 Subject: Possible violation of the European Convention on Human Rights and the Charter of Fundamental Rights of the European Union in Spain

The Spanish media has published information based on Spanish National Court ( Audiencia Nacional ) sources (1) which reveals that the Court has granted an authorisation to extend all surveillance measures in every court case under its jurisdiction, using the current state of emergency approved on 14 March as a pretext.

These surveillance measures include (but are not limited to) wiretapping and bugging not only of people under criminal investigation, but also of others related to those under investigation or accidentally connected with them. These measures affect several thousand citizens, and have been authorised without proper judicial review and with no regard or reference to the principles of necessity or proportionality.

This measure was adopted without due process, and constitutes a clear violation of the rights enshrined in Article 8 of the European Convention on Human Rights (ECHR), as well as a violation of Articles 7 and 8 of the Charter of Fundamental Rights of the European Union, and quite possibly of Article 52.

1. Does the Commission believe that these measures comply with Articles 7, 8 and 52 of the Charter of Fundamental Rights?

2. Will the Commission take this into account in its annual report on the rule of law?
