17. Vastuuvapaus 2017: EU:n yleinen talousarvio – Eurooppa-neuvosto ja neuvosto (keskustelu)

  Der Präsident. – Als nächster Punkt der Tagesordnung folgt die Aussprache über den zweiten Bericht von Isabel García Muñoz im Namen des Haushaltskontrollausschusses über die Entlastung für die Ausführung des Gesamthaushaltsplans der Europäischen Union für das Haushaltsjahr 2017, Einzelplan II – Europäischer Rat und Rat (COM(2018)0521 – C8-0320/2018 – 2018/2168(DEC)) (A9-0010/2019).

Ich darf Sie darüber informieren, dass wir eine neue Möglichkeit für Wortmeldungen haben, nämlich die elektronische Anmeldung für die blaue Karte und für das Verfahren für spontane Wortmeldungen. Sie können aber auch stattdessen die blaue Karte benutzen. Die elektronische Anmeldung ist ab jetzt möglich, Sie brauchen nicht bis zum Ende der Aussprache zu warten.

  Isabel García Muñoz, ponente. – Señor presidente, gracias especialmente a la señora Tuppurainen de la Presidencia finlandesa por comparecer en este debate.

Desde el año 2009, el Parlamento no ha podido aprobar la gestión presupuestaria del Consejo debido a su falta de cooperación para que el Parlamento pueda llevar a cabo su labor de control de la gestión de las cuentas de la Unión. En el procedimiento para el cierre de cuentas del año 2017 —que es el que nos ocupa ahora—, una vez más el Consejo no respondió a los cuestionarios enviados y tampoco compareció en la audiencia de los secretarios generales de las instituciones organizada por la Comisión de Control Presupuestario.

En consecuencia, el pasado 26 de marzo, el Pleno del Parlamento postergó la aprobación de las cuentas del Consejo hasta este mes de octubre, dándole una vez más la oportunidad de enmendar la situación.

Lamentablemente, el Consejo no ha movido ficha hasta la fecha; de modo que, una vez más, ante esta falta de cooperación, nuestra comisión ha tenido que rechazar la aprobación de la gestión del Consejo para 2017.

Todos los grupos políticos votaron unánimemente en la Comisión de Control Presupuestario, respaldando así la posición que el Parlamento viene teniendo a lo largo de estos años, ya que consideramos que nuestro papel consiste en confirmar que el presupuesto se ha gastado de forma legal, regular y con arreglo al principio de buena gestión financiera, ejerciendo así una competencia fundamental en interés de todos los ciudadanos y contribuyentes de la Unión, al garantizar la transparencia y la rendición de cuentas democrática de todo el presupuesto europeo. Efectivamente, el informe pide al Consejo que reaccione y valore el papel democrático que el Parlamento tiene en esta materia.

El Consejo debería adaptarse y aceptar el escrutinio democrático de sus cuentas, como ha hecho el resto de instituciones y organismos de la Unión, y es más: aunque no lo hicieran estas, el Consejo debería ser el primero en dar ejemplo de transparencia y someterse al procedimiento de aprobación de la gestión, proporcionando la información que se le requiere.

Es cierto que a lo largo de estos años ha habido varios intentos, por parte de ambas instituciones, de acercar posiciones, que lamentablemente no han dado ningún resultado positivo hasta la fecha. Pero soy optimista y confío en que el Consejo estará dispuesto a llegar a un acuerdo sobre la forma de cooperar lo antes posible. En ese sentido, espero que la Presidencia finlandesa juegue un papel importante para alcanzarlo.

Por otra parte, el informe incluye un apartado sobre los patrocinios privados a los que muchos Estados miembros recurren a la hora de asumir la presidencia rotatoria del Consejo. Consideramos que la financiación privada de la presidencia puede dar una imagen inadecuada de las cuentas de la Unión y que, por lo tanto, supone un importante riesgo no solo para la reputación del propio Consejo, sino también para el conjunto de la Unión Europea, especialmente en un contexto en el que las instituciones necesitan proteger y reforzar la confianza que los ciudadanos depositan en ellas.

