  Věra Jourová, Member of the Commission. – Madam President, the Commission has made it very clear to this Parliament and beyond, that it is following very closely, and with great concern, developments concerning the rule of law in Romania. We have repeatedly said that Romania needs to put the reform process back on track and to do so urgently. This means going forwards, not backwards, and abstaining from any steps which would reverse the progress accomplished over the past years.

The Commission, and in particular the First Vice-President, Frans Timmermans, has personally engaged with Prime Minister Dăncilă, and the respective experts have met on several occasions for constructive discussions and dialogue.

The Commission always made it clear that talking for the sake of talking will not be enough and concrete actions from the Romanian side will be needed sooner rather than later. The College discussed the situation two weeks ago. Regrettably, we have not yet been able to conclude that Romania is back on the right track. If our concerns are not met, the Commission will have to act, and to use the means at its disposal.

Today’s discussion is not about technical issues or to update you that against the backdrop of already clear backtracking identified in November, progress on the CVM (cooperation and verification mechanism) recommendations has been stalled, or to discuss that the latest Romanian legislative developments transposing a number of EU directives could raise concerns about potential incompatibility with EU law, or to mention further eroding confidence through recent executive ordinances and controversial appointment procedures. The situation around the nomination procedure for the next European Public Prosecutor’s Office chief has also not contributed.

Today’s discussion is about very real risks of further steps backwards in Romania regarding the rule of law and, more specifically, as regards the independence of the judiciary and the fight against corruption.

First, the possible amendments of the criminal code and the criminal procedure code: such fundamental issues need careful preparation, widespread consultation of the magistracy and stakeholders, and a very clear understanding of the consequences of change. Any the action taken should be compatible with EU law and international obligations, as well as CVM recommendations such as the fight against corruption. The Romanian authorities would be taking a risk in moving ahead without such a process and this might lead to creating a systemic, de facto impunity for high office holders who were sentenced for corruption.

Second, regarding the High Court of Cassation and Justice and a possible follow-up to a constitutional court judgment that has required changes to the composition of panels of five judges: there are serious questions about what is needed for the follow-up and these cannot be separated from the potential consequences of re-opening past cases, something which in itself could amount to a massive interference in the independence of the judiciary. The risk of massive disruption to the Romanian criminal justice system, including many corruption cases, cannot be ignored.

Third, the issue of appointments of prosecutors and, in particular, the need for a robust and independent system of appointing top prosecutors: this is not a new issue but the checks and balances have been successively watered down. The result is highly controversial procedures to appoint top prosecutors, the Prosecutor General and the chief anti-corruption prosecutor.

Fourth, the Special Prosecution Section set up to investigate magistrates: concerns about the structure had previously been raised in the CVM report by the Venice Commission and by the anti-corruption body GRECO. Yet, the government is reinforcing this structure.

All these elements, all of them, raise major concerns taken separately. Together, they start to amount to a very worrying pattern. Recent months have been characterised by a very volatile situation in Romania, with a series of rushed decisions being taken on essential matters. If these concerns are not met, the Commission will have to act and to use all the means at its disposal.

The Commission therefore urges Romania to take time to consult, getting as close as possible to a consensus and drawing on advice from the Venice Commission as well as from the CVM process. It is not too late for Romania to revert to the path of reform.

  Ingeborg Gräßle, im Namen der PPE-Fraktion. – Frau Präsidentin, Frau Kommissarin, liebe Kolleginnen und Kollegen! Leider kann man die Ratspräsidentschaft nicht begrüßen, obwohl es viele gute Gründe gäbe, dass sich gerade diese Ratspräsidentschaft das anhört.

Frau Kommissarin, wir müssen uns damit auseinandersetzen, dass Rumänien gerade die Europäische Union führt, und ich sorge mich schon – fassungslos und tief betroffen, denn noch nie haben wir in so schneller Folge einen Zusammenbruch des Rechtsstaats erlebt. Das, was Rumänien sich traut, hat sich noch kein anderer Staat in der Europäischen Union getraut. Ich hoffe, dass die Rumänen damit eine singuläre Geschichte sein wollen. Es wäre gut, wenn die S&D sich früh und sehr viel entschiedener von dieser Sache absetzt, die sich in Rumänien tut.

Ich kann nur der Kommission dazu raten: Wir raten zum Artikel-7-Verfahren. Wir raten auch dazu, Gelder zu stoppen, weil wir die Gelder angesichts des Zusammenbruchs des Rechtsstaats nicht mehr schützen können. Eine offensichtlich überforderte Regierung ist dafür verantwortlich, die eben eine offensichtlich überforderte Ratspräsidentschaft abgeben darf.

Die rumänische Regierung ist Täter, und sie schafft Opfer, und das erste Opfer ist die unabhängige Justiz. Sie fördert damit in beträchtlichem Umfang Korruption. Wir sehen einen sozialistischen Parlamentsvorsitzenden und Parteichef – erstinstanzlich wegen Betrug verurteilt –, der daran viel Verantwortung trägt. Diese Geschichte muss adressiert worden, auch von der S&D, weil ich glaube, dass Doppelstandards hier ganz schlecht wären.

Wir sehen ein Verfassungsgericht, das mit seinem Fall befasst ist und erheblichem Druck ausgesetzt wird. Wir sehen eine Verschiebung des Berufungsverfahrens. Wir sehen, wie die frühere Generalstaatsanwältin Kövesi mit immer neuen Verfahren und fadenscheinigen Anklagen überzogen und gewaltigem Druck ausgesetzt wird – auch hier ein Racheakt. Sie ist die Kandidatin der beiden verantwortlichen Ausschüsse für die neue Europäische Staatsanwaltschaft, und sie ist die Kandidatin des Auswahlgremiums.

