 Subject:  Compatibility of Polish anti-terrorism law with EC law and human rights standards
 Answer in writing 

On 21 April 2016, the Polish Government published a new draft anti-terrorism law, which is currently under discussion before the Polish parliament. According to several NGOs, the measures envisaged in that law are inconsistent with the Polish Constitution and with the human rights standards enshrined in the European Convention on Human Rights. Inter alia, its provisions would be in breach of the principle of equality and non-discrimination, the right to freedom, freedom of assembly, freedom of speech and communication, rules on the protection of personal data, and the presumption of innocence. Back on 13 January 2016, the Commission started a structured dialogue with the Polish Government under the Rule of Law Framework, and on 1 June 2016 it adopted a Rule of Law Opinion expressing concern about the constitutional situation arising from amendments to the Law on the Constitutional Tribunal of 22 December 2015.

— Does the Commission consider the new anti-terrorism law to be compatible with the provisions of EC law, the EU Charter of Fundamental Rights and the case law of the Court of Justice?

— Does the Commission intend to incorporate the issue of the anti-terrorism law into the Rule of Law procedure initiated in respect of the Polish Government?
