E-003808/2018(ASW)
Answer given by Ms Thyssen on behalf of the European Commission
Question reference: E-003808/2018

Directive 2018/957/EU amending Directive 96/71/EC concerning the posting of workers in the framework of the provision of services(1) was adopted on 28 June 2018. The directive's date of entry into force is 30 July 2018; the deadline for transposition for the Member States is 30 July 2020 and they have to apply the transposition measures from 30 July 2020.

Therefore, the national legislation transposing the directive will be applicable from 30 July 2020 to contracts in progress as well as to new contracts. The obligation to pay remuneration instead of minimum rates of pay will also be applicable from that date to contracts in progress as well as to new contracts.

When it comes to the calculation of the period of long term posting i.e. the 12 months, this will also apply to contracts in progress and the starting time would be the beginning of the posting assignment i.e. retrospectively.
