Breach of EU anti-discrimination law

Following the discrimination enacted by Slovakia towards Roma children in education, the Commission’s decision to initiate infringement proceedings for breaching EU anti-discrimination legislation has been applauded by NGOs and civil society.

With regards to the infringement proceedings, pursuant to Article 258 of the Treaty on the Functioning of the European Union the Commission may use this instrument to ensure compliance with EC law. The same article states that if the Commission believes that a Member State is in breach of EC law and that the Member State has not taken measures to address the concerns in question, it may bring the matter before the Court of Justice of the European Union.

If Slovakia does not comply with EU legislation, does the Commission intend to take Slovakia to the Court of Justice of the European Union?

Furthermore, does the Commission seek to take action against other Member States that breach the EU’s race equality directive?
