Directive 86/609/EEC, on the protection of animals used for experimental and other scientific purposes[1] will be repealed by Directive 2010/63/EU taking effect from 1 January 2013.
The Commission has no information on the Green Hill breeding centre case referred to by the Honourable Member.
Article 15 of Directive 86/609/EEC provides that all breeding and supplying establishments shall be approved by or registered with the relevant national authority. In relation to breeding, the directive further describes a number of other obligations concerning the personnel, care, treatment and identification of the animals as well as guidance as to their housing. However, Directive 86/609/EEC does not oblige national authorities to close down establishments found to be in breach of its Articles 17 and 18. It is for the competent national authorities to enforce any such obligation foreseen by their national legislation.
Directive 86/609/EEC foresees no Food and Veterinary Office controls in the area of laboratory animal welfare.
The Commission does not possess information on the number of dog breeding centres in the EU. The national authorities competent for this directive are responsible for enforcing EC law in their respective territories and thus controlling the correct application and compliance of the provisions of the directive.
