 Subject: VAT e-commerce package

On 8 May, the Commission decided to postpone the entry into force of the VAT e-commerce package, which will see the current VAT de minimis arrangement removed on 1 July 2021. The COVID-19 crisis was cited as the reason for this delay, although concerns about Member States’ readiness had already been raised prior to the current situation.

The delay will postpone the introduction of critical systems designed to ensure a level playing field for European e-retailers competing with foreign merchants and to secure the safety of products imported by European citizens.

It will also have an impact on VAT import compliance. Fraudulent imports of small consignments account for more than EUR 1 billion in public income losses. Meanwhile, foreign traders continue to engage in non-compliant import practices relating to valuation and VAT deferment for e-commerce, resulting in unfair competition for European e-retailers.

1. When can we expect a Commission plan on the VAT de minimis measures that sets out customs and VAT readiness by Member State?

2. When can we expect a revision of the current legislation to make registration in the Import One Stop Shop system mandatory and exert greater control over foreign traders?

3. What steps is the Commission taking to stop the fraudulent use of VAT deferment schemes concerning foreign e-commerce imports?
