  Domènec Ruiz Devesa, autor. – Señora presidenta, señora secretaria de Estado Zacarias, señor comisario Schmit, la verdad, pensaba que iba a venir el señor Šefčovič, pero, bueno, usted nos vale también. Usted nos vale también. Tiene usted distintas responsabilidades y, desde luego, admiro mucho su trabajo como comisario de Empleo y su compromiso con el pilar social y su incorporación al Tratado, al igual que también el compromiso de la Presidencia portuguesa con la Cumbre Social.

En cuanto al punto que nos ocupa hoy —el derecho de investigación del Parlamento Europeo—, como sabemos todos, el marco actual es un marco que podríamos considerar relativamente anticuado. Es un acuerdo interinstitucional del año 1995, por tanto, muy anterior al Tratado de Lisboa, y, ciertamente, es el Tratado de Funcionamiento de la Unión Europea, en su artículo 226, el que establece una base jurídica para las comisiones de investigación del Parlamento Europeo y le otorga al Parlamento la iniciativa. Señala, en su último párrafo, que el Parlamento Europeo determinará las modalidades de ejercicio del derecho de investigación mediante reglamentos adoptados por propia iniciativa, previa aprobación del Consejo y de la Comisión. En el año 2014, el Parlamento Europeo aprueba una propuesta de Reglamento, conocida como «informe Martin», sobre el ejercicio del derecho de investigación del Parlamento Europeo, que es un derecho que consideramos muy importante en el marco de una democracia europea reforzada, al igual que un derecho de iniciativa legislativa también reforzado por parte del Parlamento Europeo. O eventualmente también a la luz del Plan de Recuperación de la UE, se propone una mayor codecisión del Parlamento asimismo en los asuntos fiscales y de emisión de deuda.

Pero en este informe se establecía lo que parece de alguna manera normal si atendemos al Derecho comparado, a cómo funcionan las comisiones de investigación en la mayoría de los Parlamentos nacionales: establecía la capacidad de disponer con carácter obligatorio que aquellos llamados a comparecer tuvieran que hacerlo, la capacidad de realizar visitas en los Estados miembros en el marco de la investigación que se estuviera conduciendo, el derecho también de acceso a la documentación relevante, y también un marco de sanciones en el caso de que alguna de estas obligaciones, concretamente la de comparecer por parte de personas físicas, se viera incumplida.

Desafortunadamente, desde el año 2014 —ya han pasado muchos años, siete años— nos encontramos con que el Consejo hasta el día de hoy rechaza abrir una negociación formal con el Parlamento Europeo, porque muchos de estos elementos, si no todos los que he citado, hasta seis o siete, son considerados líneas rojas por el Consejo que deben ser levantadas y retiradas del informe antes de abrir un proceso de negociación.

Obviamente, desde nuestra posición nos parece que no se estaría en este caso actuando de acuerdo con un principio de cooperación leal y de buena fe con el Parlamento. Me sabe mal decirlo, pero es así como lo entendemos. Y, en cualquier caso, yo creo que también hay que tener muy presente en este contexto que el Parlamento Europeo lo que tampoco puede hacer es ir hacia atrás, es decir, mantener el marco de una supresión, de una amputación —digamos— general e indiscriminada, y además fuera de un marco de negociación del informe citado, lo que conduciría a una situación en la que estaríamos igual que en el año 1995.

Yo creo que esto es importante que se entienda por parte del Consejo. Yo creo que ha pasado demasiado tiempo y conviene encontrar la manera de acercar posiciones, de, por lo menos, abrir un diálogo más sustantivo sobre el fondo y ver cuáles de esas objeciones pueden encontrar algún tipo de articulación.

  Ana Paula Zacarias, President-in-Office of the Council. – Madam President, thank you for the opportunity to discuss the important issue of Parliament’s inquiry powers and to take stock of the recent development. Let me start by assuring you that the Council shares the view that committees of inquiry are important instruments. They allow the European Parliament to exercise its political control in our Union, founded on the values of respect for democracy and the rule of law, as required by the Treaty. The Council is therefore well aware that this legally complex and politically sensitive dossier is of great interest for the European Parliament. The Parliament is also aware, for its part, of the Council’s serious legal and political concerns on a number of key provisions of this proposal. I understand many of these concerns are also shared by the Commission.

Since the Martin report in 2011, the Council has been examining a series of proposals in a constructive spirit and in respect for the duty of sincere cooperation. However, as it is well known, serious legal and institutional concerns persist, in particular regarding the limits imposed by Article 226 of the Treaty, and there are questions about whether the European Parliament’s committees of inquiry should be instruments of political control or have quasi-judicial powers.

Indeed, this first proposal foresaw a far-reaching extension of the rights of the committees of inquiry that was considered to go beyond Article 226. Despite subsequent discussions, including between the three legal services, some progress was made on some less problematic provisions, but not on the most complex issues of a legal and political nature.

As you know, in its letter of 25 October 2018, the Council welcomed a non-paper prepared by Mr Jáuregui Atondo, who was the rapporteur on the file at the time, as a new attempt to revive the political dialogue amongst the three institutions. In this letter, the Council again expressed its concerns regarding the proposal.

In October 2020, the Presidency took due note of Parliament’s renewed wish to resume the political dialogue, as outlined in a new letter by Chair Tajani and rapporteur Ruiz Devesa. This letter was carefully examined by the Council, and some progress was indeed made on Parliament’s side towards meeting some of the concerns expressed by the Council. I can only welcome such a constructive approach. However, our assessment is that the majority of the legal and political concerns of the Council have not yet been addressed. Therefore, I can only restate the Council’s position on these important issues, as expressed in our letter of October 2018.