Y, para terminar, precisamente en nombre de esa confianza y en aras del ejercicio responsable de transparencia y supervisión democrática que nuestros ciudadanos se merecen, hago un nuevo llamamiento al Consejo para aunar nuestros esfuerzos con el fin de encontrar una solución a este desacuerdo lo antes posible.

Le debemos a la ciudadanía europea una gestión transparente, fiable e íntegra de todo el presupuesto de la Unión Europea.

  Tytti Tuppurainen, President-in-Office of the Council. – Mr President, honourable Members, let me first say something about the specific exercise of discharge for the 2017 budget and then comment on the state of play of our discussions on the cooperation between Parliament and the Council during the discharge procedure in general.

In relation to the implementation of the 2017 budget, you know of course that the Court of Auditors in its annual report, I quote: ‘did not identify any issues concerning the Council’. This is worth underlining. As for the more general discussion between our two institutions, after several years of deadlock both sides made an endeavour in 2018 to reach an understanding which would ensure pragmatic cooperation while maintaining certain positions of principle on both sides.

The Council has always underlined that Article 319 of the Treaty provides for a single discharge procedure for the entire EU budget. Parliament has adopted a political practice providing for separate procedures for each institution or body. In spite of this disagreement in principle, we found that there was still scope for identifying a common set of good practices to facilitate cooperation in the discharge procedure.

The Council revised its 2011 draft memorandum of understanding on the basis of a proposal of the European Parliament and sent an amendment text back to Parliament in May 2018. Further contacts and exchanges took place in summer 2018 and the Council took note of subsequent suggestions by the then—Chair of the Committee on Budgetary Control (CONT), Ms Grässle.

Last summer, after the transition period around the European elections, the Council received a letter from the new CONT Chair, Ms Hohlmeier, asking for feedback on her predecessor’s suggestions.

The Presidency can confirm that the Council’s competent preparatory bodies are currently examining the way forward. It is very important for the Council to know whether Parliament still stands behind our common approach of the last year, in particular the clear delimitation of the scope of the discharge procedure. Discharge is about the implementation of the budget. It cannot be used as a means to make the Council politically accountable to the European Parliament.

Another very important element for the Council is the equal and mutual exchange of information between our two institutions. The draft memorandum says ‘notwithstanding the difference between their respective roles in the discharge procedure, the Parliament and the Council need a similar factual basis’.

This seemed to be the common ground last year. I hope it still is, but it will also have to be ensured in concrete terms. As you will understand, I cannot anticipate today the Council’s reaction to Ms Hohlmeier’s letter. The Council is in the process of defining its position on the best way forward. Let me reassure, nonetheless, that the Presidency is doing all it can to conclude this process and to find a solution which is acceptable to both institutions. Thank you very much for your attention, ladies and gentlemen.

  Angelika Winzig, im Namen der PPE-Fraktion. – Herr Präsident, sehr geehrte Frau Tuppurainen, geschätzte Kolleginnen und Kollegen! Zunächst ein herzliches Dankeschön an unsere Berichterstatterin, Frau Muñoz, für ihre Arbeit. Protecting the European Way of Life bedeutet für mich auch, dass die Finanzierung der europäischen Institutionen für unsere Bürgerinnen und Bürger nachvollziehbar sein muss. Jedoch konnten unsere Mitglieder im Ausschuss wie in den vergangenen Jahren auch der Entlastung 2017 nicht zustimmen. 2017 verfügte der Rat über Haushaltsmittel in Höhe von 562 Millionen EUR, er war aber nicht bereit, die schriftlichen Anfragen zu beantworten und auch an der Anhörung zum Vollzug des Entlastungsprozesses teilzunehmen.

Ich wünsche mir genauso wie meine Kolleginnen und Kollegen, dass wir hier eine gute Lösung finden, und bedanke mich bei unserer Kollegin und Ausschussvorsitzenden, Frau Hohlmeier, dass sie die Verhandlungen mit dem Rat aufgegriffen hat. Für die Zukunft wünsche ich mir für die Europäische Union mehr Transparenz, jedoch nicht den gläsernen Bürger, sondern die gläsernen Organisationen und Institutionen, vor allem wenn sie vom Steuergeld unserer Bürgerinnen und Bürger finanziert werden.

