  Paulo Rangel, Relator. – Senhora Presidente, Senhora Comissária, Schengen é, como acabamos de ver, a joia da coroa da integração europeia. Mas esta liberdade que nós partilhamos vai requerer sempre segurança partilhada. Este equilíbrio entre a liberdade e a segurança só é possível se nós tivermos à nossa disposição uma rede complexa de instrumentos, muitas vezes invisível, pelo dia a dia dos Europeus.

O sistema de vistos da União Europeia - em inglês Visa Information System - está no centro desta rede. Ele é o exemplo mais acabado da simbiose entre o nível europeu e o nível nacional presente em todos os consulados europeus de todo o globo e em todas as fronteiras externas, sem exceção, do espaço Schengen.

Atualmente o VIS é já responsável pela emissão de milhões de vistos àqueles que nos visitam, garantindo com o seu código de vistos que todos os turistas estão sujeitos a regras iguais. Nos últimos anos temos vindo a trabalhar naquela que vai ser a maior reforma desde a sua criação. São alterações enormes que transformam o VIS numa ferramenta mais eficaz, mais útil, mais fácil para as polícias, guardas de fronteira, autoridades de asilo e consulados.

Começamos por mudar o próprio paradigma de sistema. Não são apenas os turistas que beneficiam da livre circulação, passam também a ser os nacionais de países terceiros que cá vivem, estudam, trabalham, ou que se encontram no nosso território de forma mais ou menos prolongada. Por isso era necessário, era até natural, que todos os turistas e residentes pudessem ser sujeitos ao crivo comum do VIS. É o que fazemos. Este sistema será aplicável a todos, incluindo aos chamados “titulares de vistos Gold”.

Com esta mudança garantimos maior segurança, razão pela qual alargamos também os sistemas aos consulados. Todos os sistemas consultados, todos os sistemas de informação da União Europeia serão consultados, sem qualquer exceção, assegurando um controlo antes mesmo da entrada no território e dedicamos um enorme esforço à proteção das crianças, à proteção dos menores. Todos os anos, na Europa, estima-se que mais de 250 mil crianças - repito, 250 mil - são desaparecidas.

Podemos e devemos fazer mais para prevenir e combater este fenômeno trágico. O VIS traz novas funcionalidades, recolhendo dados biométricos de todas as crianças e jovens que podem ser usados nas fronteiras ou, em caso de desaparecimento, podem ser usados pelas polícias.

Senhora Presidente, Senhora Comissária, foram centenas, repito, centenas de horas para negociar este dossiê complicado. O apoio e o empenho da Comissão Europeia foi essencial para este desfecho e quero agradecer em especial à Comissária Ylva Johansson por isso.

Destaco também a Presidência alemã, que fez um trabalho hercúleo e que permitiu encontrar um acordo em dezembro de 2020. Finalmente, uma palavra de muito apreço e de agradecimento aos meus colegas relatores-sombra cuja colaboração, orientação, apoio e também paciência, foram determinantes para que, enquanto relator, pudéssemos atingir o resultado que espero amanhã será aprovado nesta câmara. E claro agradecer a todos os nossos colaboradores, a todos aqueles que connosco trabalham nos serviços do Parlamento, da Comissão, do Conselho, nos nossos gabinetes, porque sem eles uma tarefa desta complexidade técnica e com esta profundidade política não seria possível.

Creio que a partir de amanhã estaremos todos de parabéns fornecendo um melhor serviço aos europeus e a todos aqueles que têm que entrar em território europeu.

  Ylva Johansson, Member of the Commission. – Madam President, honourable Members, I would warmly thank Mr Rangel, your rapporteur, but also the shadow rapporteurs for your relentless efforts and your determination to conclude the negotiations on the upgrade of the Visa Information System, as well as, of course, the Council – the German Presidency.

This is a major and timely achievement that strikes the right balance between facilitating legal travel towards the European Union, improving border management and enhancing internal security. In normal times, millions of visas are issue to non-EU nationals, a sign of Europe’s attractiveness for business, tourism and studies. In 2019, 15 million short-stay visas were issued.

The Visa Information System will be a key tool to facilitate legal travel to the EU. Firstly, it will benefit travellers and contribute to smooth border checks. For instance, biometric matching at the border to verify the identity of the traveller means foster identity checks. Secondly, the visa application procedures for Member States’ authorities will be facilitated and more secured. Applications for visas will be screened against all relevant EU information systems and Interpol databases. Thirdly, the upgraded Visa Information System will strengthen checks at external border-crossing points and within the territory of the Member States, because border guards will have better access to more information.

At the same time, the revised system will contain robust data protection safeguards. Asylum and law enforcement authorities will only get access to the Visa Information System data where needed. It will be possible to use biometric data for children to fight against child trafficking under specific safeguards. The upgraded Visa Information System will help complete the EU border management system and interoperability framework, making the Schengen Area a more secure place for our citizens. It’s an important contribution to the goal that all new and upgraded information systems will be operational and fully interoperable by the end of 2023. The Commission will closely support the implementation process to ensure that this will enter into application by the end of 2023.