I assure you that the Council continues to be open to a constructive dialogue with the European Parliament in order to explore ways forward, as I had the opportunity to convey to the Members of the Committee on Constitutional Affairs at the beginning of our presidency. Today, I also had the opportunity to meet rapporteur Ruiz Devesa ahead of this debate and I reiterated our availability in this sense. We had a very open and frank discussion, and I want to thank the rapporteur for that possibility of dialogue.

I reiterated that should Parliament wish to carry on the work based on the efforts made so far and show willingness to reconsider its approach on most of the controversial issues, the Council stands ready to examine it further in full respect of the duty of sincere cooperation.

  Nicolas Schmit, Member of the Commission. – Madam President, I would like to underline once more that the Commission recognises the importance of the Parliament’s right of inquiry. However, this is without prejudice to the powers conferred by the Treaties to the other institutions. While it is for the Parliament to make a proposal, the procedure also requires the consent of the Council and of the Commission.

In 2012, the European Parliament adopted its proposal to revise the decision currently governing the exercise of the Parliament’s right of inquiry. Since then, regrettably, there has been little progress on this file. The Commission takes note that, under the current parliamentary legislature, the European Parliament decided to resume the negotiations based on the non—paper politically endorsed by the Parliament’s Committee on Constitutional Affairs in April 2018.

In the previous primary debate on this topic on 17 April 2019, the Commission welcomed that the 2018 non—paper was drafted in more precise legal terms and it included several improvements. We had, however, also pointed out that, despite this progress, the non—paper did not address all the Commission’s substantial legal and institutional concerns. With a view to finding appropriate solutions to the divergences that still exist between the institutions, I would like to stress once more the Commission’s continued willingness and commitment to engage in a constructive trilateral discussion.

As Vice—President Šefčovič – whom I have the honour to represent tonight – stated on several occasions in his structured dialogues with the Committee on Constitutional Affairs in 2020 and 2021, in order to make progress on this file, all three institutions need to adapt a solution—oriented attitude. The future regulation on the right of inquiry should provide the European Parliament with the appropriate instrument, while fully respecting institutional prerogatives and the relevant legal frameworks of Member States.

  Rainer Wieland, im Namen der PPE-Fraktion. – Frau Präsidentin, Frau Ministerin, Herr Kommissar, liebe Kolleginnen und Kollegen! Wenn man sich den Fall anschaut, könnte man neudeutsch fast sagen: „Dramedy“. Aber die Sache ist zu ernst. Es handelt sich um ein formidables Trauerspiel, das wir besichtigen, und zudem ein Trauerspiel, das die zweifellos vorhandene Intelligenz der meisten Beteiligten beleidigt.

Wir gehen ins zehnte Jahr, das zehnte Jahr ist fast voll. Wenn ich die Formulierungen höre, dann glaube ich, dass ich in der falschen Veranstaltung bin. Wichtiges Instrument – wir sind uns bewusst – komplex – heikel – Sorge beim Rat über einige Schlüsselbereiche – wir begrüßen den konstruktiven Ansatz des Parlaments – wichtige institutionelle, rechtliche, politische Kontrolle: alles heute gesagt. Ambitionierter, vielleicht zu ambitionierter Ansatz des Parlaments, die Rechtsdienste... Und jetzt wurde ein Brief geschrieben, dass man die Fortschritte begrüßt, es wurde erneut gesagt, dass der konstruktive Ansatz begrüßt wird.

Aber darum geht es gar nicht. Es geht hier darum, dass man zum – wenn ich richtig zähle – dritten Mal einen Berichterstatter hier im Haus am ausgestreckten Arm verhungern lässt. Man lässt ihn ins Leere laufen – kalt lächelnd. Es geht auch nicht um die Ratspräsidentschaft. Der Rat lässt auch zum wiederholten Male, zum zwanzigsten Male, eine Ratspräsidentschaft kalt lächelnd ins Leere laufen. Ich erwarte, dass wir beim nächsten Mal, wenn wir hier sitzen, mit dem Ratspräsidenten über diese Frage sprechen. Endlich ist mal der Ratspräsident gefragt, und nicht mehr in der Versicherung der vollen Achtung der Zusammenarbeit. Es geht nicht darum, begeistert Ja zu sagen. Es geht nicht darum, hart zu verhandeln, sondern wir unterhalten uns hier darüber, ob der Rat bereit ist, informell zu sprechen. Deshalb, meine Damen und Herren: Es ist eine Frage der Ehre, was man von sich selber hält, was man vom Berichterstatter, vom Parlamentarismus und von den Verträgen hält.

  Gabriele Bischoff, im Namen der S&D-Fraktion. – Frau Präsidentin, werte Ministerin, werter Kommissar! In der Tat, wir wissen es: Europas Bürgerinnen und Bürger wünschen sich mehr Demokratie. Und die fragen sich manchmal, warum das so elend langsam geht mit Fortschritten in Sachen Demokratisierung. Ich glaube, dass das hier ein gutes Fallbeispiel dafür ist, um die Ursachen zu illustrieren, dass eben das Untersuchungsrecht des Parlaments seit Ewigkeiten auf Eis gelegt ist. Dabei gehört es wirklich zu den wichtigsten und ältesten Rechten, über die Parlamente in allen demokratischen Staaten verfügen.

Es ist eben tatsächlich wichtig, dass man Untersuchungsausschüsse einsetzen kann, um Verstöße und Missstände bei der Anwendung des Unionsrechts aufzudecken. Dafür muss man sie unter die Lupe nehmen können. Es ist wichtig, dass auch dieses Parlament das umfassend kann, und Sie als portugiesische Ratspräsidentschaft wissen, dass der Lissabon-Vertrag hier Fortschritte gebracht hat, dass wir aber gleichzeitig diese Fortschritte überhaupt nicht umsetzen können und dass – das ist schon gesagt worden – dieses Dossier seit der vorletzten Legislaturperiode blockiert wird.

