  Presidente. – L'ordine del giorno reca la discussione sulle dichiarazioni del Consiglio e della Commissione sulla proclamazione dell'UE come zona di libertà LGBTIQ (2021/2557(RSP)).

Ricordo agli onorevoli deputati che per tutte le discussioni di questa tornata non è prevista la procedura "catch-the-eye", né saranno accettate domande "cartellino blu".

Inoltre, come nelle tornate precedenti, sono previsti interventi a distanza dagli Uffici di collegamento del Parlamento europeo negli Stati membri.

  Ana Paula Zacarias, President-in-Office of the Council. – Mr President, honourable Members, Commissioner Dalli, thank you for the invitation to this debate on the declaration of the EU as an LGBTIQ Freedom Zone.

This subject is essential to so many of our citizens who suffer discrimination and hatred because of their sexual orientation. Let me be very clear from the start: there should be no place for homophobia anywhere in Europe. Sexual orientation and gender identity are aspects of who we are, and no one should feel the need to conceal their true selves in order to avoid discrimination, hate or even violence.

In recent decades, progress has been made on LGBTIQ rights, but more remains to be done. Unfortunately, discrimination against LGBTIQ persons persists when they look for housing, when they seek health care or social services, and also at work or in school.

All citizens of our Union are equal and should be able to live in freedom, safe from discrimination based on their sex, race, colour, religion or sexual orientation. These are principles and values solemnly enshrined in the EU Treaties, the Charter of Fundamental Rights and EU legislation. They are not up for negotiation.

Our common European commitment to decency, tolerance and equal treatment is the very foundation of the idea of a just society. The EU, imperfect as it is, is still a beacon of hope for many across the globe. We must make sure that the example we set is a good one. This means building a society where our citizens feel free to be who they are, and to enjoy equal opportunities, participate fully and contribute and prosper in our society.

The most recent survey of the Agency for Fundamental Rights has shown that as many as 43 percent LGBTIQ persons feel discriminated against. One in ten LGBTIQ respondents were physically or sexually attacked, and transgender and intersex respondents experienced attacks at a higher rate.

What makes matters even worse is the fact that most of this injustice goes unreported. Overall, across the EU, only 11% of the discrimination suffered and only a small percentage of hate–driven incidents are reported. Europe still has a long way to go before real equality is achieved.

The COVID—19 crisis has had a disproportionate impact on more vulnerable groups, including LGBTIQ community, leading to more inequalities and violence. The Portuguese Presidency attaches great importance to the inclusion of LGBTIQ persons in our society and will not spare its efforts in pursuing that goal.

We count on the measures announced by the Commission in the first—ever strategy on LGBTIQ equality presented last November, and which was discussed last December. Next week, the Employment, Social Policy, Health and Consumer Affairs Council (EPSCO) ministers will be invited to debate legislative and political measures to ensure concrete progress towards equality, non—discrimination and diversity in the EU and its Member States. Where appropriate, we will continue to discuss matters in the framework of the annual rule of law mechanism.

We would like to see equality becoming a reality, for example in Rainbow families, who can face difficulties and hurdles when seeking to exercise their right to freedom of movement within the EU. The Presidency is planning to organise an event on May 14 to commemorate the International Day against Homophobia, Transphobia and Biphobia.

We acknowledge the initiative to declare the EU an LGBTIQ Freedom Zone. Let us continue to work together towards this goal by doing everything we can to protect persons from being discriminated against because of their sexual orientation or gender identity, and to ensure across Europe that they can enjoy equality in their daily lives.

  Helena Dalli, Member of the Commission. – Mr President, allow me to dedicate this debate to Benjamin, my first grandson, born two hours ago. Dear Benjamin, may you live in a hate—free Europe. May you live in a humane Europe, and may you live in a Europe where you will have the best chance in life to be all that you can be.

I am really grateful for this debate and opportunity to speak to you about LGBTIQ people’s rights and freedoms. The Commission welcomes and supports the European Parliament’s intention to declare the EU an LGBTIQ freedom zone.

During her State of the Union address in September 2020, President Ursula von der Leyen stated in this House that she would not rest when it comes to building a union of equality, a union where you can be who you are and love who you want without fear of recrimination or discrimination. I share your vision of a European Union where LGBTIQ people are fully free to be themselves throughout the course of their life without exception, where they can love who they want and build their families without other considerations, such as their fear of negative reactions from loved ones or societal discrimination, and where no considerations related to societal attitudes or administrative burdens enter into the equation of whether to move freely to another EU country or not.

This is not reality yet, but we intend to get there. Right now, many European citizens are deprived of their full set of freedoms. In some EU countries, LGBTIQ people have come under increasing attack by politicians, religious leaders and other public figures. This has led to increased scapegoating of LGBTIQ persons, who are, for instance, framed as a threat to children. The EU must be a freedom zone for all of us, without exception.

This is why the Commission adopted the first ever LGBTIQ equality strategy last November. Our strategy aims to ensure that LGBTIQ people are safe and have equal opportunities to participate fully in society and thus reach their full potential. The Commission has started implementing this new strategy to guarantee that each measure included in it will materialise in the coming five years.

The Commission shares your vision of an EU where people in all their diversity, and regardless of their personal characteristics, live together in harmony. Where they are free to pursue their life regardless of their sexual orientation, their gender identity, their gender expression or their sex characteristics. Where they are equal, be they lesbian, gay, bisexual, heterosexual, trans, non—binary, cisgender, intersex or queer.

As part of this work, the situation in all Member States will continue to be monitored closely to make sure that the principle of non—discrimination is fully respected when implementing EU law and EU—funded projects. One of the main messages of the Commission’s LGBTIQ strategy is that LGBTIQ discrimination needs to be addressed at all levels and that progress depends on all stakeholders working together.

I thank the European Parliament for its commitment to making the EU’s shared values of equality and freedom a reality for all. Together, we can break down barriers to LGBTIQ equality.

  Roberta Metsola, on behalf of the PPE Group. – Mr President, being here today is important. Telling people that they are not alone is important. I am a mother of four. I have been able to be married to my husband for 15 years. I am a Christian Democrat and a proud southern European woman. Tradition is something I respect and so are our values, all our values.

We’ve just marked Women’s Day, and as a woman, I understand the importance of having allies in a struggle and of being an ally. This is not about one community versus another. It is about all of us moving forward together, and we cannot move forward when so many are left behind.

So today we are here to tell all those in the LGBTIQ community that this is your Europe too. To tell all those parents who are worried about the safety of their LGBTIQ children that we have their back. To tell every girl and boy that in this Europe you can be whoever you want to be, wherever you want to be, and our Union, this House, will protect that right. To tell those struggling that you do not have to adjust yourself to injustice. To tell abusers both offline and online that you will not find safe haven here, that our laws will protect those you seek to destroy. To tell everyone in Poland and beyond that we hear you, that Europe stands for freedom – freedom to live as you wish to live, freedom to love who you wish to love, freedom to be who you wish to be – and that there is not one state, not one town, not one village in our Union where this freedom will not be defended, because this is who we are. This is a freedom zone.

