  Der Präsident. – Als nächster Punkt der Tagesordnung folgt die kurze Darstellung des Berichts von Ioan-Rareş Bogdan über den Zugang der Öffentlichkeit zu Dokumenten (Artikel 122 Absatz 7 der Geschäftsordnung) – Jahresbericht für die Jahre 2016 bis 2018 (2019/2198(INI)) (A9-0004/2021).

  Ioan-Rareş Bogdan, Raportor. – Domnule președinte, dreptul publicului de a avea acces la documentele instituțiilor Uniunii Europene este consacrat în tratate și în Carta drepturilor fundamentale și este indisolubil legat de natura democratică a acestora.

Uniunea Europeană trebuie să depună eforturi pentru a atinge cele mai înalte standarde de transparență, responsabilitate și integritate, aceste principii fiind fundamentale pentru a promova buna guvernanță și pentru a asigura o mai mare deschidere în ceea ce privește funcționarea sa și modul în care se derulează procesul său decizional.

În plus, nu trebuie omis faptul că transparența are potențialul de a reduce euroscepticismul. Am să mă explic: pe piața campaniilor de denigrare a Eurosistemului, există forțe care stimulează frustrările unor cetățeni. Cum anume? Inducându-le sentimentul că o elită economică profită de vulnerabilitățile unor state, categorii profesionale, pentru a face averi pe seama sărăciei. Cum anume? Spunându-le că există niște politicieni fără Dumnezeu care vor să stăpânească lumea. Din aceste motive, a le explica cetățenilor Uniunii Europene cum sunt investiți banii lor, unde ajung, de ce, pe ce criterii de prioritate reprezintă o metodă sinceră și simplă de a întări solidaritatea europeană, iar unitatea este puterea noastră, dragii mei.

Un nivel ridicat de transparență a procesului legislativ le oferă așadar cetățenilor europeni, mass-mediei și societății civile posibilitatea să tragă la răspundere reprezentanții aleși, dar și guvernele. De aceea, la baza oricărei decizii prin care se refuză accesul public la documente trebuie să stea excepții prevăzute de legislație și definite în termeni clari, însoțite de justificări fundamentate și concrete care să le permită cetățenilor să înțeleagă de ce le-a fost refuzat accesul și să se prevaleze în mod eficient de căile de atac pe care le au la dispoziție.

O abordare mai proactivă ar însemna nu numai un pas înainte pe calea transparenței, dar ar preveni și litigiile inutile care înseamnă bani și costuri pentru toate părțile. Este nevoie așadar ca toate instituțiile și agențiile europene să aibă o abordare comună în ceea ce privește accesul public la documente, să exploreze și să dezvolte în mod constant noi metode pentru a obține o transparență maximă. Pe această cale, reiterăm solicitarea adresată Consiliului de a-și alinia metodele de lucru la standardele unei democrații parlamentare și participative, astfel cum se prevede în tratate. Consiliul trebuie să fie la fel de responsabil și de transparent ca și celelalte instituții europene.

Reamintesc că transparența și accesul neîngrădit la documentele deținute de instituții trebuie să constituie o regulă în conformitate cu Regulamentul nr. 1049/2001. În mod regretabil, revizuirea acestui regulament este blocată de mai mulți ani. Este imperios necesar ca toate părțile implicate să reia acest proces și să continue să lucreze la revizuire, pentru a adapta dispozițiile regulamentului la Tratatul de la Lisabona și pentru a garanta că domeniul de aplicare se extinde la toate instituțiile și agențiile Uniunii.

În încheiere, doresc să subliniez că societățile democratice deschise depind de capacitatea cetățenilor de a avea acces la o gamă largă de surse de informații ce pot fi verificate, astfel încât să își poată forma un punct de vedere asupra diverselor subiecte, și că accesul la informații publice sporește responsabilitatea în procesul decizional pentru cei 530 de milioane de cetățeni europeni.

  Mariya Gabriel, Member of the Commission. – Mr President, Mr Bogdan, honourable Members, first of all, the Commission welcomes the report for the plenary debate and congratulates you on the work on general reports of the Commission on Public Access to Documents in years 2016 to 2018. The report attaches great importance to the principle of transparency that should give application to every sphere of the activity of the European Union.

Transparency is one of the fundamental priorities of the von der Leyen Commission. It underpins the work of the Commission by bringing citizens closer to its decision-making process and allows citizens to retain their trust in the European Union’s political, legislative and administrative activities. The Commission supports the steps to introduce greater transparency into the legislative process in the European institutions. One recent example of fostering transparency is the conclusion of negotiations of inter-institutional agreement on a mandatory transparency register covering the European Parliament, the Commission and, for the first time, the Council of the European Union. The interinstitutional negotiations, which started in 2018, have been complex and very challenging, inter alia due to the three institutions’ own specificities, which make finding a common denominator on a new three-party transparency register a difficult equation.

The final political agreement of the institutions was successfully reached on 15 December 2020. Importantly, the agreement also opens the scheme to the voluntary involvement of other Union institutions and bodies, and of the Member States’ permanent representations. The transparency register is a big success. There are currently more than 12 000 registrants, which probably makes it the largest database of its kind in the world. In terms of access to documents, the Commission receives the largest and still—increasing number of requests. In 2019, the institution reached its highest number of requests, having received no less than 7 445 initial and 334 confirmatory applications. The statistics show that the requested documents were fully or partially disclosed in more than 77.6% of cases at the initial stage, and wider or even full access was granted in 53.4% of the cases reviewed at the confirmatory stage.

The released documents complement the considerable amount of information and documents already available via the European Commission’s website, thanks to the institution’s policy of constantly increasing its proactive publication and its commitment to transparency. The COVID-19 pandemic triggered an increased public interest in access to documents. The Commission is proactively seeking the agreement of companies concerned for publishing the advanced purchase contracts related to COVID-19 vaccines.

Concerning the legislative transparency, the Commission takes the view that it is for the legislators to decide on the scope of access provided.

  Loránt Vincze (PPE), in writing. – As AFCO Opinion rapporteur for the file, I fully support the EP report on Public Access to Documents for the years 2016-2018. Transparency of legislative processes and citizens’ right to access documents are an essential part of participatory democracy. They allow citizens to look into and understand legislative processes, to participate in decision-making and to exercise public scrutiny. Transparency and access to documents are one of the pillars on which the legitimacy of a democratic political system rests. Citizens must have the right to know how their representatives – elected in the European Parliament, representing the Member States, or appointed to other EU bodies – act.
