Derogation because of avian influenza

to the Commission
Rule 130
Miguel Viegas (GUE/NGL)
The avian influenza (H5N8) epidemic seems far from under control, with 20 Member States now affected. As a consequence of the health restrictions resulting from the epidemic, it is calculated that some 80% of free-range laying hens are currently shut indoors.
EU rules lay down that free-range eggs can be produced by hens shut indoors for periods not exceeding 12 weeks. Consequently, thousands of farmers are currently staring down the barrel of significant losses, as they risk their eggs losing their free-range classification and being sold as barn-reared instead.
What is the state of play with the epidemiological dynamics of avian influenza? Will the Commission create a derogation from the regulations to protect free-range poultry farmers in these specific situations? Lastly, are the main egg-product importers complying with the principle of regionalisation?