  Iratxe García Pérez, en nombre del Grupo S&D. – Señor presidente, señora comisaria, el miedo, la violencia y la discriminación siguen siendo una realidad a la que se enfrentan muchas personas LGTBIQ en buena parte del mundo, incluso en aquellos países y regiones que todavía nos consideramos a la vanguardia.

Todavía hay setenta países que criminalizan las relaciones entre personas del mismo sexo y doce de esos países pueden llegar a aplicar la pena de muerte. En la Unión Europea las zonas libres de ideología LGTBIQ, impulsadas por la ultraderecha polaca, recuerdan la barbarie de nuestro pasado.

La protección de los derechos de las personas LGTBIQ corresponde a todas las instituciones públicas. Después de diez años, ¿cuánto tiempo más tenemos que esperar para que se adopte la Directiva sobre la igualdad de trato más allá del ámbito laboral?

Pese al injustificable retraso, hay luz en el horizonte. La primera estrategia para la igualdad de las personas LGTBIQ en la Unión Europea, presentada el pasado mes de noviembre, es una firme respuesta de la Comisión Europea ante el retroceso de los derechos y libertades en Polonia y en Hungría.

Ahora tenemos la obligación de aplicar, junto a los Estados miembros y con carácter urgente, el conjunto de medidas legales y financieras que contempla para los próximos cinco años.

Con esta estrategia demostramos que somos capaces de avanzar hacia una Unión Europea que no solo se construye sobre la apertura de fronteras o de un mercado común, sino también sobre unos derechos y valores fundamentales iguales para todos los ciudadanos y que todos los Estados miembros tienen la obligación de respetar. Bajo ninguna circunstancia aceptaremos el hostigamiento y la criminalización de la cruzada homófoba, liderada por las fuerzas de ultraderecha en Polonia y en Hungría.

Señor Kaczyński, señor Orbán, ninguna ideología justifica la colocación de carteles con mensajes en distintas lenguas que alientan a la discriminación de las identidades sexuales. Lo único que atenta contra los derechos humanos es la ideología del odio y de la intolerancia. Nunca más viviremos en una Europa que obligue a sus ciudadanos y a sus ciudadanas a esconderse de nada ni de nadie.

Nuestros Tratados garantizan que todas las personas en la Unión Europea somos libres de ser quien somos, de vivir donde queremos vivir y de amar a quien nos dé la gana de amar. El cruel asesinato de un hombre homosexual en el municipio belga de Beveren nos recuerda que la igualdad y la no discriminación deben defenderse cada día.

Con la declaración de la Unión Europea como una zona de libertad para las personas lesbianas, gais, bisexuales, transexuales, intersexuales, queremos dar un paso más para garantizar que nadie sea perseguido en ningún rincón de la Unión Europea por su orientación sexual. Unámonos contra el odio y levantemos nuestras voces por el derecho de todos y todas a vivir libres e iguales en dignidad y en derechos.

  Pierre Karleskind, au nom du groupe Renew. – Madame la Présidente, Madame la Commissaire, Madame la Ministre, chers collègues, la résolution sur laquelle nous débattons ce jour ne comporte qu’un seul et unique article: le Parlement européen déclare par la présente l’Union européenne comme zone de liberté pour les personnes LGBTIQ. Ce ne sont que quelques mots, mais les mots ont une force. Et lorsqu’il y a deux ans, dans certaines communes polonaises, des déclarations ont été faites pour demander à ce que ce soit des zones sans LGBT, sans idéologie LGBT, ce n’était aussi que des mots. Et pourtant, quand dans certains pays, le discours public établit des différences entre les individus en fonction de leur orientation sexuelle ou de leur identité de genre, comment la société pourrait-elle éviter les actes malveillants, les insultes, les agressions? Imaginons la vie des personnes LGBTIQ dans ces communes! Avons-nous seulement pensé à ce que c’est qu’être un adolescent qui découvre son homosexualité dans ces communes? Mais mes chers collègues, parce que les mots ont une force, cette résolution est en fait bien plus qu’une simple phrase: c’est un message clair et puissant aux gouvernements que le Parlement européen ne tolérera plus les dangereuses et mortifères rhétoriques qui s’en prennent à la liberté de millions de citoyens, d’êtres qui ils sont, d’aimer, de fonder une famille.

C’est une promesse que nous faisons à toutes les personnes LGBTIQ en Europe. La promesse que le Parlement européen se tiendra du côté de la liberté et c’est un commencement: cette résolution doit sonner la charge de la liberté face à la haine. Une bataille que nous allons mener de front, mais que nous ne pouvons pas gagner seuls ici, villes et villages, régions et capitales d’Europe de l’Ouest et de l’Est, déclarez-vous zone de liberté LGBTIQ. Mais ne vous arrêtez pas là, transformez sur le terrain la réalité de la vie des personnes LGBTIQ.

Mesdames et Messieurs les représentants des citoyennes et des citoyens européens, j’ai l’honneur de vous demander de déclarer l’Union européenne comme zone de liberté pour les personnes LGBTIQ.

Esiteks, minu teada mitte üheski liikmesriigis Euroopa Liidu kahekümne seitsmest ei ole karistatav sinu seksuaalne sättumus. Vahet ei ole, kas sa oled lesbi, gei, transinimene või mis iganes veel kuuekümnest seksuaalsättumusest. Ei ole keelatud sul armastada kedagi, keda sa soovid, ei ole keelatud koos elada mitte kellegagi. Siin me näeme puhast propagandat. Lihtsalt propagandat, et mõni riik pigem väärtustab traditsioonilisi pereväärtusi ja tõesti ei luba näiteks lasteaedades kaheaastastele lastele õpetada seksuaalseid ideoloogiaid, mida on ka rahastatud Euroopa Liidu eelarvest. Ja see on nüüd siis nende ideoloogide jaoks siinsamas saaliski, kui me räägime vasakäärmuslastest või liberaaläärmuslastest, see on siis nende jaoks kohutav kuritegu, mida teevad mõned liikmesriigid, ja ma ei saa sellega absoluutselt nõus olla. Ja mis puudutab kogu seda LGBT-inimeste küsimust, siis kõik taandub lõpuks küsimusele, milleks on abielu definitsioon ja perekonnapoliitika. Ja ma põhimõtteliselt keeldun nõustumast nendega, kes ütlevad, et ei ole mitte mingisugust vahet, millises keskkonnas kasvavad näiteks lapsed. Ei, laste jaoks on väga suur vahe, kas sul on ema ja isa või sul neid kahte ei ole. Ja seetõttu mina igati kaitsen neid perekondi, kus on õigus lastel kasvada turvaliselt ema ja isaga ja kõik ülejäänud, tehku nemad, mis vähegi soovivad, elagu, kellega vähegi soovivad.   Terry Reintke, on behalf of the Verts/ALE Group. – Madam President, you call us lunatics, you call us an irrelevant minority, you call us perverts, you call us an ideology, when all we ask for is equality. You paraphrase books written thousands of years ago to justify your hate. You take away our rights to distract from the shortcomings of your own politics. You scapegoat our community when all we ask for is safety. You attack our families. You tell people we are a threat. You deny us the right to be who we want to be, when all we ask for is freedom.

