Prohibition of blood donation

The European Court of Human Rights has handed down a judgment whereby countries may, permanently or temporarily, prohibit homosexuals, that is to say, homosexual men, from voluntarily giving blood, the reasoning being that their behaviour and activities could make them more likely to contract infectious diseases transmissible by blood.

While allowing for the fact that every county has a right and a duty to protect recipients of donated blood from risk as far as possible, does the Commission believe this decision to be mistaken and discriminatory?

Does the Commission consider it justified to ban blood donation purely on the basis of a person’s sexual orientation, as opposed to actual assessment of sexual behaviour, since the implication is that all homosexual men are prone to risky and free sexual behaviour and that persons with a heterosexual orientation are less inclined to such behaviour and hence a lower-risk group?