Und von wem wird es blockiert? Von dem Rat? Von der Institution, die eben auch demokratisch kontrolliert werden soll. Deshalb ist es wichtig, dass diese Blockade aufgehoben wird. Das ist in der Tat so, dass warme Worte hier nicht helfen, weil der Rat sich weigert, nach Lösungen zu suchen, weil der Rat eisern mauert und weil das gesamte Verfahren so seit Ewigkeiten auf Eis liegt. Und es bedeutet auch, dass man noch nicht einmal mehr das Gespräch sucht. Ich will hier ganz deutlich sagen: Das schwächt die Demokratien der Union, ist nicht im Sinne der EU-Verträge, nicht im Sinne unserer Bürgerinnen und Bürger, nicht mit dem demokratischen Kontrollrecht des Parlaments vereinbar und wirklich ein Rückschlag für die Demokratie, für die Transparenz in der Europäischen Union. Deshalb ist es Zeit, mehr Demokratie zu wagen, und zwar jetzt und nicht erst am Sankt-Nimmerleins-Tag.

  Maite Pagazaurtundúa, en nombre del Grupo Renew.(inicio de la intervención fuera de micrófono) ... desde la Comisión de Asuntos Constitucionales intentando que el Consejo acepte el desarrollo de las capacidades que los Tratados reconocen al Parlamento y nadie puede dudar de que hemos trabajado de forma diligente y paciente, pero ¿qué nos hemos encontrado por la parte del Consejo y de la Comisión? Solo la falta de cooperación.

Nos hemos encontrado palabras para esconder un bloqueo intolerable. Se dice en mi país: «ni una sola palabra, ni una buena acción». Y eso nos hemos encontrado: ni una mala palabra, ni una buena acción. Y lamento decirlo, y no es exagerado decirlo.

La Comisión y el Consejo deben aprobar las propuestas que les presentemos, pero para llegar a ello debe iniciarse un diálogo institucional que permita llegar a un consenso y lo que hay hoy día es una negativa a dialogar. Comisión y Consejo están utilizando una argucia, muy poco jurídica en realidad, para evitar que esa aprobación llegue a producirse algún día.

La actitud del Consejo y la Comisión pidiendo al Parlamento que les presente un texto que puedan aprobar directamente —dicen—, sin abrirse al diálogo institucional, choca con la actitud mantenida para abordar la reforma del Estatuto del Defensor del Pueblo Europeo, que precisamente vamos a votar esta semana. Para eso han querido dialogar y hemos logrado un acuerdo. ¿Qué impide al Consejo hacer lo mismo sobre el derecho de investigación del Parlamento?

No podrán argumentar que somos irresponsables en el uso de la competencia. Esta Cámara ha demostrado rigor y grandes consensos, buscando proteger el interés común.

Lo hemos demostrado en la Comisión Temporal de Investigación sobre la EEB (Encefalopatía Espongiforme Bovina), que conocimos como de la «enfermedad de las vacas locas»; en la Comisión de Investigación Encargada de Examinar las Alegaciones de Infracción y de Mala Administración en la Aplicación del Derecho de la Unión en relación con el Blanqueo de Capitales y la Elusión y la Evasión Fiscales, que conocimos como de los «papeles de Panamá»; o en la Comisión de Investigación sobre la Medición de las Emisiones en el Sector del Automóvil. Con más competencias nuestro trabajo habría sido más útil para los europeos.

La Comisión de Asuntos Constitucionales aprobó su primer informe —el informe Martin— el 14 de octubre de 2011. O sea, llevamos casi diez años y no hemos conseguido nada. No nos queda otro remedio que incidir en el porqué de la perseverancia en el bloqueo del Consejo mandato tras mandato.

El Parlamento es la única institución de representación directa de la Unión que les reclama algo tan básico como que una comisión de investigación pueda convocar a cargos públicos y, si no aportan motivos razonables para comparecer, poder poner algún tipo de sanción. Y no hay justificación para negarse bajo estrictas garantías.

Hemos demostrado que el Parlamento es riguroso ejerciendo su trabajo. Por tanto, comparto las palabras del señor Devesa: hemos agotado la paciencia... (la presidenta retira la palabra a la oradora).

  Daniel Freund, im Namen der Verts/ALE-Fraktion. – Frau Präsidentin, liebe Kolleginnen und Kollegen! Untersuchungsausschüsse sind eines der wichtigsten Werkzeuge eines jeden Parlaments, denn ein Parlament soll ja Regierungshandeln, Verwaltungshandeln kontrollieren und aufklären, wenn irgendetwas schiefläuft. In Deutschland sind Untersuchungsausschüsse oft das, was von der Öffentlichkeit am meisten wahrgenommen wird in der parlamentarischen Arbeit, ob bei Wirecard oder bei der Maut. Und so unangenehm es für die betroffenen Minister oder auch für die Bundeskanzlerin ist, so essentiell ist eben dieses zur Verantwortung Ziehen für unsere Demokratie.

Natürlich gibt es auch im politischen Arbeiten der Europäischen Union Sachen, die vor einen Untersuchungsausschuss gehören. Obwohl es im Vertrag steht, hat das Europäische Parlament immer noch nicht das Recht, Beamte, Kommissarinnen und Kommissare vorzuladen, vertrauliche Dokumente zu prüfen. Wir warten – wir haben es heute Abend schon mehrfach gehört – seit über einem Jahrzehnt.