But we will not give up just because you keep attacking us. We will fight for our freedom. We will fight for our safety and we will fight for our equality. This declaration might only be a first step; we know that our lives are still in danger, our rights restricted, our freedom brutally suffocated in far too many places in the European Union, but it is a step and we are many. We are everywhere and we are strong. This declaration shall be a signal. A signal to the community everywhere in Europe. This battle is far from being over. This story is far from being told, and it will take all of us together. But then, yes, then we can do it. We can make the European Union an LGBTIQ freedom zone.

  Ryszard Antoni Legutko, w imieniu grupy ECR. – Pani Przewodnicząca! Pani Komisarz! Tekst przygotowany przez Parlament jest absurdalny i pokazuje, że ta izba stała się wielką ideologiczną machiną, która chce w Unii stworzyć nowego człowieka za wszelką cenę, nawet łamiąc prawo i gwałcąc prawdę odnośnie prawa. Artykuł 9 Karty praw podstawowych UE stanowi, że kwestie małżeństwa i rodziny są regulowane zgodnie z ustawami krajowymi. Jeżeli Pani Przewodnicząca von der Leyen mówi, że bycie rodzicem w jednym państwie członkowskim oznacza, że jest się rodzicem we wszystkich państwach członkowskich, a fraza ta jest powtórzona verbatim w tekście Parlamentu, to jest to ewidentny gwałt na artykule 9 Karty praw podstawowych.

Gdyby rzeczywiście tak miało być, że rodzic w jednym kraju jest rodzicem we wszystkich krajach, to artykuł 9 staje się śliski, bez znaczenia i powinien wylądować w koszu. I Państwo do kosza ten artykuł wrzucili. W wielu krajach, m.in. w moim, małżeństwo to związek kobiety i mężczyzny i podstawa rodziny. To jest zapisane w konstytucji. Kiedy więc samorządy bronią rodziny i nie godzą się na indoktrynację dzieci bez zgody rodziców i nie życzą sobie ideologicznych oficerów wykraczających do szkół i opowiadającym dzieciom absurdy o genderach i płynności płci, to stoją na gruncie krajowego prawa, konstytucji państwa i Karty praw podstawowych UE.

Obrona rodziny to jest ich święte prawo i nie wolno im tego prawa odbierać. Nie ma żadnego obowiązku prawnego ani moralnego, by wpuszczać każdego indoktrynatora do szkół, nawet jeśli ten indoktrynator ma potężnych popleczników w instytucjach europejskich. A kto każe ich wpuszczać wbrew woli zarządzających szkołami, ten gwałci prawo. Cała akcja przeciw tym samorządom, prowadzona również przez Komisję, przez fundusze norweskie, jest bezprawna i stanowi brutalną presję, podobnie jak dzisiejsza akcja Parlamentu. To jest polityka zastraszania ludzi, zastraszania, upokorzenia wspólnot. Ideologiczny amok się tutaj unosi. Nie macie szacunku dla ludzi. Jak każda radykalna lewica chcecie zrobić rewolucję.

A odnośnie do faktów, sprawdźcie dane OBWE na temat tzw. hate crimes, szczególnie ataków na osoby homoseksualne. W jakich krajach ta liczba jest najwyższa? Dane za rok 2019: w Holandii 574 przypadki, w Niemczech 248 przypadków, w Belgii 163. W jakich najmniejsza? Na Litwie 2 przypadki, w Polsce 16. Więc może powinniście mówić tutaj o Niemczech i Belgii, a nie o Polsce i innych krajach Europy Wschodniej. Kraje Europy Zachodniej prześcigają się w akcjach ideologicznych, już od żłobka karmicie niemowlaka genderami i płynnością płci. Oficerowie ideologiczni nie wychodzą ze szkół, mediów i korporacji.

Utrudniacie badania naukowe, wprowadzacie cenzurę na te tematy, zatruwacie język i umysły polityczną poprawnością. I co z tego macie? Efekt odwrotny do zamierzonego, to tam jest przemoc, nie tutaj. Zatem uspokójcie się ideologicznie. Dajcie ludziom żyć, nie róbcie rewolucji, zróbcie Unię strefą wolną dla zdrowego rozsądku. Ja wiem, że to trudne, ale mimo wszystko polecam. A przynajmniej nie mówcie nieprawdy, bo jak twierdzicie, że taki kraj jak Polska jest krajem wrogim dla osób homoseksualnych, że u nas są strefy wolne od LGBT – to mówicie nieprawdę. Powtarzam, to jest nieprawda. A mówienie nieprawdy to jest wstyd, wstyd. Jeżeli rozumiecie jeszcze, co to słowo znaczy.

  Eugenia Rodríguez Palop, en nombre del Grupo The Left. – Señora presidenta, en Bélgica, David, creyendo tener una cita el sábado noche, se encontró con tres adolescentes que lo asesinaron; en España, el mes pasado, un niño trans de once años fue agredido en un parque por cuatro menores. Subrayo: adolescentes y menores agresores. Y todavía tenemos que escuchar a las derechas hablar del pin parental y del adoctrinamiento de género en las escuelas…

La discriminación pública, la incitación al odio y los delitos motivados por el odio contra las personas LGBTIQ siguen siendo frecuentes en la Unión. Estas personas sufren más discriminación en todos los ámbitos, una alta prevalencia de ataques y una preocupante tasa de suicidio entre los jóvenes. Insisto, víctimas de asesinatos, agresiones y suicidios.

Mientras tanto, muchos Estados carecen de leyes específicas que respeten las normas mínimas de la Unión en esta materia o las aplican de manera insuficiente; por eso aplaudimos que la Comisión quiera ampliar la lista de «eurodelitos» para incluir la incitación al odio contra las personas LGBTIQ, así como su reciente estrategia en este terreno.

Sería bueno que, además, saliera adelante, de una vez, la Directiva antidiscriminación, que lleva bloqueada más de diez años en el Consejo, y que se condenara al ostracismo a la extrema derecha, a la derecha extremada y, muchas veces también, a la centrada por alentar la homofobia desde las instituciones.

De momento, si la Unión Europea se declara zona de libertad para las personas LGBTIQ, la homofobia lo tendrá mucho más difícil.

  Antoni Comín i Oliveres (NI). – Signora Presidente, onorevoli colleghi, io appartengo a una generazione di omosessuali che ha visto come la mia società si è evoluta, da una cultura in cui l'omofobia, la lesbofobia e la transfobia erano ancora molto prevalenti, in una nuova cultura in cui la rivendicazione dei diritti LGBT è ampiamente diffusa.

I diritti LGBT sono diritti umani, è inconcepibile che i paesi dell'Unione che ricevono fondi europei possano discriminare i cittadini a causa della loro sessualità. L'inaccettabile situazione in Polonia può ripetersi in più Stati se è tollerata.

Il ruolo dell'Europa nel mondo dipende dalla forza con cui difende i diritti umani all'interno dei suoi confini. Consentire la violazione dei diritti delle persone LGBT significherebbe incoraggiarne la violazione a livello globale, rinunciare ai valori dei trattati e mettere a rischio milioni di persone in tutto il mondo.

Questa iniziativa per trasformare l'Unione in uno spazio di libertà LGBT è fondamentale e spero abbia il massiccio sostegno di quest'Aula.