Leider, leider hat der Rat wenig unternommen – gar nichts unternommen –, um diese Machenschaften der Ratspräsidentschaft zu sanktionieren. Der Rat trägt deswegen eine klare Mitverantwortung. Er ist bereit, Rumänien für diese Übergriffe auf den Rechtsstaat auch noch zu belohnen. Und das ist etwas, was absolut abgelehnt werden muss. Der französische Kandidat kann deswegen nicht der erste Europäische Staatsanwalt werden. Seine Kandidatur ist das Feigenblatt, hinter dem sich beispiellose Verstöße gegen das Recht und gegen die rumänische Kandidatin des Parlaments verbergen.

Es geht längst um mehr als um eine Stelle für den Europäischen Staatsanwalt. Es geht um die Glaubwürdigkeit Europas und auch um die Glaubwürdigkeit der Kommission und des ersten Vizepräsidenten.

Aș dori să vă întreb - și vă adresez această provocare - cum puteți explica românilor mei că în țara dumneavoastră membrii Curții Constituționale pot fi membri de partid?

  Ingeborg Gräßle (PPE), Antwort auf eine Frage nach dem Verfahren der „blauen Karte”. – Lieber Kollege, danke für die Frage. Ich habe gar nicht gerügt, dass das Verfassungsgericht durchaus auch Politiker als Mitglieder hat. Die Frage ist, ob sich diese Politiker an das Recht halten.

Ich habe im Übrigen das Verfassungsgericht verteidigt, weil es im Moment so unter Druck gesetzt wird – von einzelnen Politikern. Darum geht es doch. Und ich möchte Ihnen auch sagen: Es ist höchste Zeit, dass die sozialistische Fraktion dazu Stellung nimmt.

Und warum dürfen alle Rumänen immer abstimmen, wenn es um rumänische Fragen geht? Das ist eine Sache Gesamteuropas. Wir haben es gesehen beim Kandidaten für den Rechnungshof, der uns im Übrigen zumindest nicht die Wahrheit gesagt hat über seine Firmen, die er hat und die europäische Gelder bekommen. Wir haben es gesehen bei der Kandidatin für die Generalstaatsanwaltschaft.

Wann wird sich die S&D-Fraktion endlich dazu durchringen, rumänische Fragen als europäische Fragen zu betrachten? Es ist nicht Sache der Rumänen.

  Josef Weidenholzer, im Namen der S&D-Fraktion. – Frau Präsidentin! Ich möchte schon feststellen, dass die Präsidentin hier die Sitzung leitet und nicht Herr Preda.

Im Gegensatz zu meiner Vorrednerin meine ich, dass die rumänische Präsidentschaft in der zur Verfügung stehenden Zeit vieles erreicht hat, allen Befürchtungen und Unkenrufen zum Trotz. Umso verwunderlicher ist es, ...

(Antwort von Herrn Weidenholzer: Sie können mir auch einmal zuhören, Herr Preda. Ein bisschen Disziplin wäre angesagt.)

... dass wir heute diese dringliche Debatte führen müssen. Wir diskutieren diese Fragen ja nicht zum ersten Mal. Im November hat unser Haus in einer Entschließung deutlich gemacht, dass die Überarbeitung der Justiz und strafrechtlichen Vorschriften in Rumänien die Unabhängigkeit der Justiz nicht beeinträchtigen darf, weil nur so die Korruption nachhaltig bekämpft werden kann. Kontrolle und Gegenkontrolle müssen hergestellt und die parlamentarische Überwachung der Nachrichtendienste gestärkt werden. Leider haben unsere Forderungen nicht die notwendige Beachtung gefunden. Das ist sehr bedauerlich.

Es geht nicht gegen Rumänien; es geht um unser gemeinsames Rechtsverständnis. Ein funktionierender Rechtsstaat ist die wesentliche Säule des gemeinsamen Europa, und das wurde in den Kopenhagener Kriterien eindeutig festgelegt. Auf deren Einhaltung zu bestehen, ist daher keine Einmischung in die inneren Angelegenheiten eines Mitgliedstaats, es ist in unser aller Interesse. Natürlich darf das nicht einseitig und oberlehrerhaft sein. Aber die gemeinsamen rechtsstaatlichen Prinzipien müssen wir im Dialog festigen. Das ist unsere Botschaft in Richtung Bukarest. Nur so werden Ost und West zusammenwachsen.

  Monica Macovei, în numele grupului ECR. – Doamnă președintă, astăzi în România un grup de politicieni corupți condus de condamnatul și socialistul Dragnea, care este condamnat definitiv și are noi procese, a luat țara în mână și dă cu ea de pământ. Nu respectă programul de guvernare anunțat la alegeri, schimbă legile, șterge infracțiuni, îi subordonează politic pe judecători și procurori, transformă banii de investiții în mită electorală, distrug inima democrației pentru ca ei, politicienii corupți, să scape de justiție. Soarta a 20 de milioane de oameni stă, până la urmă, în cântar cu soarta unuia singur, cu salvarea unuia singur?

Românii nu sunt un popor inert, ieșim în stradă de peste doi ani de zile. Suntem gazați, suntem bătuți, suntem împușcați cu gloanțe de cauciuc sau loviți cu grenade de mână. Asta nu ne împiedică să ieșim. Mai departe, drumul nostru este Europa. Asistăm cu disperare la scufundarea țării lovite de Dragnea, Tăriceanu și gașca lor. Eu nu pot să tac. Nu puteți să ne lăsați să sfârșim ca prizonieri ai câtorva sute de politicieni care au în mână pârghiile puterii.

