Following the call[1] of the European Parliament to prepare legislation to ensure fair access to in-vehicle data and resources, the Commission committed in its communication of 17 May 2018[2] to update its legislation on access to in-vehicle repair and maintenance information (RMI) taking into account RMI services provided by wireless connection, as well as to study further policy options to ensure a fair access to in-vehicle services beyond repair and maintenance.

To prepare this action, the Commission held, throughout 2019, discussions with stakeholders within a dedicated expert group covering notably the issues of cybersecurity, safety considerations and data protection.

Subsequently, in the first half of the year, the Commission plans to examine different policy and regulatory options by means of a dedicated analysis. In particular, it will look at how to ensure secure access, an effective competition, the consumer’s choice and privacy, in compliance with the EU Data Protection and Intellectual Property Rights legislation as well as competition law. It will also look into the forthcoming European Data Protection Board guidelines on connected vehicles[3].

Testing and pre-deployment of access to data and cybersecurity solutions are being discussed within the EU platform on connected and automated mobility.

The question of access to data is expected to come within the scope of the Commission’s European Strategy for Data.

As concerns cybersecurity, the recently adopted EU Motor Vehicle General Safety Regulation[4] requires the Commission to put in place measures against cyberattacks. The Commission is working on the implementation of these requirements, including the work on a motor vehicles cyber-security regulation[5] in the United Nations Economic Committee for Europe.