  Andrzej Halicki (PPE). – Pani Przewodnicząca! Witam serdecznie z Warszawy. Jest oczywistością, że gdyby we wszystkich państwach członkowskich Unii Europejskiej rządzili wyłącznie ludzie przyzwoici, nie mielibyśmy dzisiejszej debaty i nie musielibyśmy przyjmować oczywistej przecież dla większości Europejczyków rezolucji. Ale niestety, Panie Madison, to ja mogę powiedzieć z polskiej perspektywy jako Polak i katolik, co jest prawdą, a co jest propagandą. I wstyd, Panie Legutko, że stanął Pan po ciemnej stronie mocy, używając właśnie języka nieprawdy i insynuacji, kłamstw w gruncie rzeczy.

Jest mi wstyd jako Polakowi, że najwyżsi rangą politycy w Polsce, także prezydent czy minister sprawiedliwości, używają języka nienawiści i wykluczenia. Jest mi wstyd, że to ma miejsce w moim kraju, przecież tak bardzo znanym z tolerancji, z wielkich Polaków jak Władysław Bartoszewski, który mówił: „Warto być przyzwoitym”. Ten więzień Auschwitz, żołnierz antyniemieckiej konspiracji, a także opozycji antykomunistycznej namawiał do tolerancji i pojednania, używając tego właśnie stwierdzenia. Warto być przyzwoitym, ale tych nieprzyzwoitych musi odsunąć polskie społeczeństwo, a Panią Komisarz, babcię Beniamina, chciałbym z Warszawy serdecznie zaprosić do Polski, do tego wspaniałego kraju, by przekonała się Pani, jak wspaniałe jest polskie społeczeństwo, jak wspaniałą mamy historię i jak w swojej ogromnej większości ludzi nieprzyzwoitych będziemy odsuwać.

  Cyrus Engerer (S&D). – Madam President, every single person in every part of our Union should be able to live their lives with equal rights, irrespective of the way they were born. It sounds so simple. Yet this is not the experience of thousands of persons in Poland and Hungary today, who are seeing their rights being stolen away.

This is the reason why we are here today. Everyone must be given the assurance that, as their representatives in the European Parliament, we are working tirelessly to safeguard their fundamental rights.

Because this is what Europe means. Europe means the guarantee of fundamental human rights. Europe means solidarity between its people. Europe means all of us living together, irrespective of our differences. Europe means democracy, peace, fairness. Europe means freedom of movement. Europe means liberty. And today Europe means an LGBTIQ Freedom Zone.

It is our obligation as representatives of the people, as much as it is of the Commission, to ensure that this is the Europe experienced by all citizens, irrespective of where they live in the Union. This is why we need to unite as European institutions against those who abuse and oppress our citizens. Even when this is done by the Polish President, who believes that we are an ideology. No, we are human beings. Even when this is done by the Hungarian Prime Minister, who last week said that we are lunatics and that we should be hidden.

No, you will not make us invisible again, Mr Orbán. Whether we are trans, straight or gay, we are here to stay.

  Sophia in ‘t Veld (Renew). – Madam President, my congratulations to the Commissioner and the new granny, excellent news!

Today Parliament sends a message to everyone out there: Europe is an LGBTIQ freedom zone. Because Europe belongs to all of us. It’s the home of all of us, all – no exceptions. And at home, we have the right to be safe and free because that’s what Europe is all about. I’m very proud and grateful of this initiative led by my colleague Pierre Karleskind.

And it is an initiative that’s resonating widely in Europe already. And it is necessary, because others have also referred to it: David Polfliet was brutally murdered in Belgium last week. He was a fellow European, but some people believed that he did not have the same right to freedom and safety as everybody else because of who he was. You see, hate speech kills, and keep that in mind, colleagues Madison and Legutko, hate speech kills. And the Polish so–called ‘LGBTIQ-free zones’ are a message of hatred, and are also terrible city marketing, by the way.

But our message is stronger, because our message today is one of unity and humanity, and belonging together, because everyone belongs in Europe. And I therefore call on all Europeans to echo and amplify today’s message, and let us put up the LGBTIQ Freedom Zone signs in every town of Europe.

  Annika Bruna (ID). – Madame la Présidente, ce week-end, non loin de Bruxelles, un homme était, en raison de son homosexualité, lynché à mort par une bande de jeunes.

Ces drames intolérables ne cesseront pas parce que vous aurez proclamé l’Europe comme zone de liberté LGBT. Ce qui menace aussi la liberté des homosexuels, tout comme celle des femmes en Europe, c’est l’expansion de l’islam radical et d’une immigration massive non assimilée. Au lieu de combattre ce phénomène dont votre résolution ne dit pas un mot, vous attaquez la souveraineté des nations et instrumentalisez ce sujet pour faire avancer votre agenda politique.

En effet, vous voulez imposer la reconnaissance par les États membres d’enfants qui auraient deux parents de même sexe. Vous cédez ainsi à l’idéologie d’une minorité d’organisations LGBT. Tout enfant naît d’un père et d’une mère, c’est une réalité biologique indiscutable.

Nous voterons donc contre votre résolution et proposerons un texte qui défend le droit et la sécurité des personnes ainsi que la souveraineté des nations.

  Alice Kuhnke (Verts/ALE). – Fru talman! EU ska vara en frihetszon för hbtqi-personer. EU ska vara en plats där hbtqi-personer inte diskrimineras, inte hotas, inte misshandlas, inte dödas. EU ska vara världens mest fria och mest toleranta region.

Det är ett vackert och stort beslut men det kommer med krav på att agera därefter. Vi måste se till att alla har rätt till samma skydd mot diskriminering i hela EU. Därför måste en gemensam lagstiftning mot diskriminering komma på plats. Men antidiskrimineringsdirektivet har varit motarbetat i över tio år.

Vi måste också se till att vi stoppar all utbetalning av medel till medlemsstater som inte lever upp till EU:s grundläggande värderingar. De ska inte ha en krona av våra skattebetalares pengar.

Oczywiście w Polsce nie ma żadnych stref wolnych od LGBT, ale żeby sprawdzić Wasze prawdziwe intencje, złożyłem poprawkę, że Unia Europejska jest nie tylko strefą wolną dla LGBT, ale dla wszystkich, bez względu na religię poglądy czy kolor skóry. Ale Wy to odrzucacie. Dlatego, że Wam wcale nie chodzi o tolerancję. Wam chodzi o ekspansję lewicowych działaczy na tradycyjne wartości. Znów widać na tej sali kolonialne myślenie, że Wasza kultura jest lepsza niż kultura polska. Tymczasem spójrzcie na Wasze statystyki – okazuje się, że w Polsce jest mniej ataków na osoby LGBT niż w Waszej postępowej Holandii, Belgii czy Niemczech.