Vă cer să ajutați România pentru că, sub aparența democrației, România trăiește astăzi o dictatură criminală și tragedia golirii țării. Patru milioane de români au plecat din țară numai în ultimii ani. Ruperea noastră de Europa este coșmarul pe care istoria noastră l-a trăit decenii la rând. Acesta este ultimul tren pe care îl putem prinde.Vrem în Europa!

  Sophia in ‘t Veld, on behalf of the ALDE Group. – Madam President, I would like to thank the Commissioner. I have to start by saying that I share Ms Gräßle’s irritation about the absence of the Council, not least because it is the country concerned.

(Applause)

But hold your applause until I have finished, because you may not be so happy any more – I also regret the absence of Mr Timmermans. No offence, Madam Commissioner, but he is the Commissioner and the Vice—President in charge. And what has he done over the last five years? Just last week, the Commission presented a kind of communication on the rule of law which was hardly worth the paper it was written on, and Mr Timmermans didn’t even bother to show up at the Committee on Civil Liberties, Justice and Home Affairs (LIBE) to present it. No, he left it to his civil servants.

Where is he today? What has he done in the last five years? Because now I’m coming to the partisan issue. I am a bit tired of having debates here – today it’s about Romania and it’s the EPP criticising, tomorrow it will be about Hungary and the Socialists will be criticising and the EPP will be, well, not silent because I know that some of you are indeed critical, I know that Ms Gräßle is very outspoken and very, very honest, and some other EPP Members as well – but these debates are always turned into a partisan issue.

It is not a partisan issue. This is about the values laid down in Article 2 of the Treaties that concern us all, regardless of party political colour. I don’t understand – two-and-a-half years ago this House adopted a position, a proposal for a DRF pact, which is a general mechanism covering all the Member States, all the Governments and the Commission. And again, I’m not pointing at you Madam Commissioner, but Mr Timmermans is responsible here. Mr Timmermans said ‘oh, we don’t need that because we’ve got all the tools in the toolbox that we need’. Well, we don’t. Mr Timmermans is a Spitzenkandidat, but Mr Weber is also a Spitzenkandidat. So I would like to know from both Spitzenkandidaten, who are conspicuously absent, both as group leader and Vice—President of the Commission, what they intend to do once they are President of the Commission. Will President of the Commission Weber do what he voted for as MEP Weber, namely propose a fully—fledged DRF mechanism applying equally to all the Member States?

To be perfectly clear here, my group, the ALDE Group, has firmly distanced itself from the ALDE Romania party in government because we are disappointed, not just about the changes to the penal code, but also about their failure to support equal marriage or indeed civil partnership. We are very disappointed about the attitude of the Romanian Government in the case of Ms Kövesi, and we are also very disappointed about their attempts to try and prevent the registration of new parties who want to run in the European elections. So I think we should insist on a DRF pact in the next period.

  Cristian Dan Preda (PPE), question "carton bleu". – Je suis tout à fait d’accord avec votre critique de la Commission, de M. Timmermans lui-même, mais – sans vouloir faire preuve d’esprit partisan – le président de votre groupe, M. Verhofstadt, n’a rien dit jusqu’à récemment sur la situation en Roumanie. Il s’est tu. La dérive n’a pas commencé il y a trois mois, Madame, et quand on vous a demandé de faire quelque chose, vous n’avez pas bougé. Vous aussi, Madame, vous faites un calcul électoral. Dites-moi: pourquoi M. Verhofstadt n’a-t-il rien dit? Son amitié personnelle avec M. Tăriceanu ou ses amitiés privées comptent-elles plus que les principes que vous invoquez?

  Sophia in ‘t Veld (ALDE), blue-card answer. – You’ve got it completely wrong. Just read the minutes of this House – the attitude of this Group has been completely solid. If the EPP had been equally solid on Mr Orban, we wouldn’t be in the situation that we are in with Hungary.

We have to be very critical of what happens in Romania. We have, as I said, formally taken our distance from the other party that is in government, and asked the European ALDE party to expel them from our political family. We are very firm. We do this with a heavy heart because, indeed, there are many years of political friendship. But we stand by our principles, contrary to the EPP which has still not taken its distance from Mr Orban.

I recommend that you read the minutes of this House because I personally, Mr Preda, took part in the debate on Romania and I’ve been very critical, very critical, Mr Preda, and I would beg you to be equally critical of your Member, Mr Orban.

  Victor Boștinaru (S&D), Întrebare adresată conform procedurii „cartonașului albastru”. – Doamnă in 't Veld, am două întrebări scurte la adresa dumneavoastră. Știți de câte ori Curtea Constituțională a României a declarat acțiunile doamnei Kövesi ca anticonstituționale? De câte ori doamna Kövesi a fost declarată că a încălcat Constituția în România? Și doi, știți că în cazul - care este și în atenția dumneavoastră, dosarul deschis pentru abuz împotriva doamnei Kövesi - cele mai importante mărturii sunt cele ale foștilor adjuncți ai doamnei Kövesi, doi procurori din Direcția Națională Anticorupție care au depus mărturie împotriva doamnei Kövesi? Atunci cum puteți să spuneți că se fac presiuni politice în acest caz?

… can I finish, do you want to hear, are you interested in the reply? I’ve got 30 seconds and half of it has already gone. What I do know first of all is that the court has already allowed Ms Kövesi to travel and to speak.