Dem Europäischen Parlament der EU fehlt eines der wichtigsten Werkzeuge politischer Verantwortung, und die Regierungen im Rat – Sie, Frau Zacarias – wollen noch nicht einmal mit uns darüber verhandeln. Sie wollen sich Ihrer politischen Verantwortung gegenüber allen Europäerinnen und Europäern nicht stellen. Denn Sie – die Ratspräsidentschaft, der Rat insgesamt – sollen ja nicht nur dem portugiesischen Parlament gegenüber verantwortlich sein, sondern diesem Haus, von allen Europäerinnen und Europäern gewählt. So unangenehm ein wirkliches Untersuchungsrecht im Einzelfall sein mag, so wichtig ist es für die Demokratie, und solange wir uns dagegen weiter sträuben, brauchen wir uns nicht wundern, wenn die Bürgerinnen und Bürger weiter den Eindruck haben, dass sich Rat und Kommission ihrer politischen Verantwortung nicht vollumfänglich stellen wollen.

  Gilles Lebreton, au nom du groupe ID. –. Madame la Présidente, chers collègues, le Parlement européen doit-il bénéficier d’un droit d’enquête autonome sur le modèle du droit d’enquête qu’exercent les parlements nationaux des États membres de l’Union? La réponse dépend de la conception que l’on se fait du Parlement européen.

Si on estime, d’un point de vue purement institutionnel, qu’il faut calquer les pouvoirs du Parlement européen sur ceux des parlements nationaux, alors la réponse ne peut qu’être affirmative. C’est la position exprimée par la majorité du Parlement européen dans sa résolution du 18 avril 2019 et réitérée par les auteurs de la question orale dont nous débattons aujourd’hui.

Si, au contraire, on prend en compte le manque de légitimité démocratique de l’Union européenne, alors la réponse doit être négative. C’est la position du Conseil et c’est ma position. Il n’existe aucun peuple européen au-dessus des nations européennes. Dès lors, le Parlement européen ne représente qu’un souverain fictif et ne peut prétendre se voir attribuer des pouvoirs de contrôle démocratiques qui n’appartiennent qu’à des parlements nationaux représentant de vrais peuples.

Le Parlement européen dispose déjà d’un droit d’enquête limité prévu par l’article 226 du TFUE et dont l’exercice est soumis à l’approbation du Conseil. C’est déjà beaucoup. Qu’il s’en contente, au lieu de tenter d’accentuer la dérive fédérale de l’Union.

  Joachim Stanisław Brudziński, w imieniu grupy ECR. – Pani Przewodnicząca! Traktat Lizboński zmienił procedurę dotyczącą określenia postanowień regulujących wykonywanie uprawnień śledczych. Artykuł 226 Traktatu stanowi, że szczegółowe postanowienia dotyczące wykonywania uprawnień śledczych określa Parlament Europejski, stanowiąc w drodze rozporządzeń z własnej inicjatywy zgodnie ze specjalną procedurą ustawodawczą po uzyskaniu zgody Rady i Komisji.

Warto tutaj przypomnieć, że Rada i Komisja zwracały uwagę, że do istoty uprawnień śledczych Parlamentu należy zastosowanie środków związanych z odpowiedzialnością polityczną, nie zaś sądową, a funkcja kontrolna Parlamentu Europejskiego musi być wykonywana w ramach ogólnie przyjętych ram i funkcji, jakie nadają mu Traktaty. Dlatego należy respektować prawo Parlamentu Europejskiego do sprawowania kontroli politycznej w Unii Europejskiej i wykonywania przez Parlament uprawnień śledczych zgodnie z artykułem 226 Traktatu, ale przy zachowaniu równowagi międzyinstytucjonalnej oraz poszanowaniu kompetencji państw członkowskich oraz innych instytucji Unii Europejskiej.

Clue całej tej sprawy zawarte jest w tym ostatnim zdaniu „z poszanowaniem kompetencji państw członkowskich”, państw narodowych. Ten fenomen, jakim jest Unia Europejska, ten fenomen, jakim jest również Parlament Europejski, jako parlamentarzysta europejski, jako Europejczyk, jako Polak, jako obywatel jestem dumny, że zasiadam w tej izbie, ale przez myśl mi nie przechodzi, aby przypisywać sobie kompetencje, jakie lewa strona sali próbuje czasami nam narzucać.

Mówicie państwo wiele o demokracji, o poszanowaniu woli wyborców. To ja wam podam jeden przykład. Była premier polskiego rządu, dzisiaj europosłanka, pani Beata Szydło uzyskała ponad pół miliona głosów. Co Państwo zrobili? Odrzuciliście te pół miliona głosów, nie wybierając jej, nie udzielając jej akceptacji jako przewodniczącej jednej z wielu komisji w Parlamencie Europejskim. Przedstawiciel Prawa i Sprawiedliwości, przedstawiciel EKR znakomity socjolog pan profesor Krasnodębski nie został waszymi głosami wiceprzewodniczącym Parlamentu Europejskiego (...).

  Helmut Scholz, im Namen der Fraktion The Left. – Frau Präsidentin, Frau Ministerin, Herr Kommissar! Das umfassende Recht auf Kontrolle gehört zu den zentralen Aufgaben eines jeden Parlaments. Dieses Recht verweigern die EU-Staats- und Regierungschefs dem Europäischen Parlament seit einem Jahrzehnt.

Es ist nicht nur höchste Zeit, nein, es ist überfällig, die Mängel zu beheben, die sich im Zuge bisheriger Untersuchungen ergeben haben. Nur so können Untersuchungsausschüsse auch ein wichtiges Kontrollinstrument gegenüber der EU-Exekutive sein. Nur so können wir in Zukunft garantieren, dass nationale und EU-Behörden den Zugang zu relevanten Informationen und andere Sachfragen des täglichen Alltags in der Europäischen Union nicht verweigern.