To w Polsce homoseksualizm nigdy nie był karany, a u Was był. Wreszcie to w Polsce jest więcej niż u Was kobiet na kierowniczych stanowiskach. Więc może ta tradycyjna kultura nie jest wcale gorsza niż ta Wasza nowa inżynieria społeczna. Wam się wydaje, że będziecie uczyć zacofanych Polaków nowej kultury. Tymczasem to nie nasza kultura wytworzyła przemysł zbrodni w Afryce czy nazizm. Dlatego nikt z Was nie będzie uczył Polaków kultury. W czasie, kiedy w Niemczech stawia się pomniki Lenina, Polacy muszą bronić tradycyjnych europejskich wartości i zdrowego rozsądku.

Oli kyse sitten seksuaalisesta suuntautumisesta, sukupuolivähemmistöistä, ihonväristä, uskonnosta tai mielipiteen vapaudesta, jokaisen pitää saada elää vapaana omana itsenänsä. Se, että vähemmistöjen oikeuksia poljetaan, on vielä sitäkin isompi asia kuin mitä se on sille yksittäiselle vähemmistölle. Kun yhden ihmisryhmän ihmisoikeuksia poljetaan, poljetaan ihmisoikeuksia. Poljetaan myös sinun ihmisoikeuksiasi, koska ihmisoikeudet kuuluvat kaikille kaikkialla kaikkina aikoina. Ne ovat jakamattomat.

  Maria Walsh (PPE). – Madam President, Commission, Council, colleagues, last week three Polish LGBTQI activists were acquitted of charges deemed to be offending religious beliefs – a victory for freedom of expression. The judge said there is no provision in the catechism of the Catholic Church that excludes non-heteronormative persons. There is love, mutual respect and understanding. This declaration is a way for our communities, on the second anniversary of the Polish LGBT-free zones, to show that equality isn’t a buzz word, but an EU right.

I’m proud on this day that the Commission has committed to their LGBT+ strategy. I’m proud on this day that the Parliament will pass this resolution with a large majority, declaring an LGBTQI freedom zone. I am proud, on this day, that my EPP Group colleagues contributing to this debate are actively supporting the rights of all citizens, not some, but all.

To those in this chamber who do not believe in equality, let me echo once again what the Polish judge said: there is love, mutual respect and understanding. No matter how much you attempt to undermine our efforts to secure equal rights for both men and women, you will lose. We will prevail.

Finally, Madam Commissioner, here’s to Benjamin and all the children who will call a fair, equal and loving Europe their home.

  Marc Angel (S&D). – Madam President, too often we think that the discrimination of LGBTIQ people is limited to specific regions of our Union. No! There is discrimination and hate crime all over Europe. We Socialists and Democrats strongly condemn the despicable murder of a gay man in Belgium, who was lured by three youngsters via a dating app and lynched on the spot. Many of us fellow members of the LGBTIQ community were assuming that things were getting better; unfortunately, the situation across Europe is worsening.

While nurses, doctors and people fight COVID—19, the Polish and Hungarian governments have nothing else to do than scapegoat LGBTIQ people in an attempt to demolish democracy. In Poland, the activists who documented the adoption of anti—LGBTIQ resolutions by local authorities are prosecuted with the support of the ultra—conservative organisation Ordo Iuris.

We need the Commission to protect activists from strategic lawsuits against public participation. In Hungary, the Minister of Justice, Judit Varga, said on Women’s Day that she only celebrates ‘real women’. Indeed, the Fidesz government basically outlawed trans and intersex people last year.

We need to act. The Commission’s excellent LGBTIQ equality strategy must rapidly be put into concrete action. The EU must be a freedom zone for all, and this must include LGBTIQ people. Declaring the EU an LGBTIQ freedom zone is a signal that all EU institutions and Member States have to secure the rights of LGBTIQ people.

  Moritz Körner (Renew). – Frau Präsidentin! Was wir heute hier diskutieren, ist eigentlich schon in Verträgen und in der Grundrechtecharta festgeschrieben. Es müsste eigentlich eine Selbstverständlichkeit sein. Und trotzdem gibt es in Europa Regierungen und Politiker, die Hass säen, die LGBTI-freie Zonen hochziehen.

Und wenn man sich hier heute diese Debatten, diese dümmlichen Wortbeiträge, teilweise aus der rechten Seite, anhört, dann muss man sagen: Diese Entschließung ist immer noch wichtig! Denn wir müssen dafür kämpfen, und so lange dafür kämpfen, dass Toleranz in Europa eine Rolle spielt, bis queere Menschen nicht mehr ein vier- bis sechsfach höheres Risiko haben, Selbstmord zu begehen, bis in Europa jede Regenbogenfamilie die gleichen Rechte hat, bis ein schwuler Jugendlicher keine Angst mehr haben muss, sich bei seinen Eltern zu outen, und bis jedes lesbische Paar in jeder Stadt in Europa Händchen haltend ohne Probleme durch die Gegend laufen kann.

Und deswegen: Europa steht nicht für Hass, Hetze, Schwarz-Weiß-Denken. Die EU steht für Liebe, Vielfalt und die Farben des Regenbogens. Und das sagen wir heute klar. Und darauf bin ich stolz.

  Nicolaus Fest (ID). – Frau Präsidentin! Deutschland hatte mal einen homosexuellen Außenminister, Berlin und viele andere europäische Großstädte wurden von Homosexuellen geführt, und auch die Fraktionsführerin meiner Partei im Bundestag ist offen homosexuell.

Aber die Zustände haben sich im Westen verschlechtert. Herr Legutko hat die Zahlen genannt. In vielen Vierteln in Berlin, Hamburg, München, aber auch in Paris, Brüssel oder Amsterdam trauen sich homosexuelle Paare nicht mehr, Hand in Hand durch die Stadt zu gehen. Diese Leute werden nicht von Deutschen bedroht. Sie werden auch nicht von Polen, Ungarn oder Slowenen bedroht, sondern von Muslimen. Aber das ist das große Tabu, das man hier nicht ansprechen darf. Denn das würde die Frage nach der muslimischen Migration stellen und danach, ob die Gesellschaft durch sie wirklich bunter, besser und liberaler wird.

Die 70er, 80er und 90er Jahre waren für LGBTQI-Leute in Europa sehr viel besser als heute. Der Krebs der Homophobie hat sich erst in den letzten 20 Jahren in Westeuropa wieder ausgebreitet, und die Ursache dieser Metastasierung ist bekannt. Solange Sie das Problem der muslimischen Homophobie totschweigen, hat es auch keinen Sinn, Europa zur LGBTQI Freedom Zone zu erklären.

Już czas, aby cała Unia Europejska stała się strefą praw człowieka, w której każda i każdy jest równy, w której każda i każdy jest chroniony przed dyskryminacją, w której nikt bez względu na swoją orientację seksualną i tożsamość płciową nie jest wykluczany. Strefa wolności dla osób LGBT+ to ważny sygnał, ale to dopiero początek. Za tym muszą pójść konkretne decyzje, i polityczne, i prawne.

Jeżeli musimy zmieniać Traktaty, to zacznijmy je zmieniać. Jeżeli Komisji brakuje kompetencji do ochrony praw człowieka, to zacznijmy te kompetencje zmieniać. Równość małżeńska, prawo do wychowania dzieci, ochrona przed mową i przestępstwami z nienawiści, prawo do decydowania o swojej tożsamości płciowej to muszą być prawa Unii Europejskiej. To prawa każdej Europejki i każdego Europejczyka. Pani Komisarko, zacznijcie działać!

