Following illegal practices in previous years leading to a number of court rulings against it and the subsequent conclusion of an agreement with its workers on 1 January 2018, the administration of the Greek Fertilisers and Chemicals ELFE SA has, since December 2019, once more been refusing to comply with the terms thereof at the workplace. It is obliging its workers to enter into new individual fixed-term contracts or accept postings to another company that is apparently taking over some of its production activities.
The company is thus in breach of the fundamental provisions of EU law regarding the protection of employees’ rights in the event of transfer of an undertaking or a part thereof and preventing the abuse of fixed-term contracts.
By obliging its workers to enter into new individual fixed-term contracts or accept postings to another company, ELFE is in breach of the Seveso Directive aimed at the prevention of major accidents involving dangerous substances and the limitation of their consequences for man and environment.
In view of this:
- 1.What action is the Commission taking in response to this infringement of EU law in order to uphold the fundamental rights of workers?
- 2.What measures will it take to prevent any breach of the Seveso Directive by ELFE, which is placing at risk the life and safety of workers and the environment, and to provide effective protection within the EU?