The point is that the arguments I always hear against do not make the matter any better, because the image that we have here is of a complete mess, and what we need is the rule of law, not just for the European Union, but for the people in Romania, because young people are craving a country that is stable, where the government is reliable and clean, and all the stories saying, oh, you know, somebody’s in court, and then there’s the secret services interfering. Do you really think that makes it better? I don’t think so.

  Judith Sargentini, on behalf of the Verts/ALE Group. – Madam President, the rule of law is not left wing or right wing, and it’s very painful to see here that the Romanian Government is backing up the Hungarian Government by not putting the report on Hungary on the agenda. Everybody has said it, but it’s incredibly disappointing. The Romanian Presidency is not here, that is unbelievable. It’s also the Presidency that is de-legitimising the Parliament’s candidate for the European Public Prosecutor, and with that actually de-legitimising the whole process. Fighting corruption is crucial in the rule of law, and we’ve got a country that is seriously backsliding and that is chairing the European Council right now.

Give me another example... oh, I know, January 2011 when the Hungarian Government was chair of the Council. That was also half a year when nothing happened. People, we need to be ashamed of this: six weeks before the European elections and we’ve got this as an example.

  Jeroen Lenaers (PPE). – Voorzitter, de EU is meer dan een interne markt of een economisch partnerschap. Het is een unie van landen die samengekomen zijn in de nasleep van oorlog en ellende, en besloten hebben dat ze samen sterker staan dan alleen. Eendracht maakt macht.

Dat klopt. Maar dat klopt alleen wanneer die eendracht gebouwd is op een stevig fundament van gedeelde waarden. En daar ligt tegenwoordig een grote uitdaging. We zien sommige lidstaten weg bewegen van de waarden waarop de EU gebouwd is.

We zien tegelijkertijd het uitblijven van een consistente, eenduidige reactie van de Europese Commissie. Eerste vicevoorzitter Timmermans had in het geval van Polen geen aansporing nodig. Hij startte direct, effectief, terecht en zonder twijfel een artikel 7-procedure.

Van diezelfde daadkracht is richting een land als Roemenië of bijvoorbeeld Malta echter helaas weinig te merken. "Pappen en nathouden" lijkt het devies te zijn richting Boekarest en Valletta.

We kunnen het ons in de Europese Unie niet veroorloven om met twee maten te meten. Waarden kunnen niet alleen verdedigd worden als dat politiek handig uitkomt. Daar zijn ze veel te belangrijk voor. Ook – of eigenlijk zelfs juist – als je vrienden het niet zo nauw nemen met de rechtsstaat, moet je ze een spiegel voorhouden.

Ik hoop dan ook oprecht dat in het geval van Roemenië, maar zeker ook in het geval van Malta, de Europese Commissie dat eindelijk een keer gaat doen.

  Dan Nica (S&D). – Doamna președintă, din păcate astăzi avem din nou o dezbatere electorală, o dezbatere în care, fără să se aducă niciun fel de precizare și nici să se spună absolut nimic concret despre România, suntem nevoiți să spunem care este adevărul și, mai ales, să combatem foarte multe dintre lucrurile care au fost spuse și sunt mincinoase.

Care este situația statului de drept? Doamnelor și domnilor - stat de drept fără ca să existe drepturi și libertăți pentru cetățeni nu există.

În 2009, procurorul general al României a semnat un protocol secret cu serviciile de informații. Surprinzător - procurorul general era Kövesi. De doi ani de zile au început să apară dezvăluiri despre o lungă serie de protocoale secrete încheiate cu serviciile de informații și românii au putut să afle cu oroare, cu teamă, cu spaimă că au existat aceste protocoale secrete și că aceste protocoale secrete au condus la abuzuri și nedreptăți abominabile.

Cred că este corect să spunem că românii urăsc dublul standard. Urăsc dublul standard în justiție. Urăsc dublul standard în tot ceea ce înseamnă lucrurile care țin de viața lor de zi cu zi: produse alimentare care sunt contrafăcute și vin și au invadat piața românească, punând în pericol sănătatea acestora, produse farmaceutice.

Românii nu sunt primiți în spațiul Schengen deși din 2011 se îndeplinesc toate condițiile. În toate aeroporturile sunt milioane de români. În toate punctele de trecere a frontierei cetățenii europeni sunt într-o parte, iar românii în cealaltă parte. 80 % dintre români în toate sondajele de opinie spun că este inadmisibil și nu recunosc ca fiind legitime abuzurile care au fost făcute în justiție, aceste abuzuri care trebuie să fie odată pentru totdeauna curmate. Și vreau să știți de ce spun aceste lucruri, pentru că au putut să vadă la televizor în fiecare zi mărturii, mărturii și mărturii. Iar românii sunt sensibili pentru că au trăit aceste abuzuri în perioada comunistă și nu vor să accepte că există judecători care sunt șantajați, judecători și procurori care sunt în filmați în baie, în dormitor ca să poată să fie șantajați pentru a li se indica și a li se cere o anumită soluție într-un dosar.

Românii vor să fie tratați ca parteneri egali, ca cetățeni ai Uniunii Europene. Românii nu vor și nu acceptă această discriminare, care nu este bazată pe absolut nimic concret și este nemeritată. Tuturor celor care au urechi să audă și ochi să vadă le spunem un singur lucru: România merită mai mult și românii merită mai mult!

  Renate Weber (ALDE). – Doamnă președintă, România este într-un mecanism de cooperare și verificare cu Comisia Europeană. Nu o dată, politicieni români au fost sever criticați în rapoartele MCV pentru declarații publice privind cazuri concrete din tribunale, considerând că astfel de practici sunt o ingerință în justiție.