Zudem müssen wir dringend festlegen, wie vertrauliche Informationen zu behandeln sind. Die bereits seit 2014 andauernden Reformdiskussionen, bei denen der Rat seit Jahren den Fortschritt blockiert, müssen endlich konstruktiv abgeschlossen werden, um die Regeln in Einklang mit dem bestehenden Recht zu bringen. Welche Angst treibt eigentlich den Rat um? Die Angst vor den direkt gewählten Abgeordneten, Missstände eventuell zu hinterfragen? Deshalb fordere ich Sie, Frau Zacarias, ich fordere die slowenische Ratspräsidentschaft und den Rat insgesamt auf: Lassen Sie uns endlich in den konstruktiven Dialog treten, um zu einer Einigung zu gelangen! Lassen Sie uns das Vertrauen der Bürgerinnen und Bürger in europäische Demokratie nicht weiter aushöhlen!

  Sven Simon (PPE). – Frau Präsidentin, meine sehr geehrten Damen und Herren, liebe Kolleginnen und Kollegen! Die Debatte hat schon teilweise absurde Züge. Vielleicht ist die Einrichtung eines Untersuchungsausschusses nicht das älteste Recht eines Parlaments, wie die Frau Kollegin von S&D gesagt hat. Aber es ist zumindest ein Recht, das das Europäische Parlament nach Artikel 226 seit dem Vertrag von Lissabon innehat. Und deshalb ist – gelinde gesagt, ist hier ausgedrückt worden – mangelnde Organtreue vom Rat natürlich wirklich mehr als unanständig – und das ist jetzt eher schon parlamentarisch freundlich ausgedrückt –, da Sie noch nicht einmal bereit sind, überhaupt auch nur in informelle Gespräche einzutreten.

Wir sollten mal darüber nachdenken, ob man vielleicht nicht eine Untätigkeitsklage an dieser Stelle einrichten kann. Da sind wir bei einem anderen Thema, das ist die Frage der Rechtsstaatlichkeit, denn darum geht es ja eigentlich. Da nimmt es jetzt wirklich absurde Züge an, was die rechte Seite dieses Hauses vorgetragen hat. Sie behaupten also, die Forderungen des Europäischen Parlaments seien jenseits der Kompetenzen, ultra vires, jenseits der Verträge. Ja, dafür haben wir den Europäischen Gerichtshof in Luxemburg. Das könnten wir überprüfen lassen.

Deshalb ist es in der Tat so, dass sich der Rat bewegen muss, denn das Untersuchungsrecht ist ein Recht, ein politisches Recht der Glaubwürdigkeit, und am glaubwürdigsten sind wir allerdings dann, wenn wir uns auch selbst an Rechtsstaatlichkeit halten. Auch da müssen wir teilweise ein bisschen über uns selbst reflektieren, denn auch in diesem Haus wird zu oft gegen rechtsstaatliche Prinzipien verstoßen, die Geschäftsordnung wird zu häufig gedehnt, nach links und rechts, in alle möglichen Richtungen. Ich denke auch zum Beispiel daran, wenn der Präsident sich recht freizügig politisch äußert. Auch das gehört natürlich dazu, aber insgesamt möchte ich wirklich an Sie appellieren: Seit zwölf Jahren – Vertrag von Lissabon – gibt es jetzt dieses Recht, und jetzt bewegen Sie sich bitte ein bisschen. Sie könnten stolz auf Ihre Ratspräsidentschaft sein, wenn es ausgerechnet jetzt zu einem Erfolg und Abschluss kommt.

  Carmen Avram (S&D). – Domnule președinte, dreptul Parlamentului European de a conduce investigații este mai mult decât o prerogativă a acestei instituții în care ne aflăm și, mai mult chiar, decât dreptul meu de a mă exprima acum pe acest subiect. Este, de fapt, dreptul la informație al celor 450 de milioane de europeni care și-au dat votul direct pentru acest Parlament, iar o lipsă de comunicare între Parlament și Consiliu nu trebuie decontată pe seama cetățenilor. Prin urmare, după șapte ani de blocaj, consider urgentă reluarea discuțiilor pe acest subiect și găsirea unui compromis ferm pentru că, în caz contrar, eșecul nu va fi doar al uneia dintre aceste instituții, ci al Uniunii Europene per ansamblu, al societății noastre și al valorilor europene. Cu toate acestea, consider că, odată cu dreptul la investigație, Parlamentul European trebuie să își stabilească și responsabilitățile, adică să definească foarte clar modul în care trebuie conduse aceste anchete pentru că, fără un echilibru absolut între drepturi și responsabilități, limitele riscă să fie încălcate, iar când se întâmplă acest lucru, apare și tentația de a abuza o putere vremelnică. Ca fost jurnalist, știu că scopul nu scuză mijloacele, dacă asta înseamnă încălcarea adevărului și ignorarea faptelor, iar abuzul de putere nu înseamnă investigație și viceversa: datoria noastră supremă este față de cei care ne-au trimis să-i reprezentăm în Parlamentul European și lor le datorăm nu numai adevărul, dar și o înțelegere clară a realității lor și, mai ales, soluții adaptate la această realitate.

  Vlad Gheorghe (Renew). – Doamna președintă, cetățenii europeni aleg parlamentari europeni. Cetățenii europeni ne dau sarcina de a-i reprezenta și ne obligă să ne exercităm mandatul cu bună credință, servindu-le interesele. Cetățenii europeni învestesc Parlamentul European cu încrederea lor și pentru asta au dreptul ca noi să veghem la bunul mers al Uniunii și la cheltuirea corectă a banilor din bugetul Uniunii Europene.