  Nicola Procaccini (ECR). – Signora Presidente, onorevoli colleghi, se il titolo di questa risoluzione fosse stato "Unione europea zona di libertà per le persone di qualunque orientamento sessuale", anziché LGBTIQ, l'avremmo votata favorevolmente anche noi, perché siamo contro qualunque discriminazione.

Ma il vostro obiettivo è un altro, è utilizzare questa risoluzione per attaccare il popolo polacco perché non vota come volete voi, tutto qui. Poi pensate inoltre che il progresso sia creare ogni giorno delle nuove categorie e sottocategorie sessuali, che a scuola si debbano insegnare fiabe dove ci sono principi che baciano altri principi, che si debba legalizzare la pratica odiosa dell'utero in affitto, voi pensate che sia moderno trasformare ogni desiderio in diritti, anche a costo di violare i diritti dei più indifesi, dei bambini.

Per voi questo è il futuro, per noi siete rimasti all'età della pietra, come i Flintstones.

  Malin Björk (The Left). – Madam President, to the racists and haters in this room, I just want to say ‘never in my name’ and ‘not in our name’ will you be able to use LGBTIQ rights against other people, against Muslims or any other European.

Den här resolutionen handlar om hur vi ska ha det i Europa, i våra egna länder, i våra skolor, på våra arbetsplatser och i det offentliga rummet.

Ska mina barn, med vår regnbågsfamilj, kunna känna sig värdefulla? Ska de kunna känna sig välkomna? Eller ska de ses som en avvikelse, något som ska bekämpas?

Ska vi tvinga människor in i garderober, ska vi känna oss rädda och otrygga i det offentliga rummet eller på våra arbetsplatser?

Nej, det är klart att vi inte ska. Mina barn, alla barn, ska känna sig trygga och värdefulla. Alla ska känna sig trygga i det offentliga rummet och på sina arbetsplatser.

Det är det här resolutionen handlar om, inte om att någon ska gå rädd och otrygg. Det här handlar om att skicka en signal om att snarare än hbtq-fria zoner så vill vi ha en frihetzon.

  Isabel Wiseler-Lima (PPE). – Madame la Présidente, il s’agit de la dignité inhérente à chaque être humain. Il s’agit de respect, du respect que nous devons à chaque être humain. Vous n’imaginez pas à quel point il me coûte de parler de personnes LGBTIQ, car si ce sigle existe, c’est parce que des personnes, à cause de leur sexualité, de leur identité, se sont vues exclues, privées de droit et même détruites, tout simplement parce qu’elles sont ce qu’elles sont. Ceci est tout simplement inexcusable.

Nos sociétés d’après-guerre se sont construites sur la volonté de bâtir sur les droits humains et les libertés fondamentales. Singulariser un être humain dans ce qui le définit comme personne dans le but de l’exclure, parfois même de le nier, est tout simplement inacceptable. Et ceci d’ailleurs, que ce soit pour son orientation sexuelle, son identité, sa couleur de peau, une quelconque caractéristique physique, ses croyances, sa nationalité, peu importe. Nous devons protéger ceux qui subissent. Nous devons éduquer ceux qui agissent par ignorance. Nous devons combattre et, si nécessaire, juger et punir ceux qui, en charge de responsabilités sociales ou politiques, agissent contre les personnes LGBTIQ. C’est en ce sens que le Parlement européen a voulu cette résolution, déclarant l’Union européenne un lieu de liberté pour les personnes LGBTIQ. Aujourd’hui, avec la conscience que rien n’est jamais acquis et que tous nos succès en matière de droits de l’homme sont encore et toujours à défendre, j’estime que nous pouvons être fiers de l’Union que nous construisons, les droits que nous affirmons dans cette déclaration pour nous, nos jeunes et nos enfants.

  Sylvie Guillaume (S&D). – Madame la Présidente, mes chers collègues, nous déclarons aujourd’hui que l’Union européenne est une zone de liberté pour les personnes LGBTIQ.

Oui, malheureusement, en 2021, cela ne va pas de soi et c’est consternant. Alors nous n’aurons de cesse de le répéter: les droits des personnes LGBTIQ sont des droits humains et doivent à ce titre être protégés dans toute l’Union. La hausse des discriminations à l’égard des personnes LGBTIQ dans l’Union ne vient pas de nulle part. Elle trouve sa source dans la haine distillée par certains chefs d’État et certains chefs de gouvernement, et ce, au plus haut niveau. Pourquoi alors, avec ce blanc-seing, les citoyens ne se sentiraient-ils pas libres d’insulter ou d’agresser des personnes LGBTIQ? Ce sentiment d’impunité prévaut notamment en Pologne. C’est intolérable. Nous continuerons ici tant que cela sera nécessaire à rappeler que l’Union européenne est un territoire ouvert et sûr.

Je me réjouis que nous ayons désormais les moyens financiers pour faire pression sur des États qui ne respectent pas les droits fondamentaux, alors n’ayons pas la main qui tremble au moment de les utiliser.

  Liesje Schreinemacher (Renew). – Madam President, this month marks the second anniversary of the first Polish LGBTIQ–free zone, and since then, over 100 places in Poland followed; a disgrace on European soil.

It is a sad truth that LGBTIQ people still face discrimination, hatred and violence, not only in Poland but all across Europe. And I can stand here and be very angry about it. And I am.

But that won’t help the transgender woman who is forced to undergo sterilisation to have her gender legally recognised. And that won’t help the gay dad who loses his parental rights when he crosses a European border. And that won’t help the non–binary child who is forced by their parents to undergo conversion therapy in order to become normal.

No, what would actually help these people are real and tangible changes, whether it be through new legislation, better enforcement or infringement procedures. So let’s take concrete action now to protect our people and our values.

The European Union I call my home is an LGBTIQ Freedom Zone.

  Angel Dzhambazki (ECR). – (start of speech off-mic) ... debates an issue which essentially does not exist.

After numerous debates on so-called LGBTI-free zones in Poland, we saw that a lie repeated often enough became the truth. Using this lie, the liberal elites, which are represented by the narrow majority in this House, are now on the offensive.

We are aware that you want to destroy the family as a unit of our societies. We know that you want to impose unnatural and dangerous ideas like the scientific fact that there are only two genders. We know that you want to erase all traces of traditional European and Christian values.

What you should know is that we will not allow it. We do not need to proclaim the EU as an LGBTI Freedom Zone because the European Union is already the safest place on earth for LGBTI people.

What we do need, however, is the European Charter of Family Rights, which will strengthen the legal protection for traditional families and uphold the simple truth: a family consists of a mother, father and their children.

You must know the deviant sexual practices and LGBTIQ ideology can and will open the door to child abuse and paedophilia, and we shall not allow it. Our peoples will stand for traditional European values and will be ready to hold them.