  Lara Wolters, on behalf of the S&D Group. – Mr President, I welcome this report and especially its critical stance on the private sponsorships of the rotating Presidency of the Council. To sketch out the problem for you, Romania was sponsored by Coca Cola at a time when the Council was negotiating rules on foodstuff labelling. Finland accepted 100 BMW vehicles while it was reviewing emission norms for cars. The incoming Croatian Presidency has published a paper on how private companies can seize the business opportunities that come with their Presidency.

Corporate sponsorships, in my opinion, discredit the EU. What is at stake here is not only conflicts of interest and transparency, but also trust. In the last European elections, more young people than ever cast their vote. They show trust in the European project and we should be cherishing that trust. These sponsorships undermine the trust that we were given and they show the EU at its worst. The EU, not for the many, but for the few, namely a few corporate sponsors. Instead of this, what we need is an EU that puts the public good first and curbs the power of vested interests.

So two weeks ago, I stood here and I asked the Council Presidency this very same question: what are you going to do about private sponsorships? The Finnish Presidency then dodged the question and said, well, this is a matter for the Member States. But the last time I checked, Finland was a Member State and the Council was made up of Member States. So I will ask you again, will you choose to be a force that undermines EU citizens’ trust, or will you tackle these private sponsorships and work with the European Parliament to reinforce trust in the EU?

  Mikuláš Peksa, za skupinu Verts/ALE. – Paní předsedající, já myslím, že tahle procedura udělení absolutoria Radě a Evropské radě je problém, na který tu narážíme už dlouho. Není možné, aby se Rada chovala tímto způsobem.

Tento problém odhaluje daleko horší vazbu nedůvěry mezi našimi institucemi, mezi Parlamentem a Radou, které mají reprezentovat zájmy evropských občanů. Nejsme tady proto, abychom si vzájemně škodili, jsme tady proto, abychom si vzájemně pomáhali, a to znamená i pomáhat si s finanční kontrolou.

Jsou to peníze evropských daňových poplatníků, které spravujeme společně, a musíme se společně snažit o to, aby byly utráceny efektivně. Požadovat jejich kontrolu není ze strany Parlamentu agrese, je to prostě přirozená součást transparentního jednání evropských institucí. Jsme odpovědni našim voličům za naplňování těchto požadavků a myslím si, že bychom jim měli dostát. Z tohoto důvodu nemůžeme podpořit udělení absolutoria Radě, nebude-li ochotna vyjít Parlamentu vstříc.

  Joachim Kuhs, im Namen der ID-Fraktion. – Herr Präsident, sehr geehrte Damen und Herren vom Rat! Ich habe mich als Neuling sehr gewundert, als ich zum ersten Mal gehört habe, dass der Rat seit sieben Jahren nicht mehr entlastet worden ist, und jetzt frage ich mich: Wie kann das sein? Dieses Jahr ist es auch wieder so: Wir können für 2017 die Entlastung nicht erteilen, weil einfach die Kooperation fehlt.

Und jetzt frage ich mich: Meinen Sie denn, dass das Parlament nicht befugt ist, die Gelder, die halbe Milliarde Euro, die Sie aus dem EU-Haushalt bekommen, zu kontrollieren? Sollen wir das nicht machen? Sind wir aus Ihrer Sicht nicht dazu berechtigt? Das ist für mich einfach die Frage, und ich bitte Sie, das wirklich mal ernsthaft zu prüfen. Denn wenn Sie weiterhin diese Prüfung verweigern, diese Möglichkeit, Ihren Haushalt zu entlasten, dann stellt sich die Sinnfrage. Da muss man fragen, wozu ist dann überhaupt das Parlament hier? Brauchen wir dann dieses Parlament überhaupt noch, wenn es nicht in der Lage ist, eine Institution der EU zu entlasten? Deshalb bitte ich Sie, diese Frage ernsthaft zu prüfen.

  Der Präsident. – Herr Kollege! Darf ich nur feststellen, dass ich schon erwarte, dass die Abgeordneten dieses Hauses die Zweckmäßigkeit des Europäischen Parlaments als Herzstück der europäischen Demokratie nicht in Frage stellen.

