On 24 June 2025, the MEP Axel Voss presented a draft own-initiative report of the Committee on Legal Affairs entitled ‘Copyright and generative artificial intelligence – opportunities and challenges’[1]. This draft report seems to question the established basis for the ongoing training of AI models in Europe. Referencing Directive (EU) 2019/790 on copyright and related rights in the digital single market[2], it states that ‘Article 4 was neither drafted nor intended to regulate the specific practices involved in AI training’. This question has been tackled previously by the Commission.
The report also calls for significant intervention in the AI creation ecosystem, in particular by setting unprecedented fees for AI developers that would benefit the publishing industry.
- 1.Can the Commission in this current mandate reaffirm its position that Article 4 (and its sister provision Article 3) provides a sound legal basis for AI training, as confirmed previously by Commissioner Breton?
- 2.Does the Commission plan to reopen these provisions during this term and introduce other, more stringent, rules for AI development in the EU?
- 3.Is the Commission taking any steps to ensure that the creation of AI models, and not just their use, can continue in Europe, especially through the establishment of a legal framework that is competitive with other jurisdictions such as the US, China, Japan or Singapore?
