Introduction of statutory minimum wage for work carried out in Germany

On 1 January 2015, Germany will be introducing a statutory minimum wage of EUR 8.50 per hour (gross). This will apply to any employee carrying out work in Germany. For the transport sector, however, this regulation will apply not only to cabotage, but also to any international transport entering, leaving or crossing through Germany. Both the employer and the customer can be fined up to EUR 500 000 for failing to comply with the minimum wage regulation.

This law has also given rise to a number of concerns and questions on the part of international transport companies. It is still not clear how the German customs authority will check whether international employers are complying with the legislation. There are also a large number of practical issues relating to the pre-arrival notification and how to register. Introduction of the regulation also entails a heavy administrative burden.

If so, does the Commission believe that it is contrary to the principle of the free movement of goods and services within Europe?