Și totuși, în urmă cu câteva săptămâni, lideri ai acestui Parlament European au cerut imperativ autorităților din România, parchete și tribunale deopotrivă, să oprească o investigație împotriva unui cetățean român căruia îi fuseseră respectate toate drepturile procedurale prevăzute de lege. Consiliul Superior al Magistraturii din România, garantul constituțional al independenței justiției, a declarat că acești lideri, Antonio Tajani, Manfred Weber, Guy Verhofstadt, prin declarațiile lor au pus presiune pe judecătorul național care urma să soluționeze cauza, o ingerință cu consecința subminării independenței justiției.

E timpul, dragi colegi europeni, să încetați cu standardele duble și să vă comportați exact așa cum le cereți politicienilor din alte țări, chiar și în campanie electorală.

  Cristian Dan Preda (PPE). – Doamnă președintă, trebuie să spun că regret, la rândul meu, faptul că Guvernul României nu este reprezentat astăzi de nimeni, nici pentru a participa la dezbaterea despre România și nici pentru a reprezenta președinția rotativă a Consiliului European. Asta nu vădește decât dispreț față de instituții și față de Parlamentul nostru și față de Consiliu. E regretabil că la prima președinție românească suntem în această situație.

Aș vrea să spun, pe de altă parte, că trebuia să fie cineva aici pentru că, din nefericire, regimul de la București, regimul românesc, nu mai este un stat de drept. Nu mai este un stat de drept pentru că majoritatea aflată la guvernare din 2016 încoace face exact ceea ce domnul Nica descria, și anume o presiune enormă asupra judecătorilor, procurorilor, asupra întregului corp de magistrați, creând chiar instituții pentru a-i obliga să revină asupra deciziilor luate, decizii definitive, pentru a-i obliga să nu urmărească fapte de corupție. Totul, până la urmă, pentru a-l salva pe marțafoi.

Au în fruntea partidului un om condamnat pentru corupție de două ori, un om care e în fruntea Camerei. Spuneți-mi și mie o țară din Uniunea Europeană, de la Al Doilea Război mondial încoace, care a avut drept lider al unui partid - cel mai important ca număr și care a continuat să rămână în această poziție -, pe cineva condamnat de două ori. Cine e premiat în Uniunea Europeană pentru că fură? Cum putem să acceptăm această coaliție a mârșavilor care vor să distrugă o țară pentru un marțafoi? Asta e întrebarea.

  Maria Grapini (S&D). – Doamnă președintă, doamnă comisar, stimați colegi, dați-mi voie să fac o remarcă: este un eșec această dezbatere, doamnă comisar, se vede din prezență. Suntem douăzeci de persoane aici - liderii, cei mai critici la adresa României, lipsesc de aici, sunt lași. Recent, domnul Weber a îndrăznit să vină în România, în țara mea, să spună guvernului să sisteze un proces în derulare.

Doamna comisar, sunteți de specialitate, știți bine că în materie de organizare judiciară și în domeniul justiției nu se poate amesteca nici guvernul din țara respectivă, dar nici oficialii europeni. Și vreau să vă spun că prin intervențiile oficialilor europeni de fapt ați afectat justiția în România. Cetățenii din România nu înțeleg de ce anumiți oficiali, anumiți europarlamentari se amestecă în procese în derulare.

Ce vrem noi? Vrem o Europă comună? Cum să facem o Europă comună? Este campanie? Da, pentru că domnul Preda mai devreme spunea „faceți și dumneavoastră campanie”. Asta înseamnă că PPE-ul, care a declanșat această analiză, face campanie.

Doamna comisar, nu mie trebuie să-mi răspundeți, ci românilor. Să înțeleagă din ce ați prezentat dumneavoastră aici - pentru că se înregistrează. Nu ați dat măcar un exemplu de încălcare a statului de drept - unul singur! Guvernul României pe președinția rotativă are succes! Vă pare rău că are succes, că a încheiat atâtea dosare? Pentru ce faceți acest lucru?

S-a încheiat anul trecut cu o rezoluție, o rezoluție nedreaptă, și știți, doamnă comisar, că este un punct acolo pe care nu l-ați pune la nicio altă țară. Învinovățiți România că a schimbat un șef de instituție. Păi șeful acela de instituție a făcut ravagii în justiție. Nu mai spun de protocoalele pe care le-a admis - spun de viețile oamenilor, de procese pierdute, mii de procese. Dumneavoastră chiar ați spus că trebuie reluate niște procese. Să lăsăm oamenii cu nedreptate sau să reluăm procesele? Pe cine apărați? România nu este Kövesi! România nu este o persoană! România înseamnă douăzeci de milioane de persoane - și vă rog să le tratați cu respect.

  Gunnar Hökmark (PPE). – Madam President, undermining the independence of the judiciary; undermining the independence of the prosecutors; hindering new parties from being established; trying to legalise corruption; fighting not corruption but those who fight corruption; getting rid of uncomfortable leaders of independent authorities; prohibiting them from leaving the country. Of course this is a collapse of the rule of law. And what worries me maybe most is the denials. But I must say also, Mr Weidenholzer, the silence from the Socialist Group is thundering. Your contribution here tonight was not impressive, and I will tell you why.

The defence of rule of law and democracy does not follow party colours. The misuse of power in Hungary or in Poland doesn’t excuse it in Romania, and I have heard you – all of you – be very vocal, just as I am about Hungary, just as I am about Poland. But your silence is thundering. You’re misusing your obligation to defend democracy: you as a leader here tonight in the Socialist Group. That is wrong.