Looking ahead, I can already inform you that the next step to further modernise our visa policy is in preparation. By the end of this year, the Commission will come with a proposal on digitalisation of visa procedures, which will introduce simplification for the benefit of Member States’ consulates and third-country nationals, improve the security of the Schengen Area and increase the attractiveness of the EU as a travel destination. I therefore look forward to continuing to work with all of you in this upcoming proposal.

  Juan Fernando López Aguilar, en nombre del Grupo S&D. – Señora presidenta, comisaria Johansson, esta misma noche hemos debatido aquí el estado del Código de Fronteras Schengen y de la gobernanza de Schengen, que tiene como corolario un Sistema de Información Schengen, que es también Derecho europeo legislado. Y ahora debatimos el estado del sistema europeo de visados, legislado igualmente desde este Parlamento Europeo por un Reglamento que establece un Código Europeo de Visados, del que fui ponente en la pasada legislatura, y que tiene como corolario un Sistema de Información de Visados que debe hacerse interoperable.

Ese fue el mandato del Parlamento Europeo, no solamente con el Sistema de Información Schengen, sino también con SEIAV, entradas y salidas y ECRIS antecedentes penales. En eso consiste la interoperabilidad. Pero es un enorme avance que este Parlamento vaya a votar por fin el acuerdo en segunda lectura entre el Parlamento Europeo y el Consejo para que entre en vigor esta visión reforzada del Sistema Europeo de Visados, que da mayores garantías de seguridad, de comunicación con los consulados de todos los Estados miembros de la Unión Europea, de identificación de las personas que entran en la Unión Europea para estancias de corta duración. Y todo ello en compatibilidad con el estándar europeo de protección de datos, que ⸺reitero⸺ es el más alto del mundo y estamos orgullosos de ello.

Pero tocará ahora también a los Estados miembros asegurar la correcta ejecución de este Código Europeo de Visados y las inversiones que serán necesarias para ello. La agencia europea eu-LISA, la de sistemas informáticos de gran magnitud, que hemos establecido para hacerlos interoperables, ha estimado en 182 millones de euros el total de inversiones que será necesario para garantizar la ejecución de esa interoperabilidad, con al menos dos millones de euros en lo inmediato, entre 2021 y 2023, exactamente para la implantación de este Código Europeo de Visados y del Sistema de Información de Visados.

Tenemos que celebrar que hayamos conseguido ese acuerdo entre el Consejo y el Parlamento Europeo que completa un programa legislativo que arrancó en la pasada legislatura y que tiene esta noche, en este debate y mañana en la votación, un jalón muy importante.

Wizowy System Informacyjny musi być i jest odpowiedzią na zmieniające się wyzwania w dziedzinie migracji i bezpieczeństwa Unii Europejskiej, ale jednym z najważniejszych aspektów w ramach współpracy pomiędzy państwami członkowskimi w ramach tego systemu musi być zaufanie. Moje doświadczenie, jako byłego ministra spraw wewnętrznych i administracji, wskazuje, że bywa z tym różnie. Mam w pamięci rozmowy z moimi koleżankami, kolegami ministrami spraw wewnętrznych, kiedy wymieniliśmy uwagi na temat podważania decyzji podejmowanych przez służby (służby zajmujące się zwalczaniem terroryzmu, zwalczaniem prania brudnych pieniędzy) i były sytuacje, gdzie inne państwa członkowskie podważały decyzje podjęte w ramach Systemu Informacyjnego Schengen. Nawet to miejsce, Parlament Europejski, było świadkiem wydarzenia, gdzie fetowano takie osoby, które przez służby innego państwa były podejrzewane o działania przestępcze.

Nie może być sytuacji hipotetycznej, gdzie handlarz bronią, handlarz narkotykami pod przykryciem działalności w NGO lub działalności filantropijnej będzie mógł cieszyć się zaufaniem innego państwa członkowskiego. Służby wiedzą, co robią. Jesteśmy wspólnotą, która powinna opierać się na zaufaniu. Policja, służby specjalne naprawdę wiedzą, co robią.

  Clare Daly, on behalf of The Left Group. – Madam President, for years I think the EU’s policies towards migration have rested on the assumption that every person who wants to come here from outside is a potential threat: highly skilled workers, babies, children washed up dead on Europe’s Mediterranean shores. And sadly, the same logic applies to the revision of the Visa Information System. There’s actually no rational justification for this. Europol says there are no signs of systemic use of illegal migration by terrorist organisations. There’s zero evidence that people using things like work and tourist visas to come here are any more dangerous than the people who already live here.

The mania for making every migrant an object of suspicion is really no more logical or rational than the medieval assumption that if a woman was tied to a chair and thrown into a pond and she sank, she was a witch. No more logical, but actually the same type of evil prejudice. And there may be people in here who are happy to bring in a policy based on the type of logic that would make a Witchfinder General proud. But I’m not interested in witch hunts, and we won’t be voting for this resolution.

  Ylva Johansson, Member of the Commission. – Madam President, the vote tomorrow on the reform of the Visa Information System will conclude the legislative process which started more than three years ago, and I think it’s a great achievement.

The negotiations were not always easy and they were complicated, but they were conducted in a very cooperative manner thanks to the constructive attitude of you, Paulo Rangel, the rapporteur, but also as well to the Finnish, Croatian and German presidencies. I also thank the Portuguese Presidency for bringing this process forward.

Border checks will be smoother for travellers and the EU borders will be more secure.
