Mr Krueger submitted a request for outside activity while on leave on personal grounds in April 2018. The related Appointing Authority decision, which was issued on the same month, was analysed under the Staff Regulations as well as under the Commission decision of 16 December 2013(1) which was applicable at that time.

The outcome of the assessment would not have been substantially different under the new Decision which was adopted on 29 June 2018(2).

Following the consultation process required for this type of request, the Appointing Authority gave its approval to carry out this activity, under certain conditions aimed at preventing any potential conflict of interest. Mr Krueger was reminded of all the relevant Staff Regulations’ obligations, notably the prohibition to engage in any activity or role which involves lobbying or advocacy vis-à-vis staff of the Commission and which could lead to the existence or possibility of a conflict with the legitimate interests of the Institution.

He was also requested not to deal in any way with files and matters directly linked to his work at the Commission and not to participate in meetings or have contacts of professional nature with his former Directorate General or service for a period of one year. Mr Krueger has also to immediately report to his Appointing Authority any actual, potential or perceived conflict of interests that may arise.