  Petri Sarvamaa (PPE). – Madam President, well where on earth is Vice-President Timmermans? I don’t – do I see him? No. Where is the Romanian Presidency? I don’t see them either. The European Union was founded in order to prosper peace, democratic principles and the rule of law. As my EPP colleagues, I am extremely concerned about the state of the rule of law and the recent developments in Romania. We cannot accept the Romanian Government’s continuous attempts to make changes to the Romanian penal code through emergency ordinance, which aim at decriminalising corruption progressively. We cannot accept the continuous attempts to interfere with the independence of the judiciary. The special section for investigations, which puts pressure on the judges and prosecutors, has to be stopped. All in all, defending the rule of law and urging the Romanian Government to stop acting against the core values of the European Union should be considered as top priorities for all of us. And by the way, I would advise Madam in 't Veld to take a closer look at the decision the EPP made in Brussels on 20 March. I don’t think your comments do full justice to that decision.

  Siegfried Mureşan (PPE). – Doamnă președintă, stimată doamnă comisar, stimați colegi, România este o țară proeuropeană. Poporul român dorește valori europene, dorește justiție, dorește dreptate, dorește stat de drept. De doi ani de zile, sute de mii de oameni ies în stradă pentru a apăra valori europene. Oamenii politici au datoria să asculte întotdeauna voința poporului, iar oamenii politici nu au voie să modifice niciodată legi în propriul interes. Spun foarte clar: milioane de oameni cinstiți din România nu doresc nici amnistie, nici grațiere. Și de aceea, cer Guvernului României să țină cont și să implementeze toate recomandările experților independenți de la Comisia de la Veneția, recomandările exprimate de Comisia Europeană în cazul mecanismului de cooperare și verificare.

Guvernul României are datoria să asculte de popor, iar tocmai de aceea președintele României, domnul Klaus Johannis, a convocat pentru data de 26 mai un referendum în cadrul căruia poporul român să se poată exprima cu privire la ce fel de justiție dorește. Oamenii să poată spune foarte clar că nu doresc nici amnistie și grațiere și nu doresc modificarea legislației penale peste noapte în mod intempestiv. Legislația penală trebuie să fie modificată ținând cont de avizul magistraților, de avizul ONG-urilor și, evident, ținând cont de recomandările partenerilor noștri internaționali. Rog, doamna comisar, rog Comisia Europeană să fie alături de poporul român în această luptă pentru justiție și pentru valori europene.

  Lívia Járóka (PPE). – Madam President, I would like to congratulate the Romanians and I know what it is to be in your shoes, being Hungarian. But this speech is against double standards and I have to say that Ms Gräßle has reconsidered many of the accusations that I’m against Hungary, as also this time against Romania. Many times it comes to light – how come Romania has come so far when it comes to the integration of the poorest people? Today there is a crisis situation all around Europe, with people being sent out of their settlements because EU money is only very slowly coming to these places in Europe. So I would like to ask the Romanian Presidency to stand together with the Council, with the Commission – several Commissioners, among them Madam Crețu – to make sure that the unused money in the Structural Funds will be very quickly used to help those citizens of Europe who are not receiving the EU money being spent on them because there are difficulties in the bureaucracy and therefore they will be evicted. So please, let’s stop eviction everywhere in the Roma settlements around Europe...

  Andi Cristea (S&D). – Doamnă președintă, doamnă comisar, tăcerea dumneavoastră în fața abuzurilor din România este asurzitoare. Vreau să vă spun foarte clar: obiectivul partidului meu este consolidarea proiectului european și eliminarea standardelor duble pe care dumneavoastră le tolerați. Populismul și extremismul care amenință proiectul european își trag rădăcinile din desprinderea de realitate a oficialilor europeni față de ce se întâmplă în capitalele europene. Din cauza lipsei de bun-simț în abordările Comisiei Europene față de MCV și abuzurile dovedite în țara mea, reputația Uniunii Europene are de suferit. Implicarea Bruxelles-ului, apelurile sale la implicare în procesele judiciare și constituționale din România este inacceptabilă.

Unii dintre dumneavoastră se vor regăsi și în viitoarea formulă a Comisiei și vă cer să încetați amestecul brutal în procesele judiciare și constituționale ale statelor membre. Sunteți gata să ne folosiți ca material didactic doar ca să câștigați câteva procente în bătăliile dumneavoastră interne electorale. (Președinta a retras cuvântul vorbitorului)

  Marek Jurek (ECR). – Pani Przewodnicząca! Pani komisarz Jourová powiedziała, że jeżeli sytuacja w Rumunii się nie zmieni, to Komisja podejmie konieczne działania. Na szczęście ta Komisja żadnych działań nie podejmie, już dość działań szkodliwych w tej kadencji podjęła. Może co najwyżej wykonać gesty wyborcze i pan Timmermans, o którego pytano, jeszcze zapewne wiele takich gestów politycznych, wykorzystując swoje stanowisko, zrobi.

Natomiast jeżeli chodzi o Rumunię – sytuacja w Rumunii jest trudna, jest nie mniej skomplikowana niż w Wielkiej Brytanii. Mnie nie podoba się tolerancja władzy dla tak zwanej drobnej korupcji, bo korupcja zawsze jest złem, a upowszechniona korupcja jest złem powszechnym, ale nie podoba mi się również permanentna, wieloletnia inwigilacja polityków, bo społeczeństwo inwigilowane nigdy nie będzie wolne. Również wolny nie będzie naród, którego zasadą staje się zwracanie się do zagranicy jako do arbitra swoich własnych problemów. Ten problem w interesie Europy muszą rozwiązać sami Rumuni.

