Implementation of Proportionality Directive in Germany

Does the Commission consider that Article 4 of the German ‘draft law implementing the Proportionality Directive (Directive (EU) 2018/958) in respect of public corporations’  [1] is essential to ensure that Germany implements the directive in compliance with EU law, or could this be achieved without the article in question?