Dreptul de anchetă al legislativului față de executiv este firesc în absolut orice stat membru, ține de principiile statului de drept și contribuie la justa separație a puterilor. Același este rolul dreptului de anchetă al Parlamentului European la nivelul Uniunii Europene, dar modul în care a fost stabilit în 1995 nu mai corespunde realităților europene. Este insuficient și ineficient.

În 2014, atât Parlamentul cât și Consiliul și Comisia și-au exprimat voința instituțională și politică să avem un nou text juridic în acest sens. În 2019, după cinci ani, s-a reluat această procedură. Suntem în 2021. Traversăm o pandemie și, pentru următorii ani, avem cel mai mare buget cumulat pus vreodată la bătaie de Uniunea Europeană.

Cu toate acestea, în ce privește dreptul de anchetă al Parlamentului European, ne aflăm în fața unui blocaj. Discutăm despre condiționarea fondurilor europene de respectarea statului de drept în țările Uniunii. Dar ce se întâmplă în instituțiile europene? Consiliul, Comisia, Parlamentul trebuie să fie exemple de transparență, devotate în totalitate principiilor și valorilor europene.

De aceea, este nevoie de un cadru juridic adecvat pentru punerea neîngrădită în aplicare a dreptului de anchetă al Parlamentului. Acesta reprezintă piatra de temelie a democrației și se bazează pe legitimitatea dată parlamentarilor de votul cetățenilor europeni. În numele lor și în litera și spiritul tratatelor Uniunii, solicit Comisiei și Consiliului să accepte urgent cererea Parlamentului pentru un mecanism de anchetă eficient. Orice bucățică de legislație europeană trebuie protejată, iar prin dreptul de anchetă ne asigurăm că facem asta.

  Tilly Metz (Verts/ALE). – Madam President, this is not just a theoretical debate. The lack of a clear legal framework for our right of inquiry has very concrete consequences. As Chair of the Parliament’s Committee of Inquiry on the Protection of Animals during Transport, I have first-hand experience of this.

The committee I chair does not want to blame other institutions; we want to help uncover current issues, to contribute to finding better solutions. But for us to be able to fulfil this mission, we rely on the full cooperation of all institutions. If an inquiry committee invites Member States for an exchange of views, they should respond to the invitation.

If an inquiry committee sends requests for information, we currently expect other institutions to cooperate, but can do little when they start disputing the Parliament’s competences and hiding behind their legal service’s interpretation.

Instead of a battle between legal services, we need clear rules and procedures for the implementation of the right of inquiry. This is a crucial element of a parliamentary democracy.

  Gunnar Beck (ID). – Frau Präsidentin! 1770 erschien der Essay „Thoughts on the Cause of the Present Discontents“ des britischen politischen Denkers Edmund Burke. Darin betonte er die Rolle der Parteien und des Parlaments für Gewaltenteilung und Kontrolle ungezügelter Exekutivmacht.

Das EU-Parlament billigt Gesetze, kann Kommissare befragen und entscheidet mit über den Haushalt. Es kann Untersuchungsausschüsse einsetzen und Zeugen vorladen, aber Anwesenheit oder Aussagen unter Eid nicht erzwingen. Daher fordert dieses zahnlose Parlament nun mehr Rechte und Macht. Doch Burke warnte in seinem Essay auch vor den sogenannten Königsfreunden, Parlamentariern, die die Kontrollaufgabe des Parlaments von innen her torpedieren. Das EU-Parlament hat zahllose Königsfreunde, das heißt Türsteher der wahren Machthaber, Bankenfreunde und Finanzlobbyisten, die die Wärme und Silberlinge der Macht suchen und sich als Weltretter ausgeben und Kontrollen über NGOs durch Steuer- und Geldwäscheausnahmen verweigern.

Bevor wir nun aber über das Kontrollrecht des Parlaments sprechen, sollten wir diese Rolle erst ernst nehmen. Dieses Haus ist kein Kontrollorgan im Burkeschen Sinne, sondern eine Applauskammer für handfeste wirtschaftliche Interessen und Fantasten, die unbehagliche Fragen scheut, Meinungsfreiheit beschränkt und Europa abschaffen will. Burke sagte:

‘No European can be a complete exile in any part of Europe’. We may add: ‘no true European can feel entirely at home in the European Parliament’.

  Patryk Jaki (ECR). – Pani Przewodnicząca! Panie Komisarzu! Znów chcecie Państwo więcej uprawnień. Może ta idea nawet byłaby słuszna, gdyby nie to, że przecież my bardzo dobrze wiemy, jak Państwo korzystacie z tych uprawnień, które do tej pory sobie rozszerzaliście. Nie wykorzystujecie ich wcale do poprawy bytu obywateli, do wzmacniania demokracji, dochodzenia do prawdy, ale jako pałki politycznej. Bo czymże według was jest ta praworządność, o której dzisiaj znów wspominacie? Gwałceniem Traktatów i chowaniem waszych opinii prawnych, które o tym mówią. Podważaniem wyborów demokratycznych. Bo demokracja nie wybrała tak, jak wy byście chcieli. W Polsce i na Węgrzech nie wybrali tak, jak byście chcieli, to my ich nauczymy. To my ich nauczymy, jak powinni myśleć. To typowe kolonialne myślenie. To napuszczanie jednych państw na drugie. To prawo do zabijania nienarodzonych dzieci, które jeszcze bezczelnie nazywacie prawem człowieka. To narzucanie innym, że płeć człowieka to nie jest sprawa biologii, ale sprawa wolnego wyboru. To wreszcie cenzura, represje dla wszystkich, którzy odwołują się do chrześcijańskich wartości Europy, czyli tego wszystkiego, co budowało Europę od samego początku. To wreszcie Europa, gdzie Niemcy mogą sobie robić co chcą, jeżeli chodzi o wybór sędziów, a inni nie mogą nic.