  Στέλιος Κυμπουρόπουλος (PPE). – Κύριε Πρόεδρε, σήμερα συζητάμε ένα σημαντικό κοινωνικό και πολιτικό θέμα για πολλά κράτη μέλη και πολιτικές ομάδες. Για τον λόγο αυτό πολλά κράτη μέλη δεν έχουν λάβει μέτρα για την αντιμετώπιση του νομικού κενού για την προστασία των ανθρώπων από τις διακρίσεις, τη ρητορική μίσους και τη βία λόγω σεξουαλικού προσανατολισμού, ταυτότητας φύλου, ρόλου φύλου και χαρακτηριστικών φύλου. Παρατηρούμε μια οπισθοδρόμηση και επαναφορά σε ακραία συντηρητικές θέσεις σε αρκετά κράτη μέλη με αλλαγές στο νομικό καθεστώς, όπως για παράδειγμα στην Ουκρανία και την Πολωνία. Κυρία Επίτροπε Dalli, πρέπει να προσέξουμε να μην δημιουργήσουμε κοινωνικές αδικίες για κανέναν και να σεβαστούμε τα δικαιώματα όλων των πολιτών, όπως την προώθηση της αποδοχής της μοναδικότητάς τους στον εργασιακό χώρο και την ανεμπόδιστη πρόσβαση των ΛΟΑΤΚΙ ατόμων στην εκπαίδευση, την υγεία, τον πολιτισμό, τον αθλητισμό, τελικά στη ζωή. Αλλά έχουμε πολύ δρόμο μπροστά μας, για να κατανοήσουν όλες οι κοινωνίες των κρατών μελών το δικαίωμα στη διαφορετικότητα και τον αυτοπροσδιορισμό. Τέλος, θα ήθελα να θυμίσω σε όλους μας πως η καταπολέμηση των ανισοτήτων στην Ευρωπαϊκή Ένωση αποτελεί κοινή ευθύνη όλων μας. Απαιτεί κοινές προσπάθειες δίχως πολιτικά χρώματα και δράση σε όλα τα επίπεδα, από το τοπικό μέχρι το ευρωπαϊκό.

Hej wy, tam z prawej strony Parlamentu, zjednoczona – już tylko w nienawiści – prawico. Znacie to? Trzecia dekada XXI wieku. Unia Europejska, Polska i tak zwane strefy wolne od LGBTI, otwarta instytucjonalna dyskryminacja osób nieheteronormatywnych. Wstyd i hańba. Ośmieszajcie Polskę każdego dnia waszych rządów. A my tutaj każdego dnia musimy udowadniać, że Polska to nie PiS. Ja nie jestem ani gejem, ani biseksualistą, ani osobą transpłciową, ale mogę się domyślać, jak to jest być wyzywanym przez prezydenta swojego kraju od bycia ideologią. Mogę sobie wyobrazić, jak to jest być nazwanym przez arcybiskupa, waszego sojusznika w propagandzie, tęczową zarazą. I stoję za wami, moi tęczowi bracia i siostry, murem. Jako człowiek, ale także jako Ślązak. Po śląsku, w moim ojczystym języku, tęcza to danga, bardzo piękne słowo pokazujące także naszą wielokulturowość. Tak samo piękne, jak piękna jest idea integracji europejskiej. I właśnie dziś ogłaszamy Unię Europejską strefą wolności dla wszystkich osób LGBTI. Tutaj wszyscy jesteśmy równi, tutaj wszyscy jesteśmy u siebie i mile widziani.

  Katarina Barley (S&D). – Madam President, we’ve been hearing the narrative of the right and the extreme right today. What we are hearing here is ‘policy for minorities damaging the majority’ and, of course, this is complete nonsense. Respecting the rights of LGBTIQ people does not take anything away from others.

Why do I stand here as a woman happily married to a man and fight for LGBTIQ rights? First, because it is the obligation of every democrat to stand up when anyone’s human rights are being violated. And second, because when minority rights are being violated, democracy is in danger, and we see this everywhere where LGBTIQ rights are being endangered. It is about the independence of the judiciary, the freedom of the press and the rights of the opposition. It is no surprise that it’s especially in Poland and Hungary, among other countries, where we have these issues.

So if we stand for democracy, we have to stand for the rights of minorities, of LGBTIQ people. We have to stand for the EU being an LGBTIQ freedom zone.

  Helena Dalli, Member of the Commission. – Madam President, I would like to thank the minister and the honourable Members for this debate.

The Commission has on several occasions taken a strong stance in favour of equality for all and equality in all of its senses. I look forward to a strong cooperation with the European Parliament and implementation of the LGBTIQ strategy, which will be key to advancing LGBTIQ equality in all Member States.

We have already launched the process towards the presentation of an initiative by the end of this year to extend the list of EU crimes to cover hate crime and hate speech, including when targeted at LGBTIQ people.

The fight against discrimination and the advancement of equality is, and will remain, a priority for the Commission. Thank you for the strong support in building a Union of equality for all, not least for LGBTIQ people.

Let’s make the EU an LGBTIQ Freedom Zone without delay. And may all of us be able to be true to who we are without even thinking twice about it, wherever we are in Europe.

  Ana Paula Zacarias, Presidente em exercício do Conselho. – Senhora Presidente, Senhoras e Senhores Deputados, Senhora Comissária, espero que o Benjamim e todas as crianças possam crescer num ambiente europeu de tolerância e liberdade de serem quem quiserem ser sem discriminação e sem violência.

Já percorremos um longo caminho. Muito já foi conquistado, mas há ainda muito por fazer para garantir a igualdade. E como decisores políticos, para mim é muito claro: temos o dever de promover, de forma vigilante, o pleno respeito pelos direitos das pessoas LGBTIQ em toda a União Europeia. Os direitos das pessoas LGBTIQ, tal como os direitos de todos os cidadãos e cidadãs da União Europeia, são direitos humanos que é preciso respeitar e defender.

  Magdalena Adamowicz (PPE), na piśmie. – Najważniejsze prawo, które jest sensem człowieczeństwa, brzmi jednoznacznie „Wszystkie istoty ludzkie rodzą się wolne i równe w godności i prawach”. To prawo bezwarunkowe – obowiązuje każdego i przysługuje każdemu człowiekowi na świecie. Czy to się różnym Kaczyńskim, Orbanom, Łukaszenkom, Unom i Putinom podoba, czy nie. Czy to sami zadekretują, czy nie. Dlatego wszelkich despotów za łamanie praw człowieka można prędzej czy później osądzić.

Równość kobiet, o którą walczy w Polsce Strajk Kobiet, równość gejów, lesbijek, osób biseksualnych i transpłciowych, to nie są żadne „prawa mniejszości”. To są prawa człowieka. Bo każda z tych osób jest człowiekiem. I żadna większość nie może tych praw ani przyznać, ani tym bardziej odebrać. Są one przyrodzone i niezbywalne. Strefa wolna od jakiejkolwiek ludzkiej istoty to strefa wolna od człowieczeństwa. A więc to strefa bestialstwa, strefa końca ludzkiej cywilizacji. Koniec z proszeniem o równe traktowanie kobiet czy osób LGBTQI, bo nikt – żaden Czarnek, żaden Duda tego świata – nie ma prawa decydować, kto jest, a kto nie jest człowiekiem.

Koniec z proszeniem o tolerancję dla osób nieheteronormatywnych, bo skoro proszę, to znaczy, że ktoś ma prawo odmówić tolerowania innego człowieka. Najwyższy czas, aby równego i godnego traktowania każdej ludzkiej istoty twardo wymagać.