  Norica Nicolai (ALDE). – Doamnă președintă, să provoci o dezbatere despre statul de drept, instituție fundamentală în Uniunea Europeană, și să nu vii la ea înseamnă că fie desprețuiești dezbaterea și statul de drept și îl utilizezi doar din rațiuni formale și politicianiste, fie că îți dai seama că este o dezbatere care dezonorează. Nu știu dacă ne dezonorează pe noi în acest hemiciclu, dar oricum este o dezbatere care nu are niciun fel de substanță. E un fel de reluare a filmului lui Steven Spielberg, doamnă comisar, când cineva era condamnat pentru ceea ce gândește.

Asta ați făcut dumneavoastră astăzi, pentru că, dacă ați fi avut minima decență să verificați ce s-a întâmplat în România, ați fi văzut că nu am adoptat nicio lege și pentru asta suntem criticați. Dar eu înțeleg nevoia de voturi, înțeleg dorința unora de a rămâne la putere, de a-și perpetua puterea, dar trebuie să înțelegeți și dumneavoastră că acest tip de comportament îndepărtează cetățeanul de Europa și, pentru asta, cred că merită să abandonăm și bruma de voturi și populismul de care ați dat dovadă astăzi.

  Krisztina Morvai (NI). – Tisztelt Elnök Asszony! Jurová biztos asszonyhoz van konkrét kérdésem. Ismeri-e Jurová asszony Beke István és Szőcs Zoltán kézdivásárhelyi lakosoknak a büntető ügyét? Ez egy jó példa – idézőjelben mondom, hogy jó – arra, ami itt többször elhangzott, hogy tudniillik a politika pressziót gyakorol a büntető igazságszolgáltatásra és a leggyalázatosabb bolsevik időket idéző módon a titkosszolgálatokkal összefonódva, a politikum, az igazságszolgáltatást, a büntető igazságszolgáltatást, a bebörtönzést, előzetes letartóztatást használja fel a politikai célok megvalósítására. Beke és Szőcs Zoltán esetében egy koncepciós büntető per keretében öt év szabadságvesztést kaptak olyanok, akik kizárólag a magyar nemzeti közösség emberi jogaiért harcolnak, ezért Románia politikai ellenfélnek tekinti és bebörtönözte őket. Mit tud erről az ügyről, és mit tanácsol a hozzátartozóknak?

  Răzvan Popa (S&D). – Doamnă președintă, doamnă comisar, din păcate, constat că iarăși nu este o dezbatere, ci este un festival de lozinci electorale ale celor care au inițiat această așa-zisă dezbatere, pentru că nu există niciun element concret și dumneavoastră ați spus la începutul discuției că nu vreți să discutăm despre lucruri concrete. De fapt, nimeni nu vrea să discute despre lucruri concrete, ci doar despre îngrijorări și despre riscuri. Păi, doamnă comisar, ar trebui să ne îngrijorăm, dacă vreți, și să discutăm despre riscuri atunci când înalți oficiali europeni de aici, de la această tribună, au spus magistraților din România ce și cum să facă, ceea ce este inacceptabil. Statul de drept înseamnă să lăsăm justiția să își facă treaba, nu să îi dictăm, indiferent de rangul pe care îl au, sau l-au avut, ce și cum să facă.

  Claudia Țapardel (S&D). – Doamnă președintă, doamnă comisar, îmi încep intervenția prin a pune o întrebare: atunci când vorbim despre statul de drept, vorbim sau nu despre respectarea drepturilor și libertăților cetățenilor? Pentru că despre asta este vorba, aceasta este lupta și efortul pe care îl face guvernul din România, de a asigura un sistem de justiție corect, în care drepturile și libertățile cetățenilor sunt respectate, în care luptăm împotriva protocoalelor secrete, luptăm împotriva abuzurilor unor procurori, luptăm pentru a nu mai avea vieți și cariere distruse.

De aceea, doresc să transmit tuturor forțelor politice din acest Parlament care folosesc România ca temă de campanie electorală, că voturile se câștiga prin prezența la vot, prin credibilitatea pe care o aveți în ochii electoratului. Consider că este inacceptabil ca în pragul campaniei electorale să se facă din nou o dezbatere prin care se atacă politica internă a unui stat membru. Vorbim iarăși de o dublă măsură la nivelul instituțiilor europene și acest lucru este de neacceptat. Consider că ceea ce se întâmplă astăzi aici este doar un joc politic electoral, care afectează din nou credibilitatea Parlamentului European... (Președinta a retras cuvântul vorbitoarei)

  Mircea Diaconu (ALDE). – Doamnă președintă, mi-e greu să înțeleg cum putem vorbi despre ceva, care se numește stat de drept, care nu e definit. Câtă vreme politica penală este competență națională - și diferențele între politicile penale ale statelor membre sunt uriașe -, este imposibil să poți face orice evaluare. De aceea, din păcate, trebuie să spun, aici e doar zgomot. Deci tot ce se întâmplă este doar zgomot, atât și nimic mai mult.

E competență românească, națională. Aștept și eu, personal, de la sistemul de justiție românesc și de la Parlamentul României să își stabilească regulile, firește, după principii europene. În rest, din păcate, asta trebuie să spun neapărat, în România într-adevăr nu este stat de drept, după părerea mea, nu a apucat să fie. Așa că e foarte mult de lucru până vom fi acolo. Aștept însă de la următorul Parlament să definească statul de drept în formă și în fapt.

  Maria Gabriela Zoană (S&D). – Doamnă președintă, doamnă comisar, dragi colegi, România este țara mea și, atât timp cât și eu voi fi aici și o voi reprezenta în Parlamentul European, nu voi permite nimănui să spună minciuni despre ea. România este stat de drept. O spun încă o dată - România este stat de drept.