  Ryszard Czarnecki, w imieniu grupy ECR. – Panie Przewodniczący! Procedura udzielania absolutorium oddzielnie poszczególnym instytucjom i organom unijnym to długoletnia nasza praktyka, która została opracowana w celu zagwarantowania przejrzystości rozliczania tych instytucji przed obywatelami krajów członkowskich Unii i niezbędnej walki z nadużyciami finansowymi. Procedura ta jest akceptowana przez wszystkie instytucje oprócz Rady, podkreślam wyłącznie oprócz Rady. Parlament udziela absolutorium innym instytucjom po rozpatrzeniu przedłożonych dokumentów, odpowiedzi udzielonych na postawione pytania oraz po wysłuchaniu sekretarzy generalnych tych innych instytucji. Pytanie, jak mamy udzielić absolutorium, skoro nie dysponujemy żadnymi informacjami? Rada ponownie nie udzieliła odpowiedzi na pisemne pytania skierowane przez Parlament, a sekretarz generalny Rady nie wziął udziału w wysłuchaniu zorganizowanym w dniu 27 listopada 2018 roku w kontekście procedury udzielenia absolutorium. Rada nie ustosunkowała się do uwag potrzebnych Parlamentowi do rezolucji, lekceważąc tym samym rolę Parlamentu.

  Michael Heaver (NI). – Mr President, I’ve always said the European Union is world class at one thing – wasting money, and this discharge report rather makes the point again.

In 2017, the EU Council spent EUR 100 000 on a relaxation chair and EUR 20 000 on the rental of a shooting range. It spent EUR 35 000 taking its staff and children on a subsidised trip to a theme park and spent EUR 55 000 on a big party where staff could enjoy a 3—course dinner and dance the night away with a taxpayer—funded open bar until 3 am.

In 2018, the EU Council spent EUR 115 000 on bottles of champagne. Do the British people really want to funnel another 30 billion plus into the European Union’s coffers for a new European treaty or do they want to take back control? I say ‘enough’. I say let’s take back control of our money with a clean break Brexit.

  Tomáš Zdechovský (PPE). – Pane předsedající, já pevně věřím, že tak, jako Britové si vezmou kontrolu nad svými penězi po brexitu a ukážou nám, jak umí skvěle hospodařit – já se tam rád budu jezdit učit –, tak i my dnes s Radou najdeme nějaký konsenzus. A myslím si, že je důležité, aby ten konsenzus jsme hledali napříč politickým spektrem.

Ano, bylo tady zmiňováno mými kolegy z ID, že ten konsenzus nad právě kontrolou rozpočtu už se nemohl najít 7 let. Já bych měl být příští rok zpravodajem právě pro discharge Rady. A proto jsem si ho vzal, protože si myslím, že je potřeba vést dialog.

A tady potřebuji pomoc Klause Welleho a potřebuju jeho otevřenost, aby byl schopen s námi vyargumentovat, proč je to právě Evropský parlament, který dohlíží nad účty evropských institucí, že měříme všem stejným metrem. Že tak, jako ho drtíme na výboru CONT našimi otázkami týkajícími se Evropského parlamentu, tak je normální ptát se na otázky týkající se Rady, na které se ptali kolegové z Velké Británie. A já pevně věřím, že nám všem záleží v této místnosti na transparentnosti. To je to, co jsme tady zmiňovali. A že tento kompromis najdeme a ukážeme občanům Evropské unie, že jsme ti první, kteří chceme mít pořádek v našich účtech.

  Der Präsident. – Liebe Kolleginnen und Kollegen! Wir kommen jetzt zu den spontanen Wortmeldungen. Es liegt mir eine Wortmeldung vor. Aber ich möchte vorher etwas Grundsätzliches sagen: Es sind jetzt weniger Kolleginnen und Kollegen anwesend, als Fahnen auf Plätzen von Kolleginnen und Kollegen stehen. Im Sinne eines Parlaments, das die Bürgerinnen und Bürger durch Bürgerinnen und Bürger vertritt, möchte ich schon sagen: Die Fahne kann eine Person – einen Menschen – nicht ersetzen. Wir haben als Bürgerinnen und Bürger die Bürger zu vertreten, und ich bitte daher, diesen Ersatz zu überdenken. Wir sollten uns als Menschen an der Debatte beteiligen und nicht durch Ersatzstücke, die noch dazu der Geschäftsordnung widersprechen.

