1. The Commission is aware of its reply to Written Question E‑5814/2011[1].

2 and 3. The Commission must take action when there is evidence that EU funding has not been used for the intended purposes and without following the EU financial rules. However, the Commission cannot financially sanction a Member State in relation to issues where the EU has no legal competence.