Cu toate acestea, imaginea pe care anumite partide românești încearcă să o proiecteze în spațiul public este total diferită. Interesele electorale ale opoziției și interesele politice ale unor partide europene fac ca imaginea justiției din România să fie prezentată în mod eronat. Cei care reclamă în Europa nerespectarea de către România a statului de drept sunt aceiași care acasă în țară fac presiuni asupra justiției, încercând să influențeze sistemul juridic pentru condamnarea, chiar fără probe, a unor politicieni sau, dimpotrivă, fac presiuni asupra justiției de clemență față de anumite persoane aflate în cercul lor de influență. Atunci când membrii opoziției din România sesizează anumite aspecte care li se par neconforme cu legea, ar trebui ca, în primul rând, ei să se oprească din a o mai încălca prin presiunile pe care le fac asupra justiției.   Ana Gomes (S&D). – Madam President, I voted here in this Parliament for Romania to join the EU and fought those who wanted to keep Romania out, and then the ransom because of the Moratorium on the International Adoption of Children. I backed all those in Romania who fought the immoral and corrupt business of exporting Romanian children, most were from the PSD.

Fifteen years later I am appalled that the EU is under a Romanian Presidency which does not even bother to be here today, which is captured by a PSD leader, Liviu Dragnea, whom the European Anti-Fraud Office (OLAF) identifies as having created a criminal organisation to steal millions in EU funds. As a socialist, I have higher demands from my own political family and that is why I have not been shy in criticising what’s going on in Romania, and I am relieved to see that, finally, my Group has had the courage to suspend the Romanian PSD while this criminal capture persists.

As Commissioner Jourová said, this is about the rule of law, not only in Romania but in the EU. And if you want to back all these Romanian citizens who braved the harsh winter demanding, indeed, the rule of law, then we have to back them in the fight against corruption.

  Juan Fernando López Aguilar (S&D). – Señora presidenta, comisaria Jourová, intervengo desde la bancada socialista en este debate sobre el Estado de Derecho en Rumanía. Y no lo hago en rumano, ni en húngaro, ni en polaco, respetadas lenguas oficiales de la Unión que han estado muy presentes en este debate, por una razón transparente. Y es que el debate sobre la lucha contra la corrupción, el Estado de Derecho, la democracia y los derechos fundamentales es a menudo subvertido en un debate de acusaciones cruzadas entre aquellos países que han sido sujetos al artículo 7 por incumplimiento de los principios consagrados en el artículo 2 del Tratado de la Unión Europea y otro país en el que no se ha producido un conjunto de reformas constitucionales directamente agresivas contra esos principios.

Pero lo fundamental es que el trabajo está todavía por hacer. Un mecanismo fiable, sólido, de verificación, de cumplimiento de los principios consagrados en el artículo 2 del Tratado de la Unión Europea. Estado de Derecho, derechos fundamentales, calidad democrática y, también, lucha contra la corrupción.

Y ese mecanismo, señora Jourová, es exigible a la Comisión, de acuerdo con las Resoluciones que hemos adoptado en este Parlamento Europeo. Se lo exigimos a la Comisión que deba venir de la próxima investidura del Parlamento Europeo, tras las elecciones del 26 de mayo.

  Věra Jourová, Member of the Commission. – Madam President, first let me express the conviction that I represent here the whole College, the whole Commission. So that’s the reaction for you who criticised First Vice-President Timmermans for not being here today. Frans Timmermans has engaged very intensively in continuous, long-lasting dialogue with the Romanian authorities and he is the last person who should be criticised for doing something wrong or something negative against Romania.

The second comment: the Commission does not interfere in individual cases in Romania. This is the reaction to Ms Grapini. This is our principle: we do not interfere. We are looking at a systemic situation, at the situation in the legislation, and that’s why we are addressing the recent legislative changes which we see in Romania, because the cumulative potential of the individual changes might lead to the breach of the rule of law in Romania.

Last comment to Ms Morvai: No, I don’t know the basis.

I very well remember my own case from 2006. I was accused of corruption in 2006, with a very dirty political case. It was purely motivated by political interests and it was a charade for the media, and I still remember that when sitting in the jail, not for a single second did I believe that any judge in my country would send me to jail after indictment in the court. I believed in independent justice in my country and by the way the case never got to the court because there was not the slightest evidence. It was just politically initiated, a dirty game for the media.

I remember it very well and it’s a paradox that Romania was the country which offered me work after this, because everything was destroyed by this. I will not go into details but it also affected horribly my family. I worked in Romania. This country gave me a chance to provide my knowledge and expertise and that’s why I should be the last person who could be accused now of doing something against Romania.

I just have to share the view that in Romania we might get into the situation of irreversible changes in the judiciary system, the systemic breach of rule of law, where the independence and impartiality of the judiciary is endangered. I was following closely what Romania is doing through the CVM exercise. I was happy about the reform going in the right direction and at the same time, I was very scared about the changes which started to go in a very wrong direction and this is where we are now.

The independent judiciary is a very important pillar of the democratic state and it is something which is being developed over decades. In all the Member States we saw a very long process which led to the well-balanced constitutional system, with a very strong independent judiciary as the main part of it, or one of the main parts. But it can be destroyed literally overnight and this is what the Commission doesn’t want to happen in Romania.

So again, the debate, the dialogue is ongoing. I agree with those of you who said that Romania and the Romanians deserve more. So we would like to help Romania. Now the debate is ongoing on a technical level, I would wish us to come back to the political level and have a positive dialogue which will lead to positive changes and the reform coming back on track in Romania.