Spontane Wortmeldungen

  Tudor Ciuhodaru (S&D). – Domnule președinte, din punctul meu de vedere, lucrurile pe care le-am auzit astăzi sunt extrem de grave și cred că este momentul să avem o altă abordare democratică, inclusiv pe ceea ce înseamnă controlul fondurilor Uniunii Europene. Ar trebui să existe o lege a transparenței și mi se pare incredibil că, în fața unui parlament ales de cetățenii Europei, pot fi și pot exista lucruri care mai sunt ascunse, fie că e vorba de buget, fie de alte proceduri.

În al doilea rând, cred că este momentul să existe o instituție care să facă independent verificarea acestor descărcări bugetare, pentru a fi mai presus de orice suspiciune, dar aceste reguli clare trebuie făcute de cetățenii europeni și vă reamintesc că organul democratic ales în acest moment este Parlamentul European. Așa că le solicit colegilor mei, poate ne reunim pe grupuri parlamentare și găsim o procedură unică care să facă cu adevărat față unor cerințe extrem de importante.

  Matthew Patten (NI). – Mr President, Mr Zdechovský was kind enough to refer to the UK in terms of issues of this matter. I want to make a couple of points that are not about democracy per se, but about the responsibilities of democracy. Transparency is one of the essential ingredients in terms of giving trust to our voters.

Throughout this debate, we have heard the key issue of transparency come round and round again, and I am not surprised, given that we are talking about EUR 562 million that has not been accounted for to this Parliament. The three things the European Parliament and the European Council really need to reflect on are the following. The first thing, there needs to be external accounting for these matters; at the moment, the internal accounting procedure is not working. The second thing is that the executive must appear before the committees. I cannot imagine a situation where the executive is refusing to appear before the committees of this Parliament. The third thing is conflicts of interest around sponsorship; those must be accounted for. Our voters need transparency.

  Tytti Tuppurainen, President-in-Office of the Council. – Mr President, honourable Members, ladies and gentlemen, I appreciate the exchange of views we have had today.

I wish to highlight that the President of the Court of Auditors himself has declared in your Budgetary Control Committee that the Council is examined in the same way as any other institution. Furthermore, the Council provides the European Parliament with the complete financial documentation mentioned in the Treaty articles about discharge. In addition, for some years now Parliament has had access to the annual activity reports of the Council’s authorising officers by delegation and other documents which contain all relevant information about how the Council uses its resources and how it organises its work.

Honourable Members, I’d like to repeat here that the Finnish Presidency is committed to exploring all possibilities to reach a mutually acceptable arrangement. We have to aim for something that works, and that works for everyone. I want to emphasise that one of my predecessors as President of the Council once said that the EU institutions can gain the trust of the citizens in the Union only together, not against each other.

Finally, just shortly on corporate sponsorship. I’d like to reiterate that corporate sponsorships are a matter falling within the remit of each Member State. Of course the Council is politically accountable to the Union’s citizens. This accountability operates through Member States’ governments that are being controlled democratically and legitimatised by national parliaments. It is fair to say that it does not operate through the European Parliament.

  Isabel García Muñoz, ponente. – Señor presidente, en primer lugar, deseo agradecer a los miembros de la Comisión de Control Presupuestario su cooperación y sus aportaciones a través de enmiendas, y también las intervenciones que ha habido en este debate y, sobre todo, el respaldo al informe.

Reitero la necesidad de encontrar una solución a este desacuerdo. Nos jugamos la reputación de las instituciones europeas y nos debemos a la ciudadanía, que nos requiere transparencia y rendición de cuentas. No demos armas para conformar discursos como el que ha tenido el señor Heaver.

Me alegra saber que se está examinando el camino a seguir para buscar una solución que contente a las dos partes y espero que las negociaciones puedan empezar cuanto antes. Creo que para ambas instituciones es fundamental llegar a un acuerdo y terminar con esa «representación» que llevamos a cabo desde hace años y que no lleva a ninguna parte.

Y en cuanto a los patrocinios: simplemente, me preocupan los posibles daños para la reputación y el riesgo de la pérdida de confianza de los ciudadanos en la Unión Europea, a pesar de que sean competencia de los Estados miembros.