To oczywiste, że również tego narzędzia użyjecie do swojej krucjaty. Popatrzcie sobie uczciwie na tego potwora, którego stworzyliście. W tej chwili, gdyby tutaj pojawili się ojcowie-założyciele Europy, nie mogliby pełnić tutaj żadnej funkcji. Szczególnie w tych waszych komisjach, które w tej chwili tworzycie. Dlatego że mają inne poglądy od was. I nie liczcie na to, że przyjdzie dzisiaj ktoś i pomoże wam tworzyć kolejne uprawnienia, kolejne narzędzia do tego, żebyście pokazywali znów to swoje kolonialne myślenie, które oczywiście w słowach potępiacie. A potem pokazujecie, że jak jest konserwatywny rząd, jak ktoś myśli inaczej, to zabierzemy im pieniądze, to rozszerzymy swoje Traktaty, żeby pokazać im, jak jest według nas naprawdę, jak powinna wyglądać cenzura, jak powinny wyglądać represje. A dla nas, Szanowni Państwo, to wolność. A wolność to jest również uszanowanie tych, którzy mają poglądy inne od waszych.

  Anne-Sophie Pelletier (The Left). – Madame la Présidente, penser la démocratie pour les citoyens européens, c’est apporter une autre envergure à l’institution qui les représente. Colégislateur porté au rang d’influenceur, le Parlement ne peut même pas dire qu’il est bon contrôleur. Comment allons-nous donner confiance au peuple européen quand nous, parlementaires, sommes incapables d’apporter la lumière sur des zones d’ombre? Quand les citoyens européens demandent des comptes, nous leur devons des résultats à travers un travail au sein des commissions d’enquête, dont les prérogatives doivent s’inscrire dans la même logique que celles de nos parlements nationaux.

L’aide-soignante que je suis sait l’importance du rôle qui incombe à la création de commissions d’enquête, d’autant plus dans la situation tragique que nous traversons, où les responsables de certains choix doivent être entendus.

(Chers collègues, je veux bien que vous parliez, mais c’est très désagréable)

J’ai une pensée toute particulière pour les familles endeuillées par la mort de leurs anciens durant cette pandémie. Elles attendent des réponses sur les échecs de leurs gouvernants et sur la gestion, qui méritent d’être auditionnés, analysés et critiqués.

Madame, j’aimerais toucher votre cœur et porter la voix de ces deuils injustes en réitérant ma demande de commission d’enquête parlementaire co-portée par l’EPSU sur ces deuils en EHPAD. Le bruit silencieux de la mort doit résonner dans ces murs. Nous devons tirer des leçons grâce aux commissions d’enquête. Madame la ministre, donnez-nous-en les moyens.

  Jiří Pospíšil (PPE). – Paní předsedající, je to paradoxní, ale k tématu vyšetřovacího práva Evropského parlamentu vystupuji již potřetí, v roce 2017, v roce 2019 a nyní. Proč to říkám? Tyto opakované debaty jsou důkazem toho, že Evropský parlament předložil určitou možnost reformy vyšetřovacího práva Evropského parlamentu. A bohužel naši partneři, Rada, na to nijak nereagují. A v tom já vidím největší problém. V tom, že se nevede dialog mezi evropskými institucemi, a v tom, že Rada není ochotna vůbec debatovat o tom, zda je či není vhodné a možné reformovat vyšetřovací právo Evropského parlamentu.

Můžeme mít na ten problém různý názor, různý pohled, ale měli bychom debatovat. A já bych zde chtěl opětovně vyzvat Radu, aby prolomila ledy a začala s Evropským parlamentem debatovat o tom, zda vůbec a případně jak vyšetřovací právo Evropského parlamentu reformovat. Diskuse je základ demokracie a Rada se tím bohužel neřídí.

  Leszek Miller (S&D). – Pani Przewodnicząca! Dzisiejsza debata ma fundamentalne znaczenie ponieważ Parlament Europejski nie tylko stanowi prawo, ale sprawuje też funkcje kontrolne, czego przejawem są jego kompetencje śledcze.

Uważam, że należy zdecydowanie negatywnie ocenić postępowanie Rady, która pomimo wezwań ze strony Parlamentu do udziału w negocjacjach od paru już lat skutecznie odmawia dialogu legislacyjnego. Jest to tym bardziej zdumiewające, że traktat nie tylko daje Parlamentowi możliwość, co nakłada na niego wymóg określenia w rozporządzeniu szczegółowych zasad wykonywania uprawnień śledczych. W tym kontekście blokowanie przez Radę negocjacji w sprawie aktu prawnego, który Parlament musi przyjąć, jest nieuzasadnione, świadczy o obstrukcji i zwykłej arogancji. Rada Unii powinna pamiętać, że choć nie odpowiada politycznie przed Parlamentem, to jest związana traktatową zasadą lojalnej współpracy i z tego powodu powinna natychmiast zaprzestać ignorowania prawnie uzasadnionych oczekiwań Parlamentu Europejskiego.

Liczę, że pryncypialne zapowiedzi, które padły w dzisiejszej debacie, zostaną niezwłocznie wcielone w życie i wywołają nie tylko kolejne słowa, a oczekiwane działania.

  Jadwiga Wiśniewska (ECR). – Pani Przewodnicząca! Panie Komisarzu! Szanowni Państwo! Do czego właściwie dzisiaj sprowadza się nasza debata? Do konieczności postawienia pytania, jakiej Unii Europejskiej chcemy? Bo te dyskusje tak naprawdę wskazują na to, że większa część Parlamentu chciałaby Unii Europejskiej jako federalistycznego związku państw. A może chcecie państwo takiego jednomyślnego związku jakim był Związek Sowiecki? Jedna myśl, jedna rada, jeden sposób widzenia świata.

