 Subject: Dual quality of products

The Commission has earmarked EUR 1 million for developing a common testing methodology for the dual quality of products. In January 2019, the Joint Research Centre (JRC) once again concluded that dual quality of products is in fact a fairly common practice in the EU. More specifically, in 9 % of cases, products presented as being the same in the EU had identical packaging but a different composition. In 22 % of the cases studied, products had similar packaging but a different composition. The unfair commercial practices directive has been revised and now includes a test, whereby products should be scrutinised on a case-by-case basis. The relevant companies accept that this is the current state of affairs. However, they explain the situation by pointing to differing consumer preferences across the EU. This is unsatisfactory and further steps must be taken to address the dual quality of products. This should apply not only to food products, but to all products across all categories of goods. There are no second class citizens in the EU.

Is the Commission prepared to revise the unfair commercial practices directive in order to broaden its scope?

Is the Commission satisfied with the justification that the different composition of products that use the same packaging is due to differing commercial practices?
