E-014611/2015(ASW)
Answer given by Ms Thyssen on behalf of the Commission
Question reference: E-014611/2015

The Commission kindly refers the Honourable Members to written answer E-007664/2015.

It is for the competent national authorities, including the labour inspectorates and the national courts, to ensure that the national legislation transposing the EU Directives relating to workers' information and consultation(1) is correctly and effectively applied by the Member States and the employer concerned, having regard to the specific circumstances of the case.

The Commission urges companies to follow good practice in anticipating and managing restructuring in a socially responsible way, as it outlined in its communication of 13 December 2013 establishing an EU Quality Framework for Anticipation of Change and Restructuring(2).

(1)In particular, Directives 2002/14/EC and 98/59/EC.
(2)COM(2013)0882 final.
