli colleghi, io mi associo agli apprezzamenti per il lavoro svolto dall'onorevole Proust. Supporto pienamente questa iniziativa della Commissione europea volta ad istituire una normativa per il monitoraggio degli investimenti esteri diretti nell'Unione europea. L'obiettivo è quello di colmare una lacuna e creare le condizioni giuridiche per permettere ai paesi dell'Unione europea di dotarsi di condizioni per l'ingresso degli investimenti esteri diretti, soprattutto sulla base di considerazioni legate alla sicurezza nazionale o all'ordine pubblico.

Questa azione di monitoraggio, in linea con quanto già accade oggi in Stati quali gli USA, il Canada o la Cina, riguarderà in particolare alcuni settori strategici quali quelli legati alle infrastrutture o alle principali tecnologie avanzate. Inoltre le disposizioni normative possono riguardare anche investimenti da parte di società a proprietà statale o in stretto rapporto con governi stranieri.

Sono convinto che dobbiamo proteggere l'indipendenza dell'Europa, promuovendo il suo primato nei settori chiave per lo sviluppo industriale e tecnologico. Per questo serve approvare testi come questo.

  Christophe Hansen (PPE). – Mr President, ‘if you can’t beat them buy them’. As the world’s main destination for foreign direct investment, the EU cannot allow this proverb to underpin global trade and investment. To harness globalisation we need to safeguard the critical infrastructure and long-term strategic interests that directly support jobs and people in Europe – and protection is not protectionism, as was insinuated by Mr Pretzell.

In a hyper-connected single market, this regulation will enable patterns to be highlighted that might escape individual Member States, like my small Luxembourg, because foreign investors can knock on one door after another. Coming from a small Member State, without formal FDI screening, I hope that in the future every Member State, including mine, will assume this responsibility and perform minimum screening. Openness can never be a goal in itself, in a Europe that protects.

To conclude, I want to thank Franck Proust for his excellent work: he has done a tremendous job.

  Aleksander Gabelic (S&D). – Herr talman! Jag vill börja med att tacka föredraganden och alla som varit inblandade i detta viktiga arbete.

EU:s öppenhet för utländska direktinvesteringar handlar inte bara om pengar och jobbskapande utan också om den teknik och kunskap som investerare för med sig. Även om vi har en positiv utgångspunkt måste vi inse att världen har förändrats. Det är inte alla investerare som agerar på rent kommersiella grunder. Därför ska vi inte vara enfaldiga eller naiva – särskilt inte när det gäller strategiskt och säkerhetsmässigt viktiga sektorer i vilka vissa välkända statliga företag från ett antal länder agerar och som inte spelar på samma villkor. Därför är det väldigt bra att EU tar tag i den här frågan och får till ett tydligt ramverk.

Jag tycker att det är mycket välkommet att medlemsländerna insett behovet av att hantera problematiken och att vi samarbetar kring den bättre nu. Ett samlat EU-grepp kan göra det lättare att hantera utmaningar med utländska direktinvesteringar i EU, vilket är väldigt viktigt och positivt i dessa tider vi nu lever i.

  Jarosław Wałęsa (PPE). – Mr President, we live in dangerous times and we need to be fully aware of foreign investments coming into strategic sectors in the European Union. It’s no longer about the growth of particular Member States but more about the security of the European Union. We cannot pretend that ownership does not matter and that foreign investment is always good. There are external dangers that we need to counteract better, and a risk with foreign investment in strategic sectors that we need to address because this can threaten or undermine national, European or even global security or public order.

Foreign investment is investment – which is good because it leads to economic stability, activity and jobs. Moreover, foreign investment promotes the international exchange of capital, ideas, business strategies and technologies – which is good for the economy and for people. That’s why I welcome the appropriate balance between open investments and screening which was struck in the Mr Proust’s report.

  Eduard Kukan (PPE). – Mr President, I would like to express my thanks to the rapporteur for a good job. Openness to foreign investment remains a key principle for the EU and a major source of its growth. We should nevertheless be cautious about investments that could endanger our critical infrastructure, technological development or even security. The experience from many Member States shows that in many cases we are facing serious problems with third countriesʼ state-owned enterprises taking over European technological companies only for the key strategic reasons. The EU and Member States should be sensitive to such investments, especially in cases where our investors do not enjoy the same rights to invest in the FDIʼs country of origin. Moreover, we should also be more sensitive to such investments in the countries in the EU accession process, as strategic infrastructure might eventually be incorporated into the EU when it was in the hands of third countries, often the ones which are problematic.

