Amendment to Regulation (EC) No 1107/2006 concerning the rights of disabled persons and persons with reduced mobility when travelling by air

The Spanish committee of representatives of people with disabilities (CERMI) has reported that Regulation (EC) No 1107/2006 concerning the rights of disabled persons and persons with reduced mobility when travelling by air is discriminatory.

Specifically, it has indicated at least three points that need to be changed on the grounds that they limit the right to mobility of disabled passengers:

passengers with disabilities should not be denied boarding for reasons of safety and at the discretion of the airline;

passengers with disabilities should not be required to be accompanied by another person, since it restricts freedom of movement;

damage or loss to support products, such as wheelchairs and walkers, should be compensated at the actual value of these items, and, moreover, these items should not be regarded as mere luggage.

The Commission initiated the process of evaluation of Regulation (EC) No 1107/2006 in 2019 and is expected to begin a public consultation on a revision of this Regulation in 2020. In view of the above, the Commission is asked:

How does it intend to guarantee the fundamental right to freedom of movement for people with disabilities in the new Regulation?