Państwa tolerancja kończy się tam, gdzie zaczynają się poglądy innych ludzi. Kiedy dla mnie aborcja jest zabiciem człowieka, dla państwa jest prawem obywatelskim. Pani się oburza? Pani jest wzburzona? Nie dziwię się. Jeśli nie będziemy się różnić i jeśli nie będziemy zjednoczeni w różnorodności, to Unia Europejska naprawdę będzie zmierzała donikąd. Jakiej Unii Europejskiej chcemy? Unii wartości i zasad. Jeśli wiceprzewodnicząca Parlamentu Europejskiego mówi, że państwa członkowskie, których rządy jej się nie podobają, należy zagłodzić, to państwo stosują dyktaturę.

  Juan Fernando López Aguilar (S&D). – Señora presidenta, este Parlamento Europeo es la única institución directamente elegida de la arquitectura de la Unión y, en el curso de su historia, su fuerza como motor de legitimación democrática no ha hecho sino crecer.

Ahora se ha puesto en marcha la Conferencia sobre el Futuro de Europa: bottom-up, propuestas de los ciudadanos de abajo hacia arriba. ¿Es que alguien puede pensar que no va a surgir como una demanda de la ciudadanía que este Parlamento complete sus poderes de control sobre el brazo ejecutivo de la Unión que componen el Consejo y la Comisión?

¿Es que alguien puede pensar que no se va a exigir que haya un question time, un control parlamentario ordinario, y un poder de investigación que dé plena eficacia a lo previsto en el artículo 226 del Tratado de Funcionamiento de la Unión Europea?

¿Es que creen que alguien va a entender que eso no se haga realidad porque se oponen precisamente las dos instituciones que tienen que ser controladas por el Parlamento Europeo?

La respuesta no puede ser de ninguna manera ni el silencio ni el bloqueo. Por eso, es absolutamente imprescindible acometer esta maduración del control parlamentario ordinario que todo Parlamento ejerce sobre el Ejecutivo —Comisión, Consejo— y, por supuesto, una regulación eficaz —ya va siendo hora— de las comisiones de investigación del Parlamento Europeo.

  Nicolas Schmit, Member of the Commission. – Madam President, I would first like to thank all of you for your comments and remarks. Let me reiterate again that the Commission attaches great importance to Parliament’s role of scrutiny and political control, of which the ultimate aim is to guarantee that citizens’ concerns regarding the implementation of Union law are properly addressed. The Commission therefore fully acknowledges the need to have an adequate scrutiny instrument, and as I mentioned already, the 2018 non-paper represents progress compared to earlier proposals, but it still raises a number of legal and institutional concerns, which need to be addressed.

The Commission reiterates its commitment for constructive engagement in trilateral discussions in order to clarify all remaining points of concern before being able to give its agreement. We hope that progress can be made soon on this politically sensitive but, as this debate shows, very important file.

Senhora Presidente, Senhor Comissário, senhoras e senhores Deputados, estes debates são importantes para o nosso relacionamento interinstitucional. Este não é um assunto fácil, está connosco há muitos anos e, por isso, é importante ter um debate num registo de abertura e de franqueza, como tivemos hoje aqui, que permite clarificar as posições das três instituições sobre um tema tão relevante.

Sabemos todos como democratas quão importante é o escrutínio parlamentar. Mas a proposta que temos sobre a mesa não é neste momento aceitável para o Conselho. Tal como referi no início, quero reafirmar a vontade e o empenho do Conselho em dialogar com o Parlamento Europeu. Consideramos ser do nosso interesse comum ter regras claras e atualizadas que regulem o exercício do direito de inquérito do Parlamento Europeu para que todos os intervenientes saibam exatamente quais são os seus direitos e as suas obrigações.

Foi esta a mensagem que transferi, hoje mesmo, num espírito de leal colaboração ao relator Domènec Ruiz Devesa, a quem muito agradeço.

  László Trócsányi (NI), írásban. – A vizsgálati jog reformja kapcsán annak valódi okát kell feltárni, hogy valójában miért nem működik megfelelően ez a jogintézmény. Az újabb és újabb hatáskörök követelése nem oldja meg a problémát. Egyetértek annak fontosságával, hogy a hatalmi ágak elválasztásának elve kiemelten fontos a vizsgálati jog szabályozásának terén is. Explicit módon szükséges rögzíteni a tagállami alkotmányos normák által is elismert követelményt, miszerint parlamenti vizsgálóbizottság nem állítható fel olyan ügyben, amelyben bírósági eljárás is folyik. Csak így lehet megőrizni a bírósági eljárások pártatlanságát, politikától való mentességét. Ugyanakkor az Európai Parlament egy társjogalkotó szerv, az Unió sajátos entitás, így annak sajátos természetére, intézményi egyensúlyára tekintettel kell lenni. Önmagában új, eljárási természetű normák elfogadásával nem válik hatékonyabbá a visszásságok feltárása. Fontos kérdés, hogy egy esetleges reform mennyiben érintené a tagállami parlamentek jogosítványait. A párhuzamos struktúrák felállítása nemcsak költséges, mellőzi a hatékonyságot, de akár a jogbiztonságot is alááshatja. A tagállami hatóságok vizsgálatára valamennyi tagállam parlamenti vizsgálóbizottságai jogosultak, míg az európai közéletet terhelő, az uniós intézményekben történt visszásságok kivizsgálására legközelebbi rálátással a hatáskörrel rendelkező uniós intézmények bírnak. Az olyan eljárások hatékonyságának növelését érdemes ezért ösztönözni, amelyben az Unió végrehajtó jogosítványokat gyakorló szerveinek eljárásai során elkövetett visszásságokat lehetne feltárni, amelyekre más módon nehéz fényt deríteni.