  Joachim Stanisław Brudziński (ECR), na piśmie. – UE opiera się na wartościach poszanowania godności osoby ludzkiej i równości, a wartości te są wspólne państwom członkowskim (art. 2 TUE). Ten fundament zobowiązuje instytucje unijne „do zwalczania wszelkiej dyskryminacji, również ze względu na orientację seksualną” (art. 10 TFEU).

Pragnę podkreślić fakt, że szczególna ochrona rodziny opartej na związku małżeńskim kobiety i mężczyzny jest gwarantowana przez Polską Konstytucję (art. 18), a Unia, w zapisach Traktatów „szanuje równość państw członkowskich wobec Traktatów, jak również ich tożsamość narodową, nierozerwalnie związaną z ich podstawowymi strukturami politycznymi i konstytucyjnymi, w tym w odniesieniu do samorządu regionalnego i lokalnego” (art. 4 ust. 2 TUE). Wszystkie państwa członkowskie zostały zobowiązane prawem międzynarodowym do ochrony rodziny. „Rodzina jest naturalną i podstawową komórką społeczeństwa i ma prawo do ochrony ze strony społeczeństwa i Państwa” (art. 23 ust. 1 Międzynarodowego Paktu Praw Obywatelskich i Politycznych). Realizacja tego zobowiązania powinna być wspierana. Unia Europejska nie posiada wyłącznej kompetencji w zakresie spraw rodzinnych, a w myśl traktatowej zasady pomocniczości to właśnie szczebel lokalny, najbliższy obywatelowi i rodzinom, jest właściwy, aby wspierać rodziny.

Polska przywiązuje wagę do konstytucyjnej zasady równego traktowania, która mówi, że wszyscy są równi wobec prawa, a wszystkie grupy zagrożone wykluczeniem powinny być traktowane na równi bez żadnego wyjątku.

  Tanja Fajon (S&D), pisno. – Namesto napredka smo v Evropski uniji spet vse pogosteje priča krčenju pravic LGBTIQ oseb in njihovi sistematični diskriminaciji. Na žalost so manjšine vse prevečkrat zlorabljene za razpihovanje sovraštva, širjenje nestrpnosti in kot sredstvo političnega boja.

Spet smo na polju, kjer namesto o zaščiti manjšin večina odloča o njihovem zatiranju. Kjer demokraciji spet spodleti. Kot da se nismo iz zgodovine ničesar naučili. Čas je, da resnično naredimo korak naprej. V Evropi ni prostora za nasilje, diskriminacijo, ustrahovanje in nestrpnost. Naredimo prostor za solidarnost, pravičnost in vzajemno spoštovanje, ne glede na to, kdo smo in koga ljubimo.

Vsi smo enako rojeni v isti svet, in vsi bi morali uživati enake in neodtujljive pravice in svoboščine. Skrajni čas je, da presežemo delitev na nas in vas. Ker nas različnost bogati. V Evropi smo združeni v različnosti in zato močnejši. Pravice "mavričnih" oseb so človekove pravice. Boj proti neenakosti skupin je boj vseh nas, na vseh ravneh. Ker je ljubezen – ljubezen. Ker smo vsi ljudje. Zato močno podpiram sprejetje resolucije Evropskega parlamenta za razglasitev Evropske unije kot svobodnega območja za osebe LGBTIQ. Združeni v različnosti!

  Eider Gardiazabal Rubial (S&D), por escrito. – En Polonia, desde marzo de 2019, más de cien regiones, distritos y municipios de todo el país han adoptado resoluciones por las que se declaran «zonas libres de ideología LGTB» o han adoptado «cartas regionales de los derechos de la familia» expresando, así, su oposición a la «ideología del movimiento LGTB» y pidiendo a los Gobiernos locales que se abstengan de toda acción que pueda fomentar la tolerancia hacia las personas LGBTIQ discriminando, por tanto, a este colectivo tanto de forma directa como indirecta.

Por su parte, el Parlamento Europeo ha expresado su posición en varias de sus Resoluciones sobre la situación del Estado de Derecho, los derechos fundamentales y la democracia en Polonia, denunciando la amenaza sistémica a los valores de la Unión, así como el deterioro de la situación respecto de los derechos de las mujeres y el colectivo LGTBIQ.

Considerando que la UE debe proteger y promover la igualdad y los derechos fundamentales de todas las personas, incluidas las de este colectivo, se declara a la Unión Europea como una «zona de libertad para las personas LGBTIQ».

  Michaela Šojdrová (PPE), písemně. – Nemohla jsem podpořit usnesení o prohlášení EU za zónu svobody pro LGBTIQ osoby. Ne však proto, že bych odepírala základní práva jakékoliv skupině či menšině na území EU. Zásadně odmítám diskriminaci a útlak menšin na základě rasy, pohlaví, sexuální orientace či náboženství. Evropská unie nepotřebuje vyhlašovat zóny svobody pro LGBTIQ, protože všechny osoby jsou v rámci Evropské unie již chráněny Listinou základních práv EU, Všeobecnou deklarací lidských práv, ale také judikaturou Evropského soudního dvora. Zmíněné usnesení však značně zasahuje do pravomocí členských států a nerespektuje dodržování principu subsidiarity. Interní věci by měly být ponechané na řešení národním vládám. Musíme se zasadit za to, aby se všechny osoby na území EU cítily bezpečně a byla dodržována jejich lidská práva. Myslím si, že by Parlament neměl ukazovat, že nevěří členským státům, že jsou schopné dodržovat lidská práva a udělat si pořádek. Je na občanech Polska, aby se za plnění lidských práv postavili.

  Tom Vandenkendelaere (PPE), schriftelijk. – In Polen zien we zorgwekkende ontwikkelingen. Sinds maart 2019 zijn er meer dan 100 steden en gemeenten die zichzelf bestemmen als plaatsen ‘vrij van LGBTIQ-ideologie’. Lokale overheden worden opgeroepen om LGBTIQ-personen te discrimineren en LGBTIQ-acties te boycotten. LGBTIQ-vrije zones zijn een schande en een regelrechte aanval op de fundamentele rechten van de mens. De Europese samenleving is gebaseerd op gelijke kansen, non-discriminatie en respect voor de rechten van alle burgers. Vandaag stuurt het Europees Parlement het krachtige signaal aan alle LGBTIQ-personen in de EU dat ze kunnen zijn wie ze zijn, waar dan ook in de EU, door de volledige Europese Unie als vrijheidszone voor LGBTIQ-personen te bestemmen. De manier waarop we geboren worden, kent geen ideologisch fundament. Dat is de natuur. Dat is biologie. We leven in het jaar 2021, er zouden geen haat en discriminatie meer mogen zijn. Op grond van huidskleur. Van gender. Van seksuele geaardheid. Ik zal de rechten van LGBTIQ-personen blijven verdedigen tegen degenen die hen aanvallen vanuit ideologisch onverdedigbare standpunten. De Europese Unie staat voor gelijkheid, een plaats in de wereld waar iedereen dezelfde vrijheden en rechten geniet, ongeacht hoe we geboren worden.