Przyznam się, że jak Komisja zabiega o nowe kompetencje, to nie jestem zbyt entuzjastycznie nastawiony i zawsze wolę, żeby te kompetencje, które Komisja do tej pory posiadała, wykonywała najlepiej jak można, natomiast zabiegała tylko w ostateczności. Tu mamy sytuację taką, że z jednej strony proponuje się, by państwa członkowskie mogły utrzymać, zmienić lub przyjąć nowe – podkreślam nowe – mechanizmy monitorowania bezpośrednich inwestycji zagranicznych. Po drugie, proponuje się określenie minimalnych wymogów proceduralnych. Na szczęście minimalnych. I po trzecie, proponuje się właśnie nadać – na szczęście warunkowo – Komisji nowe uprawnienia w zakresie monitorowania bezpośrednich inwestycji zagranicznych. I co ważne na szczęście wydawanie opinii, które mają charakter niewiążący. To, co jest bezpieczne, pojawia się na końcu, czyli potwierdza się, że państwa członkowskie zachowują ostateczne uprawnienia decyzyjne. I to należy utrzymać i uszanować.

  Laima Liucija Andrikienė (PPE). – Nors šis dokumentas, kurį šiandien svarstome, yra ne apie Kiniją, bet aš kalbėsiu apie Kiniją kaip vieną ryškiausių pavyzdžių. ES politika Kinijos atžvilgiu visada buvo ir yra atvira, geranoriška ir nuosekli. Iki šiol kinai galėjo investuoti ES valstybėse narėse kada tik panorėję ir kur tik panorėję. Tačiau potencialiems Europos investuotojams Kinijoje biurokratinių kliūčių ne mažėja, o daugėja. Kinija nesilaiko abipusiškumo principo. Dėl to tiesioginių užsienio investicijų patikros mechanizmas visos ES lygiu turi būti įteisintas ir veikti artimiausiu metu. Visose šalyse turi būti tikrinamos užsienio investicijos į tokius sektorius kaip energetika, komunikacijos, transportas – turiu galvoje jūrų ir oro uostai, geležinkeliai ir medijos. Europos Komisija ir Europos Parlamentas dėl patikros mechanizmo būtinumo yra vieningi. Tačiau to negalėčiau pasakyti apie visas valstybes nares. Kai kurios jų, kur Kinijos investicijos yra ženklios, jau dabar kalba Kinijos balsu, akivaizdžiai atstovaudamos Kinijos interesams, ir tai iš tikrųjų yra pavojinga.

  Michaela Šojdrová (PPE). – Pane předsedající, je třeba si uvědomit rizika, která s sebou mohou některé přímé strategické investice přinášet. Je to otázka, která se týká celé Evropské unie, a proto souhlasím s tímto nařízením.

Je známou věcí, že některé země – a byla zde jmenovaná Čína – se snaží prostřednictvím svých investic státních nebo polostátních podniků ovládnout klíčová odvětví v jednotlivých zemích, získávat vliv, získávat know-how strategického významu, dokonce, domnívám se, ovlivňovat politiku. My jsme v České republice měli takovou poměrně neblahou zkušenost s investicemi firmy CEFC, jejíž šéf byl napojen na čínskou vojenskou rozvědku.

Tedy prověřování investic je legitimní nástroj členských států, který mohou využívat s ohledem na potřebu zajištění vlastní bezpečnosti i EU, a samozřejmě efektivní, když budeme moci využívat společný rámec, proto za něj děkuji.

Όσο οι ευρωπαϊκές πολυεθνικές επιχειρήσεις του σκληρού πυρήνα αγόραζαν αντί πινακίου φακής τις επιχειρήσεις του ευρωπαϊκού Νότου δεν υπήρχε κανένα πρόβλημα. Τώρα, λοιπόν, που εμφανίζονται ισχυρές κινεζικές επιχειρήσεις ή ρωσικές ή αμερικανικές για να αγοράσουν τις ευρωπαϊκές επιχειρήσεις, όλοι διαμαρτύρονται. Δεν σας είδα να διαμαρτύρεστε, αρκετοί από εσάς, όταν με το μνημόνιο έγινε αφελληνισμός των ελληνικών τραπεζών. Όταν γερμανική κρατική επιχείρηση αγόρασε την επιχείρηση Τηλεπικοινωνιών Ελλάδος ή όταν ιταλική κρατική επιχείρηση, με εντολή του μνημονίου, αγόρασε τους Σιδηροδρόμους Ελλάδος. Ή όταν γαλλική εταιρεία εκμεταλλεύεται τη μεγαλύτερη επένδυση, που είναι η γέφυρα Ρίου-Αντιρρίου, και όταν γερμανική εταιρεία, όπως η Fraport, αγόρασε αντί πινακίου φακής τα δεκατέσσερα περιφερειακά αεροδρόμια. Όπως βλέπετε, αγαπητοί φίλοι, ο καπιταλισμός εκδικείται τους ίδιους τους καπιταλιστές.

  Miguel Viegas (GUE/NGL). – Senhor Presidente, nós registamos a preocupação da União Europeia com as empresas estratégicas. Agora convenhamos que é preciso ter uma certa lata! Então não foi a União Europeia que obrigou Portugal, especialmente durante a Troika, a vender todas as suas empresas estratégicas na área da energia, dos transportes e do sector financeiro?

Ficamos perplexos! Esta proposta não pode ser desligada da crescente penetração do capital chinês na economia europeia. Importa dizer que, para nós, não é importante a origem do capital, o que é determinante é o controlo público sobre essas empresas. E, neste sentido, apelamos à Comissão que emende a mão e que crie condições para que países como Portugal voltem a adquirir o controlo, a soberania sobre essas empresas estratégicas em nome do seu desenvolvimento.

  Cecilia Malmström, Member of the Commission. – Mr President, this was a good debate and I can see that, with a few exceptions, there is strong support for the proposal. That’s very much thanks to our good cooperation under the leadership of Mr Proust, and also with Mr Bütikofer and others, who have made huge efforts to get this done in what was quite a short time.

I would like to underline the fact that this is not a protectionist measure. It is not intended to stop investment that we need for jobs, for growth etcetera, and it is not a way for the Commission to tell Member States what investments they should accept or not. But it is a very important new tool, which would help us strengthen our collective capacity to respond to challenges that have arisen because of globalisation, in particular when foreign investments threaten our strategic interest. It would be the first time that we have the means to assess those risks and address them – reflecting the fact that we are an integrated economy in which foreign investors operate freely from one Member State to another. We will be able to share information, to coordinate and to get a much better overview thanks to this proposal.

We’ve had very intense exchanges over the past years on how we should calibrate this instrument: the balance between the roles of Member States and the Commission; the balance between confidentiality and security interests; and how to protect them, while still exchanging meaningful information and ensuring reporting. The outcome of the negotiations reflects, in my view, this careful balance. We are in the area of security and public order, and that places responsibility on all those involved, the Commission and the Member States, to ensure that the cooperation mechanism is trustworthy, works in practice and is efficient.

We will, of course, report regularly to Parliament on how this regulation is implemented and then – maybe soon when it works – Mr Proust, we can say to our voters that ‘c’est le temps retrouvé’.

  Franck Proust, rapporteur. – Monsieur le Président, Madame la Commissaire, je pense noter, comme vous, que les interventions des différents groupes politiques démontrent un soutien fort pour un mécanisme à fort potentiel.

J’ai noté avec satisfaction le soutien du Rassemblement national, qui a pourtant toujours soutenu, comme il le dit, mais sans apporter aucune contribution ni déposer aucun amendement. Pire encore, sa représentante, Mme Jamet, avait même voté contre le texte en commission INTA.

Et puis, même si nous sommes en période préélectorale, cessons toutes ces caricatures, ces infox sur les accords de libre-échange qui, à les entendre, viseraient à amplifier la concurrence déloyale, alors qu’au contraire, ces accords visent à réglementer nos relations commerciales.

Je n’ai pas compris, non plus, les rares critiques à l’égard de la Commission, car la Commission ne décidera de rien; la Commission n’émettra que des avis, et nous avons tenu à ce que ce soit ainsi, à ce que le principe de subsidiarité des États ne soit jamais remis en cause. Seuls les États décideront si, oui ou non, l’investissement est viable sur leur territoire.

J’ai cependant un regret: hier après-midi, nous avons reçu M. Conte, président du Conseil italien, qui a assuré devant nous sa préférence pour une coopération renforcée entre les États membres dans de nombreux domaines. C’est pour moi en totale contradiction avec la position de l’Italie depuis l’arrivée de ce gouvernement au pouvoir. Je dois en effet vous dire qu’elle est le seul État membre à avoir rejeté l’accord sur cet instrument de filtrage, je dis bien le seul. Pour quelle raison? Je ne me l’explique pas. Car les pays les plus sceptiques en sont venus à soutenir cette proposition, vous l’avez dit, Monsieur Bütikofer, nous pouvons tous nous en féliciter.

Malgré cela, nous avons avancé dans la bonne direction: le suivi de l’application de ce mécanisme est entre les mains de la Commission, mais avec le regard vigilant du Parlement européen.

Les débats autour de ce règlement ont permis d’amener un sujet stratégique sur la table et la Hongrie est d’ailleurs devenue le quatorzième État membre à créer son mécanisme, fin 2018. D’autres pays y pensent, il faut bien entendu les encourager dans cette voie pour créer, dans chaque État membre, un mécanisme national de filtrage, et ce pour renforcer l’efficacité du mécanisme européen.

Voilà ce que nous allons mettre en place de manière pragmatique pour que l’Europe continue d’être vue comme un continent attractif pour les investissements étrangers, mais pas naïf lorsqu’il s’agit de défendre ses intérêts. Alors, si nous revenons de loin, gageons que nous irons loin.
